May is one of my favorite months. I celebrate my birthday, and Mother’s Day gives me an opportunity to thank all the women who have made such a difference in my life: my mom, my grandmother, my step-mother, and my mother-inlaw – not to mention so many other female role models. I’m fortunate to call a number of women “Mom.” My mother graduated from high school at the age of 16 and began working for the United States Air Force. After she married my dad, she soon became a stay-athome mom, raising four children. When I married at 21, I was given the gift of a second “mom.” My mother-inlaw, Noreen, had three sons and enjoyed welcoming “daughters” to the family. When her son and I divorced, she never took sides and instead maintained our relationship and her involvement with her grandchildren. When my mom passed away in 2001, my relationship with Noreen became even more important. She was even there at my wedding when I remarried in 2009, supporting me unconditionally. An amazing grandmother to my children, she is also a friend and role model to me. My husband David’s mom and two stepmothers were also present at our 2009 wedding. I was blessed to meet three women, all so different from one another, who nevertheless all received me with the same welcoming open arms. Along with all these wonderful “moms,” I am fortunate to have a number of female peers who support and inspire me. In addition, Armed Forces Day and Memorial Day, also in May, remind us to pay respective tribute to those women and men who currently serve in the United States’ armed forces, and to those who gave their lives during service. This May, I hope we all take a moment to thank those whose dedication and support have enriched our lives. And remember: Summer will be here before we know it, so get out and enjoy your May!

Don’t Let Your Legal Rights Float Away When Cruising the High Seas By Attorney Joshua D. Ferraro and Gary S. Lesser, Esq., Managing Partner

This year more than 20 million people throughout the world will embark on cruise vacations to destinations ranging from the Western Caribbean to the Far East. Each of these passengers can expect to enjoy new sights, adventure and (in most cases) large amounts of food. However, it’s those things that cruise passengers rarely expect that can end up costing them a relaxing vacation, and often a whole lot more. According to a study published through the National Center for Biotechnology Information, about one percent of cruise passengers will experience a traumatic injury during a cruise vacation. By far, the most prevalent cause of injury is an onboard slip and fall, but other common injuries occur on shore excursions and during tenders from ship to shore. If you are injured during a cruise vacation as a result of actions, inactions or negligence on the part of the cruise line, any employee of the cruise line or any company operating a shore excursion sponsored by the cruise line, you may have a legal entitlement to compensation. However, the procedures and deadlines for exercising these rights are much different from those in a typical personal injury case. The most important differences between a cruise ship injury case and a land-based injury claim are as follows: •

Cruise ship injuries are typically governed by federal maritime law (the law of the sea), rather than state civil law

Most of your rights and obligations are set forth in your cruise ticket, which is considered a binding contract.

You will need to file any lawsuits within one year, instead of the four years typically permitted in landbased injury claims.

If you are injured during a cruise vacation, follow these tips to ensure that you do not waive any rights: •

Report the injury as soon as possible to a cruise employee and make sure that they follow-up by documenting the time, place and manner of your accident.

Seek medical care immediately if you are injured. Almost every cruise has medical personnel on board, ranging from trained EMTs to board certified physicians. Most ships have the capability to run tests, take x-rays and even perform minor procedures. Make sure that you document all of your injuries Continued page 7

Ask for a copy of any medical notes or records that are taken while treating you on board.

In rare circumstances, injuries will be so severe that you will need to be removed from the ship. In this case, you should contact the U.S. Embassy immediately to ensure that you are taken to a facility that can provide appropriate care.

If your accident was the result of a slip and fall, be sure to keep your shoes and your clothes so that they can be examined in the event the claim proceeds to court.

Ask if the incident was captured on video and ask to see a copy of the video. If they will not allow you to see the video, ask them to preserve it so that you can get a copy later. If possible, make this request in writing.

Every major cruise line requires that you provide formal notice of a claim within a very short period of time and that you file a lawsuit within one year. These

requirements are set forth in your ticket and they are binding upon you. These deadlines are far shorter than for most land-based accident claims, so it is vitally important that you obtain legal advice as soon as possible. •

Keep in mind, that most major cruise lines require that any lawsuit claiming personal injuries must be filed in South Florida. Therefore, if you live in another state, you should make arrangements (if possible) to consult with a South Florida cruise injury lawyer before you leave town.

Unfortunately, the unforeseen sometimes happens, and when it does, it is important to be informed so that important rights are not inadvertently waived. “Knowing What They’ve Got” By Darla Parris Smallwood

Joni Mitchell said it in the 70s. The glam metal band Cinderella said it again (albeit somewhat differently) in the 80s. California rockers the Counting Crows reiterated Mitchell’s “Big Yellow Taxi” sentiment in 2002. And Mirasol’s own Becker family discovered firsthand the truth of those lyrics in 2004: “You don’t know what you’ve got till it’s gone!” Michael, originally from New York, and Audrey, a New Jersey native, lived in Irvington (Westchester County, New York) before making Florida their permanent home. Like countless other Northerners, the Beckers initially vacationed here, drawn to the perpetual sunshine and slower pace. They fell in love with the area, and in 2003, they bought a second home in BallenIsles. But they never thought they’d relocate for good. Michael was convinced that he’d be a New Yorker for life. Then, a couple of years later, the Beckers sold their Palm Beach Gardens home. “It just seemed like the right thing to do at the time, and we thought we might eventually get another vacation home in the area,” Michael explains. However, he and Audrey were unprepared by how much they’d instantly miss having a place here. “The minute we were without one, it hit us. We 8

ended up selling our house in Westchester, buying another BallenIsles house, and moving here full-time in 2005.” After three years, the Beckers made another move – a much shorter one this time – to Mirasol, where they have lived for the past nine years. “We really surprised all our friends and family when we decided to move to Florida permanently. We had spent four years fixing up our Westchester house and making it gorgeous, and we were very involved in the community there,” Audrey explains. “But we love it here. We would never go back to the cold.” Michael agrees: I couldn’t be pried away to go back to New York even if you paid me – well,


okay, maybe if you paid me enough,” he jokes. Florida’s luxurious warmth and laid-back lifestyle, however, does not mean that the Becker family spends all day lying around on their respective chaise lounges. When he came to Florida, Michael sold his two New York Video rental stores (including Manhattan’s very first of its kind, opened in 1978), and started a “second act” in investment management. He is now a senior vice president in Suntrust Bank’s private wealth division. Audrey, who spent many years in finance before turning toward her interior design talents, now operates her own small home-based business, Coastal Interiors of the Palm Beaches. also teaches private paddle-boarding lessons out of Guanabanas. In addition, both Michael and Audrey actively give back to their neighborhood and community. Michael serves as neighborhood HOA president, and is a member of the finance and member selection committees, as well as various other committees and boards. Beyond his community, he is a board member for Junior Achievement, as well as past president of the Palm Beach County Estate Planning Council.

Audrey volunteers with Meals-on-Wheels, and she also serves as garden coordinator for Abacoa Community Garden. The community garden follows organic, sustainable growth principles in raising vegetables, fruits, wildflowers, plants, shrubs and trees, while offering charitable and educational opportunities for all ages. “Our interests are pretty different,” says Michael. “You’ll find her snorkeling or paddle-boarding at the beach, or working in the garden. I just like to drive by the garden. You’re more likely to find me at the gin table or on the golf course – though golf doesn’t love me as much as I love golf.” Those differences are what makes for a good marriage, the two agree. Those differences, along with one big similarity: Both Michael and Audrey share a love for of family and friends, and for the place that’s truly become their “home, sweet home.” 10

“We brag so much about how great it is to live here that everyone followed us here,” says Audrey. “Everyone” includes Michael’s 33-year-old son Steven and his wife Taryn, as well as Audrey’s mom, sister, and niece (Brianne Carroll, DVM, of Gardens Animal Hospital). “We even have two friends who just bought in BallenIsles.” While Melissa, Michael’s oldest daughter, remains in New York, the Beckers’ 17-year-old daughter, Alexa, lives at home with her parents. She is a junior in the International Baccalaureate (IB) program at Dwyer, where she also she plays lacrosse for both the junior and varsity teams. Alexa, who used to jump horses in Wellington as well, continues to be involved in the arts as a singer and actor. “Together, we’re all one big, happy extended family,” says Audrey. A family that includes Coco the Schnoodle and Nigel the pug. And just what is it about Mirasol that makes the Beckers so extra-happy? “The landscaping of the grounds, the secondto-none facilities, the wide range of ages – including the 375 kids that add such liveliness to our community…” says Michael. “Settling here permanently was the right move,” he adds. “Even though I put a suit and tie on every morning, I still feel as if I’m on vacation every day.”  ————————————————————————————————————— Do you have a story to share, or do you know a neighbor who does? Before you head out to the pool or beach, consider these tips: • Swim in designated areas supervised by lifeguards. • Swim with a buddy; do not allow anyone to swim alone. • Never leave a young child unattended near water, and do not trust a child’s life to another child. Teach children always to ask permission to go near water. • Have young children or inexperienced swimmers wear U.S. Coast Guard-approved life jackets around water, but do not rely on life jackets alone. • Maintain constant supervision, and avoid distractions while supervising children around water. • Make sure everyone in your family learns to swim well. • Secure your personal pool with appropriate barriers. Many children who drown in home pools were out of sight for less than five minutes and in the care of one or both parents at the time. • If a child is missing, check the water first. Seconds count in preventing death or disability. Diving Safety Serious spinal cord injuries, permanent brain damage, and death can occur when people dive into shallow water or spring upward on the diving board, then hit it on the way down. • Check water depth before diving. Enter the water feet first, especially when going in for the first time. • Never dive into above-ground pools; they are usually not deep enough. • Never dive into the shallow end of a pool. • Never dive through inner tubes or other pool toys. • Take classes to learn proper diving techniques. Additional Safety Tips • Keep appropriate equipment nearby: reaching or throwing equipment, a cell phone, life jackets and a first aid kit. • Know how and when to call 911 or the local emergency number. • Protect your skin by limiting the amount of direct sunlight you receive between 10am and 4pm and wearing sunscreen with a protection factor of at least 15. • Drink plenty of water regularly, even if you’re not thirsty. Hemorrhoids By Ronald S. Zelnick, MD, FACS, ASCRS; Board-Certified

No one likes to talk about them, but millions of people worldwide suffer from hemorrhoids, enlarged, bulging blood vessels in and about the anus and lower rectum. External hemorrhoids develop near the anus and are covered by sensitive skin. Mild symptoms can be relieved by increasing fiber in the diet, avoiding excessive straining, taking warm baths and using anesthetic creams. However, if a blood clot develops in an external hemorrhoid, a painful swelling may occur. (It bleeds only if it ruptures.) Evacuation of the clot, performed under local anesthesia with a small incision, may bring immediate relief. Excision is the best method of permanent removal, and is necessary if clots repeatedly form, protruding hemorrhoids can’t be reduced, or persistent bleeding occurs. The surgery is done under anesthesia, usually as an outpatient procedure. Internal hemorrhoids develop within the anus beneath the lining. Painless bleeding and protrusion during bowel movements are the most common symptoms. However, severe pain can result if it protrudes from the anal canal and cannot be pushed back in. More severe symptoms of internal hemorrhoids may be

treated by rubber band ligation or by HET bipolar systems (Hetsystems.com), the newest treatment, which applies highenergy compression to internal hemorrhoids while a patient is under sedation. It can be done in combination with colonoscopy, and multiple hemorrhoids can be treated in one procedure. While the exact cause of hemorrhoids is unknown, our upright posture forces a great deal of pressure on the rectal veins, causing them to bulge. Aging, constipation, diarrhea, pregnancy, heredity, straining due to poor bowel function, overuse of laxatives, and spending long periods of time on the toilet may also be contributing factors. There is no relationship between hemorrhoids and cancer. However, because the symptoms of hemorrhoids (particularly bleeding) are similar to those of colorectal cancer, having symptoms investigated by a physician is imperative. Donn R. Colee Jr. Presents Towers in the Sand By Veronica (Ronnie) and Ian Helsby, PR co-chairs, Palm Beach Historical Society

On Wednesday, May 10, Donn R. Colee Jr., author of Towers in the Sand: The History of Florida Broadcasting, will discuss his story of the people, the radio and television stations, and the events that built an industry in the state of Florida. Colee, a 41-year resident of Palm Beach Gardens, is a seventh-generation Floridian and second-generation Florida broadcaster. He began his career as a teenage disc jockey at Orlando’s top-rated rock ‘n’ roll radio station. In 1971, after service in the US Navy, he moved to Palm Beach County and joined his father’s advertising and public relations firm. In 1988 he resumed his broadcasting career at WPEC CBS 12, working in marketing, community relations,

programming, and senior management positions. He took early retirement from the station in 2009 to finish his book and to serve as a nonprofit fundraising consultant. Donn is a member of the Florida Association of Broadcasters, Leadership Palm Beach County (class of 1985), and the Florida Historical Society, as well as historical societies of Palm Beach County, Fort Lauderdale, and St. Augustine. He is an avid fisherman and boater and serves on the board of the West Palm Beach Fishing Club. He and his wife, Martha, reside in Palm Beach Gardens.
