THE SMALL CLUB WITH A BIG HEART

At October’s Clubs SA Awards, a small Adelaide club run by a group of highly dedicated and decorated volunteers won the Outstanding Community Service Award, sponsored by SA Lotteries, which is shining a light on how the club fosters belonging and promotes social interaction.

It’s often the little things that mean the most to people. Whether it be playing a game of bocce with friends, being part of a dance group, having a monthly lunch catch-up, or learning a new language. For 73 years, The Croatian Club Adelaide has been dedicated to promoting Croatian culture, fostering a sense of belonging, providing support, and promoting social interaction and connections for its members and the wider community.

Just as incredible as its long history of community service are the volunteers who have been involved in the club, some since its establishment, and many of whom have been honoured in Australia and abroad for their work. The club fosters a strong culture of volunteerism and community engagement among its members, who dedicate their time, skills, and efforts to ensure the success of inclusive programs, events, and initiatives, delivering on the club's commitment to selflessly serving the community. Three members have received the Order of Australia for services to the community, two of whom have since passed away, and several others have received an Order of Croatia for various community services, especially during the war. Another two volunteers have won the Governor’s Multicultural Award, including club Chairman Kruno Batrac in 2018, and three members have been awarded the Multicultural Women in Leadership Award. “We hope to enrich the lives of our members and contribute positively to the broader community fabric,” explains club Chairman

Kruno Batrac. “Our club acts as a catalyst for building strong relationships and friendships, breaking down barriers, and creating a supportive and inclusive community environment. “We feel it’s important to provide essential and varied activities and events to encourage individuals to come together, share their experiences, and learn from one another, acquire new skills, and achieve a sense of

fulfillment through volunteering.” The club offers a variety of initiatives, programs, and events to actively engage with different segments of its community, with activities that cater to all age groups, making a positive impact on their lives. No one is left out. The club provides programs that engage elderly members, educational courses including children's and adult language classes, dance groups, cultural events, fundraising initiatives, and opportunities for socialisation and activeness through bocce, cards, chess, and social activities.

Most importantly, the club has consistently received positive feedback from its members and local community – the people they serve. Club members agree that its intergenerational approach and emphasis on diversity and racial and inclusivity has achieved something very special. “Our club gives everyone a real sense of belonging across three generations, offering a place to celebrate our diversity,” says Hilda Zuvela. Fellow club member Mate Boz agrees. “Spending time with members of the community, be it young or old is a hallmark of our club. Listening to their stories and ideas, regardless of sexual orientation, religion, gender, and disability is fundamental.” Club Secretary Sandra Jadresic shares that the club is “a home away from home, where your children, your parents, your grandparents, and you, can find a group to join, things to do, and people to see.” “Whether through cultural preservation, social inclusion, educational opportunities, skill

development, or fostering community connections, the club's efforts have made a noticeable and positive difference in the lives of community members,” says club President Marijan Cubelic. “We have provided a venue to support multicultural communities and charity organisations for their fundraising activities. Our community has organised fundraising events such as ‘Get the Girls Out’ dinner event in 2014, held for 535 women to honour loved ones battling or lost to cancer, raising $35,000.” There is no debating that the club’s services have contributed to enriching the lives of individuals and the broader community through bolstering cultural preservation, social inclusion, and community cohesion, intergenerational interaction, skill development and personal growth, multicultural understanding and appreciation, and community well-being and sense of pride. “These benefits collectively contribute to a vibrant and interconnected community, where individuals can celebrate their cultural heritage, forge meaningful connections, and actively participate in the community's social fabric,” says Cubelic.

QUIZZAME LAUNCH AT MURRAY BRIDGE CLUB: A RESOUNDING SUCCESS!

The QuizzaMe launch at Murray Bridge Club was nothing short of spectacular, drawing a packed house of around 85 players eager to experience the quiz for the first time. Shane Barton-Ancliffe, General Manager, and his team's proactive promotion efforts, both within the venue and across social media, paid off handsomely, delivering an amazing turnout and a vibrant atmosphere. Shane reported excellent patron feedback, a significant increase in dwell time, a 15% boost in food spend, and an outstanding 180% surge in bar sales. CHRISTMAS FESTIVITIES Christine Carter, Membership Manager

With the number of functions and events increasing on the run up to Christmas, this is the perfect time to remind your staff, paid or volunteer, of everyone’s responsibilities around the safe supply of liquor. So here are some key points to refresh your knowledge of responsible service of alcohol:

THE LAW

It is against the law to supply liquor to an intoxicated person. It is an offence for a patron to supply liquor to another person who is intoxicated. You can remove from the premises an intoxicated person and the person who supplied that person with liquor. You must have ‘reasonable grounds’ for your belief that a person is intoxicated. It is alright if you refuse service to a person on the basis of this belief – even if you are wrong. Encourage your staff to be firm but polite, friendly and respectful if they must refuse

service. Have a policy in place as to what to do in the instance of a refused patron reacting with aggression to the staff member, along the lines of calling for support and notifying other bar staff, management and/or security.

IDENTIFYING INTOXICATION

Remind your staff how to identify signs of over consumption of liquor by: Observing the amount and type of alcohol consumed. Noticing physical signs and symptoms that a person is showing including differences in their speech, balance, coordination, appearance or overall demeanour. Hearing a patron talk to their friends about how much they have had to drink. An assessment must then be made as to whether such symptoms are the result of alcohol and/or drug consumption. Perhaps talk to the person or their friends to form a better understanding.

Be aware that there are some conditions that may cause a person to display symptoms or signs similar to those of intoxication. People who experience physical, intellectual, psychiatric, sensory, neurological or learning disabilities, or have an acquired brain injury, could display difficulties with speech, balance, coordination or behaviour. It is important to be mindful of the various conditions and disabilities that a person may have when assessing intoxication.

RESPONSIBLE MANAGEMENT

There are things you can do to help prevent your patrons from becoming intoxicated: Promote low or mid-strength alcoholic drinks, nonalcoholic drinks and food. Provide free snack food. Don’t conduct an activity or promotion that encourages rapid or excessive consumption of liquor. Being confident in the law and your Club’s policies will ensure a safe, happy and prosperous festive season for all. Any questions or signage needed, please call me on 0437 95 95 89.

Working on a Public Holiday Can an Employee Refuse to Work?

Under the National Employment Standards (NES) an employee has a right to refuse to work on a public holiday where they have reasonable grounds or an employer’s request for them to work is unreasonable. In determining if an employee has reasonable grounds and/or whether an employer’s request is reasonable things that can be taken into account include but are not limited to the nature of the workplace, the employee’s personal circumstances, amount of notice given and the employee’s type of employment. Clubs need to be aware that a recent Federal Court decision has clarified than an employer must properly “request” an employee to work on a public holiday, that is provide them with a choice to work or not. An employer can’t just issue a roster in advance prior to making a request or specifying that the roster is a draft. If an employee has been rostered to work without a prior request, employers should immediately advise them that the roster is not yet finalised and that the employee has a right to reasonably to refuse to work those days.

minimum engagement apply which is 2 hours for a majority of employees but 3 hours for bingo callers and 1 hour for fitness instructors. If a casual employee is working overtime on a public holiday however then the minimum engagement is 4 hours. Under clause 24.3(b) of the Clubs Award non maintenance and horticultural employees also have the option by agreement to be paid a 150% penalty rate on a public holiday rather than the 250% penalty rate. If done however, the employee will then receive either the equivalent paid hours they worked on the public holiday to their annual leave balance or be given an alternative paid day off in the week the holiday falls, or within 28 days. This is only allowed where there is clear written mutual agreement between employer and employee for this to occur. Clubs with employees who are paid salaries or above award amounts in lieu of penalty rates will need to ensure they are paying their employee sufficiently to cover/offset what they would be entitled to under the relevant Award for the relevant period.

Where an employer makes a reasonable request and an employee unreasonably refuses however they can require them to work.

Clubs with employees under a different Modern Award or Agreement will have to check its provisions for any penalties or other entitlements applicable to an employee who works on a public holiday.

Payment - Working on a Public Holiday

Payment - Not Working on a Public Holiday

Under the Registered and Licensed Clubs Award 2020 (Clubs Award), where an employee works on a public holiday or during a part-day public holiday they are entitled to a penalty rate of 250% of the ordinary hourly rate applicable. Club Managers receiving a salary that is in excess of 50% above the minimum annual rate for their classification will not receive any additional payment for time worked on a public holiday. Permanent employees who work on a public holiday have to be paid for a minimum of 4 hours. Casuals who work ordinary hours on a public holiday will have the usual causal

Under section 116 of the Fair Work Act 2009 (Cth) full-time and part-time employees that don’t work on the day of a public holiday but would ordinarily be rostered to work that day are entitled to be paid at their base rate for the ordinary hours they would have worked had they not been absent due to the public holiday. Base rate of pay does not include any loadings, bonuses, overtime, penalty rates etc. The above also applies to part day public holidays with an employee entitled to be paid for the hours of the part-day public holiday they would have normally worked. For example if someone ordinarily works 2:00pm10pm on Sundays but they don’t on the

Sunday Christmas Eve falls, they will be entitled to be paid for 3 ordinary hours (the period between 7pm-10pm which is during the part day public holiday). If a casual employee does not work on a public holiday then they are not entitled to any payment. Also if someone is rostered to work on a public holiday on a day they don’t normally work but then calls in sick they do not need to then be paid for that day.

Special Additional Provisions for Full-time Employees under the Clubs Award

In addition to the above, clubs with full-time employees covered by the Clubs Award also need to be aware of clause 31.4 (or if a similar/more generous provision exists in an Enterprise Bargaining Agreement) that sets out an additional entitlement for full-time employees. Where a full-time employee has a

rostered day off (RDO) fall on a public holiday or part day public holiday (not including Easter Saturday where they only have their ordinary hours rostered on MonFri), they must either: be paid an extra day’s pay; be provided with an alternative paid day off within 28 days; or receive an additional day’s annual leave. For part-day public holiday’s clause 31.4 will apply on a pro-rata basis for the number of ordinary hours on the part-day public holiday. This clause will not apply to club managers who are paid a salary in excess of 50% above the minimum annual rate for their classification or maintenance & horticultural level 1-4 employees who have agreed in writing to a salary of not less than 33% more than the minimum weekly rate for a level 4 employee instead of certain provisions of the Clubs Award applying as per clause 18.4(b).

Public Holidays and Leave

If a public holiday falls on a day when someone is on a period of paid leave such as annual or paid personal / carer’s leave then they must be paid for the public holiday and not have hours deducted from their leave balance. Where someone is on long service leave (LSL) under the Long Service Leave Act 1987 (SA) though this day will still count as a day of LSL as every day after commencement of leave is considered a day of LSL. Also where someone is on a period of unpaid leave they will not be entitled to payment for a public holiday that falls in this time and if someone takes annual leave during unpaid parental leave and a public holiday falls, the Fair Work Ombudsman’s view is that they won’t be taken to be on annual

leave that day but they also won’t get paid for it. Lastly in order to direct an employee to take annual leave during a temporary shutdown period under the Clubs Award an employer must comply with the requirements in clause 25.4. This includes giving the employee a written reasonable direction with at least 28 days’ notice. FOOD SAFETY STANDARD 3.2.2A – NOW IN FORCE Rhys Braybrook , Workplace Relations & Policy Manager Over this year Clubs SA members have been notified of the introduction of a new food safety standard, standard 3.2.2A, which introduces three safety management tools. As a refresher the new safety management tools are: 1. Have food handlers complete a food safety training course (which can be done for free here) or be able to sufficiently demonstrate they understand safe handling of food to an authorised officer 2. Appoint a qualified food safety supervisor to oversee day to day food handling and food safety who needs to be reasonably available 3. Show that they are managing key food safety controls by demonstrating this to an authorised officer or by keeping appropriate records Clubs who would be deemed a category one businesses, being those that make / process unpackaged potentially hazardous food into potentially hazardous, ready-to-eat food which is made for sale or intended for sale (e.g. sandwiches, pasta, pizza, schnitzels etc) will need to implement all three. Category two businesses, being those who don’t make / process but handle and sell unpackaged potentially hazardous ready-to-eat food only have to implement the first two. The new standard is in force from 8 December 2023 and this means any member who is a category one or two food business must have the necessary management tools in place. Members are advised that authorised officers will start

will start checking compliance from this date and should clubs not have already implemented the necessary new management tools where needed then they need to do so ASAP. There is an exemption from the requirements for “fundraising events” however these are generally one-off or infrequent activities that raise funds solely for a community or charitable cause e.g. all proceeds go back into a not-for-profit club. Day to day food operations will generally not meet the requirements of this exemption. Clubs who are after further information on fundraising events can refer to SA Health’s fact sheet for not-for-profits which is available here. This is also available on the Clubs SA Members area on the Food Safety page along with an FAQ and other useful documents. Additionally, Clubs SA’s training partner, Complete Hospitality Training Skills, offer Food Safety Supervisor training. It is tailored specifically towards not-for-profit clubs at a cost of $100 per person for Clubs SA members and $120 per person for non-members. INCOME TAX EXEMPTION - ANNUAL SELF-REVIEW RETURN Rhys Braybrook , Workplace Relations & Policy Manager

Members are advised that changes brought in from 1 July 2023 will now require not-for-profit (NFP) entities with an active Australian Business Number (ABN) to lodge an annual self-review return if they wish to be entitled to income tax exemption. Previously an NFP that was not a charity just had to undertake a self-assessment to determine whether it fell into a category set in taxation law that was entitled to income tax exemption. The new requirement to lodge an annual self-review return has been brought in as a means to ensure that only eligible NFP entities access income tax exemption. The annual self-review return will need to be lodged between 1 July and 31 October 2024. Clubs who wish to access income tax exemption can look to prepare for this change prior to 1 July 2024. Commencing a self-review process earlier than this date can ensure a club is aware of whether it meets the income tax exemption eligibility and if so that it then has everything it needs to lodge the return during the lodgement dates.
