The Clubs SA team have hit the ground running already this year, with a huge range of new initiatives, roadshows, webinars, regional meetings, training modules and of course the Annual Clubs SA Clubs & Community Awards 2024 all planned for the year ahead. It’s going to be a big one!

We launched into February with a trip to Queensland with the Chef winners and nominees from last year’s Annual Clubs SA Clubs and Community Awards all thanks to our Corporate Partners, Stoddart Food Service Equipment What an amazing experience and reward for our Club Chefs and Cooks Stoddart spoilt us with a grand tour of their showroom, demo kitchen and operating facilities. A huge thank you to Chris Baggaley and Sam McMahon from Stoddart for making this trip happen and to all the Stoddart team for hosting us A wonderful experience was had by all.

Our 2024 Roadshows have also begun with our first at Hockey SA for the North Metro region We covered some great topics on food safety, mental health awareness, reviewing your kitchen and bars to ensure safety and efficiency, insurance for your clubs and people, the Club Development Program plus some other great industry updates It was wonderful to get together to share information between our clubs, gain further insights from our Corporate Partners and enjoy a drink and a bite to eat. Special thanks to Stoddart for providing food and beverages on the day, Samuel Smith & Sons for the lovely wine and big thanks to TAB, Insurance Advisernet, and HCH.

Nestled on the shores of one of South Australia's most picturesque beaches, the Normanville Surf Life Saving Club (NSLC) stands as a beacon of safety and community spirit Situated along the iconic Normanville Foreshore, this club has recently undergone a remarkable transformation, with the grand opening in December 2023 of the brand new clubrooms and the Aqua Blue Café/Kiosk This $7 million redevelopment project, a collaborative effort between the State Government, the District Council of Yankalilla, and the NSLC, signifies a significant

The objective of the The Power of Her - Infrastructure and Participation Program (IPP) is to build on and deepen the legacy of the 2023 FIFA Women’s World Cup by providing funding for dedicated facilities, improvements to facilities, equipment and programs for girls’ and women’s sport in South Australia. Successful projects will foster and enhance the participation of female athletes in sport by addressing key challenges and barriers to female participation

DRUG&ALCOHOLTESTING DRUG&ALCOHOLTESTING NEEDFORANAPPROPRIATE NEEDFORANAPPROPRIATE POLICY POLICY

Whilst hopefully a situation doesn’t arise requiring this, there may be times where a club wants to test some or all or their workers for drugs and/or alcohol When intending to do so however it is important that clubs understand the requirements and the vital need to have a proper drug and alcohol policy in place.

It can be legal to drug and alcohol test people in the workplace as business will have obligations to ensure a safe and healthy workplace as well as duties of care for those on its premises. A proper drug and alcohol policy however is needed When someone is tested, especially in the case of random testing, it is of utmost importance a policy is in place that makes the worker aware that they may be subject to testing and in what manner Where testing has occurred without the presence of a clear policy it could risk being found to have not been done fairly or correctly and/or be a breach of someone’s privacy.

When implementing a policy a club must always ensure that they properly make employees aware of its contents and give them the chance to understand and comment on it before it comes into force. Failure to do so can then later cause issues with whether they were properly bound by the terms of the policy or not In addition to this, it is always recommended that employees have something in their contract that specifies they accept to abide by all workplace policies and procedures Clubs

could also have a worker sign something acknowledging they have read and understood a particular policy or procedure

A template drug and alcohol policy and other useful policy templates are available on Clubs SA’s members only site. Clubs can look to alter the template drug and alcohol policy to better suit their specific needs and wants or develop their own, however overall a club needs to ensure such a policy clearly specifies such things as:

the circumstances in which testing can occur in the workplace;

the means of testing applied (e g can you do just saliva testing or also urine testing);

the types of substances that can be tested for;

the consequences of returning a nonnegative test (this is what it is called if someone doesn’t return a negative test as it has to be confirmed by a lab) or refusing to submit to a test without reasonable cause; and any support that might be available to someone

When an instant drug or alcohol test is utilised and it comes back with a nonnegative result it must then be sent for confirmation to a lab as the first non-lab test is not always accurate.

Another important thing for clubs to be aware of is what disciplinary action can and should be taken if someone were to

return a non-negative test and this is later confirmed by a subsequent test.

Clubs need to be aware that there are certainly risks where the policy states termination will occur where someone breaches the policy regardless of if this is the first time and the lack of other warnings or issues. These types of policies are often fraught with risks as there have been a number of occasions in which decisions have found dismissal for the first failure of a test to be harsh or unreasonable.

Only in very high risk areas such as mining has it been found that a “zero tolerance” policy can generally be justified and in other instances it will have to be argued why their position was so safety critical, other circumstances deemed this fair etc Mitigating circumstances such as any other disciplinary issues, length of service and nature of the breach can also factor into whether someone being dismissed for a breach of a drug and alcohol policy is harsh or not

A question I have been asked by a few members has been whether an employee needs to be paid for the time they spend attending training or at a meeting

Beginning with time spent training, an employee has to be paid for time spent in training if it is deemed to be part of their “employment relationship”.

In determining this, firstly if an employee has been asked by their employer to attend training and it is compulsory then this will be a clear indication that it does fall within their employment relationship Where this occurs an employee will have to be paid for the time they spend at training

A Federal Court case also highlighted a number of other factors that can point towards training being within the course of someone’s employment relationship such as: Where the training was authorised by the employer

The employer obtains a direct benefit from them undertaking the training

It is closely connected to the employees essential duties

The training was designed to increase proficiency in their current job

Failure to attend would likely adversely impact their employment

Training was completed during ordinary hours of work

The above applies to training and meetings attended by any type of employee e.g. casual, part-time and full-time employees. The timing of the training or meeting can also have implications for what the employee is owed e g if it occurs at a time that incurs overtime or penalty rates.

Due to the above clubs should look to schedule any meetings or training for employees that is part of their employment relationship on days and times they would already be working or would ordinarily work Clubs should also look to avoid times where it may incur additional significant penalties such as overtime rates or at times that will generally be unreasonable or an inconvenience.
