Information gathered at twicea-year meetings helps the federal agency to maintain navigational charts and keep track of water levels. By Parimal M. Rohit
WASHINGTON, D.C.—An advisory panel within the National Oceanic and Atmospheric Administration, or NOAA, held a public meeting at the Hall of States in Washington, D.C., on March 5-7, to discuss sea level rise and coastal inundation. Members of the public provided NOAA’s Hydrographic Services Review Panel with input regional navigational services, water levels, global positioning or any other issues associated with sea level rise and coastal inundation. The panel advises NOAA’s administrator on products and services used for global positioning, navigation and water levels/currents. Changes in sea level and more frequent coastal inundation events could alter readings of global positioning and uses of navigational charts. Data and information presented at these public meetings are tools for NOAA; the federal agency uses such data and information in updating coastal and ocean mapping protocols and determining its priorities for the
Arctic region, for example. The panel’s recommendations to the NOAA administrator are partially influenced by what is shared at the public meetings. “The public meeting [focuses] on broad issues related to hydrographic and navigation services, products and data,” the public meeting’s official notice explained about the panel’s goal, March 5-7. Sessions were held on legislative issues and sea level rise. Panel members previously met in August 2018 and discussed the Trump Administration’s Ocean Policy for 2018. They also determined relative sea level rise was third priority on its list of five issues to consider for potential issue papers; autonomous vessels and emerging technologies was the most important priority, followed by quantifying benefits of NOAA’s hydro services. Other potential paper issues were public-private partnerships for a blue economy and enhanced navigational assistance. NOAA’s Office for Coastal Management, separately, publishes several documents on the potential effects of predicted sea level rise as part of its “Digital Coast” initiative. Most documents posted on NOAA’s Digital Coast website focus on predicted sea level rise scenarios in Florida or along the Atlantic Seaboard. There are, however, some documents discussing the prospects of sea level rise in California.

A National Oceanic and Atmospheric Administration panel met with the public in Washington, D.C. to discuss sea level rise and coastal inundation. Data and information gathered at the meeting are used, for example, to update coastal and ocean mapping protocols.
One of those resources – titled “Understanding and Planning for Sea Level Rise in California” – highlighted an interactive sea level rise viewer created by California’s State Lands Commission. Another resource, an official sea level rise viewer created by NOAA, shows the ocean rising by as much as 5.45 feet by 2100 in Los Angeles; Orange County would experience a 5.71-foot increase in sea level, also by 2100. The situation would be slightly direr in San Diego, where the city’s harbor could witness a 5.81-foot increase in
sea levels by 2100, according to NOAA’s Sea Level Rise Viewer. The sea could rise by as much as 6.04 feet at Rincon Island – located in between Santa Barbara and Ventura harbors – by 2100, the Sea Level Rise Viewer predicted. The federal panel regularly receives updates on national and regional navigation services, in relation to sea level rise and coastal inundation. Panel members advise NOAA’s leadership on a variety of issues, such as commercial shipping, marine transportation, ocean and coastal stewardship, recreational boating and safe navigation.

California’s wild succulents are being poached due to Instagram’s obsession, trendiness

BIG SUR—When poaching comes to mind, typically one thinks of harm coming to an animal, such as the saga of the critically endangered vaquita porpoise. According to The Mercury News, however, California’s natural resources are being taken and this is causing danger to one coastal succulent – and the reason behind the poaching is mostly for vanity. The succulents, known as Dudleya farinosa, are being sold on the Chinese and South Korean black markets, where they sometimes sell for $50 a stem. The plant is also called by the common names “bluff lettuce” and “powdery live-forever,” and attracts wild bees and hummingbirds. California’s

One of the fatal flaws, which I think you should have pointed out in your article, is that the applicant for the Poseidon project has not identified the use(s) of the desalinated water created by the Poseidon project. Will it simply be used to recharge local groundwater basins in times of drought (that would be terrific), or will it be used to by new developments? Environmental Impact Reports are required to address the whole of the action. The Environmental Impact Report for the Poseidon project does not answer this question. The applicant has manipulated the description of the project (it’s referred to as piecemealing) and thus far has successfully lobbied to answer this question at a later date (once the facility is built and presumably it’s too late to stop it). Sea lion accessibility solutions? I watch the sea lions frequently. The one thing I noticed is the dock made for them sits higher than the boat docks. I used to see them on their dock but have noticed the sea lions seem to prefer the boat docks. Could it be that the boat docks are easier to get up onto? If it were me, I too would use the boat docks. Maybe some type of device could be attached to their dock to make it easier for them, especially the pups, to get up on the dock. SACRAMENTO—How’s this for a clichéd start to an article: The definition of insanity is repeating the same act over and over again but expecting a different result. Then again “insane” isn’t the best way to describe legislative efforts and a public relations campaign to reform California’s fishing licensing scheme. The better word to use: persistent. California’s angling community lost a legislative ally when Tom Berryhill was termed out of the State Senate in 2018. He had also exhausted his time in the Assembly, meaning the legis-
lator who championed fishing license reform in Sacramento would no longer be around to challenge the regime requiring anglers to seek new permission to fish in state waters at the start of each year. Berryhill, to refresh your memories, tried three times to change California’s fishing license regime. Any fishing license purchased within California will expire on Dec. 31 of any given year, regardless of purchase date. Each of Berryhill’s attempts to change California’s regime to a 12-month fishing license system failed to make it out of the legislature. So here we are in 2019 – Berryhill is no longer in Sacramento but another legislator has picked up the mantle and proposed legislation to do away with California’s calendar-based regime and replace it with a 12-month system. SANTIAGO CANYON—Southern California’s inland boaters expressed a welcome sigh of relief when Lake Elsinore announced the large waterway was officially open to recreational boating activities. Will Orange County’s Irvine Lake one day earn a similar victory? Irvine Lake, which opened in 1933, has been closed to boating and fishing activities since February 2016. A website maintained by Irvine Ranch Water District stated the future of recreational activities at Irvine Lakes remains unknown, since the waterway’s recreational rights are pending a legal transfer to Orange County. (Irvine Co. owns 75 percent of the lake’s recreational rights and is apparently seeking to transfer such rights to the Orange County government; the other 25 percent is owned by Serrano Water District.) The lake was originally built as a water storage venue for nearby farmers, but later evolved into an irrigation facility for avocado orchards and nearly 85,000 homes in Irvine, Orange and Villa Park.

Freshwater anglers used to frequent Irvine Lake for the opportunity to catch catfish, crappies, largemouth bass and trout. An angler from Sylmar made one of the last catches at Irvine Lake – a 10.3-pound largemouth bass caught on creature bait. Also caught at Irvine Lake in its final days as a fishing destination was an 80-pound sturgeon. The lake’s water levels were reaching alarming low levels in 2016, which, in light of the recent streak of rainy days in Southern California, begs the question: What is Irvine Lake’s current water levels and could its days as a recreational boating and fishing destination be revived?

within California’s angling community have long argued. After all why would anglers pay for a license in, say, June, when it will only expire six months later (and purchased at the same price it was offered a few months earlier)? The powers that be, of course, maintain the situation is far more complicated than simply dropping a calendar-based system for one allowing anglers to maintain a fishing license for 365 days. There are administrative barriers, costs, infrastructure issues, etc. Yet a handful of legislators still believe they can break through and achieve fishing license reform before this year is over. Those legislators – Assembly member Jim Wood and more than a dozen co-authors – introduced Assembly Bill 1387 on the legislative floor. Wood and his colleagues proposed to switch California’s fishing licensing system from a calendar-based scheme to 12-month regime. (See FishRap for complete details of the proposal.) Time will tell whether Wood’s proposal will accomplish what legislators ahead of him couldn’t, but groups such as the California Sportfishing League, or CSL, hope 2019 will be different than years past. CSL is quick to point out the need for a 12-month fishing license regime. California, for example, is home to the lowest fishing participation, per capita, in the nation, CSL staff recently mentioned in a released statement. The low participation rate persists despite nearly 60 percent population growth in California since 1980 – a statistic also cited by CSL’s released statement. Yet anglers shouldn’t be hard so hard to find in California, CSL staff point out, as the state is home to nearly 40 million people and features one of the longest coastlines in the country. There are also thousands upon thousands of freshwater lakes, rivers and streams
within California, giving anglers here even more opportunities to drop a line in the water. Why the low fishing participation rates, then? Some of the blame, according to CSL staff, falls on California’s antiquated fishing license scheme. “A leading contributor to declining fishing participation rates is costly fishing licenses that are not valid a full 365 days from the date of purchase,” CSL staff said in a released statement. “California’s calendar-based fishing licenses expire on December 31st of each year, regardless of when purchased. Because most anglers will not pay full price for a license that is not valid a full 365 days from the date of purchase, California Department of Fish and Wildlife … fishing license data reveals that annual license sales peak in the first quarter of the year and then decline significantly by spring, even as weather warms and outdoor activity increases.” CSL staff went on to point out 14 states adopted a 365-day fishing license system, as a direct response to reforming away from calendar-based regimes. “States that offer a 365-day license are outperforming revenue of states that only offer a calendar-based license,” the CSL press release continued. Other statistics shared by CSL staff: • California’s fishing license cost is second-highest in the country (behind Washington state) • The cost of an annual resident fishing license in California has increased 216 percent since 1986 • A fishing license in California costs 110 percent more than the national average. There are certainly other issues affecting fishing participation on California, but could a 365-day (or 12-month) fishing license help buckle the backward trend of angler engagement?

Just a few of the POTUS that visited Catalina were Richard Nixon, a young Ronald Reagan (when he was a radio announcer and had yet to enter into politics) and, pictured here, Calvin Coolidge. Coolidge was the 30th President of the U.S. and was in office from 1923 until
1929. He visited Avalon during the same time period as the Wrigley age, which can be seen in the photo. Coolidge is meeting William Wrigley Jr. and his wife, Ada, at their beloved home (the home currently carries her namesake). One of the most impressive tourist attractions on Catalina, Mt. What Happened: A publication covering convenience stores across the United States published an article on Feb. 15, painting a positive outlook for gasoline fuel blends with 15 percent ethanol – also known as E15. The article, headlined “E15 Poised for Liftoff,” explained E15 advocates are awaiting the eventual rollout of year-round sales of 15 percent ethanol fuels. At least one source in the article stated the current mandate of preventing E15 sales during summer months was disruptive to sales. “For supporters of E15, the 15 percent ethanol blend, its national rollout has always been a matter of when – not if,” the article in cspdailynews.com stated.“With the U.S. Environmental Protection Agency (EPA) promising to have rulemaking that would allow E15’s year-round sale ready before the summer 2019 driving season, that finish line appears to finally be in sight.” CSP Daily News is the publication for convenient stores – CSP stands for Convenience Store Products. E15 sales are limited between June 1 and Sept. 15 every year – only vehicles with flex-fuel engines are permitted to fill up with the fuel during that stretch. Sheetz Inc. Senior Vice President Mike Lorenz said the summer restriction on E15 fuels is unfair to business and confusing to the consumer. More than 200 stations under the Sheetz umbrella offer E15 fuels. “It’s so disruptive to try to sell a product for eight months out of the year. Let’s face it: There’s no other grade of gasoline that has that restriction,” Lorenz told cspdailynews.com.“It’s extremely confusing for the consumer. That would be a huge win that we can sell it year-round like other grades of gasoline.” What’s On Tap: The EPA could be issuing a rulemaking later this year, allowing E15 to be available year-round. Pres. Donald J. Trump advocated for year-round sales of E15 in 2018; his administration submitted a proposed to the EPA for a final rule making toward the end of last year. CHEYENNE, Wyoming (AP)—Wyoming lawmakers took another step toward lowering the state’s legal limit for boating under the influence of alcohol after debating Feb. 28 whether to exempt people using unpowered watercraft and small motorboats. State representatives ultimately decided not to include such an exemption. Operating even the smallest watercraft under the influence can be dangerous, some argued. The proposal, which earlier cleared the Senate 25-5, passed a second reading in the Wyoming House on a voice vote. Wyoming’s current blood-alcohol limit for boating under the influence is 0.1 percent. The bill would reduce the threshold for driving a motorboat to 0.08 percent, the same as Wyoming’s legal limit for driving under the influence. People operating non-motorized watercraft would continue to be subject to the 0.1-percent limit. Lawmakers debated a proposed amendment to the bill to exempt people using unpowered watercraft and boats with motors under 25 horsepower from the boating-under-the-influence law. Some questioned whether a slow-moving boat could be dangerous to others on the water. Even a boat with a small trolling motor could be dangerous to children on board, said Rep. Stan Blake, a Democrat from Green River. “If you’re impaired in a boat, then you probably shouldn’t be on the water,” Blake said. Alaskan officials worried budget cuts may disband Ocean Rangers JUNEAU, Alaska (AP)—The state official overseeing Alaska’s cruise ship monitoring program is concerned about losing independent environmental inspectors on cruise ships. CoastAlaska reports the inspectors, known as Ocean Rangers, are on the chopping block as Gov. Mike Dunleavy’s budget cuts work their way through the legislature. The State Department of Environmental Conservation’s top budget official, Jeff Rogers, laid out the Dunleavy administration’s case for removing inspectors from cruise ships. But those that work in the state’s cruise ship program note that without onboard inspectors, the state’s authority to monitor pollution from ships would be limited. The head of DEC’s cruise ship monitoring program, Ed White, says the Ocean Rangers have been a “critical part” in the permitting process.

LOCAL Dolphin strandings becoming more frequent in Southern California LAGUNA BEACH (AP)—Experts were working Tuesday to determine the cause of an increase in dolphin strandings along the Southern California coast. The Pacific Marine Mammal Center said it has responded to six beached dolphins this month and received reports of two others. Necropsies have been performed on all the dolphins to try to determine the cause of the strandings. The center’s veterinarian, Kristen Sakamaki, said in a statement there were a variety of potential reasons, including viral infections, bacterial infections and toxins. “We may not always get a definitive answer, but we consider our research with these dolphins to be a very important piece to the puzzle in providing clues as to what is going on in our nearshore habitats,” Sakamaki said. The center said that, according to the Southern California Coastal Ocean Observing System, there have recently been blooms of algae that can produce domoic acid, which is toxic for marine mammals, seabirds and humans when ingested. Southern California has also had heavy winter rains that can cause or worsen strandings by flushing excess nutrients and harmful toxins from land into the oceans, the center said. The center said people who see a stranded marine mammal should call in experts and should not touch it or try to help it back into the ocean. The strandings began with three common dolphins beaching themselves on Feb. 4. One washed up dead at Huntington Beach and two more were rescued alive at Laguna Beach but had to be euthanized after examination. A dead bottlenose dolphin washed
ashore at Corona del Mar on Feb. 10, followed five days later by a common dolphin. Both were pregnant. The most recent stranding was a common dolphin at Corona del Mar on Feb. 18.

State Senator introduces a new bill on vessel impoundment Gov. Jerry Brown vetoed the Southern California legislator’s similar proposal in 2017. By Parimal M. Rohit
SACRAMENTO—A state senator from Riverside County hopes to beef up California’s laws governing the impoundment of vessels operated by someone who was convicted of navigating while intoxicated or impaired by alcohol or drugs. The proposal follows a separate bill signed into law in 2018, allowing law enforcement officials to remove a vessel from public property if it was used in the commission of a crime. State Sen. Jeff Stone introduced Senate Bill 393 (SB 393) on Feb. 20; the legislation proposes to give courts the authority to order certain vessels as impounded for one to 30 days. The vessel would be impounded if its registered owner was convicted of a crime and operated the boat while under the influence of alcohol or drug (or both). The influenced operation of the boat must also result “in the unlawful killing of a person.” “The bill would authorize a court to consider certain factors in the interest of justice when determining whether a vessel used in the commission of such a crime shall be impounded,” language of SB 393 stated. Current state law allows peace officers, lifeguards or marine safety officers to remove and store vessels from a public waterway in certain circumstances. The authority to remove vessels from public waterways was authorized by Assembly Bill 2175, which was signed into law in September 2018. This is not the first time Stone proposed legislation on vehicle impoundment; he introduced a similar bill during the 2016-2017 legislative session (Senate Bill 644). Stone’s pro-
posal made it out of the legislature but was vetoed by then Gov. Jerry Brown, who stated the law, if put on the books, would not deter boaters from engaging in illegal behavior. Brown added Stone’s proposal would not enhance law enforcement practices, either. “Boating under the influence is a very troubling crime which exposes the public to grave danger. However, especially in cases where this conduct resulted in an unlawful killing, a defendant will be exposed to very serious criminal and civil liability, including potentially years in prison depending on the circumstances,” Brown wrote in his veto message, which was announced during the summer of 2017. “I do not see the need, in these tragic but narrow instances, to additional expand the powers of government to impound private property as an added punitive measure,” Brown continued. “This bill will not act as a deterrent, and existing criminal and civil penalties are sufficient to address the conduct contemplated.” Stone brought SB 393 to the State Senate floor a few weeks after Brown left the Governor’s Mansion. The question now is whether Gov. Gavin Newsom would view Stone’s proposal in a more favorable light than Brown did (assuming, of course, the bill gets to his desk).
Sea Cucumbers Another proposal on the State Senate floor could extend California’s protection of the sea cucumber for another 10 years. Senate Bill 262 (SB 262) was introduced by State Sen. Mark McGuire on Feb. 12; the bill would allow sea cucumbers to maintain its protected status through April 1, 2030. Current law calls for the state’s prohibition of possession of sea cucumbers aboard a boat or for commercial purposes to expire on April 1, 2020.

IN MEMORIAM: Bill Shakespeare By Parimal M. Rohit
SAN DIEGO—William “Bill” Shakespeare, who held several positions during his 50-year career in the boating industry, died on Feb. 4. Shakespeare had been battling an illness for quite some time. He was 85. Shakespeare made a name for himself selling boats. He eventually connected with John Knight, founder of Knight & Carver, and joined the custom yacht builder for 25 years. Afterwards he moved on to Northern Lights as Business Development Manager before landing at Selene California. Before then he crewed sportfishers navigating the waters between San
Diego and Mexico. It wasn’t long before he was captaining those navigations. At one point Shakespeare was introduced to Bob Peterson, a broker at Fraser Yachts’ San Diego office. Along the way Shakespeare met Interpac Charters founder Bob Parsons (and his wife, Bev) and Mikelson Yachts owner Dick Peterson. Shakespeare spent a lot of time fostering those friendships, according those who were close to him, Shakespeare hailed from the East Coast, graduating from a high school in Hollywood, Florida and the University of Miami. Enlisting in the U.S. Coast Guard brought Shakespeare to the West Coast, where he served at the Point Loma Lighthouse.

Shakespeare spent the final 18 years of his life with his long-time girlfriend, Suiko; she helped take care of Shakespeare during his illness. A private ceremony honoring Shakespeare’s life was held on March 7. His ashes were spread at sea, just off the Point Loma Lighthouse. There will be a remembrance in Shakespeare’s honor held at Fiddler’s Green on March 16 from 1-4 p.m. Fiddler’s Green is located on Shelter Island. Steve Rock hosts the remembrance. Shakespeare’s sons, Doug Shakespeare and Kevin Lanctot, two grandsons Kevin and Jeffrey, and granddaughter Allie survive him.
Lake Elsinore reopens after blue-green algae takeover By Devon Warren-Kachelein LAKE ELSINORE—In its heyday it must have been a grand place to visit, but in recent years Lake Elsinore, the largest freshwater lake in Southern
California, has certainly had its fair share of problems. On Feb. 20, after an extended closure to treat a blue-green algae outbreak, the lake reopened to the public. At one time, Lake Elsinore was one of the celebrity “staycation” destinations for stars of the silver screen and it even had its own answer to the Loch Ness Monster in Scotland – Elsie the lake’s “unofficial mascot.” The lake has faced a terrible drought, low water levels, and higher temperatures, possibly resulting in the algae, also known as cyanobacteria. Lake Elsinore’s fishery also saw overpopulation of threadfin shad, which the city also cites as reasoning behind the algae bloom. Shad feast on zooplankton that in turn feed on algae, disturbing the delicate balance and health of the lake. In 2015, the city of Lake Elsinore began Lake Watch in an effort to protect the lake, which now displays a greenish hue of toxic algae on top of the other problems.

day, it is not enough to offset evaporation,” states the city of Lake Elsinore’s official website. The lake’s water levels declined in 2016, which also coincided with its first algal bloom outbreak. Storms helped to replenish the lake in 2017, but 2018 was a significantly drier year and the algae returned causing officials to shut Lake Elsinore in August. Algal blooms are very dangerous, especially when ingested. Pets and children are most notably susceptible to the blooms since dogs will often groom their fur to remove the scum and children may accidentally swallow water while playing near algae. Algae are becoming a growing problem in many areas of the United States and Southern California is no acceptation. Are abandoned vessels problematic in Southern California? Navy officials report abandoned vessels in San Diego cost taxpayers thousands of dollars in taxes each year.
STATEWIDE—California is one of the largest boating destinations in the country, coming in fourth place. More than 772,000 people have registered recreational vessels, which sparks the question: What happens when a boat is no longer useable, either due to an accident or poor maintenance? Sometimes, instead of paying the fees or seeking legal courses of action to dispose a vessel, it ends up abandoned on one of California’s many waterways. Things can happen on the water, leaving a boat totaled or sunk. However, the damages associated with owning a boat can lead to one deciding to leave a vessel behind. According to California State Lands Commission’s website, “While responsible owners dispose of vessels lawfully, other owners abandon them on state waterways where they impeded navigation, interfere with boating traffic, and as they deteriorate, leach toxic chemicals and fuel into state waterways.”
Vessel Funding by DBW There are several vessel removal plans in California. In a press release by California’s Department of Parks and Recreation, it was announced the state would fund up to $2.75 million to local public agencies to help remove abandoned vessels and keep waterways clean and safe. Funding will come from the Abandoned Watercraft Abatement Fund (AWAF) and will go towards the Surrendered and Abandoned Vessel Exchange grant program, also known as SAVE. During the last fiscal year, in 2018, Division of Boating and Waterways (DBW) also reported it provided $2.75 million in AWAF funds to go toward the SAVE program.

taken advantage of, if that’s the case? “Abandoned and derelict vessels are a pervasive environmental and public safety problem in coastal and inland waterways. Not only are they an eyesore, destroying the beauty of the waterways, but they also pose an environmental hazard by polluting the waterways,” said Ramona Fernandez, DBW’s acting deputy director. The Log contacted representatives for DBW to find more extensive information about which cities take advantage of the grant removal programs, but did not hear back in time for press. If any further information becomes available, it will be posted online at thelog. com or written in an article released in a later issue. Applications for the grant program will be accepted until April 30. The deadline is at 5 p.m.
Problematic in SoCal? In regions such as Sacramento and Antioch, abandoned vessels have become a serious matter. There have been various news reports in recent years in which approximately 250 vessels, some large commercial ships, have been dumped. While abandoned vessels have been reported by multiple news sources to be an issue in the Sacramento Delta Area, where is the funding going in Southern California? The Log has reported on San Diego’s Zuniga Point many times. The area is an interesting one because it was a territory turned over to the United States Navy, who in turn has been working with the Port of San Diego to introduce an ordinance that will prevent others from abandoning vessels in San Diego Bay. However, there has not been much work – at least outwardly – on writing
the ordinance since it was proposed. It’s not just boats that are dumped at Zuniga Jetty – there have been old washing machines and other junk gathering, as the area tended to be a kind of no-man’s land at one time. In a recent report by NBC News San Diego, Navy officials said each time a boat is abandoned and the Navy has to remove it, it costs taxpayers thousands of dollars. An estimate of $20,000 was given by Naval Base Coronado Public Works to remove a single boat. Also, the agency approximated more than 90 tons of debris and 600 pounds of hazardous materials have been removed since 2017. Costs to removed vessels can be very pricy, which could also be one of the contributing factors to why owners sometimes choose to dispose of their boats illegally. According to Trade Only Today, of the 51 commercial vessels that have been abandoned in Sacramento Delta, the cost of removal can sometimes be upwards of $30 million. Because the funding is so limited for removal, oftentimes these boats just remain in the water, where they continue to worsen in condition. To keep the waterways and coastline safe for all other boaters, it’s important to dispose of a vessel in a legal way. At dbw.parks.ca.gov, there is bountiful information about how one can dispose of a vessel in the correct way from recycling/dismantling and through a landfill. Through DBW’s Vessel Turn-in Program, or VTIP, boaters can also make arrangements to surrender their vessel at no cost. Check with DBW or local government agencies to see if your city participates. The Port of San Diego’s Board of Port Commissioners continue to hash out the Port Master Plan, which could dramatically alter the local waterfront. What will the Port Master Plan have in store for San Diego’s boating and fishing interests? Port district staff hopes to receive input from local stakeholders.

SAN DIEGO—The San Diego waterfront could look significantly different as the next few years play out – assuming the local port district develops and executes its developing but ambitions Port Master Plan. Members of the Port of San Diego’s Board of Port Commissioners met on Feb. 25 to discuss the latest update on the developing master plan. Commercial fishing opportunities and configuration concepts of the North Embarcadero section of the port were casually vetted out during the Feb. 25 meeting, which was labeled as a Port Master Plan workshop. Some of the elements of the Port Master Plan include concepts for a commercial fishing pier, recreation open space and water connectivity, a waterfront park and visitor-serving uses on the North Embarcadero. Port district staff ultimately hopes the Port Master Plan would establish the San Diego waterfront as a destination, a “singular waterfront experience, with distinct places and experiences.” The plan’s focus on the North Embarcadero, which includes portions of Downtown San Diego’s waterfront, stems from an April 2017 workshop. A Port Master Plan update held at that time identified the Embarcadero Planning District as San Diego’s “front door,” particularly for visitors who arrive to the city by air, land and sea, according to port district staff. Both the city’s international airport and cruise terminals are adjacent or a short distance away from the North Embarcadero, for example. “Considered the front porch of San Diego, the Embarcadero is a vibrant planning district with broad recreational and access opportunities on the waterfront that also provide economic value for the region and the tourism industry,” port district staff stated in
a report to commissioners. “This area provides a waterfront experience that combines visitor- and maritime-serving uses with working waterfront and water-side activities of commercial fishing boats, cruise ships, and pleasure craft.” North Embarcadero is one of three districts within the Embarcadero Planning District; the other two areas are Central Embarcadero and South Embarcadero. All areas within the planning district support a variety of marine activities, such as recreational boating, commercial fishing, cruise ship docking and sportfishing. Implementation of the Port Master Plan could result in the North Embarcadero being declared as the “Window to the Bay.” Increasing visitor-serving recreational and commercial uses of the North Embarcadero is also a state goal of the Port Master Plan. What those plans look like, however, are still being vetted. The port district has been working on an “Integrated Planning” of San Diego’s waterfront redevelopment since 2013. Port district staff created the Port Master Plan to help realize the planning’s conceptual ideas. “The Port Master Plan update … is a comprehensive, integrated, baywide approach that will modernize our method for land and water planning and serve as a guide for future uses and development of [port] district tidelands,” port district staff stated. “The [Port Master Plan] will connect the tidelands through a series of networks and planning districts. “It will control the allowable land and water uses, including the type and characteristics of development, recreation, and environmental conservation throughout the District’s jurisdiction,” port district staff continued in a report to commissioners. The Port Master Plan is organized into seven sections: land and water use; mobility; coastal access and recreation; natural resources; resilience and safety; economic development; and, environmental justice. Port district staff is expected to return in front of the board again in mid-March and provide additional updates.

Avalon City Council takes measures to regulate sidewalk vendor bill The bill, which decriminalized street vending, put pressure on Avalon to introduce some cityspecific guidelines.
AVALON—Avalon city officials were less than thrilled to learn that former Gov. Jerry Brown had passed Senate Bill 946 decriminalizing sidewalk vendors. During the latest city council meeting, in an attempt to regulate some of the chaos that might be caused by the new legislation, council members introduced a few guidelines. Community Services Director Dan Huncke recounted Avalon officials had made some interim resolutions at the Jan. 15 City Council meeting. The Log covered this subject briefly in the Catalina Connection department. Between the council meeting and when the latest meeting took place, on Feb. 19, Huncke received five applications from parties interested in vending in Avalon. In an effort to regulate some components of the bill, council members received a proposed ordinance to make city-implemented rules around street vending. Eight amendments were proposed in addition to the language of the bill: • Street vending will be prohibited in residential areas • Vending carts must be 20 feet away

from fire-related access areas • Vendor sales can only take place from 8 a.m. until one hour before dusk • Total number of vendor permits cannot exceed 12; six vendors can sell on Front Street, one can sell at each park, and two will be given roaming rights near the beaches • Vending carts must stay 20 feet away from building entrances • The city may require a Livescan background check to operate • The permit process will be for 6
months and include an evaluation period • The bill did not state explicitly how many permits an individual can take out, so there was discussion on this subject. Locals appeared to be divided between opinions about introducing sidewalk vendors. For years, Avalon City Council had dissuaded street vending, even by major business owners in the area. On one hand, restaurant owners and some others were bothered by
several factors, a major one being crowding on Front Street and near the beaches. Avalon is quite busy during the summer season with an influx of visitors from the mainland, cruise ship passengers and many more coming to the island. Some council members and locals were afraid about the visual look of the carts, while others were fearful the carts could potentially interfere with business owners who pay rent to maintain storefronts. At least two residents during the meeting mentioned this could be a good move for the city as it would allow some of Catalina’s youth a new avenue of work, could potentially be a revenue booster and would solve the problem of not having enough places to eat near Avalon’s fuel docks and other less crowded areas. One commenter said she was tired of paying $6 for an ice cream cone and upwards of $50 for a restaurant meal, when street vendors might offer more affordable options; whether the food options would be more affordable, however, is still up in the air. Vendors are also not limited to selling food and can sell souvenir merchandise as well. Overall, will street vendors on Avalon be a pleasant surprise or cause more chaos than it’s worth? There are arguments on both sides that suggest it could be positive or detrimental for the city. Usually there are multiple causes, a series of problems. We’re always doing causal analysis,” she explained. Their primary goal, she stressed, is prevention rather than assigning blame. “We find out why the casualty happened and how to prevent it happening again,” she said. What triggers a full-blown investigation? Following any accident a responsible party – the captain, owner, officer – should call the nearest Coast Guard Command Center via Channel 16 or, in San Diego, 619-278-7033 and in Los Angeles/Long Beach, 310-521-3800. The Coast Guard, working with local authorities, can provide help or assist with search and rescue. SAN DIEGO—Following the ProwlerAttessa IV collision in October 2018, there was much speculation – and confusion – about the U.S. Coast Guard investigation into the incident (technically a “marine casualty”) that it seemed timely to find out what triggers an investigation, who conducts them, what they entail and how outcomes are determined. To learn more, I visited Coast Guard San Diego Sector’s marine safety office and met with their investigations team, Senior Marine Investigator Lt. Cdr. Stefanie Hodgdon, Investigating Officer Lt. Miguel Maldonado and Marine Investigator Greg Cable. We explored their investigatory process, with the understanding they couldn’t discuss open investigations. It’s a small unit, only three persons, with wide responsibilities and a vast geographic range. All of SoCal south of San Onofre plus the entire state of Arizona, including Lake Mead, Lake Powell and much of the Colorado River, as well as marine casualties involving U.S. citizens or vessels on waterways south to Puerto Vallarta, Mexico. Los Angeles/Long Beach Sector serves an even larger area. All such work focuses primarily on commercial vessels. SAN PEDRO—Most Southern California developments, especially near the coast, are making an attempt to capitalize on location, expensive name-brand storefronts, luxury hotels and other upscale amenities. The Wilmington Waterfront Promenade, on the other hand, is one of the few recent development designs attempting to incorporate more green space and community gathering centers. On Feb. 21, Board of Los Angeles Port Commissioners held a special meeting to provide an update on the anticipated Wilmington Waterfront Promenade. Expected to cost $52.7 million, the project is expected to be completed in April 2022. According to Hugo Cisneros, an engineer with the Port of Los Angeles, the port district will advertise for construction in June this year and construction is anticipated to begin in December. OXNARD—Trouble is brewing on the waters of Channel Islands Harbor, as the city of Oxnard has apparently stopped maintaining areas on the waterfront it is responsible for maintaining. The lack of maintenance has purportedly cost Ventura County an estimated $500,000. In July 2018, Oxnard city officials stopped providing maintenance work for its areas of responsibility of the harbor, such as public parks, parking lots, restrooms, lighting, green area watering and landscaping, and more. Harbor Director Mark Sandoval, in a recent letter to the Board of Supervisors, stated harbor staff had immediately assumed the responsibility of harbor maintenance and upkeep following the city’s declaration to no longer do the work. “We could have sat on it, but it would be a disservice to the public,” Sandoval said. At a Ventura County Board of Supervisors meeting in February, Sandoval laid out the cost of the upkeep since the city has abandoned its duties. The cost was $500,000, which was covered by a $9 million reserve fund set aside for capital projects at the harbor. Money from the fund, however, was never intended for ongoing maintenance costs. Sandoval also pointed out the city of Oxnard receives funds through tax revenues for ongoing harbor maintenance and upkeep. Channel Islands Harbor is an enterprise zone and it must be self-supporting. It does not rely on taxpayers for planning, development,

GOLETA, California—The 19th annual Blue Water Ball returns to Santa Barbara on March 16 and will be hosted by Santa Barbara Channelkeeper. This year’s fundraiser is expected to attract more than 250 ocean enthusiasts, business owners, community leaders and public leaders. Environmentalists, sailors, scientists and swimmers have traditionally attended the annual fundraiser; this year’s event includes live music, silent auction, reception featuring local beer and wine, and a dinner. Rick Ridgeway, the vice president of public engagement for Patagonia,
will serve as the fundraiser’s keynote speaker. “During his 14-year tenure at the Patagonia, Rick Ridgeway has worked with teams to develop and launch environmental and sustainability initiatives within the company,” Channelkeeper staff stated in a released statement about the fundraiser. “He was also the founding chairman of the Sustainable Apparel Coalition, and is recognized as one of the world’s foremost mountaineers. “Rick has produced and directed many adventure shows for television, authored six books and magazine articles featured in Outside, National Geographic and Harvard Business Review, and was honored by National Geographic with its ‘Lifetime Achievement in Adventure’ award,” the statement continued. Dana Point Harbor Partners, the “best-in-class” developers tasked with the $330 million project to revitalize Dana Point Harbor, continue the project behind closed doors. By Devon Warren-Kachelein DANA POINT—One of the inevitabilities of waterfront revitalization lies in the changing of the locks. Like anything else, when new management comes in there are bound to be casualties. Through an unnamed source, it was revealed there were layoffs at Dana Point West since the new developers, Dana Point Harbor Partners (DPHP), have decided to combine the East and West basin teams. Included in the layoffs was longtime general manager of Dana Point Marina Company, Doug Whitlock, who previously hinted at change coming to the marina, in an article published by The Log concerning the removal of the boat hoist. Similar to Orange County’s handling of the Dana Point Harbor revitalization project, DPHP are also remaining tightlipped about the project as it develops. The publicity team was contacted for DPHP, but the group declined to comment at press time. However, the team shared that some updates about the project will be available later.

By Devon Warren-Kachelein SANTA BARBARA—Algae and invasive species have certainly been a major theme in the lives of boaters all over Southern California this past year. Boaters in Santa Barbara have received their fair share as well. The Santa Barbara Harbor Commission entertained a presentation by National Oceanic and Atmospheric Administration (NOAA) concerning the findings of Japanese kelp called Undaria pinnatifida. Undaria pinnatifida, most commonly called wakame, is an ingredient found in Japanese cuisine like miso soup and seaweed salad. Wakame has been found in Santa Barbara’s marina since the early 2000s. Dr. Lindsay Marks, a representative for NOAA via Channel Islands National Marine Sanctuary, stated, at the Feb. 21 Santa Barbara Harbor Commission meeting, she believed the kelp had spread to Santa Barbara Harbor by boat. Wakame in the harbor spreads to areas randomly and unlike some other species of seaweed and kelp, has a tendency to sink so it is not always easy to spot or clear away. This lead the NOAA team to believe wakame may have attached itself to the hull of a vessel that travels more frequently such as one of the fishing boats. The spores from the wakame, which allows it to reproduce, are also microscopic in size;
this makes the eradication process very difficult since there has not been a successful method to clean the spores from the waters – however, that’s in the works. “There are certain hotspots in the harbor. It’s really not distributed evenly,” said Marks. Marina 1 and the mouth of the marina, near Marina 4, appear to be the hot spot locations. According to Marks, the kelp has also been found near the Channel Islands including Catalina.

Commissioner Jim Sloan also said it may be worth educating divers about Undaria in preparation for the harbor’s clean sweep event or investigating the effects of anti-fouling paints on the species.
Knowledge for Boaters As with many other problems boaters have faced from invasive species, such as zebra and quagga mussels, NOAA hopes to bring awareness to the problem in case it may worsen or have a negative impact in the future. “The most bang for your buck is to prevent reintroduction and spread,” said Marks. Marks further shared NOAA is taking measures to continue studying wakame, including monitoring it through surveys, research, outreach with boaters and trying to control it. WASHINGTON, D.C.—A landmark outdoor conservation bill is at the White House awaiting approval or rejection, as the House of Representatives joined the U.S. Senate in approving the Natural Resources Management Act, or NRMA, by a 363-63 vote. Senators approved the outdoor conservation bill about two weeks earlier by a 92-8 vote. The only question remaining is whether Pres. Donald J. Trump will sign the bill or veto it and send it back to Congress. Acres of public lands and hundreds of miles of rivers would be protected by the NRMA, should Trump sign the bill into law. The NRMA, which gained House approval ahead of Michael Cohen’s public testimony and Trump’s meeting with North Korean leader Kim
Jong-un in Vietnam, also reauthorizes the Land and Water Conservation Fund. Congress allowed the fund to expire last year after maintaining it for 50 years. There are several fishing-themed topics within the bill, such as protecting public access for anglers and permitting takings of certain fish species. “Congress declares that it is the policy of the United States that Federal departments and agencies, in accordance with the missions of the departments and agencies … [shall] facilitate the expansion and enhancement of hunting, fishing, and recreational shooting opportunities on Federal land, in consultation with the Wildlife and Hunting Heritage Conservation Council, the Sport Fishing and Boating Partnership Council, state and tribal fish and wildlife agencies, and the public,” language of the NRMA stated. The bill would also call for the conservation and enhancement of “aquatic systems and the management of game species and the habitat of those species on federal land, including through hunting and fishing, in a manner that
respects … state management authority over wildlife resources and private property rights.” Closures of public lands for fishing and other outdoor activities were also outlined in the legislation. Some of the other elements of the bill include: • Permanently prohibiting mining in 30,000 acres at Yellowstone National Park • Expanding national parks at Death Valley and Joshua Tree • Establishing a memorial at the Saint Francis Dam site near Santa Clarita • Designating certain lands in the California Desert Conservation Area to be administered by the Bureau of Land Management. The NRMA also renamed nearly 100,000 acres of U.S. Forest Service land in Oregon after Frank Moore and his wife, Jeanne. Frank Moore, according to the legislation, was a World War II veteran who stormed Normandy who also enjoyed flyfishing as a personal hobby. “Frank Moore returned home
after the war, started a family, and pursued his passion of fishing on the winding rivers in Oregon,” language in NRMA stated. “As the proprietor of the Steamboat Inn along the North Umpqua River in Oregon for nearly 20 years, Frank Moore, along with his wife Jeanne, shared his love of fishing, the flowing river, and the great outdoors, with visitors from all over the United States and the world. “Frank Moore has spent most of his life fishing the vast rivers of Oregon, during which time he has contributed significantly to efforts to conserve fish habitats and protect river health, including serving on the State of Oregon Fish and Wildlife Commission,” the legislation’s language continued. “Frank Moore has been recognized for his conservation work with the National Wildlife Federation Conservationist of the Year award, the Wild Steelhead Coalition Conservation Award, and his 2010 induction into the Fresh Water Fishing Hall of Fame.” Sen. CATALINA ISLAND—Every year on Catalina Island, there is a Cross Catalina Hike in honor of brothers Graham “BZ” Jones and Thad Jones. This year’s event, which takes place on March 23, is already full – a testament to just how popular the hike has become. BZ and Thad Jones, however, are names that many are likely to hear, but may not be aware of why their memory is so closely connected to Catalina Island and especially the Catalina Island Conservancy. The Jones Brothers’ legacy and love for Catalina is clear, even after they passed on. Both were world-class sailors. Brad Avery, who is currently a sitting member of Newport Beach City Council and well-known sailor, previously told Catalina Island Conservancy Times Thad Jones was one of the most sought after crewmembers for sailing competitions. Thad held the record for most transpacific races from Los Angeles to Hawai’i, having completed
22 races. Thad, who was attending the Catalina Island School for Boys at Toyon Bay (now gone), was also the first person to map out and complete a cross-Catalina hike. Through Avery’s efforts with Catalina Marineros, this is how the Thad and BZ Jones Cross Catalina Hikes were born. In addition to their sailing feats, the brothers loved Catalina Island and were always willing to volunteer in its name. LONG BEACH—There’s a new sailing school in town and what’s setting it apart from other courses is its practical, on-the-water offerings – not to mention the guarantee if a student cannot pass
a course on the first try, he or she is invited to take the course again for free until they do. Santana Sailing opened a new location in Long Beach, situated in Rainbow Harbor, on March 1. The school is currently offering a variety of courses, from handling heavy weather to chartering. “Long Beach is an ideal location for the sailing school. It’s windier, closer to Catalina, and at a better wind angle than any other harbor,” says Marc Hughston, the school’s sailing instructor with 20 years of experience. Hughston, who has honed his craft as an expert sailor, has a U.S. Coast Guard 100-ton license, and has earned
his ASA, US Sailing, and NauticEd instructor credentials. “I quit everything else I was doing and became a full-time instructor about 4 years ago, because I found that one of the most satisfying things in life is helping others accomplish their goals and dreams in the world of sailing,” Hughston told The Log. “From teaching brand new sailors how to make the boat work for them, to teaching experienced hands how to fly the spinnaker, handle heavy weather, or size up a new anchorage, I love to help build confidence and competence. What’s great is, we’ve made it our business to do exactly that,” Hughston
continues. According to Hughston, there are four main things separating Santana Sailing from the other sailing schools, but what really set it apart is the student’s ability to take courses again for free until it has been mastered. “First, it’s the passion we bring to whole training process. Second, it’s the online knowledge training component and much higher practical standards with the NauticEd system. Third, we offer Guaranteed Practical Competency – you’ll be able to perform the skills to the certification standard, or we’ll bring you back for free until you can. Long Beach YC has invited eight skippers to compete in this year’s Ficker Cup; the eight teams will compete against each other in Catalina 37s. Each boat will be provided with Mainsail, Genoa, Jib and Spinnaker sails. A crew of six, including skipper, will navigate each vessel.

BRISTOL, Rhode Island—The coveted Rolex Yachtsman and Yachtswoman of the Year awards for 2018 will be in the hands of sailors hailing from the East Coast, as Jud Smith and the Cowles sisters claim U.S. Sailing’s top prize, it was announced on Feb. 21. Smith of Gloucester, Massachusetts was recognized for his J/70 World Championship, while Carmen and Emma Cowles from Larchmont, New York collectively won the Yachtswoman of the Year trophy as the International 420 Youth Sailing World Champions. A panel of 28 sailing media members voted on the top yachtsman and yachtswoman, giving Smith 116 points (20 first place votes) to edge out Zeke
Horowitz (Annapolis, Maryland, 86 points, seven first place votes) and Will Welles (Portsmouth, Rhode Island, 50 points, one first place vote). The Cowles sisters, meanwhile, earned 88 votes (nine first place) to finish ahead of Daniela Moroz (Lafayette, California, 82 points, eight first place votes) and Paige Railey (Clearwater, Florida, 82 points, 11 first place votes). Moroz was the only finalist from California and not from the East Coast. Smith, at age 62, is the oldest winner of the Yachtsman of the Year award. The Cowles sisters, meanwhile, are the second youngest winners of the Yachtswoman of the Year award, winning the prize at age 18. Moroz is the youngest winner of the award, claiming her Yachtswoman of the Year title in 2016 at the age of 16. Davis did reel in a 14-pound lingcod while fishing the Outer Island area of the Channel Islands. SACRAMENTO—Will a new batch of legislators produce different results? State Sen. Tom Berryhill is no longer serving in Sacramento as a legislator yet the fight to make the 12-month fishing license a reality in California continues – and this time it’s Assembly member Jim Wood, D-Santa Rosa, who’s picked up the torch. Wood introduced Assembly Bill 1387 (AB 1387), calling for California to drop its calendar-based fishing license scheme in favor for a 365-day system. All sportfishing licenses in California expire on Dec. 31 of the year it was purchased, regardless of purchase date. Wood’s bill, if signed into law, would
allow anglers to maintain their license for 365 days from the date of purchase. Assembly member James Gallagher, R-Yuba City, and 12 other legislators representing both parties co-authored the bill, which was also sponsored by the California Sportfishing League (CSL). AB 1387 proposes to eliminate California’s calendar-based fishing license scheme and replace it with a 12-month regime. Anglers would pay the same fee for the 12-month license as they would under the current calendar-based scheme. The proposal also calls for California Department of Fish and Wildlife to create a mobile application for anglers to view sportfishing and hunting licenses on their respective devices. Automatic license renewals could also be in effect should Wood’s proposed legislation, as introduced, becomes law. CSL, in a press release, state an automatic renewal system in Florida resulted in a four percent

It was built in 1960 as part of the San Diego Aqueduct project. Fishing takes place year-round at the reservoir. The freshwater venue is stocked with bluegill, channel catfish, crappy, largemouth bass, sunfish and trout. GOLETA—A fish seldom found in the Northern Hemisphere was found beached on the shores of Goleta in late February. Coal Oil Point Reserve, which is located at U.C. Santa Barbara, earned its 15 minutes of fame on Feb. 27 after a hoodwinker sunfish (Mola tecta) was found on its shores. The species was discovered only in 2017 and was never been observed in the Northern Hemisphere before the beaching event, according to a story published by Shelly Leachman in U.C. Santa Barbara’s The Current. Marianne Nyegaard, who is considered an expert on the Mola species, first discovered hoodwinker sunfish. She is based out of Murdoch University in Perth, Australia.

NOAA received petition to ban certain fish imports from New Zealand WASHINGTON, D.C.—The National Marine Fisheries Service (NMFS) and National Oceanic and Atmospheric Administration (NOAA) announced they have received a petition for emergency rulemaking from Sea Shepherd. The petition seeks to ban imports of fish and fish products from New Zealand – specifically those imports not satisfying the Marine Mammal Protection Act (MMPA). The petition was submitted in hopes of protecting the Mãui dolphin. The U.S. Department of Commerce was specifically petitioned “to ban importation of commercial fish or products from fish that have been caught with commercial fishing technology that results in incidental mortality or serious injury of Mãui dolphin in excess of United States standards,” the notice of rulemaking stated. Those campaigning NOAA to protect the Maui dolphin stated: “The petition requested that the relevant secretary ban the importation of all fish and fish products caught in set nets or trawls inside the Mãui dolphin’s range and from either the west coast of New
Zealand’s North Island or the Cook Strait, unless affirmatively identified as having been caught with a gear type other than set nets or trawls or affirmatively identified as caught outside the Mãui dolphin’s range.” Petitioners stated the Mãui dolphin population was at 2,000-some in 1971 but dropped to 111 in 2004 and 55 in 2011. “The petitioners maintain that any fishery using set nets, trawls, or gillnets in the Mãui dolphin range along the west coast of New Zealand’s North Island violates U.S. standards under the MMPA. The petitioners provide a list of 11 fish species harvested within the Mãui dolphin range by set nets, trawls, or gillnets that are potentially imported into the U.S. as fish or fish products,” the formal petition stated, according to NMFS.
