SHOULD WE OR SHOULDN’T WE: A CAREFUL DECISION ENSUES

Early in my career, I served as editor for a series of suburban Twin Cities newspapers. In that role I’d make decisions each week as to which stories would get front page placement. A common dilemma was whether to run a story that would be of higher reader interest, usually more feature oriented, or to run a story covering information we felt the reader should know, such as a city council wrap-up. Put another way, to what extent does an editor have a responsibility to lead his readers to information about which they should care and know, versus providing stories about which they are likely more interested? Association executives face a similar challenge. To what extent is it the responsibility of an Association Executive Director and his or her Board of Directors to lead the industry and to what degree should the Chief Staff Officer and his Board represent and reflect the mood of membership? Whether as a newspaper editor, or Association executive director, there aren’t easy answers to these questions. If an Association executive director gets too far 4

in front of his membership, he’ll look back and find no followers. The balance is delicate and requires a great deal of sensitivity. A good executive will assess where the industry is at any given moment, what the future likely holds, and the appetite for change among the membership. Then he and his Board of Directors chart a course for the organization that tries to pilot the industry to the right port. BATC has, on many occasions, faced this very situation of leading our industry forward while being very aware of the challenges of change. Minnesota’s Green Path is a clear example. All of the research across the country indicates that future home buyers will expect and demand that homes be constructed or remodeled with a strong element of green. And yet, consumer demand in our area isn’t strongly evident yet. Most buyers aren’t asking, and most appraisers don’t add value for green on appraisal. So, does BATC lead the industry, or wait for demand to appear? Our forward-looking Board of Directors has elected to lead the industry, and has done so with a program that is flexible and realistic for our market. With more than 140 Green Path tested homes in the spring Parade of Homes, our program is slowly growing. But Green Path has undergone changes even from its inception, reflecting market realities. We have tried hard to strike the balance between leading and meeting the market where it stands. We often face similar dilem-

Spring is here! Although as I write this it is snowing! We are well into spring cleaning at BATC. Housekeeping items like developing a Policy and Procedures manual and polishing up our Bylaws are well underway. Additionally, this quarter we will finalize our strategic plan. BATC is doing lots of plant-
ing this spring with fresh improvements to our member website (BATC.org). We’ll be completing a few remaining features on our newly rebuilt consumer site (ParadeofHomes.org), as well as creating revenue streams with our new Artisan Home Tour launching in 2014. BATC is housing and we will cultivate that space. Our industry is definitely seeing sprouts of growth, with Parade of Homes entries up more than 22 percent this spring, quality traffic growing and permits climbing! Our advocacy fund under the new dues structure is blossoming and preparing us to weather any storms ahead. BATC is answering the need for growth in our industry work force. We hosted a job fair on February 6th with almost 20

companies offering over 200 jobs, and around 400 potential employees in attendance. We even got a great PR story on KARE11 with Marv McDaris, John Zirbes and Jon Coty. It was a well conceived event — kudos to the task force! And, we are planning to host more job fairs in other quadrants of the Twin Cities. Even though we suffered through the great recession, BATC was better prepared than many of our sister HBAs, increasing our ranking from 11th to sixth largest HBA in the nation. We ARE the acorn that became the mighty oak and we will continue to grow and improve that brand and develop programs that benefit you — our member.

BATC REMODELERS ROUND TABLE WRAP UP: MARKETING TIPS Just before BATC’s February Showroom Mixer at Designer Marketplace, a dozen members of the BATC Remodelers Council gathered to share tips and ideas that have worked for them in marketing. James and Rachel Julkowski shared that they were a little leery of buying additional display ad space in the Guidebook, but gave it a shot last fall. They were thrilled with the results. They recommended placement next to your entry, and including additional photos to entice visitors to come in to see the whole picture. It’s a great branding opportunity that helps a remodeler stand out, too. Some of the other Showcase recommendations included connecting with the neighbors, they’re excellent prospects! Both mailers to the surrounding neighborhoods and hosting a party for the neighbors ahead of the tour make a lot of sense. Several remodelers stressed that follow-up is critical, advising that just because you have a sign asking folks to register, that doesn’t mean they will. And we discussed how sometimes you want homeowners to stick around during the tour, they can be your best sales people. But of course, there are some homeowners that simply shouldn’t be there, so find ways to help them enjoy a weekend away from their home. Security is always tricky. We discussed how important it is to staff a home well, including
bringing in your subs to help — they can be great sales agents too. Another suggestion was to have printed information about the materials and colors used in the house available for visitors. You are likely gathering that information for the homeowner anyway (and if you’re not, you should— plus instructions on how to maintain and use any of the systems and products). Like most discussions today, technology was front and center. While most everyone in the room has a Facebook page, fewer have signed onto Houzz. Those that do use it really like it and recommend everyone join in. Sales teams are using iPads more and more in their sales efforts. And a technology discussion with remodelers wouldn’t be complete without a review of design programs. Two programs discussed were Google Sketch UP and Chief Architect. But there was also a lament about finding drafters and computer folks with enough understanding of construction. One excellent tip came from Bryan Ogle of Ogle Construction who does a sub walkthrough before starting the job. The subs can make great suggestions about their specialties. Marc Tomas with PipeRight Plumbing mentioned that they love to do walk-throughs and are often able to save money and time by recommending better piping schematics and the like. He also suggested that sharing of marketing costs is a great way for subs to grow their businesses, too.

ADVOCACY: 2013 Q1 REVIEW If the advocacy activity from first quarter of 2013 is a preview of what is to come throughout the year, buckle up. We’ve seen legislative and regulatory proposals that touch almost every corner of our industry, ranging from street and park fees; to disclosure requirements, to sales tax on services, even environmental stewardship requirements for paint and carpet manufacturers and retailers. There are a few factors contributing to the pace of regulatory proposals. The first is a unique political dynamic with the Governor’s office, Minnesota House, and Minnesota Senate all under the hands of DFL leadership. This level of single-party leadership hasn’t been seen in Minnesota for nearly 25 years, dating back to 1989. Joining the new dynamic is a political youth movement anchored in nearly 60 freshman legislators. These folks bring new energy and ideas to the process and are more likely to chal-
lenge the ‘it’s the way we’ve always done it’ phenomenon. Finally, the growth of the regulatory footprint has been occurring for the past 30 years. Incrementally, the federal, state, and local governments have expanded their watch over our industry in a mix of small and big bites, culminating in what we have today as a heavily regulated industry.
Proposals on the Table in 2013 Today, regulations account for 25-30 percent of the final price point of a newly built home, as this graphic
shows. Ideally BATC would focus on measuring cost-benefits for existing regulations to see where we can increase efficiencies. Given the political dynamic in Minnesota however, we are focused instead on trying to limit additions to the existing regulatory footprint. This is not an easy task given the proposals on the table in 2013.
Keep Calm, Carry On, Stay Engaged With the flurry of bills and regulatory proposals impacting our industry it’s easy to feel overwhelmed by the whole thing. The good news is that our process requires all ideas, good, bad, or somewhere in the middle, to go through the legislative and regulatory processes. BATC is committed to representing our industry aggressively at the legislature, regulatory agencies, and beyond. We’ve had good luck so far in 2013 improving bills that we were initially opposed to. For those wondering what they can do to help – join us!

BATC has a compelling message platform from which to press for reasonable and smart regulations. At the heart of our message is our industry’s place in the broader economy. As we all know, the recovery of the housing market will be one of the most important factors in economic growth for Minnesota. A healthy housing market means more good jobs, more tax revenue from economic growth and more families investing in an important asset — their dream home. Economists make it pretty clear — if the housing market doesn’t recover, neither will our economy. Many regulations are necessary and the support of BATC, but we oppose those that are unneeded, unfair or too costly.
Builder Day at the Capitol was a major success where more than 80 members of the Builders Association of the Twin Cities (BATC) joined other residential construction industry professionals from around the state to descend on the Minnesota Capitol grounds to meet and talk with representatives and senators about the issues that affect the housing industry. We’ve also had several members join our lobbying team for individual meetings with legislators where we went in-depth on the sprinkler mandate issue.

A strong foundation is required for any structure to weather the storms of time. Likewise, the GC must implement the foundation of S-Shifting appropriate risk in order to weather the insurance cycles that are sure to come. There are two primary components necessary in shifting appropriate risk: Contracts: It is critical to have a signed subcontractor agreement on file from every subcontractor performing work on your project. Experienced legal council will recommend it be signed annually, contain both hold harmless and indemnification language, and spell out the specific insurance requirements

that each of your subcontractors must comply with. Certificates of Insurance: Prior to starting work on the project, each subcontractor must provide a valid certificate of insurance showing the required coverages specified in the contract. Each certificate must agree with the contract requirements, or the inconsistency may void the contract during litigation. A certificate tracking service is well worth your consideration in handling this burdensome but very important compliance task. Interpretation of each subcontractor’s additional insured forms and cover limits, among a host of other insurance forms, is
better left to a professional service. Shifting risk helps you stay eligible for the best coverage, best rates, and better protects your loss history. Failing to consistently follow through collecting contracts and certificates from subcontractors may result in non-renewal of your policy, additional premium charged, or other penalties. BOARD PROFILE
A WINDOW ON DARYL DOEHR BATC 2013 Executive Board Secretary Written by Wendy Danks
looked back — although he did transition from crunching numbers to convincing customers when he moved into sales in 1988. Sales is the perfect environment for Daryl, who brings a calm, steady hand to everything he does. We’ve already noticed this during BATC Board meetings where his questions and comments are always the right ones. But that’s not to say he isn’t good at dropping a clever zinger now and again, either. Since graduating from college in 1984, Daryl Doehr has made his living in windows, and a good one at that. Fresh out of the University of Wisconsin at River Falls with a degree in economics and quantitative analysis (that’s why he’s so darned good with numbers), Daryl took a position as statistical analyst with SNE Enterprises, manufacturer of Crestline and Vetter windows. He’s never

It was 2001 when Daryl moved to Marvin Windows and Doors to bring his sales skills to one of Minnesota’s top window firms. They knew talent when they saw it and promoted Daryl to sales management in 2003, where he’s thrived. He has only good things to say about his tenure with Marvin, explaining one of the main benefits of working there is “working with people that are committed to a
APRIL/JUNE 2013
common cause.” He also likes that there’s a stability you don’t find in a lot of companies, “because we’re a good company to work for, you get to work with the same people for a long time.” Daryl’s longevity isn’t just with windows, he’s been married to Denise for a quarter-century and they have three children. Beth, who follows in Daryl’s sales shoes (in the software industry) has given Daryl and Denise two grandkids to dote on (Logan and Layla). Middle child, Charle, is 24 with a plan. He currently works for Coca Cola as a merchandiser part time while finishing business school in Duluth. And Joe, the baby at 22, is currently getting some real world work experience at a deli in a Wyoming (MN) grocery store before going back to school. No stranger to long hours and hard work, Daryl grew up on a dairy farm in Wisconsin. He doesn’t miss the 5:30 (a.m. and p.m.) milking chores, but does miss the Holsteins. His youth included 4H and Future Farmers of America (FFA), including earning a coveted FFA State Farmer Degree his senior year in high school for a four-year project tracking the herd. After work, Daryl heads home to Wyoming where he’s greeted by their two rescue dogs. Gracie is a middle-aged yellow lab and Shar Pei mix, while Scamper, a young Corgi and Dachsund mix, joined them last year. You’ll often catch Daryl playing cards, including poker, cribbage, rummy and sheepshead (if you’re from Wisconsin you might know that one). You might also find his nose in a historical non-fiction
book. He just finished Bill O’Reilly’s Killing Lincoln, but his all-time favorite is a story about Lewis and Clark called Undaunted Courage. The other place you might find Daryl is at his church, where he’s served as an Elder for more than a dozen years. Outside, Daryl loves to golf and fish (as you can see at left). Fishing for Daryl often means portaging his small boat to hidden lakes around the state and once a year to Canada. He scoffs at those walleye hunters — for Daryl it’s the mighty northern or muskie that calls. If that’s not enough, Daryl has some fairly well-hidden talents, at least from his BATC family. He played in both his high school and college bands, handily managing the baritone, trumpet and tuba, and was the featured soloist as a college senior. But of course music leads to acting, and Daryl’s career in that arena is blooming, having played the main character in his church’s Christmas dinner theater for the past 13 years. It’s clear that Daryl had a strong and happy upbringing, and our hearts were heavy when his dad, Lyle, passed away earlier this year. Married for 71 years to Hazel, Lyle was a great role model as a dad and husband, and told Daryl often, “I’m glad everybody likes something different, otherwise everybody would want to be married to my wife.” Daryl says his mom is doing pretty well, and will continue to live in her “mother-inlaw” apartment with Daryl’s sister. We’re truly lucky to have Daryl serving on BATC’s executive board for the next three years.

Why did you become involved with BATC? In-Focus and I became a part of BATC eight years ago for several equally good reasons. 1. We wanted to get a better understanding of the marketplace and industry trends. 2. New technology has always been interesting to me because it makes our life efficient, allowing us to spend more time with the people we care about. I want to golf at least one day every week until the snow starts flying again. What’s your favorite app? Google Maps. Where is the best or furthest place you’ve traveled to? Seoul, South Korea and Shanghai, China working as an Account Executive for LG Electronics with product development and Global Sourcing for Best Buy. What was the best advice you’ve ever received or given? Every day is a gift so treat it like one! What’s the one technological device you couldn’t live without? Television! It is what keeps us in touch with our community/world and allows us to see things that we may have never been able to experience otherwise. And, I can keep up with sports, of course.

Our 2013 Builders & Remodelers Show (BRS) held on Thursday February 21st was a huge success. From the kickoff BATC Foundation Recognition Luncheon to the game-filled after party, the day was a winner.

by the numbers BATC Foundation Recognition Luncheon Promptly at 11:30, the Foundation welcomed 105 attendees as it recognized Builder Partners, recent Dream Home builders and remodelers, and key volunteers and donors. Keynote speaker, former Minnesota Viking Linebacker, Matt Blair, opened his talk with a fun trivia game, handing out some of his original photographs to the winners. Blair motivated the audience with his personal story, and how he had achieved success through a continual commitment to setting and reaching goals. Blair’s 12year career as a professional football player started with small milestones like making the team (even if he spent most of the time on the bench). But that was just the beginning. He continued to set and pursue ever higher goals, culmination in six consecutive Pro Bowls, two Super Bowls, and making the Vikings All Time List for tackles. Blair is second on the list with 1,452 tackles.
The Show Meanwhile, 198 companies were taking over the 79,200 square-foot exhibit hall at the Minneapolis Convention Center, setting up 243 10x10 booths for the trade show floor opening at 2pm. BRS was A Hollywood Styled Affair this year and our exhibitors delivered… more on that later. Greeted by an official red carpet, the builder, remodeler, architect and interior designer attendees had an opportunity to check out the free oneday show from 2 until 7pm. Besides all 32

the BATC celebrities, guests spotted Marilyn Monroe, Cher and Napoleon Dynamite toting his tots and all. Returning to this year’s show floor was the Minnesota’s Green Path Pavilion. The program, which certifies energy efficiency and home performance in home construction and remodeling projects, debuted in 2012. The pavilion featured recent program updates, including the new Energy Tested level that can provide every energy-tested new home with a unique Home Performance Report (HPR). For those checking out all the cool exhibits this year, there were a few wayside rests to help stave off exhaustion. The Demo Stage was an ideal stop to take a load off and take in some solid information to improve their residential construction businesses from six exhibitors. And, six well-stationed bars made sure no one got thirsty either. We know that all that walking can work up an appetite, so each attending company received up to four free dinner tickets. This year’s five star feast offered buffet lines chock full of salad, sides, and a chef-staffed carving station, plus dessert waiting at the sit-down dining tables. For those attendees that were feeling lucky, the Stars of Fame Scavenger Hunt offered a chance to win $500 cash just by visiting the 16 participating exhibitor booths. Lennar has held the top spot since 2006. Rankings are based on annual gross revenue as reported by respondents for for-sale housing. Lennar reported gross revenue at $160 million, with 441 total housing units closed in the 2011 calendar year. “Lennar is honored to be named the Twin Cities Number One Home Builder for the seventh consecutive year,” said Bill Burgess, Minnesota Division President. “We appreciate that every year more home buyers are recognizing the Lennar difference — great neighborhoods, innovative designs, and luxury-included features, all designed around your families’ future.” All of the top five ranked builders are national firms with corporate offices located outside of Minnesota. Rankings changed slightly as Ryland

Homes and D.R. Horton - Minnesota swapped rankings. Following Lennar were The Pulte Group (marketing homes under both Pulte Homes and Centex Homes) with almost $120.5 million in revenue and 284 housing units closed, followed by Ryland Homes with $88.5 million revenue and 271 housing units, D.R. Horton-Minnesota with revenue of almost $72 million and 205 units, and Mattamy Homes at $70.3 million and 243 units. Rankings are based on information provided by survey respondents. Respondent information is believed to be reliable. Each company has verified information to the best degree possible. Commercial construction firms building rental or senior housing were not included in this ranking. THE RIGHT PATH FOR MN HOME BUILDERS… And now is the right time to join us. We’ve learned a lot over the past two years as we developed our energy-focused green build program. We started out knowing that today’s buyers are mostly about energy efficiency and saving dollars on their future energy bills. We also knew that building today is about providing the right choices to your clients, no matter how much or how little green they want. And, we knew we had to offer a process for builders that was, in a word, simple. To meet these goals we started by creating a program that used the national RESNET energy-testing system (and its HERS index) and partnering with local rater, Residential Science Resources (RSR), to develop an online tool to make the builders’ process simple. We followed that up by creating the MN Green Path Home Performance Report (HPR), our independent, third-party documentation for showcasing a home’s energy performance and green features. We launched over a year ago to the public and discovered a couple of things. We were definitely correct that buyers are willing to invest a little in energy-efficiency, but those wanting the more costly, higher levels of green are still a very small niche (though we think that will begin to change as the Millennials move into the market).
We learned that for most builders, any additional steps in the building process were too many. We also found that the HPR really does help homebuyers feel confident about the energy and green features in a home without having to understand a lot of confusing language about insulation and r-values.

Kraus-Anderson Rebuilds Tornado Torn School

The Minnesota Construction Association (MCA) honored Kraus-Anderson Construction Company in January for their outstanding work on the Wadena-Deer Creek Middle and High School project. The highperformance school replaces one that was destroyed by a tornado. Construction was completed on an aggressive 15-month schedule, and included tile enhancements, energy efficient features and a multitasking safe room shelter.

Permeable Pavers vs. Concrete Pavers AZEK VAST Permeable Pavers were selected by The University of Minnesota - Duluth (UMD) to be tested side by side against traditional concrete pavers from 2007. An Unusual Retirement Party It’s not an employee they’re toasting, but rather a window. CONDOLENCES A Remarkable Life Our sympathies to the family of Daryl Doehr, Marvin Windows and Doors, at the passing of his father Lyle W. Doehr, 91, who was peacefully taken to his eternal home in heaven with Jesus on January 11, 2013. He lived a remarkable life with wife Hazel, their four children, thirteen grandchildren and 29 greatgrandchildren.
Reunited Again Our condolences to the family of Sven Gustafson (Stonewood, LLC) for the loss of his father, Jeff Gustafson, following a nine-year battle against pancreatic cancer. Jeff ascended into Heaven on March 18th to be reunited with his life-long love and Edina High School sweetheart, Ethel. Our thoughts and prayers go out to the couple’s five children and four beautiful grandchildren.

A very special congratulations to Katherine Harms for being named an All American at the University of Minnesota for Women’s Volleyball. The team finished 8th in the country and Katherine received MVP, Big 10 and All Regional honors. She will graduate this year with a degree in Business Marketing, a minor in Communications, and will look to play professional volleyball in Europe next season.
