If 5th December, 1950, means little or nothing to you, it’s likely you’ve not heard that it was the date 7 British airmen perished when the plane carrying them between France and Gibraltar crashed into the Montgó mountain that divides Jávea from neighbouring Denia. Messages on the ‘BritsInSpain’ Group at Yahoo, confirmed the rumour one member had heard, and resurrected the idea of Peter Sharp, for the ‘scaffold pole’ cross on top of the Montgó to be replaced by a more appropriate memorial, reflecting the sun’s brightness during the day and lit by solar powered light at night. Another story says it was an English pilot that crashed there in the Spanish Civil War and that is why the cross was erected on the Montgó top. We have asked the RAF Museum what they know? Meanwhile, we rely upon Denia painter Jaime Costa Tur who told reporters at the time “the mountain was covered with a white scarf.” The crash occurred at 3 in the afternoon and was witnessed by two men working in a field and spoke of ‘four bodies’. A search team consisting of the Mayor, Police captain and two corporals, four members of the Guardia Civil, a judge, priest and neighbours, the wreckage was not found until shortly before 3am the following morning, according to an ABC report the following day. The Montgó was described as one of the highest peaks in the region, jutting into the sky with the minimum of warning. Hopefully, we’ll have an update next month.

Mercadona inherited a ‘tired warehouse-like’ building on the Ctra. Cabo la Nao when buying SuperAguilar. It has since been demolished and replaced. If my memory serves me right, the ‘town’ premises on Amanecer de España was constructed without Planning permission, and built over a ‘public right-of-way’ so, one Saturday night, all the cash registers were moved towards the sea and the rear staircase built, so people could still walk where they had the right to walk. JAVEA RESIDENTS GET DISCOUNT AT BENITACHELL SWIMMING POOL Jávea Ayuntamiento has signed an agreement with the neighbouring municipality of Benitachell that will allow registered residents in Jávea to use the indoor swimming pool located in the sports area in Partida La Font just off the Carretera de Benitachell. Councillor Juan Luis Cardona, Jávea Councillor responsible for Sports, told us 12,000 euros has been reserved in the Town Hall budget to partially subsidize residents to use the swimming pool. To qualify for use, residents must contact the “Citizen Centre” in Portal del Clot to receive a certificate proving residency in Jávea which will need to be presented at the swimming pool in Benitachell. The agreement also includes the use of indoor pool for two activities offered by
the Department of Sports: swimming lessons for children aged 5 to 12 years old and therapeutic swimming for people with health problems or in need of rehabilitation. To register for either of these activities, one should contact the Palau d’Esports Municipal in Avenida del Furs or telephone 96 579 2000. The agreement comes into force immediately. It was always going to be a difficult road, with jobs for Javienses (those born in Jávea) always being more important than ‘green’ issues. THE ARENAL or Beach Despite the danger of melanoma of the skin, tourists still pour onto the beach to gain a sun tan that will show their UK friends they’ve had a great holiday. The ‘Sandy’ beach offers safe bathing - not forgetting all bathing by the young or elderly should be supervised - combining sand that is cleaned overnight, with an abundance of nearby bars and restaurants to suit every palate and pocket. There are rope and rubber climbing frames and a special area for disabled bathers at the Southern end of the bay.
THE PUEBLO or Old Town With the Gothic Parish Church of St. Bartolome at its centre, the narrow streets remind us they were designed with horse and cart in mind. Wooden front doors open on the street, behind which is a labrinth of rooms and an inner courtyard where livestock were housed. Many properties have been converted into shops and intimate cafés, each with its own tapas to match the atmosphere. It might look boring but the ‘Old Town’ is always fresh, and delivers on promise.
THE PORT or Aduanas A reminder to everyone that Jávea was - and still is - an important fishing port, proven by the number of refrigerated vehicles that make their way there from places as far away as Malaga. Fuel tax and EU quotas are strangling those who fish, in the same way as few now harvest oranges and other crops that are left to rot. You’ll discover something new with every visit to the Port - and the ‘Fisherman’s Church’ always impresses.

Footwear MUST have a ‘heel’ or ‘strap’ at the rear to prevent it slipping. the sole must NOT be of fabric, but a material this helps to grip the pedal. The general guide is that any shoe with a heel higher than 7cms is WRONG, but it is not about the height of the heel, but it’s proportion. A 2cm stilleto heel would prevent the driver breaking in an emergency, whereas a heel of 6cm, that was uniform in shape, would be OK.

There is confusion as to whether Brits can currently donate blood, if they have lived in - or visited - the UK since the discovery of ‘Mad Cow Disease’. There is a subsidised service from Toscamar to the Arenal, Port and Town, that is cheap and reliable, but little else. If you are a Pensioner there are concessions. Obtain the form from the Services office above Parking El Clot, and hand it - after completing your details, a photo of yourself and the fee, to one of the bus drivers, who will tell you when they will have your ID card with barcode. Those not of pensionable age can buy a ‘Season Ticket’ for 10 €uros that buys 13,50 €uros of journeys. Itinerant ‘Gas Inspectors’ - working only on commission for out-of-area companies - regularly visit Jávea, and charge huge amounts for replacing out-ofdate tubing or regulators, using very intimidating tactics. Propane and other gases are available and there is a specialist supplier for oxygen and industrial gases in Benissa. Cable and Satellite TV Many properties in the South of Jávea are served by underground cable from Balcon al Mar, and some even receive internet by cable. A vast range of radio and TV programmes from throughout the world are available, the cost depending on the package you choose. For those beyond the reach of the cable network, many of the programmes are re-transmitted terrestially from Costa Nova or Cabo de San Antonio. Camping and Campsites Jávea has two, both with facilities for static units intended for all-year-round occupation but which welcome tourists and their tents. Neither are ‘close’ to the beach, but Camping Naranjos is less isolated than Camping Jávea. The police discourage parking of Campervans on the beach overnight. Groups of Campervans appear from time to time on the Car Park at Av. Tamarits in the Arenal, and only 200m from the beach.

Rubbish is collected by driver-operated semiautomatic lorries, that upturn street-level or underground bins into the hopper, whether collecting plastic, cardboard and paper or household rubbish. They do not indicate when turning off a road either, do not stop for pedestrian crossings nor acknowledge any courtesy you give them. They will also be inches from your rear bumper when on fast roads and will overtake to fill the gap you leave from the car in front, as taught in the UK.

Funerals Insurance It was traditional for many Spanish grandparents abuelos - to arrange burial insurance for new nietos grandchildren, ensuring future low premiums and one less financial trauma, no matter how many years into the future that child dies. The problem with burial insurance is that you have no idea how much you will pay. Many policyholders have paid many times over for a funeral that has not - yet - been needed, but if they stop paying NOW, they will lose the benefit of every premium paid. Applications are invited as a matter of urgency and those interested should first visit the officies of the Agencia para el Fomento de las Iniciativas Comerciales (AFIC) at Carrer Roques, 5. The successful tenant can sell any product approved in the municipal area: food (butchery, prepared foods, wines and spirits, delicatessen, dietetics, dried nuts, bakery, fresh fish, meats, pickles, poultry, eggs and game meat) as well as complementary activities such as drugstore and perfumery, florist, ice cream parlour or bar-cafeteria. By contrast, the German company would use only the very best materials and all their builders were qualified and experienced. Then the mayor asked the Spanish company why they were asking for 900,000

BABY DOLPHIN FOUND DEAD IN AMBOLO COVE A baby dolphin was found dead at the end of September between rocks in the cove of Ambolo in the southern extremities of the municipality. The Policía Local was informed and a recovery plan was put in place by the Department of Services and the Environment. Given the inaccessibility by land, assistance was requested from the Red Cross who launched a rigid inflatable from the Arenal to the location of the dead dolphin at Ambolo, which was then removed to the Granadella beach. A team of biologists from the faculty of Biological Sciences in Valencia, which has responsibility to record all instances of dead cetaceans (such as dolphins) found along the Valencian coast took samples from the specimen to establish the cause of death and then authorized the disposal of the remains by the Ayuntamiento. (thanks:www. javeamigos.com) Museum The museum originated in 1969 following the creation of a small collection of historical and ethnographic items gathered by youths led by J. B. Soler and J. Celdrán. A few years later, these materials occupied an office of Justice of the Peace and, in 1973 the chapel of St. Anne. In 1975, the City acquired through the efforts of J. Soler Blasco (then Mayor of Jávea) the old palace house of Antoni Banyuls, which since 1977, has housed the current permanent collection. It was in recognition of the main promoter and first director, Juan Bautista Soler Blasco, that the corporation gave the Museum his name. Since 1985 the Curator has been a local archaeologist who manages and advises technically. Alongside the permanent exhibition rooms are other

Pine Trees Pollen from pine trees will be a major problem to anyone suffering from hay fever, from as early as March, each year. Needles & Caterpillars The strange ‘pear-shaped’ bags hanging from pine trees that look as though they have been created by over-active spiders, are the day-time resting place of caterpillars that graze on pine needles at night. The adult, as a moth, lays around 300 eggs in August that hatch a month later. When fully grown, the Caterpillars can be seen in a procession, as if holding each other’s tail with their own head, and have a poisonous protein on every hair of their body, as they search - usually during March - for soft soil in which to pupate. Contact with human skin can produce extreme redness and swelling and any pet which disturbs a procession should be immediately taken to a Vet. It is said, that by removing pine tree branches below 3 metres (but DO NOT cut them where there are baskets of these enemies) protects the tree because the feeble female moth cannot fly that high. Plus Valia is the Tax levied by the Town Hall, based on the increase in value of your property whilst in your ownership, when you sell. Their main office is in Plaza Marina Alta, at the highest point in the Old Town. Stamps are also sold in TABACS. Postmen only deliver to certain areas on certain days and insist that outlying houses provide community boxes where letters for 50 or more homes can be placed by the postman, for the owner to collect. If a letter that needs a signature arrives, the postman will leave an Aviso in the ‘buzón’ for you to collect from the Correos office within 15 days. If you do NOT have a ‘buzón’ the postman will likely leave an Aviso under a stone near your house, in expectation that you will find it! Postcodes Most towns have a single Postcode: Jávea has 4 but Correos discourage their use, and claim it is better to use 03730 (where 50% will be wrong) rather than the code for your area, which ‘some’ will get wrong.

I love my ‘Cruise Control’ - BUT I read of a Stateside driver, on a long, straight road doing 65mph in the rain, when the car began to ‘aquaplane’ and literally flew through the air. The driver was not seriously injured but very stunned by the turn of events! When explaining to the highway patrolman what had happened, his advice was blunt: NEVER DRIVE IN THE RAIN WITH YOUR CRUISE CONTROL ON. I would have thought I was being cautious by setting the cruise control and maintaining a safe consistent speed in the rain, but the police (and www.snopes.com) point out that if the cruise control is on, your car will begin to aqua-plane when the tyres lose contact with the road, and the car will accelerate to a higher rate of speed making you take off like an aeroplane. The police urged car manufacturers to add a label to the driver's seat sun-visor NEVER USE THE CRUISE CONTROL WHEN THE ROAD IS WET OR ICY, along with the airbag warning. I thought that by setting the cruise control and driving at a safe speed - I’d be minimising the possibility of an accident, regardless of road and weather conditions. I am told that some vehicles (like the Toyota Sienna Limited XLE) will not allow you to set the cruise control when the windshield wipers are in action.
GOOD VISION IN A DOWNPOUR If you are caught in a torrential downpour of rain when out in the car, resist the temptation to switch your wipers to maximum. It doesn’t make sense, but use the MINIMUM setting that casually wipes the screen. Most motorists would turn on HIGH or FASTEST SPEED of the wipers during heavy downpour, yet the visibility in front of the windscreen is still bad....... This advice is only good if, close to hand, you keep a pair of POLARISED SUNGLASSES and wear them - in the downpour - and with the wipers on minimum speed. Suddenly, as if by a miracle, your visibility in front of your windscreen is perfectly clear, just as if it was not raining. You still see the drops on the windscreen, but not the sheet of rain falling. You can see where the rain bounces off the road. It works to eliminate the "blindness" from passing cars as well as the "tyrespray" if you are following a car in the rain. CR (thanks: thlmfstr)

The infamous LRAU ‘Land Grab Law’ by which a stranger could ‘gain the right to build’
on land they did not own, and charge the owner part of the cost for a new infrastructure, without any opportunity of sharing in any profits, has deterred many buyers. The LRAU was introduced to prevent a landowner from frustrating ‘Community Projects’ - like a school, hospital or community centre - but was used by corrupt developers and Townhalls to allow luxury homes to be built on stolen land, claiming that ‘high class homes’ were good for the community. Attempts to overthrow the Law by AbusosNo have been unsuccessful, an EU Court recently deciding the practice was NOT unlawful. Spain does not recognise the function of a District Valuer who would stipulate the value of the land involved. Socialists cancelled the River Ebro water project and PP endorsed the LRAU, prompting some to suggest that there is little point in voting in National elections. Back in 2003 the (then) Mayor promised to introduce ‘Ventanilla Unico’ - one window - for residents and it has always been a TOP manifesto item! One proposal was for each of the Tourist Offices to act as the Point-of-Contact, receiving requests “expones” and giving an indication of when to call back for the answer. The ‘Expone’ would be moved from office to office, rather than the applicant needing to do so. The traditional Townhall in Plaza de Iglesia in the Town centre, was vacated for
October 2011 refurbishment. At the same time new Council Offices were created as part of the El Clot parking scheme, but remain unoccupied because there are no funds to equip and furnish them. Town Plan Every town is obliged to have a “Strategic Plan” which states what can - and cannot happen in different zones. It is normally revised at 10-yearly intervals, but the content is bitterly controversial, and its preparation and approval can often take 6 or 7 years. Jávea’s new Plan is overdue. Trains Jávea’s only train is privately owned and run, during the Summer months between the Arenal and Port. It has not been running in 2011. It could be hired for events. Connection to Spain’s national rail network is via Valencia, with Gandia being the closest station. Most travellers from Jávea join the train at its first stop, Xeraco, which is close to the AP-7 motorway exit, and has ample free parking. There is often talk of reopening the former link from Gandia to Denia that was closed in a ‘Beeching’ exercise, but the project has never received central government funding.

Verbal Agreements These are binding in Spain as they are in most other countries.

Vado A ‘Vado’ is a plaque, issued by the Council, for an Annual fee, so that any citizen can protect the vehicle access from the street to their home or underground parking area. A ‘Temporary Vado’ can be obtained to ensure access for a removal van to park outside your property to load or unload. You first apply at the Council office above Parking Al Clot, pay the fee at a Bank that has authority to accept Town Hall payments (see Banks) then take the receipted form to the Technical Office, and finally, go to the
Vulnerable Elderly Those living on their own are encouraged to ‘buddy up’ with a nearby elderly person, both of whom phone each other at an agreed time each morning. One rings the other and lets it ring 3 or 4 times before closing the call. The other rings back, lets it ring 3 or 4 times, and ends the call. Both know the other is alive and well. If the first or second call is not received - try again - and be prepared to phone whoever has the key to the non-responder’s property. Jávea Police will always assist if contacted on 96 579 0081. Jávea Social Services department, the Red Cross (Cruz Roja) and Amigos Europeas Ambulance Services, all provide special telephones with panic buttons on a necklace.
Votes and Voting The first requirement to vote is joining the Padrón list of residents, for which the Town Hall receives around 200€ per person, per year. Once on the Padrón, residents need to apply to join the Censo Electoral to vote in local and European elections. Desalination For many years water in Jávea had an unacceptably high salt content. Wells were then purchased in the Jalón Valley area as everyone waited for surplus water from the River Ebro to be brought to the Costa Blanca. When the Socialists came to power in Madrid they cancelled the Ebro project, compensating contractors and again left Jávea with the prospect of salty water. Newly-elected Jávea councillor Ana Vasbinder is credited with bringing Jávea’s Desalination plant to fruition. Jávea’s new Government team are discussing water

TOWN HALL INITIATES FIRST PHASE OF STRATEGIC PLAN Jávea Town Hall invites the public to influence the “Plan Estratégico” – “Strategic Plan”, calling for public involvement from anyone concerned for the future of the town. Deputy Mayor Oscar Ánton, insisted the Town Hall wants maximum public contact to create hope, stressing “a strategic plan is something in which everyone listens to all ideas for a common goal” and that it would encourage every type of citizen participation. Mayor José Chulvi said he wants to have the plan ready by June 2012. “In times of limited resources, it is essential to find the strengths and invest in them. We’re going to accelerate the process because this is the time to tackle the ‘crisis’, track the progress of every opportunity and design the future”. He is committed to do everything possible to create a plan for Jávea that is sustainable socially, economically and environmentally. Five forums will be convened to address sectors such as tourism, economic promotion, education and culture, social welfare, and the environment. The intention is to talk to everyone to collect ideas, projects, opinions and constructive criticism to foster prosperity and employment, equal opportunities and social inclusion, protecting and improving the urban environment and contribute to good government with local participation. Economist Antonio Martinez reminded that the world of today is everchanging and complicated so the Ayuntamiento should be praised for the courage to face the problems, address them and bring about progress for all. Martínez insisted that it is vital for public participation and quoted the words of Argentine author Jorge Luis Borges: “The future is
not what will happen, but what we do.”

Spain is totally different. Only a Notary can create the public documents that contains your final wishes, retaining the original in his archives and sending notification to the Registry of Wills in Madrid. Abogados (lawyers) can advise on the wording where there are complications like previous marriages or illegitimate children, but you will have to pay the Notary fee, whether you have an Abogado or not. If your situation is not complicated - just spouse, car, house and legitimate children - the Notary can provide you with a template you complete as and where appropriate, so that all issues are included. The Original Notary's Office is in Historia Chabas, Nº 6 (I think). If you were to travel from the PORT towards the town, passing the Ctra. HOW TO AVOID A FIGHT A couple of years back, I decided to buy my motherin-law a cemetery niche as a..... Christmas gift. Last year, I didn't buy her a Christmas gift. When she asked me why, I replied, "Well, you still haven't used the gift I bought you last year!" and that's how the fight started..... I took my wife to a restaurant. The waiter, for some reason, took my order first. "I'll have the rump steak, rare, please." He said, "Aren't you worried about the mad cow?" "Nah, she can order for herself." and that's how the fight started..... My wife and I were sitting at a table at her high school reunion, and she kept staring at a drunken man swigging his drink as he sat alone at a nearby table. I asked her, "Do you know him?" "Yes," she sighed, "He's my old boyfriend. I am told he took to drinking right after we split up those many years ago, and I hear he hasn't been sober since." "Wow!" I said, "Who would think a person could go on celebrating that long?" and that's how the fight started..... When our lawn mower broke and wouldn't run, my wife kept hinting to me that I should get it fixed, but, somehow I always had something else to take care of first, the shed, the boat, making beer. Always something more important to me. Finally she thought of a clever way to make her point. When I arrived home one day, I found her seated in the tall grass, busily snipping away with a tiny pair of sewing scissors. I watched silently for a short time and then went into the house. I was gone only a minute, and when I came out again I handed her a toothbrush. I
said, "When you finish cutting the grass, you might as well sweep the driveway." The doctors say I will walk again, but I will always have a limp. My wife sat down next to me as I was flipping channels. She asked, "What's on TV?" I said, "Dust." and then the fight started... Saturday morning I got up early, quietly dressed, made my lunch, and slipped quietly into the garage. I hooked up the boat to the van and proceeded to back out into a torrential downpour. The wind was blowing 50mph, so I pulled back into the garage, turned on the radio, and discovered that the weather would be bad all day. I went back into the house, quietly undressed, and slipped back into bed. I cuddled up to my wife's back - now with a different anticipation, and whispered, "The weather out there is terrible." My loving wife of 5 years replied, "And, can you believe my stupid husband is out fishing in that?" and that's how the fight started..... My wife was hinting about what she wanted for our upcoming anniversary. She said, "I want something shiny that goes from 0 to 150 in about 3 seconds." I bought her a bathroom scale. and that's how the fight started..... My wife was standing without clothes, looking in the bedroom mirror. She was not happy with what she saw and said to me, "I feel horrible; I look old, fat and ugly. I really need you to pay me a compliment.' I replied, "There’s nothing wrong with your eyesight." and that's how the fight started.....

The Notary is OBLIGATED to notify the Archive of Wills in Madrid (Registro Civil Central de Madrid - de Testamentos y Últimas Voluntades) of the name, and place and date of birth of everyone for whom he holds the original. When the Testator is deceased, on production of a copy of the entry of Death (in Denia Court in the case of Jávea) application can be made TO MADRID, stating the reason you want a copy, and asking where the latest document is held. On production of the authorisation from Madrid, the Notaria will provide you with a Certified Copy of the Original Document. Spanish Law stipulates the inheritance rights of a spouse and children, but allows a Brit to choose to leave their assets as they wish - even 100% to the cat or dog’s home - but family always have the right to contest the intentions of the Testator. Work Non-Spaniards - and especially those who are not fluent Spanish speakers - will find it VERY hard to get employment. Employers pay a punitive tax for employing staff, so there is a huge ‘black’ labour market where the government receives nothing in respect of Income Tax or Social Security, and the employee has no rights, health cover or pension to look forward to. Autonomo - self employed - is one option, but skills that were amply rewarded in the UK (PA to the MD) are worthless in Jávea, where villa-cleaning is all you might be offered. This is a huge generality, but DON’T listen to people who will promise you work if you relocate to Jávea - the chances are 99.9% against. XabiActual This is the title of a TV programme, created weekly in English and Spanish by a team of volunteers. It can be viewed on ‘Swiss Cable’ - Channel 25

TIME TO GIVE THANKS Sunday 30th October will be an extra ‘Celebration Sunday’ for the folk at Jávea Evangelical Church, at their usual 11am Morning Service with Holy Communion. It will focus on ‘Another Harvest’ with members of the congregation bringing packet and tinned items, that will find their way into ‘Christmas Hampers’ to be distributed to his own parishioners by the priest of the Port Fishermen’s Church. Anyone unable to be present on October 30th, or one of the preceding Sundays, can still donote, by phoning 96 646 2848 and someone will call - by appointment and collect. ‘Crisis’ or not, we’ve all a lot to be thankful for. LYN “Jumps for Jesus” TO RAISE MORE THAN 700€ FOR MEN’S HOME As soon as they heard that congregation member Lyn Fisher was willing to jump from a plane, strapped to an experienced ‘jumper’ Jávea Evangelical Church decided to pay the 180€ sponsorship fee. The event was on Saturday 24th September at an airfield near Castellon, organised by the Lyons Club. Accompanied by husband, Tony, and watched by Mike and Jeanette on behalf of the congregation, Lyn discovered her butterflies were late in arriving. Though full of confidence beforehand, Lyn found the thought of dangling herself out from the side door of the plane, relying on the man strapped to her back to begin their decent from thousands of feet in the sky, was much more traumatic than she’d expected. “I knew if I died I’d be in the presence of Jesus - but I’ve never felt so dependent on the newcomer strapped to my back - and then I remembered that we were BOTH dependent on God, not only there and then, but for everything and always.” Safely back on ground, preceded by the 19 year-old photo and videographer who jumped out before each couple and provided them with a DVD and photos. before donning a new parachute and joing the next couple of lucky jumpers, Lyn found herself being helped to her feet “My legs wouldn’t work” before realising that “I’ve done it!” When I asked if she’d do it again, the look on her face gave me her answer. Because her church paid the 180€ ‘registration fee’ all of the 700€uros Lyn raised from friends and sponsors, went to the Gandia home for homeless men - many of whom live out their final days there - being cared for by Franciscan Monks.

SCHOOL PRICES HEALTHY LUNCHES BEYOND REACH OF MANY LOCAL HOMES At 4.20€ a day, Jávea school dinners are not cheap and some months the charge is over 100€! Imagine if you have 3 children at school! Previously, depending on your family situation the Comunidad Valenciana gave a 'subsidy' to help towards the cost. Instead of paying 100€ a month you paid something like 40€, based on a point system to determine whether you needed the subsidy or not. Last year the child needed more than 13 points to get the 'benefit'..this year - two days before the final list was printed the Comunidad Valenciana changed the amount of points you needed to qualify to 17. To be able to receive 17 points the child must be an orphan or a victim of war or something like that. If - like me - you can't afford the price of the school dinners you have to pick your children up at 12:30 and return them to school at 3pm. It can’t be saving any money to have the same staff cooking fewer meals. The price includes starter, main and pudding but the majority of 3, 4, 5, 6, 7, 8, 9 and 10 year olds wouldn't eat all of that and leave most of it. It's a waste of food as well as money.
