Welcome to this month’s edition of the Clubs SA magazine!

The nomination deadline for the prestigious Clubs SA Clubs and Community Awards for 2024 is drawing near with just 4 weeks to nominate These awards are a significant opportunity to acknowledge and celebrate the remarkable contributions that clubs make to the South Australian community I encourage every club to nominate in at least one category Let’s make this a night to remember, highlighting the invaluable role our clubs play in fostering community spirit and support. Remember, the deadline for nominations is Monday, 15th July 2024 Don’t miss out!

Last month, I had the privilege of attending the Breakthrough Mental Health Research Foundation’s “Biggest Men’s Meals and Mental Health Dinner,” as a guest our Corporate Partner, Loftus IT Over 600 guests came together to support men ’ s mental health It was an evening of candid conversations and collective action, raising an astounding $364,000 These funds will launch a Suicide Prevention Fellowship in Men’s Mental Health, sustaining it for three years We are incredibly fortunate to collaborate with the Breakthrough team, who have also contributed their expertise at our Roadshows earlier this year

In a significant partnership, Clubs SA and Breakthrough Mental Health Research Foundation, with funding from IGC - Clubs with Heart, are offering Clubs SA members FREE Mental Health First Aid Training Mental health is a pressing issue, with nearly half of Australians experiencing mental illness in their lifetime Currently, one in five Australians has a mental illness, and tragically, nine people die from suicide every day This training is a vital step towards addressing these issues, empowering

our members to become Mental Health First Aiders. Learn more about this invaluable opportunity and how you can participate HERE

I would like to extend a heartfelt thank you to John Fulbrook MP for hosting Clubs SA in the Parliament of South Australia John successfully introduced a motion supporting the work of Clubs SA and underscoring the pivotal role that all clubs play in our community The motion was passed unanimously, a testament to the broad support for our mission Special thanks also go to Erin Thompson MP and Tim Whetstone, Member for Chaffey, for their enthusiastic support We are immensely grateful for their backing and look forward to continuing our collaborative efforts to support clubs across South Australia

A big congratulations to Dee Slade & Emma McCaskill from Complete Hospitality Training Skills (CHTS) on a successful evening of Pizza Pizza Seltzer - Tasting Australia! Their SOLD OUT event was held in the beautiful flour shed at Harts Mill, Port Adelaide

Everyone in attendance enjoyed the Gangurru Seltzer , wood fire pizzas and a live band kicked off the night allowing their students from LeFevre High School to get a taste of the industry

CHTS provide wonderful training to children in schools around South Australia to give them a kick start into the hospitality industry

MORE OF OUR NEW COUNTRY RACING CLUB MEMBERS

What a pleasure it was to meet Geoff, President of Bordertown Racing Club and Larissa, secretary at Naracoorte Racing Club during our latest trips to deliver their Clubs SA Folders Both racecourses looked stunning in the Autumn sunshine Geoff was very proud to tell me some of the history of the place, especially of how the local community has always been of great support when it comes to rolling up sleeves and getting things done This began in its earliest days Horseracing has a long history in Bordertown with earliest reference going as far back as a meeting in December 1861 With the South East being home to many large sheep stations, the farmers had the resources to breed horses that were good for racing as well as stock work A further influx of wheat farmers in 1872 saw the town grow and expand and the races increased in popularity

Bordertown Racing Club fared well and not so well over the next 60 years or so, and was located in a few different spots The Club eventually took root in its current location in the late ‘30s to early ‘40s with manpower shortage due to WWII halting development for a time After the war, work resumed and it took a huge amount of effort and work from the community to develop what had been virgin bushland, clearing timber, laying out and fencing the track and erecting buildings The community spirit continues to recent times with the acquiring of its unique and eye catching pavilion This was originally sited in Victoria Park Adelaide but with sheer guts and determination and lots of blood sweat and tears I’m sure it was relocated to Bordertown It now stands proudly at the Club where it is home to the Legends Bar, providing welcome shade to spectators It’s a fantastic achievement and testament to the locals love of their Racing Club

Race meetings are coming up in July and August at Bordertown and in June and August at Naracoorte, Winter would be the perfect timing to visit the south east Both Clubs would love to welcome you!

Clubs SA is thrilled to be partnering with Breakthrough Mental Health Research Foundation via funding from IGC - Clubs with Heart to offer members FREE Mental Health First Aid Training.

Mental health is a critical issue in our society Almost half of us will experience a mental illness in our lifetime and right now, one in five Australians has a mental illness and nine people die from suicide every day, so it’s essential that we take steps to address it

That is why we are offering members the opportunity to become a Mental Health First Aider for FREE.

So Why Become a Mental Health First Aider?

1 in 5 Australians will experience a mental health problem in any given year That means that every person is likely to know someone who is experiencing a mental health problem, whether that is a family member, a friend or colleague. In fact, mental illness is now said to affect every Australian either directly or indirectly. This makes mental health everybody’s business

Most people are familiar with physical first aid and the idea that when you attend a physical first aid course you learn the skills and knowledge required to recognise and respond to life-threatening emergencies and provide a first aid response to a casualty across a range of different situations.

Mental Health First Aid training adopts a similar approach The course teaches participants about the different types of mental illness and using a practical, skills-based action plan you learn the skills to assess and respond to someone experiencing a mental health problem or mental health crisis

Mental Health First Aid is a full, 3-year accreditation There will be two sessions available in July and August Spots are limited to make sure you book your place as soon as possible

To become fully qualified you must attend the two full days

The Club Development Program has seen remarkable success and strong attendance across various regions Our training sessions in Club Governance 101 and Meetings 101 have covered the South, West and North areas of Metro Adelaide Special thanks to the various Clubs for hosting our sessions including Mt Compass Sports & Social Club, The Glenelg Club, RSL Henley and Grange and Grand Central Tavern

Notably, a highly successful webinar on Governance 101 garnered such high demand that registrations had to be closed early Due to this overwhelming interest, additional sessions are being planned for the coming months to accommodate the enthusiastic participation New dates will be communicated shortly

TAX TIME! HELP FROM ATO FOR HOSPITALITY WORKERS

Let’s talk record keeping

Just like that, tax time is here so it’s time to start digging out those receipts! Or, if you used the ATO’s myDeductions tool, all you’ll need to do is whip out your device of choice

Here are a couple of things to remember: Having records of your work-related expenses is essential If you don’t have the proof to support your claim, you can’t claim it

1 A bank or credit card statement (on its own) is not enough evidence to support a work-related expense claim In most cases, you’ll need a receipt Speaking of receipts, they must show all of the following:

2 the cost the supplier the date of purchase the nature of the goods and/or services

You may need to keep other records depending on the expense type, such as a logbook of your car journeys or records of the hours you work from home

To give you a hand, the Australian Taxation Office (ATO) has provided a handy guide for hospitality workers to help you understand what you can and can’t claim this tax time

BARRING’S – THE PROCESS TO FOLLOW

Occasionally a club will contact us about issues they have had with someone on their premises and what they can do One option could be barring them which are a means to stop someone from coming onto a licensed venues premises where they have committed an offence or some form of misconduct or there are genuine concerns for their welfare or the welfare of a member of their family or a person residing with them The ability for a licensed premises to bar someone comes from section 125 of the Liquor Licensing Act 1997 (SA)

Barring’s - Misconduct

Someone can be barred on misconduct grounds where they have behaved in an offensive manner, assaulted and/or harassed someone, committed theft or propertydamage etc

Someone barred on misconduct grounds can be barred for the following periods:

1st Barring - 3 months or less

2nd Barring - Up to 6 months

3rd Barring - Indefinitely or for a specified period

Where someone ’ s conduct is of such a serious nature that a club wishes to bar them for a longer period on their first or second barring then the Liquor & Gambling Commissioners approval is needed When seeking to bar someone for misconduct the appropriate barring form must be utilised and this can be found on the Clubs SA member’s site on the Compliance Resources page

All information on the first two pages of the form need to be filled out and a club needs to ensure that a copy of the barring order is made and the original is kept in their liquor folder For the barring to operate a copy of the first two pages must be served on the barred person either in person, by post, left at their home address or posted to their solicitor SAPol can assist with identifying the

barred person or serving the barring if necessary or a period exceeding 6 months then within 7 days of service, Consumer and Business Services (CBS) must be provided with a copy The last page of the form only needs to be utilised where an extended barring period is sought This is a separate step that can be undertaken following the initial barring notice being issued and this request along with a copy of the original barring must be sent to CBS

Barring’s - Welfare

Barring’s for welfare are less common and can be utilised in order to protect a person whose welfare or the welfare of their family or a person they reside with is seriously at risk due to the consumption of alcohol

There is a separate form for barring someone in this manner and someone barred on welfare grounds can be barred for any specified period including for an indefinite period from the first barring As with barring’s for misconduct, the first two pages need to be filled out including clearly specifying a reason for the barring and a copy must be provided to CBS within 7 days where the period is for more than 6 months

Someone can apply for a review of a barring order on misconduct or welfare grounds where the barred period exceeds 1 month If a barring is in place though then it is an offence for someone to remain on the premises from which they have been barred. SAPol can assist with removal of a barred person where needed and the barred person could face a maximum penalty of $5,000 and an expiation fee of $315

WORKING WITH CHILDREN - WHO NEEDS ONE?

Clubs who have children as members and/or involved at the club need to determine if they need working with children checks (WWCC’s) for certain people

The Child Safety (Prohibited Persons) Act 2016 (the Act) determines who will need a WWCC and it is anyone who will be deemed to be undertaking “child related work” This includes:

services or activities provided in the course of the operation of clubs and associations with a significant membership of, or involvement by, children; and those who provide coaching or tuition services to children

The first dot point means that where a club has a significant involvement or membership of children they must have WWCC’s for all their employees and those doing voluntary work regardless of their level of contact with children

This will not extend as far as requiring every member to need a WWCC though and specifically it will be required by those who are doing some form of paid or unpaid work

In regards to what is meant by “significant”, this is not specifically defined in the Act Instead a club should give it its ordinary dictionary meaning which is “sufficiently great or important to be worthy of attention; noteworthy ”

When in doubt about whether or not the club has a significant involvement or membership of children Clubs

SA recommends taking a cautious approach and assuming you do

WWCC’s are valid for 5 years and free for volunteers, although there is a cost for employees

There are also certain people who will be exempt from needing a WWCC (unless they have been specifically prohibited from working with children) This includes but is not limited to:

someone who believes on reasonable grounds that they won’t work with children on more than 7 days, consecutive or not, in a calendar year (unless it involves an overnight stay or close personal contact with children with a disability); and someone who is providing a service or activity that is child related work on a voluntary basis where their own child participates and it does not include accommodation for a child other than their own or close personal contact with a child other than their own

A club with people who require a WWCC will also have to register them with the Department of Human Services Screening Unit via their portal which can be accessed here.

POSITIONS OF RESPONSIBILITY IN CLUBS

With many Clubs holding AGMs and elections to their Boards/Committee, we are receiving an increased number of queries relating to RPs and Approved Committee Persons, as well as the ever constant questions on responsible service of alcohol. There are basically three areas referred to by liquor legislation:

Approved Committee Member

Responsible Person

Responsible Service of Alcohol

The positions are explained below and we have step by step guides available to Clubs SA Members for each application available in Members Only or of curse, give us a call and we shall get the guides to you

Approved Committee Member

You need to notify CBS of any changes to your committee within 14 days This is done via an application lodged through your LGO account CBS then approves any new committee member and notes the resignation of any

Approved committee members can perform the duties of a Responsible Person (RP) They can do this without the usual RP application and associated fee This s a fantastic win for Clubs SA to save Clubs money and is being widely taken up Anyone performing the duties of a responsible person must wear an identification badge (Approved Committee badge) issued by the commissioner

You need to print the badge yourself from the template that CBS will provide.

Responsible Person

Your Club must have a Responsible Person (RP) on duty to supervise and manage your venue at all times when your Club is open for trade, unless your Club has an exemption from the Liquor and Gambling Commissioner

On your licence, an exemption will look like this:

Very often, there is no Attachment A. Where there has been a condition applied, this may take the form of ensuring a committee member is contactable by phone whenever the bar is operating, or needing an RP only when the number of patrons is expected to exceed a stated figure and so on.

RPs are required to oversee and manage the venue and, although many do serve and supply liquor while at the Club, it is not an obligation RPs do not have to be behind the bar

An RP must wear an ID badge at all times when overseeing and managing the premises and must be trained in RSA, even if they’re not serving or supplying liquor

CBS charge a fee for this application

Responsible Service of Alcohol

Holding a Club licence means any person who serves or supplies liquor must complete RSA training

This training must be undertaken with a nationally accredited registered training organisation (RTO) approved by the Liquor and Gaming Commissioner Following completion of this training, the person will be presented with a certificate of accreditation which must be kept handy and made available to a CBS Officer within 7 days of request

This RSA accreditation is ongoing, without need for renewal or ‘refreshing’.

PLEASE REMEMBER - An RP must be trained in RSA, but training in RSA does not automatically make a person an RP
