Applauding BATC Members GIVING BACK Often, I spend time in this column sharing news of BATC’s substantial advocacy efforts on behalf of the home building industry. Those efforts continue to grow—you can read about them in our Association’s 2015 annual report and in our weekly e-newsletter to members, The Voice. But as we approach the holiday season (I’m writing this in December), it seems appropriate to share news of one of BATC’s key efforts with a very different focus – the BATC Foundation. Our charitable Foundation is celebrating 20 years, and in the past few years we’ve seen dramatic enhancement in its sophistication, operations and projects. For example, in November, as we all expressed gratitude at our Thanksgiving tables for the blessings we enjoy, our Foundation turned over the keys to a newly built 2,700 square foot house in Ramsey to Army SPC Marco Solt, his wife, Gena and son, Devin. Built by build-partner Accent Homes (Thank You), with incredible donations from so many of our member companies, this home contains dozens of unique features to accommodate Marco’s disabilities. A huge array of dignitaries were on hand at the key ceremony, including US Senators Amy Klobuchar and Al Franken, the Mayor of Ramsey, state legislator Abigail Whelan and more. Why is our Foundation important? Foremost, it’s noble and inspiring to do good deeds for others. The world faces so many challenges, and it brings us joy and honor

to be humble contributors to making the world a better place. The new generation of workers places great value on community engagement. Efforts by our Foundation are part of a larger workforce development effort by BATC to attract our future employees. Existing employees feel pretty good too. Research indicates workers at companies with a cause are far more satisfied and much more likely to stay. Additionally, the work of our Foundation highlights the great work that our builders and remodelers perform every day in communities across the Twin Cities. By casting the spotlight on giving back, we illuminate our industry under a halo that has value with regulators, legislators, city officials, the media and other key audiences. So as we approach 2016, know that BATC will continue to drive toward its mission of helping our member businesses grow through marketing, advocacy and industry connections. And we’ll continue to enhance our charitable efforts, bringing joy to the recipients of our work and pride to our industry. a word from our president

Let’s Make 2016 a Year Filled With Success! I am excited and honored to begin my term as your BATC President. I want to thank you for putting your trust in me to serve this organization and this industry, and I promise to do so to the best of my ability. I also want to thank Chris Contreras, our 2015 President for leading us through some difficult decisions over the past year. I know we are stronger today than we were a year ago, and I certainly hope to leave BATC even healthier at the end of 2016. As a small-volume builder, I truly understand the issues many of you face in today’s evolving marketplace. I’m a firm believer that organizations like BATC are our first line of defense to help our businesses remain successful. My own experience bears that out, as the more time and energy I’ve put into our association, the more benefit I’ve seen. That’s why I’ve put membership growth and enhancement as a primary focus for the coming year. I’ll be working with our new membership committee chair, Jill Murphy, to make sure BATC is prepared to welcome and nurture our newest members. As we move into what looks like a rather heated election cycle this fall, BATC will be working hard to elect housing advocates to the state legislature. Politics isn’t exactly my thing, so I’m really looking forward to watching what our amazing team (volunteers, consultants and staff) can accomplish, and plan on learning a lot. Related to our electoral efforts, and much more in my wheelhouse will be our industry communications work. In addition to strengthening our “New and Newly Remodeled Homes Make Your Life Better” campaign, we’ll be finding ways to show consumers that they can put their trust in BATC builders and remodelers. Our goal is to continually elevate the new home and remodeling industry in the eyes of consumers, legislators and

governmental officials, and the press — as an important contributor to the general economy, as a place with great home-grown job opportunities, and as providers of homes that are superior in every way. As I look to the year ahead, I am fully aware that we still face plenty of challenges. Our relationship with the Builders Association of Minnesota remains unresolved. As of this writing, the State Supreme Court has yet to decide if it will take on the Sprinkler appeal. And a flat 2015 has left many of us wondering what the housing market will do in 2016. But there are bright spots too, beginning with our January Launch Party. I’m looking forward to being officially sworn in and hearing the economic forecast from Dr. Dietz, NAHB’s senior economist. The Spring Parade of Homes and Remodelers Showcase look promising (both from the number of entries and as a way to excite consumers about buying or remodeling this year). I’m hoping to see all of you at our Builder Day at the Capitol in March, and of course, the Builders and Remodelers Show (BRS) in April should be a huge success. And that’s just the beginning. Again, thank you for giving me this opportunity to lead our association in the year ahead. Please feel free to contact me if you have any questions, comments or suggestions. The Whole Home New Construction Program is now offering cash rebates! CenterPoint Energy’s premier new home program is now offering cash rebates for top performing new homes. The Whole Home New Construction program, delivered by Residential Science Resources, will continue to offer building science consulting funded 100% by CenterPoint Energy. However, now builders can earn rebates starting at $250 for homes that exceed the requirements of the new energy code.

All participating homes continue to receive: • Site visits at framing, insulation, and final stages • Descriptive site visit reports • Expert building science consulting from RSR

To qualify for a Whole Home rebate, the home must: • Complete the program • Be permitted under the new energy code (effective 2/14/2015) • Include natural gas heating and water heating equipment • Achieve natural gas energy savings of 20% or more above code requirements

Rebate levels for qualifying homes: • 20% natural gas energy savings: $250 rebate • 30% natural gas energy savings: $500 rebate - Plus $50 for each 1% in savings above 30% • 40% natural gas energy savings: $2000 rebate - Plus $100 for each 1% in savings above 40% Maximum rebate for a participating home will be $5000.

BATC Scores Big Victory in Fighting the Code, but the Effort Continues Court Declares Sprinkler Mandate Invalid BATC filed a petition to the Minnesota Court of Appeals earlier this year to argue that the sprinkler rule exceeded the rulemaking authority granted under Minnesota law. In a huge win for our members, the Minnesota Court of Appeals released its major decision in mid-October in the Builders Association of the Twin Cities (BATC) v. Department of Labor and Industry (DLI) case regarding the appropriateness of the sprinkler mandate. The court ruled, “DLI failed to establish a record supporting the 4,500 sq. ft. threshold for sprinklers as required by Minnesota law invalidating the sprinkler mandate.” Unfortunately the work does not end there. Despite the unanimous

ruling by the court of appeals the DLI has filed a petition requesting that the Minnesota Supreme Court review the Court of Appeals’ decision invalidating the residential sprinkler mandate for one-family and two-family homes. At the time of printing, BATC has filed its opposition to DLI’s petition for review. The Supreme Court has discretion whether to grant or deny review of the Court of Appeals’ decision. The decision to grant or deny review is typically made by the Supreme Court within 30 to 60 days. As of this writing we have not heard their decision. Trail Blazed for Energy Code Performance Path BATC scored a key victory on one of its top 2015 priorities when we gained the commitment of the MN Department of Labor and Industry to coordinate the build-out and promotion of an energy code performance path. Here’s what you need to know: Energy Code Performance Path New to the code this cycle, the performance path allows for energy modeling of a home pre-construction. If the simulated performance of the home is at or below the energy line established by the code, a builder has flexibility on insulation (attic, wall) and sets the stage for a streamlined energy code inspection/enforcement process. The Performance Path in the Energy Code Wasn’t Usable The model code amended by Minnesota maintained a performance alternative, but the software used by BATC members rating their homes was not updated to work with the new code. BATC will be working with a ratings software company to ensure that our new code can be modeled. DLI has pledged to assist with this effort.

Legislative Action Advanced this Issue Last session Rep. Vogel introduced HF 1977 which was included in the House Jobs & Energy Omnibus bill. The bill would have required DLI to enter a rulemaking process to create an Energy Rating Index (ERI) for performance path compliance. After concerns were raised by DLI and others, BATC worked with DLI to establish an alternative way to achieve our performance path objectives without entering into a rulemaking process. What Trade-Offs are Available for Builders Meeting the Energy Performance Standard? Builders now can change certain code-required insulation levels, as long as those changes still perform at or below this performance standard.

Some trade-off examples are: R-20 in wall and rim joist cavities R-49 attic insulation .32 U factor windows (fenestration) Hot water pipe insulation

When Will this Be Available and Where Can I Learn More? We expect that this will be available for use in early 2016. When the modeling software and reports are ready for use, BATC will likely hold a training session for our members. DLI has committed to doing the same for the building official enforcement community.

What would you say is the number one reason you invest your time and energy into professional associations like BATC? I have always believed that THE most important thing that any one person can do to both serve their community and make oneself a trusted member of that community is to make relationships, not just transactions. That means going beyond the dollar and fostering meaningful relationships that will serve all parties meaningfully. Servant leadership in this community has allowed me to get to know both colleagues and prospects on a personal level that trying to just sell to them would never achieve. It takes time and commitment, but the rewards are infinitely sweeter.

Thank you for agreeing to chair BATC’s Membership Committee, can you explain a little bit about what this committee does? This committee is so excited for the coming year!!!!! There are lots of changes on the horizon and with one of Meg’s (Jaeger, 2016 BATC President) top priorities being membership, we are ready for the challenge. This committee works not only to bring in new members to the BATC community, but also to stay in front of members and help them derive what is important to them from their BATC membership. We are also developing a new program to focus on mentoring new companies and individuals through the initial stages of membership, when they are the most likely to be hesitant about

Tell us a little about Jill, what do you like to do in your spare time? I have a 23-year-old daughter Katie who is the light of my life and one of my very best friends, so spending time with her is a joy. If I could cook for people every single day I would! I absolutely love planning menus, shopping for ingredients and spending hours in the kitchen whipping up delicacies for my favorite people. Other than that, I am quite the sports fanatic, with hockey and tennis being my favorites. And every summer weekend is a trip to my cabin in Wisconsin where I (go figure) love to cook for my family. I am clearly a person of limited but very specific interests!

A Home for Marco Solt A cold day in November did not stop over 100 family, friends, supporters and organizers from coming out to honor SPC Marco Solt and his family at their new home Key Ceremony. The BATC Foundation with community partner Homes for Our Troops, and build partner Accent Homes, gifted the Solts with a new mortgage-free, specially adapted home for them to enjoy. While in service to our country, Marco lost both of his legs below the knee when his unit’s vehicle hit an IED in Afghanistan. With this in mind the builders integrated over forty special adaptations into the Ramsey home’s design. For example, the doors are wider, counter tops lower, and cook tops and sinks have a roll under design to accommodate Marco’s wheelchair. The bathroom was also designed for Marco’s independence. These designs will not only ease Marco’s challenges in daily living, but as Marco said with a smile, “ease the added workload his wife, Gena, has been managing.” Included at the Key Ceremony celebration were Minnesota’s own Senators Amy Klobuchar and Al Franken, who graciously thanked SPC Marco Solt and his family for their service and sacrifice. Senator

Klobuchar added a quick anecdote related to her first meeting with Marco. “It is something I’ll never forget. I was having a bad day, and yes, politicians have bad days,” she said. At that point she took a break to visit injured troops at Walter Reed General Hospital and met Marco, who was optimistic in spite of his injuries. He told her, “I’ve lost my legs, but I’ve got my life in front of me.” Senator Klobuchar found his bright and optimistic perspective inspired her. With speeches done, honor guards formed, United States flag raised and cheers from the gathered supporters, Marco, Gena and son Devin, led the way into their new home. “We are so excited, I’m at a loss for words. Not only does this mean a lot to me, but it means a lot to all veterans. It shows them that there are people out there that support them” shared Marco. Then, in the middle of all the guests, two-year-old Devin sat down on the living room floor and had lunch, making the home transfer to the

Solts complete. The Solt’s, whose moving truck was to arrive within several hours, were cozily settled in before the holidays. Another home completed. And, BATC Foundation did what BATC Foundation does best, inspires members of BATC to participate in supporting distressed members of our community with safe and appropriate housing options. This dream home could not have been possible without the community partner, Homes for Our Troops and build partner, Accent Homes. These leaders were joined by an amazing contingent of build vendors, professional building volunteers, material and funding donors, family members who came out on Volunteer Day and many more. To our BATC Foundation members we are endlessly thankful for their commitment, investment in our community and on-going support. And to the Solt family, with a new baby boy expected in March, welcome to your new home.

Our sincerest sympathies to the family of Craig Plekkenpol for the loss of his mother, Joan Plekkenpol. Joan passed away on November 17, 2015 at the age of 83.

Brad Norling has joined the Westwood Professional Services’ Minneapolis office as a senior biologist/project manager supporting its environmental services. He will be working on a broad range of field studies, compliance monitoring and permitting projects for Westwood’s land, oil and gas pipeline and wind energy markets.
