Spring is in the air, and for some it’s usually a time of fresh outlooks, coming out of the hibernation of winter and having an enthuiastic outlook on the future. A difficult approach to adopt given the swathe of bad news locally and abroad of late, and there have been many tragic events that have us naturally wondering what on earth is going on with people and the world? This time of new beginnings can be an opportunity to check in with oneself and say where am I? What do I want? and Where do I want

ED’S LETTER Elections are behind us and a long, hopefully wet Winter is ahead of us. I wonder how many of us are still practising all the water-wise ways we adopted for the drought? Or do we feel that worry is behind us? Either way I don’t think it can do any harm to play it safe, considering how close we came to ‘Day Zero’ just last Summer. For those with school- going, older children exams have commenced. Who worries more in your household about these bi-annual occurrences, you as a parent or your offspring? There’s a fine line between not wanting to load on the pressure and making sure that your child begins to learn that for some things in life, maximum effort is required. Not because it’s fun or because there is a reward attached but because the reward is a long-term. This of course being something completely alien to our youths’ need for instant gratification. So much of parenting is in building our children up, telling them they can do anything their heart desires. I worry that for many of them we may be setting them up for failure. Life isn’t always glitz and glam and things don’t always go our way. Life is more often than not built on every day mundane activities, interspersed with occasional moments of joy and love and play. I want to prepare my children for this, and so hiding their ipads away and forcing them to spend some time on an activity they’d rather not focus on is the first small step. Lastly, a big Happy Father’s Day to all the fathers/step-fathers and father figures out there who are doing an invaluable job. We applaud you.

PADDY UPTON: BAREFOOT AND ON A MISSION By Danni Martin

Head coach in international T20 cricket, mental coach to professional athletes, a University Professor and acclaimed speaker, this talented man has launched his first book which will no doubt wow us all. What was the inspiration behind writing your upcoming book? I’ve been gifted so many amazing opportunities to work with professional athletes, across the world, for the past fifteen years. As sport teaches invaluable lessons, for all of life, the book provides an opportunity to share the best insights and lessons from these experiences, hopefully adding value to other people’s personal and professional lives. Why ‘the Barefoot Coach?’ ‘The Barefoot Coach’ title reflects the down-to-earth, candid and very real content, where I share success and failure, and the good and the not-so-good with equal honesty. Also, when I was appointed as one of the first foreign coaches in Australia’s Big Bash T20 cricket League in 2014, my friend and Proteas cricketer Dale Steyn commented, ‘not bad for a barefoot surfer from Hout Bay.’ (I seldom wear shoes around the village). How do you leave your ego behind as a coach to best help those you’re working with? When coming from ego, we are serving ourselves, placing our own agenda (of looking good and being right), ahead of serving the needs of the people we are supposed to be serving. Despite being acutely aware of this and working to not succumb to it, serving my ego still lead to one of my biggest professional errors that played out on global television which hurt some of the very people I was charged to serve. The whole story about this is explained in the book. For me, awareness is the best antidote to ego, which thrives in lack of awareness. Who’s been your biggest mentor? As far as mentors go, when it comes to innovation and having

the courage to challenge convention, Tim Noakes has been a guiding light. My other ‘great examples’ are those athletes that have got to the top of their game and have achieved ‘so-called’ fame, yet do not confuse having special talent with being a special human being. Examples include the likes of Gary Kirsten, Hashim Amla, Mike Hussey (Australian cricketer), Rahul Dravid (Indian cricketer), Jean de Villiers (SA rugby) and from my favourite sport, people like Mick Fanning and Ace Buchan (surfing). How do you balance your nomadic lifestyle with the needs of your family? For over a decade, I have worked abroad for 6-7 months of the year, mainly in India, Australia and Dubai. This has been particularly tough on my wife who takes care of our three children, our pets, and our home and vegetable garden etc. Our rule has been that if any trip is longer than 4 weeks, her and the children would join me for about 2-weeks. This has provided us with some wonderful travel opportunities. Almost everyone I speak to, where one partner travels extensively, reports a similar experience of the first few days back being the most difficult. Both of us become independent when apart, and it takes time (and friction) to reintegrate as a couple and in partnership. Tell us something about yourself no one may know I could live anywhere in the world with my work, and am often asked where I would choose. The answer is simple; I have chosen. I live in one of the most beautiful suburbs, in the world’s most beautiful city, and in which the quality of life is the best I’ve experienced. Sure we have challenges, but the good parts are better than anywhere in the world.

BUT MARRIAGE IS AN EYE-OPENER The love of your life finally popped the big question and you are on cloud nine. For most couples this is a very exciting and overwhelming period in their lives. Not only do they have to ensure that they secure the perfect venue and photographer, but they also have to consider the legal implications of marriage. Firstly it is important to understand the different types of marriages in South Africa. Most of us are familiar with the “traditional” marriage between a man and a woman. Fortunately, our matrimonial laws make provisions for other alternatives to accommodate our diverse culture. Other than the “traditional” marriage, couples of the same gender, can enter into a civil union. A civil union can be defined as a voluntary union between two people of the age of 18 years or older, which is solemnized and registered as such. Partners can decide whether they want to call their partnership a marriage or a civil partnership as the union has the same legal consequences as the “traditional” marriage as mentioned above. Couples can also get married in terms of customary laws. A ‘customary marriage’ is defined as a marriage concluded in accordance with customary laws, being the customs and usages traditionally observed amongst indigenous African groups which form part of the culture of these groups. Religious marriages such as Hindu and Muslim marriages are not traditionally recognised in South African law, but fortunately change seems to be imminent. During August 2018, the Western Cape High Court ordered that legislation is to be changed to “recognise marriages solemnised in accordance with the tenets of Sharia law (Muslim marriages) as valid marriages”. This has not been affected to date, but we are hopeful that it will be in the near future. Upon deciding which type of marriage is best suited for your lifestyle, the next (and probably the most im-

portant) consideration is your marital regime. For many years the most popular choice was getting married in community of property. This means that a couple gets married without entering into an anti-nuptial contract prior to solemnising their marriage. Both parties’ estates are joined, meaning that all assets and liabilities (prior and subsequent to the marriage) of each respective party are now joined to form one single estate. This form of marriage bears the most risk to both parties as both parties are bound by the financial decisions and responsibilities of the other. In order to avoid such a risk, parties choose to enter into a notarial anti-nuptial contract prior to solemnising their marriage. This contract excludes community of property which means that each party retains their assets and liabilities accrued before getting married. Once a couple with an anti-nuptial contract in place gets married, they start accruing a new joint estate from the moment of marriage, subject to any exclusions that they might have in their anti-nuptial contract. Should a couple wish to retain their separate estates and not have a joint estate after marriage, the accrual system (profits and losses) must be expressly excluded. Each party will then have their own separate estate, before and after entering into the marriage. When getting engaged, many couples get caught up in the excitement of a new future, but it is of utmost importance to talk to your partner about the above and consider all options available. DEATH & TAX Many people are unaware of how significantly taxes and fees can reduce the anticipated value of their estates after passing on. Anthony Palmer and Hailey Roos, wealth management specialists at Carrick Wealth, tell us more. We often find when assisting our high-net-worth clients with estate planning that they are mortified when they discover the corrosive impact of tax and fees upon their passing. Estate duty, capital gains tax and executor fees can easily add up to over 25% of an estate as demonstrated in the simple calculation below. Clients’ are understandably distressed when they realise that the South African Revenue Service (SARS) is in fact an additional beneficiary alongside their children.

Another aspect that shocks our clients is death tax on property held outside South Africa. This is called situs tax and relates to assets that are “on site” in another jurisdiction. Common assets that fall into this category would be cash in a bank account and property. These situs assets are taxed as follows: • United Kingdom - Inheritance Tax rate of 40%, after accounting for an abatement of GBP325,000. • USA - Estate Tax of 40% with a much smaller abatement of USD60,000.

Other issues overlooked Not only is this a jaw-dropping number but to add insult to injury the estate needs liquidity to make the above payment, often resulting in a forced sale of investments at an inopportune time.

SCHEUERMANN’S KYPHOSIS (OSTEOCHONDROSIS)

Scheuermann’s Kyphosis (osteochondrosis) is a condition that affects the growing skeleton in which the normal curve in the upper back (thoracic spine) is increased, forming a hunched back which can have a profound effect on total body development. Disturbance of the spinal end growth plates causes frontal spinal segment (vertebral body) wedging usually in a group of 3-4 vertebrae that results in a forward curve of the spine (kyphosis) during a growth spurt. This can then lead to some restriction in range of movement especially into extension (bending backwards). It is not known what triggers the abnormal growth in Scheuermann’s but there are theories that the bone may have been injured at some point, or that the area was weak before puberty. Your child, normally between the ages of 10 and 15 when the spine is growing rapidly may complain of upper back pain and stiffness and this is more likely following either exertion or long periods of inactivity. The pain can be made worse by activity including sports that require a lot of twisting, or forceful bending or arching backwards such as gymnastics, cricket, rugby (reaching backwards in the lineout or bending over at the breakdown) or athletic field events. A visit to the osteopath is often prompted not by pain, but by cosmetic concerns about the “hump” appearance of the back with Scheuermann’s. This increased curve and reduced flexibility can then mean that there is an increased susceptibility to ligament, muscle and, sometimes, disc injuries in these neighbouring areas (neck and lower back) in adult life. BRETT NUSSEY: ANYONE CAN COOK! Brett, as the mastermind of Stir Crazy, tell us a bit about your background. I have always welcomed the challenge of learning new life skills and never really settled on one career path. My life has involved following a number of different careers, most of which I have started and run as my own businesses. These have included advertising and design agencies, marketing, product merchandising, technology, restaurants, business consulting and teaching. I’d occasionally teach cooking classes in the evenings after work which is how Stir Crazy came about. How was the concept for Stir Crazy conceived? Stir Crazy was a business that arose almost by accident. I started the Harbour House restaurant in Kalk Bay and after some time had enough of working long crazy hours, so I left to go back into the IT business. Some friends then asked me to give them some after-hours cooking classes. I enjoyed the creativity of cooking and started teaching hands-on cooking classes which I found kept my cooking creativity alive. Later, in 2006, I set the school up in Observatory premises and Stir Crazy was formally established. The business has since grown into an organisation that provides training courses with International Certification, Domestic Training, Teambuilding and of course, Social Evening Classes. It’s been a great adventure. What makes your classes truly memorable? Most people leave our classes in awe of what they have just experienced. Many come along with pre-conceived ideas about what cooking classes are and find that the experience we offer is very different.

WINTER IS HERE! ARE YOU SECURITY READY? The cold is setting in and with it comes additional security issues to be considered, says Charnel Hattingh, National Marketing and Communications Manager of Fidelity ADT.

‘The arrival of Winter means that it gets darker earlier in the evenings and lighter later in the mornings. This may end up providing useful cover for any would-be criminals,’ she says. Hattingh says it is very important that house numbers painted on the roadside curb are visible and that if if you haven’t checked yours in a while to please do so as the paint fades over time, and with it getting darker earlier it gets harder to see these numbers in the event of an emergency. She adds that by simply having a visible number you can cut off precious minutes in terms of a response time from your security provider or medical response team. She also raises the issues related to residents keeping animals indoors and out of the cold

during the evening and not activating their home alarm systems. ‘It is perfectly understandable that people want to keep their pets indoors where it is warmer. I would recommend asking your security company to ‘animal proof’ your alarm sensors, or that you partition the house in such a way that your alarm system can still offer an early warning system in case someone enters your property,’ she says. Winter brings an increased demand on the national power grid which in turn makes the possibility of blackouts a reality. Hattingh recommends making sure that back-up power supplies are in place to keep lighting, non-functional gate motors and security systems in a working condition at all times.

She suggests leaving outside lights on if you know you’re going to get home after dark and to partition alarms so that external beams can be set early in the evening, just after you get home. Other recommendations include getting a professional in to check the tensioning of electric fencing as it shrinks in colder weather and can cause false alarms and linking smoke detectors to your alarm system. Fires during Winter can be caused by heaters, electrical appliances and the cosy fireplace left burning when you go to bed. She concluded by warning to please be extra vigilant when leaving and arriving home and that if you notice anything suspicious to alert your security company or the SAPS immediately.
