Anglers find naked fugitive in a tree while putting out crab pots By LINDSEY GLASGOW DARWIN, AUSTRALIA —A pair of anglers in search of crabs in a waterway outside of the Australian city of Darwin found a little more than they were searching for when a naked man in a tree clinging to branches called out to them for help. According to several news sources, Cam Faust and Kevin Joiner were laying crab traps on Jan. 3 in a creek known to have a lot of crocodiles when they discovered the naked man covered in cuts calling for help in the mangroves. The swamps around Darwin have been labelled ‘crocodile heaven’ because of the murky water and poor light. Giant saltwater crocs also breed and lay eggs there. The two friends told The Daily Mail they were hesitant to stop and help the man due to his strange appearance but ultimately pulled up in their boat to assist. Joiner and Faust told news outlets the man told them he had been there for four days and had been living on snails. The anglers told news outlets they tried to figure out why the man was naked and how he ended up there but said he was

talking gibberish. The men loaned the rescuee a pair of shorts and the trio shared a beer as they brought him back to shore. They then called an ambulance and he was taken to a hospital. As it turned out, the man was Luke Voskresensky, who was wanted by authorities for allegedly breaching bail over an armed robbery. Voskresensky had allegedly been on the run for days after allegedly cutting his ankle bracelet and evading police. The NT News reported the man was placed into custody at the hospital.

Anaheim Landing: From Port to Housing to Naval Base By LINDSEY GLASGOW SE AL BE ACH —Soon after the
founding of Anaheim in 1857, the Anaheim Landing Company established Anaheim Landing, in what is now Seal Beach, as a port for the Santa Ana Valley. A warehouse and wharf were built on the small bay where Anaheim Creek emptied into the Pacific Ocean. Despite treacherous entrance conditions that caused several disasters, regular coastwise trade was carried on here for about 15 years. For a few years, Anaheim Landing came close to rivaling San Pedro for its volume of shipping, but the arrival of the railroad in Anaheim in 1875 made it easier to ship product via the rails than by hauling a wagon overland across 12 miles of soft soil to the Landing. Around the same, the beaches and surrounding Anaheim Landing had become a popular getaway
on hot summer days. Los Angeles newspapers talk of a permanent summer population of as many as 400 and even more on special days. In 1915, the area now known as Seal Beach was incorporated as Bay City. The town made its official debut with a population of 250 on October 25, 1915, during a night full of music, food and fireworks, according to orangecounty.net. The city’s highlights included a roller coaster, which burned in the late 1920s; the Jewel Cafe, site of the town’s inaugural celebration; and a dance pavilion next to the pier. During World War II, homes at Anaheim Landing in the city gave way to a US Navy ammunition and submarine net depot, which is now known as Naval Weapons Station Seal Beach. “A naheim Bay and A naheim Landing a beach colony which boomed three decades ago and- began a firmer wave of popularity in the last five years— will be the site of a $20,000,000
naval ordnance depot,” an article from the January 13, 1944 San Pedro News Pilot stated. “Bridges will be ripped down, 200 homes will be razed, the channel will be dredged to a 15-foot depth and the federal government will acquire 3500 acres of land by negotiation and condemnation.” The article went on to say all private structures east of Anaheim Bay to a point beyond Surfside Colony would be taken over by the government, noting most of the homes were 30 years old, dating back from Anaheim Landing’s early heyday. The navy has shared the waters in Anaheim Bay with civilian boats since Huntington Harbour was developed in the 1960s. Civilian boats pass through the Navy’s jurisdiction while entering and exiting the harbor. The site of Anaheim Landing is now registered as a California Historical Landmark.

news briefs WORLD/NATION NMMA announces additional changes to 2021 boat show schedule CHICAGO—After a thorough market-by-market evaluation of its boat shows still on the schedule for the first quarter of 2021, the National Marine Manufacturers Association announced it is canceling this year’s Progressive Insurance New England Boat Show and Progressive Insurance
Northwest Sportshow. NMMA has also postponed the Progressive Insurance Atlantic City Boat Show to April 7-11, 2021, which was originally scheduled Feb. 24-28. In the fall of 2020, NMMA had announced the cancelation of nine of its other boat shows scheduled for the first quarter of 2021, driven by the trajectory of the covid-19 pandemic. “These decisions are the result of continued conversations with exhibitors, health

Boats on Jan. 14 announced it had made Mercury Marine its exclusive supplier of outboard and sterndrive marine engines and related power products beginning with the 2022 model year. “We will pair our expertise in new-product design with Mercury’s expertise in propulsion systems and integrated parts-and-service platforms,” Vice President and General Manager of Crownline Boats Kevin Riem said in a released statement. “We are very excited about this strategic partnership and firmly believe it will result in enhanced product quality and better overall service experiences for consumers after the sale.” Crownline, a builder of recreational boats since 1990 in West Frankfort, Illinois, currently produces 34 models: eight wakesurf models, 12 sterndrive models in the 20- to 30-foot range, 11 outboard models in the 20- to 30-foot range, and three cabin cruisers in the 26- to 35-foot range.The company also recently launched four new models of center console fishing boats. CHICAGO—The National Marine Manufacturers Association reported that retail unit sales of new powerboats in the U.S. hit a 13-year high in 2020. NMMA reported sales in 2020 increased by an estimated 12 percent compared to 2019. More than 310,000 new powerboats were sold in 2020, levels the recreational boating industry has not seen since before the Great Recession in 2008, according to NMMA. “2020 was an extraordinary year for new powerboat sales as more Americans took to the water to escape pandemic stress and enjoy the outdoors safely,” NMMA president Frank Hugelmeyer said in a released statement. “For the first time in more than a decade, we saw an increase in first-time boat buyers, who helped spur growth of versatile, smaller boats – less than 26 feet – that are often towed to local waterways and provide a variety of boating experiences, from fishing to watersports.” Sales of personal watercraft, including Jet Ski, Sea Doo and WaveRunner; sales of wake boats; and sales of freshwater fishing boats and pontoons boats, drove record retail unit sales in 2020, according to NMMA. NMMA expects boat sales to remain at historic levels in 2021 as manufacturers continue to fill a backlog of orders from 2020. Pandemic-related supply chain constraints curbed powerboat production and shipments for several months in 2020, which are expected to subside and restore marine manufacturing to normal levels this year. “We expect consumer interest in boating to remain strong through 2021 and
beyond, with millions of Americans discovering the mental health benefits and joys of being outside and on the water,” Hugelmeyer said.

Last month I was returning home on my boat from a weekend at Catalina Island when I responded to a call from a disabled boat halfway between Catalina and the mainland. They apparently had engine problems and needed help since they were not members of an assistance towing program. We agreed to tow them home since we happened to keep our boats in the same marina. As we approached them to hand off a tow line, we were caught by a swell and crashed into them. Both boats suffered some minor damage but nobody was hurt. The line was eventually secured and we towed them home without further incident. They thanked us for our help, and since it appeared that neither boat was significantly damaged by the collision, I assumed that would be the end of it. Unfortunately, I received a letter from his lawyer yesterday demanding that we pay to repair the damage to his client’s boat. This raises all kinds of questions, but it all seems pretty unfair since I was the “good Samaritan” who rendered assistance. Should I have just ignored his request for assistance? What are my legal rights?
ANSWER: Before we look at our reader’s legal rights, I will first advise that he should immediately submit a claim to his insurance company. Insurance claims should always be submitted promptly, even if there is some question about who is at fault. The insurance company is much better equipped than a boat owner to hire experts to fight about who was at fault. And a claim may be denied if it is not submitted in a timely matter. As for the legal requirements, on dry land we generally have no duty to assist a person in distress. The law simply requires that if you choose to render assistance, you do so without acting negligently. Our obligations on the water are different. requires the master of any vessel subject to U.S. jurisdiction to “render assistance to any individual found at sea in danger of being lost,” so long as the assistance can be rendered without endangering the rescuing vessel or individuals on board. This law is a part of an international treaty (the International Convention on Salvage, 1989) which extends the obligation to mariners throughout the world. The statute includes criminal penalties that may include jail time for failing to render assistance. This federal statute may not apply to our reader’s case since it does not appear that the boat he was assisting was “in danger of being lost” at the time. But the statute does not provide any guidance for determining whether a boat is facing this kind of danger. Leaving aside the question of whether the disabled boat was in immediate peril and whether our reader was therefore legally required to render assistance, his good faith efforts to help the stranded boat should be protected under both state and federal law. Federal law (46 U.S. Code sec. 2303) provides that an individual who gratuitously and in good faith renders assistance at the scene of a marine casualty is not liable for damages as a result of rendering assistance, assuming that he or she acted prudently, and assuming also that the person needing help did not object to the assistance as it was being rendered. California has a similar maritime assistance statute (Harbors and Navigation Code sec. 656) with essentially the same language. Based upon the state and federal statutes described above, the demands made against our reader would need to include a claim that he failed to act prudently when he rendered assistance to the disabled boat. A failure to act prudently means that a person acted negligently, and this starts to look a lot like the law as it relates to rendering assistance on dry land. We could spend a couple semesters in law school discussing negligence, but for our purposes, we will simply say that negligence is rarely a “black and white” analysis. In most cases a court will end up allocating fault between the parties on a percentage basis. All of which explains why boaters who are facing this type of dispute should promptly submit a claim to their insurance company, followed by a phone call to an experienced maritime attorney.

Newport Beach Harbor Commission forms ad-hoc committee to study floats on private docks and piers WHAT HAPPENED: An appeal hearing for a violation issued for a dock structure that exceeded the permissible length stated in the permit was held at the Dec. 9 Newport Beach Harbor Commission meeting. The appellant told the
Commission he documented about 360 similar infractions from other permittees and shared a slideshow featuring photographs of illegal floats attached to private docks similar to his. The hearing turned into a broader discussion about illegal float extensions in the harbor, ending with the commissioners suggesting a committee be formed to address the issue and possibly come up with a new policy.
WHAT’S ON TAP: At the Jan. 13 Newport
Beach Harbor Commission meeting, the Commission established an ad-hoc committee to study floats on private docks and piers. Commissioner Marie Marston was appointed to head the committee. Commissioner Don Yahn was also appointed to the committee. The subcommittee will research and evaluate the issue and return to the full Harbor Commission with any recommendations.

between the ocean and Huntington Harbour have a new route to follow, which will separate them from Naval vessel traffic and provide a more direct route. The Naval Weapons Station Seal Beach opened a new small craft channel in Anaheim Bay on Jan. 21. The new channel separates Navy traffic from civilian boat traffic. The old channel previously shared by the two is now closed to the public but work on armoring the sides of the new channel will continue for several more months. Naval Weapons Station Seal Beach Public Affairs Officer Gregg Smith said the new small craft channel will allow civilian vessels transiting between the ocean and Huntington Harbour to do so in a safer and more efficient route. “There’s been a longstanding concern on part of the Navy that it’s not optimal to NAVAL have civilian small boats transiting right WEAPONS 1 STATION next to a location where Navy ships are SEAL BEACH operating,” SmithNT’L said. The old channel will become part of the Naval Weapons Station Seal Beach restricted area and is now serving as a construction zone for this next phase of the overall project. “We wanted to ensure that civilian boats always had access to Huntington Harbour so we built the small craft channel first and then we’ll be doing other parts of the project in the coming months and years,” Smith said.

Restaurant, a fixture on the Port of Los Angeles waterfront and remnant of the Ports O’ Call Village, has announced it will be expanding to a new location within the port. “For decades this community has clamored for attractions that celebrate our history, provide us with a place to gather and attract the world,” San Pedro Fish Market & Restaurant CEO Mike Ungaro said in a released statement. “Thanks to the support and vision of so many our plans are coming together quickly to do just that.” San Pedro Fish Market & Restaurant, which is currently located in the old Ports O’ Call Village, has plans for a new facility along the main Port channel adjacent to the World Cruise Center. Company officials said the new location will allow the restaurant to double its waterfront seating capacity, add additional parking and will also include iconic attractions that celebrate the rich history of the community. Company officials went on to say they will work cooperatively with area businesses to continue the renaissance of the Port waterfront. “Given our continued growth and commitment to safely serve the Port communities and our guests during the emergency orders, our team in coordination

The design and development team for the new location includes companies that have helped complete projects globally for clients including Disney, Cheesecake Factory, Universal Studios, BJ’s Pizzeria, and dozens of other global brands. San Pedro Fish Market has been part of the Port of Los Angeles waterfront for more than 60 years. Its current location is encompassed in the Port of Los Angeles’s LA Waterfront redevelopment, which consists of a series of development and community enhancement projects blanketing more than 400 acres of existing Port of Los Angeles property in the harbor communities of San Pedro and Wilmington. The Port District hopes the project will help transform the waterfront area into a visitor-serving destination which embraces the existing authentic character of the Port of LA as a working waterfront and bustling industrial port. The San Pedro Public Market project is center of those plans. The San Pedro Public Market project will cover 42 acres, along the west side of the Los Angeles Harbor Main Channel and will replace the former Ports O’ Call Village, which was once home to a marina and several restaurants, nearly all of which were torn down in recent years. San Pedro Fish Market is one of the only remaining businesses in the old Ports O’ Call Village. The Log reached out for more information about the restaurant’s new location. The Log was told by ACE Agency, a public relations and marketing firm, more information would be available when the renderings are available to share and discuss, which is expected in February.

The act was introduced by Senator Dianne Feinstein and Representatives Salud Carbajal and Julia Brownley after the deadly Conception dive boat fire off the coast of Santa Barbara. The Conception, a 75-foot commercial vessel based at Santa Barbara Harbor, was anchored in Platts Harbor off Santa Cruz Island when it caught fire in the early morning hours of Sept. 2, 2019. One crew member and 33 passengers who were asleep below deck at the time of the fire died. The Small Passenger Vessel Safety Act of 2019 was later rolled in the National Defense Authorization Act for Fiscal Year 2021, which authorizes $740.5 billion for national defense spending and

President Trump vetoed the National Defense Authorization Act in December but Congress overturned the veto, with both the House and Senate voting in favor of the override on Dec. 28 and Jan. 1, respectively. The Small Passenger Vessel Safety Act of 2019 directs the Coast Guard to implement safety reforms to small passenger vessels to prevent a similar disaster in the future. The Coast Guard will be required to prescribe additional regulations to secure the safety of individuals and property on board certain small passenger vessels including the addition of interconnected fire detection in all areas to which passengers have access, including dining areas, sleeping quarters, and lounges. The law also requires vessels to have no less than two avenues of escape to different parts of the boat. It also includes requirements for marine firefighting training programs to improve crew member training and pro-
ficiency; and mandates safety standards for the handling, storage, and operation of flammable items, such as lithium-ion batteries. “The Conception boat fire was a tragedy that could have been prevented had stronger safety measures been in place,” Senator Feinstein said in a released statement when the bill was first introduced in December 2019. “We must ensure that small passenger vessels have the right safety measures in place to prevent disasters at sea. This bill addresses the specific conditions that are being investigated as causes of the Conception fire, conditions that exist on hundreds of similar vessels in operation today.” A National Transportation Safety Board investigation into the fire, released after the bill was first introduced, found a lack of U.S. Coast Guard regulations for smoke detection in all accommodation spaces in small vessels with overnight accommodations and the configuration of exits from the bunkroom contributed to the fire and its deadliness.

the nation’s busiest container port, moved 9.2 million Twenty-Foot Equivalent Units (TEUs) in 2020, Port of Los Angeles Executive Director Gene Seroka announced at the Pacific Merchant Shipping Association’s sixth annual State of the Port of Los Angeles – a virtual event this year. A late-year surge of pandemic-induced consumer spending helped boost volumes to near 2019 levels, making 2020 the fourth highest-volume year in the Port’s history. “Our container business in 2020 was the most erratic we have ever seen, with volumes plunging nearly 19% in the first five months of the year, followed by an unprecedented second-half surge,” Seroka said. “Our ILWU longshore workforce did a great job adapting to the huge swings in volume, as did port truckers and everyone else involved in moving

Newport Beach staff propose changes to several Harbor Department service fees Recommended changes include a flat fee for harbor appeals and five new fees, including a large boat escort fee. By LINDSEY GLASGOW NE W P O R T BE AC H —Newport Beach staff has proposed several changes to the fees charged by the Harbor Department for various services. Staff gave a presentation on the proposed changes to the Harbor Commission at its Jan. 13 meeting. The fees were recently studied as part of regular efforts to ensure the proper recovery for cost of service, according to a staff report. Staff recommended increasing 17 fees, decreasing three fees, and introducing five new fees. The changes recommended by staff included making the harbor appeal fee a flat fee, which would in most cases decrease the cost. Appellants would be charged $1,250 for any appeal of a decision to the Harbor Commission and another flat appeal fee of $940 for a decision to the City Council. Staff also recommended not charging an appellant if they are successful in their appeal. Other proposed modifications included changing the Raft Up Permit fee to the same as Harbor Special Events – Simple fee in order expand permit approvals to include events such as boat races. That fee would be $95. In response to the recent changes to title 17 dealing with Marine Activities Permits (MAP), which now includes four different application options, staff recommended splitting the MAP – Initial fee into two categories based on the amount of staff time needed to review those permits. One fee would be charged for the review of service provider applicants such as boat cleaners, fuel delivery, maintenance and repair and anoth-
er fee would be charged for the review of charter, boat rentals, and human-powered rental applicants. Staff also recommended adding five new fees: Environmental Response fee: a fee would be charged when a boater experiences mechanical or vessel system failure that results in hazardous materials being introduced into the harbor, necessitating staff to contain the hazardous material and a contractor to clean it. Harbor Special Events – Complex fee: $491 would be charged for large scale harbor events requiring assignment of Harbor Department resources during the planning and execution of the activity. Large Boat Permit (80+ LF), Requiring Interagency Coordination fee: $736 would be applied when a large motor yacht or vessel requests temporary mooring permits within the harbor, where coordination with the owners’ representatives, the United States Coast Guard, and/or third-party service providers is required. Large Boat Escort (per escort) fee: a flat fee of $102 would be charged when Harbor Department vessels are required to provide escort services to large vessels entering or departing the Harbor. Multiple Vessel Mooring System Application fee: a flat fee of $503 would be charged applied to permittees requesting consideration for the installation of approved float systems on a permitted offshore mooring. Decreased fees would include key card replacement, which would decrease from $23 to $12, and a lost/broken line, which would decrease from $104 to $60. The Harbor Commission asked a few questions before filing the report. Staff said they hope to bring these recommended updates to the service fees before the finance committee in February and then City Council. The fees will need to the approval of City Council to be applied. If approved, the changes would take effect July 1, 2021.

would not be pushed out. “I’m very concerned about the fate of this parcel, it is one of the few marine commercial parcels in Marina del Rey,” Lumian said at the Jan. 13 meeting. “It is very important to the boating community, in particular the businesses that support the boating community.” Ross assured the Commission their focus would be serving the tenants at the property, the boaters at the property and the boating community. “In terms of the long-term marina and anchorage uses at the property, we’re committed to that, that goes without saying there will be continued anchorage and marina uses here on the property,” Ross said. The commissioners also raised concerns that Caruso Management Company has never operated a marina before. Ross said they have hired experts from Catalina Yacht Anchorage and other marina experts to assist. “We’re in the hospitality business and that’s how we view this, we’re going to add the experts that are needed specially for marina uses but serving the boating community is our number one objective,” Ross said. The Commission ultimately voted to provide their support to the assignment of the lease to CAH Marina I, LLC. The matter will now go before the LA County Board of Supervisors, which will have the final say.

Under the terms of the lease, the lessee is required to obtain the county’s consent to the proposed assignment of the lease. DHB said staff and county counsel have reviewed the lease amendment and proposed assignment and have determined that the county has no reasonable basis on which to withhold its consent. Prior to going before the Los Angeles County Board of Supervisors for approval, it was discussed at the DHB Small Craft Harbor Commission meeting on Jan. 13. Bryce Ross, Senior Vice President of Development & Acquisitions for Caruso, told the commissioners at the Jan. 13 meeting they will maintain the area as marine-serving and will engage the boating community in any planning. “We have no immediate plans, our plan is to get to know the community and learn what’s important to the boaters here,” Ross said at the Jan. 13 meeting. would be a good idea to evaluate them from an open book perspective and to see if any enhancements can be made while we’re going through the effort of permitting and getting these floats rebuilt,” Miller went on to say. Some of those improvements could include making the piles inboard of the floats as opposed to outboard of the floats to prevent damage and scratches to dinghies and boats and to add additional dingy parking. Commissioner Cunningham noted the dingy parking at the public piers is most used by the offshore moorings and due to inadequate dingy parking, the city in recent years discounted mooring rates. “When we reviewed these docks over the last couple of months one of the things we were sensitive to was additional dingy parking throughout the public dock areas,” Cunningham said at the meeting. Commissioners provided positive feedback to the presented initial conceptual ideas for improvement. “I think Mr. Miller you have certainly the support of this group keep going forward, I think you also have to consider having public input,” Chair Kenney said. Miller said staff would further refine the conceptual concepts as well as look at some of the feasibility aspects and then reach out to the public in the coming the months.

Catalina Island Shrew spotted for first time in 15 years By LINDSEY GLASGOW AVALON—For the first time since
2004, researchers have observed a live Catalina Island Shrew, a small mammal that weighs the same as about four paperclips. The Catalina Island Shrew was listed as a Species of Special Concern in 1996 by the California Department of Fish and Wildlife. Conservancy Wildlife Biologist Emily Hamblen said three other major research efforts have attempted to document the endemic species since 2016 to no avail, despite more than 200,000 photos reviewed and 1,500 camera trap nights. “We have been looking for the Catalina Island Shrew for years,” Hamblen said in a released statement. “I thought, and really hoped, that they still existed somewhere on the Island. Animals are incredibly resilient, and it is amazing to see that they are still here.” Conservancy biologists found the shrew during an extensive remote camera research effort that took place between February and May 2020. The Conservancy deployed and rotated seven remote camera traps specifically to detect small mammals at 28 locations. The cameras were purchased in 2016 thanks to a donation from the Harold McAlister Charitable Foundation. The remote cameras were placed pointing down inside up-
side-down 5-gallon buckets. Bait was placed in the center of the buckets, with four small entrances cut into the trap. More than 83,000 photos were collected through about 12 weeks of trapping. To date, only a few thousand photos have been reviewed. An adult shrew measures approximately 3.74 inches, including their tail, which makes up about a third of their total length, and weighs just 3.96 grams, equal to about four paperclips. The shrew’s high metabolism means that the insectivores can only survive between five and 23 hours without feeding. “This makes them challenging to capture safely because they need to eat so frequently,” Hamblen said in a released statement. “Remote camera traps are a noninvasive survey method allowing us to collect data without disturbing the animal.” Now that the shrew has been spotted once again, the Conservancy plans to continue efforts to encourage their survival. “Our next step is to figure out the island-wide distribution and if they seem to prefer specific habitats, based on the locations where they have been observed,” said Hamblen. “Then, we can work to promote the health of those types of habitats and reduce risks to their survival.” For more information about Catalina Island Conservancy’s conservation programs, visit CatalinaConservancy.org.

REDONDO BEACH HARBOR COMMISSION RECOMMENDS HIBERNATING SOME MOORINGS INSTEAD OF REMOVING The city began discussing removing some of the moorings from the field of 25 during the Fiscal Year 2020/21 budget process after numbers showed they were underutilized and cost more to maintain than the amount of revenue they generated. By LINDSEY GLASGOW B E A C H —T h e Redondo Beach Harbor Commission has unanimously supported a staff recommendation not to remove any of the 25 transient vessel moorings in the main harbor channel, but instead hibernate some of the moorings to reduce maintenance costs. In June 2020, the City Council directed staff to investigate the feasibility and potential cost savings of removing some of the moorings. Staff presented their findings to the Harbor Commission at its Jan. 11 meeting and will now present their recommendation to the City Council for a final decision. “When we look at the numbers, we don’t see a real big cost savings [of removing the moorings] if we can reduce our maintenance expenses,” Waterfront Director Stephen Proud said at the Jan. 11 meeting. According to numbers from Leonardo Management, the property management company which oversees the moorings, in 2018, 3.7 percent of the available mooring days were used and in 2019,

7.4 percent of the available mooring days were used. Total revenues collected for mooring rentals in 2018 were $9,036, $17,556 in 2019 and $18,618 in 2020 through November. The current cost to maintain the moorings through an outside contract is roughly $60,000 per year. The moorings were installed in the harbor in 2014, partly funded by a grant from California Department of Boating and Waterways (DBW), which required the mooring field to be in place for 20 years. Since the installation of the moorings was partly funded by a DBW grant, approval from DBW would be needed to remove any of the 25 units. City staff initially contacted DBW in June 2020 to discuss the feasibility of removing moorings as a cost cutting measure. DBW responded in October 2020 and indicated that they would allow some or all of the moorings to be removed. However, removal of the moorings would require the city to refund a prorated amount of grant funding based on the portion of the 20-year grant period the moorings were not in place. There is approximately 14 years left on the grant term and staff determined if the city were to remove all 25 moorings, they would need to reimburse DBW $129,000. Staff said there would also be an additional cost for the work of physically removing the moorings. Staff did not present costs for removing only some of the moorings. Staff also evaluated alternatives and found they could reduce the cost of maintaining the moorings by $30,000 by making some of the moorings disabled. Some of the mooring lines would be dropped to the bottom and rendered unusable. “We will keep our regular-
ly quarterly scheduled cleanings for the remaining 10 or 12 or whatever we decide on,” Leonardo Marina Management Property Manager Craig Stanton said at the Jan. 11 Harbor Commission meeting. “The rest of the annual mooring underwater inspections will still be included in that $30,000 price and we’ll also keep an eye on the ones that are disabled just to make sure they’re not getting heavy growth.” Staff calculated that at an annual maintenance rate of $30,000, offset by projected revenues, it would cost $154,000 over 14 years to keep the moorings in place with some periodically idle. “From our perspective as staff, we don’t particularly think that it’s a worthwhile endeavor for us to take a public amenity that’s within the harbor, and for what really amounts to at this point a $10,000 a year subsidy, if we can reduce that maintenance contract by $30,000 a year,” Proud said. The commission seemed to agree they did not want to pay back grant funds to DBW if there were other ways to keep the moorings and save costs. “I am completely comfortable hibernating whatever moorings is deemed prudent but keeping the entire mooring field alive and well,” Commissioner Matt Kilroy said at the Jan. 11 meeting. Kilroy made a motion to recommend the City Council not remove any moorings permanently and to let staff determine how many moorings to hibernate in any given quarter to reduce maintenance expenses. It was unanimously supported by the commission. Proud said they would incorporate their recommendation in their upcoming presentation to the City Council.

BRITTANY LOUST SERVES AS FIRST FEMALE CAPTAIN OF OCEAN INSTITUTE’S ‘SEA EXPLORER’ Loust started at Ocean Institute in January 2008 as a science instructor and after being mentored by the captains of the Research Vessel Sea Explorer, she was inspired to get her own U.S. Coast Guard Master 100 Gross Tons License. By LINDSEY GLASGOW DANA POINT—Brittany Loust has seen a pod of orcas, many whales, dolphins and other marine life out on the ocean in her life-long career in marine science. She said those sightings are just the icing on the cake in her job at the Ocean Institute in Dana Point working on the Research Vessel Sea Explorer (RVSE), now as the first female captain. The cake, she said, is watching young children come aboard the vessel a little nervous but disembark comparing the trip to Disney Land. “You get those comments and I think that’s such a rewarding experience,” Loust said. Loust, who has worked for Ocean Institute for 13 years, recently became the first female captain of Sea Explorer, which is used by the ocean education organization for whale watching tours, kids programs, school programs and more. RVSE serves as a sort of floating science lab, with the educational trips including collecting and looking at plankton samples and collecting and sorting through mud grabs for invertebrates and other critters. Loust said it’s humbling, exciting and a little terrifying to be the first female captain in RVSE’s roughly 25-year history. “We’ve done so much here at the Ocean Institute for women in science,” Loust said. That includes an annual conference for middle and high school girls called Girls
in Ocean Science, which aims to connect influential, female scientists with the next generation of ocean ambassadors. “It’ll be cool to have a female captain when we take all these young girls out on the boat,” Loust said, going on to say she felt honored that person would be her. Loust said she knew in the fifth grade she wanted to study marine biology. She grew up in Dana Point and went on to get a degree in marine science from University of Hawaii before returning to the area. She started at Ocean Institute as a science instructor and a few years later became a Floating Lab Scientist on RVSE, serving as the lead deckhand to the captain and running the programs on board. She said when she first started working on the vessel, besides the captains, a majority of the crew were female. “It was all kind of inspiring,” Loust said. She then moved to a program coordinator role before deciding to get a U.S. Coast Guard Master 100 Gross Tons License around January of last year. Loust said she was inspired by other captains of the vessel and encouraged that she could do it by her husband, who also got his captain’s license. She said one of her longterm goals is to run a boat with her husband offering ecologically-friendly fishing and scientific trips. “Knowing that I can do it and having people kind of push me and inspire me to reach for that goal,” Loust said. She said she was particularly inspired by the head captain’s passion for the mission of Ocean Institute, which is to use the ocean as a classroom and inspire children to learn. “For me, coming from a science background, I really appreciated putting a little more effort into it than just here’s a whale and this is cool, but really giving people a little more of that experience and that educational part of it,” Loust said. RVSE has been docked for the past several months due to state and county regulations related to the coronavirus. Once given the greenlight to resume operations, Loust will take her first trip as captain.

Sharon Green to share multimedia experience from career photographing sailing events By LINDSEY GLASGOW SANTA BARBARA —Performance sailing
photographer Sharon Green will transport viewers out on the water in a virtual multimedia presentation that might have viewers feeling the spray of water in their faces. Green will share highlights from her career photographing performance
sailing during a virtual event hosted by the Santa Barbara Maritime Museum. The event will be held via zoom on Feb. 18 at 7 p.m. “My greatest satisfaction is when it all comes together: the anticipation, planning, organizing, traveling and epic conditions that combine to create a thrilling photograph,” Green said in a released statement. “The pursuit of Ultimate Sailing images never seems to grow old.” Green has been photographing competitive sailing for more than 35 years. She has photographed many events including the 2020 Melges IC37 Lauderdale Cup, 2020 Melges IC37 National Championships, 2019 Rolex Big Boat Series, 2019 Viper 640 World Championship, 2019 Tanspac – Selects and many more. She said she is happiest when she is on the water or hanging from a helicopter in search of the elusive image that can be called Ultimate Sailing. “Sailing is a magnificent, colorful and
dramatic sport,” Green said in a released statement. “This unique sport has many variables with the constantly changing elements, sea conditions, boats, events, competitors, and locations. The challenge is to capture on film electrifying moments that take your breath away. Those moments and opportunities are very few, but when they happen…it is ‘Ultimate Sailing.’” Green also produces an annual Ultimate Sailing Calendar, featuring the highlights of competitive sailing, and has been published in major boating publications, both locally and internationally. Green was awarded an honorary master’s degree from the Brooks Institute in Santa Barbara, where she currently lives. Green’s work can be viewed online at ultimatesailing.com/. Classes include one design fleets, handicapped race boats, predicted log racers and, more recently, remote controlled model yachts. Races are hosted by SCYA member yacht clubs from San Diego to Morro Bay extending to Phoenix, Las Vegas and Ensenada, Mexico. The event is touted as
the nation’s largest sailing competition. “SCYA has every intention of resuming the multi-weekend SCYA Midwinter Regatta on Saturday-Sunday, February 12-13 and 19-20, 2022,” SCYA said in a released statement. This will be the first time in years the Midwinter Regatta will not be held. The races were cancelled as part of the Civil Defense black-out during World War II. US Sailing announced the creation of a new series featuring Olympic-class regattas to be held at sailing venues in Florida and California in 2021. The West Marine US Open Sailing Series will offer an increase in high-quality Olympic-class racing for U.S. athletes with a long-term goal of attracting top-level international competitors to race in these regattas for years to come. The series includes regattas in San Diego, to be held June 11 through 13, and Long Beach, to be held July 9 through 11. San Diego has been hosting Olympic-class and other one design regattas similar to this series since 2018. “This event is four years old now and the evolution of the regatta is evidence of our commitment to competitive one design racing,” San Diego Yacht Club Waterfront Director Jeff Johnson said in a released statement. “With the 2028 Olympic Games
in Los Angeles on the horizon, establishing a path of well-run events on the West Coast that can accommodate the needs of campaigning Olympic-class sailors, as well as translate their drive into a positive net for the local sailing fleets and communities, would be a huge win for everyone.” US Sailing said this series will become an important part of the training plans for young sailors participating as part of the Olympic Development Program (ODP), a US Sailing initiative supported by the AmericaOne Foundation that provides world-class coaching support to promising American youth sailors competing in high-performance classes. “This series is a real game changer for Olympic-class sailing in the U.S.,” US Sailing Olympic Development Director Leandro Spina said in a released statement. “The U.S. really needs an Olympic sailing platform like this, so prospective athletes at every level can race and train right here in the United States. Registration opens for California Offshore Race Week

Hosted by Encinal Yacht Club, Monterey Peninsula Yacht Club, Santa Barbara Yacht Club and San Diego Yacht Club, CA Offshore Race Week encompasses four races held between May 29 and June 5. The week kicks off with the Spinnaker Cup May 29-30. Sailing teams will race from San Francisco to Monterey. The Coastal Cup will follow May 31June 1. The Coastal Cup starts in Monterey and finishes in Santa Barbara. Leg three is the SoCal 300, a race from Santa Barbara to San Diego, held June 3-5. The yacht club announced on Jan. 13 the event was being moved from May to September due to
the status of the covid-19 pandemic and recovery. The last Congressional Cup was held in April of 2019. The 2020 event was canceled due to the coronavirus. “We look forward to celebrating a return to the glory of Congressional Cup racing,” Congressional Cup Chairman Chris Macy said in a released statement. Organizers plan to follow the traditional program with the world’s top-ranked skippers from around the globe competing for the iconic grand silver trophy and Crimson Blazer. The revised schedule will commence with the Ficker Cup qualifier Sept. 10 to 12, to determine the final two entries to Congressio-
nal Cup. On Sept. 15, the premier-level match racing returns to the waters off Belmont Veterans Memorial Pier for five days, culminating with finals on Sept. 19. Racing commences at roughly noon each day and is held in a fleet of identical 37foot Catalina keelboats. Ian Williams was the last to win the iconic Crimson Blazer and hoist the trophy. In the 2019 event, he scrambled up the leaderboard through an international field of top-ranked skippers after a slow start, claiming his fourth Congressional Cup title. An official World Championship event of the World Match Racing Tour and a Grade One competition, the Congressional Cup has been hosted by Long Beach Yacht Club since 1965 and is known as the ‘grandfather of match racing’ and pioneer of on-the-water umpiring that is the standard in yacht racing today. COMMERCIAL FISHERMEN REACH PRICE AGREEMENT FOR DUNGENESS CRAB WITH WHOLESALE BUYERS The Dungeness crab season was delayed until December 23, 2020 due to the risk of whale entanglements and further delayed as fishermen negotiated prices with wholesale buyers.
By LINDSEY GLASGOW SAN FRANCISCO —There was no fresh, locally caught Dungeness crab for Christmas or New Year’s after a delay in the start to the season due to dangers of whale entanglements and then a price dispute between Northern California fishing fleets and wholesale buyers. California Department of Fish and
Wildlife (CDFW) delayed the start of the Dungeness crab season for more than five weeks to protect migrating whales that were clustered in the fishing grounds, risking entanglement. The season opened statewide on Dec. 23 but it was a few more weeks before fishermen ventured out as Northern California fishing fleets negotiated prices with wholesale buyers. The Half Moon Bay Seafood Marketing Association (HMBSMA), a non-profit organization run by fishermen, announced local fishermen hit the water on Jan. 11, nearly two months after the traditional Nov. 15 start of the season. HMBSMA said a price agreement was negotiated on Jan. 8. “It has taken an extraordinary level of communication and unity among a traditionally diverse fleet to wait so long to fish, and then to self regulate a starting date and a pre-soak under a ‘gentleman’s agreement’, but that is exactly what is happening,” HMBSMA wrote on its website. “The agreement for a safe start process was reached between fishermen in Bodega Bay, San Francisco, Half Moon Bay, Vallejo, Santa Cruz, Moss Landing and Monterey on 12/29/20 to mitigate at least some uncertainty and to provide a safer start for the whole fleet. When a price was agreed to on 01/08/21 the process in the agreement was enacted and this has resulted in the scheduled set time of 8 am on 1/11/21 at 8 am.” Since 2015, there have been delays in all but one commercial Dungeness season. Domoic acid, which could sicken anyone who eats crab tainted with the toxin, destroyed Northern California’s 2015-2016 commercial season and created delays in other years. In 2018, recreational crabbers had to postpone their fishing, but the commercial season began without a hitch. In 2019, as with 2020, the fishing line danger to whales resulted in a crabbing delay of several weeks.

WINTERTIME FISHING REMAINS GOOD By Bob Vanian of 976Bite.com
SAN DIEGO—The cold water winter fishing season has finally set in but that does not
mean the fishing has been slow. The best overall fishing has been for boats traveling down the Mexican coast on 1.5 and 1.75 day trips to fish the waters off Punta Colnett. The fishing off Punta Colnett has been producing very good mixed bag bottom fishing for reds, rockfish and lingcod and has also been providing a chance at finding some surface fishing fun from yellowtail and bonito. A recent fish 1.5 day trip aboard Pacific Queen out of Fisherman’s Landing to Punta Colnett had 33 anglers catch 141 rockfish, 114 reds, 13 lingcod and 19 yellowtail. H&M Landing had Ocean Odyssey fishing a 1.75 day trip with 28 anglers catch 250 rockfish, 150 reds, 18 bonito and 2 yellowtail. Most of the yellowtail being caught off Punta Colnett have been quality sized fish that are in the 15-to-25-pound class. Punta Colnett yellowtail often bite best from stopping on meter marks and sonar marks and fishing with yo-yo iron or with sardines that are fished on dropper loop rigs. In more local offshore waters, there has not been much recent news on deep drop fishing for swordfish but during the first week or so of the new year there was a bit of deep drop swordfish fishing activity reported by boats fishing between the 178 Spot and Oceanside as well as at the Avalon Bank and the 152 Spot off the East End of Catalina. Recent reports coming from Los
Coronado Islands are of very good fishing for reds and rockfish. The last reports of surface fishing activity from Los Coronado Islands were from a week ago when there were good numbers of small bonito biting around North Island. The reports about good rockfish fishing around Los Coronado Islands have been coming from areas such as the lower end of the 9 Mile Bank while fishing on the Mexico side of the border as well as from hard bottom areas to the north and the northwest of North Island in the 35 to 50 fathom depths. Another productive rockfish zone has been at hard bottom areas below and outside of South Island in 25 to 40 fathoms. A reminder to anglers is that the annual two-month rockfish/groundfish closure on the United States side of the Mexico border went into effect on January 1, 2021. Those wishing to fish for the rockfish/groundfish species covered by the closure will need to travel into Mexican waters. With the annual rockfish/groundfish
closure in effect in Southern California waters until March 1, skippers fishing along the San Diego County coast have been focusing their efforts on calico bass, sand bass, sculpin, halibut and yellowtail. There has been pretty good to good fishing for the calico bass, sand bass and sculpin reported and there has also been occasional yellowtail and halibut activity. The yellowtail fishing has been scratchy but there have been a few schools of yellowtail around that occasionally show in an area ranging from Sunset Cliffs on up to the upper end of La Jolla. The yellows tend to show best during the morning hours and locating areas of bait has been a good way to try and position yourself to be in the right spot at the right time if and when the yellows decide to show. Most of the yellowtail activity has been found while fishing in the 18 to 35 fathom depths. Surface iron works best when cast to yellowtail that are found up on the surface and yo-yo iron works best when dropping down to meter marks or sonar marks. Sardines and mackerel can also be effective while slow trolled, flylined or fished deep on a dropper loop rig. Good choices for surface iron include Salas 7X lights and Tady 45’s in blue and white, mint and sardine colors. Good
choices for yo-yo iron include Salas 6X and Salas 6X Jr. jigs in blue and white, scrambled egg and blue and chrome. The yellowtail found along the coast have been quality sized fish with most up in the 15-to-25-pound class. Much of the San Diego County coastal fishing has been focused on sand bass, calico bass and sculpin with hard bottom and structure spots producing most of the fish. The best area for sand bass has been fishing outside of and below the Imperial Beach Pier in 7 to 12 fathoms. Also productive has been the structure of the Imperial Beach Pipeline and hard bottom areas outside of the Pipeline. Going further north, other productive halibut areas have been the hard bottom to the northwest of Buoy #3 at Point Loma, the Jetty Kelp outside of Mission Bay, the upper end of La Jolla, the Anderson and Buccaneer Pipelines, the artificial reefs outside of Oceanside Harbor and Box Canyon. There have been a few halibut biting in areas up and down the San Diego County coast. Try sandy bottom beach and bay areas and spots where you can fish sandy bottom next to structure or can fish sandy bottom adjacent to hard bottom.

Channel Islands National Park Access remains open for private boaters While ferryboat access to the islands is barred at this point due to Covid-19, private boaters can still access the islands but some areas remain off limits for other reasons. By CATHERINE FRENCH VENTURA —Although the pandemic has
made access to the five islands in Channel Islands National Park—Anacapa, Santa Barbara, Santa Cruz, Santa Rosa and San Miguel islands—difficult for the public, private boaters still have good accessibility to most of the anchorages. Here’s a look at what’s open and what remains off limits. Due to the local stay at home order, Island Packers Company, the concessionaire for the Channel Islands National Park service, is unable to provide ferry service to the islands until restrictions are lifted, possibly by February 3, 2021. Private boaters can still anchor and go ashore to visit most of the trails on the islands. Construction of a new pier at Scorpion Landing on Santa Cruz Island is still ongoing, making it unsafe for visitors to go ashore. Private boaters can still anchor in the adjacent Little Scorpion, but Scorpion Landing remains closed for public safety.
Scorpion Anchorage is the most visited destination in the park, with about 65,000 people coming ashore each year to enjoy recreational activities such as hiking, picnicking, camping, kayaking, swimming, and diving. According to Lauren Boross, spokesperson for the National Park, boaters may anchor and go ashore at Smugglers Cover, but cannot hike the popular Smugglers Trail to Scorpion Valley. Smugglers Trail is closed from Smugglers Cove to the overlook above Scorpion Cove due to the fire that occurred last fall. The 1,400-acre burn area is in the process of revegetation. Another popular destination for boaters, Anacapa Island Landing Cove, is once again accessible to boaters. Access to Anacapa Island through parts of the summer of 2020 was closed due to crane construction. The work has been completed and boaters are able to access the island by using the landing dock ladder to embark on the island. No boats are able to tie up at the dock. However, anchoring just offshore allows for many recreational activities like hiking, kayaking and swimming, and diving. Visitors to the islands will soon be blessed with lush sightings as wild-flower season approaches. With the help of the rainstorm from a few weeks ago, the glorious yellow blooms from the tree sunflowers--the giant Coreopsis have begun, along with other island plants. These large blooms can often be seen from offshore.

NEWPORT BEACH—Fraser Yachts announced founder David Fraser died peacefully at his Newport Beach home on Jan. 6. He was 99. “A passionate yachtsman with a vision, a drive and a set of principles that not only built the company that today proudly continues to carry his name but equally continues to apply the values, thoroughness and ambition he was personally renowned for,” Fraser Yachts CEO Raphael Sauleau said in a released statement. “He loved the business of yachting and leaves behind him a legacy of talented sales brokers, all with the same sense of integrity and business values as his. Fair winds and following seas David....and thank you!” Fraser was a passionate sailor from an early age. The first sailboat he ever crewed on, during high school, Anna R Heidritter, remains on Fraser’s emblem today. He told The Log in 2016 his love for boating dates back to his days working aboard the 185-foot schooner as a deckhand. The schooner carried lumber and coal from Charleston, South Carolina to ports on the Atlantic Coast. Fraser also told The Log in a 2016 interview, after graduating from the Citadel in South Carolina, serving in the U.S. Navy and working aboard a trading vessel, Fraser hopped into a car and drove west – all the way to California - where he started selling boats in Wilmington before moving to Newport Beach to do the same. He launched Fraser Yachts in 1947, expanding the business from Newport Beach to San Diego, San Francisco, Seattle and Florida over the 1960s. Today there are offices in San Diego, Ft. Lauderdale, England, France, Monaco, Spain, Thailand, China, Dubai, Qatar, Kuwait, Italy and Australia. A statement from Fraser Yachts said Fraser was determined to ensure the company always felt like a family, and this team spirit remains at the heart of Fraser to this day. Fraser’s daughter Diane, who first joined the firm in the 1980s, has remained with the company to date. “Diane’s early rise in the company is just one example of many that exemplify David’s commitment to including and encouraging women to take key roles in yachting, at a time when that was not always the case, and specifically in the business and growth of Fraser,” Fraser Yachts said in a released statement. Outside of work, Fraser found time to participate in sailing races. Fraser made three races to Honolulu, two Miami-to-Jamaica runs and a Trans-Atlantic trek from Bermuda to Marstrand, Sweden. His team came in first place in the Trans-Atlantic race from Bermuda to Sweden. Fraser was a member of Newport Harbor Yacht Club for more than 65 years. His affiliations also included St Francis Yacht Club, Transpacific Yacht Club, and the American Legion. He also served on the California Yacht and Ship Broker Commission. “We look forward to continuing to keep David’s legacy alive.,” Fraser Yachts said in a released statement. Fraser is survived by his wife of 71 years, Eleanor; three daughters Laurie Booth (Barry) of Newport Beach, Diane Strollo (Rick) of Orcas Island and Jennie Heinke (Keith) of Newport Beach. He also leaves four grandchildren Jeannette Palisoul (Phil) of Costa Mesa, Diane Booth of Las Vegas, Hilary Elliott (Rob) of Dallas, Emily Heinke of Seattle and two great grandchildren.

40-year Bahia Corinthian Yacht Club member and racer NEWPORT BE ACH —Longtime Bahia Corinthian Yacht Club member and racer Joe Degenhardt passed away January 1, 2021. “BCYC members’ hearts are deeply saddened by the passing of one of their members Joe Degenhardt,” Bahia Corinthian YC said in a released statement. Bahia Corinthian YC said he died peacefully by natural causes at his home in Corona del Mar with his son Bill, his daughter Grace and her husband Glenn Dassoff by his side. Degenhardt joined Bahia Corinthian YC in 1980 and had been sailing for 41 years, racing his 38-foot Catalina Lickity Spilt for the last 20 years. His accomplishments include four Congressional Cups, including one 1st place; 30 Newport to Ensenada races; a Transpac race with his daughter; and sailing the world over many years with his beloved wife, Verna, their family, and many friends. He also won four Catalina 38 National titles. Degenhardt raced an average of 50 races a year, including Angelman, Doubled-handed (BCYC) Bogart Series, Hot Rum Series (Voyagers Yacht Club), 66 Series, Sunkist Series (Balboa Yacht Club), SCYA Mid – Winter Regatta and the Ahmanson Series (Newport Harbor), plus many more.
