Octavius, A Giant Pacific Octopus, Takes Up Residence at Ocean Institute

DANA POINT— If you’ve visited Ocean Institute recently, you may have noticed Octavius, a Giant Pacific Octopus perched over the institute’s front entrance, suspended above to welcome all to visit the exhibits of the hundreds of aquatic creatures living at the institute.

Octavius is the creation of Jeffrey Skarvan, a fine art photographer, painter, and sculptor. Samples of his work can be viewed at www.jeffreyskarvan.com. “Octavius resides right over our main entrance, ready to welcome visitors with open arms...well, tentacles...as they step into our underwater world of wonder!” said Sara Vaughn, Ocean Institute’s manager of public programs and volunteers, in a press release. “Crafted by Dana Point’s very own Jeffrey Skarvan, Octavius is a stunning masterpiece crafted from fiberglass and reinforced recycled plastics. This extraordinary creation pays homage to our incredible ocean-dwelling neighbors, reminding us of the importance of being responsible stewards of our coastal environment,” said Vaughn. Octavius is a whimsical work of

art designed to delight the thousands of v isitors who come to learn about the ocean and the creatures that live in it. He’s a real conversation starter; here are a few key characteristics. • The octopus is one of the oldest a nima ls in existence, having occupied the oceans for millions of years. They are highly intelligent and can learn to navigate mazes, open jars, and use tools. • T h e G i a n t P a c i fi c Octopus, the largest of the octopus species, can weigh more than 50 pounds. The heaviest on record weighed 200 pounds and measured nearly 20 feet across. • This species can be found all around the Pacific, in shallow waters and depths of nearly 5,000 feet. “The Old Man and the Sea” Wins Pulitzer Prize 70 Years Ago M. CLEMENTS

Seventy years ago, “The Old Man and the Sea,” a novella written by American author E r n e s t H e m i n g w a y, w a s awarded the 1953 Pulitzer Prize for fiction. Published in 1952, it is one of Hemingway’s most famous and celebrated works, contributing to his Nobel Prize in Literature in 1954. The story revolves around an aging fisherman named Santiago and his epic struggle to catch a giant marlin. Ernest Hemingway was an avid and passionate fisherman.

His love for fishing greatly influenced his writing and is a recurring theme in many of his works. Hemingway was particularly fond of the deep-sea fishery, which he often engaged in while living in Key West, Florida, and later in Cuba. Spoiler alert— The novel is set in a small fishing village near Havana, Cuba. Santiago, a n old a nd i mp o v e r i s he d fisherman, hasn’t caught any fish for 84 days, making him an object of pity and ridicule in the village. Determined to break his unlucky streak, Santiago enters the Gulf Stream on the 85th day.

However, his pride and inner strength remain unbroken. “ The Old Ma n a nd t he Sea” is often interpreted as a sy mbolic work, exploring complex themes through the story of Santiago’s battle with the marlin and the subsequent struggle with the sharks. It remains a classic of American literature and is widely studied and analyzed for its literary merit and symbolism.

LOCAL 2024 Festival of Whales Logo Design Contest is Underway DANA POINT— The Festival of Whales Foundation is seeking a logo design for the upcoming 53rd Annual Festival of Whales celebration, slated to occur March 1-3, 2024. The contest is open to the general public, and submissions must include a dominant representation of a California gray whale/s, the beloved ocean mammal that—with their annual 10,000-mile round trip migration past Dana Point between Alaska and Baja— inspired the special annual event.

Spiny Lobster Recreational And Commercial Fisheries Set To Open With Delays In Portions Of Los Angeles And Orange Counties Due To Public Health Hazard The California spiny lobster fishery opened on Sept. 29, at 6 p.m. for recreational diving and hoop netting, followed by the commercial fishery on Wednesday, Oct. 4. The recreational opener is 12 hours earlier than past seasons this year, providing an extra night of recreational fishing opportunity. However, state health agencies determined that spiny lobster sampled off of mainland Los Angeles County had elevated levels of domoic acid and recommended a delayed opening of the recreational and commercial fishery in the area. Following this recommendation, California Department of Fish and Wildlife (CDFW) Director Charlton H. Bonham enacted a delay to start the recreational and commercial spiny lobster fisheries within specific areas of Los Angeles and Orange counties. Areas immediately surrounding the recreational delay area will be open to recreational

take under an advisory issued by the California Department of Public Health (CDPH) to avoid consuming the viscera (tomalley) and roe (eggs) of spiny lobster. Cooking lobsters neither decreases nor destroys the toxin, so consumers are advised to discard the viscera, roe, and cooking liquids. The delay areas shall remain in effect until OEHHA, in talk with the State Public Health Officer of CDPH, determines that domoic acid no longer poses a significant risk to public health. Both delays are contingent upon additional sampling, planned for next week. Samples from Sept. 18 were below the health hazard threshold. If following weeks samples are also below the threshold, the delays may be lifted. The recreational delay area is defined as state waters between the following landmarks: the northern boundary of the Point Vicente SMCA and the westernmost point of the Long Beach Breakwater. The area is bounded by straight lines connecting the following points in the order listed except where noted: 33° 44.800′ N. lat. 118° 24.807′ W. long.; 33° 44.800′ N. lat. 118° 28.931′ W. long.; thence southeastward along the three nautical mile offshore boundary to 33° 40.384’ N. lat. 118° 10.850’ W. long.; and 33° 45.640’ N. lat. 118° 10.850’ W. long. Transiting the area with spiny lobster in possession is allowed as specified in the Director’s Declaration. The commercial fishery is delayed in state waters off Palos Verdes, Los Angeles County, to Huntington Beach, Orange County, within the following coordinates: between 118° 0.00’ W longitude and 118° 30.00’ W longitude and between 33° 40.00’ N. latitude and 33° 50.00’ N latitude. When the commercial season opens on Oct. 4, take of spiny lobster will be prohibited in this area. Please see the Director’s Declaration regarding allowances for commercial lobster trap deployment and transiting and possessing lobster in the area. According to Fish and Game Code, section 5523, the Director of CDFW will notify the Fish and Game Commission of the delay and request that the Commission schedule a public discussion at its next meeting. Domoic acid is a potent neurotoxin produced by Pseudo-nitzschia, a naturally occurring single-celled marine alga, under certain ocean conditions. Domoic acid can accumulate in shellfish, other invertebrates, and sometimes fish without the organism becoming ill themselves. At low levels, domoic acid exposure can cause nausea, diarrhea, and dizziness in humans. At higher levels, it can cause persistent short-term memory loss and seizures and can, in some cases, be fatal. State and federal laws prohibit the commercial distribution of seafood products that contain domoic acid levels above the federal action level, which is 20 parts per million in the viscera of spiny lobster. Should my yacht club be including a liability waiver?

QUESTION:

I am on the race management committee for my yacht club and our committee is concerned about exposure of the club and its volunteers to liability during races and other events. We have considered asking participants to sign a waiver but some of our members have questioned whether that kind of waiver would be enforceable. Other members contend that all participants in a sport such as yacht racing automatically assume the risk of injury, and to complicate things even further, we have learned that the Racing Rules of Sailing prohibit the use of liability waivers in race documents. ANSWER: Our reader is basicallyBWasking whether his yacht club should include a liability release in its race documents. The short answer is yes. The question of whether that release will be frowned upon by the sailing community is a lot more complicated, as is the question of whether the release will be enforceable. Let’s start with our reader’s reference to competitors automatically assuming the risk of injury through their participation in the event. The “Assumption of Risk” doctrine provides a defense against a lawsuit where the injured party knowingly participated in a dangerous activity, and was injured in a way that he or she could have reasonably foreseen. Assumption of Risk cases usually arise in the context of an employment or sporting activity, where the nature of the activity may give rise to certain obvious risks. For example, under this doctrine a lion tamer who is employed by a circus may not be able to sue the circus if he gets bit by a lion. Notably, the application of this doctrine under “General” (Federal) Maritime Law will differ from a case decided under California State Law. An incident arising during a yacht race will in most circumstances be subject to Maritime Law rather than California State Law. Simply put, in Please see ATTORNEY, PAGE 7

most cases the doctrine is not a defense against a claim brought by an injured person in a case subject to maritime law. We will need to save that discussion for another day, but the “take-away” here is that a race organizer will need to look elsewhere for protection against claims arising during a yacht race. This is where a written liability release may help race organizers to limit their liability. Courts have consistently upheld written liability waivers in a recreational maritime context, so long as the language of the waiver is clear, unambiguous and prominently positioned on the document. Courts have distinguished this defense from the Assumption of Risk doctrine because the waiver is a form of contract which can be freely accepted or rejected by the participants on both sides of the equation before anyone leaves the dock. A n u na mbig uous a nd properly worded liability waiver or release will go a long way toward easing the concerns of our reader and his fellow committee members, but he questions whether such a document is enforceable. In fact, it is enforceable if it is carefully drafted. A liability release is a type of contract, whereby the participant in the activity agrees to give up certain rights in exchange for something of value. The “something of value,” or “consideration,” may take many forms, but it must be clearly stated in the document. In practice, the “something of value” is usually stated simply as granting the individual the opportunity to participate in the event. This may sound like an insufficient form of consideration to receive in exchange for giving up your right to sue, but in fact the actual value of the items exchanged in a contract will not be questioned by a court. Many liability waivers or release documents also include language which requires the participant to “indemnify” the race organizers against claims arising from the event. An indemnification agreement goes beyond a simple release or waiver of liability, in that it also requires the participant to defend the race organizers against claims brought by third parties. This seems a bit onerous at first, but it is often necessary to bring crewmembers under the liability release umbrella since they don’t usually sign the race entry form. A carefully worded indemnification clause that is narrowly tailored to meet this objective will not expose competitors to claims brought by unrelated third parties. And, it is consistent with the traditional maritime principle of holding a captain responsible for whatever happens aboard his or her vessel. Our reader points out that U.S. Sailing does not encourage the use of indemnification clauses in race documents. U.S. Sailing is a Rhode Island based organization that is the national governing body for the sport of sailing in this country. Their responsibilities include the enactment of rules (“prescriptions”) to supplement the international Racing Rules of Sailing for events conducted in the United States. U.S. Sailing prescriptions include Rule 81 (formerly Rule 82), which discourages the

use of indemnification or liability release agreements by race organizers, and their website includes a section where they describe liability release documents in very scary terms. In my opinion, their description is inaccurate, and both the Racing Rules of Sailing and the U.S. Prescriptions allow race organizers to waive the prohibition against the use indemnification language in these documents. It should be noted that the mission of U.S. Sailing is to protect the interests of racers - not race organizers. Before closing, we should take a quick look at the actual language of a liability release. When a party in any endeavor seeks to reduce or eliminate its liability for injury or damage in that endeavor, the party faces a complicated maze of

rules and restrictions. This puzzle is considerably more complicated when that endeavor takes place on the water. Written liability waivers require specific language that may not be available through a “copy and paste” exercise from a random document found on the internet, and failure to use the correct language will render the document ineffective. In fact, we have reviewed race documents from 15 different yacht clubs around the country, and found the liability release language in at least two-thirds of those documents to be ineffective and unenforceable. Most of the deficiencies in those documents could be cured by the simple addition of the contract language discussed above. But they - and our reader - should contact an experienced

maritime attorney for help with their particular activity. Between Ensenada and Turtle Bay — Bahia San Quintin is Baja’s First Great Rest Stop By: CAPT. PAT RAINS

For this year’s Baja Ha Ha cruisers who might need a rest stop on their way to Turtle Bay, I suggest checking out San Quintin. Pronounced “keen TEEN,” this bay is located about 110 n.m. down the coast from Ensenada. Here are three good reasons to stop. First, Bahia San Quintin itself is an uncomplicated 5-mile bay with an “easy in, easy out” approach and departure. The curving anchorage area can provide a dozen boats with a good holding bottom and reliable shelter from Baja’s prevailing northwesterly winds and long-shore current.

SAN QUINTIN The name “San Quintin” appears in four local features: Cabo San Quintin, Bahia San Quintin, Estero San Quintin and the inland village of San Quintin. Cabo San Quintin (GPS 30°21.43’N, 115°59.56’W) is the lighted southwest corner of a 10-mile long sand bar crowned by a volcano cone, Mount Mazo. We round Cabo San Quintin about a half mile off in 37 to 45 feet of water to enter Bahia San Quintin on an east-northeast heading until about half to a quarter mile off the long curving sandy beach of Playa Santa Maria. (Stay outside any breakers and black lava reefs that mask the shallow entrance to Estero San Quintin.)

ANCHORAGE We’ve anchored here many times over a good holding sand and shell bottom in anywhere from 24’ to 35’ of clear water, and Playa Santa Maria’s hard sand beach is decent for landing a dinghy and beach hiking. For a restful overnight anchorage, Bahia San Quintin is a good place to test your anchor watch, set up a perimeter alarm on the radar targeting the nearest

Bahia San Quintin Area. After passing Isla San Martin, it’s easy to round Cabo San Quintin and enter the rest-stop anchorage of Bahia San Quintin. shore break along Playa Santa Maria. But in the morning, you might expect a few fishing pangueros who are exiting the estuary to swing by your anchored boat just to make sure you’re OK, don’t need any help.

EXPLORE ASHORE You won’t find a diesel dock here nor any other yacht services. However, if you have an extra day at leisure (This is cruising, remember.) and want to check out the 7.5 mile long estuary channel and hit the Old Mill restaurant for lunch, you might ask one of those helpful pangueros to return on their way back in to port, to guide you ($20) in your dinghy through the safe passage between the breakers. One week the route is close to the base of Mount Mazo, the next it may have moved east nearer sandy Punta Azufre (Sulphur Point). Be ready with your dinghy when the panguero guide returns, and pay attention to the route, because you probably won’t have a guide hours later on your way back out at a different tide level. Once you’re safely inside the estuary abeam of sandy Punta Azufre, the main channel (6’ to 12’ unregulated depths)

Third, a stop at Bahia San Quintin, whether brief or overnight, might logistically set you up for a safe daylight passage well around the dangerous Sacramento Reef, located 38 n.m. south of Bahia San Quintin. Avoid the unlighted Sacramento Reef area at night or in rough seas, when its tell-tale breaking crests are invisible. Winter kelp beds also disguise this lethal ship killer. (See below.)

Second, an overnight stop at Bahia San Quintin is likely to afford everyone onboard a good night’s sleep, not just the guests or off-watch members of the crew. And after the hectic push to get headed south on a group’s rigid schedule, a pleasant rest stop here might be good for onboard morale.

SACRAMENTO REEF From Bahia San Quintin, it’s about 38 n.m. to the Sacramento Reef. My GPS waypoint 2 n.m. west of the Sacramento Reef is 29°44.0’N, 115°50.0’W. In 1872, the 270’ side-wheel passenger steamer “Sacramento” hit this reef and was torn to shreds with great loss of life. For decades rumors persisted that tons of gold and jewel treasures were yet to be recovered. When kelp da mpens the waves crashing on top of this broad reef, so it’s harder to see in daylight and makes no telltale sounds at night. To avoid tangling with this ship-killer reef, it’s best to lay a course from San Quintin that keeps you at least 2 n.m. west of the reef’s western side. Only after well south of the Sacramento Reef is it safe to change a southbound course toward Cedros Island. Buen Viaje to all the southbound cruisers. You’ll be known as the Class of ‘23-24.

Winter Fishing in California Winter might get cold, but a Southern California winter is when fishing heats up. Don’t pack up your rods and reels quite yet. By: KATHERINE M. CLEMENTS

Winter is when we see the end of the Pacific bluefin tuna season which generally concludes in October. The bright side is that Rockfish season is in full swing in Southern California, and there are still Yellowtail and white Seabass, Calico Bass, Sand Bass, Dungeness crab and Halibut out there. The choice of fishing location and target species will vary based on the specific area within Southern California you’re interested in and the type of fishing you

If there is a successful winter fishing season anywhere, it’s going to be in the warm regions of Southern California. While a specific “fishing season” can vary based on the type of fish and location, winter is generally considered a viable time for fishing in Southern California. The SoCal region has a relatively mild winter climate allowing fishing activities to continue throughout the year.

If you aren’t sure where the good fishing spots are during winter, check out California’s Department of Fish and Wildlife website (or the one for the state you’ll be fishing in). The CDFW offers an updated map of legal fishing locations, Quagga-infested areas and legal boating locations. However, in California, many fisheries remain open during the winter months, providing opportunities for fishing enthusiasts. A bonus for SoCal anglers is that they don’t have to go far or spend much money to enjoy the local fishing outside of Point Loma, Imperial Beach and La Jolla. Additionally, winter can be a good time for winter steelhead and surfperch along the coast. For anglers further north, the Sacramento-San Joaquin Delta and several rivers in California have open seasons for species such as striped bass, sturgeon, salmon (during cer tain times) and various other freshwater fish. Many lakes and reservoirs throughout California are open for fishing during the winter, providing opportunities to catch species like trout, bass, catfish, crappie and more. Additionally, some urban areas in California have stocked lakes and ponds that remain open for fishing during the winter months. These locations often receive trout stocks and may have catfish, bass and sunfish.

Some high-altitude lakes and streams in the Sierra Nevada region remain accessible for fishing, with opportunities to catch trout, especially in lower-elevation areas with milder winter weather. It’s important to note that specific fishing seasons, regulations and species availability can vary by location and are subject to change. Anglers should always check the CDFW (wildlife.ca.gov) website or contact local authorities for the most up-to-date information on fishing regulations, seasons and access during the winter months. Additionally, local fishing clubs, bait shops, and outfitters can provide valuable insights and recommendations for winter fishing in your desired area.

Other General Winter Fishing Recommendations Fishing during the winter can present unique challenges due to colder temperatures and changes in fish behavior. Here are some tips to help make your winter fishing more successful and enjoyable: Choose the right location: Focus on fishing in areas where fish are more likely to congregate during w inter, such as deeper water, near structures or around places with consistent water temperatures. Time your fishing trips and target periods of warmer weather or stable weather patterns. Fish are more likely to be active and feed during milder days. Use lighter line and tackle and move slower: Fish may be more cautious during winter, so downsize your line and tackle for a more subtle presentation. Lighter lines and smaller hooks can

increase your chances of enticing bites. Slow down your fishing techniques. Fish are generally less active in colder water, so slow presentations like jigs, soft plastics or slow retrieves can be effective. Also, leverage live bait and smelly baits. Live baits with strong scents can attract fish even in colder water. Consider using options like minnows, worms or cut bait. Focus on sunny areas and monitor water temps: Fish tend to be more active and may move into sunny spots to warm up. Target areas where the sun hits the water. These areas can be slightly warmer and more attractive to fish. Pay attention to water temperature as it influences fish behavior. Use a thermometer to gauge the temperature and adjust your tactics accordingly. Dress in layers and be prepared for sudden weather changes. Dress warmly and bring extra clothing, gloves and rain gear to stay comfortable. Fish are more vulnerable during winter, so consider catch-and-release practices to help conserve fish populations. In addition, always check the weather forecast before heading out and ensure that conditions are safe for fishing. Be aware of ice conditions if you fish in areas with potential ice cover. By adapting your approach and being mindful of the unique conditions during winter, you can still have a successful and enjoyable fishing experience. Ports of Los Angeles, Long Beach and Shanghai Unveil Plans for Trans-Pacific Green Shipping Corridor

Long Beach and Shanghai announced on Sept. 22 that they would work together to create the first-ever Trans-Pacific green shipping corridor, a shipping route supporting zero-carbon emissions vessels and other emissions-reducing programs. It would be the first-ever green shipping corridor across the Pacific. “This initiative will drive emissions reductions across the world’s largest ocean and lead to greener practices from supply chain participants along these vital trade routes,” said Mario Cordero, chief executive officer of the Port of Long Beach. “The new and innovative vessel technologies, increased availability of sustainable fuels and better practices created through this green corridor will also impact society’s transition to a cleaner future far beyond the areas served by our ports.” The Ports of Los Angeles, Long Beach, and Shanghai, among the largest in the world, unveiled the Green Shipping

NOAA Report to the San Diego Bay Harbor Safety Committee The National Oceanic and Atmospheric Administration (NOAA) is ending production of raster chart products, including the traditional paper chart. The final charts will be issued in December 2024.

The “Last Edition” announcement starts a 6-month warning period until final cancellation, meaning these charts will be officially canceled in August 2024.

In 2019, NOAA announced its Sunsetting of Raster Nautical Charts in the Federal Register. The Federal Register is the official daily publication for rules, proposed rules and notices of federal agencies and organizations, as well as executive orders and other presidential documents, in the U.S.

“Currently, we have two completely independent chart production systems,” Ferguson said. “One to maintain the raster charts and another to maintain the Electronic Navigational Charts (ENC). The ENC is the modern chart. It is vector-based and has attribution (i.e., it is ‘smart’) that computer systems can use to trigger alarms if the vessel goes into shallow water, for example. The number of ENCs being sold/downloaded is now far greater than the raster sales/ downloads. So, to be able to focus on the modern product and improve production efficiencies, the decision was made to discontinue the raster product line and focus solely on the modern ENC products.”

The raster sunset program w ill gradually end the production and maintenance of NOA A traditional paper and raster nautical chart products. NOAA began canceling its traditional nautical charts in 2021, and the process is expected to be completed by January 2025. The term sunsetting refers to purposely and systematically phasing out a product or service.

The coastal chart 18765, Approaches to San Diego Bay (and chart 18774, which overlaps to the north) will go into “Last Edition” status in December 2023, meaning they will be canceled in June 2024. The general coastal charts along the west coast from the Mexican border to Canada will enter “Last Edition” status in June 2024 and be canceled in December 2024.

The final chart will be archived on the historical chart website. However, the chart will no longer be updated and will not be suitable for navigation. It’s archival for anyone who wants to view the final chart, needs to do research or simply wants an image to hang on the wall. Other archived charts are available on the historic website. For instance, you can see what the San Diego Bay nautical chart looked like in 1935. NOAA produces nautical charts in two different formats, as Ferguson said – raster and vector. Each are compiled and distributed using different methods. For real-time navigation, mariners should use the NOAA ENC’s in an appropriate navigation system. The ENC product format is specified by the International Hydrographic Organization (IHO). Each ENC is a digital database that stores the location and shape of charted features as pairs of latitude and longitude coordinates. This is known as “vector format” data. Database records associated with each component provide detailed information, such as the feature’s color, shape, height, purpose, quality of position and other attributes. Electronic navigation systems can use the data contained within ENCs to enable safer voyage planning and route monitoring. This includes ini-

tiating warnings and alarms when a ship is heading into shallow water or toward other dangers to navigation. Updated ENC revision files are available weekly. When ENC revision data is loaded, many navigation systems apply these updates automatically. ENCs will continue to be produced and enhanced after all raster format charts are canceled. For users wanting a large format paper representation of the ENC for situational awareness or planning purposes, NOAA has the Custom Chart Tool that can convert the ENC data into a PDF that can be printed. In 2021, the Service found a 400 percent increase in humpback mortality and severe injury from human activities since 2018. According to agency estimates, the sablefish fishery kills or seriously injures at least one humpback whale annually. On average, about 25 humpback whales are entangled annually off the U.S. West Coast, and more than half the entanglements are not traced to a specific fishery. The sablefish fishery uses 2-mile-long strings of 30 to 50 pots. To make all fishing safer, the Center proposed that the Service require fisheries that use pot gear to convert to new ropeless or “pop-up” gear within the next five years. The petition urges the agency to prioritize this transition in national marine sanctuaries. “Pop gear” in fishing refers to a specific type of fishing tackle or gear used to attract fish and improve the chances of

Pop gear, in this context, is intended to mitigate the risk of entanglement by featuring brightly colored, buoyant, and easily visible components such as the spinning blades and beads. This high visibility allows whales to detect the fishing gear more efficiently, reducing the likelihood of accidental entanglement. Additionally, pop gear setups often use weaker line attachments or breakaway components, making it easier for whales to break free if they do come into contact with the gear. This design reduces the risk of a prolonged and harmful entanglement. Most trap and pot fisheries use static vertical lines that can wrap around whales’ mouths, fins, or tails, wounding them and depleting their energy, often drowning them as they drag heavy traps and rope. Pop-up traps use bags or buoys on coiled ropes triggered by remote or time-release sensors to float the traps to the surface, eliminating static entangling lines.

Sailing World’s Best Master Sailors Compete at 2023 International Masters Regatta

Historically, this invitation-only regatta has attracted some of the world’s best master sailors, including iconic names like Elvstrom, Buchan, Burnham, Tillman, Trask, Irish, Harken, North and Holland (to name a few). This year is no exception. This year’s line-up includes many returning skippers and fresh faces, too. William Abbott, Nigel Cochrane, Alan Field, Scott Harris, Don Jesberg, G a r y Jo b s o n , a n d Ta d L a c e y a r e returning to the regatta. One of the most decorated skippers, Jobson, has participated in the regatta three times over the past decade, earning two fourth places and a fifth place finish. His last run was the 2019 edition of the regatta. Jobson returns for another opportunity to secure a podium finish. “The Masters Regatta is a good test of how my skill level is these days,” said Jobson in a press release. “It’s challenging to change boats every race and adapt to San Diego’s tricky sailing. While preparing, I’m thinking back to past experiences racing in this regatta, recruiting good crew and actively sailing through the summer.” Brand new to the Masters, Wolfgang

Schaefer is traveling to San Diego from Germany. He has sailed at SDYC twice before for the Farr 40 Worlds and another SDYC signature regatta, the Yachting Cup. Unfortunately for Schaefer, the J/105 is not established in Northern and Central Europe – a potential handicap. Nonetheless, the team is confident in their experience. “We have 2-3 hours on Thursday before the regatta to create a friendship with this boat. That is a handicap and not too easy, but we will do our very best,” said Schaefer. Some of Schaefer’s most significant accomplishments include winning silver at the 2019 Farr 40 Worlds, gold at the 2018 Farr 40 Worlds, fourth place in the 2018 Sydney to Hobart (Class One), gold at the 2010 Sardinia Cup, gold at the 1983 Admirals Cup, and first place at the 1983 Fastnet Race (Class One). In addition to his on-the-water success, Schaefer has served for more than 30 years as the German Sailing Federation’s chairman of the Offshore Committee, 25 years as vice chairman of the Offshore Racing Congress and is a founding member of the Offshore Committee inside ISAF, later World Sailing. Also familiar with the Farr 40s is new Masters skipper Yon Belausteguigoitia. He has been sailing and training on the Farr 40 and J/70 with his crew consisting of his wife, Eliane Belausteguigoitia, Hector Guzman, Tomas Rosenberg and Marc Rosenberg. His biggest accomplishments include silver in the Laser at the Central American Games and 15th at the J/24 Worlds in San Francisco. Eliane brings her Olympic experience from the

SAN DIEGO — The 41st running of the International Masters Regatta returns to San Diego Yacht Club (SDYC) Oct. 20-22. This year’s slate of 12 competitors brings together an international cast of Master skippers from Canada, Germany, Mexico and the U.S. Over three days of racing, teams will compete using chartered J/105s in a round-robin format in South San Diego Bay.

Invasive New Zealand Mudsnails Found in Lake Tahoe Tahoe have discovered the invasive New Zealand mudsnail in areas off the South Shore, according to the Tahoe Regional Planning Agency (TRPA) and the Tahoe Resource Conservation District (Tahoe RCD).

This is the first time the species has been detected in the Tahoe Basin. The New Zealand mudsnail is a small freshwater snail native to the island country in Oceania. It is a small invasive aquatic species (IAS) that has become a concern in various parts of the world, including Nor th A merica , Europe and other regions where it has been introduced. Aquatic invasive species are non-native plants, animals and pathogens that can harm native ecosystems, economies and recreational activities. The Lake Tahoe Aquatic Invasive Species Program includes comprehensive monitoring of Lake Tahoe for aquatic invaders. Contract divers with Marine Taxonomic Services, Ltd. surveying invasive weeds on the South Shore discovered tiny snails on the bottom of the lake about a half mile offshore from the mouth of the Upper Truckee River. Experts and a DNA lab analysis confirmed the species is New Zealand mudsnail, which also has been detected in nearby waterways, including the Lower Truckee River downstream from Lake Tahoe near Reno, Nev. No other IAS, such as the destructive quagga and zebra mussel, have been detected, according to the agencies. Following rapid response protocols under the federally approved Lake Tahoe Aquatic Invasive Species Management Plan, TRPA assembled an incident team of agency staff, Tahoe RCD and partner experts. The team is quickly deploying scientists, beginning with lake-wide dive surveys to determine the extent of the infestation, with plans to share all available information with state and federal wildlife managers through the Lake Tahoe Aquatic Invasive Species

“Lake Tahoe is one of the most protected waterbodies in the United States, and our aquatic invasive species monitoring program is credited as the reason for this concerning discovery,” TRPA Executive Director Julie Regan said in a press release. “It is critical that everyone remain vigilant and adhere to the mantra of Clean, Drain and Dry. Every boater, paddler and angler shares the responsibility to protect Lake Tahoe’s native species and the waters we enjoy.” According to TRPA, as climate change takes its toll on Lake Tahoe’s native ecosystem, the threat of new invasive species in the region will also increase. Under the Lake Tahoe Environmental Improvement Program, officials are helping protect water quality and native species in the case of further discoveries. It is a crucial program to improve the region’s climate resilience, according to TRPA.

Invasive species can be transferred to new environments through various pathways, often facilitated by human activities. The movement of invasive species can be intentional or unintentional. They can hitch a ride on boats, fishing gear, paddle craft, life vests, and beach toys, according to the National Stop Aquatic Hitchhikers! Campaign. In early September, American Fishing Tackle Company (AFTCO) Chairman Bill Shedd was inducted into the 2023 International Game Fish Association (IGFA) Fishing Hall of Fame for his massive contributions to fishing conservation, including battling for anglers’ access and pioneering innovations in fishing tackle and fishing apparel. Shedd’s father, Milton Shedd, who founded AFTCO, is also an IGFA Hall of Fame inductee. AFTCO is a well-known American company specializing in manufacturing and supplying fishing tackle, fishing clothing and outdoor gear for anglers. Over his career, Bill Shedd has volunteered more than 15,000 hours to conservation projects, spending 400 to 500 hours every year for more than 35 years on marine conservation and sportfishing industry issues. Shedd is known for co-founding United Anglers of Southern California (UASC); he led the group’s efforts to pass Proposition 132, the anti-gillnet initiative, and developed white seabass grow-out facilities to support hatchery science. Shedd’s conservation efforts also played a crucial role in eliminating the experimental mako shark longline fishery in California. In 1989, Shedd started the AFTCO “Tag Flag” (a recognizable and prestigious tagging awards program, significantly impacting the number of game fish being tagged in the northeast) and later championed tag-and-release sport fishing. Today, Shedd is the board chairman for the Coastal Conservation Association California, an organization dedicated to marine conservation, protecting anglers’ rights, promoting youth sport fishing participation, and develop-

ing and enhancing marine habitat and angling opportunities. san diego fish report BLUEFIN, YELLOWFIN, DORADO, YELLOWTAIL AND STRIPED MARLIN STILL BITING IN LOCAL OFFSHORE WATERS! By Bob Vanian of 976Bite.com

The fall fishing season is rewarding Southern California offshore anglers who have not yet put away their tackle for the winter as there continues to be good mixed bag fishing for bluefin tuna, yellowfin, tuna dorado and yellowtail in local offshore waters. When you add a chance at a striped marlin, there are lots of exciting possibilities on an offshore fishing trip! Anglers fishing San Diego County area coastal waters have also been doing well on what has mostly been a mix of calico bass, sand bass, sculpin, sheephead and whitefish to go with a chance at a few bonito or a bonus yellowtail, halibut or white seabass. Bluefin tuna have been running from 15 to 225-plus pounds with the majority of the fish being in the 15 to 60 pound range. Yellowfin tuna have been mostly in the 15 to 40 pound class with some larger fish to 60 pounds occasionally found in the mix. The current productive areas for the mix of bluefin, yellowfin, dorado and a few yellowtail span from the Catalina area on down to the offshore banks outside of San Diego and include the 152 Spot, 277 Spot, 209 Spot, 289 Spot, 312 Spot, 181 Spot, the Corner, the 43 Fathom Spot, the San Clemente Basin Weather Buoy and the Butterfly Bank. Of all those areas the region of the 43 Fathom Spot has been the best in recent days. Some of the better sportboat and private boat trips to the 43 Fathom Spot have been posting mixed bag catches that include near limit to limit catches of bluefin tuna along with a good numbers of yellowfin tuna, a few dorado and an occasional yellowtail. Private boater Captain Bob Woodard Jr. of Dropback took out Fugitive and fished the 43 Fathom Spot. Woodard reported that he and a friend caught their limits of 4 bluefin tuna, caught and released a fifth bluefin tuna and also caught a 40 pound yellowfin tuna. Their bluefin were in the 15 to 20 pound class and their catch was made up of 3 baitfish and 3 troll fish. Woodard said that when using sardines that they were get-

ting bites when they went over to using light line and small hooks. He reported that using 20 pound test line with a size 2 circle hook was a good combination that was getting bites on the sardines. Woodard also said they were getting bites on the sardines when flylining and also when using .75 ounce sinkers. Woodard’s report was that the water around the 43 Fathom Spot was at 67.5 degrees and was blue. Those wishing to focus on fishing for the larger bluefin with less available in the way of dorado and yellowfin activity have been finding bluefin to 225-plus pounds biting at the Tanner Bank, the Cherry Bank and the Cortes Bank. The bluefin have been biting during the night and the day with the best chances at the larger bluefin usually coming during the dark. The fishing out this way can be hit or miss but the payoff can be a big bluefin tuna. Kelp paddies, porpoise schools, trolling strikes, spots of breaking fish, spots of breezing fish, meter marks and sonar marks have been leading to the dorado, yellowfin, bluefin and yellowtail. Sardines have been working well for bait along with kite fished flying fish (for big bluefin), Colt Snipers, knife jigs, poppers and surface iron. Trolling strikes are also being reported on bluefin, yellowfin and dorado with cedar plugs, feathers, Nomad Madmac jigs and spreader bar rigs all being effective. Striped marling fishing has been slow most days but there are still some marlin around. The past weekend saw a few marlin hookups incidental to tuna fishing which were all lost but 2 marlin were successfully caught and released ahead of the weekend on Thursday. The areas where there has been occasional marlin activity reported have been in the region of the 43 Fathom Spot, the Corner, the 312 Spot, the 209 Spot, 4 to 5 miles off Dana Point and 8 miles off Pebbly Beach that is located below Long Point at Catalina. has been pretty much of an unknown with regard to there being any recent reports. There has been so much good fishing going on in nearby offshore waters that very few if any people have been fishing Los Coronado Islands. At last report, the surface fishing was good for calico bass at the Middle Grounds, there was a bit of yellowtail activity off the lighthouse at the south tip of South Island and there were a few bonito biting at North Island and the Middle Grounds. The bottom fishing around Los Coronado Islands has been very good for a mix of reds, rockfish and whitefish. The best areas for the mixed bag bottom fishing have been to the northwest, north and northeast of North Island in 25 to 60 fathoms. An important reminder to anglers fishing in United States waters is that the fishing for rockfish in Nearshore waters and the fishing for Nearshore rockfish species no matter where they are caught is currently closed. Please refer to the Department of Fish and Wildlife website for all the details about the closed areas and the closed species at www.wildlife.ca.gov. Anglers need to know that the current closure regulations are in effect through December 31, 2023 when the usual seasonal rockfish closure will come into effect and be in effect from January 1, 2024 through March 31, 2024. The fishing along the San Diego County coast has been good for a mix of calico bass, sand bass, sculpin, whitefish and sheephead and there has also been a chance at catching a few bonito along with a bonus yellowtail, halibut or white seabass. Calico bass have been providing most of the surface fishing activity along the San Diego County coast with productive areas being the Imperial Beach Pipeline, the hard bottom to the northeast of Buoy #3 at Point Loma, the Dropoff at Point Loma, the Green Tank, La Jolla, Solana Beach, Leucadia, South Carlsbad, the Barn and San Onofre. bass, sculpin, sheephead and whitefish have been biting for them at kelp bed and hard bottom areas off South Carlsbad, Leucadia and Solana Beach. He also mentioned that some of the Oceanside Sea Center boats have been doing well fishing for rockfish in areas outside of the closure zone that are open to rockfish fishing. As the calico bass fishing has been starting to slow some in the late part of the season, more and more boats fishing out of San Diego Bay and Mission Bay have been fishing for sculpin, sand bass, sheephead and whitefish at hard bottom and structure spots off Imperial Beach that include the Imperial Beach Pipeline. The yellowtail fishing along the San Diego County coast has been slow but there has been occasional yellowtail activity found off La Jolla. In addition to a chance at a yellowtail, La Jolla has also been producing a few bonito which have been biting on sardines. To locate yellowtail at La Jolla look for areas of bait, working birds, breaking fish, meter marks and sonar marks. The best zone has been fishing from the outskirts of the upper end of the MLPA closure zone at the lower end of La Jolla on up to the upper end of La Jolla in 7 to 35 fathoms with the 7 to 20 fathom depths being the best. Once yellows are located, try surface iron, yo-yo iron and sardines or mackerel that are either flylined or fished down deep on a dropper loop rig. Halibut fishing along the San Diego County coast has been producing an occasional legal sized halibut. A couple of the better areas for halibut have been off Imperial Beach and at the sandy bottom next to the structure of the sunken NEL tower or the structure of the Yukon shipwreck off Mission Beach. A good depth range off Imperial Beach has been in 37 to 50 feet and 50 feet has been a good depth off Mission Beach. Other productive halibut areas have been San Diego Bay, the area at the end of the sunken jetty off Coronado at the entrance to San Diego Bay, Mission Bay, Black’s Beach, South Ponto Beach, the Buccaneer Pipeline, the sandy bottom next to the structure of the artificial reefs outside of Oceanside and San Onofre. The fall fishing season has been a good one so far and things might continue to remain good for a while longer if we do not get hit by strong northern weather systems.
