Our calendar, based on the Earth’s orbit around the sun, is not a perfect match. To correct this, an extra day is added to the calendar approximately every four years, creating what we know as a leap year. This extra day, February 29th, ensures that our calendars stay synchronised with the astronomical year. The idea of leap years dates back to the time of Julius Caesar, who introduced the Julian calendar in 45 BCE. Over the centuries, adjustments were made to refine the calendar, leading to the Gregorian calendar we use today. Rent, Landlords and Tenants…. Spain’s Law Has Changed: A Guide For Expats In a landmark move, the Spanish Government has implemented significant changes to the country’s Housing Law, aiming to address the pressing issues of soaring rents and housing accessibility.

Here, we present FIVE key aspects of Spain’s new Housing Law, offering a brief overview for residents, landlords, and investors alike. 1. Rent Caps: Putting a Lid on Soaring Housing Costs One of the most notable changes in the Housing Law is the implementation of rent caps. In an effort to combat rising rental prices and make housing more affordable for the general population, the government has imposed a ceiling on rental rates. Rents for new leases cannot exceed the price set in the last contract over the past five years after annual updates.

2. Tenants No Longer Pay “Agency Fees” According to the new law, all fees and expenses associated with the rental of a property will be the exclusive responsibility of the property owner, shifting the customary practice where tenants might share or cover such costs. The legal framework reflects a comprehensive approach to ensure a more transparent and equitable relationship between property owners and real estate agents in the realm of property rentals.

3. Goodbye to CPI: A Shift in Rent Adjustment Benchmarks Instead of tying rent adjustments to the CPI, the legislation ensures that rent adjustments align with the actual costs and dynamics of the housing sector. For 2024, rent increases are capped at 3% of current rent, and this will be reviewed again in 2025. Before 31st December 2024, the National Statistics Institute (INE) will define a new reference index for the annual updating of housing rental contracts.

4. New or Improved Properties Offered For Rent For properties rented for the first time or if a property has remained unrented for the past five years, the limits imposed by the price reference index will come into effect. If the landlord makes improvements to your accommodation, the landlord is allowed to increase the rent. However, the rent must meet certain standards and can’t be more than 20% higher than your current rent.

5. Deposits Before you move in, the landlord has the right to ask you for a deposit. The deposit amount is legally capped to a maximum of 1 month worth of rent. Insist on transferring the deposit. That way you’ll have proof of payment on paper. Landlords must declare the deposit to an administrative authority within the respective autonomous community so that it can be protected. You should get your deposit back within 1 month of moving out and the landlord will have to pay interest if it is later than this. Spain’s New Housing Law of 2023 represents a significant milestone in the government’s efforts to create a fairer and more accessible housing market. By implementing rent caps and reevaluating the benchmark for rent adjustments, the legislation aims to strike a balance between the interests of tenants and landlords.
