By: JORDAN B. DARLING SAN DIEGO — On June 8 San Diego social media was buzzing about a mysterious boom that caused an earthquake-like shaking throughout the county. According to CBS 8 the U.S. Geological Survey reported that there was no earthquake activity in the area when the mystery event hit around 8:20 p.m., in fact the last report of shaking was clocked in at 5:37 a.m. the same day in southeast Riverside. This is the third such event reported in San Diego with previous events on February 17 and March 10, same M.O. a loud sound associated with earthquake-like shaking. In February, the USGS said that sonic booms, which are particularly common in Southern California with one of the largest naval bases in the country nestled in San Diego and a marine base just up the freeway, are loud noises associated with shock waves and could be the culprit of the mystery. Twitter was ablaze with theories about the mystery, guessing everything
from the return of Top Gun favorite Maverick, to aliens crossing into our atmosphere for a closer look. One Twitter fan, @GYM_SHARK, attributed it to Padres third baseman Manny Machado’s batting practice. Fantasy is much more interesting than reality, four days later MCAS Miramar tweeted a release claiming a possible responsibility for the event. “While MCAS Miramar cannot account for every sound event that occurs within the area, in this case the cause is possibly due to aircraft training occurring in the W-291 range, approximately 30 miles southwest of San Diego over the Pacific Ocean,” said a June 12 press release from Marine Corps Air Station Miramar. “Two units departed from MCAS Miramar and were conducting simulated air-to-air combat training.” The release went on to describe the factors involved in sonic booms including temperature variations and humidity levels that can cause waves to travel farther than normal. Twitter continued to question the origin of the big boom, with a lot of users still leaning towards aliens as the origin.

But it seems that the social media site has taken a lighter look at the mystery. One twitter user commented “Sounds of freedom. Boom away any time you like,” in response to the press release.

NATIONWIDE— The trademark look of a Fourth of July celebration is barbecues, little kids with sparklers, and the main event, the bright colorful lights of fireworks exploding in the night sky while onlookers ooo and awe. Historians believe that fireworks date back to the second century B.C. Liuyang, China. According to the American Pyrotechnics Association the first fireworks were believed to be bamboo stalks that would explode when they were thrown into the fire. The stalks would explode because of the hollow air pockets in the bamboo. The guess is that later on in 600-900 AD a Chinese alchemist mixed potassium nitrate, sulfur, and charcoal and then poured the powder into hollowed out bamboo sticks which made the first man-made fireworks. Fireworks made their way to Europe in the 13th century where Italians were the first Europeans to manufacture fireworks. Settlers brought the fireworks with them to the New World where they became a part of the Fourth of July. Fireworks have been a part of Fourth of July celebrations dating back to the first months of the
Revolutionary War. According to History.com the first instance of an Independence Day celebration came in a letter from John Adams to his wife Abigail in 1776, after Congress had revised a draft of the Declaration of Independence. “The Second Day of July 1776, will be the most memorable Epocha in the History of America,” Adams wrote. “I am apt to believe that it will be celebrated, by succeeding Generations, as the great anniversary Festival…It ought to be solemnized with Pomp and Parade, with Shews, Games, Sports, Guns, Bells, Bonfires and Illuminations from one End of this Continent to the other from this Time forward forever more.” Adams was off by a couple of days but the tradition of illuminations has continued to be a part of the celebration. The first organized Independence Day took place in Philadelphia on July 4, 1777 but it would not become an official holiday until 1870. According to a June 29, 2018 article from Fortune, Americans spend almost $1 billion on fireworks each year. What are my rights as a liveaboard?
QUESTION:
I am having a dispute with my marina. I am a legal liveaboard and I have been in and out of the hospital a lot over the past year, but I have paid my monthly slip fees like clockwork. Last month I received a 30 day notice to vacate my slip but no reason was given for the eviction. I know I have rights as a liveaboard, but I would think they would need to give a reason for the eviction regardless of my liveaboard status, especially in a case like mine where I am not delinquent with my slip rent. What are my legal options in a case like this where my rights have obviously been violated?
ANSWER: I have authored this column regularly since 2006, and during that time I have been asked to address this question over and over. The answer remains the same. The bottom line is that our reader can’t do anything to protect his rights because, based on the information provided, nobody is doing anything to violate his rights. It
may be time for a refresher. The concept that people seem to have the most trouble grasping is the characterization of a slip rental agreement as a storage agreement for personal property. In other words a boat owner, even a liveaboard boat owner, is not renting a home. He or she is renting a parking space and nothing more. It is a place to

store your stuff. Marina tenancies are generally characterized as a form of commercial tenancy, even if the boat owner lives aboard the boat. The tenancy falls somewhere between a rented storage garage and a space rental at a mobile home park, though unlike those two arrangements California law does not specifically address a marina tenancy. Most of the laws that restrict the behavior of a landlord in California and in other states are limited to “dwelling units,” and the definition of that term clearly does not extend to a boat. And at least one court has held that “the right to dock one’s boat at a particular berth or marina cannot be equated with the right to decent low-cost housing even if one chooses to live aboard the boat.” As a commercial tenancy,

the consumer protections that are available to residential tenants are generally not available to marina tenants, and a month to month slip lease may be terminated - without cause - on 30 days notice. This is exactly what happened in our reader’s case. He is suspicious about the basis for the eviction because the marina refused to give him a reason, but the marina is not required to give a reason. It is important to note that this is not a one-sided arrangement, and that both parties to the agreement - the boat owner and the marina - are each free to terminate the lease on 30 days’ notice without providing a reason. Coastal Commission Approves Modified Application for Changes at Corona del Mar Visitor Dock and Beach The amended Coastal Development Permit allows for the continuation of shared use of the visitor dock between the public and emergency vessels, a change in dinghy dock tie up hours, installation of safety gates, and calls for the addition of two beach wheelchairs. discussion about the Americans with Disabilities Act access and parking at its June 9 meeting, the California Coastal Commission approved an application from Orange County Parks to make changes to the visitor dock, slips, beach, and parking area at 1901 Bayside Drive in Corona del Mar and added an additional requirement to allocate 10 more public parking spaces. The Commission also requested Orange County come back within 90 days with a feasibility study for installing a boat access lift for those with mobility challenges at the location with the expectation that if feasible, the county would submit another amendment application for the project. The approved Coastal Development Permit amendment will allow for the boating public’s continued shared use of the visitor dock with emergency use vessels; change the maximum length of the dinghy dock tie up hours from 72 to 24; install wayfinding signage in the parking lot and dock facilities; install two safety gates and fencing; install a kayak storage rack and canoe storage rack on the beach; and designate eight Orange Coun-
ty Sheriff’s Harbor Patrol parking spaces for public use on the weekends. It also allows for the installation of a concrete pathway for ADA beach and dock access and provides two beach wheelchairs onsite to offset the change in access that will result from the installation of safety gates within the facility. The amendment was submitted to the Coastal Commission to resolve several public access violations issued in 2019, including the posting of “Keep Out” signage at the visitor dock, and comes after two years of demands for changes from the public and Orange County Coastkeeper. “I think there’s been a lot of benefits from this process and we look forward to seeing the changes and greater public access to that area,” said Gary Brown, founder and president of Orange County Coastkeeper. OC Parks had originally submitted an amendment application that would have restricted the use of the visitor dock to emergency use only and replaced an ADA compliant concrete path with a rollout beach mat. After significant public opposition, OC Parks modified the application. “While I’m happy, I’m cautiously optimistic that we’re making progress,” said Penny Elia, who has been outspoken about concerns of public and ADA access at the location. The amendment also requires OC Parks to implement a marketing and publicity program to advertise the availability of the public guest slips and other public amenities, including how to rent the slips and the public moorings, with a targeted outreach program to environmental justice communities in Orange County, including low-income communities, communities of color, and other historically underserved communities. “The outcome of this two, two-and-ahalf-year process has probably been far better and more beneficial to the public and to boat owners than we even expected,” said Brown. OC Parks officials said they have started looking into it but said they did not include it in this CDP amendment because they did not yet have any specifications for what would be required. The county is expected to come back to the Commission in the coming months with a feasibility study for the boatlift. Increasing parking and ADA access were also of concern of many of the commissioners. “I just think there needs to be more parking especially if this becomes a meaningful ADA site for the public who are disabled to access the bay,” said Commission Vice Chair Donne Brownsey at the meeting. Brownsey made a motion to add an additional requirement to allocate 10 additional public parking spaces, some of which will be designated as ADA after

the county comes back with the boatlift feasibility study. Brown praised the actions of the Commission. “The Coastal Commission is demonstrating their commitment to ensuring public access,” said Brown. Elia said while she is happy with what she heard the public was going to get, she was concerned the additional items discussed by the Commission, including the additional parking spaces and boatlift/ ADA study, were not in writing. "We heard what we got, we took notes on what we got, but did the county take the same notes?” said Elia. She said she still also had concerns about homeowner encroachments on the public beach which were not addressed, if the ADA study would be done by a third-party, the accessibility of the ADA compliant concrete pathway and whether there will be ADA van accessible parking near the dock with the boatlift.

LOCAL Avalon City Council Approves Contract for Continued Shoreboat Service AVALON—Catalina Coastal Tours &
Fishing will continue to offer shoreboat service in Avalon Harbor for another five years when the company’s current contract with the city ends in March 2022. At its June 1 meeting, the Avalon City Council voted to continue the contract with the fishing charter and tour company for the shoreboat service and to allow the city to negotiate proposed terms of the contract. Catalina Coastal Tours & Fishing has a five-year agreement with the city to provide shoreboat service that started in March 2017 and will expire in March 2022. According to a staff report from the June meeting, Catalina Coastal Tours & Fishing in a recent meeting with city staff indicated they were interested in continuing the service and provided a proposal to amend the contract and extend a city-provided subsidy into the next five-year term. They proposed the city continue to subsidize operations by 4.4 percent for the five-year period. They also proposed to increase fares within the harbor from $4 to $5; increase fares outside of the harbor from $5 to $7; and add a provision regarding ADA accommodations. According to a staff report, the increase in subsidy and fare costs will offset increased expenses associated with increased cost of living, fuel, mooring fees, insurance, and ongoing litigation.

cant expansion, including a $22 million maritime training center connected to the harbor-side facility by a skyway bridge over Pacific Coast Highway. Construction is scheduled to be complete in Summer 2021.
New Avalon Fuel Dock Operator Approved for General Goods Delivery

The fuel dock operator will use an inflatable boat to deliver general goods, foods, beverages, beer, wine, and ice originating from the fuel dock, to vessels on moorings within city limits. Avalon Harbor Fuel Dock proposes to operate seven days a week, between the hours of 8 a.m. and 8 p.m.

U.S. Dept. of Transportation Designates OCC Waterfront Campus ‘Center of Excellence’ NEWPORT BEACH— Orange Coast College has been named one of 27 Centers of Excellence for Domestic Maritime Workforce Training and Education (CoE) for 2021 by the United States Department of Transportation’s Maritime Administration. The announcement, made in late May, came on the heels of OCC’s announcement that its Newport Beach sailing facility has been renamed The Orange Coast College Waterfront Campus. “Orange Coast College’s professional mariner and sailing programs have long been the standard of excellence in maritime training and education,” said OCC President Angelica Suarez in a press release. “This CoE designation formally recognizes the tremendous value OCC provides in preparing students for successful careers in the nation’s maritime industry.” The CoE designation opens the door to The Maritime Administration (MARAD) entering into cooperative agreements with designated institutions to help advance recruitment of students

Catalina Island was owned by a man named James Lick in 1864 who sold the island to the Banning Brothers in 1891 after several failed attempts to develop the island into a resort destination. In 1894 the brothers established the Santa Catalina Island Company and began to build developments including Pleasure Pier in 1909, which still stands in Avalon
Bay. In 1919 the island was sold to William Wrigley Jr., whose family still owns the Catalina Island Company, and it became a hotspot for Hollywood’s elite during the 1930s, 40s, and 50s. The island continues to be a popular vacation spot and will be celebrating the Fourth of July with fireworks at 9 p.m. at Avalon Bay and Two Harbors on 3rd Street.

The gold standard of sailing WHAT CAN I SAY? The Beneteau Oceanis 40.1 is everything I love about sailing. Blending class, comfort and performance at it’s finest. She is a true beauty. Following in the wake of her elder sister the Oceanis 46.1, this 40-foot cruiser, with a new hull design by Marc Lombard, offers unprecedented deck volume and interior space. With an avant-garde flared hull design, the Oceanis 40.1 is leading the way, with no concessions to performance. The Oceanis 40.1 arrived in San Diego at South Coast Yachts in late February. The new owners from Newport Beach CA, gave permission for me to take the boat (Evelyn, is her name) for a Sail before they picked her up. I am the only person that was granted access and it was a great honor! Sean Smith with South Coast Yachts San Diego welcomed me and my partner aboard for an afternoon of sailing. The philosophy of the Oceanis 40.1 is to make sailing and mooring pleasurable, comfortable accommodating six to eight people. Perfect for cocktailing and day sailing but seriously enough with a Class A sea rating to jump on a cruise down to Ensenada, Mexico.
ONDECK The flared hull increases the area of the forward deck making for a better flow of movement as well as anchoring and mooring easier. The lines and halyards that lead aft to the helm station are now further to the rear, opening up the cockpit making it more agronomical, allowing more space for movability. The cockpit has two L-shaped benches comfortably seating six
people. In the middle, a deluxe fiberglass cockpit table that has folding leaves with compartment forward, storage aft side and cupholders. The angled coamings and clear side decks making it super easy to walk from the bow to the platform. The transom easily converts into an extensive swim platform making for a fun day anchored at sea. At the Helm there are two helm stations, both stainless steel with leather wrap. The helm station has flip up seats making it easily accessible to the bow. Whomever is at the helm will appreciate the twin rudders and retractable bow.
INBOARD The Oceanis 40.1 has 40 feet of space. Down below, the interior is a beautiful white oak finish, also available is the walnut interior option. Starboard side, the C-shaped galley wraps around giving it an abundance of counter space, double -basin sink, large refrigerator, freezer, oven, microwave, and plentiful storage above and below. Plenty of room to cook an entire meal while your friends enjoy wine and visit at the table. Port side has an enormous salon, L-shaped dinette settee with removable bench, comfortable sitting six for dinner. Utilizing all space, a chart table is at the foot of the companionway. This is perfect for those of us who end up working part of the weekend but still want to be in on the fun! Just above the chart table is your navigation station and electric panels. The hatches and the many hull and coachroof portholes, two of which face towards the cockpit, fill the boat with natural light and ventilation, making her exceptionally bright and giving you a below deck ocean view.

Evelyn has the three cabin, one head option. The forward master cabin has a center line queen bed, accessible from both sides with plenty of volume due to the shape of the new hull. Ample storage space with hanging lockers and storage on both sides, great for outfits and linens. I also appreciate the large windows and blackout shades for the morning light. One of the amenities I really like about the cabin are the USB outlets on both sides of the bed. The other two cabins also are outfitted with tons of space, windows, and storage. The head is spacious, separate shower forward and large vanity mirror.

Barbara Sunrise Charitable Foundation is hosting the 2021 Santa Barbara Dolphin Dive Festival at Chase Palm Park on July 10 from 12 p.m. to 4 p.m. The annual event is a free community event that features live music by King Bee, food, beer, wine, and activities including the main event, a dolphin race down a watercourse that runs the park. Participants can adopt a brightly colored plastic dolphin to enter into the race down the park for a chance at winning cash prizes and other donated gifts from the local community. Dolphins that cross the finish line are eligible to win cash prizes up to $5,000 or other prizes.

WASHINGTON, D.C. — On May 25,
Senator Maria Cantwell (D-WA) introduced a proposal which would create a new federal tax incentive to accelerate the manufacturing and adoption of all types of electrified transportation modes ranging from recreational boats to industrial equipment. The Fueling America’s Security and Transportation with Electricity Act of 2021 (FAST Electricity Act) would establish a 30 percent investment tax credit for any electrically propelled vehicle that is not an on-road passenger car or truck. The bill also provides a 30 percent investment tax credit for recharging or hydrogen refueling infrastructure needed to power these transportation vehicles. “The recreational boating industry applauds Senator Cantwell’s introduction of the FAST Electricity Act that would enable marine businesses to invest in next generation propulsion technologies and associated charging infrastructure,” said Callie Hoyt, director of federal affairs at the National Marine Manufacturers Association, in a press release. “Providing incentives to boost investments in greener products is a top policy priority for NMMA and we look forward to working with Congress as the industry looks toward advancing next-gen technologies to further reduce emissions and conserve energy.” The FAST Electricity Act would expand the existing Advanced Technology Vehicles Manufacturing (ATVM) loan
program to support expansion of domestic manufacturing of these new electric transportation options and the corresponding supply chains needed to produce them.
NMMA Report: Recreational Boating Continues to Boom NATIONWIDE— The National Marine Manufacturers Association has announced new data showing continued momentum of boat sales and boating demand propelled by the COVID-19 pandemic. New boat sales, which reached a 13-year high in 2020, remain at elevated levels – with sales through March 2021 up 30 percent compared to the 2020 average, according to the NMMA. “All signs point to boating demand and boat sales remaining strong as more people discover the mental health benefits, joys and freedoms of being outside and on the water,” said Frank Hugelmeyer, NMMA president, in a press release. New data from the NMMA shows 415,000 first-time boat buyers entered the market in 2020. These buyers were younger than the average, and were 1.5 times more likely to be women than other buyer groups, according to the NMMA. Discover Boating – an industry resource hub for those interested in getting started in boating – reports traffic to the site is up 56 percent year-over-year through May. “Boating has seen an increase in more diverse first-time boat buyers who are helping drive sales of versatile, smaller boats that provide a variety of boating experiences, from fishing to watersports,” said Hugelmeyer.

Commissioners Approve 8-Week Pause for In-Hull Water Cleaning in Shelter Island Yacht Basin The pause is a part of a pilot study proposed by Port of San Diego staff as an effort to meet a state-mandated 2022 deadline to reduce copper levels in this area of the bay, which exceeds federal and state water quality standards. By: LINDSEY GLASGOW SAN DIEGO — The Port of San Diego
plans to mandate a pause on in-water hull cleaning on vessels in the Shelter Island Yacht Basin for an eight-week stretch this winter. The pause is part of a proposed pilot study, which aims to provide understanding of how in-water hull cleaning impacts water quality, specifically copper levels, as the Port faces a 2022 deadline to reduce elevated copper levels in the Shelter Island Yacht Basin. The proposed in-water hull cleaning pilot study was presented to the San Diego Board of Port Commissioners on June 15 and the board voted to mandate an eight-week pause on in-water hull cleaning for the study to be conducted. The study will involve four weeks of water quality sampling in the fall of 2021, followed directly by eight weeks of water quality sampling during the mandated no in-hull water cleaning in the winter of 2021/2022, and then another four weeks of water quality sampling after the pause. A Dissolved Copper Total Maximum Daily Load for the Shelter Island Yacht Basin set by the regional water board in 2005 due to copper levels that exceeded federal and state water quality standards requires a 76 percent reduction of copper loading by 2022. Copper hull paint has been identified as the largest source of dissolved copper in the area and the Port has led many efforts aimed at reducing levels as part of its copper reduction program. Port data shows as of 2020, copper loading has been reduced by 48 percent. However, data for 2020 shows the basin-wide average concentration of dissolved copper was 8.3 micrograms per liter, which is equal to the 2005–2008 baseline level. “What we have found from examining this data over time is that there is a disconnect between the loading and the water quality, that loading continues to decrease but that water quality does not follow that same pattern,” said Kelly Tait, the environmental protection program manager for the Port of San Diego, at the meeting. A monitoring and progress report for copper reduction in the Shelter Island Yacht Basin released in March 2021 stated it was anticipated that additional activities to reduce copper loads will be needed to meet final TMDL load re-

In-Water Hull Cleaning Survey Results - Boaters Earlier this year, the port conducted an In-Water Hull Cleaning Survey to help better understand how vessels are being cleaned. Approximately 450 boaters, hull cleaners, and marina and yacht club operators and managers in the San Diego Bay boating community participated. Port staff said they sought preliminary feedback from stakeholders and received some concerns from in-water hull cleaners who said the pilot would result in the loss of thousands of dollars of income during those eight weeks and the pause may make boat hulls more difficult to clean. Board of Port Commissioners ViceChair Dan Malcolm suggested the Port set up alternative sites in the bay outside of Shelter Island where boaters could go to still get their hulls cleaned during the eight-week pause. “In moving towards a hull cleaning pause we need to work with the boaters, we need to educate boaters,” said Malcolm at the meeting, noting he was a boater himself. The pilot study has garnered the support of the San Diego Regional Water Quality Control Board and California Department of Pesticide Regulation, both of which have been involved in setting state mandates and regulations regarding copper hull paint and TMDLs. “I see this as a unique opportunity for the water board, for the Port, for the marina operators, in-water hull cleaners and the yacht owners themselves to come together on a key scientific question that concerns the future of San Diego Bay,” said David Gibson, executive officer of the San Diego Regional Water Quality Control Board, at the meeting. Port staff will come back to the board in the coming months with proposed regulations to implement a mandated in-water hull cleaning pilot study.

Underground Fuel Tank Project Completed in Santa Barbara WHAT HAPPENED: A project to replace two
underground fuel storage tanks in Santa Barbara Harbor, which was run and funded by the Santa Barbara Fuel Dock Inc., broke ground in February 2020. An electrical utility line that ran adjacent to the fuel tanks was discovered and had to be relocated for safety reasons before the project could resume. The project resumed on March 8 and replaced four 10,000 gallon single-walled fuel tanks with two 20,000 double-walled fiberglass units, one tank to hold diesel fuel and the other to hold gasoline. The replacement of the tanks is in compliance with a California Senate bill that amended the Health and Safety Code regarding underground storage tanks with hazardous substances, like fuel, that could potentially leak and contaminate water.

buzzing with people interested in boats on Saturday, May 15. Seven local boat and broker dealerships hosted an Island Boat Show. Those seven dealers were: Alexander Marine USA, Crow’s Nest
Yachts, Denison Yachting, Jeff Brown Yachts, Mikelson Yachts, Seattle Yachts International, and Silver Seas Yachts. This was the second annual event and boy was it successful! Since there have been no local boat shows in the area to attend or participate in these local dealers started their own last summer on Shelter Island. “The concept has been fun to create,” said Susan Nufer, the Silver Seas Yachts coordinator. We put together a Passport booklet with all seven dealers having a page inside, just like an actual passport. The attendees pick up a passport and go
to each dealership and have the booklet stamped, just like a real one. We incorporated a Poker Run this time and handed out playing cards at each stop and the best five card hand won at each dealership. The winners won fun prizes. “The Boat Show is no charge to those attending, so nothing is better than free, right?” Susan exclaimed. Everyone that was here on Saturday was greeted with smiles behind masks and the boats were kept cleaned in touch spots to keep to those Covid safety protocols. We had so many people just thrilled to be out and about, feeling safe and making their d rea m s come tr ue, looking and purchasing a new boat. This appears to be a new fun way to host a boat show, people are able to look at a variety of boat brands; new and used from these seven dealers. There was something for everyone to see, from an inflatable dinghy to a large yacht. Families were having fun, eating some food provided, learning about financing, insurance, electronics and more…….what better way than this to spend a day on Shelter Island, than at a boat show???? “We will host another one again!” said Susan. It’s been fun having these dealers come together for a great cause: Boating in San Diego!!!

Commission got an update on the project at its June 17 meeting. Waterfront department staff reported the project was substantially completed on May 28 and fencing removed and parking restored. They reported the alley way between 117 Building and 125 Building was scheduled to be reopened on June 21. However, the contractor, B&T Service Stations Contractor, will return to repair the west staircase to 125 Building because the support columns shifted during construction. Waterfront staff said they may look into evaluating vehicle traffic patterns in the alley way, ways to improve pedestrian safety, and where to make adjustments to adjacent parking spaces. They said any future plans would include stakeholder input.

DARLING CATALINA— Catalina Island is offering a full day Fourth of July celebration that will encompass more than the traditional fireworks show. Guests can check out a patriotic golf cart parade down Casino Way at 1 p.m. on the fourth. The parade, themed “Catalina Beautiful, Avalon Strong” will line up along Casino Way and wind up and down the streets of Avalon ending down Clarissa. In previous years participants have done everything from turning their golf carts into full tanks covered in the state and national flags from across the United States, to repping their favorite baseball team and the Wrigley family with a decked-out Cubs themed cart or the bright green of Wrigley’s Doublemint 35-cent chewing gum. Themes have changed but the popular event brings out the creativity and uniqueness of all participants. to 700 hours a year. The draft proposal requires the commercial fishing sector upgrade to tier 2 or newer engines between 2030 and 2032. CARB staff said in an email one factor for proposing less stringent emission requirements for commercial fishing vessels is the industry has less of an ability to pass costs onto the consumer than other categories that are able to establish prices for their services. A 2019 Cal Maritime study that evaluated the feasibility and costs of installing tier 4 engines concluded tier 4 engines do not exist for commercial fishing or commercial passenger fishing vessels. The study also said retrofit with a DPF and/or diesel engine fluid system would have adverse effects on vessel stability and would reduce passenger count by eight to 30 persons. The retrofit would also need to get U.S. Coast Guard approval for safety. Ursitti said they have already begun discussing how this proposed regulation would impact the cost of tickets if these vessels were to retrofit with a tier 3 engine and DPF. “For an entry-level ticket price, raise that ticket price right out of the gate in excess of 25 percent,” said Ursitti. He said to completely replace a vessel, they would need to increase ticket prices by 60 to 70 percent. “So again, you just run yourself right out of business,” said Ursitti. The CARB board is scheduled to vote on this proposed regulation at a public hearing set for Nov. 18 and 19, after a 45day comment period that will start on Oct. 1. CARB staff said they are continuing to consider stakeholder feedback and are working to balance economic impacts with the need to achieve greater public health protections by improving air quality. According to SAC, prior to the COVID19 pandemic, recreational fishing contributed $5.6 billion a year in economic activity and supported nearly 40,000 jobs. Franke said while most harbor crafts are owned by big corporations or port authorities, sportfishing and whale watching boats are family-owned businesses that operate on a small profit margin. He said these regulations would put many of them out of business in three to six years, it would substantially increase the price of passenger tickets, and limit access to saltwater fishing, whale watching, and children’s science trips. “In my time here at SAC this is the most serious issue we have ever faced,” said Franke. He also noted the proposed regulations were not developed in consultation with the USCG, which is charged with regulating the safety of commercial passenger vessels. “It’s not that they don’t want the rule, it’s that it should be such that people can actually comply,” said Franke. Those in the industry say they have already been proactively and voluntarily upgrading their engines to tier 2 and tier 3 over the past 15 to 20 years as the technology becomes available with the help of funds from the Carl Moyer Program, which is a voluntary grant program that
provides funding to accelerate the replacement of older diesel engines with cleaner technologies. Franke estimated most of the commercial passenger fishing vessels in the state currently have tier 2 engines. “Our fleet’s been very responsible and very proactive utilizing funds to up-tier and reduce emissions,” said Ursitti. Ursitti, who has previously owned multiple sportfishing charter vessels, said he himself has used the Carl Moyer Program for three repowers. “Our industry, the CPFV [commercial passenger fishing vessels], has a vested interest, just like every commercial fisherman has a vested interest, in creating and maintaining a sustainable environment, without resource available we’re out of business,” said Ursitti.
There was also concern that once these deadlines are mandated, grant funds would not be available. “If this rule goes through there’s a real serious question as to whether or not they’ll ever be able to have grant money pay for a portion of these engines or not,” said Franke. Ursitti questioned if there was data to show how much of an impact commercial passenger fishing vessels emissions had on air quality and how much of an impact upgrading to tier 4 engines would have. “I think the hard questions need to be asked,” said Ursitti. According to CARB, there are about 352 commercial passenger fishing vessels statewide and a total of 3,153 harbor craft vessels encompassed by these regulations.
CARB staff said they are finalizing emissions, air quality, economic, and health benefit analyses and those will be part of the rulemaking package anticipated for public release in September 2021. “We hope the Newsom administration sees this as a priority in rebuilding tourism and also continuing to make the ocean accessible to diverse and lower economic communities, we want to be willing partners, this fleet has a long history of working well with the state and it’s an economic engine to the entire coast that we hate to see ruined,” said Franke. WASHINGTON D.C.— On June 9 Senate Committee on Commerce, Science, and Transportation Chair Maria Cantwell, representative from Washington, and ranking member Roger Wicker representative from Mississippi introduced the Sport Fish Restoration and Recreational Boating Safety Act of 2021. The bill would reauthorize the Sport Fish Restoration and Boating Trust Fund, a fund that supports fishery restoration and conservation efforts, boating access and infrastructure, as well as fish stocking programs, according to a June 15 article from Boating Industry. The legislation would also authorize studies on impacts of non-motorized vessel use on vessel waterway access as well as the impact of abandoned vessels. The fund was initially established in 1950, and at the time used a 10 percent federal manufacturers excise tax on certain types of fishing equipment to fund and enhance sportfishing projects, according to an informational brochure from Angling Boating Alliance. “Since 1950, the Sport Fish Restoration and Boating Trust Fund has been a key component in increasing access for marine and freshwater anglers by protecting vital habitats,” said Wicker in a June 9 press release from the U.S. Senate Committee on Commerce, Science, and Transportation. “Our legislation would reauthorize this important fund while implementing studies aimed to improve the program. I thank Chair Cantwell for working with me to advance this measure.”
At the time the fund only covered sportfishing, in 1971 The Recreational Boating Safety Program was established to fund boating safety education programs, it was amended in 1980 so it would draw funding from taxes on motorboat fuel, and in 1984 the two programs were combined under the Wallop-Breaux Act. The act expanded the 10 percent tax to include nearly all sportfishing products and used the federal motorboat fuel taxes. In recent years the fund supports roughly $650 million annually in fishery restoration and conservation and boating access and infrastructure. The legislation would reauthorize the fund through the fiscal year 2026; authorize a report on the use of the trust fund towards non-motorized vessel access; and authorize impacts and potential solutions for abandoned vessels. “Washingtonians love recreational fishing,” said Cantwell in the June 9 press release. “That means boating, charter fishing, fly fishing, or even fishing just off the dock. Give us any means possible and we will fish. Marine life can become entangled in everything from trash that has made its way into

water, a slight chop to the wave, and a clear view of Catalina across the horizon. A boater thinks they see something bobbing in the waves but they can’t quite determine if it is just a white cap or a piece of trash that accidentally dumped into the ocean. They get a little closer out of curiosity, and the idea of pulling out the trash before a marine animal can ingest it or become entangled in the piece
of mankind that doesn’t belong in the ocean. It is too late; the piece of fishing gear has been tangled with a humpback whale that was on its way up the coast during its migration. In its 2020 West Coast Whale Entanglement Summary NOAA reported that there were 13 confirmed reports of whales entangled in some type of fishing gear off the California coast. But there are more than just whales living off the coast that have found themselves entangled in garbage, fishing lines, crab gear, and whatever else is in the ocean. The NOAA West Coast Marine Mammal Stranding Network was established in the early 1980s under the Marine Mammal Protection Act and has been working towards lowering the number of confirmed entanglements and assessing the best sustainability practices for fisheries moving forward. The group is composed of cooperating scientific investigators, institutions, volunteer networks, and individuals up and down the coast.

King of Spain Regatta (July 10-11) California Yacht Club will host the annual King of Spain Regatta July 10 and 11. The event is open to Star Class boats that are in compliance with STCR 21 and is ruled by The Racing Rules of Sailing. The race will be held on Santa Monica Bay, approximately one nautical mile northwest of the Marina del Rey breakwater. The names of the winning skipper and crew will be inscribed on the King of Spain Perpetual Trophy on display at CYC. The trophy, a sterling silver Spanish galleon, was presented to CYC by the King of Spain in 1928, and racers have competed since the late 1970s to add their name to the trophy. International Olympic Committee Green Lights Kiteboarding for 2024 Olympics World Sailing took a vote at the midyear meeting for events to replace the Mixed Offshore event in the Paris 2024 Olympics, with Men’s and Women’s Kiteboarding as the top choice. DARLING LAUSANNE, SWITZERLAND — On June 10 the International Olympic Committee Executive Board approved Men’s and Wo m e n’s K i t e b o a r d i n g (Formula Kite) to replace Mixed Kiteboarding and the Mixed
Offshore Event in the Paris 2024 Olympic Sailing Competition. In December 2020, the IOC informed World Sailing that there would be a review into the Mixed Offshore event revolving around the Field of Play security, scope, complexity, broadcast cost, complexity of the event, and the fact World Sailing would not have the opportunity to deliver an Offshore World Championship. In April, the IOC requested World Sailing put forward alternative event proposals for the 10th medal at the Olympic games. World Sailing took a vote at their mid-year meeting in May and the final decision was to propose Men’s and Women’s Kiteboarding as the first alternative and the Men’s and Women’s Two-Person Dinghy (470) as
the second alternative event. The World Sailing council received 23 proposals and narrowed it down to 15 before settling on the top two proposals. “The IOC provided us with clear guidance and their decision-making is consistent with other sports and events,” said David Graham, chief executive officer for World Sailing, in a June 10 press release. “The World Sailing community acted at pace to propose alternative events and we are delighted the IOC have followed our guidance and selected our first alternative proposal of Men’s and Women’s Kiteboarding.” The Olympic sailing events will be held in the newly designed Roucas Blanc Marina in Marseille, France.
King Harbor Yacht Club is hosting the 29th Annual Cure Cancer Cup for the Tom Collier Memorial Trophy on July 10. The race is open to all sailboats 14 feet or over in length with a PHRF rating of 288 or less. The boat does not have a valid PHRF RLC rating the race committee will assign a rating. The race is governed by The Racing Rules of Sailing, amendments will be posted in the sailing instructions. All proceeds from the regatta will go directly to cancer research, the entry fee is $25 for the boat and skipper plus $20 per crew member. 2021 Crew of Two, Race Around the Coronado’s (July 17) Point Loma Yacht Club is hosting the 2021 Crew of Two, Race Around the Coronado’s on July 17. The race is open to all members of organizations affiliated with US Sailing, PHRF classes must have a Rating Certificate from PHRF San Diego to race in a PHRF class. The race is ruled by the Racing Rules of Sailing, and will start at Buoy #9, the racing area covers San Diego Bay, Los Coronados Islands, the Pacific Ocean, and will include Mexican waters. There is one race scheduled, the warning signal will be at 10:55 a.m. Participants for the event must register for the event by July 16 at 7 p.m., the Skipper’s meeting will be held at 7 p.m. at the Point Loma Yacht Club. a record-setting year for the California Offshore Race Week, a three-leg series covering 549 nautical miles. The 2021 iteration of the series set records for the largest fleet signed up to complete the full series and for the longest amount of time spent on the SoCal 300 course. The series kicked off with the Spinnaker Cup May 29 and 30, a race from San Francisco to Monterey. The race continued May 31 and June 1 with the

Coastal Cup, a race from Monterey to Santa Barbara, and finished with the SoCal 300, a race from Santa Barbara to San Diego June 3-5. For many teams, this race was the first opportunity to stretch their offshore racing sea legs in more than a year. Thirteen teams were set to compete in the full series, the largest fleet to do so in the fiveyear history of the series, according to the race website. The 2021 California Offshore Race Week series winner was Jim and Kate Murray’s Pac52 Callisto. They were able to just edge out their Class A competition including Peligroso who came in second and Lucky Duck who came in third. release, the California Department of Fish and Wildlife shared that in early April biologists from the CDFW in partnership with the U.S. Fish and Wildlife Ser vice, Reno Office had relocated pupfish from five different habitats in Owens Valley to the River Spring Lakes Ecological Reserve in Mono County. The Owens Pupfish has faced extinction twice, once in 1940 and again in 1969 when fishery biologist Phil Pister saved the pupfish just days before its habitat would dry dried up. For the past five years the CDFW and USFWS have worked to restore the
fish’s habitat, removing non-native species from the reserve, and translocating more than 700 pupfish from Owen’s Valley to several square miles of marsh in the River Springs Lake Ecological Reserve in Mono County. “This release represents the culmination of years of dedication and hard work by numerous former and current biologists,” said CDFW Fisheries Supervisor Russell Black in the June 9 press release. “This population will become the largest and most genetically fit population of Owens pupfish since World War I and is a great victory for conserving the species.” The Owens pupfish is a small thin fish that ranges in color from bright blue for breeding males to brownish with a silvery stomach for females. They congregate in small schools and feed on aquatic insects. The California Department of Fish and Wildlife will be hosting two free fishing days on Saturday, July 3, and Saturday, Sept. 4. On these days, anyone can drop a line into the water anywhere in California without a sportfishing license. The free fishing days are an effort by the CDFW to provide a low-cost way for people around California to give fishing a try without committing to a full license. All fishing regulations, such as bag and size limits, gear restrictions, report card requirements, fishing hours, and stream closures remain in effect on free

fishing days. Every angler must have the appropriate report card if they are fishing for steelhead, sturgeon, or salmon in the Smith and Klamath-Trinity River systems. A full list of regulations can be viewed online at www.wildlife.ca.gov/ regulations or apps.wildlife.ca.gov/ sportfishingregs/. Outside of the free fishing days, CDFW regulations state any person who is 16 years of age or older must possess a valid sportfishing license when taking any fish, shell fish, reptile, or amphibian in California. The CDFW also offers short term fishing licenses for one day or two days for residents and non-residents and 10 days for non-residents.

By Bob Vanian of 976Bite.com The 2021 run of bluefin tuna off the Southern California and Northern Baja coast started in the late winter months and has now carried over through the spring and into the summer. Offshore anglers are not only finding good numbers of bluefin tuna biting but are also catching a nice complementary mix of large bonito and mixed-size yellowtail. As a sign of things likely to come as the summer progresses, the past week also saw a couple of yellowfin tuna caught incidental to fishing for bluefin tuna.

The bluefin tuna have been quality-sized fish that have ranged in size from 18 to 220-plus pounds with most falling within the 30 to 120-pound range. The yellowtail have been mostly 5 to 12-pound fish with an occasional larger fish to 30 pounds also in the mix. The bonito being caught have been jumbo sized bonito that have been in the 8 to 12-pound range. The main bluefin bite area is currently within 40 miles of Point Loma for boats working the waters around and below
say that Marge Brookshire passed away unexpectedly on June 16. Marge was a loving wife, mother, grandmother, and a well-known and respected member of the marine industry on the West Coast. Born in 1946 as a refugee, her family was fleeing the advancement of Russian troops when her mother gave birth to her in a field. They migrated to Brooklyn, New York and in 1972 Marge moved to California where she went into advertising and sales. Marge was a part of the SEA family where she worked in both production and sales from 1975 until 1995, and was considered “the face of SEA” before moving on to yacht financing at Ganis

Boaters can also play their part in identifying an animal in trouble and reporting it to the proper channels that will hopefully be able to help the animal out and lead to a happy ending for our trapped ocean friends. Going back to the boater who spotted an entangled whale, they should start by taking photos of the animal, noting location, time, and the animal’s condition before reaching out to either the Coast Guard through CH16 or calling one of the NOAA hotlines to report it. “The first thing to do would be to call our hotlines and report. We have a network of 15 organizations that are permitted by NOAA to conduct rescue and responses,” said Justin Greenman, California assistant stranding coordinator. “… They monitor those phones 24/7 and they have folks who are able to come out and respond.” Once they call one of the numbers, they will be asked to describe the situation while being as detailed as possible.

Bluefin have been biting during daylight hours but the best bluefin fishing continues to be found during the dark. The bluefin fishing during daylight hours has been improving though and those not wanting to fish during the dark hours have seen their bluefin catches improving when compared to the daylight hours fishing of a week ago.

Marge lost her oldest son Frank in 2019, after a twoyear battle with ALS. After his passing Marge began to suffer from neurological problems and had two brain surgeries in the past two years before her unexpected passing on June 16, a week after her 56th wedding anniversary. Marge is survived by her husband Gary of 56 years, her son Bob, and her grandchildren. A celebration of life celebration will be held on July 10 at 11:30 a.m. at Fairhaven Memorial in Mission Viejo with a reception to follow.
What is not recommended is attempting to help the animal on their own, instead boaters should keep a distance and monitor the situation until help arrives. “It could make things worse,” said Greenman. “Entangled animals are frightened, especially newly entangled animals they can be very erratic in their behavior… In addition, you don’t know what that animal is entangled in, you could potentially entangle yourself. Keep a distance, monitor the situation, and allow the vets and people who are trained and permitted to take these things on.” Once the team arrives, they can successfully assess the situation, determine the best way to untangle the animal, assess its medical needs - if it is a smaller animal like a turtle or sea lion, they can take it in for rehabilitation - and hopefully find the best solution to help. After that the boater can continue on their way, knowing they took the correct steps to assist the animal in need. Reporting these incidents helps NOAA to report and log the incidents to assess how fisheries are doing to lower entanglements and assess other methods to avoid these incidents in the future.
The best bluefin methods have been fishing with 4-ounce torpedo sinker rigged sardines and fishing with Flat Fall jigs. There have also been improving numbers of bluefin biting for those fishing fly-lined sardines and on sardines that are being fished on the surface with a kite. The Flat Fall jigs tend to work best during the dark and the torpedo sinker rigged fished sardines tend to work best during the daylight hours. If sardines are hard to get for bait, anchovies have also been working but anglers have usually had to use the lighter tackle to get the bluefin to bite the anchovies. Private boater Tom Golding of Last Buck reported about fishing on a recent trip to the 371 Bank and the 425 Bank areas. Golding said they started out the day fishing the area below the 371 Bank

» AB 335 – Consumer Privacy: Vessel Owner’s Information
Introduced Jan. 27 by Assembly Member Boerner Horvath (D-Encinitas), Assembly Bill 335 allows manufacturers of recreational boats and marine engines to receive and retain specific contact information for buyers of its products for the limited and exclusive use of conducting product safety recalls and warranty verification. The bill passed the Assembly on May 3 and is now on its way to clearing the Senate. The bill passed a first reading in the Senate on June 21, it will be read two more times and if passed both times, will be headed to the governor’s desk.
» AB 591 – Water Craft Correctable Violations
Introduced Feb. 11, Assembly Bill 591 will allow certain boating law violations - such as an expired vessel registration, not having a serviceable fire extinguisher, not having proper personal flotation devices, or not having a boater card in the operator’s possession – to be deemed “correctable” to encourage operators to remedy issues for the benefit of boater and public safety. The bill passed the Assembly and was ordered to the Senate on April 22. This bill is also on its way to clearing the Senate, it passed a first reading on June 15 and a second reading on June 16.

The bill was amended in Assembly on April 13 to remove provisions requiring all California surface waters attain beneficials uses by January 1, 2050. The amended bill instead required the state board and regional boards to prioritize enforcement of all water quality standard violations that are causing or contributing to an exceedance of a water quality standard in surface waters of the state by January 1, 2023, and required the state board and regional boards to evaluate impaired state surface waters and report to the Legislature a plan to bring all water segments into attainment by January 1, 2050. The amended bill did not pass the Assembly by the June 4 deadline.
» AB 534 - Whale Entanglement Prevention Act Introduced Feb. 10 by Assemblymember Rob Bonta (D-Oakland), this bill would have required all trap and pot fisheries, recreational and commercial, in California to transition to ropeless gear by Nov. 1, 2025 in an effort to eliminate marine life entanglements. An April 26 Assembly hearing was canceled because Bonta, the bill’s author, was appointed the state’s attorney general. Bonta was sworn in as California’s attorney general on April 23, and no other assembly member chose to pick up the bill after his departure and therefore it did not pass the Assembly.
» AB 564 – The Biodiversity Protection and Restoration Act Introduced Feb. 11 by Assembly Members Lorena Gonzalez (D-San Diego) and Ash Kalra (D-San Jose), AB 564 would ensure the goals of biodiversity protection, including 30 by 30, are not just aspirational, but are actually pursued by agencies as an official policy of the state. Callisto held the best corrected time of 08:05:01 and was the first to finish. “The highlight was undoubtedly reaching along the coast north of Monterey, where a fresh thermal breeze close to the shore gave us 27+ knots of TWS and allowed us to hit mid-20s boatspeed,” wrote Jim Murray of Callisto in thoughts shared with the race organizers and posted on the race website. Breezy conditions gave way to light conditions during the second and third legs. Only 14 of the 23 entered vessels even attempted to start the second leg of the series, a 205 nautical mile race to Santa Barbara. Seven of the 14 starters retired. First to finish was Doug Baker’s Kernan 68 Peligroso with an elapsed time of 31:20:37, while Dave MacEwen’s Rogers 46 Lucky Duck won the race overall on corrected time. This year’s race was a much different race than 2019 when the first to finish was just under 15 hours and the slowest boat finished in the course in 27 hours. Light conditions didn’t improve for the third and final leg, a 256 nautical mile stretch to San Diego through the Channel Islands. Thirty of the 33 en-
tries started and 19 ended up retiring with just 11 finishers. Those who went on to battle the conditions to the finish line spent more time on the course than in any year past, according to the race website. “We never seriously considered retiring from the SoCal 300. Most of the crew are veterans of the Chicago Mackinac Race,” wrote Murray. “The SoCal saw the same kind of drifting conditions that often occur during the ‘Mac’…without the biting flies! We were just excited to be out there as a team, logging hours on the boat and getting in practice hours ahead of the Transpac in July.” First to finish and Class A winner for the SoCal 300 was Chris Sheehan’s Pac42 Warrior Won, sailing the course in 2:00:19:05. “This was a great week of sailing coming after three days of breezy practice on San Francisco Bay,” wrote Murray. “It combined a bit of everything. A big breeze sprint, steady breezes and gorgeous scenery down the coast (the reach through the Channel Islands was particularly stunning) and a bit of Lake Michigan-like drifting further south. The parties along the way were a great break post quarantine. We look forward to returning...hopefully when the Pacific High is cranking.”

As such, the application of this body of law is mostly limited to several areas of San Francisco Bay- particularly in Sausalito. The one area of protection that boat owners share with their friends who are renting a landlocked home is the prohibition against retaliatory eviction. A marina may not evict a tenant solely in retaliation for the tenant’s exercise of a legal right. We occasionally see this sort of thing where a tenant reports a marina operator for some form of illegal activity taking place on marina property and the marina responds by evicting the tenant. But this is extremely rare. Based on the information provided by our reader, it appears that he was properly served with a notice of termination of his month to month slip rental agreement. If he refuses to leave the slip after the expiration of the 30-day period he will become a trespasser, at which point the marina may take steps to physically evict the boat, regardless of his liveaboard status.
