Recently I’ve started to shift my mentality incrementally and have been pleased with the results. The water crisis meant (I won’t bore you with the details) that I have been without water for 3 weeks and counting. Now initially I admit to wanting to run and hide in a dark place. However, the longer the taps run dry the more inventive I’ve become, and I’ve realised how much we rely on water for every basic human and household function. It’s made me extremely grateful for when I do have running water and helped me realise what an incredibly scarce and precious resource it is. Now I haven’t quite gone off the grid, but I’ve implemented a few little hacks that have made me feel a little better about doing my bit. This Christmas I’d like to add to that feeling of mounting goodwill and urge you to do

The Nutcracker at Artscape 15 – 24 Dec

JEWELLERY MAKING IS MY PASSION

Nikki Shepherd lives in Hout Bay with her husband Gavin and their daughters Gemma, 18, and Holly, 10. She runs Spirit Jewellery, who’ve just opened a studio shop in the Victoria Mall in Hout Bay. The story of how her brand grew is inspiring, and we met up with her to find out more‌

Was jewellery always a passion of yours? Yes, I have always loved jewellery and spent countless hours looking through shop windows before I started creating my own. I absolutely love jewellery that is gentle, understated and simple. I found it almost impossible to find jewellery that I wanted to wear in South Africa, so I decided to create my own. Can you take us on the brands journey from inception till now? I started making simple beaded items in 2010 to help with an income while I studied Life Coaching. I started selling at NAP stores and the Porters Market in Tokai, where I had a such positive feedback and sales were beyond what I had ever imagined. We then started at the Bay Harbour Market in Hout Bay and our jewellery range grew to include a

large range of cast silver items and semi-precious stones. My company grew year on year and it became my full-time passion. Three years ago, we moved into the Watershed at the V & A Waterfront. We now have an on-line shop and have just opened our Studio Shop in Victoria Mall, Hout Bay.

What inspired you to start your own business? I desperately needed to leave the corporate world and do something for myself. I decided to study to become a Career Coach and it was during my training that I realized I could turn my passion and love for jewellery into a career and business.

PROPERTY TRANSACTIONS CAN BE A MINEFIELD CONSULT A LAWYER BEFORE SIGNING AN OFFER TO PURCHASE

When an offer to purchase a property is signed by both buyer and seller, this constitutes a binding agreement or “Deed of Sale” between the two parties. However, in most cases the “standard contract” might not be enough to cover all the specifics pertaining to the sale. The agreement may require some additions or alterations to clauses, which needs an expert hand in the drafting of such – as these can have serious ramifications if not done properly, says Charlene Nolte-Joubert, partner of Henkes Nolte-Joubert Attorneys and a founding member of the Attorney Realtor Hub. When an offer to purchase a property is signed by both buyer and seller, this constitutes a binding agreement or “Deed of Sale” between the two parties. However, in most cases the “standard contract” might not be enough to cover all the specifics pertaining to the sale. The agreement may require some additions or alterations to clauses, which needs an expert hand in the drafting of such – as these can have serious ramifications if not done properly, says Charlene Nolte-Joubert, partner of Henkes Nolte-Joubert Attorneys and a founding member of the Attorney Realtor Hub. In terms of our law, it is the seller’s prerogative (not the agent or purchaser) to nominate the conveyancers of his choice as the seller is the most at risk and must be able to rest in the knowledge that the attorney will act on his behalf by doing whatever it takes to get the transaction finalised as quickly and efficiently as possible. Incorrect or incomplete documentation may result in delays in the transfer process, and can also result in adverse financial complications or loss of monies, she warned. There are certain questions that an experienced conveyancing attorney will ask when drafting an offer to purchase. These are (among others): By what proprietary regime are the sellers, if applicable, married? For example, if they are married in community of property, the property will be registered in both their names, and they both must sign the sale agreement. Or if the seller is a foreigner, the spouse of the seller must assist by signing the offer to purchase. Considerations such as where the husband was domiciled at the time of the marriage as well as the the marital regime will be vital in determining whether both the husband and wife need to sign if, for example, only the husband purchases the property. All these different scenarios must be considered to ensure that the sale agreement is contractually as watertight as possible. Is the property being bought in another entity? If the property is to be bought in a trust, a trustees’ resolution must be passed by the trustees before the agreement is signed, authorising one of the trustees to bind the trust. Documents cannot be backdated and the trustee signing on behalf of the trust must have been nominated by his co-trustees as the designated signatory prior to him signing the offer to purchase on behalf of the trust, failing which all the trustees must sign the purchase documents. Unlike the case of a company or close corporation, a trust/it’s trustees cannot ratify the acquisition of an immovable property by the signature of one of its trustees unless his actions were authorised by resolution prior to the sale agreement being signed by him. If it is a company and someone signs on behalf of a company to be formed it is important to know the consequences of doing so and how to go about it to ensure validity and no personal liability. If the property being sold rests in a deceased estate, the executor of the estate will have to sign the relevant documents and this can only be done once the Letters of Authority has been issued by the Master of the High Court. Also in last-mentioned instance, it is advisable to include a clause in the contract to state that the sale is subject to the approval of the Master of the High Court in terms of Section 42 (2) of the Administration of Deceased Estates Act. For such consent to be granted by the Master, the consent of all the interested parties must be obtained.

Is the purchaser paying a deposit, how much of a deposit is expected and has the payment date for the deposit been specified? Buyers might ask why they should pay a deposit and why generally 10%. Although there is no hard and fast rule as to the amount, the answer is reasonably logical, says Nolte-Joubert. If a purchaser pays a substantial deposit, this shows good faith, that he has at least some financial means or an ability to pay (although he may still have to qualify for a mortgage bond for the balance of the purchase price) and that he is seriously committed to the transaction. This strengthens an offer and its prospects of success. The deposit can also be held back in lieu of damages, should the purchaser default. If the deposit is to be non-refundable, the conditions and consequences of having this clause included will be explained fully to the buyer and seller. Has the information been verified against the Title Deed? The Title Deed will be checked to determine whether the size of the property as described in the offer to purchase or Deed of Sale corresponds with the details on the Title Deed. Restrictive conditions should be checked, for example whether there is a usufruct on the property, or any servitudes. Does the seller have copies of approved plans for the property? Having approved plans is not a prerequisite for the property to be registered in the name of the purchaser but if no approved plans are available, it is advisable from a purchaser’s perspective especially, to make it a condition of sale that approved plans be provided by a certain date the parties agree upon, as well as who would bear the costs. If the property is a sectional title unit, details of the unit number, section number and corresponding additional sections, i.e. garages, parking bays, storage rooms, will need to be checked and confirmed. Are there any suspensive conditions? An offer will often contain at least one suspensive condition if not a cash offer, i.e. be subject to the qualification for a mortgage bond of a certain specified amount by the purchaser or be subject to the sale of the purchaser’s current home, or both. It is important to ensure that a suspensive condition is properly drafted, and your attorney should ensure that this is done correctly. It must be clear, concise and, most importantly, stipulate a cut-off date i.e. by when the condition must be fulfilled. If transfers of multiple properties need to happen simultaneously, e.g. the sale of one to buy another, then the transactions need to be linked financially and the dates of registration need to be simultaneous, or if not possible as soon as possible have the one register after the other for obvious financial reasons. All the parties involved in the various linked transactions need to be “on the same page” as to what is required of them. Are there additional conditions listed of what needs to happen prior to transfer specified and how will they be dealt with? Where there is more than one condition, it is best to deal with each one separately, to avoid confusion. If there are costs involved, it must be stated who is responsible for the costs. If there is any doubt or the condition deals with some unusual matter such as the requirement of a specialist’s report on the property, e.g. an engineer’s report to confirm that there exist no structural or other defects to or in the property, then your conveyancing attorney should deal with this clause timeously to obviate any unnecessary delays or uncertainties. Often a snaglist is included and the intention is that this be dealt with prior to registration of transfer unless otherwise agreed.

Is there an existing bond registered over the property? The seller must generally give at least three months’ notice to his financial institution of his intention to cancel his bond to avoid penalties. The attorney will be able to do this on behalf of the client and this process is preferable as the attorney can ensure notice is given properly. Does the contract allow for vacant occupation and does it specify whether vacant occupation will occur on transfer or on a specific date? Should vacant occupation be specified it is important to know that the seller must deal with any tenants by giving notice timeously to ensure the property is vacant prior to the date of registration of transfer. The tenant is protected by the common-law principle of ‘huur gaat voor koop”, and if the offer to purchase does not provide for vacant occupation the lease will survive the sale and the purchaser will become the landlord by stepping into the shoes of the seller. Is the buyer in this contract covered by the Consumer Protection Act (CPA) or does the voetstoots clause apply? If the seller of the property is a private seller, and not an investor, speculator, trader, builder or developer, then he is not dealing in property “in the ordinary course of business”, which means that the voetstoots clause could apply. It is always best to attach a full disclosure report, to avoid any discrepancies in the condition of the property at a later stage. Have all the blank spaces been filled in and have the witnesses signed wherever they need to? Some banks now insist on witnesses to the offer to purchase, and even though it is not strictly a requirement, it seems to be standard practice. Buyers and sellers must never sign a contract if there are any incomplete sections in the document. Were any alterations or changes made to the contract? Any material alteration to a contract needs to be accepted by the other party for it to be valid, and if an alteration is made after the first signatory has signed – it cannot be said that the first person has accepted the change, and must be re-presented to the first signatory for confirmation of the change. Therefore, until accepted by the first signatory it will be regarded as a counter offer and only upon acceptance become a valid Deed of Dale. What is included in the sale? To avoid any later disputes, it is advisable that a comprehensive list is made of the items that will be included in the sale as it often is unclear what the permanent fixtures and fittings are. As each potential sale and acquisition has its own set of facts, before embarking on an acquisition or sale of immovable property, consult your attorney. Your attorney will also be able to provide you with invaluable information such as a breakdown of who pays for what costs and can also provide you with an accurate estimate thereof. Furthermore, they will be able to answer questions relating to when you are at risk of paying any additional taxes, such as donation or capital gains tax, and even provide advice on more complicated issues such as the possibility of structuring a sale as a zero-rated transaction. Phrases such as business days and calendar days can be explained to ensure notices are given timeously, to avoid a future unintended breach of any terms in the agreement. “It is therefore worth repeating that it is critical that both purchaser and seller understand the fine print and consequence of the terms and conditions of an Agreement of Sale before signing on the dotted line,” said Nolte-Joubert.

Jeannie D: The sky is the limit! Jeannie de Gouveia always knew she wanted to perform. At twelve she auditioned at the National School of the Arts (drama) to hone her skills. She secured many lead roles in theatre productions and starred in popular commercials. Her career kicked off when she relocated to Cape Town and (after two months on the graveyard shift at Good Hope FM) was given her own show. In 2006 she resigned from radio to join the Top Billing team - becoming a household name. Her career has continued to grow exponentially and we believe that the sky is the limit.

What motivates you to succeed? I’ve been working non-stop since I was 18. I love what I do but I also have a radical fear of failure, so I guess I just keep pushing. Give us some behind the scenes secrets about life on TV. It’s quite intense. We work really hard, but I try keep the environment quite light and fun. I love to laugh and believe that we do entertainment and the only way to do it well is if you’re truly having fun whilst working. What’s kept you so busy this year? Top Billing and Afternoon express. I also did campaigns for Biogen, Mercedes Benz, Elancyl, and First Diamonds. Where do you see yourself in 5 years? I don’t even know what I’m doing next week. What are your top 3 beauty product must haves? Elancyl slim design (obviously) but it really does work! Coconut oil! The la Mer body lotion is out of this world! My skin has never been softer. If you weren’t doing this, you’d be... No idea. Tell us something about yourself that will surprise us. I’m a complete nerd! I overthink. I’m super-dramatic and often quite shy.

What is top on your travel destination bucket list? I’m busy writing a new season of Top Travel at the moment and finding some epic travel destinations.... watch this space. What helps you stay grounded? My incredible friends. I’m so lucky to literally have the most amazing group of friends ever. What’s the craziest untruth you’ve read about yourself in the media? I’ve been quite fortunate that I’m not really tabloid fodder and I don’t pay much attention to stuff like that. What’s your favourite guilty treat? Oooh I’m obsessed with those pumpkin donuts from Scheckter’s Raw cafe but apparently they are guilt free! Who’s been the most influential and inspirational person in your life? I wanted a strong female mentor but sadly pushed through without one. I now have amazing people and influencers in my life that guide me in business. Other than that I take inspiration from many people, places and experiences.

The elegant charity event was held at the sprawling The Riverside Boutique Hotel in Hout Bay, in support of the 12 NGO’s which are the Horses For Causes champions. In addition to a scrumptious high tea and delicious pink gin cocktails from The Pink Gin Company, there were lawn games as well as music by Hezron Chetty. Guests were also treated to a glambar hosted by Langaro as well as a fashion show which exhibited summer collections available at their Spa and Boutique in Camps Bay. TENNIS ELBOW – A WATER BUCKET LIFTING INJURY By Dr Guy Ashburner, Osteopath

Founder of Osteopathy Often the condition is present long before the person actually starts to feel the pain, and usually only painful to touch or pressure, or when bumping into door frames. People may experience symptoms which range from pain while gripping objects (shaking hands, picking up a kettle, carrying a briefcase, brushing teeth) or resisted wrist/finger extension or when the muscles are stretched but also can progress to a constant and unremitting ache that disturbs sleep.

Tennis elbow is a pain or ache that is felt on the outside of the elbow due to an injury to the muscles that extend the wrist and fingers. Most people experience a gradual onset of pain that is intermittent at first then gradually becomes more constant. In some instances the pain may come on suddenly. The pain is usually around the outside of the elbow although you may feel some stiffness along the top of the forearm too. Repetitive strain or trauma leads to micro tears in the extensor carpi radialis brevis tendon (ECRB) close to where it inserts on to the bone (called the lateral epicondyle of the humerus) this initiates an inflammatory process causing pain and discomfort.

Tennis elbow can often be linked to an increase in a specific repetitive activity or a new type of activity with repeated extension of the wrist against resistance (onset of tennis season, DIY, typing, bricklaying, sewing, knitting, excessive computer use, hairdressing, playing the violin, gardening, picking up buckets of water) or incorrect technique or overuse of weights, dropping a heavy weight without control (i.e. kettlebell swings) and excessive gripping. Through accumulation or excessive movement, the forearm muscles develop muscle contractures and fascial adhesions which make them tight, weak and will increase the probability of injury to the ECRB tendon. Tennis elbow can also be caused by poor posture/biomechanics of the whole arm, shoulder and neck.

You may want to consider seeing an osteopath to have a proper examination and diagnosis of the pain. There are many causes of pain around the elbow. The correct condition and cause must be identified in order to treat it correctly. Osteopaths consider a range of muscle, ligament, joint injuries and neurological dysfunction when coming to a diagnosis. The goal of osteopathic treatment is to allow the tendon to heal, release the muscle contractions and fascial adhesions and mobilise the joints thus stopping the muscles from over contracting and pulling on the injured tendon. Osteopathic treatment may involve subtle cranial osteopathic techniques, myofascial release, soft-tissue massage and joint manipulation. With osteopathic treatment the muscle ache and pain is reduced, the muscle tightness lessened and the strength to grip, lift and carry improves. Specific advice such as isometric exercise may be given to aid further recovery and limit recurrences. This normally significantly reduces the need for injections or surgery. Left untreated this problem persists and will intermittently return.

Be Sun Smart As the sun is responsible for up to 80% of all skin ageing, dermatologists and aesthetic doctors’ one most important anti-ageing tip is to protect your skin against the damaging rays of the sun. Visible signs of ageing from sun damage can appear as early as your twenties, but generally it is only later on that the real damage comes to the surface. The more diligent you are protecting your skin, the better your chances are of looking younger for longer.

Undesirable sunburn sometimes occurs despite sunscreen application. The reason is because most people don’t apply enough. To achieve the Sun Protection Factor (SPF – which protects against the sun’s UVB radiation) reflected on a bottle of sunscreen, approximately two milligrams of sunscreen per square centimeter of skin should be applied. In practice, this means applying the equivalent of a shot glass (two tablespoons) of sunscreen to the exposed areas of the face and body – a R5 coin-sized dollop to the face alone.

Selecting a good sunscreen can, however, be very confusing. Perhaps a good place to start is to know what you’re protecting yourself against. The sunlight that reaches us is made up of two harmful rays – UVA and UVB. UVA rays (long wave ultraviolet A) penetrate into the deeper layer of the skin. UVB rays (short wave ultraviolet B) are responsible for the topical burning of the skin. It is important that the sun protection we use protects the skin against both rays, as both are damaging to the skin. This is known as broad-spectrum sunscreens. The two types of sunscreen that can protect the skin against UVA and UVB are known as physical and chemical sunscreens.

Physical sunscreens form a protective layer (or physical shield) on the skin and block or reflect the sun’s rays whereas chemical sunscreens absorb the sun’s rays and neutralise them.

Using a higher SPF does not mean a full day’s pass in the sun. Use an SPF between 30 and 50 and reapply often because sunscreen chemicals break apart in the sun, wash off and rub off on towels and clothing.

LOVE, AND GIVING UP TOO EASILY…

I recently took a short break from the office to recharge for what is for me often a busy festive season in the office. It gave me a chance to read new material and re-read some old but still very relevant writings around couples and relationships, some of which I felt worthy of sharing, especially as we go into what can be a difficult time for some people. Couples and families are tired from what has been for many a tough year. Busy lives wind down for a short spell, families get together and amidst the fun and laughter often tensions arise. January may see a surge in people entering counselling wanting to reconsider whether they want to continue with their relationships/marriages.

The subject of expectation arises often in reading material around relationships, and I find with people that I work with that a person or a couple often have unrealistic expectations of a relationship or a significant other.

I wonder sometimes, whether people actually stop to ask themselves what they expect from a relationship, are they mindful, do they actually know how they want the relationship to be and what they want their relationship to look like? Do they ask themselves, is it the relationship that is the problem, or do ‘I ‘ have a problem, am I unsettled for some reason and I am looking at the relationship as being the cause of my restlessness? When feelings of malcontent creep in are these a warning sign of deep-seated problems, or is it really a case of ‘this is the normal’ day to day up’s and down’s of life. Problems are to be expected in relationships, it’s supposed to be that way, and we have to calmly work through our issues. A couple will succeed if they have good conflict resolution

For instance, I will hear, that the ‘magic’ has gone, ‘it’s not like it used to be’ or ‘he/she has changed’ – Well, perhaps on reflection, the magic is still there but it now comes in a different form, perhaps through the joy of children, or in realising that you have a mature contented relationship and companionship. People do change, Peter Pan is a fictional character, we mature and change through the trials and tribulations of our life experiences, it isn’t always possible to remain carefree all our lives, and we are shaped by our experiences. In M. Scott Peck’s classic book the Road Less Travelled, he discusses the subject of love, and relates the initial phase of meeting a person as a ‘lust’

phase, he discusses in depth the theory of real love being something that accumulates over time and builds within two people who after a lust phase make the ‘choice’ to go on together in life and in doing so agreeing to weather the up’s and down’s of what lies ahead, he describes this ‘weathering’ as love, this is where love is fostered and grows, most growth can often come from surviving the dark moments, not just the fun times. Sadly, in our instant gratification, throwaway world, I find people are less willing to weather the downs, rather wallowing in the unhappiness of the moment and they don’t necessarily look back to the good times or accept that their partner may not be quite as perfect as they would like! Will they focus on working towards good times in the future, and accept that there will be difficult times? Perhaps the relationship just needs a bit of ‘introspection, pulling back on track and help to be coached into a continuing future life together.
