5 WAYS TO RUIN YOUR RETIREMENT
Humans are living longer. That’s the good news. The bad news is this longevity requires more work on your part to make your retirement dollars last longer. Whether you are currently enjoying retirement or looking forward to it, avoiding these mistakes could make a huge difference in your experience. 1) SPENDING TOO MUCH. Probably one of the most debated topics in personal financial planning is an appropriate withdrawal rate during retirement. Withdrawal rate is the percentage one takes from their savings each year. Calculating it is easy. It’s simply your monthly expenses minus your guaranteed income each month (social security, pension, etc.) divided by your total savings. Most financial advisors recommend a withdrawal rate of 4% or less. However, with interest rates at extremely low levels and life expectancies rising, an even safer withdrawal rate is approximately 3% per year. Figuring out your proper withdrawal rate would be easy to determine if you knew precisely when you were going to pass away and how much your investments were going to earn each year until that time; hence, the debate. Some considerations that could influence this rate would be a later retirement and/or if the retiree feels that leaving a legacy is important (inheritance). New research suggests using a variable withdrawal rate based on investment returns and different needs at different stages of retirement. In addition to sticking to a reasonable withdrawal rate, the order in which you take your withdrawals is important as well (IRA, Joint Account, Roth IRA, etc.) These withdrawals can affect your taxes, which is another way of spending too much in retirement. 2) NOT SAVING ENOUGH. This is an obvious point, but what is enough? The answer depends primarily on the amount of income you will have in retirement such as social security and/

or pensions as well as the lifestyle you want to live. If you are in your 20s and just getting started, saving 15% of your income is a great rule-of-thumb. For the rest of us, generally, the goal is to live a similar lifestyle all your life (most don’t want a major downgrade). There are plenty of online retirement calculators that can help. But, they are only as good as your assumptions. Take time to understand your current expenses. We advise to plan that your expenses before retirement will not materially change during retirement unless a mortgage payment or some other major expense will be paid off. Two of the biggest mistakes we see in planning for retirement is when retirees or their advisors use unrealistic investment return assumptions or inflation assumptions that are too low. Determining the amount to save is the easy part, but doing it is the hard part. The best way to save is by “forced” savings. Paycheck deductions into employer retirement plans work well or just simply doing automatic transfers each month to brokerage accounts, mutual funds, etc. You may be surprised how little you miss the extra dollars. 3) IGNORING INFLATION. According to Vanguard, there is a 45% chance that either spouse will live to age 90. Based on an average retirement age of 65, that is potentially 25 years of retirement for one of the spouses. If inflation is anywhere near the 3% historical average, this translates in to a cost of living that will roughly double over retirement. Most pensions do not offer cost of living adjustments, so you must have additional savings to make up the shortfall as cost of living increases. In addition, while social security does offer cost of living adjustments, they tend to lag the true rate of inflation. The bottom line is that for most retirees, their savings (portfolio) needs to have enough growth potential to give the portfolio the best chance of earning high

enough returns to meet their rising expenses over a 25-30 year time horizon. In other words, being too conservative can be just as damaging to a retirement as being too aggressive. We like to call this “losing money safely”. Unfortunately, many people are sold high commission annuities with the promise of great returns and ultimate safety. Generally speaking, we have seen those same annuities give investors less liquidity and mediocre returns. Ultimately, the comfort you are being sold when you purchase an annuity comes at a high cost and may not keep up with inflation. 4) ABANDONING YOUR PLAN. You or an advisor can come up with an asset allocation, savings rate and/or withdrawal rate that gives you a high probability of success. That is the equivalent of a doctor telling to change your diet and start exercising, but if you don’t stick with it, it doesn’t work. So, your ability to stick with a plan matters more than the plan itself. There are many reasons people don’t stick with their plan, but the two main culprits are fear and greed. Fear causes people to make their portfolio more conservative based on trying to time the next market drop or crying “uncle” in the middle of a market drop. On the contrary, greed causes people to ramp up portfolio risk because they feel like they are missing out when they hear their friends are making amazing returns doing something different. We advise the best solution may mean the plan for you will need to be modified up front (even if not optimal) to ensure that it sticks. Or, conversely you may need coaching to have the fortitude to deal with volatile markets and stick with the plan. Not sticking to a plan is a plan that isn’t worth having. 5) NOT REALLY DIVERSIFYING. We find that many believe they are diversified when they are not. Just because you
own some mutual funds, this does not necessarily mean you’re diversified. The whole point to diversification is that the investments you own do not move in lock step with each other. The financial crisis in 2008 was a great lesson to many that just because your mutual funds have different names, they may move in the same direction which means you’re not really diversified. Most think of diversification in terms of only stocks and bonds. While this is a good starting place (and may be your only option in an employer retirement plan such as a 401k), we encourage investors to consider other options. These could include commercial real estate, rental real estate, collateralized financing, commodities, and funds that use alternative trading strategies to manage stock market risk or risk of rising interest rates. Incorporating these strategies typically make a plan easier to stick with because it has a smoothing effect on a portfolio. The most difficult part of true diversification psychologically is that by definition not all of your investments will be “working” in a given year. While there are numerous ways one can ruin their retirement, these are the five most important ones. Being proactive is the key. Proper planning can ensure the retirement you desire is the one you get. The season of your life spent working hard is much too important not to consider the ways to have a successful retirement as well as these easy mistakes to avoid. BBM

Texas best state to start a business

Texas is 2019's best state in which to start a business, according to WalletHub. The Lone Star State was first in business environment and 11th in access to resources. It also ranked: fourth in longest average lengthof work week in hours; fourth in average growth in number of small businesses; fifth in highest total spending on incentives as a percentage of gross domestic product; 13th in industry variety; 20th in cost of living; and 30th in labor costs. "Texas offers a business-friendly environment characterized by low taxes (e.g., no state income tax) and less burdensome regulation that favors a market economy that has created lower costs for doing business," commented Real Estate Center Research Economist Dr. Luis Torres. "In addition, this lower-cost environment has helped keep housing comparatively affordable." Utah, Georgia, North Dakota, and Oklahoma rounded out the top five rankings. Rhode Island ranked 50th. WHAT’S THE HYPE?

Now that CBD (cannabidiol) is readily available at retail shops, pharmacies, gas stations, and yes, even the meat market and coffee shops, how is a person to know what is legal? And more importantly, what is safe and effective? Let’s tackle the legalities first. Pursuant to the 2018 Farm Bill Act approval, Texas legislators passed HB1325 this summer allowing farmers to grow hemp and produce consumable hemp products containing cannabidiol (CBD) as well as other edible parts of the hemp plant provided they contain <0.3% THC, the psychoactive component associated with getting high. Although this bill is already in effect, hemp growers must wait until 2020 to start their first crop to allow the US Dept of Agriculture to create rules and regulations including testing processes for THC content and pesticides. Texas Dept of State Health Services (DSHS) is also required to create a registration process for retailers of consumable hemp products (CBD oil, gummies, treat, etc). Retailers who currently sell hemp-derived CBD products from other states can continue to do so provided it also has <0.3% THC. They MUST register with the state once that process is available. Development of testing procedures are currently under way to determine the difference between

medicinal marijuana and hemp-derived CBD. Although the state now allows some THC content, be aware that some employers who do drug-testing may not allow ANY THC regardless of the source. In that case, a THC-free product would be necessary. Now that we have discussed the current legal landscape of CBD, let’s talk about the health benefits. CBD is often regarded as the single most important cannabinoid ever discovered. With on-going research, the list of uses continues to grow, giving more people hope to enhance their overall quality of life. Many people see improvements with pain, sleep, anxiety, mood and other inflammatory issues. Some people will tell you it’s the cure-all for any disease. As a pharmacist, I will tell you it isn’t. Yes, it helps many of our patients with their symptoms, but we also look at the root cause of symptoms. These root causes could be food sensitivities, hormone imbalance or nutrient deficiencies to name a few. There are also some documented drug interactions with CBD oil; therefore, speaking with a healthcare provider prior to starting CBD-containing products is recommended. I also encourage using a brand of CBD that routinely performs potency testing on their CBD isolate for
impurities and potency in addition to testing their end products. Current regulations don’t require end-product testing; therefore, it is imperative to purchase from a trustworthy source. Since CBD is all the rage right now, not all companies have the consumers’ interest in mind and may be tempted to take shortcuts in production. Reputable sources will provide Certificates of Analysis with their products to ensure pesticides and heavy metals are not found in their oils. I also recommend choosing a product that uses full or broad-spectrum extraction to allow synergism of the other cannabinoids In conclusion, CBD may be a great choice for you to add to your healthcare regimen. Top things to remember: 1. Check your company’s policy on THC testing to determine if you require a THC-free product. 2. Review your medication list with your healthcare provider for possible interactions. 3. Ensure the quality of your CBD is free of pesticides and heavy metals and has the CBD content labeled on the product. 4. If CBD supplementation doesn’t provide expected results, consult your healthcare provider to determine the true root cause of your symptoms. At their Annual Meeting held at the New Braunfels Civic Convention Center, GVTC gave a warm welcome to their newest Director elected to the Board, Mr. Scott Kramer of Kendall County. On the ballot this year, five positions on the GVTC Board of Directors were open for election. Four of the five elected members included incumbents, with Kramer being the fifth and latest addition to the Board where he will serve as Director of District III, Position 4 and replace longtime board member, J.B. In December of 2017, the Tax Cuts and Jobs Act was signed into law, which created IRS code section 199A, the Qualified Business Income Deduction. While the details of the code are inexhaustible, for our purpose it is only important to understand the basic nature of the 199A deduction. In a sentence, the 199A deduction is a potential 20% phantom deduction from your trade or business income. For example, if your business makes $100,000 in a year, the business may be entitled to a $20,000 phantom deduction and pay tax on only $80,000, provided the business meets certain limitations. This is a sizable tax break for owners of trades and businesses. However, the IRS generally does not consider a rental property to be a trade or business. Therefore, owners of residential or commercial rental properties would generally not qualify for this new deduction. But in January of 2019, the IRS released Notice 2019-07, which institutes a safe harbor for rental real estate owners who may otherwise not be able to take the 199A deduction. Notice 2019-07 applies to individuals, pass-through entities, and disregarded entities. Before we discuss how to qualify under the safe harbor, let’s review a few types of rentals Notice 2019-07 does not cover. Triple-net leases are not eligible for this safe harbor. In a triple net lease, the tenant or lessee pays for taxes, fees, insurance, and is responsible for maintenance. The IRS argues that you cannot be active in such a scenario. Additionally, if you use a rental property as a per-

sonal residence for more than 14 days during the taxable year, you will not qualify for the safe harbor. Finally, if your rental property is leased by a company that you own, the safe harbor is not necessary to use because the rental activity is considered to be a part of the trade or business for purposes of section 199A. If none of these scenarios apply, you are likely eligible for the safe harbor, so long as the following three qualifications are met. 1. You must have at least 250 hours of rental services performed for each Rental Real Estate Enterprise. A Rental Real Estate Enterprise is defined by the IRS as “an interest in real property held for the production of rents and may consist of an interest in multiple properties.” The phrase “multiple properties” is important because you can consider your entire residential rental portfolio as a single enterprise. The 250-hour test can be aggregated amongst all rental properties, making it considerably easier to meet the limitations. The only restrictions on aggregation are: you cannot vary the treatment of aggregation year-to-year, and commercial rental and residential rental must be considered as separate enterprises, and not co-mingled. What activities qualify for the 250 hours of rental services? Below is a list provided by the IRS: • Advertising • Negotiating and executing leases • Reviewing and verifying tenant applications • Collection of rent • Daily operation, maintenance, repairs • Management • Purchase of materials • Supervision of employees and contractors Fortunately, you do not have to perform all these activities. These services can be performed by the owner, employees, agents, or independent contractors, which again makes this test easier to meet. 2. How does the IRS know these services were performed? The second test is keeping contemporaneous records. These records should include hours worked, a brief description of the service performed, the date of the service, and who
performed the service. Again, these records should be kept contemporaneously. Keep a logbook when you are making your rounds, or have an employee send you an email or text so you can log their hours. 3. Lastly, separate books and records must be maintained for each Rental Real Estate Enterprise. You must have a good set of financial data to substantiate your income and expenses. It is also imperative that you file any necessary 1099s. Remember, you are asserting you are a trade or business. Proper reporting is paramount to substantiate that assertion. You have now met all the qualifications to qualify under the safe harbor provisions of Notice 2019-07, congratulations! But how is the safe harbor election made on your tax return? The return must include a statement that all qualifications have been met. The statement must be signed and dated under penalties of perjury and filed with your return. Fortunately, the IRS produced a statement form that can be signed and attached to the return. This election must be made annually. Every rental situation is unique and could require additional planning. If you have any questions regarding the application of this notice, or how it relates to the new tax law, please do not hesitate to give us a call.
