He seemed to be lacking in the influence and high esteem he holds, as the man who decided against taking a salary as Mayor of Jávea because the honour of being a salaried County Councillor was sufficient reward in itself. I have never attended a function arranged for foreigners by the Alicante Diputación - and some might ask why I think I have the right to voice an opinion, but my opinion is voiced as a Taxpayer, who has always believed such meetings were about travel and status of Foreigners’ Department staff, rather than about actual influence on integration of those who CHOSE to live among those BORN here. Xabia Democratica suggest a consequence of the cuts will be antagonism of foreigners who volunteer their time in charity work (like MABS, the Charity Shops and Dog Pound) not to mention the local churches who care for the spiritual needs of local residents. A motion by Deputy Mayor Oscar Anton - agreed by members of all political groups to demand the cuts are rescinded - was approved by Jávea Councillors at their February monthly meeting. Since 2011 the County Council of Alicante (Diputación), the Department for Foreign Citizens - has funded the ‘Optimiza’ project aimed at maximising their support for the local events and

intentions of individual municipalites. Among its programmes and achievements, have been: a) Information campaigns about procedure and legal matters b) Development and integration programmes. c) Consulting services and resident assistance. d) Census campaigns e) Spanish (Castellano) Courses. Jávea has been pro-active in these initiatives. Oscar Anton Deputy Mayor and Councillor for Foreign Residents, himself created the successful Help Desk in Jávea, as well as English classes taught by volunteers, lectures and many other initiatives that have been an example for the province. Earlier in February Oscar was present at a meeting in Denia where Councillors were told the Diputación budget was a little over 193 million €uro, resulting in a massive cut in funds for the ‘Optimiza’ project, sufficient only to pay staff rather than make grants to non-profit groups in local communities. The situation was described as ABNORMAL; a department that manages 25% of the population of the province has only 0.0004% of the budget. The Councillor said over 80% of activities carried out in the departments for foreigners are provided free of charge to the Council by local volunteers.

Jávea Councillors’ February Meeting

Twenty-eight items on the Agenda (twice as many as usual) was an indication it would be a long meeting. The length of political posturing speeches seems to bear a direct relationship to the unimportance of what is being said. Repeating the same arguments achieves nothing.

Point 1 approved Draft Minutes of the December 2014 and January 2015 meetings. Point 2 approved actions taken under delegated authority by the Mayor’s office. Point 3 ratified a Report sent to the Infrastructure and Environment Agency to declare Pol 33, plots 334 and 335 by Antonio Martí Sart to create a Cultural Centre. Point 4 approved proposals by the Town Planner with respect to Roig-Roquetes 2. Points 5 - 11 dealt with routine approval of financial obligations and payments. Previous reference to the ‘Festival Internacional’ would be amended to ‘Asociación del Festival Internacional’. Point 12 approved the change in admin charges in building areas and will now be published in the BOE. Point 13 acknowledged the fact on a regional Committee that meets to decide who should pay how much for waste disposal, the votes of municipalities are outweighed in number by the votes of the private contractor. PP abstained from voting. Point 14 agreed to the claim by Alonso Garcia for damage in C/. Penaguila to his vehicle on 5th February, at a cost of 2442€. The excess of 150€

Point 23 approved payment to Juan Fornes Fornes S.A. of 790€ for food giving to the hungry and homeless in 2014. Point 24 approved a report on Town Planning in Jávea during 2014. Point 25 brought up the matter of permission for Poygi S.L. to manufacture and distribute cleaning and insect repellant products, for 109 square metres, which is above the existing limit. Councillors suggested they had insufficient information on which to make a decision, but it was approved. Point 26 approved reimbursement to Balcon al Mar owners of plots 1, 2, 4, 5, 13 and 14, who had paid for work that was never undertaken. Point 27 approved the Programme of Interculture for 2015 to 2018, which was the last of the Agenda items.

MOTIONS Amparo Bolufer Castelló sought recognition of 8th March as World Women’s Day, pointing out the inequality between men and women, both within and outside of the workforce. Children need to be made aware that domestic violence is wrong. Approved Oscar Anton drew attention to the fact that 25% of the population of Alicante Province (and half of Jávea) is made up of foreign residents who provide a major structure of support for life in Jávea, benefitting Spaniard and foreigner alike. The Alicante budget was being cut to 142,000€. PP abstained but the motion requesting the Diputación reconsider was approved. Jose Luis Cardona Salvador called for more

will be paid by the Townhall and the remainder by Allianz insurers. Point 15 agreed 810€ in compensation to Catalina Puig Ferrer for damage caused by piping in C/. Santo Domingo. Point 16 Councillors approved the private use of the public square in Urb. la Plaza. Point 17 approved the obligations of the Personell Department in respect of 5 labourers employed on 5th December 2014. Point 18 approved the monthly payment to Convi Levante S.L. in respect of security at the underground carparks for December 2014 of 19,700 €uros. PP councillors and Belén Quiroga abstained. Point 19 agreed to pay 5299€ to Quesercons Marina Alta S.L. for cleaning of pavements and ditches. PP councillors and Belén Quiroga abstained. Point 20 approved payment of 14,677€ to CESPA for cleaning beaches and public areas in December 2014. Point 21 approved payment of 48,668€ to Vareser 96 S.L. for cleaning of school buildings. Point 22 agreed payment to AMJASA of 187,46€ for water used at the Day Centre opposite the town Mas y Mas.

Jávea's Department of Agriculture is bringing the world of beekeeping to the people, providing the opportunity to visit beehives in the Montgo Natural Park with beekeeper Francisco Cervera. Study highlights Jávea and Denia beaches at risk through climate change

The Hydrographic Confederation of the Xùqer (Ministry of the Environment) has produced a pessimistic study which identifies the Marina Alta beaches as an area of high flood risk due to global warming. The area of high risk stretches from Els Poblets to Moraira. There is a

possibility that the sea level will rise by 20 cm over the next 35 years. According to the IPCC report, the sea level rise could be 86-96 cm.

Fishing around San Antonio Marine reserve better regulated

|Denia Town Hall is to restrict fishing in the buffer zone around the Denia side of the San Antonio Marine reserve to six small vessels per day. The affected zone lies offshore between the light house and the Torre del Gerro. This decree provides for the creation of a commission to create guidelines for fishing in that extended area as well as the maximum number of vessels which may fish. To date there has been no regulation about it, creating some confusion among fishermen.

Hundreds of families were evacuated from their homes in Albania and one woman drowned after being swept away by floodwaters, the Associated Press reported. Snow continued to blanket parts of Italy and Spain, where hundreds of motorists were trapped on roadways. Two homeless people were killed after northern Spain was later hit by a second wave of snow. "The pattern responsible for this is called a rex block, a classic blocking pattern in the mid-upper levels of the atmosphere," says weather.com senior meteorologist Jonathan Erdman. "High pressure aloft centered over Scotland trapped a massive, lumbering area of low pressure aloft centered over Spain and the Mediterranean Sea. "With the west-to-east flow of weather systems temporarily thwarted, persistent heavy rain and snow results in this case near the upper-level low in a rex block. Spain, Italy, and the Balkans were the worst affected."

AMJASA to develop plans to connect 10,000 houses to mains sewerage

Amjasa is taking the first steps to develop a plan to connect urbanisations throughout Jávea municipality to mains sewerage. Many of the houses in the campo have septic tanks, constituting a source of pollution to the environment. It is acknowledged that Jávea's varied landscape of hills and valleys make such a project difficult, but imaginative approaches, such as recycling domestic water for garden irrigation should be looked into.

Montgó fire - transcripts reveal chaotic coordination

Following the Montgó fire in September, there was a lot of finger-pointing between central and regional governments as to who was to blame for the slow deployment of firefighting helicopters and planes. Although a report in October hinted the Central Ministry was to blame, transcripts of conversations reveal that the bottleneck rested with the Valencia authorities — and bureaucratic protocols - for example, precious time was wasted because requests for air assets had to be

Would be San Antonio lighthouse developer sends a counter proposal

The Denia businessman, David Morera, who is behind the proposal to turn the San Antonio lighthouse into a private hotel, has sent a letter to Jávea stating that his development will have broad public uses including space to develop a visitor's centre about the Marine Reserve, a large, 190m2 lookout, 2000m2 of land for the planting of species native to the Montgó, camera placements for observing the marine reserve, two permanent offices in an auxiliary building, an 80m2 room for presentations and exhibitions and a restroom for visitors. The general public would have access at least 5 days a week. Jávea Townhall has decided the lighthouse should be a public building, and is not suitable to be turned into a private hotel. There are two buildings in the lighthouse grounds: The lighthouse itself - which is the subject of this proposal, and the Semophore, which Morera has rented from the owners (la Sociedad de Correos y Telégrafos) for 20 years. However Jávea Townhall has noted that development of either building would infringe five urban development

regulations.

Pere Sapena gives pre-election update on General Plan

Jávea Councillor for Town Planning, Pere Sapena of Xabia Democratica presented to the press a report detailing the current situation regarding the General Urban Development Plan. In his presentation, Sapena reviewed the actions already carried out, "Two distinct fronts have been worked on, these are: structural and detailed". With reference to the detailed plans of October 2011, April 2013 and February 2014 three specific modifications have been made for the Tosalet 3ªfase, Pinomar and Tesoro Park areas, to adapt the management of the soil to reflect the degree of consolidation currently in demand and make development work viable through systematic procedures, thus unblocking the process for granting work licenses and certificates of habitation in these sectors The councillor went on to explain, "In May 2013 a consolidated document of the General Plan was approved, with updated maps and catastral information, a clear document as a basis for the planning of the entire municipality, being digitally based and to sufficient scale so as to continue revision of the document, in addition to providing legal security to the existing plan." There is a proposal being prepared which covers detailed planning, affecting: alignments, uses and planning regulations, with solutions to the existing problems and is applicable to extensive urban land, which is the largest of areas and the most frequently requested actions in Jávea, with a view to resolving them as soon as possible. The only disagreement I would have with him is that chatter has now been replaced by chat, and that children today are incapable of speaking to their elders with respect because they are incapable of speaking to anybody who isn’t holding a cell phone.

The truth of the matter is (and yes here comes another uninformed opinion unburdened by evidence) that each generation believes the youth of the day to be worthless; the only difference being that the present lot really and truly are.

And nowhere is this more verifiable than in the use of language. The younger generation speak a version of English that is unintelligible at best, and lacking in the finesse and sophistication required to maintain our empire at the pinnacle of its supremely designed destiny.

When I was a young man we were considerate and respectful towards our elders; there was a code of behaviour, even in a pub. Nowadays the only code of behaviour among the youth is the bar code that supermarkets had to put on their products due to the inability of their cashiers to deal with basic addition.

However, in the end, having failed to maintain a meaningful conversation with even my youngest offspring, I have bought a PC, and have been given a code book containing some common acronyms, with which I can now at least inform him that supper is ready or spring has arrived. They are: 2nite - Tonight, BTW - By The Way, B4N - Bye For Now, GR8 - Great, CUL8R - See You Later, LOL - Laughing Out Loud, ROTFLMAO - Rolling On The Floor Laughing My Ass Off, NP - No Problem, OIC - Oh, I See, RTM - Read The Manual, TMI - Too Much Information, TTYL - Thank You Very Much, XOXO - Hugs and Kisses.

The experts tell us that language is a living thing and will evolve with each generation as an expression of the essential nature of the social climate that each generation is born into.

People thought Yvonne had been sacked

Visitors to the Help desk at Portal del Clot were greatly surprised recently not to see the familiar face of Yvonne Henry at the Help Desk but none other than Oscar Anton, Deputy Mayor and Leader of Xabia Democratica. Many held their breaths as they wondered what had happened to Yvonne and whether the charming Deputy Mayor would be as helpful as the well liked Yvonne, but it all ended well with Oscar scoring an A+ and he promised to visit the Help Desk again soon. Establishing the Help Desk was Oscar's brainchild and is set up and run by XD and funded as one of the ‘Positions of Confidence’ provided and paid for by the Townhall. Oscar wanted to see for himself first hand how the Help Desk was functioning and to meet some of the residents of Jávea who use it. Over the past 4 years more than 4000 residents of all nationalities have used this facility and Oscar is anxious that this service will be able to continue after the May elections. Oscar said he was pleased with gratitude voiced by citzens with the tremendous work done by the staff of the Office for the Services of Citizens. As further evidence of his commitment to the foreign community Oscar - in collaboration with other Councillors throughout the Province is working on a motion about financing the ex-pat department based at the Diputación de Alicante whose budget has had swingeing cuts of 66% but Oscar, with his excellent knowledge of law and finance is taking the lead in trying to come up with the best solution for residents

The next generation of TV sets are going to receive signals via Satellite, besides other sources. The latest News is that Sky are testing on Astra 28.2 SSE degrees and Astra 19.2 SSE degrees! The 2012 International CES, heads need to be banged as the outcome of the 2013 International CES, has changed to Ultra H.D which had been adopted by the Consumer Electronics Association. Moving on we must consider the UHD Alliance, a sort of Global formation of some of the World’s leading Film Studio’s, TV manufacturers and of course technology companies with the aim of providing a unified platform avoiding the technical battles of years ago. These sometimes lead to the selection of a poorer system being adopted, owing to better promotion by its Sales Team, not the best selection method in my humble opinion. The idea is to provide the consumer with access to a range of products all operating on seamless and fully integrated Ultra-HD systems, offering high quality products with no catches, enabling the client to select products of their choice with the guarantee that all will function in harmony and regrdless of make, will link together. The proposed Sky UHD set-top box will require a total redesign to include the super high resolution required and of course will be quite complex. I suspect Sky’s own design team will be responsible and of course it goes without saying it must meet the public’s approval from day one.

Can we expect the BBC and ITV plus of course their rivals Four, Channel 5 etc. to compete with Sky in the near future? At present there doesn’t seem to be any sign of any of them offering to join in a race of any type. As with high definition at the moment there is not much on offer in the World of UHD, but this was also the case when HD came along. If we turn the clock back we (in the trade) can remember there was quite a bit of up scaling, (the term we use when we contrive to adjust complex signals to move up in quality to perform quite well in the World of HD). Of course it’s not quite as good as Film, Sport etc. shot in true UHD, but it did fill the gap and I can see no reason why again - as a method - this cannot be used to transfer HD to UHD. Tax authorities discover

around 19,000 illegal buildings in 45 Valencia municipalities

The first phase of regularising property values has revealed some 19,000 cases of illegal constructions in the Valencian community. These range from houses built on private plots, extra apartments in existing apartment blocks, unlicensed renovations and swimming pools. This exercise has been carried out since last March using aerial photography and inspections on the ground. So far only 12 municipalities have been inspected in Alicante Province - one of which is Denia with 8232 infringements. The exercise will result in increased IBI receipts for affected municipalities.

Jávea proposes use of municipal land near canal as a dry dock

Jávea’s Town Planning department is currently studying proposals put forward by the "Marina Nou Fontana" company for the management of the Canal de la Fontana and its moorings. In this context, the town has mooted the

possibility of letting the company lease a 3,500m municipal plot of land next to the canal for some of its buildings, and provide space for the creation of dry docks. The rent for this land would go to Xàbia's coffers, not the regional Government, and the facility could help reduce prices for users through the economy of scale.

Jávea restores Montgó lime kilns

The summer forest fire on the Montgó uncovered several old rural lime kilns, which were used up until the ‘60’s to make the lime and mortar used for building. These kilns are now being restored by a team supervised by the municipal archaeologist, Ximo Bolufer, and various information boards about their uses and history will be installed. Bolufer explained there are several of these buildings in the municipality, but "almost always away from the urban centres" e.g. in Las Planas or Granadella, the ovens needed to be near wood and limestone. ç

Online comments and conversations with Spanish expats working abroad are instigating many more qualified but unemployed Spaniards to take the leap of faith. According to The Bank of Spain, Spanish work migrants “are younger and more educated than those who stay”. “A dramatic increase in Spain’s brain drain could exacerbate the effects of the crisis,” the document states.

Walk or cycle safely to school

Jávea's councillors for Citizen Participation and Education have presented the project 'Camins Escolars' in local schools and to representatives of parents' associations. The idea is to enable children to walk or cycle safely to school, without having to be picked up by their parents. They are now working on the technical side, studying the most secure routes, such as the presence of police at crossings and a good system of pedestrian walkways. They will also have to limit traffic around some schools to increase safety and eliminate bottlenecks. This will be a pilot project.

LEARNING TO COPE WITH LIFE'S PROBLEMS

The past couple of weeks have been very frustrating for us in the Oasis Centre. It all started on Wednesday the 11th during our midweek Bible Study. We had just finished our study when the lights went out. A quick look at our fuse board showed that it was not us but a general cut, so nothing to do but wait for the electricity to be put back on. About ten minutes later the electric came back on, then ten minutes later off again. We sat and waited for half-an-hour, longing to get home as it had been a long day. Finally we gave up, shut the premises, still without electricity and went home.

Next morning we found that the reason for the cuts the previous day was that

our meter (along with many others) had been changed for a new 'Smart' meter'. And so our problems began!!! We discovered the landlord (whom we‘d never met and who is a very busy man in Valencia) had only contracted for the premises to have just over 1Kw of electricity, not enough to boil a normal electric kettle!!! On that Thursday morning our electricity went off a number of times as we overloaded the system.

As instructed by Iberdrola, we contacted an official electrician the same (Thursday) evening, who came to the premises and undertook a very comprehensive survey of all our machines, lights etc. and found we needed a minimum of 7Kw of supply. To be on the safe side we told him to go ahead with the new Boletin and ask for 10Kw of Supply. The new Boletin was submitted to Alicante a week later on

the 18th and we were told we would have an inspection from Iberdrola before the meter could be upgraded. In the meantime, our electrician upgraded the wiring in the fuse board ready for the inspection. As I write this a week later on the 25th, we are still waiting.

But we have learned to have patience and cope with our 1Kw supply. We only have the lights on in the back room and a few on in the front where the customers are served. I can't tell you the number of people that have come through the doors in the past two weeks, who have asked if we are open? Or do we need a shilling for the meter? Or haven't we been paying our bills? But all our customers have been so understanding and have rallied round, but I would like to apologise to some customers that have had to wait longer for jobs to be done that are normally done while they wait.

Our son Peter deserves a medal for the way he has coped and not lost his cool!!! If Clive and I need to do photocopies in the front office, I have to turn all Peter's lights off in the back room and he has to sit in darkness until we have finished. We can't boil an ordinary kettle at all, but I have taken Continued on page 24

Is it possible to register and matriculate a SMALL trailer (remolque) fabricated in Inglaterra where the Law allows the trailer to carry the number of the vehicle that tows it - on to Spanish plates. The trailer is already in Spain. The person who drove the car to Spain with the trailer behind, has paperwork, but NOT the trailer, as it is not necessary in the UK. 1- Is it possible to register it in Spain? 2- Does it need a registration plate number? (Remember to carry an extinguisher when you tow a trailer !!!

Remolque LIGERO: Trailers which carry less than 750 kg will need an ITV card, so you will have to go to an ITV Station where they will check your trailer and if the trailer passes the test, you will receive your ITV card. You DO NOT NEED an extra "Permiso de Circulación", you will have to put the registration plate number of your car on the back of the trailer.

Remolque PESADO: Trailers which carry more than 750 kg will need apart from the ITV card, a new "Permiso de Circulación" which has to be issued from the Traffic Department in Alicante, taking the ITV card, your trailer will get a registration plate number. (Red Plate). You will have to put the registration plate number of your car TOGETHER WITH the trailer registration number on the back of the trailer.

ITV card + Permiso Circulación (only for Heavy Trailers). There are 2 ways of getting an ITV card. 1. Take the European homologation

document together with your trailer to the ITV and after testing the trailer you get the ITV card. 2. When you do not have any paper of the trailer, ITV can carry a test of your trailer and inform you if you can get an ITV card and make a new one for you. This process is expensive, sometimes it is better to buy a trailer with an ITV card. Remember that not all trailers can be homologated in the ITV, so ask an ITV station before buying one without an ITV card. An engineer will make the homologation if your trailer was built under European Regulations.

OVERTAKING MULTIPLE VEHICLES

Staying safe on the road should be paramount for every driver. Overtaking is one of the leading causes of accidents and there’s a lot to think about. This seemingly simple manoeuvre accounts for a high rate of fatalities, second only to driver fatigue, and if poorly executed can quickly turn a few seconds on the wrong side of the road into a nightmare. Often the problem is a lack of familiarity with either the geography and/or the ability of the car under conditions we as drivers are not accustomed too. All year there’s usually you – the driver – and little else in the car, but on holidays with a car full of kids, clothes, kit and caboodle, the driving dynamics of your car are changed dramatically. 1- Is it illegal to overtake 2 cars at the same time on a single lane road? 2- Can the last vehicle (the green Volvo) overtake all the vehicles in front of it? 1- If you have looked far enough in the distance and are sure there are no cars oncoming that you are going to conflict with, no hidden dips where oncoming cars might be and no offside lay-bys or junctions on either side….you are confident of the performance of your vehicle….you have been watching the drivers in front and are aware of their vehicles and their potential intentions… .and you also have somewhere to go if it starts to look ‘close – exit strategy’… then……….. overtake. If the cars are spaced out enough for you to overtake one and have enough space (if needed) to move back (without

causing the driver you’ve overtaken to brake)..treat each car as an overtake… ie: if there are 7 cars it’s seven overtakes…. However, if the cars are bunched up together with no room to get back in… you have to treat the 7 cars as one overtake. Imagine it as a huge long goods vehicle. So if you don’t have enough power in your car and road ahead to pass all of them safely in one go…then don’t do it.. 2- Regarding the Volvo, although there is a broken line there are two lorries which hide the oncoming traffic from the curve a few metres ahead. So it is not advisable to do it until you have a better visibility.

MAN WITH A VAN

Is it legal to work from an English registered van in Spain, if the driver is non resident. We asked the drver “If you are not resident, why are you working here?” and was told “Removals. FLIP FLOPS OR HIGH HEELS

Is it legal or not to drive in flip flops, or in high heels? Reglamento General de Circulacion, article 3.1 " You have to drive properly avoiding damage to people / things. It is forbidden to drive in a negligent or reckless way." When you drive with flip flops you can have an accident, and when you drive back home from the beach, your flip flops usually are wet and sandy, providing you with a greater risk of losing your flip flops while driving or when you use your car pedals. With flip flops you can not break/accelerate properly, ALL these factors can end in a traffic accident and in this case you can be fined for driving with inappropriate footwear. We have known many cases of people driving with flip flops or with high heels who have had an accident caused by the use of this kind of footwear. So there is NO article that prohibit the use of these footwear, but the article we have posted here (art.3.1) can be applied to those drivers who have an accident as a consequence of this or do not driver properly. Remember to avoid such footwear, it is advisable not to use them but it is NOT FORBIDDEN!! Artículo 3 Conductores 1. CHILD SEAT RESTRAINTS

Until what age should a child be in a child seat, in a car? This does not depend on the age, but until they are 1.35 metres in height they have to use a restraint seat (baby seat, booster), between 1.35m and 1.50m height you can choose what to use and from 1.50m in height they only have to use the seat belt.

CAR HIRE LIABILITY

When hiring a car, for example at an airport, who has the responsibility to ensure that the warning triangles and high visibility vests are in the car as required by Spanish law? It is the responsibility of the hire company, to check that the logbook and the vehicle’s equipment is OK before renting the car to a client. So if you are stopped by the Guardia Civil, the owner will be responsible for the improperly equipped vehicle you have hired, unless the hire company can prove they gave you the car with all those things. Fines related to insurance /ITV/ vehicle’s equipment / Logbook, are always for the owner who is responsible for the car.

What are the rules about motorhomes parking/camping on spare ground or residential streets and who enforces these rules? We are plagued by these people in the area where I live, during the winter despite signs saying NO CAMPING!! There are 3 sites in the area for them to pay and use but they use our water for free and God knows what they do with their sewage? - Can the caravans park everywhere? Where is the limit? When can they be fined?

First of all, we have to differenciate between: - PARKING (The vehicle must be parked respecting the lines drawn on the ground as any other vehicle, locked and with the engine off). - CAMPING (It is forbidden to set up camping furniture in the street). Motorhomes have the legal right to park in any place where other vehicles may, and cannot be discriminated against because of the type of vehicle they are. Townhalls do not have any powers to ban motorhomes from parking in any place if the parking is allowed for vehicles. If you see the motorhomes pouring their waste in an illegal place, call the Local Police or Guardia Civil depending on where you are. But remember that if the motorhome is parked in a correct way (parking), the current legislation allow this practice unless they take out their furniture /awnings (camping).

SPARE BULB KITS

It is no longer compulsory for vehicles to carry a set of spare bulbs and the tools to fit them. The government modified the law and published it in the Boletín Oficial del Estado (BOE) in the Decree PRE/52/2010, 21/01/2010. As well as spare driving glasses, the spare bulbs are advisable to carry if they are obtainable. In many cars it is not possible to change the bulbs by yourself and you have to go to a garage. For that reason the government changed the law.

MANDATORY EQUIPMENT WHEN DRIVING IN SPAIN

Now you can check if your car has all the compulsory equipment according to Spanish Traffic Law. You need to carry in your car; - Spare Wheel and tools to change the wheel. - 1 HiViz jacket, 2 are advisable (for the passenger). - 2 Warning Triangles. - Fire Extinguisher (ONLY for vehicles towing a trailer and recommended for other vehicles). - Medical Kit (Advisable, NOT compulsory). - Flashlight/Torch (Advisable, NOT compulsory).

SPARE GLASSES

Do I need to carry a spare pair of glasses when driving my car? The law regarding drivers with glasses to always carry a spare pair has been modified! At Christmas 2014, the DGT published a book titled "Consejos y Normas de Seguridad" to give drivers travel advice. In point 5.4 you can read the following: "Si utiliza gafas graduadas es aconsejable (ADVISABLE) llevar unas de repuesto".

GROUPED CYCLISTS and OVERTAKING RULES

If you are the driver of a vehicle and you see a group of cyclists you need to overtake, we would like to inform all of you (cyclists and drivers), about your rights/obligations on the road. - Cyclists are allowed to cycle two abreast! Reglamento Circulación art 36.2 If cyclists are riding two abreast they have to ride one abreast if there are SEVERAL vehicles which want to overtake them. This means cyclists are perfectly legal to cycle side by side. Obviously some common sense needs to be used to work out if and when cyclists need to single out to let cars overtake. They DO NOT have to let pass every single car, ONLY when there is a queue behind them or there is a traffic congestion. - OVERTAKING Reglamento Circulación art.85 Before overtaking you should make sure: 1. The road is sufficiently clear ahead. 2. Road users are not beginning to overtake you. 3. There is a suitable gap in front of the road user you plan to overtake. Overtake only when it is safe and legal to do so, and always allow 1.5 meters between you and the cyclist. REMEMBER: 1. Never get too close to the cyclists you intend to overtake. 2. Use your mirrors, signal when it is safe to do so, take a quick sideways glance if necessary into the blind spot area and then start to move out. 3. Only overtake on the right if the vehicle in front is signalling to turn left, and there is room to do so. 4. Avoid overtaking with oncoming traffic (bicycles included). 5. You CAN cross the SOLID LINE if there is no risk for oncoming vehicles and you have enough visibility.

6. A group of cyclists are considered a vehicle when they ride all together, so once the first cyclist is in the roundabout, you have to give way to the whole group.

CAR DOCUMENTS

What documents do I have to take in my car? 1. ITV card. 2. ITV Report (cars more than 4 years old). 3. Permiso de Circulacion (where you can see the plate number and who the owner is and other details) 4. Insurance policy (the insurance receipt is NOT compulsory to take in the car, but if you have a traffic accident you will need to know your policy number for the Accident Agreement). 5. European Accident Agreement (ADVISABLE; if you have a traffic accident you will need one, ask your insurance company for one in your language). You do not have to take the annual tax you pay every years to your townhall, no policemen will ask you for that receipt.) If you do not want to take the original documents, you must go to a notary, he will make a photocopy from the original and he will put a stamp on it, since that moment you can take the photocopies in the car, which will be valid as well as if they were original documents.

CARRYING STUFF IN THE BACK Could you please clarify for me the rules regarding what (if anything) you are allowed to carry on the rear seats of the car? I have heard so many conflicting stories. If you are driving a vehicle that is carrying a load in the car, you have to make sure that the load is restrained

properly. Load restraint is not just about making sure that the load does not come off - it is also about making sure that the load does not shift in a way that makes the vehicle unsafe to handle or allows the load to crash into the driver’s cabin, which may cause injury or death. Please restrain the load properly, if you have a traffic accident, you could have serious injuries caused by the load you carry. The Spanish Traffic Law requires that any load carried on or in your vehicle must: 1. Not be placed in a way that makes your vehicle unstable or unsafe. 2. Be secured so it won’t move or fall from your vehicle while driving— including driving consisting of emergency braking or turning suddenly. 3. Not project from your vehicle in a way that is likely to injure a person, obstruct the path of other drivers or pedestrians, or damage another vehicle or anything else. 4. Be restrained using an appropriate load restraint method. Anything on the back seats must be secured with seat belt. It is advisable not to carry anything in the car. Please use the boot. In case you need to carry a load in the vehicle, use the seat belt to secure the load, and if you carry heavy things, use a car net, it is forbidden to take a heavy load without a load restraint net.

What ID documents do I have to carry when I am driving in Spain?

If the police ask you for proof of your identity, it will be enough with your driving licence in both cases (Residents / Non Residents), because it is an official document with photo. The only difference in the two cases, is whether you are going to be fined and you have NIE number or not: 1- showing your Spanish Driving Licence/European Driving Licence + NIE number, you can pay the fine in 20 days. 2- showing your European Driving Licence/Passport, you will have to pay the fine on the spot, (because you do not have an NIE number). Cycle Lanes

Professional cyclists ride faster than other cyclists when they are training, and are allowed to use the hard shoulder of the road for training. Often they use the road because the hard shoulders in most roads are impracticable for bicycles (dirty, stones, mud, gravel). According to the speed they reach when they train, it is safer for professional cyclists to train on roads, rather than cycle lanes. We have to differenciate among the different kind of bicycles; Road Bikes are built to reach high velocities (Special Brakes), and Mountain / Urban / Comfort / Electric bikes are built to go for a ride, and do not reach high velocities on roads. When a person is riding a bicycle it is considered a vehicle for Spanish Traffic Law purposes, and the cyclist must respect all

WHAT MARGIN IS THERE FOR SPEEDERS?

DGT has announced (from February) that it will be apply a new margin of error in all Radars. The roads with the speed limit between 30km/h and 90 km/h, the drivers can be fined when they drive over 7 km/h over the limit. Abuses by banks in Spain. Complex investments, structured bonds, autocancelables, etc.

Abuses by the Spanish banks have been and continue to be scandalous. With the numerous court decisions that continue to be granted, one could almost believe that it is general practice committed by all Spanish banks, or almost all of them. The banks’ abuses include the sale of preference shares, interest swaps (SWAP / CLIP, etc.), mortgage floor rate clauses, as well as inadequate investments. In this article I want to talk briefly about those judgments condemning banks to repay investments made by their customers, due to inadequate advice and insufficient information given to the customer / consumer, by their bank. Most of the court rulings granted in favour of consumers are based on the breach of the bank’s duty to give adequate information to customers and consumers. This information is both vital and essential when considering the purchase of complex financial products such as structured bonds, derivatives, and products of high technical complexity, these products also tend to carry a high risk. Many of the consulted court orders insist that Spanish Banks are negligent and fail to explain clearly, and prior to the signing of these contracts: the inherent risks, the commissions to be charged (normally quite high), and how to recover the investment, etc. Therefore, the consent given by the consumer is considered “null”, that is to say, that although the client and consumer signs and voluntarily accepts the purchase of the fund, or the investment, that consent and agreement is flawed because the consumer does not have enough information to really know what they are contracting. It is well known that banks routinely violate their information obligations and the regulations governing advice to be given, and they often ask clients to sign contracts without giving them the time to read them carefully. There are numerous court judgments against Spanish banks that can be easily found online, we highlight the judgments against Barclays Bank for the Royal Bank of Scotland Bonds, BBVA and Banco Santander, Structured Bonds BNP SAN POP and Caylon Bonds; the court decision against Banco Espiritu Santo (BES) in relation to bonds issued by Lehman Brothers as examples. We must not forget the special care and attention that banks should have when selling these complex products to a retail client, i.e. an individual consumer that is not an expert in complex investments. Property walls and foundation problems. A successful claim against architects and insurers

In this article, I would like to discuss construction problems and defects (also known in Spanish “vicios de construccion”), which affect many property owners in Spain. A few weeks ago we obtained a court judgment granted by the courts of Denia in favour of our clients, in connection with a claim filed on behalf of clients with a property in the Marina Alta village of Orba. The property had a foundation problem which worsened after a period of heavy rains, a few years ago, which accelerated the structural problems of the construction. The architects and developers who built the villa, said the cracks which appeared were due to settlement, which had since ceased. Unfortunately, the reality was that it was a progressive problem, which affected the foundation and vertical structure of the property, evident when the cracks repaired reopened again, proving that the cause was alive and active. In the court proceedings we were able to demonstrate: 1.- The negligence and liability of the principal architect and his insurer, that means the designer of the property and responsible for the project, who designed the wrong foundation, as it was not sufficiently deep and large, with inappropriate dimensions and without regard to the composition of the soil, and

without avoiding access by rainwater to the foundations, etc. 2.- The negligence and liability for technical architect or “aparejador”, and its insurer, because he executed and built a house with a structure much weaker than that designed, and built some walls less stable and consistent than the projected ones. 3.- Liability of ALCOYANA the insurer responsible for the Ten Year Insurance Policy “seguro decenal”, as we proved that the construction problems affected the structure and stability of the building. The defendants accepted responsibility, and in the court process agreed to pay the amount necessary to carry out the repairs needed to secure and stabilise the structure of the villa. At this point, we remind our readers that when a problem of this kind appears in a property, even if it is a minor one, we must notify in a duly reliable way all agents or people who have been involved in the construction process, and who may be responsible, such as the developer, builder, architect, technical architect, Insurance company responsible of the Ten Year Insurance Policy, etc. Frequently cases fail because the property owners have not notified those possible respondents within the limitation period foreseen in the law. Therefore, at the first sign of a potential construction problem and before anything else, we need to notify by registered fax, telegram or similar way all the possible future respondents, about the emergence of the problem and their possible liability. when the pipes were frozen, it's surprising how much water you need when you have a small baby. But we coped, we just had to, but I remember when Clive's mother came to visit us one weekend, she was so broken hearted when she saw the conditions we was forced to live under. I remember her crying on my shoulder and saying it was all her fault because if she hadn't been so horrible to me after Pop died, we would all be living together in her lovely warm home at Sidcup.

one of my travel kettles into the Oasis that uses much less electric, (even if it takes forever to boil). If Peter needs to print or mount a canvas or print copies of Jávea Jeard on the big colour printing machine, then everything else has to be turned off, including all the lights and poor Peter has to use a torch in the back while he checks the machines as they are printing. And so we battle on until Iberdrola come to do their inspection and then hopefully, service will be back to normal.

When I look back over my life I think of the many times things have been against us but we had to cope with the problems. Shortly after Clive's father died at the young age of 52, my mother-in-law, who I was living with at the time (with Peter), turned very peculiar and became impossible to live with. Clive was living and working in Crawley, although he did manage to get home for weekends. He had a key worker's job as a compositor printer and when he had been working there for nine months, we would be entitled to have a Key Worker house in Crawley New Town. Things became very difficult at home with Mum, and in the end Clive could see how unhappy I was and found us a bungalow to rent for six months at Shoreham-by-Sea near Brighton. The bungalow was lovely, right on the beach and we moved in during September until the following March.

Our son Peter was only 15 months old at the time and I used to push him in his pushchair over the bridge into Shoreham town to do my shopping. I always went to the same butcher for my meat and was often served by a very pleasant young lady who was about the same age as I was and we soon became friends. Her name was Pamela and she had a little boy the same age as Peter. Pamela confided to me that she was desperate to learn to drive but although the business was doing OK, she felt she couldn't put the added expense of driving lessons to the family budget. She said ideally, she would like to look after a child about Joseph's age who would be company for him and give her the extra income she needed for her driving lessons. What an answer to prayer that was, as I was thinking seriously of getting a job to give us extra cash to buy furniture etc. for the new council house. That night I looked through the newspapers and found a job vacancy at Brighton at the Alliance Building Society in the accounts department. I

There was no prouder Mum than me, with Peter, and Clive’s father’s bureau beside us. went for an interview, was offered the job and agreed to start the following Monday. I went back to tell Pamela the good news and she was as overjoyed as I was. So all during the winter I would leave the bungalow about 8am, with Peter wrapped up warmly in his pushchair because it was a terrible cold winter, and push him to Pamela's house at the back of the butcher's shop and he was there until I collected him at 6pm,

But what a time I had that winter trying to get the washing dried. Peter was still in nappies and of course, there was no disposable nappies in the winter of 1962, just big terry towelling nappies that my mother-in-law made especially for him. I used to wash the clothes and nappies (by hand of course) before going to work in the morning and hang them to dry on the outside line. When I came home at night and got the washing in, the nappies were a solid block of ice and hadn't dried at all. I had to put the gas oven on, open the door and try to dry the nappies in front of the gas oven. Clive used to arrive home about 8pm from his job in Crawley, at least he was able to commute because there was a good rail link between Crawley and Brighton, then another train along from Brighton to Shoreham.

Then to crown it all, the pipes in most of the houses on Shoreham beach froze up and standpipes were erected in the streets for us to collect water in buckets. What a lot of bucket carrying I did during those weeks in the snow and ice

The time came when we were given the address of the first house for us to view in Crawley. The Council were obliged to show us three properties and we could chose the one we preferred. But we fell in love with the first property we saw, 5 The Rise, Pound Hill, a three bedroomed terraced house, only a ten minute walk from Three Bridges railway station, so it was very handy for commuting. My Auntie Vi who lived in Bognor gave us her three-piece-suite as she was buying a new one, and gradually we furnished our new house and moved in. The money I had been able to save from my job at the Alliance Building Society came in very handy when it came to furnishing the house, and as a special house-warming present, Clive bought me my first washing machine, a Hoover Keymatic. I was sad to leave Shoreham and my friend Pamela, but the excitement of moving into our first house was something we both looked forward to. When we were first married we lived in a 38 foot mobile home “Shere Wonder” - manufactured by George McAllister of Gomshall in Surrey - sited at Hoo on the Isle of Sheppey, on the banks of the River Medway, which flooded whilst we were spending Christmas with my family in Yorkshire. We rented a furnished apartment for a while but when that ended we moved back with Clive's parents.

We can't prevent problems arising during our lives, but it is how we cope with them that matters. As a Born-Again-Christian I don't have to cope with problems on my own, I have my Father in Heaven who is always there for me. I have often said to the folk at the Oasis Centre, that over the years, without God, I don't know how I would have coped.

Enough to put the Fear in any competitor

This column is about people in our local community and their everyday lives and connections to the area of Jávea. Last month we turned the Spotlight to feature two brothers Vicente and Rafa Rocher Grimalt who share a passion for natural fresh produce, especially honey, and so together they opened a shop at the Portal del Clot. Our Jávea Jeard spotlight this month focuses on two members of the Fear family, Natasha who will turn 18 years this October and Ray who is her proud father at the ripe age of 89. I was pre-warned by Clive that this interview was going to be like no other as Clive had known Ray for many years and said Ray would want to ensure the Spotlight was on him. Clive picked me up from home and drove us the short distance to Ray’s villa which is just outside the town. His garden has great views across the orange groves looking out towards the Montgo. A number of years ago Ray wrote his biography but unfortunately the publishers wanted him to change a few words as by today’s standards some words used in the book were not politically correct. Ray refused to budge as he said he writes as he speaks, and decided to publish the book himself. His publication was successful although it wasn’t available through the high street bookshops but was made available by the libraries and sold through Amazon. Written by Ian Amer

Ray said his father was a tremendous person, born in Wales and with a great singing voice. He remembered a story where his father’s Commanding Officer asked him to take the Emperor of Japan, who was on a state visit, around the tower as his guide for the day. The Emperor was so impressed with his father’s knowledge and guide skills that he gave him a few shillings tip to share out amongst the other guards, although Ray suggested to me that it was likely his dad took a bit more of the tip then he should.

The book is called Pawn Shop Dick and for a while was an Amazon best seller, it is described as being about the life and times of an ex-soldier who had been conceived in The Tower of London and was born just around the corner from Buckingham Palace. In the book Ray talks about his life as a Grenadier Guard towards the end of World War II and goes on to tell us how, like many other soldiers returning from the war, he had to adapt into a normal routine after being demobbed. Tony Benn (Anthony Wedgwood Benn, Labour MP, b: April 1925-March 2014) wrote to Ray congratulating him on writing such a good book. The opening question came from Ray, who asked me “How long will this interview take?” “About an hour” I replied. He said “You should have stayed at home then as I need more than an hour to tell you my story,” or words to that effect. Yep, Clive was right! I sensed at this point the interview was going to be very different because sitting in front of me was a man who had a similar look and appearance to the English actor and writer, the late David Niven (b.1910-1983) blended with the humour of Spike Milligan (Comedy genius b. April 1918-Feb 2002). As previously stated, Ray was conceived in the Tower of London and born just outside Buckingham Palace in 1926. Ray’s father, Yeoman Warder Daniel Fear was a Yeoman of the Guard, a beefeater on duty at The Tower of London and his mother was Henrietta Eleanor Fear (nee Harrison) who worked in a local chemist. I asked “how can you be sure you were conceived in The Tower of London?” “Oh yes” said Ray, “I often heard my mum say to my dad that he should have been minding the crown jewels instead of hers and if

At the tender age of 13 years old, Ray left school where he had enjoyed sport and history, and for a while became a pawn broker’s assistant where he learnt much about the poor. He said people would come to the shop on a Monday to pawn their suits only to redeem them the following Friday. Ray lived with his parents and after his father left the Yeoman of the Guard on a commuted pension (a pension that does not keep up with inflation), his father had to find another means of employment to pay the bills and support his family. His father decided to work for boarding houses where the wage was low but usually provided free board and lodgings, Ray said this was a clever move on his father’s part because he had no rent or bills to pay. However, it resulted that Ray was always on the move as the family had nowhere permanently to settle, living in Continued on next page

Although the family were constantly moving around Ray says looking back now it was great fun and at one time he remembers impressing an old girlfriend by taking her to Brighton and pointing out every boarding house he had lived, which worked out at one every forty yards (37 metres). In 1943 Ray decided to join the army but was rejected due to being under age. He could not work out how the army knew his age from his ration book or ID card and after careful examination realised his date of birth was written in code form. So he decided to burn his ration book and ID card and save some of the ashes from each document so he could persuade the local authorities to provide him with new documents. The local authorities looked at Ray’s pile of ash and asked him to fill in some new forms where he adjusted his date of birth to meet the minimum age required to join the army. Shortly after receiving his new documents and now with the age of 18 years he was accepted into the army where he joined the Grenadier Guards, who were trained infantry men but shortly after he joined the Grenadiers they were reformed into the 6th Guards Tank Brigade. The brigade was equipped with the Churchill Tank and as Ray pointed out to me, the height of a guardsman before the reformation had to conform to a height of around 6ft and it was difficult for the often tall and lanky guys to climb into the Churchill tanks because the space inside was designed for smaller chaps. He said when sitting in these vehicles you could feel every bump and it was a rough and uncomfortable ride. He also suggested that if a German shell were to hit the tank there was no way of escape from the small hatch. It is said that some Grenadier Guards felt safer walking behind their tanks than riding inside. Ray also said “whoever thought of reforming the Grenadier

Guards into a tank brigade and then giving them small tanks were idiots” or words to that effect. In 1944, The 6th Guards Tank Brigade and “Ray” fought their way through France as part of the North West Europe Campaign, 1944-1945 and eventually arrived at Lubeck, Germany. Ray recalls being very hungry as his commanding officer gave orders for their rations to be shared among the starving people of the town. A few days after the war ended, he and his friend - a poacher from Lancashire - decided to head off into the forest to hunt wild boar or anything that happened to run in front of the cross hairs of their gun sights. Not far into the forest, Ray and his friend came across a group of German soldiers so Ray and his friend started to raise their hands but realised the Germans were doing the same. Both Ray and his friend had stumbled across some German soldiers who had deserted and were offering their watches and binoculars in exchange for Ray and his friend to take them as prisoners of war (POWs). Ray said “we were not going to take them as POWs because we had a lack of food back at the camp let alone more mouths to feed”, so he took their watches and binoculars and told them to hop it. “A few days later at the camp my friend and I were summoned to the guard room where we were told to guard some POWs, the same bloody Germans we’d let go in the forest a few days before and had later been picked up by another patrol.” The Germans recognised Ray and his friend and demanded their watches and binoculars back which of course they had to do, although Ray did manage to keep a pair of binoculars back for himself. From Lubeck the brigade were transferred to Neuengamme Concentration Camp, nr Hamburg, which at the end of the war in 1945 had become an internment camp for German officers and was now controlled by the allies. Neuengamme Concentration Camp was a concentration sub camp and extermination had been through hard labour, but Ray remembers seeing two chambers of death, The Gas Ovens, as they were known. He describes each oven as being the size of a small garage and nearby stood sheds that served as stores for shoes of all sizes, piled from floor to ceiling, another with human hair and another full with suitcases. In 1948, Ray and his brigade’s war finally ended and they were returned to Chelsea Barracks, London where he became a ceremonial guard and performed Trooping the Colour until he left the brigade in 1949.

Ray opted for a poultry course as he fancied himself as one day being a poultry farmer. He was enrolled onto the course in Wiltshire where he learned how to care for poultry. On his day of final examinations he was asked by an examiner this question. “If your land was flooded what would you do?” Ray thought about it and said “I would raise the chicken sheds onto stilts!” The examiner said “wrong answer, you keep ducks instead”. During the period of the Spivs and Drones which for Ray was in 1949 all unemployed people were asked to report to their local labour exchange where jobs would be offered. A Spiv was a smartly dressed petty criminal who sold black market goods from the back of a lorry, especially when rations and coupon books were still the order of the day. A Spiv could usually get his hands on most things for a price and they appeared from the start and ending of rationing, between the 1940s and ending in 1950. A Drone is a person who lives off the hard work of others. Ray was asked at the labour exchange if he could iron and was told he must report to a clothing company which specialised in press shaping garments using a Hoffman Steam Press. Once the clothes are made they are pressed into shape using the steam press but if you get it wrong the garments are ruined as one sleeve maybe longer than the other and the same with the trousers. He managed to ruin 4000 garments before getting the sack. Ray joined another company where on one day he wanted to go to London and watch Trooping the Colour but his boss would not let him, so he telephoned his brother who worked as a builder and asked him to send a telegram from his works to say he had fallen from a scaffold and had broken his neck and that Ray should attend the hospital. His brother followed the instruction and sent Ray a telegram that he showed to his boss the following morning and was given the rest of the day and the Continued on page 27

Continued from page 26 next day off. Ray went home and went to see Trooping the Colour. It was a hot day and Ray was sunburned on his neck. When Ray returned to work the boss said “was Trooping the Colour worth it, you are fired!” He tried his luck in Jaeger, the fashion shop and he did push his luck by courting the girlfriend of the boss. Needless to say he was caught out and fired! In 1952 Ray became an apprentice farmhand in Plumpton, East Sussex and recalls arriving at the farm where the farmer said “you must be Ray” and gave him a shovel. Ray said he had never seen so much chicken manure (or words to that effect) in his life, the trench of manure (or words to that effect) must have been about 0.5 metre deep by 50 metres long and Ray was told to shovel it all up. While working at the farm Ray had to stay in a local dosshouse (A cheap lodging house, where sometimes you shared a room and a bed with a stranger). After a few weeks a friend arrived unexpectedly at the farm and offered

him a job in Stoke-on-Trent as a fixed odds bookmaker (A person who takes bets on sporting events, football or horse racing at agreed odds). Within a few minutes pondering on the idea Ray decided to take up the opportunity and jumped in the car to start a new career as a bookmaker. Arriving in Stoke-on-Trent, Ray was accommodated in a local Country Club for a few nights until he found other lodgings, in a dosshouse because it was cheap and very near to the betting office. He said that was where he met the most disgusting two people ever. “These chaps shared my room” he said “and every night one would pass wind while the other blew his nose on the bed sheets.” In the first year Ray personally recruited a hundred betting agents including Arthur and Ron Matthews, who were brothers of the legendary footballer Sir Stanley Matthews. Ray earned enough money in commission from his agents that he was able to buy his first house. A rocky period came when Ray’s boss had a bad week on the football score draws and the forecast pay out was going to be very high, so the boss asked Ray to shut up shop. Ray refused and stayed on. Dorothy's War

Then a 19-year-old from Battersea,and now aged 92 and enjoying retirement in Jávea Port, Dorothy Quodling srved in ¨Churchill’s Forgotten Army’ - the Women’s Land Army. Land Girls worked long hours, a minimum 50 a week. Much of their work was backbreaking, working in all weathers, for £1. 85 a week. Dorothy’s first posting was to a farm in Chadlington in Oxfordshire where she became assistant shepherd to a flock of breading sheep. Her other farm work during the 'resting' season' included hedging, harvesting, milling and tractor driving. She was then involved in the mating of the sheep and then in lambing, often acting as a midwife, helping to construct lambing pens, inspecting for disease and tail docking. The last of these provided her with the perk of lambs' tails which she sent home to her dad who was famed for his delicious

She learnt to expertly trim rams for market, giving them a smart ridge down their backs and blacking their noses to enhance their eye-appeal. The work was hard, the hours long, the pay poor but Dorothy found her life in the Forgotten Army very rewarding and was devastated when ill health forced her demob in 1945. Dorothy came to live in Spain 30 years ago and for many years has worked in Javea's Original Charity Shop. When Jávea Players’ producer Penny Grant accepted responsibility for ‘Lilies on the Land’ - Dorothy supplied a reallife link to the ‘forgotten army’. Continued from page 27 He went to the bank and asked for a loan so he could pay his agents but the bank refused him so he was forced to sell the German binoculars he had taken in Lubeck. The binoculars fetched £3 which in those days was enough money to keep the business going for a while. He managed to pay off his agents and took the business over, making good money for the next thirty years. While running his bookmakers he had other business interests including a health food shop which he setup in 1966. He says he thought the idea was a great one for the people of Stoke so stocked up with healthy sausages, one hundred and twenty different varieties of honey and various fruits and vegetables. The romantic novelist Barbara Cartland (Dame Mary Barbara Hamilton Cartland, DBE, CStJ, b.July 1901-May 2000) cut the tape and opened the shop. One day he decided he would corner the market in selling fresh eggs and decided to buy some Maran chickens for their mahogany coloured eggs. The chickens laid the eggs but nobody wanted to buy them. He also tried to introduce artichokes and spinach to Stoke but nobody wanted them either. Ray is a believer in herbal and natural remedies to fight infection and colds. A healthy remedy he suggests to me is when he feels a cold coming on he uses two peeled cloves of garlic and shoves each piece gently up his nose. He said you can use bigger cloves if you have a larger snout! I cried out with laughter on hearing this one and it was even funnier when I realised he was being serious, although we must stress that you should not try this at home. Eventually Ray decided to put the shop up for sale, where one interested party was the legendary footballer Stanley Matthews (Sir Stanley Matthews, CBE, b. Feb 1915-Feb 2000) who came to view the shop. Ray had taken Stanley upstairs to show him the rooms, the shop assistant saw it was time to close and shouting out “goodnight Mr Fear” and “goodnight Mr Matthews,” closed and locked the door behind her. Unfortunately Ray did not have his keys with him to unlock the door so both Ray and Stanley Matthews had to climb out through an upstairs window and down the drainpipe. I asked Ray, “did Sir Stanley buy your shop?” NO HE DIDN’T, for I never saw him again after that! Eventually Ray did sell the health business and bought a house with eight acres of land although his overdraft with

Continued from page 29 was the large garden that swayed him. So in 1989, Ray and his wife sold up in England and moved to Jávea. Ray has been married four times. His first marriage to Hazel was in 1950 and the marriage produced four children. His second marriage to Rita was in 1963 producing two children. His quickest engagement was within twelve minutes of meeting Linda, bearing in mind he was still married to Rita. Linda was sixteen and he was thirty nine but they married in 1967, after divorcing Rita and the marriage produced three children. His latest marriage came in 1997 to Sylvia, incidentally Clive officiated at the marriage ceremony here in Jávea and not long afterwards Natasha who is the youngest daughter was born.

Natasha Fear At last, I was able to interview the reason for my visit - Natasha, born on 13th October 1997, in Denia hospital, to Ray and Sylvia Fear. She is the youngest of ten children to Ray by different marriages. Ray and Sylvia have since divorced but Natasha continues to live in Jávea although she makes frequent trips to visit her mother on the Indonesian Island of Bali. At four years of age, Natasha was taught to throw beach pebbles by her dad in the safety of their back garden. Once Natasha mastered the art of stone throwing Ray bought her a discus which Natasha soon got the swing of. One day her brother Tim came on a visit from England and launched the discus so high

and far that it fell somewhere in the nearby orange grove, never to be seen again. In 2005 and at eight years old, Natasha went to L’Ancora Tennis Club, Jávea, where she enjoyed playing on the 18 hole mini golf course. It was here that the professional golfer and her future coach José Manuel Carriles spotted her and told Ray she had a natural swing. Ray contributes this natural swing to the days of her pebble and discus throwing. Also at this time her sister Lara managed to get Natasha an interview with Nike in Cadiz, Spain. After demonstrating her talents as a young golfer with her infamous swings and putts, Nike became her sponsor where they provide her with golf bags, clothing and clubs. Nike has kept pace with Natasha and they continue to sponsor her. Ray acknowledges there are many businesses in this area and anyone willing to sponsor Natasha would be welcomed as she has many International Tournaments this year and the company logo could be sitting alongside Nike. Natasha attended the Centro Público Vicente Tena School, Jávea and moved to the Ies Antoni Llidó School, when she was 12 years old. After leaving school she enrolled on an interior design course but this was not good for her as she really wanted to focus on her golf and left the design course to further her golfing career. In 2012 Natasha played her first international tournament “although I did not win this competition it did provide me with the experience at a higher level.” In June 2011 she won the U16 Nick Faldo Series UK Championships at Trentham. The British newspaper The Stoke Sentinel headlined Natasha’s win as “Fearless Natasha wins through to Faldo Series Final”. The win put her in the final and onto a very big golf stage at Faldo Lough Erne Resort, County Fermanagh, Northern Ireland in September 2011. A field of eighty one top golfers from across the world played the U21 final tournament including 13 year old Natasha who competed hard to try and earn the Sir Nick Faldo’s 15th series grand final title. Although Natasha didn’t win she was placed at a very respectable thirteenth and was also the youngest player to compete. In 2012 she entered the inter counties competition held in Sevilla and came second. She also concentrated on many

Natasha entered the Nick Faldo UK Series Qualifier in April 2013 where at 15 years of age and for the second time she won the U16 girls competition, giving her a doorway once again into the U21 world final held in October 2013 at Green Bryer, West Virginia, USA. Natasha again worked hard and came in sixth place giving her a respectable ranking. Natasha was the County Champion winning all her junior tournaments in Valencia, Castillion and Alicante between 2010 and 2012. Natasha said 2014 had been a busy year playing golf with tournaments in Portugal, Austria, Switzerland, England, Northern Ireland and Germany. Her favourite tournament was in Germany which she felt was her best result so far in the game, being placed 13th out of 220 golfers. Last year her club, La Sella Golf Resort held a party for the players of the club where she met José María Olazábal Manterola, a Spanish professional golfer who enjoyed success on the European and PGA Tours. In 2012 he captained Europe’s Ryder Cup team to a narrow

victory over the USA. Natasha was taken aback when he said to her that he’d heard a lot about her and would give her a game on his next visit to the club. Incidentally the course at La Sella was designed by José María Olazábal Manterola. Natasha is coached at La Sella by José Manuel Carriles and trains six days each week concentrating on the driving range, putting green and the course where she combines all her skills. Her schedule Monday to Friday is no less than five hours of Golf each day and on Saturday she plays golf with her friends. During the week and after her golf practice she attends the gym for a workout and recently at the gym met a young man where a special friendship has started to develop. Although her father Ray approves of this developing friendship, Natasha says she continues to focus on her golf. Her main goals for this year is for her to decide if she will turn Pro or study for a PGA Certificate where she could professionally coach others.

She is only focusing on major events and her competition diary is filling up fast with no less than fourteen U18 International Tournaments between January and September 2015. The tournaments include Germany, Scotland, Portugal and she will definitely be competing here in Spain. Natasha expects to do well in the Queens Cup, Madrid Championships, Community of Valencia (C.V.) Championships, Spanish International and the Spanish Championships. Her handicap is currently one but in the recent past she has played off scratch. Natasha funds her own trips and coaching. At the time of writing Natasha is preparing to play at The Portugese International Amateur Stroke Tournament, which starts on January 28th 2015 at the Montado Golf Resort. After ‘warming up in Portugal’ Natasha, finised 2nd in Alicante and 3rd in Seville. Next stop was Madrid. We wish her every success with this tournament and other tournaments this year. SPANISH BANKS ARE LOSING THE BATTLE AGAINST THE “FLOOR CLAUSE” OUR LEGAL OPINION

Dear readers, clients and friends, For those people who might have a mortgage in Spain at the moment, this article will surely be of great interest to you. As you might probably know, the Spanish Supreme Court has recently ruled that the “Interest rate floor clause” can be declared abusive if the client/consumer was not duly informed before the signature of the mortgage contract at the Notary, about its content and implications, in a clear, transparent and comprehensive way. Last September 2013, the Supreme Court clarified a judgment delivered in May 2013 declaring floor clauses null and void if they breach the levels of transparency demanded by the European Consumer Directive. The clarification stated that within the context of a mortgage contract, the infringement of the indicated criteria was sufficient grounds for these clauses to be completely nullified. This specific floor rate clause imposes a limit on the extent to which consumers can benefit from lower borrowing costs, should the reference index used to set mortgage rates fall — in Spain the one-year Euribor interbank rate is usually used, (for instance 3.25%).In simple terms, it defines the lowest percentage of interest to be applied to the payments the borrower is to pay. In Spain that percentage is most usually measured according to the Euribor, (European borrowing rate). The problem is that if the floor clause is too high and the Euribor rate is below it, no matter how low the Euribor might be, the mortgage payments will never go down below the threshold of the floor clause On the other hand, the “ceiling rate clause” (or “cláusula techo” in Spanish), marks a limit to the maximum percentage of interests to be applied to the liquidation of the mortgage. This clause can be also abusive because if it is too high, then it will not serve its purpose, which is to maintain an average monthly instalment through out the duration of the whole mortgage contract. Subsequently, in practice, the bank

always wins, either: a) if the interest rate goes too high, as the client will end up making sky-high payments, b) or alternatively, if the Euribor goes down, (like the situation at present) the mortgage monthly payments will still be high due to the abusive floor rate clause, below which the applicable percentage will never go. The problem with this unfair clause is that many unreliable banks mentioned it (together with the “ceiling rate clause”) but in small print, without informing clearly to their clients even about their existence. As a result of these landmark EU, as well as domestic Court decisions, we have been receiving a lot of enquiries over the past few months, so in order to clarify the current situation to our readers, I would like - if I may - to briefly explain some of the most frequent questions and doubts posed by our clients. For example:

1º) How can I know if I have an abusive clause in my mortgage contract? You will need to ask your bank for a copy of the MORTGAGE CONTRACT (MORTGAGE DEED) signed before the Notary. If the bank might refuse to give a copy to you, remember that you can actually get a certified copy or a “copia simple” directly from the Notary where you ! signed the Title Deed for acquisition of the house.

2º) If I have a “floor rate clause” (cláusula suelo in Spanish) in my mortgage contract - what can I do about it. Can the

ABSOLUTELY YES. Getting your money back is indeed possible, but if the bank might refuse to reach an “out of court settlement”, it will be necessary to go to court, involving time and some costs. In fact, we have already won a few Court cases against banks and we are currently preparing new lawsuits on behalf of an increasing number of English people affected and we are very confident about their outcome. However, first of all, we must clarify that the objective of these claims will not be the extinction of the mortgage, but more specifically:

A) The removal of ALL the abusive clauses (usually a mortgage contract contains several abusive clauses that go hand in hand with the floor clause). B) The removal of the FLOOR CLAUSE, with RETROACTIVE EFFECT, which means that all the past interest rates overcharged will be reimbursed to the client. C) Likewise, for those affected, the change of the abusive so called “CAJA” INTEREST RATE. Many consumers are paying a fortune because they were never informed about the possibility to hire the EURIBOR RATE, much more beneficial to the borrowers.

3º) What if the bank might accept to remove the clause in order to avoid litigation, should I accept? Watch out, because your bank might be trying to delude you!!! Bear in mind that some greedy banks might still try to play you for a fool, by using all kind of dubious tricks, aimed to keep getting even more money from you, despite the removal of the abusive floor clause. For instance, we have detected that some banks have recently provided clear instructions to their staff aimed to convince those clients who claim the removal of the mentioned clause, to change the original mortgage interest

conditions, into a highly disadvantageous fixed rate type or alternatively by maintaining the same variable interest type, but with a higher differential rate or even with other hidden defective mortgage modifications. On the other hand, some banks will also try using unethical blackmail tactics. For example, they will readily accept the removal of the abusive clause, but in exchange of forcing you to hire some additional financial products, like house or life Insurance, risky financial products, etc. Likewise, another commonly used trick consists of offering the client, the accumulation of all the debts in one new mortgage loan, also called reunification of loans. Beware! Apparently, the monthly quote might seem more attractive to you, but in reality, be very careful, because you might end up paying to the bank much more costs and expenses, with higher interests and for longer period of time!!

Likewise, a copy of the bank statements showing the amount of money paid in capital and interest since the beginning of the mortgage would be extremely useful.

5º) If I take the bank to Court, should I stop paying the mortgage? Not exactly, the correct procedure would be to request the Court to deposit or allocate the monthly amounts handed over into a designated Court’s account. Otherwise, some reckless banks might try counterclaiming against you by starting a repossession eviction procedure. That Court scenario is highly inadvisable.

6º) What can I do if at the worst scenario, I have no money at all to keep paying an expensive mortgage? Well, it is not the same to take the initiative and sue the bank, that waiting for the bank to sue you for default payments. The second scenario can become more complex. However, we are currently dealing with a few cases like this, where the bank already took our clients to Court in order to repossess his house and we have managed successfully to stop the unfair

4º) If I decide to go ahead, what is the actual process of claiming against the banks through the Courts? What paperwork is needed? Firstly, we would enter into negotiations with the bank, aimed to reach an out-of-Court settlement that might avoid protracted litigation. In practice, very few banks are accepting to negotiate. The majority are very arrogant and stubborn and they refuse

repossession by invoking the existence of abusive clauses in the mortgage. Therefore, in conclusion, if you think that your mortgage might be affected by abusive clauses,-such as the floor clause,-as a preliminary step, we suggest that you might kindly ask your bank to remove immediately the floor clause from the mortgage Deed but with no condition at all. Remember, that even if you might be anational from another country, you have the same rights as a Spanish consumer! Secondly, do not sign any new novation agreement with the bank without consulting with a legal professional expert like our Firm. Third, if the bank might stubbornly refuse to remove the floor clause, please do not hesitate to contact us for further advice. We will be glad to help you in order to claim the nullity of your “floor clause” as well as to claim the refund of the interests overpaid on your mortgage contract. Considering that according to experts, the Euribor is likely to increase within the next 2 years, time is of the essence, as failing to take speedy legal action now, might involve losing more tan 3.000 euros later on!! Subsequently, if you might finally decide at the worst scenario, to sue your bank, bear in mind that the sooner the better!
