Chemical Industry Awards 2014: a night of celebration A packed audience of 400 business leaders, regulators and politicians attended a fantastic night of celebration at the stunning new Point venue at Lancashire County Cricket Club on 26 June. Judges agreed that award entries were of a very high standard this year with a number of entries that would have made the short list in previous years being rejected. Case studies of all the award winners will be made available with the October issue of CIA Matters in our special Celebration of Success booklet. The evening was hosted by CIA Chief Executive and BBC Breakfast Business presenter Steph McGovern, who did a fantastic job managing the excited winners. CIA would like to thank all sponsors especially our headline sponsor ABB. The trophies this year were made by year 10 students at Bridgewater High School in Warrington with financial support from Solvay. The school is very keen to make contact with companies who may have any unwanted laboratory equipment, or pieces of plastic, wood or metal that could be used by the design department. Nobel Prize Winner runs workshop at Catalyst! In July 2014, Trustees and staff at Catalyst Science Discovery Centre were delighted to welcome Nobel Prize Winner, Professor Sir Harry Kroto, to two events held at the centre. Professor Sir Harry Kroto, is an English chemist who grew up in Bolton, Lancashire before attending Sheffield University where he gained his BSc and PhD. In 1996 he was knighted for contributions to Chemistry and later that year, together with Robert Curl and Richard Smalley, received the Nobel Prize for Chemistry for the discovery of C60 Buckminsterfullerene, a new form of carbon. He is a Fellow of the Royal Society, former President of the Royal Society of Chemistry and is currently a professor at Florida State University. As a Patron of Catalyst, Professor Kroto and his wife Margaret, accepted an invitation to an informal evening reception on Wednesday 9th July where he was taken on a guided tour and met Trustees, sponsors and invited guests. The following day, Professor Kroto returned to Catalyst to present a workshop to over 100 local school pupils from West Bank Primary School, St Bede’s RC Primary School, Widnes and Didsbury CE Primary School, Manchester. The day began at 10.30am with a presentation from Professor Kroto before pupils took part in an hour long workshop to build their own model of C60 Buckminsterfullerene or ‘Buckyball’ as it is commonly known, ably assisted by student volunteers from Liverpool Life Sciences UTC.

Phill Day, Education Manager at Catalyst said “It was amazing to see children from three local schools in the presence of a Nobel Prize Laureate for Chemistry, who clearly understood and remembered what it was like to be a child with an aspiration to succeed. Professor Kroto’s enthusiasm rubbed off on these children as they then constructed the ‘Buckyball’ models of the carbon that he so famously discovered.”

Sir Harry Kroto who travels extensively around the world, delivering these workshops said “I am so pleased that the children were inspired, as that makes our travels worthwhile”. Having just returned from teaching children in Columbia and Rome, Professor Kroto taught sessions at Sheffield and Bolton (where he studied) and from Catalyst was travelling on to Sussex before leaving for Moscow. Speaking about Catalyst, Professor Kroto said that he was very impressed with the enthusiasm and dedication of the staff and the work being done to excite children about science and vowed to promote Catalyst wherever he can. Catalyst Science Discovery Centre, Chairman, Bryan Davies said “Catalyst had the most prestigious day in its history when Nobel Prize Winner, Sir Harry Kroto accepted the invitation to come and teach a session with the local pupils.” He added “Sir Harry is Lancashire born and his presentation to the assembled school children was inspirational and reinforced the values of studying STEM subjects as a worthwhile route for children to follow for future interest, stimulation and employment. As the UK’s only Science Discovery Centre dedicated to Chemistry, it was an honour and privilege to have a Nobel Prize Winner for Chemistry at the Centre.”

“I can rely on the buying club to provide all the support we need” Akcros Chemicals, a leading chemical additive supplier, employs more than 100 people working in manufacturing, research, administrative and business management roles at its global headquarters at Eccles in Manchester. It has been a member of the Chemicals North West Members’ Buying Club since 2008. Using the buying club, which gives access to deals on 100+ categories of noncore essential spends, Akcros has saved £25,000 on service contracts and about £20,000 on items including drums and lubricants. But the buying club, run by Independent Buyers Ltd, has helped in another way – taking on the management of a range of Akcros’s site services. This keeps costs down while ensuring service levels are constant.

The Problem: An initial assessment showed fluctuating service levels and standards of delivery that were hard to quantify. Akcros wanted to find better facilities management providers.

The Solution: Chemicals North West Members’ Buying Club worked with Akcros to create a tailored and flexible management solution

of contracts for essential support services - including cleaning, washroom services, security and vending. The buying club’s Contracts Manager works on-site one day a week and remotely to oversee all service contracts and manage the relationships with suppliers on behalf of Akcros.

Dangerous Goods Experts Around 25% of our total business is made up of the transport of Dangerous Goods. Many companies shy away from this niche market due to its complexity, so we find that many of our competitors make use of our specialism in this sector and utilise our services. I decided that as Managing Director of Ital Logistics it was my duty to take on the role of Dangerous Goods Safety Advisor (DGSA) in April 2004. Since then I have continued to renew my qualification, and have been joined by Derek Heap as secondary DGSA to the Company. In addition to this, all members of our team involved in this area of our job are awareness trained and refreshed as regulations change. There are many differences between the road, rail, sea and air regulations, even though with each revision the regulations come closer to alignment. In house we utilise a bespoke program designed by myself, which we call the HAZculator. This program collates all IMDG and ADR data, plus Eurotunnel and various other tunnel & port data, and returns correct Dangerous Goods Descriptions, including all associated regulations specific to the UN number or chemical name being searched. Additionally, it makes compatibility checks for up to 7 different UN numbers, as well as checking against other non-compatible items such as foodstuffs, for example. The UK is an island. Therefore, even just to get into the closest European country, we must use a combination of modes, and as the regulations are not completely aligned, there are often conflictions. Centre for Global Eco-Innovation helps Northwest businesses innovate to create a cleaner greener economy The Centre for Global Eco-Innovation is a partnership between Lancaster University, University of Liverpool and commercialisation specialist Inventya Ltd. Working together – the key to business growth? In August 2014, SABIC announced that it would invest for growth in the UK by modifying its cracker on Teesside into a gas cracker to take advantage of the shale gas revolution. The investment, which has Government support, meant that hundreds of jobs were secured alongside the potential for future investment.

President Keith Wiggins, who during his time in office, saw the necessity and potential for growth as global economic recovery beckoned.

At about the same time, chemicals giant Ineos was underlying its commitment to the UK shale gas industry by buying rights to explore a 329 square kilometre (127 square mile) area around Grangemouth and the Firth of Forth, in Scotland.

For Steve Elliott, Chief Executive of the Chemical Industries Association (CIA), both moves were symptomatic of the kind of forward thinking that is needed by the industry if it is to compete with shalefuelled competition from the United States and the big chemicals players in the Gulf and Asian markets. The CIA is a key supporter of the Chemistry Growth Partnership (CGP), which argues that companies in the UK chemicals sector must, in part, set aside business rivalries and work together. Their co-operation, Steve argues, is crucial if the sector is to both take advantage of the opportunities presented by the recent upturn in the UK economy but also counter the threats posed by foreign competition. The group, which has been at work for just under a year, is working to implement a strategy with a vision to grow the contribution of chemical and chemistryusing businesses by 50% in less than two decades. Chemistry Fuelled Growth of the UK Economy, which was presented by chemical business leaders to Michael Fallon, then the Minister of State for Business and Enterprise, called for rapid exploitation of shale gas, accelerated innovation and the rebuilding of UK chemistry supply chains. According to Steve Elliott, the CGP can trace its beginnings back to former CIA

“His enthusiasm has ultimately led to the creation of the Chemistry Growth Partnership, which argues that in order to take advantage of the opportunities and counter the threats the industry has to work together collaboratively. “The UK chemical sector is in recovery mode after the global crisis but we have to do much more to take advantage of the opportunities available, particularly since the UK economy started to turn. “Our argument is that as key customer sectors like automotive and aerospace grow, they will increasingly need the products and services offered by chemical companies. Why shouldn’t those chemicals and chemistry increasingly be provided by UK companies? “Also, some major companies which take their primary supplies from overseas markets are becoming concerned about the security and cost of some of those supplies and are looking to the European market for a competitive alternative supply or secondary supply. “At the beginning of 2014, the UK Prime Minister placed his personal support behind proactive “on-shoring” and I am pleased to see real evidence of this with several chemical-dependent industries such as pharmaceuticals and agritech strengthening their relationships with UK chemical businesses. “The CGP’s approach has respect for competition - many of the UK companies involved are rivals - but we feel that to truly take advantage of the opportunities we have to work together.

“There are threats to be countered as well. Take fracking. The Americans were the first to take advantage of the potential offered by fracking but the recent announcements by Sabic and Ineos show what can be achieved by companies here in the UK. “There is an urgency to our approach. We have to be aware of the competition from cheap shale gas from America and also from competition in the chemicals sector in the East. Working together as a UK industry will have its rewards, but the clock is ticking.” That sense of co-operation mirrors the work of the Chemical Industries Association, which is the organisation that represents chemical and pharmaceutical businesses throughout the UK. The CIA is well placed to bring companies together. The most powerful collective voice in the industry, it represents all sizes of chemical and pharmaceutical

businesses and has strong UK and international connections: approximately 70% of its members are headquartered overseas.

Steve himself joined the association in 1997, spending four and half years as Head, International Trade with additional responsibility for Sustainable Development before in 2002, he was promoted to the position of Director, Trade & Competitiveness and subsequently Director, Business Environment. When was the last time you cried? Why? I came across a Youtube clip recently, which has been downloaded thousands of times. I laughed until I cried. Google ‘cat vs printer – the translation’ and you’ll see what I mean. What is your most embarrassing moment? Looking down at my feet one day while talking to my boss, and realizing I was wearing differentcoloured shoes (one black, one dark brown, same style). My big mistake was in being so startled that I failed to lift my eyes quickly enough before my boss also looked down.

What is your favorite Chemical Element and why? Carbon is an amazing element. It comes in so many different forms and is the fundamental building block of life. Makes for great barbecues as well! What is your biggest regret? Not starting my own business when I was younger. Often it’s hard work, and you have to be involved in just about everything that gets compartmentalised in a big business (sales, marketing, finance, admin etc., as well as doing the ‘real’ work) but it’s great fun too. In your opinion what is the greatest ever invention? At Ironbridge, Shropshire, you learn about the invention of coke by Abraham Darby 300 years ago. Without that invention, the Industrial Revolution would never have got going in the way that it did. The rest is history… If you could be a cartoon character who would it be? Why? I’m not sure I would actually want to be one, but I love the Minion cartoon characters in the Despicable Me films. For my birthday recently, I was given a pile of Minion paraphernalia: T-shirt, cushion, keyring, poster etc.

What’s the best thing you’ve ever won (event/prize/competition)? I won a pair of Celestion loudspeakers in a hi-fi magazine competition when I was in my teens. I couldn’t believe my luck, and I kept those speakers for many years. What is the one thing that disgusts you? People that throw rubbish - especially cigarette ends - out of their cars. What was your favourite toy as a child? I was an avid collector of Corgi cars, and still have all of them. They’re worth quite a bit of money nowadays, but I wish I’d kept more of the boxes they originally came in – they’d be worth even more. Favourite Actor/ Actress (for which performances)? I’m a fan of Angela Jolie. I think her performances in films like The Tourist and SALT are great, but more than that I admire her personal courage and work on behalf of disadvantaged people. Favourite Song or Artist? I prefer rock bands, and my long-term favourites are Pink Floyd and Genesis. My kids raise their eyebrows when I play Linkin Park at loud volume, but they’re just jealous in my opinion. Favourite holiday destination/resort? I can’t get enough visits to The Lake District (the quieter parts), and consider myself very fortunate to live so close to such a beautiful part of the UK. Best Concert you’ve been to? I regularly attend rock concerts, which is the big advantage of living so close to Manchester. One of my favourites was the 2007 Genesis concert at the Man United ground.

If you could meet one person in history, who would it be and why? Churchill. The man lived a packed life and changed history. He was also down-to-earth and loved his family. A visit to his former home at Chartwell is well worth a visit. Favourite alcoholic drink? Why? Rioja has always been my favourite wine. Fortuitously, my newest business partner, SIAM S.L. is located in the capital of the Rioja region of Spain, and for obvious reasons I’m looking forward to visiting them soon. If you won 100million on the euro millions, which car would you buy? My wife tells me I must put ‘VW Campervan’. I think she’s nostalgic for her childhood. Living as we do on a farm property, I’d probably go for a big 4x4 like a Range Rover. What is the first thing you do when you get up every morning? Make the missus a strong cup of coffee. It’s the only way to get her up in the morning. Which one country would you want relocate to if you had the opportunity? I’m not sure if I would want to relocate there but I’m keen to visit and stay in Ecuador for a while. Our 22-year old daughter frequently travels there, and I’ve become quite intrigued by the country. When you were a child, what did you want to be when you grew up? An airline pilot. Almost certainly this was because I was already a frequent flyer in my early teens, given that my family was living and working in West Africa at the time. What is your favorite meal? I adore Indian food. When I visit new places in the UK, one of the first things I often do when I check into a hotel is to look for the best-rated local Indian restaurant on Tripadvisor. Which year of your life has been the most momentous so far? 1986. In that year, I gained my doctorate from Imperial Collage, my first son was born, I was successful in getting a new job with ICI in Manchester and we moved house from Berkshire. It was exhausting and exhilarating at the same time.

CLP. Are you ready for 2015? The arrival and implementation of REACH over the last few years has somewhat eclipsed another related Regulation regarding the Classification, Labelling and Packaging of chemical substances and mixtures (CLP). It is clear that the number of mixtures which will need to be reclassified and relabelled will be huge. With the deadline now so close, many formulators and importers of mixtures should already have their implementation plans well advanced, especially where new classifications will result in changes to labelling to take account of the new hazard pictograms.

The CLP Regulation came into force in January 2009 and was first implemented on 1st December 2010. It will ultimately replace the Dangerous Substances/ Preparations Directives. Although broadly similar in approach to the Dangerous Substances Directive and the Dangerous Preparations Directive, CLP has introduced different classification thresholds, new hazard categories and statements, new precautionary statements (substituting the former R/S-phrases) and new pictograms. In addition the REACH regulation established a new format for the reporting of hazards in Safety Data Sheets. Manufacturers and importers of substances and the formulators of mixtures therefore need to reassess the classification of their products and make changes to the Safety Data Sheets and labelling where required. In order to allow an orderly transition from DSD/DPD to CLP, the implementation was required over two phases. Since 2010, manufacturers and importers of chemical substances have been required to: n Notify the classification of hazardous

substances (or substances subject to REACH) to the ECHA classification and labelling inventory. n Classify and label substances according

to CLP n Provide a Safety Data Sheet with

the classification according to CLP alongside the (older) classification according to DSD.

Formulators and importers who have not yet taken action to implement CLP are urged to do so now. The following steps are recommended as a guide: n Identify your role under CLP. (Do you

The 1st of June 2015 deadline for implementation of CLP for mixtures represents a major challenge for SMEs There is a tendency to become complacent as REACH and CLP landmarks appear to roll by like waves breaking on a beach, but the 1st of June 2015 deadline for full implementation of the Classification, Labelling and Packaging (CLP) Regulation for both substances and mixtures will be a major challenge for many businesses. Mark Pemberton, director of Global MSDS Ltd, explains that while it remains true that the classification of substances according to CLP and the associated Safety data sheet (SDS) and Annex continues to be a challenge, this pales into insignificance when compared with the enormous number of products containing mixtures, including many consumer items such as paints and detergents, that must be reclassified and re-labelled to comply with CLP by June 2015.

Perhaps you are focusing on the 1st of June 2015 deadline for applying CLP to mixtures in which case our new webbrowser product for SDS authoring “Hazmix” may be the answer. Scheduled to be launched before year-end it will be a very low cost, pay-as-you-go product so will not entail any expensive capital outlay or maintenance charges. You simply pay for the SDS on output and what’s more, discounts will be available for volume users.

Mark goes on to explain that a major challenge in this regard is that many suppliers have not yet switched over from the old Dangerous Substances Directive classification system to the new CLP system so it is very difficult to obtain reliable data upon which to classify a mixture. This combined with the complex rules of CLP and the new format of the SDS makes the process of classification and SDS/label production both timeconsuming and costly. For this reason many companies have cautiously set an internal deadline of January 2015 by which to choose their SDS software service provider, or to outsource SDS production to a 3rd party.

This multi-million pound scheme – financed through the fourth round of the Government’s Regional Growth Fund (RGF) and led by the University of Chester – is stimulating business growth and job creation by helping companies with capital investment in buildings, plant and equipment, and production operations. To date, 24 companies in the region are already benefitting from a £3.2m share, and a further £2.7 million is set to be awarded in the coming weeks. With up to £1.6 million still available, eligible private sector companies can apply for grant funding from £5,000 up to £500,000. Amongst those companies already making the most of the support from the scheme is Cheshire-based ESL Fuels, which was awarded a grant of £199,200 towards costs associated with creating a hydrocarbon recovery plant at its Stanlow Oil Terminal in Ellesmere Port. A blender and supplier specialising in the manufacture of innovative fuel products, ESL Fuels currently provides a full range of fuels developed specifically for the road, heating, heavy duty haulage and marine markets. It also offers storage and processing solutions. Phillip McEvoy, Terminal Manager, explained: “The Catalyst for Growth

Fund is allowing us to refurbish 15 bulk storage tanks and add a distillation unit and filtration plant so that we can use ‘off spec’ oil from UK refineries to create new fuels. “This type of refining process will enable our business to manufacture fuel at a lower cost, without compromising quality and will help us to use the Stanlow Terminal to its full capacity, providing further opportunity for business growth and development.” Manchester-based Hockley International Ltd has also been awarded a £31,192 grant towards the purchase and implementation of a new Enterprise Resource Planning (ERP) system and the appropriate staff training. Tommy Gill, Director of Commercial Operations, said: “The company has grown significantly over the past few years, now employing 20 people. In order to develop, the company needs to implement an ERP system to help manage efficiency and productivity, safeguarding the business for the future. This funding support has enabled us to bring forward the implementation of this system and continue to grow the business.” Also benefitting from the funding is Knowsley-based UK Renewable Fuels (UKRF) which has received a £287,000 grant towards design and construction of a £1m liquid bio-fuel production plant.

Using a new and innovative process developed by UKRF, this new plant will produce bio-fuel for the commercial heating boiler market. John Neild, Managing Director, was delighted to hear that his application was successful. He said: “Without the funding we would not be able to proceed on this project in the short or medium term. The installation of the new facility will secure the future of the company, and create 14 new jobs over the coming months.” As the scheme continues to process and approve a steady stream of applications, Catalyst for Growth Scheme Manager, Janet Morris, is urging eligible companies to apply for a share of the remaining funding. Bulk solids handling in process plants The key to developing and operating a profitable process has long been recognised as being strongly influenced by the correct assessment of technical risk early in a project. What is surprising to many casual observers is the continual struggle experienced by some industries to maintain a steady and predictable level of process output. A ‘straw’ survey of industries most strongly afflicted by process problems would show that the majority are in sectors that utilise bulk materials (in either powdered or granular form) in their processes. By a somewhat bizarre twist of fate, the elements of the processes that give these problems are well established and can be traced back to the start of the industrial revolution in some cases. In contrast, most innovative ‘process steps’ benefit from new knowledge and can in many cases represent less risk than the established designs of equipment used to feed bulk materials to and from them (and upon which they are wholly dependent for their efficient operation!).

The reasons for this rather strange situation can be traced back to the traditional educational structure used to prepare engineers of many disciplines for industry. Most engineers will have had sufficient exposure to process technologies or fluid handling to ensure that, if presented with a project based around existing concepts, they can at the very least identify where potential problem areas may exist.

Colleague skydives for charity On Sunday the 13th of September Maria Crawford of Perry Process Equipment jumped out of plane at 10,000 feet in a tandem skydive to raise money for the Butterwick Hospice! Maria chose the Butterwick Hospice as they are a local charity that help people living with a life limiting illness, relieving symptoms, enriching patient’s lives and supporting them and their loved ones. The day proved perfect conditions for the jump. Clear blue skies meant Maria had a good view coming down! This was her first ever skydive, but we don’t think it will be her last. Maria said: “It was absolutely awesome. Highly recommend it to anyone and I really fancy doing another one sometime.” Maria raised a fantastic £505 for the Butterwick Hospice.

Mid Cheshire and Manchester Cell have lively discussion on common issues CIA’s Aila Bursnall, Responsible Care Executive, facilitated another meeting of this local group on 10 July at the Heath, Runcorn. Hot topics highlighted some common themes around encouraging near miss reporting, improving safety culture, involving safety representatives, competency assessments and minor injuries. Two companies, who had recently had a Responsible Care Verification visit, noted how valuable the day had been. They found that the use of the Responsible Care Guiding Principles and knowledgeable input from the Peers, gave new perspective and a fresh viewpoint which supplements the feedback from other general audits or inspections completed. Sarah Grindrod, HFL Risk gave an interesting presentation relating to Human Factors, and noted several COMAH site case studies which looked at competence

assurance, stakeholder engagement, accident investigation, safety critical tasks, safety culture and leadership. Regulator feedback was given by Jane Durling, EA /HSE, who updated on the completion of the consultation and likely changes to the regulations for 2015. It was noted to keep in mind the ‘waste’ implications for sites that could affect your COMAH status. Ruth Franklin, HSE, discussed the need to future-proof safety reports and be prepared as best you can for any review visits. Guidance will be available in March 2015, so use the draft regulations until then and keep abreast of bulletins on the HSE website. Aila Bursnall gave some additional

input to regulatory issues including checking your packaging waste is compliant with the hazardous waste regulations when dealing with recovery / disposal/ recycling operations. The risk based approach to water abstraction from rivers must comply with the Eels directive. The Better Regulation Executive (BRE) feedback seminars will follow in October to help communicate what the changes mean in practice for industry. Behavioural Safety – a practical approach Chemical Elements workshop, 18 September 2014, The Heath, Runcorn

This interactive workshop was sponsored by SOG Ltd who also presented a very interesting approach to engaging employees through interactive sessions within the workplace. Their “Deal With It” programme is gaining more and more interest from a wide range of companies across the UK and beyond. A clear process designed to enhance health and safety culture, address the behavioural reasons behind accidents and encourage employees to make pledges to improve. It is a cultural enhancement programme which can be developed on what a company needs, now and into the future. By thinking along the lines of “software of the mind” the programme sets out to deal with formed habits relating to certain hazardous tasks. It doesn’t involve managers only, but aims to involve all staff. Helen Schoelzel, Training Manager at SOG Ltd, explained that workers change behaviours when managers change their behaviour too. Many companies have undertaken culture climate surveys for completion by all employees. Managers have to be brave to deal with culture surveys and their output.

HSE outlines new safety approach HSE Checklist INCENTIVES: How are you incentivising the behaviour you want to change? What psychological rewards will the duty-holder get if they adapt their behaviour? Or what will they lose if they don’t? NORMS: What can you do to convey that the desired behaviour is a norm? Can duty-holders be persuaded to formally commit to a course of action? Does the duty-holder believe our activities are fair and legitimate?

The Health & Safety Executive outlined a new behavioural safety approach named: “INSPECT”, which brings together several prompts that if used effectively in the workplace could help reduce incidents. This is a set of useful ideas that should be used in addition to the other human factors tools currently in place. Looking further into why people do what they do, this approach employs the notion of ‘nudges’ that can be applied in re-enforcing behaviours in a systematic way. Dr Beverley Bishop Principal Research Officer, Economic and Social Analysis Unit and Dr Jennifer Lunt, Principal Health Psychologist at Health & Safety Laboratory also led an interactive session with groups applying the INSPECT elements to common work activities in the chemical

industry. Perhaps you can use the checklist (right) as provided by HSE. A personal experience of worker behavioural performance was shared by Robert Welham, GMB union convenor at Crown Paints Ltd. His career has spanned many years in manufacturing industry and with several specific examples, Bob provided a unique insight into how standards of health and safety have greatly improved over the decades. Bob also outlined how recently working within Chemical Industries Association’s Responsible Care activities, the trades unions are more on board with cultural and behavioural improvements, all with a view to raising standards.

SALIENCE: How can the dutyholder be persuaded that this issue is pertinent to them? Can messages be personalised? Can you use case studies that the duty-holder will identify with? Can you use other means to draw their attention to our message ? PRIMING: Can you make the visible environment one that supports health and safety? Can you test alternative presentations of your guidance, tool or message to see which has the biggest effect? EMOTION: Can you make use of emotional cues, such as people’s reactions to certain words, sights and sensations? CHOICE STRUCTURE: Can you introduce a desirable ‘default’ option? Can you make compliance easy? Can you force the duty-holder to choose? TRUST: Who are the trusted messengers for the people you want to influence? Can messages be delivered through ‘people like me’, those who have credibility with the group, or acknowledged experts? If you need to bring about cultural change, consider who has the social connections, expertise and influence to bring about cultural change.

Derogations from the Industrial Emissions Directive (IED) The Industrial Emissions Directive (IED) has now replaced the IPPC Directive and environmental permits covering new processes should be compliant with it. Changes will have to be made to many permits covering existing processes to bring them in line with the IED’s requirements. One of the areas where this may well be required is in relation to Best Available Techniques (BAT), and in particular emission limits. The IED states clearly that “BAT conclusions shall be the reference for setting the permit conditions” and “The competent authority shall set emission limit values that ensure that, under normal operating conditions, emissions do not exceed the [BAT conclusions] emission levels”. Although it may appear that the EU playing field has been levelled by these provisions, the situation is not quite that straightforward. The obligation on the Environment Agency and other national regulators to follow the relevant BAT Reference Document (BREF)

when writing a permit is not absolute. Regulators can, in specific cases, derogate from the requirement to follow BAT by setting less strict emission limit values. This can only be done where an assessment shows that the achievement of the BAT emission levels would lead to disproportionately higher costs compared to the environmental benefits, due to either the geographical location or the local environmental conditions of the installation concerned or its technical characteristics. Permit holders wishing to take advantage of this derogation provision will need to gather evidence to support negotiations with their regulator when their permit is due for review. They must also be prepared to appeal new permit conditions if the regulator cannot be persuaded that BAT emission limits should be relaxed.

We are aware of certain industrial sectors which are preparing derogation applications, and other operators such as Tata Steel are reported to have already sought to delay desulphurising certain processes. If you are considering seeking a derogation, then early work on the technical audit trail required would be well advised.
