Proposal to implement copper reduction plan in Orange County bay area could be open for additional public comment. By Parimal M. Rohit
NEWPORT BEACH — An Oct. 19 public hearing on a proposed copper plan for Newport Beach’s bay area was postponed, potentially opening the door for additional boater input on a Total Maximum Daily Load (TMDL) update. The Santa Ana Regional Water Quality Control Board planned to make a decision on the “Basin Plan” update this month, but delayed the vote in response to concerns raised by boaters and marine industry leaders. Recreational boaters were blamed for a significant portion of the copper sediment found in Newport Beach Harbor’s waters. A “Notice of Public Hearing” published by the Santa Ana Regional Water Board stated the Basin Plan amendments would be considered on Oct. 19. However there were no items on the Oct. 19 Santa Ana Regional Water Board agenda for the Basin Plan amendments. State water officials have been seeking to update the waterway’s TMDL plan to address various sediments found in the water, such as copper,
zinc, mercury, arsenic and chromium. TMDL plans are implemented to reduce the presence of such sediments in the water by mandating a city or county to prevent the discharge of toxic substances. Such substances are generally considered to be harmful to human health or adverse to beneficial water uses. TMDL amendments for Newport Bay’s watershed were recently proposed, with the State Water Board planning to weigh in on the possible changes. “The public hearing has been cancelled to allow time for staff to further engage with stakeholders and the public regarding the proposed Basin Plan amendments. A new date for the Public Hearing has not been set at this time. Further notification will be provided when the Public Hearing is rescheduled,” regional water board staff said in a released statement to the Recreational Boaters of California, or RBOC. Newport Bay has been subject to TMDL regulations since 1998. Algae bloom events, however, have occurred in the bay due to excessive nutrients flowing into the waterway. State Water Board officials have been pursuing updates to Newport Bay’s TMDL plan since 2015, specifically claiming the harbor’s waters have excessively high rates of copper levels. at Newport Beach Harbor’s Turning Basin and marinas, according to the State Water Board, causing the regional agency to target recreational boaters as the source of the problem. The plan proposed in 2015 sought to reduce copper levels by 83 percent, within a 15-year period, in areas frequented by anglers and boaters. Newport Beach city staff and State Water Board officials have been at odds ever since, with both sides failing to agree on the amount of copper actually discharged into harbor waters. The regional agency claimed Newport Bay’s waters had copper levels nearly
six times higher than the allowable limit. City officials pushed back, stating the State Water Board’s numbers were based on inaccurate data (such as miscounting the number of boats on the water). The proposed TMDL plan has also received pushback from RBOC, with the boating advocacy group claiming – among many issues – the State Water Board’s proposed plan “imposes unfunded state mandates” and includes information showing the waters of Newport Beach Harbor and Bay might not actually have a copper pollution problem.

A strange cube-shaped yacht keeps popping up all over Tampa Bay

By Devon Warren TAMPA, Florida — An unusually shaped yacht named Rendezvous 2018 has been popping up around the Tampa Bay waterfront, some favorable and some not so much. What’s so strange about this yacht? It’s cube shaped and, in ways, this bizarre looking boat has a futuristic look and accessories potentially paving the way for yachting technology. Cubic Yachts LLC is registered to Gordon Babbitt of Bulk Resources, Inc. There has been some confusion revolving around who the yacht belongs

Remains of sunken schooner thought to be oldest shipwreck ever found in Lake Erie TOLEDO, Ohio (AP)—Shipwreck hunters say the remains of a schooner discovered in Lake Erie in Ohio are likely from a sailing ship that went down nearly two centuries ago. That would make the wreckage the oldest ever found in the lake. Divers spent eight days looking at the wreck this summer to find whether it’s the Lake Serpent ship that sank in 1829. The National Museum of the Great Lakes said Thursday that

to, but it is certainly catching attention on the waters. A notable feature of “The Cube” is that it has four extendable legs that allow the yacht to sit above water. Onlookers may not be aware from the outside, but the inside of the yacht is also comparable to a compact floating mansion with an on-deck Jacuzzi and hurricane glass windows. Four bedrooms are onboard, each with an en suite bathroom. Entertainment options on The Cube are also endless with a downstairs gaming room and theater featuring a ping-pong table and flat-screen television. A smaller deck is also equipped with a
gas grill and sectional leather couches and lounge chairs. According to an article by Tampa Bay Times: “The boat is a work in progress with planned additions and aesthetic changes in progress, including a crane being attached to the upper deck that will be able to lift a smaller boat onboard.” The yacht, on social media, had been previously described as “freaky,” but after clearing up some rumors about its intentions, folks were more inclined to make positive comments. Others marveled at the sheer size of the yacht in person.
Initially, there were DARK quite a few rumors surrounding the BKGND question of ownership. Among some of those rumors included that the owner was banned from setting foot on American BW soil, that he was a professional athlete, that it was owned by country singer Chris Young, and that it was an old casino ferry. None of these turned out to be true. Bozell Hosey, for instance, tweeted: “Crazy cool. I’ve never seen a boat like this. I want one.” This insane cube-shaped yacht could be yours … if you happen to have $12 million sitting around.

But the museum’s archaeology director is stopping short of saying it’s definitely that ship and says divers will take another look next year. Hampshire and Massachusetts used to harvest Northern shrimp in the winter, but regulators shut the fishery down in 2013 amid concerns about low population and warming waters. An arm of the Atlantic States Marine Fisheries Commission says it has reviewed a new assessment of the shrimp population that says there are far fewer of the crustaceans off of New England than there used to be. The commission says the rising temperatures of the Gulf of Maine are a threat to the shrimp. The board is scheduled to meet on Nov. 15 and 16 to determine whether a moratorium on fishing for shrimp will continue into 2019.

DAMARISCOTTA, Maine (AP)—A Texas man has carved out a victory in a pumpkin boat race in Maine. The race featuring giant pumpkins transformed into watercraft is the highlight of the Damariscotta Pumpkinfest and Regatta each Columbus Day weekend. Jaja Martin, who has won the Golden Gourd several times, tells NECN that piloting a pumpkin boat is a delicate balance. For most, just finishing the race without sinking is a victory. In the end, Russell Orms, of Austin, Texas, motored to victory in the power boat competition. He helped to carve a 1,150-pound pumpkin into a Viking ship called See NEWS BRIEFS page 5

Coastal Commission approves revisions for Redondo Beach’s waterfront project Despite the bitter lawsuit between the city and developer CenterCal, business for Redondo Beach goes ahead as usual. By Devon Warren REDONDO BEACH — The California Coastal Commission, in August, decided Measure C, a bill Redondo Beach locals approved in response to a controversial waterfront development, would apply to CenterCal’s The Waterfront project. Developer CenterCal ,however, claimed vested rights to the property. The future of Redondo Beach’s harbor revitalization plan is uncertain, but the Coastal Commission is moving forward with business as usual. The Coastal Commission, Oct. 10, voted to adopt revised findings to the city of Redondo Beach’s Local Coastal Program (LCP), which matches the agency’s decision on Aug. 9. According to the staff report:“The amendment would impose new development standards in the King Harbor-Pier area by adding specific standards for preserving the Seaside Lagoon and adding five new land use regulations for Coastal Commercial Zones regarding view protection, development of a boat launch, parking regulations,

STATE DNA testing proves California teen was bitten by great white shark SAN DIEGO (AP)—DNA testing has revealed the shark that attacked a 13-year-old boy last month off a Southern California shore was a great white, according to a report. Scientists gathered the shark’s DNA by swabbing the wet suit Keane Webre-Hayes wore when he was bitten while diving for lobsters near Encinitas, the San Diego Union-Tribune reported. The bite on Sept. 29 tore his back, shoulder, torso, face and ear. The teen was released from a hospital after surgery and is expected to make a full recovery. Witnesses estimated the shark was about 11 feet (3 meters) long. Chris Lowe, director of Long Beach State University’s Shark Lab, said in a statement that while “shark bite incidents are exceedingly rare,” swimmers should be aware that more large sharks move along the coast during the fall season. Southern California is a known nursery area for white sharks. The lab test used to confirm the DNA is similar to a new procedure being developed that can detect a shark’s environmental DNA in ocean water samples, the newspaper said. Environmental DNA — or eDNA — can be found in cellular materials left behind by sharks and other animals. Researchers hope to develop a species-specific test that could be used by lifeguards to detect what type of sharks

Since the passing of Measure C, the city and CenterCal have had major disagreements. In an effort to recover the loss, CenterCal sued Redondo Beach; the lawsuit is still ongoing. Redondo Beach city staff has taken some steps ahead, including hiring the reputable coastal engineering Moffatt & Nichol to survey and re-build Sportsfishing Pier. In January, Sportsfishing Pier was finally closed due to the decay and decomposition of the pier, which became a safety hazard. Redondo Beach City Council member Nils Nehrenheim previously told The Log public feedback meetings for the waterfront revitalization project would need to begin again. The next steps will be continuing discussions on position of the boat launch ramp and rebuilding the pier and parking structure. CenterCal is currently constructing a new seaside development called 2nd & PCH in Long Beach.

Orcas spotted off Catalina Saw three adults and one young orca just ten minutes from Catalina Avalon Harbor while we
approached on the charter AM. Boat Captain cut engines and circled around while orcas swam belly to surface just feet from the side and went under. Does California care about anglers and boaters? Advocacy groups consistently boast economic impact of boating and fishing, but legislative efforts to support both industries continue to fail. By Parimal M. Rohit SACRAMENTO — The definition of insanity, according to a clichéd pop culture mandate, is repeating something over and over again but expecting different results. Are California’s anglers and boaters insane for pushing their respective legislators for policy changes and hoping for something other than a gubernatorial veto or legislative failure? Those who have paid any attention to Sacramento these past few years should be aware of State Sen. Tom Berryhill’s repeated attempts to change California’s sportfishing licensing regime from a calendar-based fee to a 365-day fee. Each of Berryhill’s effort fizzled on the legislative floor, never even sniffing Gov.
Jerry Brown’s desk for signature or veto. Making it to Brown’s desk, of course, doesn’t necessarily mean a legislative victory is around the corner. Brown did veto Assembly Bill 1918 in mid-September. The bill sought to create the Office of Sustainable Outdoor Recreation. Creating such an office, legislators hoped, would help encourage getting more boaters out onto the water, be it to boat, fish or kayak. Angling and boating industry leaders, of course, have regularly campaigned legislators and political executives to help them increase outdoor participation rates. Changing California’s fishing license system from a calendar to annual regime, angling advocates constantly argue, would help reverse a steady trend of declining recreational fishing participation. Royal St. John’s Regatta: North America’s Oldest Sail Competition By Parimal M. Rohit ST. JOHN’S, Canada — Sailing regattas are held almost weekly in Southern California, but did you know the oldest boating competition in North America might actually date as far back as the late 1700s? Royal St. John’s Regatta hails itself as the oldest single sporting event in North America. The actual origins of this regatta, which is held annually in St. John’s, Canada, have not been fully traced. An issue of the Royal Gazette, however, mentioned a regatta arriving at St. John’s port on Aug. 6, 1816. Six boats arrived at the finish: a sloop, a schooner and four brigs. Organizers held the 1818 regatta on Sept. 22 to coincide with the anniversary celebration of the official coronation of King George III; the monarch took his throne on Sept. 22, 1761. Whether the regatta actually launched in 1816 or was held annually for years ahead of that year
has remained unanswered. The regatta’s organizers, however, hinted the event’s origins could trace back into the 1700s. “St. John’s, with its magnificently sheltered harbour, had become a growing centre of activity and early settlement in the early 1700’s,” race organizers stated on the regatta’s website. “The fishing and trading season generally lasted from May to September. This gave the transient and local population only a few months to form summer friendships and raise a challenge to each other’s sailing and rowing skills. The boat racing, which later became our regatta, came into existence as a natural form of friendly competition among a seafaring people.” The regatta was originally held on St. John’s Atlantic coast, but later moved a few miles inland to Quidi Vidi Lake. More than 50,000 people attend the regatta now, according to sources. St. John’s coincidentally, is Canada’s – and North America’s – easternmost city.

Nearly $2 million was raised to bring harbor’s inaugural water wheel to fruition; construction is scheduled to begin in spring or summer of 2021. By Devon Warren
NEWPORT BEACH — Newport Beach’s harbor and bay will soon see a water wheel scourging the area of trash and debris after the local City Council unanimously passed the Newport Bay Water Wheel Project, Sept. 25. The water wheel, a project that has been in the works for some time, was a concept spearheaded by Billy Dutton and Mark Ward of Help Your Harbor. Debris in the upper bay area has long been a source of trouble in Newport Beach Harbor, which prompted this solution to collect the trash and prevent it from ending up on the beaches. The Ocean Protection Council awarded a grant for the amount of $1.68 million and Council member Diane Dixon praised staff for seeking the grant. Ward also added Patagonia, a retail outlet for outdoor clothing and gear, donated $10,000 to get the ball rolling for the water wheel. Several other sponsors of Help Your Harbor, including Surfrider Foundation, Duffy Electric Boats and Balboa Bay Club, have participated in harbor clean-up events and have supported the water wheel. Between local environmentalists, the grant and city budget, the project has been funded for $1.7 million. In the staff report, it reads: “The Newport Bay Water Wheel Project is recommended for funding by the Ocean Protection Council’s Proposition 1 Grant of $1,6800,000. A $12,000 contribution from Help Your Harbor has already been received along with a city budget of $8,000 to fund the environmental portion of this work. It is anticipated the OPC grant funds will cover the design and construction cost of the project for a total project budget of $1,700,000.” Ward stated the Help Your Harbor program has collected 40,000 pounds of trash since its conception. After the storm season, the debris that gathers in Newport Bay can be especially bad. Plans for the new water wheel was modeled after a similar design used in Baltimore, Maryland – also known as “Mr. Water Wheel.” Mr. Water Wheel is powered by currents from Jones Fall River and backup solar panels keep the wheel moving when the currents are too slow. ple, published a report stating boating and fishing as the top overall outdoor industries in 2016, based upon real gross output. Both industries were specifically responsible for $36.9 billion of real gross output in 2016, according to the Commerce Department report. A separate report published by the American Sportfishing Association, or ASA, found the nation’s 49 million anglers spent $49.8 billion on gear and fishing trips. Numbers are being presented to at least give the appearance of boating and fishing being vital cogs of the overall economy. Anglers and boaters, it could then follow, serve as valuable constituencies. Earning significant legislative victories wouldn’t seem like it would be much of a chore. Yet fishing license reform has yet to happen despite several valiant efforts. And the creation of a new statewide office specifically to promote outdoor recreational activities, such as kayaking or fishing, almost happened, but didn’t. We can go one of two directions, here, with our questioning. The directions aren’t mutually exclusive – there is space for both concepts to co-exist. The conceptual questions are these: • Who, in Sacramento, is looking out for boaters and recreational fishers? • What responsibility does the boating and fishing industries have, respectively, to steer their own ships?

Brown, in his veto message of AB 1918, said the creation of the Office of Sustainable Outdoor Recreation would have been an added layer of unnecessary bureaucracy. An effort to limit bureaucracy within our government isn’t necessarily a bad thing, so Brown certainly has standing to make such an argument here. Perhaps there are other ways the state’s current bureaucracy can be used as a tool to promote outdoor recreational activities. Policy decisions, at the same time, aren’t made in a vacuum. It would be fair to question Sacramento’s support of anglers, boaters and other outdoor enthusiasts, in light of the combination of a recent stretch of boating/fishing friendly proposals not becoming codified. The same could be said of recreational fishing interests within the state. Offering anglers a fishing permit system where their purchase is valid for a full 365 days has been implemented in several states already, yet California has maintained its current calendar regime. Anyone who buys a fishing permit here will see it expire on Dec. 31, regardless of when purchased. The fee does not change over time, so you’re paying the same fee for a permit that becomes less valuable as each day goes by – and efforts to change this regime has failed at least three times. Statistics consistently show fishing participation rates in California have been dwindling since 1980, all while the price to drop a line in the state’s waters has been gradually increasing. Many in the angling world have

DANA POINT — There are many, in the wake of a vague planning meeting concerning the planned update of Dana Point Harbor, who still have questions about the recently presented revitalization “plans.” Among those wondering what’s on tap for the future was the newly formed Dana Point Harbor Advisory Board (DPHAB). Functioning as a harbor commission, DPHAB recently held a meeting that hosted representation from Orange County and the developers that make up Dana Point Harbor Partners (DPHP). The meeting offered little in the way of new information, but it did give the community the chance to ask questions of the developers. As a reminder to readers, the lease option period, meaning the period to review the drafted lease, is quickly coming to a close. Orange County has plans to bring the review to a culmination on Oct. 30. An interview with

SAN DIEGO — The California Coastal Commission approved the implementation of a Maintenance Dredging Program for four navigational channels at the Ventura Keys, Oct. 10; commissioners unanimously supported the project during their October meetings in San Diego. The dredging project will cover 32 acres at an area near the entrance of Ventura Harbor. “The navigation channels in the Ventura Keys are accessed from the mouth of the Ventura Harbor and are fringed with private recreational boat docks and associated residential development,” Coastal Commission staff stated in a report to commissioners. “The proposed maintenance dredging program would maintain the channels at the appropriate depth for boating and recreational uses, and would allow for approximately 350,000 cubic yards of material to be dredged over a ten-year project term, not to exceed 100,000 cubic yards in any one year.” Sediment will be deposed at one of three sites: the surf zone near Pierpont Groin Field; the surf zone at the mouth of the Santa Clara River; and, the nearshore waters of Santa Clara River’s mouth. “Dredging will be accomplished by means of hydraulic dredging, with pipeline deposition into designated surf zone areas or alternatively by means of clamshell dredging,” Coastal Commission staff explained in a report to commissioners. “While the deposition of dredge spoils as beach nourishment will replenish public beaches and thus increase access, deposition operations have the potential to adversely affect public access.” The dredging project, consisted with current prohibitions, will not be allowed to take place between Memorial Day and Labor Day. Coastal Commission staff added there is “little to no vegetation … on most of the beach disposal site.” There are, however, several sensitive fish and wildlife species present in the area, according to Coastal Commission staff. These species are the California brown pelican, California grunion, steelhead trout and tidewater goby. Biological monitoring must take place before the start of dredging and after the project is completed “to ensure that significant adverse impacts to adjacent habitats and sensitive species are avoided.” The city of Ventura is the applicant for the dredging project. The project term is for 10 years; development under the granted Coastal Commission permit, accordingly, must be completed by Oct. 10, 2028. The Ventura Harbor entrance

Port district officials received several million dollars of funding to dredge the Ventura Harbor entrance, helping the venue return to its normal routine of servicing various boating and fishing interests. Ventura Port District General Manager Oscar Peña, in a conversation with The Log during the shoaling event, said the stockpiling of sediment at the harbor entrance was likely the result of El Niño, which was certainly in effect in late 2015 and early 2016.

Draft lease option to be forwarded to L.A. Board of Supervisors in October for $100-million redevelopment of Mariners Village, including opening of promenade and affordable housing. By Devon Warren
MARINA DEL REY — There is a long list of cities undergoing redevelopments in Southern California and Marina del Rey is one of them. At the Small Craft Harbor Commission meeting held on Sept. 12, representatives from Los Angeles County Department of Beaches and Harbors to discuss a lease option that, according to at least three public commentators, had only been unveiled seven days prior. The draft lease, an agreement between County of Los Angeles and Marina Admiralty Company, is an extension and proposes renovation of the premises of Parcel 113, which houses the Mariners Village apartment complex. The County and Marina Admiralty Company have held a lease agreement since Feb. 14, 1967. With the new extension, Marina Admiralty Company would be extended for 42 years and 10 months, leasing the property for the maximum 99 years in California. Don Geisinger, a representative from the Asset Management Division of L.A. County Department of Beaches and Harbors, stated Parcel 113 currently is the largest parcel in the harbor, holding 981 units. Moving forward, Geisinger added that the movement to renovate was “fueled by affordable housing – that’s what really drives us.” Of the 981 units, 20 percent of them would be converted into affordable housing; the quota would fit into Marina del Rey’s affordable housing plan, which was established in 2009 and requires at least 15 percent of new development include low-income housing. County staff described those eligible to take up the new affordable housing as earning $30,000 or less a year, and said tenants under the affordable housing action would pay 30 percent of the standard rate. The base cost of renting a 457-square-foot studio at Mariners Village as of Sept. 28 is $2,151, according to apartments.com. Mariners Village apartments would be remodeled on the exterior as well as the interior. For the interior remodels, Geisinger stated that would take place over the next six years as tenants moved in and out as to create the least amount of disturbance possible. In addition to the extra affordable housing units, Geisinger stated the area’s promenade would become open to the public and expanded. Marina del
Rey has had problems with diseased trees in need of removal in the past. Geisinger said the trees in the area would stay put. Overall, speakers seemed concerned residents had not had too much time to review the lease option, which had already been forwarded to Regional Planning. The draft lease is set to be reviewed by the Los Angeles Board of Supervisors next month in October. According to Geisinger, the “hard cap cost” of the project is $100 million.

Approval at a state level for the speed limit exception would be needed, according to previous discussion. Newport Beach would need consent from OC Parks and Recreations Department and Department of Boating and Waterways in order for this decision/exception to be approved. No response had been given, at the time of the meeting on Oct. 9, from these agencies. However, Assistant City Manager Carol Jacobs clarified the agencies have 30 days to issue a decision. The new rules, unless otherwise noted, are set to be incorporated by the end of 2018.

U.S. Senate passes America’s Water Infrastructure Act of 2018 Federal legislation aims to fund upgrades for waterways and reservoirs, address algal blooms.
WASHINGTON, D.C. — A federal bill proposing to support waterway access projects and improve navigability cleared its way through the U.S. Senate, Oct. 10. Senators joined their counterparts in the House of Representatives in approving S. 3021, colloquially known as America’s Water Infrastructure Act. The vote was 99-1, opening the door for the bill to move forward to Pres. Donald J. Trump’s desk for approval or veto. The bill, updates laws and regulations already on the books, specifically covers issues such as invasive species, harmful algal blooms, dredging, infrastructure maintenance and operation, local water management plans, coastal erosion and debris removal. Energy, drinking water and clean water are also covered under S. 3021. More than $6 billion of spending over the next 10 years would ultimately be authorized if S. 3021 becomes law. Some of the funding would be directed to regional water projects, such as stemming coastal erosion in Texas or improving drinking water quality in Flint, Texas. Money will also be allocated to large projects managed by the U.S. Army Corps of Engineers. Organizations such as BoatUS,

America’s Water Infrastructure Act of 2018 is officially headed to the President’s desk, as U.S. Senators approved the bill by a 99-1 vote on Oct. 10.
National Marine Manufacturers Association (NMMA) and Recreational Boaters of California (RBOC) expressed their respective support of America’s Water Infrastructure Act. A BoatUS statement on S. 3021 stated the legislative update would “provide critical funds and policy improvements for the nation’s waterways, reservoirs, levees, locks and dams.” “Recreational boaters will like the bill as it supports waterway-access projects, navigation and water-quality improvements, and provides maintenance funds for harbors of refuge,” BoatUS’s statement on S. 3021 said. America’s Water Infrastructure Act also reformed and streamlined the way the U.S. Army Corps of Engineers processes its projects. The federal bill, of course, is not free of criticism or opposition. A report
published by The Heritage Foundation – a conservative think tank – called America’s Water Infrastructure Act of 2018 a “flood of failure.” “The Army Corps’ infrastructure work has long been plagued by a backlog of projects that Congress has authorized, many of which are later de-authorized before completion,” The Heritage Foundation report, which was published on Oct. 9, stated. “The bill, as it currently stands, would only add to the backlog. Congress should implement a practice of at least twice as much de-authorization than new authorization, taking into account both the number of projects and their costs. Legislators should focus on priorities,” the report continued. Legislators still hailed America’s Water Infrastructure Act of 2018 as a victory for their constituents.
“S. 3021 will also make it easier for projects to get through the Army Corps process and authorizes important projects to deepen ports,” Sen. Pat Roberts, R-Kansas, said in a released statement. Reps. John Shimkus, R-Illinois, and Fred Upton, R-Michigan, said S. 3021 would modernize the nation’s drinking water infrastructure, improve accountability and foster more transparency. “[America’s Water Infrastructure Act of 2018] grows the economy, keeps communities safe, cuts red tape and is fiscally responsible,” a joint statement issued by Sens. John Barrasso, R-Wyoming, Jim Inhofe, R-Oklahoma, and Ben Cardin, D-Maryland, read. Language of S. 3021 stated water infrastructure should be a leading priority for each Congress session. “It is the sense of Congress that, because the missions of the Corps of Engineers for navigation, flood control, beach erosion control and shoreline protection, hydroelectric power, recreation, water supply, environmental protection, restoration, and enhancement, and fish and wildlife mitigation benefit all Americans, and because water resources development projects are critical to maintaining the country’s economic prosperity, national security, and environmental protection, Congress should consider a water resources development bill not less often than once every Congress,” the bill’s mission statement said. America’s Water Infrastructure Act of 2018 would become law with Trump’s signature. A veto would mean it goes back to Congress.

SACRAMENTO — Eradicating invasive species from California’s waterways has become a priority for state legislators, so much so they worked to create an entirely new committee to address the issue. Gov. Jerry Brown signed Assembly Bill 2470 (AB 2470) as one of his final acts as California’s chief executive. The bill created a new committee – California Invasive Species Advisory Committee – for the Invasive Species Council of California. A prescribed membership would sit on the committee to spearhead invasive species prevention and eradication efforts. The council and committee would specifically advise other state agencies how to “facilitate coordinated, complementary, and cost-effective control or eradication of invasive species that have entered or are already established in the state,” according to AB 2470. “The bill would authorize the council to establish advisory committees and ad hoc working groups, including the California Invasive Species Advisory Committee, with a prescribed membership, to advise the council on a broad array of issues related to

The Invasive Species Council of California was established in 2009; its focus, according to a legislative analysis of AB 2470, is to “keep invasive species out of the state, find invasions before permanent establishment occurs and take steps to eradicate early populations of unwanted species.” Legislative analyses from the Assembly and State Senate both stated the fiscal effect of AB 2470 was unknown, though cost pressures could be “in the millions of dollars from the [state’s] General Fund.” Grayson’s bill handily passed out of the State Senate (39-0) and Assembly (78-0).

When he first moved to San Diego in 1984 to accompany his neuroscientist wife to UCSD he quickly made a discovery that would change the course of his career. “I saw someone on Mission Bay on a sit-ski, a chair on two bars on the water. OCEANSIDE — Changes to Oceanside’s conflict of interest codes were updated to reflect routine personnel changes within City Hall, Sept. 19. The updated codes, which were unanimously adopted by the City Council, specifically applied to two Oceanside commissions: Small Craft Harbor District and Community Development. Cities, pursuant to the Political Reform Act of 1974, are required to maintain and adopt local conflict of interest codes. The codes must be updated regularly, according to Oceanside city staff, to “reflect changes to the employment positions within the agencies.” “The local codes must be evaluated every even-numbered year and amended if necessary to reflect changes in the employment positions within the agency,” Oceanside city staff stated. Oceanside requires its employees and members of boards, commissions and committees to also be subject to conflict of interest disclosure requirements. “The city’s local conflict of interest code references an appendix that sets for the various city employment positions and members of boards, commissions and committees … along with the categories and disclosure requirements for those positions,” Oceanside city staff stated in a report to council members. “The Small Craft Harbor District [is] also required to have local conflict of interest codes. The updated codes eliminated positions no longer in existence; new positions created since the last conflict of interest code amendment were added to the disclosure list. Oceanside requires its employees and board/commission/committee members to disclose four types of financial interests (and, hence, initiating a conflict of interest situation): business interests within the jurisdiction; use of services or supplies from a city vendor; income or interests subject to regulatory, permit or licensing authority of the city, agency or district; and, real property interests within the city’s regulatory, permitting or licensing authority. The Small Craft Harbor District Board of Directors has one disclosure category, according to Oceanside’s city code. Oceanside’s Small Craft Harbor District manages the city’s recreational boating and fishing area at the northwest corner of town. A 2017 audit of the district revealed it had nearly $15 million in assets and earned $6.5 million from slip rentals and related fees. City officials established the harbor district in 1960, three years before
Oceanside Harbor was built; the district maintains Oceanside’s public marine facilities, such as transient moorings, fueling dock, fishing pier, boat launch ramp and yacht club. An estimated 100 acres of Oceanside’s harbor waterfront falls within the jurisdiction of the Small Craft Harbor District. Catalina Connection Catalina Island Conservancy is batty for the island’s flying mammals CATALINA ISLAND — Bats are curious and odd creatures, being associated with Halloween, vampires, haunted houses and other things that inspire fear. What people may not know is bats are more closely relatable to the popular comic book character Batman – according to the group Bat Conservation International, bats are considered a “keystone species” because of their predation on pests that damage crops or carry disease, such as mosquitoes. Catalina Island, strangely enough, is home to 10 native bat species that also span across North America. Humans will rarely see bats, due to their nocturnal habits. It is human interference, sadly, that causes bat numbers on Catalina Island to dwindle. The Catalina Island Conservancy has been working with biologists to protect bats on the island. Dr. Patricia Brown is one such biologist who has thoroughly studied the Channel Island’s bats, including those on Catalina, extensively since the 1970s. Brown told The Log in an email:

Sailing is fighting to stay afloat in the Olympics Games The International Laser Class Association released a statement on the World Sailing Board’s recommendation to cut some sailing events in the 2024 Olympics. By Devon Warren
WORLDWIDE — Competitive sailing has long been enjoyed by sailors the world over, but in discouraging news the International Laser Class Association (ILCA) reported surprising findings about the state of sailing as a
sport. In a press release issued on Oct. 3, ILCA stated: “The International Laser Class Association is surprised and disappointed by the announcement today that the World Sailing Board has recommended to select new equipment to replace the Laser and Laser Radial Classes for the one-person dinghy events in the 2024 Olympic Games.” The hearing to determine whether the recommendation will be approved or rejected will take place at the Annual World Sailing Conference in Sarasota, Florida from Oct. 27 through Nov. 4. The World Sailing Association, since 2017, has been re-evaluating
the equipment used for the Olympics. Universality is a key component for how the International Olympic Committee appraises each competing event. ILCA argued that the affects of passing the replacement of the Laser and Laser Radial classes could be dire to the future of sailing in the Olympics as a whole. The association, accordingly, presented data showing a healthy percentage of the world still competes in the Laser Class race. ILCA appeared confident in confirming Laser equipment for the upcoming Olympics since it is still used by a majority of sailors. Data pulled by ILCA showed 85 of
94 countries still participate in the Laser Class during the Olympics. Only 29 countries participate in the 49er FX and women’s sailing also appears to be down with the RS:X Women’s category having only 37 countries and 470 Women’s with 33. As further support for the state of competitive sailing, ILCA stated: “ILCA is committed to supporting World Sailing to ensure that sailing remains an Olympic sport, and we will continue to comply with all the requirements of the reevaluation process in order to assure that the Laser and Laser Radial Classes remain part of the Olympic program.”

NEWPORT BEACH — Newport Harbor Yacht Club will host the 2018 Barney Lehman Championship, Oct. 27-28, pitting Lehman 12 boats against each other in a single-handed regatta event on the Central Orange County coast. All Lehman 12 boats are eligible to participate in this Newport Beach regatta. The race is single-handed but all boats and crews must meet specific
class-mandated weight requirements. Measurements will be taken between 9 and 11 a.m. on Oct. 27. A mandatory competitors’ meeting will be held at 12:30 p.m., followed by the first warning at 1 p.m., both on Oct. 27. The no warning signal will be given after 4:30 p.m. on the first day of racing. Competition picks up again at 1 p.m. on Oct. 28; the second and final no warning signal will be given after 4 p.m. The trophy presentation will take place after racing, also on Oct. 28. Two SoCal Sailors Named to new SailGP Team SAN DIEGO (LOG News Service) — Two Southern California sailors have been named members of the United States’ team in SailGP, the new global league that will be sailed in foiling 50-foot catamarans beginning next year. The two, wing trimmer Riley Gibbs, 22, of Long Beach and flight controller Hans Henken, 26, of Coronado along with the names of the other crew members were announced Oct. 10 in New York. Former America’s Cup champion Rome Kirby was named skipper and helmsman of the United States’ team in SailGP. Kirby, 29, of Newport, Rhode Island, won the America’s Cup with Oracle Team USA in 2013 and has also sailed in the Volvo Ocean Race. He is the son of Jerry Kirby, also a former America’s Cup champion and Volvo Ocean Race veteran. The other members of the U.S. crew are: grinder Mac Agnese, 24, of Fort Lauderdale, Florida and grinder Dan Morris, 30, of Newport, Rhode Island. Morris has won a World Match Racing Tour title. Agnese, Gibbs and former youth world champion Henken
are all bidding to represent the United States at the 2020 Olympics. American software billionaire Larry Ellison and New Zealander Russell Coutts, a five-time America’s Cup winner, founded SailGP, launched in mid-October. They began working on the concept of the annual global league after Oracle Team USA was routed by Emirates Team New Zealand in the 2017 America’s Cup. Kirby was a reserve with Oracle Team USA in that regatta. The series begins Feb. 15-16 in Sydney, Australia, followed by regattas in San Francisco on May 4-5; New York on June 21-22; Cowes, England, on Aug. 10-11; and the finale in Marseille, France, on Sept. 20-22 that will include a winner-take-all $1 million match race. Plans call for the league to eventually expand to 10 teams from 10 countries, with 10 regattas. Ellison will initially underwrite SailGP, with plans calling for it to move to a franchise ownership model. Coutts envisions it becoming commercially sustainable. The F50 is a redesigned and reengineered version of the catamaran used in the 2017 America’s Cup in Bermuda.

The race takes place one week after Santa Barbara Yacht Club hosts its Goblin Optimist Regatta, Oct. 20-21. Santa Barbara Sailing Club is the organizing body behind the Goblin Regatta, held the weekend before Halloween. The regatta is open to all one-designs and PHRF classes. At least two boats must be in a class for it to qualify as a race. Racing will take place just beyond the entrance of Santa Barbara Harbor and along Ledbetter Beach. Trophies will be presented depending upon how many entries are received. Dinner and drinks will be available after racing. Classes eligible to participate in this

Anglers aboard an early October fishing expedition aboard Thunderbird out of Newport Landing in Newport Beach certainly had their fair share of bluefin. Those anglers specifically returned to shore with 30 bluefins, between 40 and 70 pounds, during the first day of their two-day trip. Feds hope to advance first-ever traceability program for farmed shrimp and abalone NOAA could implement its proposal by the end of 2018; public input is currently being collected.
WASHINGTON, D.C. — The nation’s leading fisheries agency will be accepting public comment on a seafood traceability program through Nov. 26, according to officials at the National Oceanic and Atmospheric Administration, or NOAA. Federal officials hope to closely monitor two aquaculture fisheries through the proposed program. NOAA Fisheries had proposed the first-ever seafood traceability program for farmed shrimp and abalone. The U.S. Commerce Department was directed by Congress to implement a domestic seafood traceability program by Dec. 31, 2019; shrimp and abalone, under the program, would be traced from the point of production to entry into U.S. commerce. “NOAA Fisheries is committed to

Shrimp, according to NOAA, is the largest U.S. seafood import. “Establishing comparable requirements for domestic aquacultured shrimp and abalone allows imports of shrimp and abalone to be subject to SIMP requirements – further leveling the playing field for U.S. fishermen, aquaculture producers, and seafood producers who play by the rules,” NOAA staff said in a released statement. NOAA’s proposed rule would simply create a system where all seafood entering into national circulation would be accounted for and deemed legal. “This rule would require owners or operators of U.S. inland, coastal and marine commercial aquaculture facilities … to report information about production and entry into U.S. commerce of shrimp and abalone products,” NOAA’s Federal Register document stated. “In addition, this rule would require producers to register with NMFS and retain records pertaining to the production of shrimp and abalone and entry of those products into U.S. commerce.” A presidential task force to address IUU fishing and seafood fraud was established in March 2015. The task forced opened the door for this proposed traceability program to be presented to the public. The memoriam will begin at Baja Cantina and finish with a spreading of Bisbee’s ashes during the afternoon. Those who will be in town and want to attend the memoriam are asked to arrive at Baja Cantina at 1 p.m. A short service, with speeches, will happen at 2 p.m. Attendees will then board boats at 3 p.m.; the boats will depart IGY at 3:30 p.m. and head to sea, where Bisbee’s ashes will be spread, just beyond the outer harbor. “We have chosen what we feel is the most appropriate place and time to gather in remembrance and celebrate Dad’s life,” his family said through a
released statement. “There is no better place in the world for this to take place as Cabo was his life-long favorite home. For those of you with your own boats, we’d love for you to join us in a farewell parade as we head out to honor Dad. For those of you without boats, we will have plenty of space on the big Cabo cruise boats for you to be with us.” Bisbee, who died on June 14, founded the Black and Blue Marlin Tournament, now in its 38th year. Multiple citations issued as California’s lobster season opens SOUTHERN CALIFORNIA — Officers with the state’s Department of Fish and Wildlife (DFW) issues 106 citations and gave 165 warnings during the first weekend of this year’s spiny lobster season. The 2018-2019 season began on Sept. 29; officers reportedly engaged with 2,088 lobster divers and hunters between then and Oct. 5. Citations were given for several offenses, such as taking too many lobster (or other fish), catching undersized crustaceans, unlawful take in a Marine Protected Area (MPA), report card violations, illegal commercial passenger vessel operation and a DUI. DFW staff reported at least two notable cases – one out of San Diego and the other in Orange County. “Wildlife officers on boat patrol [near San Diego] pulled up on a vessel with two persons on board. Upon approach, the men started throwing lobsters overboard. The officers quickly boarded the vessel and located 26
lobsters hidden throughout,” DFW staff stated in a report. “The men were cited for an overlimit of lobster and report card violations.” Two wildlife officers in Orange County cited someone for taking 27 lobsters on the night prior to the season opener, making it an out-ofseason haul. October offshore tuna action still going strong By Bob Vanian SAN DIEGO — The month of October is known for sometimes providing some of the best offshore fishing of the year. The early part of this month has been one of those types of Octobers as yellowfin tuna, bluefin tuna, skipjack, Dorado and yellowtail are biting offshore and at times have been providing near limit to limit action. The best area for the bluefin outside of San Clemente Island is currently ranging from the waters outside of Seal Cove on up to the waters outside of West Cove. The bluefin bite has currently moved further off the Island than where it was for much of the summer season and if they keep going much further off the Island they will be approaching the Tanner Bank. Some of the better trips have been returning with near limit to limit numbers of bluefin tuna and most of the fish have been ranging from 25 to 90 pounds. There are also some larger sized bluefin to 200+ pounds in the mix as well. Most of the bluefin action comes from stopping and drifting on sonar marks or meter marks with an occasional spot of fish also found up working on the surface. The bluefin have been biting in the dark and during the daylight hours. Mackerel, sardines, flying fish and Flat Fall jigs have been the top baits and lures. Capt. Joe Cacciola of Sea Star with Sea Star Sportfishing and the Oceanside Sea Center reported Pronto was out fishing the bluefin on Oct. 13. Cacciola spoke with Capt. Ernie Prieto of and reported catches of four big bluefin to 90 pounds. Yellowfin tuna have been biting very well with near limit to limit catches combined with a mix of skipjack, Dorado and yellowtail being found by boats on overnight trips at some of the offshore banks outside of Ensenada. The yellowfin outside of Ensenada have been biting around spots such as the 385 Spot, the Inner Bank (that contains the 238 Spot), the 450 Spot and the 295 Bank. Boats working these areas have been finding action while fishing between 50 and 75 miles 160 to 180 degrees from Point Loma. Yellowfin stops are coming from kelp paddies, trolling strikes, skipjack trolling strikes, porpoise schools, meter marks, sonar marks and spots of puddling fish. Most of the yellowfin are in the 5- to 15-pound range with some larger fish to 30+ pounds also in the mix. The larger-sized yellowfin tend to be caught with porpoise. Sardines, Megabait style jigs, Colt Snipers and poppers have been working in the yellowfin stops. Dropping down to 15-pound test line and using small hooks is often a key to getting yellowfin to bite when they are touchy. Anglers report that the smaller sized sardines tend to work best for the yellowfin. In waters more local to Point Loma there has also been very good fishing for a mix of yellowfin tuna and skipjack for boats fishing areas such as the 9 Mile Bank, 4 to 8 miles west of North Island, the deep water inside of the Kidney Bank as well as the deep water between the 425 Bank and the 371 Bank. The skipjack fishing is very good in these areas but it is hit or miss in getting a yellow-
fin tuna stop. Once yellowfin are located though, there have been some very good bites where limits of yellowfin are caught from a single stop. In these good yellowfin stops Skippers are often calling out for someone to take over their stop before they leave to head for home with limits. Marlin have been producing some action in the Catalina and San Diego areas. The marlin fishing in the San Diego region has been scratchy. Most of the reports of marlin encounters in the San Diego region are coming from the area of the 9 Mile Bank and are found incidental to tuna fishing. Boats targeting marlin in the Catalina area are finding some pretty good action while working spots around the eastern part of the Island. Avalon Bank, the 152 Spot, Church Rock, the area between Silver Canyon and Ben Weston and while fishing out toward San Clemente Island at the Mackerel Bank have all been producing marlin action. The fishing along the San Diego County Coast has been good for a mix of bonito, calico bass, sand bass and an assortment of bottom fish. The yellowtail fishing has been slow. The bonito are currently the highlight species and have been biting well at the Point Loma Kelp Beds, by the Whistler Buoy at Point Loma, outside of the upper end of La Jolla, at Del Mar and between South Carlsbad and the Oceanside Pier. The bonito have been mostly 4- to 7-pound fish and Cacciola reported boats out of Oceanside Sea Center have been doing well while fishing in 115 to 150 feet of water in an area ranging from the Oceanside Pier on down to Ponto Beach at South Carlsbad. Cacciola said that they have been getting bonito trolling strikes and then drifting and fishing with sardines, Megabait style jigs and chrome Crocodile jigs. He added the smaller sized sardines have been working a lot better than the big sardines. The month of October is providing some of the best fishing of the year and I hope you have a chance to get out and get in on the action. Keep on fishing and I hope to see you out on the water!
