The Star of India Will Celebrate Its 160th Birthday with Celebration Sail

SAN DIEGO — On Nov. 11-12, the Maritime

Museum of San Diego will sail the world’s oldest active sailing ship, Star of India, a historic vessel.

The Star of India was built 160 years ago, in 1863, on the Isle of Man and originally named Euterpe, after the Greek goddess of music and poetry. She has circumnavigated the globe 21 times. Iron ships were experiments then, with most vessels still being built of wood. Within five months of laying her keel, the ship was launched. Over the years, the vessel has served various purposes, including transporting emigrants to New Zealand, carrying cargo and even being used as a salmon fishing and processing ship in Alaska. In 1871 she was purchased by the Shaw Savill line of London and embarked on a quarter century of hauling emigrants to New Zealand, sometimes also touching down in Australia, the U.S. West Coast and Chile. Some of these voyages lasted up to a year in harsh conditions, with the little iron ship fighting through extreme storms, “laboring and rolling in a most distressing manner,” according to her log.

Life aboard was tough on those cramped inside her ‘tween deck, fed a diet of hardtack and salt junk, subject to mal-de-mer and other ills. Astonishingly, their death rate was low. They were a tough group, nevertheless, drawn from the working classes of England, Ireland and Scotland, and most went on to prosper in New Zealand. According to the Maritime Museum of San Diego, Euterpe, a full-rigged ship, would remain so until 1901 when the Alaska Packers Association rigged her down to a barque, her present rig. She began her sailing life with two near-disastrous voyages to India. On her first trip, she suffered a collision and a mutiny. On her second, a cyclone caught Euterpe in the Bay of Bengal, and with her topmasts cut away, she barely made port. Shortly afterward, her first captain died on board and was buried at sea. After such a hard luck beginning, Euterpe settled down and made four more voyages to India as a cargo ship. In 1926, the Euterpe was retired, and in 1927, it was acquired by the Zoological Society of San Diego (now the San Diego Zoo) to be part of a new marine exhibit. It was restored and renamed the Star of India in honor of the annual San

The 19th century was a time of rapid industrialization. With advancements in iron production and manufacturing techniques, it became more feasible to construct ships such as the Star of India from iron. special events and educational programs. The vessel has been seasoned with a newly trained sail crew r e a d y for t he e x p er ienc e , which was delayed due to the pandemic. It’s been five years since Star of India last sailed on Nov. 17 and 18, 2018. Plans call for a San Diego Bay and at-sea parade of the museum fleet, including historic visiting vessels to surround Star. In some cases, there will be opportunities for the public to purchase tickets and share the water for this monumental occasion. “Star of India is an icon in San Diego, and this birthday celebration is a day to honor all supporters, including volun-

teers, members, donors, staff, educators, students, partners, and the out-of-town visitors and locals that support our mission with attendance and participation in the museum experience,” Raymond Ashley, the president a nd CEO of t he Ma r it ime Museum said in a news release. Included in the 160-year birthday celebration for Star of India will be the appearance of the newly restored figurehead Euterpe. It was unveiled last year and led by long-time Maritime Museum volunt eer G eorge Sutherland, while surrounded by sailing, maritime history enthusiasts and visitors gathered at the Maritime Museum for the vessel’s 159th birthday celebration. Two of the participating vessels are the Californian, the official tall ship of the state, and San Salvador, the 1542 Spanish galleon replica built in San Diego by staff and volunteers. A third visiting vessel, the 136-foot gaff-rigged schooner Bill of Rights, will also take on passengers for this special occasion. While at sea, Star of India will perform maneuvers, and when possible, Californian and San Salvador will sail close by. At 3 p.m., Star of India, Californian and San Salvador will assemble at the entrance to the bay. Star of India will secure her berth at the Maritime Museum at 5 p.m.

LOCAL Iconic Imperial Beach Pier Will Undergo Structural Updates SAN DIEGO — The Port of San Diego Board of Port Commissioners has approved a $1.5 million utility piping and pile replacement project at Imperial Beach Pier. This project will enhance the safety, functionality and longevity of the pier.

The key components of the project include the replacement of two piles, retrofitting utility line support systems, routine maintenance, repairs to utility lines and conduits, rewiring lighting and electrical panels, corrosion removal and coating and architectural work for enclosure and protection of the electrical room. “For us locals, having a landmark like IB Pier is something we take pride in,” said Dan Malcolm, a member of the Port’s Board of Port Commissioners, in a press release. “These improvements and the years of projects and investment the Port has poured into this iconic pier will ensure it continues to be a part of the fabric of IB culture and draw visitors to our waterfront for many generations to come.” In addition to approving the project at its Oct. 10 meeting, the board also awarded the construction contract to Reyes Construction, Inc. This repair project is the latest in a series of investments the Port has made in the Imperial Beach Pier. Since 2020, the Port has invested approximately $3.5 million in the pier. Recent upgrades include: • An artistic shade canopy in a sharkand-water design over the pier extension at mid-pier just across from the public restrooms (pictured above). • The wood railing around the old boat loading ramp area near the Tin Fish Restaurant. It was replaced with a stainless-steel cable railing for improved ocean and beach views. • A r t i s t ic a l ly de sig ne d a c t iv it y placards installed along the railings. These display different fun sayings or slogans associated with the activities to be enjoyed on or near the pier – fishing, surfing, lounging and beaching. Examples include: • Good Things Come to Those Who Bait • Enjoy Life One Wave at a Time • Life at Ease with an Ocean Breeze • High Tides and Good Vibes • Markers every 250 feet to mark the distance to the end of the pier and encourage guests to walk the entire length of the nearly 1,500-foot pier. • Surf destination arrows on the railing at the end of the pier, marking the distance and direction to legendary surf spots. • Fresh paint and murals.

• New fishing rod holders. In addition to the improvements already completed, a third phase of work at IB Pier costing $3 million was approved by the board in August. Work on phase three is expected to begin in the summer of 2024. It will include the installation of a new pier deck extension, shade canopy, structural support, additional lighting and utility improvements, bringing the total investments in the pier to $6.5 million. The upcoming repair project will require a temporary pier closure for up to 14 days. Per California Coastal Commission requirements, the closures may only occur during the work week, and

Should My Yacht Club Include a Liability Waiver for Races? 2C DARK BKGND

QUESTION:

I am on the race management committee for my yacht club and our committee is concerned about the exposure of the club and its volunteers to liability during races and other events. We have considered asking participants to sign a waiver but some of our members have questioned whether that kind of waiver would be enforceable. Other members contend that all participants in a sport such as yacht racing automatically assume the risk of injury, and to complicate things even further, we have learned that the Racing Rules of Sailing prohibit the use of liability waivers in race documents. ANSWER: Our reader is basicallyBWasking whether his yacht club should include a liability release in its race documents. The short answer is yes. The question of whether that release will be frowned upon by the sailing community is a lot more complicated, as is the question of whether the release will be enforceable. Let’s start with our reader’s reference to competitors automatically assuming the risk of injury through their participation in the event. The “Assumption of Risk” doctrine provides a defense against a lawsuit where the injured party knowingly participated in a dangerous activity and was injured in a way that he or she could have reasonably foreseen. I should note that the application of this doctrine under maritime law will differ from a case decided under California state law, but we’ll save that discussion for another day. Assumption of Risk cases usually arises in the context of an employment or sporting or recreational activity, where the nature of the activity may give rise to certain obvious risks. For example, under this doctrine, a lion tamer who is employed by a circus may not be able to sue the circus if he gets bit by a lion. The doctrine sounds simple enough, but the application of the doctrine can be complicated when the scope of risk within the activity is ambiguous. For example, looking at our lion tamer, he could have anticipated the risk of a bite from the lion, but what if he was injured instead when the circus tent collapsed? Assumption of the risk does not provide a defense where the injury was outside of the reasonably anticipated risks associated with the activity. The question of whether a risk should have been “reasonably anticipated” will invariably lead to litigation, and this is where a written liability release may help race organizers to limit their liability. Unlike the A ssumption of R isk doctrine, courts have consistently upheld written liability waivers in a recreational maritime context, so long as the language of the waiver is clear, unambiguous, and prominently positioned on the document. Courts have distinguished this defense from the Assumption of Risk doctrine because the waiver is a form of contract which can be freely accepted or rejected by the participants on both sides of the equation before anyone leaves the dock. Many liability waivers or release documents also include language which requires the participant to “indemnify” the race organizers against third-party claims. An indemnification agreement goes beyond a simple release or waiver of liability, in that it also requires the participant to defend the race organizers against claims brought by third parties. This seems a bit onerous at first, but it is often necessary to bring crewmembers under the liability release umbrella since they don’t usually sign the race entry form. A carefully worded indemnification clause that is narrowly tailored to meet this objective will not expose competitors to claims brought by unrelated third parties. An unambiguous and properly worded liability waiver will go a long way toward easing the concerns of our reader and his fellow committee members, but he points

out that U.S. Sailing does not encourage the use of these waivers. US Sailing is a Rhode Island-based organization that is the national governing body for the sport of sailing in this country. Their responsibilities include the enactment of rules (“prescriptions”) to supplement the international Racing Rules of Sailing for events conducted in the United States. US Sailing prescriptions include Rule 81 (formerly Rule 82), which prohibits the use of indemnification or liability release agreements by race organizers, and their website includes a section where they describe liability release documents in very scary terms. In my opinion, their description is inaccurate, and both the Racing Rules of Sailing and the US Prescriptions allow race organizers to waive the prohibition against the use of these documents. The bottom line is that the mission of US Sailing is to protect the interests of racers - not race organizers. But again that’s just my opinion. Before closing, we should take a quick look at the actual language of a liability release. When a party in any endeavor seeks to reduce or eliminate its liability for injury or damage in that endeavor, the party faces a complicated maze of rules and restrictions. This puzzle is considerably more complicated when that endeavor takes place on the water. Written liability waivers require specific language that may not be available through a “copy and paste” exercise from a random document found on the internet, and failure to use the correct language will render the document ineffective. The 10 Best Pleasure Stops for Winter Cruising in Mexico

Here are Mexico’s 10 best pleasure stops for winter cruising. Most have pristine spots to anchor; others have marinas, yacht services and rich local culture. that run just behind the 30-mile barrier island of Isla Magdalen. Anchor at Man of War Cove inside the north end of Mag Bay, take your dighy on the first leg of the channel toward Puerto San Carlos, but branch off toward Puerto Lopez Mateos. Get out before dusk, because it’s not well marked and unlighted. 5 La Paz, the capital of Southern Baja, is the primo provisioning stop, so stock up before heading into the Sea of Cortez. Six big grocery stores have excellent produce and separate delis for breads, cheeses, meats and salads. Tell them you’re on a boat, and they’ll box your bags for easier handling. Home to the largest liveaboard boating community in Mexico, La Paz has six nice marinas, four fuel docks, the morning VHF net, and the ever helpful Club Cruceros de La Paz. 6 Mazatlan’s Centro Histor ico (Historic Downtown) around shady Plaza Machado is 20 square blocks of 1840s Victorian Italianate mansions, now fully restored and turned into gourmet restaurants, sidewalk cafes, art galleries, boutique shops, trendy apartments, ballet studios and the Peralta Theatre. My favorite eatery, Topolo, has a tropical fusion menu and grinds your choice of ingredients for your personal salsa at your table – muy shi shi. As the year 2023 draws toward a chilly close, winter cruising season along Pacific Mexico is just warming up. What a pleasant coincidence! Escape Plan: Yes, those na st y Alaskan cold fronts are already blasting frigid air and heavy seas all down the West Coast, so we SoCal pleasure boaters are developing our Escape Plan: finish up boat tasks and head south into Mexican waters. On our way down Baja, we’ll start working on our swim-suit tans as soon we pass the Tropic of Cancer (23°27’N). All we’ll have to do after that is hunt for the sweetest little anchorages, the friendliest resort ports, the hottest fishing holes, the clearest diving reefs and the tastiest Margaritas. Que bueno, no? Where will you find all that? Well, I have personally examined every inch of Mexico’s 3,800 nautical miles Pacific coast in the course of my own sail cruising, delivering power yachts with my husband, and constantly researching for my nautical guidebooks. So I can save The Log readers mucho time and energy. Get out your overall planning chart and circle these 10 pleasure stops for winter cruising. Each is unique and pleasurable for different reasons. Let’s look at them in geographic order from the U.S. border southward. 1 Ensenada, only 60 n.m. into Baja, is the easiest and first Port of Entry, has three major marinas and one fuel dock. Better yet, Ensenada is the gateway to the Guadalupe Valley, Mexico’s fabled wine country. I recommend touring a few of the 23 award-winning vineyards; view rolling hills of vines, inspect the presses and barrels, then taste around to discover your favorites and stock your larder. 2 Turtle Bay, half way down Baja, has 340-degree anchoring shelter from storm winds and seas, so it’s the safest weather refuge in this region. Anchor off the town in prevailing northwest winds, off the south end in south wind, off the east beach in a Santa Ana blow. Turtle Bay is also the only place within 280 miles for yachts to get diesel and gasoline on a regular basis. Two popular eateries line the town beach, and stroll a few blocks inland to check out the grocery stores. Visit the abalone farm on the east end of town. 3 Abreojos is “ground zero” for watching California gray whales spout, sky hop and cavort in mating rituals, while a dozen or more mamas give birth to 300-pound babies inside shallow San Ignacio Lagoon National Whale Refuge. Anchor just west of Punta Abreojos and flag down a naturalist guide or park ranger to take in their special pangas inside the whale park for a whole or half day expedition. “Friendlies” are momma whales that bring their babies right to you for a gentle pet and photo. 4 Magdalena Bay is the coolest place for a 20-mile dinghy exploration of red mangrove forests and tall white sand dunes on narrow twisting channels

Nice balance. 10 Ixtapa, for boaters, refers to a nice 600-slip marina and 18-hole golf course that, in the 1980s, were both carved out of an ancient tropical jungle. Sport fishing and diving are superb around the Islas Blancas near the marina entrance. But for jet setters, Ixtapa refers to a beach resort built in 1975 on sparkling white sand, quickly covered with tall hotels, flashing disco bars and an active (noisy) night life. In contrast, tranquility prevails over Marina Ixtapa and the golf links. They’re so quiet and lushly landscaped that all the native wildlife still thrives – including a few large crocodiles! The marina, Pemex dock and boat yard are excellent, highly recommended. But, honestly, don’t let small pets walk these docks, because the crocs have been known to grab them. Division of Boating and Waterways Offers Floating Restroom Grants to Help Keep California’s Waterways Clean

North Atlantic right whales are approaching extinction, and vessel strikes are one of the leading causes of mortality and serious injur y for the species, according to NOAA. Right whales have been experiencing an Unusual Mortality Event, a term used by NOAA to describe a significant and unexpected increase in the number of marine mammals, birds or fish that are found dead or dying in a specific area or region, since 2017. The leading cause of these deaths is human interaction, specifically from fishing gear entanglements and vessel strikes. NOA A Fisheries and its partners are dedicated to conserving the North Atlantic right whale population. The speed zone dashboard enables NOAA to monitor the effectiveness of its vessel speed regulations. Most vessels 65 feet or longer must travel at 10 knots or less in specific locations called Seasonal Management Areas. This reduced speed lowers the threat of vessel collisions with endangered right whales. Because vessels of all sizes can strike a whale, NOAA also encourages vessels less than 65 feet long to slow to 10 knots or less within these seasonal management areas as well. NOA A proposed changes to the right whale vessel speed rule to reduce the further likelihood of mortalities and severe injuries to endangered right whales from vessel collisions. In addition, NOAA accepted public comment on the proposed rule until Oct. 31, 2022, and anticipates taking final action on the

California State Parks’ Div ision of Boating and Waterways (DBW) is accepting grant applications from government agencies for the purchase and deployment of floating restrooms on waterways with limited landside access. Federal and state funding of $1 million is available for approximately four Americans with Disabilities Act (ADA)-compliant floating restrooms. Interested applicants to the Floating Restroom Grant Program are encouraged to review the grant guidelines and submit a grant application to DBW by 5 p.m., Nov. 13. The program is available through the Clean Vessel Act, funded by the U.S. Fish and Wildlife Service’s Wildlife Sport Fish Restoration Program and the Harbors and Watercraft Revolving Fund. About 135 restrooms are currently deployed across California. A California State Parks engineering group designed the units available for the 2023/24 grant cycle. Each ADA-compliant unit can be towed to shore for scheduled pump-outs or pumped out on-site by pump-out boats. “We encourage public government agencies to join us in the effort to reduce pollution on California’s waterways,” said DBW’s Deputy Director Ramona Fernandez in a news release. “The floating restrooms are solar-powered and the holding tanks capture about 500 gallons of sewage. That’s over 1 million gallons of sewage out of the state’s waterways each year.” To be eligible for funding, grant applicants must operate on a California lake or reservoir open to the public. The competitive grant applications will be scored and ranked according to need, as well as the ability to operate and maintain the floating restrooms for at least ten years. Offshore Wind Power Signed into Law In a major boost for advocates of alternative energy, Gov. Gavin Newsom signed Senate Bill 286 on Oct. 7, authorizing offshore wind generators to be erected along the California coast. This long-awaited legislation, supporters argue, is a major leap toward weaning the state off fossil fuels and enhancing the use of alternative sources to bolster electrical infrastructure. The legislation, proposed by state Sen. Mike McGuire (D-Healdsburg), is aligned with the California Coastal Act of 1976, which requires any development along the coast or in coastal waters to gain prior approval from the California Coastal Commission. Naturally, passage of SB286 is only an initial phase of extensive coastal planning designed to embrace the needs of commercial, tribal and recreational fisheries, along with other interests, along the California coast. The bill requires the drafting of a coastal strategy by Jan. 1, 2026, and passage of the plan by May 1, 2026, thereby allowing corporations and public utilities to apply for approval of their wind generator installation plans. SB286 is a critical step in fulfilling the 100 Percent Clean Energy Act of 2018, which raised California’s Renewables

Portfolio Standard (RPS) goal to 60% by 2030. Zero-carbon resources must supply 100% of California’s retail electricity sales and electricity used by state agencies by 2045. Whether this is achievable is yet to be seen, but the windmill farms will certainly be a major jump toward reaching those goals. A lthough the bill does not specifically address these concerns, it does allow for “reasonable compensatory mitigation for unavoidable impacts associated with offshore wind projects.” The wording here is rather vague, allowing for the possibility of litigation from any individual or group claiming injury or financial loss from the wind generators. Poseidon AmphibWorks is Combining Cars, Boats and Hydrofoils for the Next New Mode of Transportation Poseidon AmphibWorks is developing an innovative Car-Boat EV Hybrid, a practical solution for land and water travel, recreation and more.

“Electric marine is growing tremendously around the world because of a couple reasons,” said Tice. “People want to get rid of pollution in the water and in the air [and] electric hydrofoil are the top of the game. Our boat is only electric power, so it is designed to get the boat up out of the water with all electric – no gas – and it allows us to compete against gas boats. Electric hydrofoil is the turning point that allows electric marine to finally compete and displace gas.” The vessel features “pontoon boat” like features, electric all-wheel drive (AWD) drive, and 5-inch to 12-inch adjustable height suspension, making it “light off-road” capable. The hydrofoil system allows for a smooth and efficient ride on water, providing a unique transportation experience. The body of the amphibious car is comparable in size to a Tesla Model X, making the Trident easy to store in a typical home garage. As an electric three-wheel reverse trike autocycle, Trident’s powertrain will have a combined projected highway/city range of at least 220 miles, a top speed projected of 100 miles per hour, and an estimated acceleration from 0-60 mph in less than five seconds. Trident’s suspension will be automatically lowered to 5 inches for ground clearance at speeds over 45 mph. Poseidon AmphibWorks is predicting the vehicle will have lower drag and enhanced handling. The interior of the vessel features a center driver seat and two rear seats, as well as a fold-down center seat.

The mode is available on the central touchscreen to allow safe flat-towing. However, as of the release date, that capability still needs to be supported, and no other EV backs the feature today.

Trident LS-1’s projected range as a watercraft is expected to be 60 miles at 25 mph or 22 nautical miles per hour cruising speed, with lower rates lasting slightly longer but still on foils. The vessel uses strut-mounted hydrofoils that slice through the water, lifting the vehicle out of the water rather than pushing a large hull. This feature allows significantly more battery range on a smaller electric powertrain due to water drag reduction from 60-80% compared to a non-hydrofoil electric monohull boat. Trident is projected to have a top speed of 35 mph

without the hydrofoils. When the foils are fully extended, the vessel is expected to endure waves of up to 4 feet. Trident is also envisioned to reduce city commute time by bypassing congested highways in cities constructed with canals and waterways. While being a functional vehicle for the streets, the hydrofoil system will give riders a “magic carpet ride” like transition in most water conditions.

SAN DIEGO — Poseidon AmphibWorks, a transportation technology startup formed by Steve Tice, a developer and electric vehicle enthusiast, and Andy Langesfeld, a captain and consultant on amphibious vehicles, announced plans to launch its new electric high-performance amphibious hydrofoil vehicle, Trident TS-1, with many potential uses. The innovative car-boat hybrid has the potential to be a practical solution for land and water travel, recreation and other operations such as tourism, offering a smooth transition between water and land. The Trident LS-1, a design that is reaching the prototype stage and has been in the works since 2021, will be legal to drive on the highway and land and marine certified for traveling on water.

the Trident in one position and pointing in one selected heading, eliminating the need for a heavy anchor. This feature can be convenient for newer boat captains. The vessel will be equipped with saltwater corrosion-resistant composites and metals like marine aluminum 5xxx and stainless-steel grade 3xx; the composites will be the materials that prolong the life and quality of the vessel. Marine-grade aluminum from the 5xxx series refers to aluminum alloys known for their excellent corrosion resistance, making them particularly well-suited for marine applications whereas marine-grade aluminum alloys from the 3xxx series are known for their excellent weldability, corrosion resistance and formability, making them suitable for various marine applications. The Trident can be stored in a typical home garage, and unlike a boat, it requires no trailer. As a convertible multi-mode/ application amphibious vehicle with user-friendly flight-controlled hydrofoils, the Trident is targeted at a ticket price from $95K-$100K. Trident LS-1 can be registered as a motorcycle or autocycle due to its three wheels and the inclusion of all required features in most regions. This minimizes considerable development costs and regulatory requirements; however, Poseidon AmphibWorks says the vehicle will have advanced safety features as its design is an uncomplicated, non-tilting, reverse trike three-wheeled chassis with a safety cage and one electric motor per wheel. Users will be able to drive the amphibious car directly into the water from launching ramps. In shallower waters, it can travel like a regular electric boat using all four electric thrusters mounted on the bottom of the retractable foil struts. Once the water is deep enough, the hydrofoils extend down, and at 12 mph, the hull will rise from the water and the flight control system will maintain stability, coordinate banked turns and so forth at speeds of up to 35 mph. Poseidon AmphibWorks is predicting future upgrades that will include automatic docking.

Because water resistance is so great, battery-electric boats typically provide little reasonable range when pushing a large hull through the water, unless they have considerable battery packs. Hydrofoils have much less drag because the hull is out of the water. Poseidon AmphibWorks believes LS-1 is the first electric amphibious vehicle to attempt to incorporate hydrofoil technology. Tice and Langesfeld believe the Trident can potentially impact transportation such as ride-sharing, water taxis and cargo, and also help with bypassing traffic, while benefitting recreational markets and search-and-rescue operations. The San Diego-based startup predicts that amphibious vehicles will be a key component in adapting to a world altered by climate change and can help the economy flourish through recreational and eventually commercial profits. “Having an amphibious vehicle that can be used for commuting and as family recreation can also be a lifesaver when the unexpected happens,” said Tice, in a statement. He explained though that amphibious vehicles on the market today are all fossil-fuel powered, with limitations. For instance, they might be great for offshore performance, but only legal for light off-road use, or low performance on both water and land, or highway legal, with good performance on water and limited applications. They also are all very expensive. “The Trident LS-1 represents a new mode of practical future transportation,” he said. “It is a testament to our commitment to creating sustainable, efficient, versatile vehicles that represent a real value proposition to a broader group of customers that will change the way people travel in many (water) adjacent regions.” Poseidon AmphibWorks believes that if it can get full funding by the end of 2023, that consumers can expect to see a close-to-production prototype of Trident LS-1 within 18 months. Catalina Connection Catalina Museum for Art & History Celebrates 70 Years with 70 Rare Objects C ATA L I NA I SA L N D — In honor of the

Catalina Museum for Art & History celebrating its 70th Anniversary, the museum has ventured into its vault and selected 70 objects that showcase the rich heritage of the island which have been safeguarded for seven decades. The exhibit is a captivating blend of artifacts, stories, and art that have shaped our institution. The exhibit is called the Cabinet of Curiosities, and it consists of 70 objects so rare and absurd, that many have never been exhibited publicly. The exhibit is a journey through the Island’s history, showcasing curious and odd artifacts, photos, and paintings that tell the intriguing story of Catalina Island and its connection to early California history. “We’ve gone through our vault and carefully selected the 70 objects featured,” said Gail Fornasiere, Deputy Director of External Affairs for the Catalina Museum for Art & History. “Some are new acquisitions some have been in the collection

from the very beginning. In fact, we are displaying the very first item in our collection: an abalone shell. A number of these artifacts have never been or rarely been exhibited in our 70 years.” Highlighted pieces include: Frances G. Lauderbach Paintings. Born in 1867, Frances G. Lauderbach was an exceptional artist renowned for pioneering underwater painting. Settling in Pasadena in 1886, she refined her skills at Stickney School, becoming a key figure in LA’s 1920s-1930s art scene. A devout Quaker, Frances embraced a simple, unmarried life without modern conveniences. She was known for her ‘underwater’ paintings. Some were painted while in a glass bottom boat, and others were painted after hours at the aquarium in Avalon at the time. Those paintings gave life and color to something that most would only see in black-and-white photographs. Gift of Oliver S. and Catherine MacLean Loud. Other treasures include the First Letter, 1826. Sailing The Second America’s Cup Preliminary Regatta Will Sail the Red Sea from Nov. 29 to Dec. 2 By: LOG STAFF

The goal of One Design racing is to create a level playing field where the skill and tactics of the sailors, rather than technological advantages or variations in the boats, are the primary factors in determining the winner.

The format calls for the six teams to contest eight fleet races starting on Nov. 30. Jeddah is just the second event in which the defender, Emirates Team New Zealand, will race against all five challengers. The final scheduled phase of the event is the final - contested between the top two teams in a winner-takes-all one-onone match race. There is a distinction between the six teams. Some own two AC40s and can sail against each other, and those with only one AC40, therefore, don’t have the same pre-regatta training ability. As the fully crewed retro race continues the legacy of the 1973-74 Whitbread Round the World Race, permitted onboard technology is severely limited, and all personal electronic devices must be kept sealed onboard for crew use in ports only. The Whitbread Round the World Race, now known as The Ocean Race, is a prestigious and challenging sailing race that circumnavigates the globe, and multiple teams compete in a series of legs across various oceans and continents. The race was established in 1973 and was named after the British brewing company Whitbread, which sponsored the event for many years. In 2001, the event was renamed “The Volvo Ocean Race” after the new title sponsor, and later, it became “The Ocean Race.” Taberly is the daughter of Eric Tabarly and is sailing the same ketch built for her dad to race in the 1973–74 race. The official report includes a statement of the facts in the case, the inspection team’s findings and a summary of the judgment. The facts as laid out by the OGR team: At Oct. 20 2023 approx 20.00 local time, Georgie Vintner, Don McIntyre, and Marco Ausderau boarded Pen Duick VI as soon as they arrived. Skipper and all crew signed the NOR compliance declaration. On inspection of the comms bag presented by Marie Tabarly, the OGR securit y seal holding approx. nine personal crew phones, sealed a few hours before the start in Southampton, was observed to be broken, allowing free access to all phones. Photos were taken of the broken seal. The integrity of the seal is the responsibility of the entrant. The seals are quite strong and would not normally break without a reasonable force. A crew member suggested it may have broken while rummaging through the locker where it was stored while looking for food, also stored in the same locker. A comment

Marie was present and saw the seal was broken. The next day, on Oct. 23, a recorded interview was held with Marie Tabarly to investigate the evidence suggesting her WhatsApp account was active after the start including on the Sept. 11 – a day after the start. A [follow-up] interview was held on Oct. 25 to clarify contradictory statements and information. The inspection team then presented its findings: The seal on the comms bag onboard Pen Duick VI was found to be broken by the OGR inspection team. Pen Duick VI did not report the seal broken in the first instance. It is likely that the phones inside were not accessed, but this cannot be proven conclusively. Evidence shows that Marie’s Whatsapp account was confirmed active after the start of the OGR when approx. 5 miles offshore UK and most likely in range of phone signal. Marie was not forthcoming with accurate and timely information in regard to OGR questioning. In fact, contradictory statements and information was provided to key [inquiries] on two occasions. When OGR asked for confirmation of recorded answers, from a meeting 24 hrs. previous, Marie replied … “I do not know what I said and so what!” Finally, the team summarized its actions: 1. OGR cannot prove conclusively the cause of the Active WhatsApp account notice, as two phones are involved and one was onshore. It is possible the phone ashore could have been used, which is not a breach of the NOR. On this issue, no action is taken. 2. The OGR security seal on the comms bag was broken. It cannot be proven if it was an accident or with intent. It may be as a result of the entrant not having an onboard management plan to protect the comms bag. 3. It is the responsibility of the entrant to maintain the integrity of the seal. Not reporting the broken seal is the fault of the entrant. Other than the regret of the crew member responsible for regularly moving the bag to access food in the same locker, not being aware of the seal and it’s importance, there are no mitigating circumstances. 4. Under the NOR 3.1.7.C… Banned Equipment, a broken seal of the comms bag imposes a 72-hr time penalty. The seal of this comms bag was broken. A penalty, the team determined, “is applicable” and “after consideration of the facts, Pen Duick VI is given a 72-hour time penalty applicable on Leg one of the OGR.”

Potential Whale Entanglement Forces CDFW to Restrict and Delay Commercial Dungeness Crab Fisheries By: LOG STAFF

The California Department of Fish and Wildlife (CDFW) announced that the recreational take of Dungeness crab using crab traps will be temporarily restricted between the Sonoma/ Mendocino County line and Lopez Point in Monterey County (Fishing Zones 3 and 4) after the season opens due to the presence of humpback whales and potential for entanglement from trap gear.

In addition, a Fleet Advisory has been issued for all Fishing Zones (1-6) for the recreational fishery. Such an advisory refers to guidance, advice or recommendations provided to a fleet of vessels. This guidance often comes from experts in the maritime industry and can cover various aspects related to the management, operation, and optimization of fleets. The commercial Dungeness crab fishery south of the Sonoma/Mendocino County line was scheduled to open on Nov. 15 in Fishing Zones 3, 4, 5, and 6. However, the season opener also has been delayed in those zones due to the presence of high numbers of humpback whales. “Large aggregations of humpback whales continue to forage between Bodega Bay and Monterey, and allowing the use of crab traps would increase the risk of an entanglement in those fishing zones,” said CDFW Director Charlton H. Bonham in a news release. “We will continue to work with both the recre-

In addition, if adopted, proposed regulations for recreational groundfish will allow the deployment of Dungeness crab traps shoreward of the 50-fathom Rockfish Conser vation A rea (RCA) boundary line (50 CFR Part 660, Subpart G) when groundfish are onboard. Until the emergency regulations are in place, no fishing gear of any type may be deployed shoreward of the 50-fathom RCA line when shelf rockfish, slope rockfish or lingcod are onboard.

The CDFW anticipates the subsequent risk assessment will occur on or before Nov. 17, at which time the director will re-evaluate risk for the Dungeness crab fisheries. That risk assessment is expected to inform the potential for a statewide commercial fishery opener on Dec. 1 and the possibility of modifying the recreational trap restriction. Using lights to fish at night leads to a whole new understanding of fishing. By pointing lights down in reasonably shallow water, anglers will either bring in curious fish swimming nearby or, more commonly, identify a fish they want to spear. Shining lights into the water at night makes it easier to see what’s under the surface because, during the day, the glare doesn’t allow for much visibility.

There are several different styles of lights on the market. Submersible fishing lights are typically waterproof and weighted to sink. Floating lights can be placed on the water’s surface and are often used to illuminate the surrounding area, making it easier for anglers to see their lines, bait or fishing gear. They are portable and easy to deploy. LED underwater lights are energy-efficient and emit a bright glow. They are used both for illuminating the water and

Glow st ick s or chemical lights are chemical-based light sticks that produce a low-intensity glow. Anglers might attach t h e m t o fi s h i n g lines or use them as markers for floats to help monitor t he movement of their lines. When a fish bites or moves the line, the subtle movement of t he glow stick becomes more visible in the dark, signaling to the angler that there’s fish activity. While glow sticks are a non-intrusive and affordable tool t hat prov ides a sof t, continuous glow, the use of glow sticks does not directly attract fish; instead, they serve as aids for in line visibility and bite detection, contributing to the overall success of the fishing experience. Lastly, headlamps and handheld lights, while not specifically designed for underwater use, can be handy for anglers to see what they’re doing on the boat or shoreline during night fishing. The choice of which type of light to use always depends on the angler’s preferences, the targeted fish species, the fishing environment and local regulations. It’s important to consider the specific needs and conditions of the fishing trip to determine the most

These fish lights, also known as submersible fishing lights or underwater fishing lights, attract fish and increase the probability of landing a catch by beginning at the start of the food chain. These lights are designed to emit specific wavelengths that appeal to various fish species. The lights help to attract smaller prey such as bait fish and plankton, which in turn attracts the larger predator, ultimately to be spotted by the fishermen.

Several fish species, such as catfish and channel catfish, find food with their sense of smell instead of sight, which allows them to hunt anytime. That said, some of these fish are nocturnal and prefer to hunt at night. On the contrary, events such as insect hatching make trout or other fish go on a feeding frenzy throughout the night and may only happen for a day or two, especially in warmer weather when water temperatures are more favorable for feeding. This also makes them an easy target for anglers on the chase after hours.

After the invention of the light bulb in the 1870s by Thomas Edison, using fire as a light source was quickly replaced by electricity, and anglers have learned to use light to their advantage, not only to find fish, but to attract them. Anglers have found that the lights they used as a guide can now be submerged into the water to draw in their prey.

Fishing during the dark hours after the sun sets and before it rises is quite literally the definition of night fishing, but there is a lot more to it. Fishing at night has likely been practiced for thousands of years. It probably evolved as a result of human adaptation to various fishing environments and fish species’ behaviors. However, according to captainexperiences.com, Hawaiians are believed to be the first to attempt to do so. These natives would use torches to spearfish in the shallow waters inside the reefs after dark.

BLUEFIN, YELLOWFIN, SWORDFISH AND STRIPED MARLIN KEEPING OFFSHORE ANGLERS BUSY IN NOVEMBER! By Bob Vanian of 976Bite.com

Bluefin tuna fishing has been good on fish that have mostly been in the 20 to 125-plus pound range with some of the better sportboat trips producing limit catches of bluefin tuna. Yellowfin tuna have been in the mix in many of the areas where bluefin have been biting and most of the yellowfin have been in the 20 to 40 pound class. The numbers of dorado in local offshore waters has thinned out with the cooling of the water temperature but there is still a chance of finding a few dorado or yellowtail around a kelp paddy. The tuna hotspot area at the moment is in the region to the southwest of the 43 Fathom Spot. Other productive areas have been 5 to 12 miles to the east of Pyramid Head at San Clemente Island and the regions of the San Clemente Basin Weather Buoy, the Corner, the 182 Spot and the 289 Spot. There have also been sporadic showings of bluefin and yellowfin 5 to 12 miles off the coast between Point Loma and South Laguna Beach. Tuna have been found by locating sonar marks, meter marks, porpoise schools, spots of breaking fish, kelp paddies and trolling strikes. Sardines have been the best bait for the bluefin and yellowfin. Good news for private boaters is that there has been a recent increase in bluefin trolling strikes on the Nomad Madmac trolling plugs. Striped marlin fishing has been slow

We are now well into the month of November and there is still warm 66 to 68 degree water to be found off the Southern California coast that is holding good numbers of offshore game fish. Those looking for tuna have been finding good fishing for bluefin tuna and yellowfin tuna along with a few dorado and yellowtail. Anglers looking for billfish have been finding a chance at marlin or swordfish with the marlin fishing being on the scratchy side of things and with the deep drop method of fishing for swordfish producing quite a few opportunities for catching a swordfish.

An unusual marlin catch was recently reported at the 9 Mile Bank when a marlin bit a plastic squid that was fished on a rock cod rig. The bite came 100 feet below the surface and I am not sure if the marlin bit on the sink or when the rig was being retrieved. Areas where there has been a bit of marlin activity reported have been the 9 Mile Bank, the 178 Spot, the 182 Spot, the 43 Fathom Spot and the back side of Catalina. Swordfish fishing has been good for those using the deep drop method. The fishing has been good enough that a commercial boat Captain recently reported having 7 swordfish hookups in a day. Commercial boats and sportfishing boats have been getting swordfish bites while deep drop fishing at spots such as the 9 Mile Bank, 178 Spot, the east end of Catalina, the area off the Slide and Avalon at Catalina, the oil rigs in the Catalina Channel and 3 to 8 miles off the stretch of coast between La Jolla and Newport Beach. Of all those areas the 9 Mile Bank, 178 Spot, La Jolla and Carlsbad have been the best. An incredible rod and reel swordfish catch was recently made out at the 9 Mile Bank when private boater Karl Adriany of Party of Three caught a 313.6 pound

The fishing around Los Coronado Islands has not received much attention due to the good fishing that has been going on in local offshore waters. The last reports were of good fishing for an assortment of bottom fish species with slow fishing for surface fishing species such as yellowtail, bonito or barracuda. The bottom fishing around the Coronados has been producing a mix of reds, salmon grouper, assorted rockfish and whitefish along with a chance at a bonus lingcod. The best areas for the mixed bag bottom fishing have been to the northwest, north and northeast of North Island in 25 to 60 fathoms. An important reminder to anglers fishing in United States waters is that the fishing for rockfish in Nearshore waters and the fishing for Nearshore rockfish species no matter where they are caught is currently closed. Please refer to the Department of Fish and Wildlife website for all the details about the closed areas and the closed species at www.wildlife.ca.gov. Anglers also need to know that the current closure regulations are in effect through December 31, 2023 when the usual seasonal rockfish closure will come into effect and be in effect from January 1, 2024 through March 31, 2024. The fishing for rockfish has been good in areas that are outside of the current closure zones at places such as the 9 Mile Bank, South Carlsbad, Box Canyon and the 14 Mile Bank. The rest of the fishing along the San Diego County coast has been pretty good for a mix of calico bass, sand bass, sculpin, whitefish and sheephead and there has also been a chance at scratching out a yellowtail at La Jolla. Productive areas for calico bass, sand bass, sculpin, whitefish and sheephead have been the Imperial Beach Pipeline, the hard bottom to the northwest of Buoy #3 at Point Loma, the

Dropoff at Point Loma, the Green Tank, La Jolla, Solana Beach, Leucadia, South Carlsbad, the Barn and San Onofre. Halibut fishing along the San Diego County coast has been scratchy. A few of the better areas for halibut in the fall season have been off Imperial Beach, San Diego Bay and at the sandy bottom next to the structure of the sunken NEL tower or the structure of the Yukon shipwreck off Mission Beach. A good depth range off Imperial Beach has been in 37 to 50 feet and 50 feet has been a good depth off Mission Beach. Other productive halibut areas have been Mission Bay, Black’s Beach, South Ponto Beach, the Buccaneer Pipeline, the sandy bottom next to the structure of the artificial reefs outside of Oceanside and San Onofre. The 2023 Southern California fall fishing season is continuing to produce a wide range of good fishing be it tuna and billfish biting in offshore waters or for a mix bag of coastal type species that have been biting along the San Diego County coast and at Los Coronado Islands.
