Senate takes first step toward addressing exclusionary zoning As the Minnesota Legislature convenes for its 2022 session, legislators find Minnesota’s housing market facing historic headwinds. The inventory of available homes is consistently at or among the worst in the United States, the homeownership equity gap measures the worst in the country and new-home housing affordability in our state is the worst in the Midwest. These challenges merge with a broader legislative backdrop featuring an enormous state surplus and fierce debate on where to spend those dollars. With the state budget completed last year, the 2022 session is the second half of the biennium, traditionally known as a “bonding” year, in which capital project spending is the centerpiece of the debate. Within this busy schedule, housing is expected to find a prominent place on the policy and fiscal calendars. “The state of Minnesota is staring down one of the most profound housing shortfalls in the country,” stated Rep. Jim Nash
(R-Waconia), co-chair of the Legislative Commission on Housing Affordability. “The Legislature must act rapidly to address that crisis.” The Legislative Commission on Housing Affordability’s activity throughout its fall meeting schedule foreshadowed a focus on increasing housing supply by boosting the construction of affordably priced homes. The testimony provided to the commission was heavily focused on policy changes that would lift roadblocks that are currently limiting the construction of affordably priced homes. One of the leading efforts to address this problem has emerged from a collection of proposals authored by Rep. Steve Elkins (DFL-Bloomington). The Elkins proposal addresses many land use, permitting and public finance issues that inhibit housing construction. The bill also addresses the use of Planned Unit Developments (PUDs), which are frequently used by many municipalities to extract unique and costly development requirements in order to achieve
approval of housing projects, thereby driving up the cost of homes. The broad use of PUDs runs counter to the original legislative intent of creating PUD options, which was to provide a tool for local governments and property owners to navigate unique circumstances in a given project. However, over time, cities began using the PUD process almost exclusively to approve housing developments, according to housing industry leaders. Housing industry groups have focused on PUD reforms, along with other modernization efforts in zoning approvals and permitting. “The urgency of the housing crisis can’t be overstated,” said David Siegel, executive director of Housing First Minnesota. “If we want Minnesota to remain competitive and to attract the brightest in today’s workforce, the legislature must work on substantive housing policy reform proposals. These will be challenging debates, but the moment

Experts predict little price relief for housing in 2022 The 2021 housing market was one of high demand for homes and short supply. This imbalance led to double-digit growth of home prices month after month, and experts predict the trend will continue well into 2022. According to the Minnesota Realtors®, the number of homes for sale across the entire state fell to just 7,121 homes in December. At the end of 2021, there was “barely a month’s supply” of homes for sale on the market. A healthy housing market has five to six months of supply of available homes for purchase. New opportunities in 2022 Despite historic supply chain issues and ongoing COVID-19 challenges, we built more homes in 2021 than in any year since 2006. The natural questions for many of us in the housing industry revolve around what lies ahead in 2022 as we try to build upon last year. We know there will be challenges. Every company in our industry is being impacted by supply chain issues in one way or another. As much as we hope this evens out quickly, experts urge patience as the system works toward a new normal. We also know that interest rates will be closely watched. Many of the affordability challenges over the past couple of years were mitigated in part by historically low interest rates. Industry experts are forecasting incremental interest rate increases throughout 2022, which will further challenge affordability. Despite these challenges, there are many opportunities in 2022. Generational demand for homeownership is increasing. Those who were waiting to move into homeownership are now

impatient to act. The challenge lies in the lack of available homes for purchase throughout our state. But that challenge has paved the way for an opportunity. Leaders in Minnesota are seeing the housing roadbocks for the threat they pose to the competitiveness of our state and the lives of so many Minnesotans. The Minnesota Legislature will have the opportunity to lift barriers that are currently in the way of our industry providing more homes at affordable prices. We know the market needs options at all price points, including starter homes, which have largely vanished from Minnesota. We know there will be bumps in 2022, but we also know that these have given way to opportunities to modernize how we approve housing projects. Let’s take this opportunity to ensure that everyone has an opportunity to own a home!

Building Code TAG completes work; some proposals head to Legislature Housing affordability legislation review completed Talk of comprehensive housing policy reform at the state Capitol has gained the interest of the Minnesota Department of Labor and Industry (DLI). In September 2021, DLI formed a Technical Advisory Group (TAG) to review several pieces of legislation expected to be part of the 2022 legislative session. In the final two months of 2021, the TAG reviewed changes to the annual construction and development fee report, adult-size changing table requirements, energy code provisions and residential building permit fees. The state’s Construction Codes Advisory Council (CCAC) accepted the TAG reports at its January 2022 meeting. Construction and development fee report A bill from Sen. Mark Koran (R-North Branch) seeks to provide DLI with more direction on the construction and development report that municipalities are required by law to complete each year. Many of the recommended changes were already made by the department when it revised the most recent annual report format. However, one aspect does require legislative action: increasing the threshold beyond which the report is required for a municipality from $5,000 in permit activity to $7,000. The TAG report was supportive of raising the threshold. In 2020, the most recent reporting year, 20% of municipalities did not meet the existing threshold of $5,000, and Koran’s bill would further reduce the number of municipalities required to complete the report. DLI pledged to work with stakeholders to address the remaining concerns over the report. During the meeting, State Building Official Scott McLellan reported that DLI is working to increase transparency surrounding the report. Currently, reports are available on an individual basis and raw data must be requested by the public. DLI is working on a new interface that will allow the public to access multiple reports concurrently. Adult changing tables The Building Code TAG also reviewed a proposal from the 2021 session regarding adultsized changing tables. Due to the requirements of these devices, there are structural design specifications that would be affected by this legislation. There are model code requirements surrounding this topic that are likely to be included in the 2024 International Building Code. During the TAG review, the narrow focus of this provision, the pending model code language and significant impact on structural design specifications were noted. The TAG recommended proceeding with the model code language during the next code series update. Code adoption and Energy Code payback In 2020, the Senate Select Committee on Homeownership Affordability and Availability released legislation that would have kept the 2020 Minnesota Building Code in place until 2026, and called for state law to establish a payback period on the residential energy code for future energy code updates.

This proposal is similar to a concept included in drafts of Rep. Steve Elkins’ (DFLBloomington) upcoming comprehensive housing reform bill. The TAG was unable to reach consensus on this proposal. Square footage building permit fees Both Elkins and Sen. Rich Draheim (R-Madison Lake) are proposing legislation that would calculate new-home building permit fees based on square footage as opposed to the current practice of valuation. Similar legislation has been introduced in other states. According to Nick Erickson, director of research and regulatory affairs at Housing First Minnesota and a TAG appointee, there is no consistency when the valuation methodology is used. “Valuation is only ‘sticks, bricks and labor,’ and land is not included,” Erickson said. “When a builder is building the same home in Blaine, Prior Lake, Lake Elmo or Farmington, the valuation should be the same. Yet we see variances that are more than 50% of a home's value.” In the report accepted by CCAC, DLI would be supportive of a measure that would “adopt rules to establish a uniform statewide valuation based on a square foot construction cost for new one- and two-family dwellings and townhouses.” Sample legislative language was included in the TAG report for legislators to consider. Next steps The TAG review of these issues was completed to inform legislators and to help provide feedback from technical experts. “While addressing these issues is important and we commend DLI for its engagement, a piecemeal approach to affordability is inadequate,” said David Siegel, executive director of Housing First Minnesota. “Fixing housing in Minnesota is simply not possible without reimagining our state’s housing policies and our development approval processes,” stated Siegel in a letter to CCAC. Siegel noted that a comprehensive approach to addressing the housing crisis was a recommendation of the 2018 State Task Force on Housing formed by former Gov. Mark Dayton. “Across the nation, state legislatures, including our own, are looking at ways to increase housing access and affordability by breaking down the barriers to desperately needed new housing construction,” Siegel wrote. Charlie Vander Aarde, a TAG member with the Association of Metropolitan Municipalities, addressed CCAC and raised concerns over the proposed legislation. Local governments, the primary permitting entity for all new housing, have opposed similar housing affordability legislation over the past few years. Elkins, whose legislation was a central part of the TAG, said he was looking forward to integrating the report into his broader package that will “legalize affordable homes.” Elkins noted that his bill seeks to remove the financial incentives for local governments when they “over-zone for large executive homes,” an approach known as fiscal zoning.
OSHA COVID vaccine and testing requirement invalidated by US Supreme Court Ruling impacts MNOSHA rule The U.S. Supreme Court invalidated OSHA's COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS) in a 6-3 ruling on Jan. 13. OSHA's ETS covered large employers with 100 or more employees and required these employers to develop, implement and enforce a mandatory COVID-19 vaccination policy, with an exception for employers that instead adopt a policy requiring employees to either get vaccinated or elect to undergo regular COVID-19 testing and wear a face covering at work instead of vaccination. In the unsigned opinion, the court stated, "Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly. Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category." The challenge was brought forward by the National Federation of Independent Businesses after OSHA published the ETS in November 2021. On Jan. 3, Minnesota became the first state to adopt the ETS at the state level when it adopted the rule by reference. The ruling from the nation's top court invalidates the MNOSHA ETS as well. Following the ruling, MNOSHA sent out a notice suspending the ETS enforcement "pending future developments." MNOSHA also noted that the ruling does not impact other separate COVID-19 regulations. "MNOSHA will continue to enforce all employers' obligations under the general duty clause and its general standards, including the Personal Protective Equipment (PPE) and Respiratory Protection standards," the agency said. The ruling does not impact a similar requirement for vaccination and testing in a health care setting.
State assumption of federal program could streamline land use applications State of Minnesota issues report on cost of state assumption of Section 404 of the Clean Water Act The state of Minnesota has released a draft report outlining the funding estimates for state assumption of Section 404 of the U.S. Clean Water Act, which covers the discharge of dredged or fill material into waters of the United States. The program in Minnesota is currently administered by the United States Army Corps of Engineers with additional oversight by the United States Environmental Protection Agency (EPA). The shift to state assumption of the program would eliminate the need for separate, federally issued permits that exists today in Minnesota. “Minnesota has one of the most complex approval processes when it comes to water and new home development,” said Nick Erickson, director of research and regulatory affairs for Housing First Minnesota. “Anything that simplifies the process is a welcomed change. The housing industry is carefully watching this proposal since, if implemented properly, it can reduce barriers to the approval of new communities.” Minnesota has been considering assuming control of the program since 1989, but it was not until 2019 that the Minnesota Legislature directed the Minnesota Environmental Quality Board to assemble the materials needed for the application to assume state control of Section 404. The draft report shared with stakeholders in January is the result of legislation in 2021 that allocated state funds to complete an evaluation with regard to the state takeover of the program. That report indicates $740,000 in additional state funds are needed to finalize the application, split across three agencies: Board of Soil and Water Resources, Department of Natural Resources and the Minnesota Pollution Control Agency. Assumption of the federal program is not a simple process. Minnesota must first identify all state statutes and rules requiring changes, develop a program infrastructure and submit a comprehensive report to the EPA outlining the program it aims to implement. Only after a memorandum of agreement has been signed by both the Secretary of the Army and the EPA regional administrator, as well as an approved application for 404 assumption, can the program be moved to Minnesota.

MNDOT initiates airport zoning regulation changes
The proposed regulations establish the parameters within which airport zoning boards or other local municipalities adopt zoning controls directly tied to a local airport.
The Minnesota Department of Transportation (MNDOT) Office of Aeronautics has initiated a comment period on its regulations for airport zoning in the state. These regulations establish the parameters within which airport zoning boards or other local municipalities adopt zoning controls directly tied to a local airport, which can have an impact on residential construction and other forms of construction around airports. MNDOT says the proposed amendments to existing regulations will bring the zoning control standards into conformance with statutory changes made in recent years and provide greater flexibility to municipalities. In addition to updating zoning control regulations, MNDOT is also seeking to introduce rules into state law that outline the funding of airport clear zone acquisition, a program that enhances aviation safety by ensuring compatible land use. MNDOT’s proposal seeks to take its existing standards and codify them into rule. MNDOT’s comment period on airport zoning regulations is open through April 2022.

Window cleaning code requirements, new floodproofing regulations forthcoming; MDH issues stormwater reuse white paper Last legislative session saw bills introduced in both chambers to establish when window cleaning anchors are necessary on buildings. The legislation has been sponsored by Sen. Karin Housley (R-Stillwater) and Rep. Bob Dettmer (R-Forest Lake). Window washing anchors are deployed in certain situations to enhance washing safety. The Minnesota Department of Labor and Industry (DLI) formed a Technical Advisory Group (TAG) earlier this year to evaluate the legislation. The TAG submitted a report to DLI’s Construction Codes Advisory Council (CCAC) that unanimously recommended rulemaking that will allow for further clarification of window cleaning safety standard requirements and allow building officials to approve alternative methods. The TAG included a variety of groups including multifamily building owners, the professional window cleaners union, architects, engineers, DLI and MNOSHA staff, and a local building official. Floodproofing rulemaking authorized At its Jan. 20 meeting, CCAC initiated the final stages of rulemaking on floodproofing construction regulations in Minnesota. The state’s floodproofing regulations were last updated when the 1972 Army Corps of Engineers floodproofing regulations were adopted nearly five decades ago. The American Society of Civil Engineers (ASCE) Standard 24-14 Flood Resistant Design and Construction
went through a technical review in 2021 and will only apply to homes built or undergoing significant renovations in an existing floodplain. Stormwater reuse report The Minnesota Department of Health (MDH) issued a report on the reuse of stormwater and rainwater in Minnesota, often referred to as greywater. The report outlines recommendations in several key areas of stormwater reuse systems including the management, design, operations and maintenance of these systems, as well as the distribution of greywater and the monitoring and reporting of greywater quality. The topic of water reuse has been gaining attention from policymakers as the broad issue of energy management receives more attention and environmental issues continue to draw consideration. In 2018, Minnesota convened an interagency workgroup to examine the public health and environmental impacts of water recapture and reuse. “While recognizing the value of stormwater reuse systems, we have also learned that there are potential public health risks associated with these systems,” the new MDH report says. “Managing and operating a system properly also requires training and attention. It is important to understand there are limitations to current knowledge and data availability on some sources of reuse. It is also important to protect the public’s health when we have evidence of risk.”
Many in Minnesota’s housing industry would like to see a greater ability to capture and reuse graywater. However, in the present regulatory environment, reinforced by the new MDH report, reuse of graywater in residential construction is severely limited. New plumbing board leadership, technical plumbing code updates Rick Jacobs, longtime Minnesota Plumbing Board chair, stepped down from the board last year. At its January meeting, the Plumbing Board elected Richard Becker, an associate with Steen Engineering and the board’s past secretary, as its new chair. Kent Erickson, a plumbing inspector in Mankato, was elected as the new secretary to fill the role vacated by Becker. The Plumbing Board, which operates under DLI, also announced that a minor technical update to the recently adopted plumbing code will be going into effect soon. According to the board's website, “it came to the board chair’s attention that due to renumbering, when combined with the existing and soon-to-be-effective Minnesota amendments, there are some provisions of the 2018 Uniform Plumbing Code (UPC) that were inadvertently retained and conflict with Minnesota amendments that were vetted by the board and the public. The board is seeking to clarify the 2018 UPC by deleting the UPC sections that were inadvertently retained and that conflict with the existing and soon-to-be-effective Minnesota amendments.”

If we fail to act, the next generation of homeowners will stand on the sidelines and watch helplessly, and legacy wealth will disappear.” Zoning and permitting proposals are not only being considered in Minnesota. States such as Colorado and Connecticut are working through similar proposals to lift housing construction roadblocks. California has passed the most sweeping housing policy reform, in response to its collapsed housing market. “It would certainly be regrettable if we had to reach the crisis levels seen today in California before we act,” said Siegel. Solving the issue in 2022 will be a major challenge for the Legislature and Gov. Walz, but housing leaders see an urgency that is expected to fuel this debate throughout the session. “The future of our state depends on our action. If our children and grandchildren hope to buy a home, we must remove obstacles that prevent the construction of stater homes,” Nash concluded.

New maps ahead in 2022 Minneapolis and St. Paul are each navigating different paths to enacting rent control policies.
Rent control policies in limbo Following referendums passed by both Minneapolis and St. Paul voters in November, each respective city has been navigating different paths to enacting rent control policies. In St. Paul, voters passed a very specific law that would only allow a maximum 3% increase in rent annually, but Mayor Melvin Carter and some members of the St. Paul City Council are still looking for ways to amend the language. One change that has been discussed would be to remove new construction from the 3% limit before the ordinance's expected May enactment. The concern as outlined by Carter, some Council members and other experts is that the rent control limit is a disincentive for new rental construction in the city. On the other side of the river, a handful of newly elected and reelected members of the Minneapolis City Council are pushing for a similar policy to St. Paul’s, with a possible increase indexed annually for inflation as well. Council Member Elliott Payne expressed urgency in moving forward. “That’s going to be one of the very first things we do, because I think rent control is going to be one of primary policy tools for stopping the displacement [of renters],” Payne told Axios Twin Cities. However, Mayor Jacob Frey is expressing concern about such a proposal. Frey voted in favor of the referendum in November. The Council is expected to discuss draft legislation in the coming months.

In April 2021, the final U.S. Census data was released and with it came a sigh of relief from nearly every Minnesotan across the political spectrum. By a razor-thin margin of 89 people, Minnesota retained eight congressional seats in Congress, narrowly beating out the state of New York and holding on to our current number of seats. Since then, there has been little agreement about how to redraw the congressional and legislative maps for the upcoming decade. Redistricting is extraordinarily significant in that it can have a major impact on the likelihood of one party or the other to experience success in a legislative district. With a divided Legislature, most political observers expected to have maps drawn in the way that it has been done since 1980, through the courts. While both the DFL majority in the Minnesota House and the GOP majority in the Minnesota Senate have created and presented their own plans, neither is expected to be accepted by the other prior to the required Feb. 15 deadline, though there may be votes on the floor of each chamber.
In the meantime, the Minnesota Supreme Court has appointed a panel to hear from interested parties and to draw maps of their own. Four separate groups spanning the political spectrum have proposed redistricting maps. When drawing maps, there are four state-based requirements: contiguity, that all areas with a district be physically adjacent; compactness, that constituents within a district should live as near to one another as practicable; the districts should be communities of interests; and that state legislative district lines take into account other political boundaries (counties, cities, school districts). As the Legislature continues to work, there will likely be much discussion and possible votes on redistricting. But most likely, the final map will be released on or following Feb. 15 from the courts. Once the map is confirmed, many legislators will have decisions to make. Some will be moved into new districts, some may decide to run for a different office and others may see the newly created districts as unfavorable and decide to retire.

Even as the pace slowed at the end of the year, new home construction in the Twin Cities metro area hit levels not seen in 16 years. A frenzied pace in the beginning of the year slowed as shortages in the supply chain, labor challenges and other headwinds tempered home construction. Area homebuilders pulled 629 permits for new single-family homes in December 2021, an 8% drop from December 2020.

Minnesota’s unemployment dropped slightly on a seasonally adjusted basis to 3.1% in December, according to the Minnesota Department of Employment and Economic Development. This is compared to the November unemployment rate of 3.3%.
The Overall Remodeling Market Index is calculated by averaging the Current Marketing Index and the Future Market Indicators Index. Any number over 50 indicates that more remodelers view remodeling market conditions as higher than the previous quarter. Results are seasonally adjusted.
The national unemployment rate also decreased from 4.2% in November to 3.9% in December. Construction in Minnesota recorded a 7.7% employment growth, or 8,894 jobs, since December 2020.

Experts predict little price relief for housing in 2022 With so few homes available, it is a seller’s market, pushing prices even higher. Housing First Minnesota estimates that the state is now short more than 62,000 housing units. “The increasing median and average price for homes reflects the fact that buyers are still actively competing for properties. Limited inventory will continue for the foreseeable future due to escalating construction costs, labor and materials shortages, zoning requirements and regulatory burdens,” said Chris Galler, CEO of Minnesota Realtors. According to a 2021 report titled "Housing is Critical Infrastructure: Social and Economic Benefits of Building More Housing" by the National Association of REALTORS® (NAR) comparing the last two decades of annual housing production with the prior historical period (19682000), every major region of the country heavily underbuilt housing. NAR estimates that to fill an underbuilding gap of at least 5.5 million housing units nationally during the next 10 years, while anticipating growth based on historical trends, homebuilding would need to accelerate to a pace that is well above the current trend, to more than 2 million housing units per year. In concert with virtually all national housing experts, NAR finds the only solution to bring the market back into balance is to dramatically increase the pace of new home construction and expand the supply of all types of housing. “It is the only way to substantially reduce the
size of the current demand-supply gap and thereby stabilize housing costs in a more affordable range,” states NAR. “In this strained environment, addressing the underbuilding gap that the nation faces would help alleviate some of these affordability challenges and promote economic opportunity.” With the global pandemic making homeownership more desirable and millennials entering their peak homebuying age, the demand for new homes has been pushed to new highs. Economist Dr. Elliot Eisenberg predicts that demand will remain elevated for years to come. With homebuilders currently unable to build entry-level homes, home prices will continue to soar in 2022. “Anti-development attitudes make it very tough to build. Supply chain problems and the high prices they create prevent entry-level homes from being built,” said Eisenberg. “On top of that households currently have ample wealth to spend on housing, and rates remain low.” Minnesota is uniquely disadvantaged to tackle this problem. According to a report by Housing First Minnesota, the state is the costliest market in the region in which to build new homes. The median price for a new single-family home in Minnesota was $444,000 by the end of 2021. The next closest state in the region was Illinois with its average new single-family home costing $366,000 in 2021, some $78,000 less. Wisconsin’s average price for a new single-family home was $346,000 in 2021, a nearly $100,000 difference in price.

Minnesota’s workforce continues to improve into 2022 Minnesota’s unemployment rate fell slightly to a seasonally adjusted rate of 3.1% in December as more job vacancies continue to fill across the state, according to the Minnesota Department of Employment and Economic Development (DEED). This is compared to the November unemployment rate of 3.3%. The national unemployment rate also saw a slight decline from 4.2% in November to 3.9% in December. Although the year-over-year declines show promising economic stabilization in the wake of COVID-19, labor force participation remains to be a concern going into the new year. Minnesota’s labor force participation saw no significant growth in December and held steady at 67.7%. Furthermore, Minnesota recorded the first month-over-month drop in available jobs in 12 months. 2,000 jobs in December, compared to November’s large jump of 13,600 jobs added. “Today’s jobs report is a reminder that economic progress in these times is not a straight line,” said DEED Commissioner Steve Grove. DEED also reports that at the onset of the COVID-19 pandemic, Minnesota lost a total of 416,300 jobs from February through April 2020. Since then, they estimate the state has recovered 74% of those jobs. Construction in Minnesota recorded an employment increase with a 7.7% employment gain, or 8,894 jobs, since December 2020. Most other industries also saw growth in employment year-over-year. The leisure and hospitality sector saw the largest uptick with a 64.2% increase since last year as they continue to recover from the pandemic and the sharp employment declines through most of last year. In the Metropolitan Statistical Areas, employment growth rates were all up: Minneapolis-St. Paul MSA up 5.3%, Rochester MSA up 5.6%, St. Cloud MSA up 4.8%, Duluth-Superior MSA up 4.9% and Mankato MSA up 4.5%.

The Federal Reserve made the decision in 2020 to slash interest rates to preempt possible economic consequences due to the COVID-19 pandemic. As a result, the housing market ignited as buyers rushed to lock in these record-low rates. Since then, rates have remained relatively low. However, the economic situation with COVID-19 continues to evolve and inflation has become a greater concern. The Federal Reserve has indicated that interest rates will be adjusted throughout the year as a result. As a result, mortgage rates are at their highest levels since March 2020. "Mortgage rates increased significantly across all loan types last week as the Federal Reserve's signaling of tighter policy ahead pushed U.S. Treasury yields higher. The 30-year fixed-rate hit 3.52%, its highest level since March 2020,” noted Joel Kan, associate vice president of economic and industry forecasting for Mortgage Bankers Association (MBA). According to Freddie Mac, the rate for a 15-year fixed-rate mortgage rose to 2.62% in January 2022 compared to 2.43% at the same time last year. According to the latest report from MBA, this policy change has not yet fostered a notable slowdown in the frenzied market. In the first week of January, mortgage applications increased 1.4% compared to the previous week. In an already heated housing market, these rate increases may lead to a greater surge in demand as potential buyers look to secure current rates before they continue to increase. Although increased rates may temporarily create more stress on the market, this may not be sustained as 2022 progresses. Increasing rates along with always-climbing home prices may force many buyers out of the market throughout the next year. “The rise in mortgage rates so far this year has not yet affected purchase demand, but given the fast pace of home price growth, it will likely dampen demand in the near future,” said Sam Khater, chief economist at Freddie Mac.
Building material prices continue roller coaster ride The price of material for new homes continues to spiral up and down as the supply chain remains unstable following the impacts of COVID-19 and the pentup demand for new housing. Building materials prices increased 15.9% in 2021 and have climbed 18.6% since December 2020, according to the latest Producer Price Index (PPI) report released by the Bureau of Labor Statistics. On the lumber side, just as homebuilders were starting to see some relief in costs, prices started to climb again. According to the National Association of Home Builders (NAHB), the PPI for softwood lumber (seasonally adjusted) increased 24.4% in December and has shot up 44.5% since September. NAHB reports the volatility in lumber prices at this level has not been seen since prices were first Softwood Lumber Prices January 2018December 2021
recorded. The monthly change in softwood lumber prices averaged 0.3% between 1947 and 2019, according to NAHB. In contrast, the percent change of the index has averaged 12.0% since January 2020—the highest 24-month average since data first became available 1947 and nearly triple the previous record. “The price and availability of building materials, and the supply chain in general, remains the most pressing, immediate challenge for builders as they seek to add housing supply,” said Chuck Fowke, chairman of the NAHB and a custom homebuilder from Tampa, Florida. “Policymakers must focus on easing production bottlenecks and eliminating tariffs on Canadian lumber to help address the issues builders are currently facing.” Gypsum products prices ended the year 18.2% higher than they were in January of 2021, but they started a downward trend in November, according to NAHB. Steel mill products prices rose 0.2% in December, which is the smallest monthly increase for the products since September 2020, according to NAHB. Monthly price increases have slowed in each of the past five months.

Solving the construction industry’s labor crisis Q & A with project manager and 2022 president of Project Build Minnesota, Dan Beaving Dan Beaving has just started his second term at Project Build Minnesota, the nonprofit founded by Housing First Minnesota, Minnesota Builders Exchange, Associated Building Contractors and The Builders Group to highlight careers in construction to young people and make construction an industry of choice. Under Beaving’s leadership, Project Build Minnesota has reached into Minnesota classrooms to address students and organized the first-in-a-decade Construction Teachers Conference, bringing both high school and post-secondary construction teachers together to share best practices.

Q: What do you hope to accomplish this year with Project Build?
DB: Workforce development has always been a concern in our industry. However, due to the sharp decrease in new employment numbers and with the median age of the construction workers rising, it has moved to the top of the list of concerns.
DB: Our main goal is to make sure the younger generation has all the information they can get on careers in trades so they can make an educated decision on which path they should take.
Q: What are the biggest hiring challenges you are seeing in the current labor market? DB: The challenge we are seeing the most is that young adults have a preconceived idea that the construction industry is hard work with long hours for little pay. In reality, it is completely the opposite. With little to no education
Q: Why is Project Build so important for the construction industry? DB: At Project Build, we found that most young people looking into careers had little knowledge of the benefits that the construction industry can provide. With rising pay rates and top-notch employee benefits, trade schools or on-the-job training should be highly considered versus the traditional four-year degree.
Q: What does the industry need to help people to understand about working in construction? DB: On top of being highly compensated, I feel that construction gives a higher sense of pride that other industries may not. Seeing people enjoy and use that building we created really helps cultivate the ‘I helped build that’ mentality that all of us in the construction industry strive to have.

Progress on new home for veterans
The four-bedroom home in North Minneapolis will also include an ADU, providing much-needed living space for veterans.
The Housing First Minnesota Foundation/HomeAid Minnesota is nearing the completion of a new home with an accompanying accessory dwelling unit (ADU) for veterans experiencing homelessness in the Twin Cities. The Foundation and build partner Lennar broke ground on this latest Housing for Heroes project in November 2021. The home, located in North Minneapolis, will feature four bedrooms and two bathrooms. The ADU will feature an additional bedroom, bathroom and small living area. When completed, the home and ADU will be handed over to the Minnesota Assistance Council for Veterans (MACV) in a key cermony. MACV will own and operate the home, providing wraparound services that help bring these veterans back into a stable environment. “This new residence will provide veterans with dignified housing and supportive services they need to transition into independent living,” said Kate Hamilton, the 2022 Housing First Minnesota Foundation president from Custom One Homes. The ADU will provide MACV with additional space for veterans who may require more space or privacy to find success. This is the sixth home the Foundation has built in partnership with Lennar and MACV. The Foundation estimates this one project could serve up to 640 veterans over 50 years. Several additional homes for veterans are planned for 2022.

Pulte opens sales for Highland Bridge
St. Paul housing projects on pause
More single-family rentals in Woodbury
Buyers can start submitting offers for the first 22 rowhomes on Pulte Homes’ Highland Bridge development, which was formally the Ford Motors Company manufacturing plant in St. Paul. The new construction property’s starting prices will be between $594,000 and $763,000. The process was set up to move quickly with multiple offers being accepted from Jan. 18-20, confirmation of purchases on Jan. 21, and signing of purchases agreements starting on Jan. 22. Future residents are expected to move in sometime next summer.
Several St. Paul multifamily housing projects were put on hold due to financial concerns over the rent-control ordinance passed this November. The Lexington Station apartments in Frogtown had their fair share of hurdles even before the new law took effect when community groups and the St. Paul City Council attempted to block the project due to a lack of low-income units. Mayor Melvin Carter vetoed the blocking, but even with mayoral approval, concerns over rent control have soured investors. Developer Alatus lost financial backing for the $70 million Lexington Station apartments citing rent-control concerns being the reason. The new calculus on multifamily properties will make them harder to finance in Minneapolis and St. Paul, which keeps developers reluctant to take on new ventures. Although Carter has expressed interest in modifying the ordinance to exempt new construction from the rent control cap, no concrete steps have been taken towards this measure.
An affiliated company of Watermark Cos. of Illinois recently purchased a development site in Woodbury for $11.7 million promising to bring dozens of new single-family rental homes to the market. Canvas at Woodbury North will include 89 lots and various amenities, including a clubhouse and a pool. This is Watermark’s second development in Woodbury, previously building the 81-home Canvas at Woodbury South community. According to their website, Watermark specializes in building single-family communities “designated specifically for rent,” and they also have a similar project in the works for a 120-unit development in Inver Grove Heights. The company has offices in Illinois, Minnesota and Colorado.
