REGGAE SUPERSTARS UB40 TO RETURN TO MALLORCA THIS SUMMER

UB40, famous for their hits such as ‘Red, Red Wine’, ‘Kingston Town’, and ‘(I Can’t Help) Falling In Love With You’, have sold over 70 million records worldwide and show no signs of stopping any time soon. The band are heading back to perform on our shores for the first time in five years as part of the Mallorca Live Festival’s Es Jardi Boutique Concerts on July 29th. So, how did this working-class band from Birmingham come to be a household name?

Formed in Birmingham, UK in 1978, UB40 took their name from the government form used for claiming unemployment benefits, (Unemployment Benefit, Form 40) something many of the band members and their families were familiar with. Initially, the band were identified as a reggae group by the masses although many critics stated at the time that reggae is more than a onedrop rhythm and that UB40 belonged firmly in the pop category. With four Grammys for Best Reggae Album, it is safe to say that the masses were correct.

UB40’s early work tapped into reggae’s political roots and voiced very acerbic concerns about Margaret Thatcher’s conservative policies, the rise of the National Front in the UK and the country’s “pervasive, destructive joblessness” as they said at the time. Their first single consisted of two A-sides - “King” which was written about the legacy of Martin Luther King Jr, and “Food for Thought” which is a scathing observation of the hypocrisy of Christmasnot quite the normal sugar-coated pop that was popular at the time but well received and soared up the charts.

By the early 1980s, UB40 had more commercial success in their sights and

released the album ‘Labour of Love’, a collection of covers including the now world-famous song ‘Red Red Wine’ which was originally a hit for Neil Diamond in 1968. UB40s version is somewhat more upbeat and catchy than Diamond’s original which focuses on using alcohol as a way to self-destruct following the breakdown of a relationship. UB40 on the other hand put a catchy, reggae-esque twist on the song by adding a verse, or to use the correct reggae term “toast”, which highlights some of the delights of wine-drinking. This part of the song is perhaps the most famous and is often belted out by the crowd in a rowdy karaoke bar.

“Red red wine you make me feel so fine. You keep me rocking all of the time. Red red wine you make me feel so grand. I feel a million dollar when you’re in my hand”

‘Red Red Wine’ was a huge hit for the band and eventually reached the top of both the Billboard Hot 100 and the UK singles chart and ‘Labour of Love’ reached number one on the UK Albums Chart. For this album,

UB40 hold the record for most weeks spent by a group in the UK singles chart during the 1980s along with the English band Madness with 214 weeks each.

Throughout the rest of the 80s, UB40 continued their skyward journey to success and on the 11th of June 1988, UB40 performed at the Nelson Mandela 70th Birthday Tribute concert at Wembley Stadium alongside artists such as Dire Straits, George Michael, Whitney Houston, the Bee Gees and other famous names of the time. They followed this with their most successful worldwide single release which was ‘(I Can’t Help) Falling In Love With You’ in 1993 which was a number-one hit in the UK, across Europe and in the US and was the main theme song to the Sharon Stone movie ‘Silver’.

Throughout the rest of the 90s and into the 00s, the band remained relevant with appearances in several films such as ‘Speed 2: Cruise Control’ and ‘The Yob’. In 2003, they swung onto the radar of a younger generation with the release of their version of ‘Swing Low, Sweet Chariot’ as the official anthem for the England National Rugby Union team for the Rugby Union World Cup and subsequently reached number 15 in the UK Singles Chart.

In 2008, lead singer Ali Campbell sensationally announced that he would be leaving the group after 30 years and it was originally reported that this was to concentrate on solo projects, but Campbell later said he was leaving due to other disputes with management. The remaining members released a statement saying: “Ali made a very simple decision; he chose to pursue and put his solo career over and above continuing

to work with UB40 after February 2008. It’s as simple as that”. Keyboardist Mickey Virtue left the band shortly after and gave a statement that listed the same issues that Campbell had as reasons for his departure. The band released their next album, ‘TwentyFourSeven’, the last with their original lineup, but this time they made the unconventional decision to release it as a free insert in The Mail on Sunday’s 4 May 2008 issue which sold nearly three million copies. This decision led to somewhat of a backlash when the full version was released in June of the same year and most of the big retailers refused to stock it. Subsequently, the album failed to reach the Top 75 in the UK - something that is unheard of for a band with such popularity as UB40.

UB40 were not to be kept down for long though and their next album was a collection of songs from the ‘Labour of Love’ series called ‘Love Songs’ and featured Ali Campbell on all vocals and reached number 3 in the UK. The band then embarked on a tour of the US, which included their first show at the Hollywood Bowl. In 2009 the band released their first album with their new lead singer Duncan Campbell entitled ‘Labour of Love IV’ although it only remained in the charts for two weeks and reached number 24.In 2013 percussionist and vocalist Astro announced that he had left the band, describing it as a “rudderless ship” and criticising the “serious lack of communication between the band and management”. Astro then controversially joined former UB40 members Ali Campbell and Mickey Virtue on stage at the indigO2 Arena in London on 6 December 2013. The three former band members continued to tour as UB40 which resulted in several legal proceedings being filed between the former and current members of the band over the use of the name. Ali Campbell told the press that he would rather go to the High Court in London over the matter than settle out of court.

Over the next few years, lead vocalist Duncan Campbell retired from UB40 due to ill health, following a stroke he had suffered and was replaced by Matt Doyle of Birmingham reggae band Kioko. In 2021, saxophonist Brian Travers died of cancer at the age of 62 and later in the year, former vocalist and founding member Astro also died rather suddenly.

The current lineup consists of Jimmy Brown on drums, Robin Campbell on guitar and vocals, Earl Falconer on bass guitar and

vocals, Norman Hassan on percussion, trombone and vocals, Matt Doyle on lead vocals and guitar are joined by Laurence Parry on trumpet, flugelhorn and trombone, Martin Meredith on saxophone and keyboards, Tony Mullings on keyboards and Ian Thompson on saxophone.

Over the years, UB40 have remained at the top of their game and have influenced other musicians in their careers with their politically-motivated songs, ability to reinvent themselves, and career longevity. Considering that the band are still going strong 45 years later, they must be doing something right and we can’t wait to see them in Mallorca!

The band are currently touring and will be making an appearance at the Mallorca Live Festival’s Es Jardi Boutique Concert on July 29th at the Antiguo Aquapark in Magaluf with tickets starting from 36 euros. Book your tickets now here.

“Vino tinto me haces sentir tan bien. Me mantienes rockeando todo el tiempo. Red red wine you make me feel so grand.

TAYLOR SWIFT BREAKS MORE RECORDS

MYSTIC MEGS DIES AT 80

It would seem that everything that Taylor Swift touches turns platinum and she will soon need her own page in the Guinness Book of Records. She can now add another couple of accolades to her evergrowing collection - the highest-attended concert for a female artist in 36 years and the most tickets sold by an artist in a single day. Madonna previously held the record for her 1987 Anaheim Stadium concert in Los Angeles with 67,000 people but Taylor has beaten her by 3,000 with 70,000 people attending one of her concerts on her Eras Tour. Not happy with one record, however, Ms Swift also took the title for most tickets sold by an artist in a single day with 2.4 million tickets sold on the first day of pre-sale alone. So successful is her Eras Tour, the town of Glendale, Arizona temporarily changed its name to Swift City for a few days to mark Taylor’s tour.

Anyone who has lived in the UK in the last 35 years or so will know Mystic Meg, the iconic astrologer that rose to fame for her National Lottery predictions. She successfully wrote a column in The Sun for 23 years and became a household name. Meg’s real name was Margaret Lake and she was fondly remembered with tributes coming in from loyal readers and followers as well as magician Uri Gellar who tweeted that Mystic Meg was “so identifiable by name and image, the quintessential fortune teller who brought mystery and mystique to millions of believers. She defied the dreary sceptics, as did her fans. Much love and positive energy, Meg, on your onward journey.”

MARK WRIGHT ARRIVES IN MALLORCA TO GET HIS HANDS DIRTY

Former TOWIE heartthrob turned presenter

Mark Wright has recently arrived in Mallorca to work on his apartment himself after a problem with “nightmare builders” - something I’m sure many of our readers can relate to. The Heart Radio presenter posted on his Instagram detailing his 30-hour drive to Mallorca in a van laden with materials followed by another post in which he voiced his concerns about their sleeping arrangements. Mark is heard asking his friends “where are we sleeping tonight...” to which his friend replies....”well, I have got a pink lilo.” Mark has been seen taking some time out in various bars and restaurants around the Calvia area causing many of his loyal fans to try and catch a glimpse of him and lamenting that it is just a tad too cold for him to take his shirt off! Let’s just hope he comes back once the building work is completed and the weather is warmer!

BARON LLOYD WEBBER KT TO COMPOSE FOR KING CHARLES III’S CORONATION

As a Knight Bachelor of Britain, one that has been knighted by the monarch but does not carry the title of ‘Sir” or “Dame”, Andrew Lloyd Webber may have felt that he had no choice but to accept King Charles III’s invitation to compose a piece for his coronation.

Lloyd Webber is world-renowned for the musicals “Cats”, “The Phantom of the Opera”, “Evita” and “Jesus Christ Superstar” and for his extensive back catalogue of compositions so it is unsurprising that he was the first choice for the role. For the coronation ceremony on May 6th in Westminster Abbey in London, the King has asked Lloyd Webber to compose a melody to Psalm 98 although it is unknown yet at what point this piece will be played. Details about the coronation are slowly being released although the King and his courtiers are keeping everything very close to their chests so we will just have to wait and see what else he has up his sleeve…

Amanda spends her time in London, Mallorca and Ibiza researching fashion from every angle. Zips It Up is a part tongue-in-cheek, part brutally honest look at this world that she inhabits. THE SEVENTIES REVISITED

Hit series Daisy Jones & The Six has influenced a spike in 1970s-inspired fashion. I have read the book but also love the TV series as I feel they have captured the wardrobe and fashion sense of that era.

From dramatic flares to floaty maxi dresses, even in 2023, these styles remain key staples to add to your wardrobe.

At the Michael Kors AW23 show we saw fringe detailing, hip-slung belts and knee-high boots on the catwalk. The High Street has taken note, too. Team Jigsaw’s fringed suede jacket with a pair of flares and you’re ready to rock ’n’ roll. Flares have made a huge comeback, especially for men as seen on the red carpet at The Oscars 2023.

Too scary? Try a softer take with a knitted tank in a retro colour or suede cowboy boots which are everywhere from London to Mallorca right now. Now’s the time to channel the disco decade.

The key look is plenty of denim, floral patterns and those all-important brown leather platform sandals or boots, which are available at the touch of a button on asos.com

Here’s my round-up of the key pieces you need to ‘rock the roll’ this summer 2023.

Palma International Boat Show

27th-30th April, Palma

The Palma International Boat Show returns to Palma’s Moll Vell from the 27th-30th of April for what promises to be even bigger and better than last year’s hugely successful event. PIBS attracts movers and shakes from the marine and yachting industry and has grown to become one of the most well-respected events of its type. Catering to long sailboats, motor yachts, refit and repair companies and everything in between, the event is the place to be for networking. The separate Superyacht Village is a recent edition and is home to yachts over 24m and well-frequented bars and food trucks.

Mallorca 312 29th April

From sea back on to terra firma, the Mallorca 312 is the most famous cycling circuit in Mallorca and attracts cyclists from around the world. Covering 312 kilometres with an altitude gain of 5,050 metres, it is not for the faint-hearted. The route takes in the majestic views of the Sierra de Tramuntana, a UNESCO World Heritage Site, and pushes cyclists to their limits, so much so that registration fills up almost a year in advance. Take care if heading to the northwest of the island on this day as most roads are closed for the event but you can cheer the cyclists on from various points along the route.

The Balearics are well known for their impressive fiestas that are celebrated in all towns and villages around the islands and one of the most famous is Easter. This solemn religious festival is celebrated during Holy Week and is a much more sombre affair than the Easter eggs and bunnies we have come to associate this time of year with. The Crist de Sang (Blood of Christ) is celebrated on Holy Thursday and takes place in Palma. This procession brings together the 33 brotherhoods or ‘nazarenos’ of the island and is a solemn parade of up to 5000 men in long white robes and pointed white hoods. This procession has been taking place for over 400 years and is taken very seriously with many of the men appearing shackled or barefoot in an act of penance. Good Friday celebrations take place in the main squares of towns and villages around the islands and include food markets, religious masses and some more parades. Easter Sunday is mainly celebrated with the resurrection mass at La Seu Cathedral in Palma, famous as the King historically always attended although this has been less frequent over the last few years. Other masses take place in local town churches and families get together to eat and celebrate and enjoy another day off on Easter Monday. Happy Easter everyone!

Puerto Portals Farmer’s Market 5th May

Stroll around the stalls at the Puerto Portals Farmer’s market and sample a selection of local produce from almonds to a glass of wine. Live music, some children’s activities and plenty of familiar faces will be around to make this an enjoyable way to while away an afternoon so grab your shopping basket and head on down.

Pollensa Wine Fair 6th May

The Balearics produce some of the finest wines in Spain, and indeed Europe and many of us that enjoy a glass or two are lucky enough to sample some of these from our local supermarket. But if you fancy supping some wine (from the handy free wine glass that is provided) then head up to Pollensa to sample what the islands have to offer. After two years in a local car park, the event is moving back into the beautiful cloisters of the Convent of Santa Domingo. Handy tip: eat beforehand and take plenty of water as it can be very hot and it isn’t always possible to exit and reenter the event.

RHOC - Hanna and Martin Kinsella: A Family Weekend in Palma

Hanna and Martin recently made a trip to Mallorca for the weekend with their two gorgeous young kids in tow and those of you that follow their social media profiles will have already seen that they had a wonderful time. I sat down with them in Palma on a sunny Monday for a catch-up and to see the kids for the first time in a while! As always, they have lots going on…

Bar Bosch on the Paseo del Borne in Palma is a well-known suntrap and is usually full of people enjoying the views, the food and an afternoon caña. Hence, it was no surprise that Hanna and Martin chose this as the location for a catch up having escaped the grey skies of northern England. Our very own Donna and Larrick were also sitting there on the terrace when I arrived, a pleasant surprise as always as it’s always fun whenever these two are around!

Since we last spoke, Hanna has wrapped filming for the next series of Real Housewives of Cheshire on ITVBe and the series is due to air in the next couple of months.

“This series has been really fun to film,” Hanna says. “We have also had two new Housewives join the cast but I couldn’t name them last time we spoke. Most people now know that one of them is Natasha Hamilton, famous for being in Atomic Kitten”. Natasha has seemingly slotted into life as one of the Real Housewives of Cheshire quite harmoniously and Hanna had only lovely things to say about her. Natasha also revealed on the show that she is pregnant with her fifth child, the first with her husband and is over the moon - a great exclusive for the show and something that they will no doubt give plenty of airtime to.

During the filming of the current series, Hanna also launched her Icy Bear Cubs dental range, a new line of products that

are aimed at children and their parents to improve their dental hygiene. The launch of the product was included in the show and Hanna also ran a focus group to gauge fellow Housewives and other parents’ opinions of the products. In the last edition, we also spoke about the app that will be launched to complement this new line of Icy Bear products and it is now due to be launched and will soon be available for download.

Martin is still very busy with his clinics, both in the UK and here in Mallorca. His patients are still coming back month after month for their treatments and, now that he is back on the island once a month as he was prior to the pandemic, his Mallorca clinic is welcoming more and more patients. As the couple is planning on spending more time on the island in the next 12 months and have bought a property here, Martin is looking forward to offering his patients here more of his time and offering more treatments.

In terms of their property in Cala Vinyes, Martin and Hanna are very excited about this new chapter in their lives and are patiently waiting for the permits and licenses that they need in order to break ground on the building project. Watch this space…

Back to the world of TV and it seems we will be seeing a bit more of Martin from May as the couple’s Dr Kinsella Skincare range will be launching on QVC, the globallyrenowned shopping channel. Martin himself

will be appearing as an expert consultant to discuss skincare in general and promote the products directly. This means that Dr Kinsella Skincare could soon be shipping to more countries around the world and become available to more people in Spain in particular.

During their time in Palma, Hanna, Martin and the kids caught up with friends and family in Palma Nova and also enjoyed lunches and dinners around Palma in some of the main hotspots such as Merchants and Mar De Nudos. Charming photos that Hanna posted on her social media show the kids tucking into(and making a mess with!) ice creams s well as the well-heeled couple posing for photos around the old town of Palma. Hopefully, they will all be back on the island again soon!

The new series of The Real Housewives of Cheshire will be airing in a few months’ time on ITVBe and ITV X. Martin’s clinic, Re-Enhance Medicina Asthetica is located on Avenida del Rey Jaime I, 108 in Santa Ponsa and enquiries and appointments can be made by contacting info@re-enhance. com. To find out more about Dr Kinsella Skincare visit www.drkinsella.com and for everything Icy Bear Dental head to www. icybeardental.com.

FROM DARK TO LIGHT

Una pintura par leer” is the title of the current solo exhibition of the Austrian artist Enrique Fuentes in the HMH Gallery in Port Andratx. The Mexican-born Enrique Fuentes, who studied at the Ecole des Beau Arts in Paris, is one of Austria’s upcoming, contemporary artist elite. He was assistant to Arnulf Rainer and has already a considerable reputation.

Through the influence of Austria’s most famous action artist Günter Brus, who is Fuentes’ mentor certainly promoted his expressive and spontaneous handling of painting grounds, which is an explosive mixture of Austrian activism coupled with informal spontaneity and Mexican impulsiveness.

https://youtu.be/R38BkAIxtMo

From Otto Hans Ressler’s point of view the works of Enrique Fuentes go, so to speak directly into the blood, without taking the detour over the the head. We understand that here was force of nature at work”.

This becomes particularly vivid in the works “Black Angel”, “My Poppy” and “Black Wave” which are presented in the entrance. With powerful and impulsive hurled oil painton the raw canvas these works hit right to the heart. Also a new series of works on paper with the title “The birth of an Angel “are equally passionate works. They radiate a timeless beauty, beyond common ideals, but we can also sense the lurking behind them.

The works were created in 2017-2018 in Berlin and should tell of the complexity of this city. In nightly secret actions, Enrique Fuentes tore thick layers of posters from Berlin’s advertising pillars, glued them to canvas and brutally painted over these poster accumulations. The result is a contemporary document that reflects this vibrant metropolis.Layer by layer posters of films, parties, events - just an excess of impressions of a big citypossibly a subtle hint that one can also loose oneself in this city.

The shady sides and abysses of Berlin.

Through his Mexican roots Enrique Fuentes has a different culturally conditioned view of death and transience. In Mexico, death is seen as a natural part of life is not taboo. Instead, the Día de los Muertos (Day of the Dead) is celebrated with a colorful celebration. In the Mexican tradition of commemorating the day of the dead, La Catrina plays the role of the female personification of death (la muerte).

Fuentes presents in his contemplative approach the broad spectrum.

So it is not surprising that his newly published book “Via Crucis”is the core element of the exhibition “ A painting to read” in Port Andratx, which shows the cross as a sign of eternal life and the attitude of the artist to life and death. In this impressive book, whose covers of raw linen were individually painted by Enrique Fuentes. He works and processes impressively the theme of the “Way of the Cross” in a new cycle of works that was recently shown in exhibitions in Austria.

In the exhibition “Una Pintura para leer”, curated by the director of HMH gallery Andreas Streicher, “Via Crucis is on the one hand an art book but at the same time an original oil painting.

It is on display on a black wall integrated in the center of a 150 x100 cm large black wooden frame , which was impressively signed by the artist during the opening.

An excitingly book that gives deeper insights into Enrique Fuentes’ work and essence - “ Via Crucis” is a gem and a profound, imposing work of art to hang.

A novel concept of the artist, which makes sense.

It is not simply a book about an work cycle, it rather becomes the essence of it.

First of all, the visitor can expect a brilliant start, a fireworkof color and expression as they enter the gallery rooms. Then the viewer’s gaze is drawn to a small imposing work on the front wall of the tubular main room of the gallery. If one goes towards the picture one discovers on the left a passage to a third room, which is filled with large collages, which originate from another phase of Enrique Fuentes. We experience here a small retrospective and notice that Enrique Fuentes works in series, that differ a little bit in terms of technique, but still have the same basic intensity and impulsiveness of a passionate gesture.

A creator with a dark side, whose knowledge of death, disease, despair, gives him something Shamanic. The large size canvas work “Island Fata Morgana” reminds on wings or feathers, that shamans use as utensils for their rituals and a small dusky and expressive work on raw sackcloth in the third exhibition room, even bears the title “Self Portrait as a Shaman.” Surrounded by colorful collages, it seems strangely archaic in this room, surrounded by a modern, shallow world. In conversation with the artist it becomes clear that these collages also reflect the profound nature of Enrique Fuentes.

As if this impression would be manifested, in the collage “Air”, which is placed diagonally opposite the “Self-portrait as Shaman”.

In this work, an open-air concert poster was overpainted with a skull, that refer to finiteness-freely after Goethe’s Faust:

“All is but noise and smoke”

The inspiration for the book came after the exhibition of his monumental nine meter high resurrection painting (the 15th station of the Stations of the Cross) above the main altar in St. Stephen’s Cathedral in Vienna.

The book has been published by Marion Fischer (Gallery Art Moments Austria), who represents Enrique Fuentes as artmanagement worldwide.

https://youtu.be/R38BkAIxtMo

A historical moment in art: Enrique signs the first Pintura para leer.

On a white, almost altar-like table in front of the painting about thirty copies were presented, which whereall painted differently. Enrique Fuentes emphasizes in the conversation that he has filled the cross with life and passion and that he is interested in the repetition of the symbol artistically compositions out of it.

The subversive power of this symbol should be made clear to the viewer. In this way, even in times of crisis the other, daily bread for life will be accessible. The entire book is a a sign of life and gives people orientation in existence.

The exhibition “Una Picture Para Leer” is open until the 15th of April 2023 at HMH Gallery in Carrer Isaac Peral 51 in Port Andratx.

Opening hours are from Monday to Saturday from 12-18h. Outside the opening hours it is requested to make an appointment under +34 610 159 543.

Cala Nova Cancer Charity Shop are on the Move!

Most people in Mallorca are familiar with Cala Nova Cancer Charity Shop in San Agustin as it has been around now for a staggering eleven years and Angela and her amazing team of volunteers have become well known for their kindness and generosity.

The original shop is still on the corner at 358 Joan Miro in San Agustin but there are changes afoot and I sat down with Angela recently to catch up on all their news.

“We have been so lucky,” Angela tells me. “We have had so many amazing donations already this year and people are so generous. We are also getting so many designer donations and interesting things that people will love.”

With all these donations the current shop is feeling a little snowed under and, even with the spillover at the furniture shop and the kids’ shop a few doors down, they just need more space. As Angela knows everyone in San Agustin, it didn’t take her long to find a solution. Just a stone’s throw away from the current shop is a much bigger unit that has a large storage area that the volunteers can use to sort through the donations.

By moving to these larger premises, the two

smaller ones will be emptied and all of the stock will be moved around to make life easier for both the customer and volunteers. Thanks to this and the generosity of the new shop’s owners, costs will be reduced helping your donations to go further. This shop will be full of clothes, shoes, bags, bric-a-brac, bedding and lots of other things that the shop has become so famous for. The original shop will have children’s clothes, toys and prams etc as well as all of the furniture and homewares.

Even whilst organising all of these changes, the shops continue to thrive and the volunteers work tirelessly to make sure that they are able to make donations to their charities and donate things that can be used by other charities such as Yachting Gives Back. Sleeping bags are donated to the homeless, furniture to refugees and other items to abused families that need them. Angela is also talking about putting on another fair at Port Cala Nova this year as

the last one at Christmas was so successful so watch this space for a date!

As always, volunteers and donations are always welcome and with more volunteers, the shop can stay open for more hours every day and help more people. Pop in and have a chat with Angela, bring your donations down to the shop or just come in and browse through the treasure trove of clothing, furniture, books and bric-a-brac.

Angela and the team would like to thank you all for your ongoing support and look forward to welcoming you to the new shop when it opens.

Pop in and see Angela and the team at the Cala Nova Cancer Charity Shop at Avinguda de Joan Miró, 358 in San Agustin between 10 am - 2 pm from Monday to Saturday. For information or to offer your time, give Angela a call at +34 609 84 86 22 or call the shop on +34 971 708 664.

Feliciano López will play his last professional tournament in Mallorca

Feliciano López receives an invitation from the Mallorca Championships to play there in the year of his farewell. The ATP Mallorca Championships (June 24-July 1) will be his last tournament as a professional in our country.

The event took place in Berlin with the presence of Edwin Weindorfer, Feliciano López and with the representation of government institutions.

Feliciano López will say goodbye to the tennis courts this year and will definitely hang up his racket. Feli, a Spanish tennis legend, announced a few months ago that in 2023 he would end a long and successful career as a professional tennis player. The Mallorca Championships has announced that, due to his impeccable career and his incredible contribution to Spanish tennis, Feliciano López will receive an invitation to play the tournament that takes place from June 25 to July 1, 2023 at Mallorca Country Club. Feliciano has been happy for the invitation received and has acknowledged that “in Mallorca I will play my last professional tournament in Spain. Mallorca is a spectacular place and one of the most important tourist destinations in the world and a tournament of the level of the Mallorca Championships helps to continue in that line and I am happy to say goodbye here”. A farewell in style. Throughout these years, the tennis player from Toledo has achieved numerous successes for Spanish tennis, including 7 ATP titles, 5 Davis Cup and Roland Garros champion in doubles. In addition, Feliciano

López has the record of participation with 79 consecutive appearances in Grand Slams and having played at least 20 times in each major: more than enough merits to receive the invitation to the tournament. The long-awaited announcement has been made taking advantage of the tournament’s visit to the Berlin International Tourism Fair together with the rest of the island’s Government Institutions. At the announcement press conference, Feliciano expressed his joy at being able to say goodbye to Mallorca playing on the slopes where in 2021 he achieved his 500th victory on the circuit. The player, a lover of the island, has played in both editions of the tournament and with this participation he will close his particular triplet on his favorite surface, where he has won more than half of his ATP tournaments (two titles in Queens and as many in Eastbourne ).

With the participation of Feliciano López, the tournament ensures a class farewell for the Spanish player and adds this legendary tennis player to the already confirmed lineup, along with the spectacular Australian talent, Nick Kyrgios. Glamor and show guaranteed for a tournament that has its tickets on sale at www.mallorca-championships.com.

Edwin Weindorfer CEO of e|motion group has expressed his joy: “it is a pride to say

goodbye to Feliciano López like this, with an invitation to both the singles and doubles draw and celebrate together his spectacular career and enjoy a great tournament in the Wimbledon preview.

EVENT HELD TOGETHER WITH THE INSTITUTIONS.

This event, which took place in Berlin, was attended by Catalina Cladera, president of the Consell de Mallorca, Iago Negueruela, Minister of Minister of the Economic Model, Tourism and Labor of the Government of the Balearic Islands, Andreu Serra, Minister of Transition, Tourism i Esports of the Consell de Mallorca and Xavier Pascuet General Director of Tourism of the Calvià Town Hall. All the institutions represented have been very proud of the work carried out by the tournament to internationalize and value the island’s brand and to attract new markets that add value to the work carried out by each of the different government institutions.

ARTIST FOCUS: MEET REBECCA NORDELL

My name is Rebecca Nordell and I have lived on this amazing island since 1990. My wonderful parents loved Mallorca and bought me and my sisters here on holiday when we were children, and that’s how I came to love this beautiful island.

After my parents introduced me at such a young age to the sun, swimming and blue skies, it was an easy decision to move away from the winter and cold that I had in the small town of Ludvika in Dalarna, Sweden, in search of warmer climes..

My first stop was Barcelona, then on to Miami and then to the Caribbean and the Dominican Republic. For five years I travelled and worked as a model and was just young, carefree and happy. As with everything though, I finally started longing to return to Europe, and so I went home. And there was always my beloved island of Mallorca waiting for me. At that time Spanair

was looking for cabin crew who spoke Swedish, English and Spanish, and I thought, I should have that job... and so it happened.

I moved to Mallorca, and I absolutely loved every second of my life, we had sooooo much fun. We flew around the world and just enjoyed every second. After 5 years as a flight attendant, I had my beloved son and had to stop flying. I thought I’ll come back right after I have the baby, BUT no, I was so in love with my son like all mothers that I didn’t want to fly and be away from him. So instead I decided to open a business and stay in Mallorca to be with my son every day.

During this time I did many different types of creative design of all different kinds, such as painting on glass, making jewellery, decorating, etc. I started a course learning to sculpt nails, and I just loved it. It felt like I had found my home at last. I have now worked with nails for 15 years and still think it’s super fun. I create something new every day and make people happy. Meanwhile, my son was all grown up, and at 17 he moved to Sweden to study.

I have never felt so lost and alone in my life as the day he left. I became so empty and lonely, and there was no meaning to anything. That’s when I decided to start painting... I’d always wanted to try

it, but I didn’t have the time before. It was absolutely the best decision I’d made in a long time. It was like meditation. Time stood still when I painted and I forgot everything, and I also felt a rush of happiness that gave me a lot of energy, like being in love… It started in sadness, and there were many sad faces, especially in the eyes, but this sadness turned to happiness for me.

I was loving it but I felt that wanted to

further develop my painting skills. It was at that point that I had the luck to meet the amazing artist Bego Riba, who is now my teacher. She has taught me so much and still does. I paint with her every week and it is incredible to see my personal development. Little by little, I have become more and more fascinated by facial expressions and how much the eyes can speak. It is this that gives me joy and harmony now. Being creative and painting has helped

me so much. I have now come so far that I will have my first exhibition and it feels completely surreal. I hope that you’ll be able to join me and share in the joy that I get from putting brush to canvas.

SOLLER VALLEY STORIES

Spring has arrived in the Soller Valley. The meadows are full of carpets of yellow sorrel and blossom still lingers on some trees. With a ‘blue sky’ backdrop this is the favourite Soller season for many. The weather is good enough to walk, sit and on some days swim and sunbathe. Spring can often surprise with a quick return to winter, but we now have proof that the seasons are heading for summer.

The Soller Valley always enjoys the Easter season with the Parades and Observances of the Penitents. Wonderful sombre traditions are observed and taken part in. Many visitors mean the hotels and restaurants are very busy. The ‘foodie’ reputation of the Valley is known far and wide. Many make their reservations in our special restaurants before they arrive here to be sure they get in. The ‘Soller Prawn’ is mentioned often by

top chefs and foodie bloggers. This is the place to taste them as they are brought into the Port of Soller and into the hands of local chefs within a few hours of landing. The season has officially started in Soller and in the Port. Restaurants often offer live music along with their great cuisine and weekends are full of local events and more live music. This is a world with an event vibe of its own - our area is not called ‘The Island within an Island’ for nothing.

The unique transport system of the 100-yearold train negotiating the mountains is an art form of its own. Pick it up from the centre of Palma and prepare to be enchanted. Get off in Soller then hop on a wooden tram to complete the trip to the sea. This is a trip never forgotten by the thousands who do it every year.

Every month has a new story and vibe in

our world. Day trippers and holidaymakers make this place their own and repeat visits are common. At the heart of the place is the welcome that returning families experience here. Traditional bucket and spade holidays go alongside the passion for fine dining and the cocktails of the sunset watchers. A gentle place for all seasons is here in the glory of the Soller Valley. You are very welcome…

THE GLOBAL WELLNESS MARKET AND THE FUTURE OF WELLNESS IN MALLORCA

THE NEW BALEARIC TOURISM LAWS

These new laws set numerous goals and obligations for the island’s tourism hotel industry, the Mallorca Sustainable Tourism Observatory (STO) is a key new element of the island’s strategy to preserve the destination and assess how the sector affects the natural environment, economy and the residents. These key objectives include promoting a circular economy within hospitality, reducing the overall carbon footprint and promoting locally-produced gastronomy to enhance Mallorca’s reputation and increase its appeal.

My first Wellness article last month for Celebrity Magazine focused on the growth and expansion of the Global Wellness Market as a whole. An overwhelming number of facts and figures to get your head around, but the main message being, the world is more than ready for a more expansive Wellness approach, in all areas of life - the emphasis on holistic health being amplified by the Covid pandemic.

To reiterate a little - according to the Global Wellness Institute figures (see my previous Celebrity article for more information)

Wellness Tourism is one of the biggest growth areas in the entire Wellness market. Not only that but Wellness is forecast to be the biggest growth area for the global travel industry as a whole, with a predicted increase of 20% to an industry worth over €1050 billion by 2025 (pre-pandemic figures valued the market at around €700 billion in 2019), Wellness equals big business for the future!

Post-pandemic, the Balearics have become

Spain’s most successful tourist region, with Mallorca winning the prize as the most popular destination, according to 2022’s statistics. Clearly, a successful PR campaign for the island being an all-year-round destination.

Under the skin, Mallorca has always been a perfect “wellness” location, with so much to offer to the Wellness Traveller.

Firstly, there is the stunning diversity of landscapes from rugged mountains in the north, lush interiors and fertile plains, and a spectacular coastline that stretches for 550km with over 367 beaches.

The cosmopolitan city of Palma, with its ancient culture and rich traditions, year-round island-wide festivities, and a variety of entertainment intertwined with Michelin-acclaimed gastronomy (11 stars across ten restaurants at the end of 2023, compared to Ibiza’s two), the island also boasts award-winning wines and a multitude of luxury designer hotels. There are a vast array of activities to keep

everyone active and engaged, including sailing, hiking, diving and cycling and a number of other exciting outdoor activities. Add to this an average of 300 days of sunshine a year - the icing on the cake - Mallorca stands head and shoulders above so many other destinations around the globe.

There is of course always a downside - and that is the sheer volume of tourist numbers in the summertime and the impact it has on the island’s natural resources and infrastructure. Ironically, Covid once again has helped highlight the fact that sustainability is essential for the future growth of tourism, particularly if wishing to compete in this highly lucrative expanding wellness travel market of the future. New legislation was passed in May 2022 with the mission of making the region’s tourism industry more environmentally friendly and creating a sustainable and regenerative tourism model for the Balearic Islands as a whole.

Diesel and other fuel boilers are to be replaced with thermal systems to cut CO2 emissions, with the installation of watersaving devices in bathrooms and the abolition of single-use plastics among the new regulations. Although the legislation doesn’t include plastic bottles as yet, the islands are moving in the right direction, aiming to reduce waste by 20 per cent by 2030. Filtered water is set to become a

more usual sight in Balearic hotels, bars and restaurants in the next few years, with The Plastic Free Balearics initiative set up to help hospitality firms find more environmentally-friendly alternatives, whilst also reducing the impact on marine ecosystems caused by plastic pollution. All establishments must draw up a strategic circular plan for energy, waste, water, land use, food and mobility. Now tourist establishments must offer at least 3% of local produce, livestock, or fishing products. In the case of 4 and 5-star hotels, the percentage rises to 4% and in rural agro-tourism establishments, they must offer at least 5% local produce. The new law also includes a moratorium on any new tourist accommodation for the next four years (currently the Balearic Islands has more than 600,000 tourist beds). The law permits hotels to grow by 15% in volume in exchange for a 5% reduction in the number of beds. It also authorises a change of use for obsolete hotels, which can be converted into housing. But it’s not just in terms of environmental protection that Mallorca

tourism is to become more sustainable. Working conditions for employees in the tourism sector are also to be improved - an example includes Hoteliers being required to purchase height-adjustable beds so that cleaning staff no longer injure their backs when changing bed sheets.

Francina Armengol, the regional president of the Balearic Islands, is determined to make the Balearic Islands, in her words, “a fully sustainable destination”. Ultimately, Mallorca and the Balearics are heading in the right direction towards becoming fully equipped and prepared for this new expanding market to open up. Each month we will venture into the developing world of wellness, bringing you the latest news and activities from around the island of Mallorca. If you would like to contact me to share your wellness offerings, either as a service, an experiential provider or because you have been a recipient of the best this island has to offer, I would be delighted to hear from you at amanda@wellnesstraveller.co.

Mind Matters a spiritual journey to recovery

We know that awakenings are triggered by big life changes, breakdowns, breakthroughs, and traumatic situations. But why you had a spiritual awakening is simple: Life decided you were ready to finally wake up and see your life path ahead differently. Whatever the case, spiritual awakenings occur when the soul is ready to undergo a process of transformation – and that may occur at different moments for everyone.

HERE WE LOOK AT THE BENEFITS OF FEELING MORE ENLIGHTENED:

• Clarity for life’s decisions

• In control of your emotional reactions

• Inner peace and outer love

Positive mental health can be reached through several ancient practices.

This month we’re following some of the personal accounts from some of Jamie’s clients, who give us a personal perspective and insight into this way of life and how it’s made a positive impact on their lives.

Mind Matters a spiritual journey to recovery

Testimonials

I reached out to Jamie after reading one of his articles in Celebrity Magazine. I have lived a very ‘ordinary’ life and not ever really explored anything spiritual, but I was curious in the work that Jamie was doing, and his methods.

After an initial phone call where Jamie asked a few questions, I booked in my first 90-minute session with him.

My first visit was very relaxed and Jamie explained how he works and what good results for this, and any future sessions look like, along with a cleansing of my chakras. I know Jamie helps a lot of people who are in very dark and low places, this was not the case with me, I was actually in a reasonably good place, although I could see how Jamie could help me ‘sharpen my mind’, help clear the ‘brain fog’ and simply feel even better and mentally stronger.

I am now around six months seeing Jamie on a twice-monthly basis and can honestly say that I am seeing things clearer, making better decisions, showing more confidence, and I am looking forward to exploring many more sessions with Jamie as I discover more about shamanic wellness and my progress on my spiritual journey.

Island Spirit Mind, Body & Soul

I was first introduced to Jamie through Amanda when I started attending his meditation classes. I then decided to invest in myself and started seeing Jamie for one to one sessions. WOW is all I can say. If you have met Jamie, I’m sure you will have felt his kind energy and that is exactly what you will experience in a session. His calming presence and actual want to help you with whatever you are currently experiencing. There is zero ego with Jamie. He genuinely wants you to get the most from a session and help you in your healing and spiritual journey. When Jamie mentioned to me about integrating the rites of the Munay Ki, I had no hesitations. Each week integrating a different rite, experiencing different emotions each time. Each week there are different practices associated with each rite, to take away and implement in your daily routine. Jamie is fantastic at guiding you through this process. His knowledge and experience is something to be

admired. So inspiring. Some weeks I would come out light as a feather, some weeks bouncing on a complete high, some I would want to listen to my body and rest, some weeks were emotionally and physically harder then others and I had to experience and process emotions that the rite had bought up for me. Healing is certainly not always pretty and has never been linear for me but all with Jamies constant support, guidance and love. As a reiki practitioner I am always learning and implementing new practices into my healing journey. Meeting Jamie and integrating the rites of the Munay Ki has been one of my most profound learning, healing and spiritual journeys I have been on and I truly hope anyone on this path gets to experience it. I am always so immensely grateful to Jamie who has become a great friend, more like family and came into my life at exactly the time he was meant to.

Being an energy healer myself I’m in need once in a while to get healing myself, Jamie has proven himself to be a good and clear channel in whom I trust and on top of this he is a very kind and generous human being.

Although im a very spiritual person by nature i never thought I’d be one into the whole “energy healing” thing for coping with the weight of huge life decisions , but after a year of struggling with my mental health and feeling like I was stuck in a foggy rut, I was given the opotunity to give it a try. That’s when I was invited to learn and experience the Munay Ki Rites, a set of ten energetic transmissions that are said to help bring balance and healing to one’s life.

Knowing Jamie as a wonderful peaceful soul for a year i put my trust and life in his hands and signed up for the whole package, not really sure what to expect.

As I went through each of the ten rites, I began to notice a shift in my energy and perspective. The first rite, the Healer’s Rite, was all about healing our wounds and learning to become a vessel for healing energy. I felt a sense of peace and comfort after receiving it, like a weight had been lifted off my shoulders.

The second rite, the Bands of Power, was all about protection. As someone who has always been a bit of an empath and struggled with taking on other people’s energy, this rite was particularly powerful for me. I felt like I had a shield of energy surrounding me, keeping me safe and grounded.

As I continued to receive each rite, I felt like I was shedding layers of negative

energy and old patterns of behavior. The Harmony Rite helped me let go of any conflicts or grudges I was holding onto, while the Seer’s Rite helped me tap into my intuition and trust my inner voice. By the time I received the Starkeeper’s Rite, the ninth rite, I felt like a completely different person. The Starkeeper’s Rite is all about connecting with the cosmos and our place in the universe. As someone who has always been interested in astrology and spirituality, this rite was particularly meaningful for me. I felt like I was part of something much larger than myself, and that my existence had a greater purpose.

The Creator Rite is all about stepping into our power and becoming co-creators of our lives. It was a fitting towards the end of the whole process, as I felt like I had truly taken ownership of my life and my energy.

The tenth and final Rite of the Womb

The Rite of the Womb is the most wonderful transformative energy healing in a ceremony that can brings many benefits to women. This Rite helps release emotional and physical blockages held in the womb, restore balance and harmony to the reproductive system, and connect women with their feminine power and creativity.

This powerful ritual also helps to heal past traumas and ancestral wounds we may have carried through many generations as well as promoting self-love,

personal acceptance, fostering a deeper connection to the divine feminine energy we all carry within. The affects… So what has been the impact of completing the Munay Ki Rites on my mental health and well-being? It’s hard to put into words, but I can say that I feel more centered, more grounded, and more in touch with my intuition than ever before. I’m not saying that all my problems have disappeared overnight, but I do feel like I have a stronger foundation to work from.

For example, when I’m feeling overwhelmed or anxious, I have a set of tools that I can turn to. I might light some candles and do a meditation to ground myself, or I might do some energy work to clear any blocks. And when I’m feeling lost or unsure of my direction, I can turn to the Munay Ki Rites as a reminder of my purpose and my connection to something greater. Overall, I’m so grateful that I took a chance on the Munay Ki Rites. It’s easy to dismiss something like energy healing as woo-woo or pseudoscience, but I can say from personal experience that there is something real and powerful here. If you’re feeling stuck or lost or just looking for a new way to connect with yourself and the world around you, I would highly recommend giving the Munay Ki Rites a try. You might just be surprised at the results.

HIGHWAY TO A BETTER LIFE

Business and Private Relationships on Social Media

Additionally, social media can create unrealistic expectations for relationships based on the curated, idealised versions of people’s lives that are often presented online. This can lead to feelings of inadequacy or disappointment in real-life relationships. Overall, the impact of social media on relationships depends on how it is used and the individuals involved. It’s important to use social media mindfully and communicate openly with partners about how it is affecting the relationship.

MY ADVICE:

1. Set boundaries: It’s essential to set boundaries for your social media use, such as limiting your screen time, taking breaks, and not checking your phone first thing in the morning or before going to bed.

Social media can be a valuable tool for businesses to build and maintain relationships with customers, partners, and other stakeholders.

One of the biggest benefits of social media for businesses is engaging with customers and receiving real-time feedback. Social media platforms provide a direct line of communication between businesses and their customers, allowing them to respond to questions, concerns, and feedback quickly and easily. This can help build trust and loyalty with customers, as well as improve the overall customer experience.

Social media can also help businesses establish thought leadership and brand authority in their industries by sharing relevant content and engaging in industry discussions. This can help businesses build relationships with other businesses and industry influencers, leading to potential collaborations and partnerships.

However, it’s important for businesses to use social media strategically and mindfully. Overpromoting or spamming followers can turn them off and damage the relationship. Also, businesses must take care to manage

their online reputation, as negative comments or reviews can quickly spread on social media and damage a business’s reputation.

Overall, social media can be a powerful tool for building and maintaining business relationships, but it requires a thoughtful and strategic approach to use effectively.

Personal Relationships and Social Media

Social media can have both positive and negative impacts on relationships, depending on how it is used.

On the positive side, social media can help people maintain long-distance relationships by allowing them to stay in touch and share updates about their lives. It can also help people meet new romantic partners or form new friendships through dating apps or online communities.

However, social media can also have negative effects on relationships. For example, social media can increase jealousy and insecurity in romantic relationships if one partner is spending a lot of time liking or commenting on other people’s posts. It can also make it easier for people to cheat or engage in inappropriate behaviour online.

2. Be mindful of your content: Think before you post and consider how your content may be perceived by others. Avoid posting or sharing content that is offensive or discriminatory, and be aware of the potential consequences of your actions.

3. Engage positively: Use social media to connect with others in a positive and constructive way. Avoid engaging in arguments or negative interactions online, and focus on building relationships and fostering a sense of community.

4. Protect your privacy: Be aware of the privacy settings on your social media accounts and take steps to protect your personal information from being shared or accessed by unauthorized users.

5. Stay informed: Be aware of the latest trends and developments in social media, including changes to policies or new features, and stay informed about how these changes may affect you and your use of social media. By following these tips, you can use social media effectively and responsibly, while minimizing the potential risks and negative impacts that can come with excessive or thoughtless social media use.

BOATS, BIKES AND AUTOMOBILES

Welcome to my favourite time of the year. The days are warm, the evenings are cool, the air is clear, every flower is blooming, the roads are empty and the Rally Clasico Mallorca recently rolled its noisy way into Puerto Portals.

Two and a half days of tarmac closed-road special stages awaited those taking part. As always, the cast was a good mixture of local classics, some genuine rarities and oddities - and a host of flatulent Porsche 911s all the way from Germany, more often than not taking away most of the silverware.

I’ve done this event a number of times, unable to compete this year as the Lotus we crashed last year remains crashed. Even so, no less than a record of around 130 cars were entered into the 19th year of this wonderful event. This is good and bad

- and while I’m delighted for my friend Toni Descallar who organises all the fun to have such an amazing turnout, there must have been a lot of waiting between stages. On the first evening of the night stage, many cars had returned to the Parc Ferme in the port before a substantial amount had even started. None of this matters much to the competitors, allowing for much camaraderie and petrol-headed chit-chat while they wait. The event was not helped at all this year by a combination of bad weather and the odd politician. Back at the end of February, Storm Juliette lashed the island, dumping half a metre of snow on the Tramuntana and felling hundreds of thousands of trees along the entire range, understandably taking an age to clear. Equally recalcitrant was a local councillor, who refused to sign off the event

for the stage from Andratx to Estellencs. Bearing in mind the amount of money that this event brings to the island each year at one of the few times when it is relatively quiet, it is somewhat tedious that they couldn’t put one morning aside to allow it to happen on this particular stretch. With a landslide at Sa Calobra, the event lost three of its signature stages - a poor return on the immense amount of work of the superb organising team and the infinite number of local Mallorquins that assist in marshalling the show.

The Ma-10, which stretches from Andratx in the southwest, all along the Tramuntana to Pollensa in the northeast, must be one of the best driving or riding roads on earth. Once the route finally opened, I took the motorbike from Cap Formentor to Soller

and was amazed at the devastation - only mitigated by Storm Juliette usefully filling up our empty reservoir at Gorg Blau in one hit.

Up in the mountains, behind the road closure signs and unseen by the majority, the local authorities have done an incredible job of clearing the roads - not least for the arrival of hundreds of thousands of well-heeled and brightly (sometimes questionably..) dressed peddlers that descend on the island at this time of year - the cycling season is upon us. Time to get fit then - and is there a better place anywhere on earth to ride at this time of the year? With the Mallorca 312 and the 6Points Mallorca taking place in April and May - both circumnavigations of the island over one or three days respectively - it’s a very good excuse to get out there and enjoy it before the true hordes arrive. It’s going to be a busy year..!

BARCOS, MOTOS Y COCHES

Property Market Update by

In this article I am going to give my practical and synthesised vision of what decision the buyer should take when it comes to materialising the interest in a sale and purchase contract, as the formalisation and signing of this contract generates rights and obligations for all parties (buyer and seller), and also, why not for the rest of the professionals involved, who see reflected in it the work carried out in the previous phase of negotiation.

In the real estate market, there is a common tendency to confusion when it comes to formalising the private contract to ensure the future sale and purchase of a property.

In fact, it seems that we are talking about the same thing, but it turns out that they are two different legal businesses, and, above all, and with regard to both the seller and the buyer, it can imply a better positioning in the sale and purchase. We are talking about the option to purchase contract and the deposit agreement contract.

We start from the assumption that both contracts are perfectly valid and legally recognised as fully operative in legal transactions. But what is in the interest of the buyer? Let us see.

The option to purchase contract grants the “opting party” the right and power (not the obligation) to acquire a property owned by another party, called the “grantor”, for a certain and determined price, and under certain agreements established in the contract itself, upon payment of an amount, which is called the “option premium”.

Although it is true that it is not a contract regulated as such in our Civil Code, and that, in any case, it will be regulated by the provisions and agreements reached by the parties, its regulatory framework is to be found in Article 14 of the Mortgage Law, which to a certain extent sets the guidelines for its regulation.

Normally, and in practice, this type of contract is usually used for various reasons.

HOMES & PROPERTIES

Actualizacióndelmercadoinmobiliario

Either the purchaser and future buyer needs financing to carry out the purchase, or to complete the necessary documentation to carry out the purchase.

On the other hand, the deposit agreement contract is legally configured as the agreement whereby the purchase is secured by means of its notarisation, through the payment of a monetary amount, which will serve as a means of compensation for the defaulting party. This is what is known as the deposit paid by the buyer to the seller in order to complete the sale.

The problem lies in the question of what the buyer considers to be legally protected by this down payment regarding the performance of the sale.

With the payment of the deposit, the execution of the sale is not 100% assured, as the seller can withdraw from the sale with the effect of releasing the buyer from the obligation to pay a certain amount depending on the type of deposit signed.

I say the type of deposit signed, because there are 3 types (confirmatory, penal, and penitential), although the Civil Code only refers to the so-called penitential ones according to the provisions of article 1154 of the Civil Code. Focusing on the latter type, since the others, namely confirmatory, which are configured as an advance payment that prevents the seller

from cancelling them at his own free will, and the buyer can demand fulfilment of the contract or termination by claiming the damage caused, or the penal ones, which respond to a guarantee in the fulfilment of the contract, it is worth mentioning that they are those that set out the future conditions that will govern the sale, giving both parties the possibility of freeing themselves from the obligations of the contract. On the one hand, the buyer, with his decision, loses the amount paid. On the other hand, if it is the seller who exercises it, returning “in duplicate” the amount received.

However, from a legal perspective, and in order to avoid legal surprises according to the criteria maintained by the Supreme Court, I expressly mention that in the deposit contract that is formalised, it should be clearly stated that the deposit is a penitential deposit governed by article 1154 of the Civil Code, as otherwise we would find ourselves with the power for any of the parties to demand the fulfilment of the contract.

Having made these clarifications, and without prejudice to the fiscal aspects for taxation purposes, in my subjective opinion, the opting party and purchaser should choose the legal form of the option to purchase contract, as it will allow him/ her to control the sale to a certain extent, being empowered to exercise the sale in the agreed terms, both in time and price, and not allowing the seller to cancel it at his own interest (e.g., a party with a proposal for the sale of the property with an option to purchase it), and not allowing the seller to cancel it at his own interest. This is why, on the contrary, it will be in the seller’s interest to formalise the deposit agreement contract, as long as it is penitential, since he will be able, at any time, to cancel the contract, paying back double the amount received.

TRIBUNAL LEGAL TRIBUNAL LEGAL

As I mentioned in my previous article, today we are going to deal with the modification of Article 5 Uno.2. B, of the LAW ON WEALTH TAX, Law 38/2022 of 27 December, regarding:

SUJETOS PASIVOS POR OBLIGACION REAL TAXPAYERS OBLIGATION

What does this mean, very simple, until now, those non-residents in Spain, who had their property and assets located in Spanish territory, regardless of their country of residence, in companies, either in Spanish companies or interposed companies.

That the sole shareholder is another foreign company, as well as those foreign companies that have invested directly in Spain and meet this requirement: That their assets are constituted in at least 50%, directly or indirectly, by real estate located in Spanish territory, will have those persons who are at the end of the chains of companies or corporate entanglements to be taxed here in Spain

for Wealth Tax.

It should be noted that each case must be studied individually, as some countries in their international double taxation agreements with Spain may provide for this situation, which will affect each country in a very different way. This leads to three different situations:

1) Countries with double international taxation agreements, such as the United Kingdom and Germany, will be affected by the modification and will have to pay tax on their assets.

2º) Countries that Spain has an international double taxation agreement, but without a clause on real

estate companies, e.g. Holland and Switzerland, will not be affected by the modification.

3º) Countries that Spain has not signed an international double taxation agreement, for example Italy and Portugal, will be affected by the modification and will have to pay tax on assets.

This change will come into force in the year 2022, and the deadline for filing this tax will be from 11 April to 30 June 2023.
