Building for the Future The two greatest challenges facing our industry today are over-burdensome regulations and a labor shortage. BATC is working hard to address both.
On the regulatory front, BATC has a comprehensive legislative agenda to rein in regulations that is part of our Home Ownership Initiative with the Minnesota Association of REALTORS®. You can read a great deal more about that initiative on BATC’s blog. In addition to regulatory reform through the legislature, BATC has brought on board Nick Erickson as our full-time Regulatory Affairs Manager. Nick has already begun meeting with key agencies to share our concerns. He will oversee our efforts to mitigate regulatory impact at the local, regional and state level. You’ll be reading about Nick’s efforts in the blog, the weekly Voice e-newsletter, the Digest and our social media properties. Equally as important, BATC is spearheading marketing efforts to show Minnesotans the tremendous career path

in our industry and make the construction industry a field of choice for our youth. Called Project Build Minnesota, you’ll be hearing a great deal more about this initiative in the coming months. We are working with some 15 construction associations to create a movement that makes working in the building industry exciting and enticing. We’re going to need your help to succeed. As we launch Project Build Minnesota, we need every member to use the brand on their website and in their social media. We’ll be supplying the materials – we just need your cooperation to extend our reach. Imagine the collective power of thousands of members, each with their own substantial networks, promoting Project Build Minnesota on their social media properties and their websites. We also need contributions

toward our effort – we have a three-year plan and a budget and any assistance our members can provide is extremely helpful. Our partner associations are seeking funds as well. Not only are we marketing careers in construction, BATC’s Education and Workforce Development Committee is forming a Speakers Bureau to reach into schools. If you are willing to take a PowerPoint into a high school class or career fair and speak to today’s youth, please let me know (david@batc. org). a word from our president
What’s Up With BATC? A Whole Lot! One of our greatest challenges at BATC is simply communicating our range of activities and accomplishments. Inevitably, as new volunteers get active in BATC, the words we hear most commonly are, “I just didn’t realize BATC was involved in all of these things.” So I decided to make my column in this issue all about our array of activities over the past several months. Here we go:

Membership is growing (up 7.5% in 2016 to 1200 members). Retention is up (91% in 2016). Very difficult for a larger association. Nick Erickson has joined our staff team as Regulatory Affairs Manager. He will focus on all of the state agencies, regional planning, watershed districts and local units of government. Our members needed this effort due to the business environment in Minnesota. BATC Housing First PAC and Housing First Fund had a phenomenal fall election. We ran a highly successful $1 million independent expenditure campaign (17 for 17 in endorsements and 16 of 19 in independent expenditure candidates we supported). BATC is acknowledged as one of the top three business organizations in electoral engagement. Leadership of the House and Senate are very aware of the effective role we played in the election, and are responsive to us in ways we’ve not previously experienced. BATC’s Housing First Network (c4) is engaged in a year-round issue advocacy campaign to educate opinion leaders and influencers about the importance of home building. Visit www.

We’re running digital ads right now in support of our Minnesota Homeownership Initiative at the Capitol. BATC and Minnesota Association of REALTORS® combined for Housing Day at the Capitol with 600 attendees registered. It was a very powerful day – our folks were everywhere you looked at the Capitol. BATC has partnered with the REALTORS® to initiate the Minnesota Homeownership Initiative at the Capitol – with more than six different legislative items we have packaged that will actually reduce our regulatory burden and move our industry forward. What a nice change to be on the offensive. BATC has also initiated a BATC Legal Defense Fund (BLD Fund) to address the growing legal challenges we are being asked to support or initiate. We focus on cases that have broad significance. We currently have one court case in which we are filing an Amicus Brief and are helping to support the case.
BATC is very close to launching our first on-line educational course that meets our Department of Labor and Industry standards. That will complement our in-person courses offered through Contractor University, which train several hundred members and nonmembers annually. Visit www.ContractorU.com for our courses. BATC is about to launch Project Build Minnesota, a collaborative effort among 15 construction-related associations to tell the story about careers in our industry and make construction attractive as a career. We are planning for this to be a multi-year initiative supported by the broadest array of construction-related organizations and their members that we can muster.

We just completed our annual Job and Career Fair at the Mall of America with 27 exhibitors and 200 jobs. We got solid evaluations for the event and some exhibitors have already hired directly from the fair. BATC has substantially expanded our advocacy capacity. What’s Up With BATC - continued affairs manager and the top contract lobbyist (and attorney) in the land use space on retainer. Our Executive Director is also deeply engaged in our advocacy efforts, along with our Independent Expenditure leadership team and our Public Policy Committee. We’re now forming subcommittees of our Public Policy Committee for Regulatory Affairs and Legal Defense. Our goal is to enhance our modern, comprehensive advocacy program utilizing best management practices to serve this deserving industry. BATC has a well-staffed creative services department with graphic designers and social media experts that we leverage for both the Parade of Homes and our advocacy efforts, as well as our industry events. We contract for public relations services and have media buyers that purchase our marketing. Our team is engaged and busy doing exciting and rewarding work that benefits our industry. Our charitable BATC Foundation (501c3) builds and remodels homes for veterans and those less fortunate. Through the “halo effect” it helps us get out the message that we are builders of and experts in community. To see our Foundation’s efforts, visit www.BATCFoundation.org. Several projects are in the formative stages. We just launched a new online BATC membership directory, which we had custom built, and which will form the basis of a Parade of Homes website rebuild that we are undertaking so that our site is fully responsive and mobile friendly to anticipate future needs. We recently completed and made available for member download model contracts and performance guidelines, a popular membership benefit of substantial value.

Our Biggest Day at the Capitol Yet! More than 600 members of the Builders Association of the Twin Cities and the Minnesota REALTORS ® came together in February, to advocate for homeownership during the first ever Housing Day at the Capitol. The monumental event marked the start of an exciting partnership as both groups joined together to share with lawmakers their collective support of the Minnesota Homeownership Initiative, a package of legislative proposals that promote homeownership. “Homeownership strengthens our communities and helps build safe and secure neighborhoods. This collection of legislation is an important step in opening the door to homeownership for the next generation of Minnesotans,” said Christopher Galler, Chief

Executive Officer of the Minnesota REALTORS®. The Minnesota Homeownership Initiative addresses many of the challenges current and future homeowners face. This package of common-sense legislative proposals aims to protect the dream of homeownership for all Minnesotans by creating opportunities for first-time homebuyers and addressing the cost-drivers that are negatively impacting housing affordability. “A recent survey showed that 84 percent of Twin Cities residents believe

In a recovering housing market in the wake of the worst recession in 70 years, a variety of strategies are needed to help families purchase their dream home.
BATC and MN REALTORS ® members met with 171 legislators including Speaker of the House Rep. Kurt Daudt, House Minority Leader Rep. Melissa Hortman, Senate Majority Leader Paul Gazelka, and Senate Minority Leader Thomas Bakk.

Putting Homeownership First at the Capitol On the heels of Housing Day at the Capitol, the BATC advocacy team has been very busy in St. Paul. Multiple pieces of the Minnesota Homeownership Initiative have taken major steps forward at the capitol. While numerous steps remain, these mark important incremental victories toward achieving our homeownership and affordability objectives. BATC’s advocacy team along with several engaged members of BATC have been active and ready at every chance to support our pro-housing legislation. This has included testifying at numerous committee hearings and attending press
conferences in support of workforce development legislation. Thank you to all our members who have stepped up to help make a difference for our industry. March marked the various deadlines in which committees must act favorably on bills in order for the bill to continue through the legislative process. We’re pleased to report that the numerous pieces of the Minnesota Homeownership Initiative all met this deadline. Here are those issues moving forward:
FIRST TIME HOME BUYER SAVINGS ACCOUNT The First-Time Homebuyer Savings Account would encourage Minnesotans to save for a down payment by providing tax deductions and incentives to help achieve the dream of owning a home.
to conduct oversight on a housing rule proposal that would increase the costs to a homeowner by more than $1,000. Research demonstrates that for every $1,000 increase in the price of a home, 4,000 Minnesotans can no longer purchase that home.
PUBLIC NOTICE FOR HOUSING MORATORIUM Today there is no due process protecting homeowners and land owners before the use of their properties is frozen by a housing moratorium for up to a year. This legislation would provide advance notice and a public hearing before a moratorium is imposed that would regulate, restrict, or prohibit activities relating to housing.
TOWNHOUSE DEFINITION A long-time BATC priority, this initiative is a continuation of BATC v. DLI and would modify the townhouse definition and remove the sprinkler mandate.
RULEMAKING REVIEW The regulatory costs associated with new construction have surged over the past decade. This legislation would allow the legislature
WORKFORCE DEVELOPMENT What is one of the biggest obstacles facing the housing industry? The lack of workers trained in the construction trades. Two bills address this issue, by encouraging trades and vocational careers. HOME TAX CONFORMITY This measure would make
mortgage debt cancellation tax relief and mortgage insurance premium deductibility permanent features of Minnesota’s tax code. Mortgage debt cancellation tax relief provides homeowners who have had some portion of their mortgage debt forgiven by a lender through a short-sale, foreclosure, or a principal reduction, relief from having that forgiven debt treated as “income” and taxed. Mortgage insurance premium deductibility benefits homeowners, often first-time homeowners who had to purchase mortgage insurance because they were not able to make at least a 20 percent down payment, by allowing them to deduct the premiums from their taxes. CONDO/TOWNHOME DEVELOPMENT Ten years ago 57 percent of our new home market was multi-family, today it is just 15 percent. A healthy
housing market includes a wide variety of options to meet demand and condo/townhomes are sought-after by first-time homebuyers. A key challenge to a healthy condo/ townhome market is the state’s current construction defects law, which needs to be amended to encourage more condo/townhome development. MANUFACTURED HOME TITLE ISSUES Transferring ownership of a manufactured home can sometimes be a challenge because manufactured homes are titled as personal property (like a motor vehicle) rather than as real property. This legislation would create an administrative process that manufactured homeowners could follow to obtain a new title, rather than having to commence an action in the judicial system, which can be complicated, slow, and expensive.

Q
A Stop Order can be used by the Building Official at any time during the construction. It would normally be used as a last resort after other means to obtain compliance have failed. In the situation that you describe with the drywall contractor, the Building Official probably placed the Stop Order in an attempt to verify the proper installation of the insulation, vapor retarder and maybe the air barrier. Although the code is not specific to what extent the Stop Order should affect other trades on the project, it would seem appropriate that only the drywall contractor should be affected in this situation, but allowing other trades to continue.

Peter has three decades of extensive experience in the construction and building codes industry as an author, educator and experienced in residential building codes, energy codes and green building practices. His background includes working on staff with the International Code Council, as an Instructor with the State of Minnesota Building Code Division, as a municipal Building Inspector and in various positions with residential and commercial construction companies in Minnesota. Peter is certified by the International Code Council as a Building Inspector, Plans Examiner, and Green Building-Residential. He is also certified by the State of Minnesota as a Certified Building Official and Certified Instructor.

A Room for Rachel The BATC Foundation has big plans for a deserving girl! Rachel is an exceptional 12-yearold in many ways. She loves music and sings in her school choir. She is active in Circus Juventas and theatre. She’s a world traveler, visiting Paris, Belgium and China. Two years ago, Rachel experienced a series of health events that led to a diagnosis of Crohn’s Disease and a type of malformation of the spine. For more than two years, Rachel’s world has consisted of hospitals (her longest stay was 86 days), doctors and multiple surgeries. Because of her illness, Rachel is homebound much of the time and has missed a lot of school. Rachel’s bedroom can only be described as tiny and that has led her to spend much of her time at home in the family’s dark and partially finished basement. Rachel wanted to have a space in her basement fixed
up for her to do crafts, her schoolwork and hang out with friends. The BATC Foundation, Special Spaces - Twin Cities and Ispiri have teamed up to create such a space for Rachel.

There is a lot to do to make this a perfect space for Rachel. Our volunteers will replace cracked floor tile, remove dark wood paneling, mitigate moisture, install drywall and paint. Windows and ceiling tiles will be replaced and an area for homework and crafting will be added. Chelsey Green, Executive Director of Special Spaces - Twin Cities designed an incredible space for Rachel. The plan contains built in storage cabinets and shelves, custom craft table, chalk board, craft wall and will be accented with bright colors and furniture. The BATC Foundation is excited to be working with Special Spaces and Ispiri LLC throughout this project. Rachel’s new room is set to be completed at the beginning of April 2017. MACV Project Back on Track for 2017 We are thrilled that Lennar has stepped up and will be the Build Partner for the brand-new Minnesota Action Council for Veterans (MACV) Supportive Independent Living (SIL) house for families! You may remember this project from last year when we tried to move a donated duplex to a new lot. There

proved to be more obstacles than we could overcome in moving the duplex so we shelved the project for 2016. When Lennar came to us earlier this year looking for a project, they were excited by the idea of a home that would keep on giving to local veteran families well into the future and agreed

to take on the MACV SIL house. “We are delighted to be working with Lennar on this project and we know that MACV is excited to be able to expand their SIL program to homeless families,” said Perri Graham-Raff, BATC Foundation Executive Director.

Give Your Membership a Kickstart! Well, I have officially been your Director of Membership for a year now. What a great ride it has already been! Have you been a member for a long time? Maybe you are trying to understand WHY you are a member because you don’t utilize your membership. Or maybe you attend every event we have, but don’t really understand best practices for BATC membership. Or perhaps you are a new employee at a long established member company who is trying to wrap their head around this industry. It’s time for you to Kickstart your membership! Last year, we introduced our Kickstart events to welcome new members into the association. Generally, it is considered an informative presentation and networking opportunity to initiate individuals who want the most out of BATC membership. We feel it is important to not only tell people about our
association, but to let them put names with faces on our team. As we have had more and more of these Kickstart events, it has become clear they are also a valuable tool for our existing members. So much has changed at BATC over the past five years and we find that our long standing members don’t always realize how many benefits they are missing out on. What can you expect at a Kickstart? You will arrive at 3:30pm, grab a drink (wine and beer are options!) and some snacks, settle into a spot (preferably in the front row since it always seems to be empty), say hello to your neighbor and prepare yourself for an impressive PowerPoint presentation, usually by yours truly. Just kidding… about the impressive part…
everything else is true. We will spend the next half hour telling you more about BATC and our different departments. Each person on staff will introduce themselves, tell you what they do and explain any engagement opportunities that they can offer. After the presentation is complete, we encourage you to network. Some of the best relationships are made at this event. Our staff gets to meet you and take an interest in your success. You can meet other new and existing members who will be your “people” moving forward at BATC. And let’s face it, we all can use a familiar face when attending an event. Nick Erickson joins BATC as Regulatory Affairs Manager BATC is pleased to welcome Nick Erickson to our staff as Regulatory Affairs Manager. Nick brings more than a decade of public affairs and strategic communications expertise to BATC. Prior to joining us, he worked at UnitedHealth Group where he provided strategic communications guidance to UnitedHealth’s External Affairs and Human Capital teams. Nick’s work included complex regulatory affairs issues, assessing their impacts, and developing communications strategies to multiple audiences. Nick will utilize this experience to advocate for BATC’s issues with key regulatory agencies, which include the Department of Labor and Industry, the Pollution Control Agency, the Met Council and many more.

Bob Michels Construction Honored as Phantom Screens 2016 Impact Winner
Creative Homes Named as One of the 100 Best Companies to Work for
Congratulations to Bob Michel’s Construction for receiving Phantom Screens 2016 Impact Award for their project featuring a car carousel which operates both as a space to highlight the owner’s car collection and the functional purpose to turn cars around and drive out of the showroom. Entries were judged based on design and creativity, market appeal and livability, and product integration.
We’re proud to share that BATC member Creative Homes was honored as one of Minnesota Business Magazine’s “100 Best Companies to Work For in 2017.” The “100 Best” were determined by the resulting scores of an anonymous online questionnaire filled out by the employees of each participating company — to determine which companies in Minnesota excel in the areas of work environment, employee benefits, and overall employee happiness.
KC Chermak Recognized as Life Director of NAHB Congratulations to KC Chermak, Pillar Homes Partner, Inc. on his election as a Life Director of NAHB. To be eligible as a NAHB Life Director, members must have served as a voting director for ten years, have attended at least two board meetings annually as well as receive a recommendation from their local association.
CalAtlantic Homes’ Executive Chairman at the Helm of HomeAid America Scott Stowell, CalAtlantic Homes’ Executive Chairman, will lead the HomeAid America Board of Directors as Chairman for 2017-18. CalAtlantic has a Twin Cities division. HomeAid is a non-profit organization that builds shelters and other facilities where homeless Americans can rebuild their lives. HomeAid works closely with local NAHB affiliates and their related organizations. The BATC Foundation hosts the local HomeAid chapter.
CONDOLENCES Jim Brown Longtime BATC member Jim Brown died suddenly at the age of 56 on February 23rd. Jim was the co-founder of Stonecrafters Midwest LLC. Our deepest sympathy to his family and friends.
Ross M. Fefercorn Our deepest sympathy to the family of Ross M. Fefercorn who passed away suddenly on January 11th. Ross’s distinguished real estate career spanned more than 30 years. He was president and owner of the RMF Group. His development and design work earned him numerous honors including 24 various BATC awards. He will be missed.
Linda K. (Corbett) Jacobson We are deeply saddened by the loss of one of our own BATC family members. Linda Jacobson passed away peacefully on February 21st. Linda retired from BATC in 2013 after spending 22 years as a part of Parade of Homes team. She was not just a co-worker but a dear friend at BATC and will be sorely missed. Our thoughts are with her friends and family.
