letter from the eo
Of, By and For the Builders We’ve been having powerful and important discussions with a key segment of our membership, our high-end custom builders, regarding the Artisan Home Tour. We’ve discussed together that the Artisan Home Tour is of, by and for the builders. But what does that actually mean and how does that statement, of by and for the builders, relate to the broader mission and vision of BATC? I’ve been thinking a lot about that as we close out 2015. It means first and foremost that our tours are literally owned by you—our members. BATC members have owned the Parade of Homes tour for more than 60 years, and they’ve nurtured, protected and grown that brand successfully for the good of the entire industry. So we’ve got a pretty good track record. We want to carefully nurture, grow and protect the Artisan Home Tour for the benefit of our members and industry as well, today and for the next 50 years and beyond. That’s really the key here—our motivation in owning any of our assets is slightly different than that of a typical business. While for a typical business, profit is the primary motive, such is not the case for BATC. Our calling is to grow this industry overall and to create an environment in which our members can grow their businesses. Don’t get me wrong, we do want to make money on our events even as a nonprofit. We need to be financially responsible. But it’s not goal one. And whatever profits we do generate, we drive back into this industry. Every dollar raised in any BATC activity is used toward our mission—helping our member businesses grow through marketing, advocacy and industry connections, and toward our vision to be the leading voice for builders and remodelers.
Those dollars drive our public policy efforts, where we seek to minimize the regulatory burden on our builders, create open markets and keep government in check so you can grow your business. Those dollars drive our industry connections where our members participate in education, awards programs, networking events and leadership training, all of these are the glue that holds our industry together. Those dollars drive innovation and reinvestment in the Parade of Homes and Artisan Home Tour, from technology to creative design to brand protection and promotion. Those dollars drive our BATC Foundation, whose good works not only affect positive change in the world, but create a wonderful halo over our industry for lawmakers and policy makers to ponder. Everything we do here at BATC is of, by and for the builder. In short, we exist to make the business environment and opportunity better for you. Our leadership is passionate about this cause. Our staff team is passionate about this cause. And what I’ve come to realize even more clearly over this past year, is that our entire membership is passionate about this cause. Your Board has worked very hard over the past year to fulfill our mission and vision. For me, it’s been an action-packed year of big issues and big decisions for BATC. What gives me goosebumps is that every action we took was of, by and for the builder. You can’t get more powerful and true than that.
Our tours are literally owned by you—our members. BATC members have owned the Parade of Homes tour for more than 60 years, and they’ve nurtured, protected and grown that brand successfully for the good of the entire industry.

a word from our president
It’s Been Quite a Year One of our past presidents recently commented that we will look back five or 10 years from now and see 2015 as one of the most pivotal in BATC’s history. It’s humbling and a bit scary to ponder that thought because as your elected president, I take very seriously the charge you gave me to lead BATC well! Thankfully, I’ve got a great Board of wise men and women and a strong BATC staff providing counsel and guidance. I want to assure you that we seek in every decision to serve our members and our industry, meet our mission and achieve our vision. As we enter Q4 of 2015, we can look back and see major progress on several initiatives; and several that are still developing. It’s really been a phenomenal year already.
Builder Day at the Capitol It was a personal goal of mine to grow Builder Day at the Capitol this year, and that we did. We held the event in cooperation with our state association and I was proud that we registered some 250 for the event. We’re moving to the St. Paul Hotel in 2016 with room to drive attendance even higher. Mark March 15 on your calendar NOW and please come to this must-attend event that showcases the power and impact of the home building and remodeling industry on Minnesota’s economy.
NorthStar MLS A task force of bright builders and REALTORS came together to identify barriers to putting newly built homes on the MLS. The result? We engendered major changes in new home fields on the MLS — a huge accomplishment for BATC and our REALTOR friends. (See details on page 34).
Parade of Homes Research It’s vital, with a 67-yearold tour, that we conduct the necessary research to elevate this mature but well-loved brand to the next level and meet the needs of the future
buying public. The great news is that our Parade of Homes remains beloved and continues to play a central role in the buying behavior of new home buyers and those seeking remodeling. This research will drive our decisions for the next strategic planning process as we strengthen and enhance the Parade. See key findings beginning with page 12.
Successful Parades Regarding Parade of Homes, we act as if putting on two huge events is “no big deal,” but we need to stop and take a bow for continuing to execute flawlessly the largest Parade of Homes in the country, which continues to create great value for our members.
Artisan Home Tour Our second annual tour was a tremendous success, with dramatic growth in the number of average visits per home and in the traffic at our top home. The Artisan Home Tour is of, by and for our builders, and directed by a unique committee of builders in the high-end space. Proceeds benefit BATC, which is working yearround on behalf of our industry, and the nonprofit BATC Foundation. We are hard at work on the 2016 tour, adding even
more new features. We look forward to continued growth to serve this important segment of our membership.
Membership Survey We completed a comprehensive membership survey this year working with four MBA students from the University of St. Thomas. The survey revealed that BATC continues to be a much-desired association with powerful connections to its members. Overall, member satisfaction is exceptional
Housing First Sets Sights on 2016 Elections Housing First, BATC’s independent expenditure Political Action Committee, has been a game-changer in achieving our strategic goal of being the premier brand for our members, and our vision to be the voice of builders and remodelers. Through Housing First, we run campaigns on behalf of candidates who are friends of housing. In 2014, we had a major impact on the election, working in cooperation with the Minnesota Chamber of Commerce and Minnesota’s other major business trade associations. We’re now gearing up for the 2016

election cycle, which includes the Minnesota House and Senate, with a fundraising goal of $1.2 million. Equally as important we’re already preparing as well for the 2018 elections, which include the office of Governor. Most importantly, we’ve now established a culture and structure at BATC that will support Housing First for years to come, because a key to political capital is consistency of effort.
Home Builders Advocate Network Yet another major initiative is now underway, designed to fill out our modern, comprehensive advocacy program. We have just initiated development of the Home Builders Advocate Network (HBAN), a grasstops network of well-connected BATC members who are engaged with state legislators and regional, county and city-level policy makers. Modern and holistic advocacy requires an engaged grasstops network, a robust issues advocacy effort, respected lobbyists and deep electoral engagement. With the launch of HBAN to complement Housing First and our stellar lobbying team, BATC moves closer to an advocacy effort that is at maximum power.
Discussions with BAM You may recall that we began the year by seeking a substantial reduction in dollars flowing to BAM, with the idea that we could best use those dollars here at BATC for advocacy efforts on behalf of our membership. Our state association’s leadership asked that we reconsider our request and work through a process. As sincere partners in the discussion, we significantly modified our request, by asking that BAM reprioritize its budget to use the $150,000 to reflect a modern, comprehensive and holistic advocacy effort. After nine months of discussion we prepared an alternate budget for our state organization for 2016 that demonstrates the ease with which dollars can be redirected to the Home Builders Action Network, election activities through Housing First Network and an Industry Communications Fund. As I write this, we await a response from our state association to our proposal.

a word from our president — continued Department of Labor and Industry in 2015 instituted a new building code and a new energy code— the most substantial changes in codes since their initial adoption in Minnesota. Through the legislative process, BATC sought to remove a key provision of the building code—the mandate for sprinklers for homes above 4500 sq. ft. We had very strong bipartisan support at the Legislature, but ultimately faced a governor who has been immovable. BATC then turned to the court system to seek consideration for our members and most importantly, future home buyers. We sued the DLI on behalf of our members, challenging the code as arbitrary and suggesting there are less expensive ways to achieve similar goals. The case is pending before the Minnesota Court of Appeals with an answer expected in a month. Should we lose there, your Board will likely go the final step of seeking consideration by the Minnesota Supreme Court. Even if we lose, the very act of suing the state on behalf of our industry sends a powerful message to legislators and regulators in all departments that ours is an industry that will fight to protect itself and will stand strong on principles.
Minnesota’s Green Path Tops 4,000 Quietly, Minnesota Green Path, our green building program, continues to mount successes, topping 4,000 Green Path tested homes. Some 63% of the homes in the Fall Parade of Homes are Green Path tested, a record. We continue to work with our implementing partner, RSR, seeking ways to further grow and enhance Green Path. In one exciting new development, RSR and BATC are jointly producing the Minnesota

Home Energy Efficiency Conference, with recognized national speakers in two interesting tracks. This conference is an unique opportunity to bring together builders, remodelers, raters, utilities, appraisers, REALTORS, building officials and mortgage bankers to engage in a necessary dialogue regarding energy efficient residential construction.
BATC Education Offerings Expand One of the core functions of a trade association is to provide education for our members. BATC’s educational efforts continue to grow. At our annual Board Induction and Inaugural, we provide insights from a national economist. This year, we launched the mid-year economic outlook in July and more than 125 members joined us. We also reached more than 500 builders, remodelers and trade partners with our courses in 2015 on Minnesota’s new building and energy codes, and several hundred more attended BATC University. Equally as exciting, we launched in late 2015 the BATC Leadership Institute. Through this new Institute, 16 up-andcoming industry leaders will meet monthly at BATC to learn c-suite skills that will enhance their careers and build the talent pool for future BATC volunteer leaders. Finally, as we head into continuing education season late in Q4 and in Q1 of 2016, we’ve significantly revamped our curriculum and renamed our training program Contractor University. This will be a key year as we continue to strengthen and expand our educational offerings. The University of St. Thomas study said we’ve got strong value in this area, and that it can grow. They recommended a price reduction to match
October–December 2015
market standard, which we are implementing in 2016. We’re enthusiastic about our potential for the coming Contractor University series.
BATC Foundation Serves Those in Need The BATC Foundation is really blossoming under the leadership of our Executive Director Perri Graham and a strong Board of Directors. We’re about ready to hand the keys of a brand new house constructed by build partner Accent Homes to the family of an Afghanistan war veteran who lost both legs to an improvised explosive device. We’ve remodeled the basement of a woman who developed an extreme sensitivity to light after an operation and are remodeling a group home called the Bluebird House for medically challenged adults. Further, we’ve become a chapter of HomeAid America, which focuses on homelessness and we are exploring projects in that area for 2016. Beyond projects, our Foundation spent much of 2015 getting its house in order with a new financial policy, investment plan and overall three-year strategic plan through 2018.
BATC’s Communications Capacity Grows With all of this activity I’ve described above, communicating to our members and to key publics such as the media, policy makers, legislators and audiences is essential. BATC recognized a weakness in this area a year ago and brought on board a press secretary to give strength and consistency to our voice. We’ve made big strides, with our
regular weekly Voice e-newsletter achieving stellar open rates; our Hot Sheet redesigned with a stronger graphic appeal; strengthened relationships with the media covering housing and active blogging and social media efforts creating engagement. Plans are in action to produce a quarterly e-newsletter for Green Path and a short monthly e-newsletter for Housing First and our Home Builder Action Network. We’re also at work launching a new Twin Cities Home Builder Confidence Index in cooperation with the University of St Thomas. Watch for its roll out in 2016.
Oh, and a Few Awards Too We were thrilled to win a national award from Meeting Planners International recognizing how we developed our strategic plan and had it guide our events. Our own Nicole Coon, Meetings and Events Manager, accepted the award in San Francisco at the MPI conference in front of 1500 attendees. And our Executive Officer
David Siegel was named the Executive Officer of the Year by the Executive Officers Council of NAHB. He accepted the award at the Association Leadership Institute in Pittsburgh.
New Strategic Plan for 2016-18 Each activity above was tied directly to our threeyear strategic plan from 2013-2015. We lived the plan and worked toward its achievement every day. Our Board meeting agendas were structured around the plan’s goals, as were our staff meeting agendas. It’s incredibly powerful when a group of leaders can coalesce around a direction and keep feeding logs into the fire. We’re about to develop our next three-year plan and I can’t wait to see what’s in store. For me as your volunteer leader, the most rewarding part of the “job” is ensuring that the organization has strong direction, is united in its efforts and that future leaders will build on the good work we did, just as we built on the work of those that came before us.
As I look back on what we have done in 2015, I am humbled. So many great accomplishments that were spearheaded by leaders before me continue to grow our association. A big thank you goes out to all the past presidents of this association for setting the groundwork over the past decades. Thanks for placing your confidence in me and allowing me to help guide BATC during this exciting time. Thanks to my family and my company both—being BATC’s president is no small responsibility and it takes mental and physical energy. not to mention a great deal of time. We’re fullsteam ahead into 2016 and BATC continues strong. A strong association means a strong industry, and that’s good for us all.

PARADE OF HOMES CONSUMER RESEARCH
As many of you know, this Spring BATC conducted an extensive research project surrounding our consumer brand, the Parade of Homes. It had been a dozen years since we last looked into the consumer mind set in regards to our marketing efforts on your behalf. Our research partners began with a member survey and secondary research review (looking at competitive events and websites as well as reviewing current research available nationally). Next, we conducted almost 900 exit interviews at last Spring’s Parade of Homes and Remodelers Showcase, four focus groups, and completed the research with a phone survey to metro area 25-55 year olds looking to buy a home in the next five years. The results were encouraging (we’re doing a lot of things right) and have laid the groundwork for our next steps to ensure our consumer brand remains relevant and exciting into the future. Here are some of the key findings.

EXIT INTERVIEWS
FOCUS GROUPS
4.4/ 5 Overall Impression Advertisements and Guidebooks get people through the doors. People are looking for design and remodeling tips. 72.3% of attendees use the Guidebook to plan their POH visit. Attendees rated their overall impression with the Parade of Homes 4.4 out of 5.
Four focus groups were held, two from participants from the exit interviews, and two from general consumers who said they were in the market to buy a home in the next few years. We found two distinct groups of consumers who like and know about the Parade of Homes:

Three critical themes emerged from the focus groups:
House shopping is fun
They want more transparency They want more control over the information
PHONE SURVEYS
To ensure a scientifically valid survey, the professional research firm used qualifiers to limit respondents to those who expressed a desire for buying a home in the next five years, and were considering a new or newly remodeled home. This turns out to be about 15 percent of the overall metro population. Of that sample:
1/ 10 POH TOUR PARTICIPANT
5.5/ 10 LIKELY TO USE WEB/APPS, MAY BE OPEN TO POH TOURS
3.5/ 10 LESS LIKELY TO BE REACHED BY POH
Respondents who were aware of the brand had these impressions of the Parade of Homes: 93% have a positive impression of the brand 89% had used the guidebook
CONCLUSIONS all good news—from the state of the market It’s to impressions of the Parade, BATC is in a strong position to continue a marquee event with room to grow. The primary and secondary research are in alignment, each revealing different nuances on consistent themes. arade of Homes is valued and P trusted by both members and consumers. Members value the marketing and lead generation support. For consumers, the experiential nature of the event cannot be replicated, despite the rise of digital resources. There is an opportunity to update marketing for the smartphone era.
Recommendations • Continue the Guidebook—for now. It is widely used, however the balance of print and digital will shift over time. • There is an opportunity for more transparency and specificity on the website—consumers are seeking basic facts that make them feel more in control. • Put digital marketing through the smartphone filter—can Parade guests easily find what they need on the go?
88% had fun 84% were satisfied with their Parade of Homes experience 74% had viewed the website 69% said the Parade of Homes had helped their thinking 31% had attended a Parade of Homes tour in at least two of the last five years
16
BATC Digest
October–December 2015
Exit surveys show Parade guests recognize BATC as the event host about half of the time. Continue the brand relationship, it has value and credibility for both consumers and members. However, it is not necessary to invest in elevating BATC to “seal of approval” status for this event.
There is a perception that Parade homes are expensive, and there is a central tension between the Parade serving as a luxury inspiration or a buying resource. Recommendations • Maintain current price point and positioning—it is working for a broad market. Consider a second-layer of marketing more directed to consumers currently shopping for a new home.
Secondary research indicates there is a preference for existing homes, (47 percent) nationally, however there is a large persuadable population (36 percent) who are indifferent to new or existing homes. Locally, primary research indicates new and newly remodeled homes are equally desired among the target audience in the Twin Cities. Recommendations • Consider incorporating more “why new construction” messages in current Parade of Homes marketing efforts, and potentially strengthening the message in existing campaigns such as “That moment when.”
Millennials are purchasing homes later than previous generations, and looking at the investment in the short-term when they do purchase. However, as the first wave turns 30, marriage, families and homes are likely to increase importance. Recommendations • Don’t over-market to Millennials, yet. Trends in digital marketing, transparency and more consumer control are appropriate to the general market and will have Millennial appeal, with room to grow over time. BATC.org

ELEVATE YOUR NEXT JOB BY VISITING ELEVATIONS: ABC Millwork and Cabinetry’s New Showroom ABC Millwork and Cabinetry is pleased to announce the opening of Elevations—our new millwork and cabinetry showroom in St. Louis Park. Late in 2014, ABC began renovation of a 5,000 square foot historic manufacturing facility into an elegant showroom that will inspire your customers and designers. “We felt there was a real need for a destination showroom that was available for our builder and remodeler customers to use, as an extension of their business,” said Charlie Bradburn, Branch Manager of ABC Millwork and Cabinetry. Located at 5320 West 23rd Street in St Louis Park, just south of the West End Shopping district, the Elevations Showroom will be easily accessible to you and your customers from the 394/Hwy. 100 Interchange. Being centrally located was a very important factor in the decision as to where to put the showroom.
30
BATC Digest
October–December 2015
At the Elevations showroom you’ll find 21 cabinetry displays with leading countertop styles, and 18 millwork vignettes to help your customers imagine the many possibilities within the cabinetry and millwork categories. You’ll see a working kitchen, massive patio doors, tech-savvy conference rooms and more, all integrated with our millwork offerings to help your customers visualize different styles and finishes. “The feedback we’ve received is that homebuyers and remodeling customers need help in visualizing the end product and defining their own style of home,” explained Bradburn. “Elevations will provide exactly what they need to make those decisions easy and fun.”
Design. Manage. Perform. At first glance, the varied array of displays is sure to impress you and your customers, but the underlying tone of the showroom is about the experience and exemplifying a clearly defined process. Millwork and Cabinetry can be a daunting task when you consider all of the detail that goes into the selection process. For that reason, the Elevations showroom is staffed by accredited professionals in design and cabinetry. Each project is handled from start to finish by an Elevations Design Consultant working as an extension of our Builder/Remodeler customers’ design and project management team.

Housing First Continues Preparations for 2016 & Beyond Non-election years provide a respite from the onslaught of political ads in mailboxes and on computer screens, but for political efforts like BATC’s Housing First, there is no break in the action. Coming off a successful 2014 where Housing First achieved all three of its objectives (see below) the focus in 2015 is on fundraising, coalition building, and infrastructure work to prepare for an even bigger effort in the 2016 elections. Looking ahead to 2016, the entire Minnesota legislature is up for reelection as all 201 House and Senate seats will go before voters. While there is no statewide race on the ballot, the U.S. Presidential race will heavily influence election outcomes based on voter intensity and turn-out. Noting these factors, Housing First has continued to broaden its fundraising efforts to ensure that the homebuilding and remodeling industry is a major factor in the 2016 races. Leading this effort is a dedicated cadre of industry leaders who make up the Housing First Leadership Group. Under their leadership, in concert with the BATC Board of Directors, Housing First is well-positioned to build upon the 2014 success by running dynamic independent campaign efforts in State House and Senate races next Fall.

BATC Continues to Work on Fixing the Code In early July BATC’s petition to invalidate the sprinkler mandate was heard in the Minnesota Court of Appeals. Attorneys Rob Stefanowicz and Brian Huntington from Larkin Hoffman represented BATC before the court, with Stefanowicz leading the oral arguments. BATC’s argument was multi-pronged, focusing first on the sprinkler mandate being out of line with code norms across the country. Also highlighted, was the lack of an adequate record of data established by the Department of Labor and Industry (DLI) to support the 4500 square-foot threshold and the costs of the mandate itself. The three-judge panel asked several questions regarding the sprinkler mandate, lack of adoption by other
states, and the code development process, while spending the most time attempting to find the basis to support the DLI’s decision to establish a 4500 square-foot threshold. As of print BATC has not heard back from the court regarding this case, but expects a decision by mid-October. The courtroom isn’t the only place BATC is working to fix the new residential building and energy code. During the 2015 legislative session BATC introduced legislation to require DLI to create a performance-based path for compliance with the new energy code. The DLI preferred not to enter into a formal rulemaking process, leading to an agreement by BATC and DLI to work
together to create and promote a performance path. The benefit of the performance path lies in the software modeling of homes using the new energy code requirements. If a builder can demonstrate the adequate energy savings performance in the new code, certain requirement ‘tradeoffs’ can be utilized, saving money and increasing project efficiency. Since the session’s adjournment BATC has been working with NORESCO, the nation’s leading home-ratings software company, to create the performance path. Like many software upgrades, the timeline has been longer than we initially anticipated and we are now hoping to have software update completed by the end of 2015.
Look for updates in BATC’s weekly e-newsletter, the Voice.

METRO CITIES CONTEMPLATE CONTROVERSIAL
HOUSING POLICIES BY PETER COYLE AND BRYAN HUNTINGTON
Recent weeks have brought about significant developments in the area of “affordable housing,” ranging from a United States Supreme Court decision regarding housing discrimination, an aggressive new federal agency interpretation of the federal Fair Housing Act (FHA), and the Metropolitan Council’s approval of an amended 2040 Housing Policy Plan. Housing affordability is a growing problem for the Twin Cities region and for Minnesota as a whole. The severity of the issue is underscored by a Metropolitan Council forecast that between 2020 and 2030, the region will add 37,400 low- and moderate-income households which will require affordable housing. Minnesota homebuilders have raised concerns about the problem of housing affordability for years and pointed to factors contributing to the problem. The most apparent being the high cost of regulation—national estimates reflect that regulatory burdens, such as permit fees and other locally-imposed costs, comprise about 25-30 percent of the cost of a new home—and the high cost of land. Unfortunately, the complaints of builders have largely been ignored by state and local government policymakers. Instead of taking action on these considerable obstacles to home construction, policymakers have myopically focused on expanding the supply of “affordable housing,” either by buying down the cost of housing with taxpayer funds or by attempting to link affordable housing requirements to new market-based projects. This article briefly discusses new developments relating to affordable housing and the significant implications of these developments for homebuilders, especially with regard to so-called “inclusionary” zoning. State of the Law Concerning Affordable Housing in Minnesota Since 2002, Minnesota law has allowed a municipality, in approving a subdivision or other similar application for housing targeting persons or families of low and moderate income, to place various conditions on the use of the housing. Conditions may include minimum sales prices or rents for designated units and/or establishing maximum income limits or
other means of maintaining long-term affordability of the units. Of critical importance, ho wever, municipalities can only impose these conditions with the development applicant’s permission. Separately, the 1995 Livable Communities Act created a fund to help communities support development of affordable housing. Municipalities electing to participate in the Council’s housing incentive program are required to negotiate
housing goals with the Metropolitan Council and to spend grant monies to create housing opportunities for low- and moderate-income households. Other available financial tools have included tax increment financing and federal tax credits. The Supreme Court Affirms Disparate Impact Liability Under the Fair Housing Act In late June 2015, the United States Supreme CONTINUES ON 42

HOUSING POLICIES – CONTINUED
Court, in the decision of Texas Department of Housing and Community Affairs v. Inclusive Communities Project, Inc., decided in a landmark decision that a form of anti-discrimination liability known as disparate impact is recognized under the FHA. At the center of that case was a tax credit program run by the Texas Department of Housing and Community Affairs. The plaintiff—a Texasbased housing nonprofit— alleged that the Department’s distribution of tax credits was discriminatory and violated the FHA. The plaintiffs contended that the tax credit program perpetuated housing segregation by granting too many tax credits in areas that were predominantly black. While the Supreme Court recognized disparate impact as a basis of liability under the FHA, it nevertheless held that the FHA “does not decree a particular vision of urban development; and it does not put housing authorities and private developers in a double bind of liability, subject to suit whether they choose to rejuvenate a city core or to promote new low-income housing in suburban communities.” A lawsuit raising similar issues is pending in Minnesota. HUD Imposes a Federal Obligation to Affirmatively Further Fair Housing Virtually simultaneously with the Supreme Court’s decision, the federal Housing and Urban Development agency (HUD) confirmed the obligation of state and local agencies that receive federal housing support to affirmatively address the shortage of affordable
42
BATC Digest
housing. Specifically, the new HUD rule specifies that HUD program participants have an affirmative duty to further fair housing, meaning that they must take “meaningful actions to overcome patterns of segregation and foster inclusive communities free from barriers that restrict access to opportunity based on protected characteristics.” It must be noted that HUD takes the position that the duty to further fair housing extends to all of a program participant’s activities and programs relating to housing and urban development. HUD emphatically denies, however, that it is mandating the adoption of any particular strategies for compliance with the FHA or any particular land use or zoning outcomes. The Metropolitan Council’s Thrive 2040 Plan Imposes Penalties on Communities That Fail to Meet Affordability Thresholds Amidst these federal developments, the Metropolitan Council has approved an amended housing plan, as part of its Thrive 2040 plan, which establishes specific affordable housing targets for metro cities. It appears that the Council believes the new HUD rule expands the Council’s authority to regulate housing policy in areas not directly tied to federal financial assistance. In its new housing plan, the Council devised a formula to determine a community’s anticipated need for future affordable housing based upon factors such as whether a community imports low wage workers and whether existing
October–December 2015
affordable housing is scarce. The Council appears prepared to impose significant penalties based upon noncompliance with its housing plan. For communities along the Southwest light rail corridor, for example, this could become a serious challenge. Metro Cities Consider (and Appear on the Cusp of Implementing) Mandatory Inclusive Zoning Following on the coattails of the HUD rule and the Metropolitan Council’s new housing plan, municipalities in the metro area are actively exploring how they may impose “inclusionary” zoning—i.e., a mandatory amount of means-based housing within new market-based housing developments. The City of Edina, for example, is exploring whether to impose requirements for a certain percentage of means-based housing in new multifamily housing projects that are requesting more density over what is allowed by ordinance. As part of its review, the City is also evaluating whether it can enact an “in lieu” fee to be paid by an applicant as an alternative to meeting the affordability requirement. The legality of municipal maneuvers to impose mandatory inclusionary housing requirements is highly suspect. There is no statutory authority for these proposed actions. As such, they would arguably amount to a regulatory taking without payment of just compensation. Additionally, Minnesota law only permits a municipality to impose affordable housing requirements
on units either when public funds are expended or the developer voluntarily accedes to them. In response, municipalities seeking to impose inclusionary housing policies may argue that they are merely obeying the federal obligation to affirmatively further fair housing and/or comply with the Metropolitan Council’s direction to expand affordable housing to meet future needs. Yet, the legal footing of such a position would be questionable, as none of the recent developments discussed above expand the power of municipalities to mandate requirements that violate the Takings Clause of the United States Constitution. Policymakers continue to ignore the cost of housing as it relates to all consumers, especially those seeking to purchase their first home, and instead appear intent on imposing new regulatory burdens and costs on new housing projects. Rather than helping to address “housing affordability” on a broad-scale basis, these policies likely will exacerbate the affordability problem for more people than will be helped. n

Welcome Jacqueline Bilek, BATC FOUNDATION PROGRAM COORDINATOR Foundation employees often have big hearts and a focus on people. BATC Foundation’s new Program Coordinator brings that and more. Having spent twenty years in her own company serving people, plus an equal number of years volunteering with The Advocates for Human Rights, Open Arms, Store to Door, and The Institute for Multi-track Diplomacy Corp/CDC Development Solutions, Jacqueline Bilek brings a strong background in training, communications, event planning, fundraising and nonprofit service. Joining the BATC Foundation team in July, Jacki supports Perri Graham-Raff by working with committees, developing communications, assisting in fundraising and coordinating program logistics. As Executive Director, Perri Graham-Raff shifts more attention to fundraising, Jacki will provide another bridge for builders, subs, sponsors and donors to link into the Foundation events and programs. Originally from Wisconsin, and

yes, she still is a Packer-Backer, Jacki came to Minnesota more than a few years ago for her undergraduate degree at the University of Minnesota. With that in hand, she was then selected for the Women In Leadership program at the Hubert H. Humphrey Institute at the University of Minnesota. With strong interest in the international community, she has taught Business Development at the Wroclaw University of Economics and coached business entrepreneurship during privatization in Poland for the Citizen’s Democracy Corp/CDC Development Solutions. Jacki has led a public relations initiative supporting Haiti’s children and has helped build bus shelters in India. In fact, when it comes to travel, at any given time her bags are packed and she’s ready to go. When at home, Jacki and her son, Oscar, are apt to be out exercising. She said it’s not easy keeping up with a twenty-three year old. Although a past runner and marathoner, Oscar talked his Mom into doing three triathlons.

All three were completed but Jacki has now focused on swimming. This year she finished her first open-water mile race. Next year Jacki’s committed to the Point to La Pointe race from Bayfield, Wisconsin to Madeline Island. That would be a two-mile open-water swim in Lake Superior. She admits not everyone would think this is fun. On the other hand, Jacki said there are always a few beers afterward. Although Jacki is quite athletic, she said there is a warning from her son—“Don’t let her on a golf course.” We’ve been warned. Please welcome Jacki next time you’re in the BATC offices. She’s looking forward to putting names and faces to the many wonderful BATC members she has heard about.

BATC Wins Awards Yep, we are tooting our own horn for earning two, count ‘em, two national awards this summer. But then, as a member organization, feel free to take a little credit too!
David Named Top EO David Siegel, BATC’s crack executive officer, was named the National Association of Home Builders (NAHB) 2015 Executive Officer of the Year! He was selected by the NAHB executive board based on his extensive and successful contributions to BATC, his deep involvement in NAHB as well as his numerous contributions to other executive officers around the country. David was chosen for this honor out of the more than 300 HBA executives across the country. “While we of course know how dedicated and committed David is to BATC, it’s great to see the rest of the country take notice,” said 2015 BATC President Chris Contreras. “I think it says a lot about what we are doing as an association when the national organization recognizes your leadership as someone who is doing great things.”
BATC Events RISE to the Occasion BATC was also honored by Meeting Professionals International (MPI) with their 2015 RISE Award for Organizational Achievement. Thanks to BATC’s amazing event planner, Nicole Coon who is also a member of MPI, BATC’s entry explained how we have used meetings and events to support our five key goals. The criteria included attendee reach, member value, profitability, and staff time. “We’ve worked hard to be more efficient while creating high quality events and are honored to be selected for this award,” said David when interviewed by the press about our honors. “We pride ourselves on organizing great BATC events, this recognition means a lot to us.”
David received the Executive Officer of the Year award during NAHB’s Association Excellence Awards luncheon in Pittsburgh on July 23rd. Nicole attended MPI’s RISE Award event in San Francisco on August 3rd and accepted the award for BATC.

ME Member Experience = It’s all about ME
—Deb Earl and the BATC Membership Committee
Join our 2015 Membership Drive It’s that time of year again—October is NAHB Membership Drive Month. Now is the time to help us grow BATC membership. You can play along in two ways: Join us on Drive Day, Wednesday, October 14th, here at BATC. You can create your own team or join one of ours. All it takes is a cell phone and a few hours of your day. We’ll provide a list of prospective members and talking points. You make the call and share why you find BATC membership of value. That’s it. Top recruiters will earn triple Spike points, and have a chance to win great prizes like cash (up to $500), wine and gift cards! Recruit on your own! Contact your nonmember trade partners and peers about joining BATC. We’ll provide talking points, you just report prospects you’ve spoken with to Membership Director Deb Earl. She’ll follow up and when your prospect becomes a BATC Member, you’ll receive triple Spike points, $500 BATC Bucks (to use at the December
auction), and a free company profile upgrade at ParadeofHomes.org or BATC.org (up to $400 value). Thanks for being a valued BATC Member! And we hope you’ll help us bring the BATC message to even more companies!
Mentor a New Member We’re looking for a few good men and women to become new-member mentors. Like most associations, new members are the most likely to drop membership after a year. But, with an established member mentor, we think we can change that. All it takes is a few phone calls a year and inviting your mentees to BATC events that you attend. We’ll provide scripts and talking points, and reminders for your calls. If you’d like to share your experience and get to know a new member or three, please contact Deb Earl, 651-697-7562 or Deb@ BATC.org to volunteer.
BATC MEMBER ORIENTATIONS Each quarter, BATC hosts a onehour orientation to help you get the most value from your membership. We cover opportunities and resources to help you build your business, as our mission states, through marketing, advocacy and industry connections. It’s a great way to connect with other members, and a first step to deeper involvement in your association. Why not join us next time?
