What’s at stake in the 2013 election?

ast February 12, the Senate race began between President Benigno “PNoy” Aquino III’s handpicked candidates and the opposition Three Kings’ handpicked candidates. PNoy’s Liberal Party-led coalition of candidates from five different political parties were proclaimed at Plaza Miranda in Manila while the Three Kings’ United Nationalist Alliance (UNA) candidates were proclaimed in Cebu City. Each slate has 12 candidates. At stake are 12 Senate seats. And by the looks of it, it’s just like any other mid-term senatorial election. There is nothing unusual about it, right? Wrong! Although, the senatorial lineups seem to appear “normal” by Philippine election standards, there is something – or should I say, several things – odd or strange about some of the candidates. And underneath the seemingly placid political waters, there is a great deal of crosscurrents going on that could pull a candidate down. Team PNoy But first, let’s look at the leaders of the two opposing slates. PNoy is using his popularity to sway the voters to support his “Team PNoy,” hoping that branding them under his own moniker would attract a lot of votes. And as the team’s
campaign manager, Sen. Franklin Drilon, hammered it in at the Plaza Miranda rally, “It’s time to show support to President Noy!” Yep, a vote for Team PNoy is a vote for PNoy. PNoy told the cheering crowd about his administration’s accomplishments. He said that he needs the Team PNoy candidates to win so he could continue his reforms. Then he criticized the opposition candidates whom he claimed are running only to promote their personal interests and that of the previous administration of Gloria Macapagal Arroyo, reminding them of the anomalies during her presidency. It is interesting to note how PNoy associated the UNA candidates with Gloria. Other than Mitos Magsaysay and Migz Zubiri, who were once members of Gloria’s political party, LakasCMD, the other 10 candidates have no political association with Gloria. PNoy is treading on dangerous waters when he tries to link the UNA to Gloria, who has yet to be convicted of any crime. As a matter of fact, for lack of evidence the courts threw out most of the corruption and plunder cases filed against her. But PNoy said that more cases would be filed against her. All of these could boomerang against PNoy and hurt the Team PNoy candidates at the polls in the May election. “Three Kings” On the other hand, the Three Kings -- Vice President Jejomar “Jojo” Binay, former President Joseph “Erap” Estrada, and Senate President Juan Ponce Enrile -- are carrying a lot of excess baggage. Binay, who made his presidential aspirations known long time ago, has to explain a lot of things that
happened when he was mayor of Makati City from 1986 to 1998 and 2001 to 2010 -- a total of 19 years! An article, “The Lord of Makati,” was published on March 28, 2001, when he was running for another term as Makati mayor. The article says, “Can Binay explain his wealth? In less than a decade, Jejomar ‘Jojo’ Binay, former chair of the Metro Manila Development Authority (MMDA) and former mayor of Makati, accumulated at least P80 million worth of real estate properties in Makati and Batangas, which he kept undeclared…” To date, Binay has yet to explain his wealth. Erap carries the stigma of having been convicted of plunder while Enrile was haunted by his long association with the dictator Ferdinand Marcos. He was one of the “Rolex 12” who assisted Marcos in planning the martial law in 1972. Although Erap and Enrile aren’t running for national office, they have an agenda in this year’s election. Erap’s son, Sen. Jinggoy Estrada is positioned to become Binay’s vice presidential running mate in 2016. Enrile, who will be termed out in 2016 would like to see his son, Juan Ponce “Jack” Enrile Jr., elected senator this year. But Jack is getting a lot of flak because of several incidents in his past that involved people getting killed. Although he came out clean in those cases, there are a lot of people who are not totally convinced of his innocence.
in this year’s election is the presence of dynastic candidates. There are five dynastic candidates in Team PNoy, namely: Alan Peter Cayetano (brother of incumbent Sen. Pia Cayetano); Paolo Benigno “Bam” Aquino IV (nephew of PNoy); Cynthia Villar (wife of termed out Sen. Manny Villar); Juan Edgardo “Sonny” Angara (son of termed out Sen. Edgardo Angara); and Ramon “Jun” Magsaysay Jr. In the opposition UNA, there are five dynastic candidates: Jack Enrile; Joseph Victor “JV” Ejercito (son of Erap and halfbrother of Jinggoy); Margarita “Tingting” Cojuangco (aunt-inlaw of President Aquino); Nancy Binay-Angeles (daughter of Binay); and Milagros “Mitos” Habana-Magsaysay. In my article, “Should the Philippine Senate be abolished?” (February 6, 2013), I wrote: “If all 10 dynastic candidates win in the May elections and you add the three incumbent dynastic senators (Juan Ponce Enrile, Jinggoy Estrada, and Pia Cayetano), there would be a total of 13 dynastic senators in the new Senate. That’s more than 50% of the entire Upper House of the new Congress! That’s not ‘representative’ of the people. That makes the eight family dynasties collectively in control of the majority of the Senate. That’s called dynasticracy.”
Roxas-Binay rivalry So what’s at stake in the 2013 election? Recently, Drilon alleged that the UNA is out to make PNoy a Dynasticracy “lame duck” president. Binay But what is most noticeable denied the allegation, saying,

“UNA remains supportive of Aquino’s ‘Daang Matuwid’ and reform agenda but would not hesitate to expose to the public any wrongdoing it will see.” However, he said, “We are the new opposition, an opposition who will be supportive of matters which the President is undertaking.” He claimed that some quarters are just trying to create a “wedge” between them. Really? Last January 31, Drilon announced that the Liberal Party is going to field Interior and Local Government Secretary Mar Roxas as its standard bearer in 2016. With Binay running for president, would the entry of Roxas in the presidential derby bring out the old rivalry between the Samar (Noy-Bi) and Balay (Noy-Mar) factions? It would be interesting to know how PNoy would deal with a Roxas-Binay presidential contest? Would he remain loyal to the Liberal Party and support Roxas or would he support Binay, a long-time family friend whom the Noy-Bi people say would take a bullet for PNoy? In addition to Roxas and Binay, two other dynasts are expected to run for president in 2016 – Senators Ferdinand “Bongbong” Marcos Jr. and Ramon “Bong” Revilla Jr., the new chairman of the Lakas-CMD Party. The 2016 presidential election might turn out to be a battle royale among the country’s powerful dynasties. Makes one wonder what did we gain in 30 years after the EDSA People Power revolution? It looks like we’re going back to square one.

Gov’t appeals to Malaysia to allow Sen. Santiago calls on students to join ‘net revolution’ against corruption entry of humanitarian mission
Deputy Presidential Spokeswoman Abigail Valte announced that Foreign Affairs Secretary Albert del Rosario has sent a note verbale to the Malaysian Ambassador to the Philippines seeking permission to allow a humanitarian mission to enter Sabah. The mission will assist Filipinos affected by the bloody clashes between the Sulu Sultanate’s army and Malaysian forces as Malacañang once again appealed to the loyalists of Sultan Jamalul Kiram III holding fort in Sabah to reconsider their stand and surrender immediately. At least 12 Filipinos were reportedly killed in the violent encounter with the Malaysian troops seeking to end the standoff that started early last month in Sabah.
Sen. Miriam Defensor-Santiago is calling young students to use the social media in the fight against traditional politicians in the coming May elections. Speaking at a recent symposium spearheaded by the UP Student Council in Manila, Santiago said young voters should use the internet to determine the fitness of the present batch of senatorial candidates to be in office for the 16th Congress this July. He is reportedly amenable to fight before his adoring fans in the Philippines.

The Stunning Resignation of Pope Benedict XVI

n Monday, February 11, our beloved Holy Father Pope Benedict XVI announced his decision to step down on February 28 saying that “... both strength of mind and body are necessary, strength which in the last few months, has deteriorated in me to the extent that I have had to recognize my incapacity to adequately fulfill the ministry entrusted to me.” He had seen how his two immediate predecessors Pope John Paul II and Pope Paul VI carried on despite pitifully emaciated bodies and functions. A highly intelligent intellectual, Pope Benedict’s eight years in the papacy will be remembered for his humanity, his willingness to admit and apologize for errors committed in the Church. He will also be remembered for his courage and selflessness to resign when it is due. Very soon after he became pope, he removed the pedophile priest Father Marcial Maciel from active ministry and his honored position within the Vatican. Maciel, the Mexican founder of the Legionaires of Christ, was alleged to have sexually abused young men in his seminaries as well as fathered several children. As Cardinal Joseph Ratzinger, he knew about Maciel and he probably agonized over Pope
John Paul’s sweeping Maciel’s misdeeds under the rug. In 2009, Pope Benedict wrote to Catholics in Ireland and expressed his sorrow and shame at what the victims of pedophile priests went through. In 2006, he quoted a 14th century emperor who attributed evil and inhuman violence to Islam and had resulted in demonstrations in India and Muslim countries. Later, Vatican issued a statement that the quotation was not the Pope’s thoughts and he apologized for the misunderstanding. He had also incurred the anger of Jews when he readmitted the Holocaust denier Bishop Richard Williamson of the Lefebvrist group excommunicated by Pope John Paul II. All of these are probably due to his nerdiness or naivete. The resignation is definitely an act of selflessness and humility. As absolute head of 1.3 billion Catholics making up a 2000 year-old institution, he could have forestalled many liberal movements in our time – gay marriages, women priests, contraception, stem cell research. Indeed, it requires superhuman strength to buck the march of time. The conclave of cardinals will be electing a new pope in March and it is not likely that the new pope will be much less conservative than John Paul II or Benedict XVI for they were all elevated to being cardinals by these two popes. Still, a younger pope may be more inclined to changes that would redound to the benefit of the Church. There is fear that the new pope would hesitate to act freely while a living ex-pope is looking over his shoulder. Since Benedict appointed a
majority of the cardinals who will elect his successor (67 out of 117), he should be confident that the new pope would not do anything drastic to negate or change his papacy. As Pope Emeritus, he would do himself and the Church tremendous good by returning to writing and doing scholarly work as a theologian.
As the Catholic Church becomes more and more a universal church, a non-European pope is probably needed to reverse the dwindling attendance in churches. This possibility looms up as the six or seven “papabiles” (likely candidates to be elected pope) include an African (Cardinal Peter Turkson of Ghana) and a Canadian (Cardinal Marc Ouellet) both of whom are in their sixties. The newly appointed Filipino Cardinal Chito Tagle is not a papabile. He might be perhaps in twenty years or so. Benedict’s resignation was a stunning move, not because it has not happened in over six centuries, but because it is a vast departure from John Paul’s papacy to which his has been thought to be a continuation. It really should not be a surprise. Benedict has shown hard-boiled courage in doing what he thinks
is right as he did regarding Maciel and Williamson mentioned earlier. These moves directly contradicted what John Paul did. By the same token, wouldn’t it be something if the new pope readmits Rev. Roy Bourgeois who was ex-communicated during Benedict’s watch because Father Roy advocated the ordination of women priests. The new pope might also consider a Vatican III to address the many modern-day problems besetting the Church. For now, we join the vast crowds at St. Peter’s Square in pouring out their affection for our beloved Holy Father with “Viva Il Papa!” (Long Live the Pope!) In his short tenure, Pope Benedict XVI has shown such sterling character traits as courage, selflessness, humility, wisdom and love for people. May the Lord God bless and guide him in his retirement!
Nietes’ rallies to keep WBO crown
Donnie Nietes rallied in the last two rounds and settled for a 12-round majority draw against Mexican challenger Moises Fuentes in their World Boxing Organization (WBO) lightflyweight title match Saturday night in Cebu City. The draw allowed Nietes who was making the second defense of the title he won in late-2011, to keep his hold on the WBO 108-pound division crown.

Filipino judge Danrex Tapdasan scored it 115-113 for Nietes, while Adalaide Byrd and Pat Russell, both from the US, both scored it 114-114. The 31-year-old Nietes appeared to have connected the cleaner blows against the Mexican challenger who, aside from being six inches taller, is also younger at 26 years old. As early as the first round, Nietes had landed his favorite
right on Fuentes’ face. However, Fuentes later opened a cut through a legitimate blow and an accidental clash of heads causing the Filipino champion to bleed profusely. The Mexican took advantage of the situation but Nietes avoided getting hit by another fatal blow. The Filipino remained on his feet and at the same time land occasional blows until the final bell sounded.

In Remembrance

Nunavut – The preceding month is an auspicious period of sorts. For one, it is EDSA ’86 Anniversary, as well, it is my birth month. Two, it is the Death Anniversary of Linda, the late Editor-in-Chief of the Filipino Journal, who is the topic of my article on this issue---the celebration of her life, how she had been an influence to this writer in one way or the other. I met Linda at Casa Buena through Rod Cantiveros. I left the Philippines with my family on 22 December 1987. The following day of our arrival my sister-in-law, Bernadette, suggested if I need to mingle with Filipinos I shall visit Casa Buena where Filipinos congregate to socialize and buy Oriental foods. At Casa Bueno, curious to discover my new environment I keep turning left and right when I heard a baritone voice, “Bagong dating ka ano?” Albeit startled, I managed to reply, “Paano mong nalaman na bagong salta ako?” My greeter gave out a wide grin with chuckles, “Ang suot mo, manipis, halata, hindi gawa dito sa Canada”. Thereafter, Rod invited me for coffee. We chat about the latest news from the old homeland. Learning I had formal studies in Journalism,Rod gleefully shared that he and his wife, Linda, recently bought out a community paper and renamed it, The Filipino Journal. That if I am interested to contribute a column, I would be introduced to Linda being the Editor of the paper. I disclosed to Rod that in the Philippines I do not regularly write an opinion column except when I was asked to write editorials as guest, or
write policy speeches of some politicians, or help draft policy papers to bureaucrats. I am more of a “ghost writer” in terms of writing experience. “When are you prepared to submit your maiden column?” Linda inquired with her soft voice when I was introduced to her. “I will find fine time since I still need a sufficient period to adjust”, I reluctantly replied since I am not certain of the instance I could start writing. In the period that I work with her for two decades until her body succumbed to the debilitating ailment, I find Linda a paragon of patience. I never felt any pressure when we have deadlines to beat since the printer has schedules too to beat to finish their job orders. Her reminders are gentle when I am remiss in my in my submission. Linda would gently say, “Rod is driving tomorrow to Steinbach to print the last edition. Do you think before 12:00 midnight you can send off your column?” I remember the days when The Filipino Journal and the radio program, Good Morning Philippines took the lead role in boycotting a chain of grocery stores. After a yearlong boycott the Head Office of said grocery chain contacted me through a kababayan explaining that since The Filipino Journal and Good Morning Philippines were in tandem in leading the boycott against them, the query was conveyed if it is possible the Filipino Community could now “forgive” and be “reconciled” with the establishment? (I received the information that the store was losing sales of $50,000.00 per day. The other members of the migrant groups, i.e., East Indians, Chinese, Vietnamese, and Pakistani joined the boycott too). The first party I conferred with regarding the sensitive matter are the spouses Rod and Linda. The latter opined, “Bob, we are Christians. We have the right to defend our honor. But, we neither harbor grudges, nor are we vindictive people”.On that note

the other community leaders at the time were contacted to discuss the issue of lifting the call of boycott and “accept” the offer of apology of the offending establishment. The seven of us including Linda Cantiveros and I, were dubbed as the Committee of Seven. The five others were Rey “Kaka” Pacheco, Fred de Villa, Ric dela Cruz, Edda Pangilinan, and the late Joe Sulit. When the Commission of Overseas Filipinos sought documented information about the precedent setting act of expatriate Filipinos not only in North America but elsewhere, copies of The Filipino Journal were mailed out to Malacanang Palace. Linda, being the Editor-inChief, is always in the forefront on issues that affect the interests of the old homeland. Occasions I vividly recall was the lobby in behalf of the Philippine Airlines to grant the Flag Carrier landing rights in Canada. It was a long drawn effort. But today, Canada, have granted the airlines direct flight from Manila to Toronto and return. When I lodged the complaint of racial discrimination against Winnipeg Free Press and the Winnipeg Police Service for naming the ethnic background of offenders who are members of the Filipino-Canadian Community when they were suspected of violation; but, does not name the country of origin of convicted criminals who are Caucasian looking----Linda supported me to grieve with the concerned respective parties. A meeting with the management of Winnipeg Free Press were convened joined by a police officer. Curiously, in 1999, I was named by Winnipeg Free Press in their rooster of “Who is Who”, earning the moniker of “community activist”. Trying times are the best gauge in determining who the true friends are. In 1988, I proposed to the Provincial Government to recruit Philippine trained nurses to address the shortage of hospital beds for lack of healthcare delivery workers. It took the incumbent government ten years to approve
the long delayed proposal. But it was the NDP government that executed the proposal after additional two years of waiting. Bringing Philippine trained nurses was no excursion. I was reviled by many that my proposal was a scam and I was falsely accused of bilking 1,000 Filipino Nurses at $1,000.00 dollars each. I never earned a single cent out of my civic initiative. I lobbied the government to grant settlement funds to nurses who successfully entered Manitoba, yet, some kababayan maliciously suggested in their newsletter that my house be lobbed with a grenade bomb for fooling Filipino Nurses. Sinister innuendos reached my wife that I impregnated five recruited nurses. The days that I was seething with anger plotting my revenge, Linda, all along calmed me down. That I should pray for patience for eventually vindication would

come. “Vengeance is mine, said the Lord”, Linda would remind me when rage seem to overcome me. As I write this essay, my wife and I commiserate with the survivors of Linda. I still have the feelings of sorrow over the loss of Linda due to Cancer. We grieved when we lost our job, some mourn when they undergo divorce. But bereavement over the death of a dear one is far deeper than sorrowful feelings when one loses a job, or had gone through divorce. From a Biblical perspective, however, the death of God fearing people is precious in His sight. For in death there is no more suffering, not more pain, and no more sorrow. Yes, life is fragile. Life is short. Death is sure. Life must be handled with care.

he email read, “Can you fit the Porsche 911 Carrera S into your schedule?” I barely had a chance to hit the reply button and I was already thinking of where to drive the second Porsche in as many months into my first year reviewing new model cars for the Filipino Journal. I believe in the same split second, I pretty much figured I’d cancel all my appointments and justified delivering a bundle of the newspaper to Brandon. For nearly a week in September, I spent nearly every waking moment in the Porsche Panamera S Hybrid. Of course I’d fit the 911 Carrera S into an incredibly tight travel and project schedule. I didn’t cancel any meetings. The closest thing I’ve had in owning a Porsche 911 was a small diecast model back in high school and I was anxious to sit behind the wheel.
Ferry Porsche once said: “ The 911 is the only car you could drive on an African safari or at Le Mans, to the theatre or through New York City traffic.” I don’t think Ferry made it to Manitoba but the thought would easily apply to the country roads of Manitoba in the middle of winter. In its 7th generation, the 911 continues to be an iconic sportscar. This model is larger, lighter and faster than previous models. Sitting behind the wheel of this beautiful machine was a delight to the senses. The roar of the engine screamed, “Drive me fast. Drive me faster” as we ripped along the country roads in Southern Manitoba. The prairie excursion
was a bit to far in the short amount of time I had that day. Even with high performance winter tires and a slight cross wind and blowing snow, I had to hold back a little. Just a little. The cockpit of the 911 was familiar as the new centre stack console comes from the Panamera. And what cockpit would be without a G-Force metre. Yes, the Porsche 911 Carrera S has a G-Force metre. The only thing I needed now was a fighter pilot’s helmet and a licence to fly! The top speed of the 911 is listed as 304 km/hr. The Porsche 911 Carrera S comes with a 3.8L naturally aspirated flat 6 engine with 400hp. In my real world Manitoba highway
results, 0-100km/hr was under 5 seconds and close to the published sprint times of 4.3 seconds. I’m sure if I owned or rented a test track, I’d be more than happy to test this over, and over, and over again. On a completely different note, the Porsche 911 Carrera S is by far the most expensive and least efficient Filipino Journal delivery vehicle in our history. The storage
capacity that sits in the front of the vehicle was only capable of holding 6 small bundles of the newspaper, or 300 copies of the Filipino Journal. Price as tested of the 2012 Porsche 911 Carrera S was a mere $146,975. I think I may just have to settle with the premium diecast model the next time I see them for sale at Costco.

Good news! Effective December 15, 2012 all Temporary Foreign Workers (TFWs) currently living in Canada who has submitted an application for permanent residency (PR) under the following programs: a. Canadian Experience Class (CEC) program b. Alberta Immigrant Nominee Program (AINP) c. Federal Skilled Worker (FSW) program d. Federal Skilled Trades (FST) program and meet eligibility requirements (ie. received an application file number) may apply for an Open Work Permit (OWP) if their current Work Permit (WP) will soon expire. An Open Work Permit allows a TFW to work for any employer(s) in Canada and in any location – without requiring an approved LMO (except for Provincial Nominees, they can only work in the province that nominated them). This provides the TFWs greater flexibility and freedom to integrate with the Canadian society while waiting for their PR application approval and eliminates the burden of obtaining a new LMO to get a WP. In the past, applicants who were waiting for the decision on their PR application may have to continue working with their current employer because they are dependent on them to apply for a new Labour Market Opinion (LMO) to obtain an extension of their Work Permit. Before their current WP expire, the TFW has to persuade his current employer to re-apply for a new LMO through Service Canada (a process that could take 2 to 3 months or more) or find a new employer who is willing to hire him and go through the often grueling LMO application process... before he can apply for a new Work Permit. Consequently, while waiting for their PR application approval, the TFWs are stuck to work with their current employer unless they can find another employer who will obtain for them a new LMO. This limits the flexibility of the TFWs to move to another job and find a better employer – if they are not happy with their current employer. Since Work Permits
To be eligible to apply for a bridging Open Work Permit (OWP), the PR applicant has to meet the following requirements: a. The applicant has to be living in Canada b. The applicant has a valid WP that is due to expire within four (4) months c. The applicant has received a positive eligibility decision on the PR application under one of the Economic Class PR program listed at the beginning of this news article d. The applicant has to indicate in his WP application that he is applying for a bridging OWP The OWP is valid for one (1) year from date of issuance. Generally PR applications decisions are completed within a year. However, if the PR application process takes longer than 12 months, the TFW can apply for an extension of their OWP. This new government policy makes the treatment of other PR applicants consistent – to those who apply under In-Canada PR programs such as the Live-In-Caregiver (LIC) class, Spouses or Common-Law Partners in Canada class, Refugee class, etc. Applicants under these programs become eligible to apply for an Open Work Permit as soon as their application has been “approved in principle” or upon submission of their PR application. They do not require an approved LMO or job offer from an employer to apply for an Open Work Permit. Frequently Asked Questions (FAQs) regarding Work Permits and Employment Contracts Q1. Can my spouse or common-law partner work in Canada? ANS: It depends. Yes, your spouse or common-law partner can apply for an "open" work permit—allowing him/ her to accept any job with any employer without an approved LMO if you meet these conditions: a. You are a TFW in a skilled job category under NOC: O, A or B (eg. cooks, supervisors, managers, nurses, engineers, electricians, welders, plumbers, pipefitters, etc. b. Your Work Permit is still valid for at least six (6) months c. You and your spouse plan to physically reside in Canada while working If your spouse or common-law partner gets an open work permit, it is normally valid for the same period as yours. If your occupation is not under NOC category O, A or B ( low skilled or semi-skilled)... then your spouse has to go through the normal process of obtaining an approved LMO from a Canadian employer before he/she can apply for a regular Work permit. Q2. Are there conditions normally placed on a regular Work Permit? ANS: Yes, normally there are conditions placed on a regular Work Permit (WP). Normally, WPs are employer and location specific. This means that the TFW can only work for a specific employer in a specific work location. For example: an employer who owns hotels in different locations like Edmonton, Red Deer, Calgary, etc. can apply for LMOs for specific locations and the WP are normally issued for specific locations identified in the LMO application. Therefore, if your WP indicates that you are approved to work in a hotel in Edmonton... the employer even though he owns another hotel in Red Deer cannot transfer the
TFW to work there without obtaining a new LMO for Red Deer. The same principle applies to an employer who owns several fast food stores/gas stations, if your WP indicates that you are approved to work in Edmonton ... your employer cannot transfer you to work in Grande Prairie without a new approved LMO for that location. Your Work Permit may limit: a. The type of work you can do, b. The employer you can work for, c. Where you can work, and d. How long you can work, etc. Regulation 185 of the Immigration and Refugee Protection Regulations lists all the conditions that may be placed on your work permit. Q3. As a live-in caregiver, can I return to my home country for a vacation? ANS: Yes, you can return to your home country for a vacation. The length of your vacation should be written in your employment contract. If you take a longer vacation than that, without written consent from your employer, you could lose your job in Canada. If you leave Canada before your application for permanent residence is approved, you may not be allowed to come back into Canada, especially if: a. You come from a country whose citizens need a Visa to enter Canada; or b. Your Work Permit has expired and you no longer have legal status in Canada. In this case, if you cannot return to Canada for any reason, your application may be abandoned. Before travelling, check with your country’s government for information on visiting or exit visa requirements. They may have changed while you have been working in Canada. Citizens from some countries and territories must have temporary resident visas to enter Canada. If you are from one of these countries (Note: Filipinos need a valid Canadian Visa to enter/return to Canada), you may have to get a new Visa before you can return to Canada. This could take time. Find out the rules before you leave Canada. If you stay outside Canada for more than one year or if your work permit expires while you are outside Canada, you will have to reapply to return to Canada under the Live-in Caregiver Program. Q4. What can a TFW do if his employer is not following the terms of the Employment Contract or the approved LMO? ANS: TFWs should always get a signed copy of their Employment Contract and a copy of their approved LMO. The approved LMO indicates the salary, hours of work, employee benefits, contract length, etc. If the employer is not following the terms of the Employment Contract or the terms outlined in the approved LMO, the TFW should contact the government ministry responsible for labour or employment standards in the province or territory where they work. The TFW can use the Employment Contract and the approved LMO as a basis for registering a complaint against their employer. In Alberta, the TFW can contact: Alberta Employment Standards Branch Toll free: 1-877-427-3731 Fax: (780) 422-4349 TDD/TDY: 780-427-9999 (in Edmonton) Website: www.employment.alberta. ca/SFW/1224.html Q5. Can a TFW resign and leave a job before the expiry of his Employment Contract?
ANS: Yes, the TFW can resign and leave a job before the expiry of his Employment Contract. However, the TFW has to submit a written resignation letter and give the employer the required notice as stipulated in the Employment Contract. On the other hand, if a TFW does not or cannot properly carry out the duties agreed to in the Employment Contract, the employer can fire the employee. The employer has to give the employee the required notice or pay in lieu of notice as stipulated in the Employment Contract. Q6. What happens if a TFW becomes sick, has an accident, is hospitalized or needs to stay home to recover? ANS: The TFW is entitled to sick leave, as set out in provincial or territorial legislation. The employer cannot force the employee to work if they are ill (may need a note from a doctor). The required health insurance or workers' compensation plan (eg. WCB insurance) in your province or territory should cover the employee. The responsibility of the employer depends on the insurance coverage provided under these plans. The employee may also be able to collect Employment Insurance sickness benefits. In Alberta, the TFW can contact: Alberta Employment Standards Branch Toll free: 1-877-427-3731 Fax: (780) 422-4349 TDD/TDY: 780-427-9999 (in Edmonton) Website: www.employment.alberta. ca/SFW/1224.html Q7: Do I need a medical exam to get a Work Permit? ANS: It depends. You may need a medical exam to get a work permit if: 1. You wish to work in a job where it is important to protect public health, such as: a. health services, b. child care or c. primary or secondary education, or 2. You will be working in an agricultural job and you have lived in a designated country or territory, or 3. You want to work in Canada for more than six (6) months, and you lived in a designated country or territory for six consecutive months during the year right before the date you intend to enter Canada. If you need a medical exam, an officer will tell you so and send you instructions on how to proceed. The officer's decision is based on the type of job you will have and where you lived in the past year.
Permit that is valid for six months or more, or d. You are in Canada because you have already applied for permanent residence from inside Canada. You will have to pass certain stages in the main application process before you can be eligible for a Work Permit. There are other requirements as well. Your eligibility will depend on where you plan to apply for your work permit. Regardless of where you apply, you must: a. Satisfy an officer that you will leave Canada at the end of your employment; b. Show that you have enough money during your stay in Canada to take care of yourself and your family members and to return home; c. Be law-abiding and have no record of criminal activity (you may be asked to provide a Police Clearance Certificate); d. Not be a danger to the security of Canada; e. Be in good health and complete a medical examination, if required; f. Not intend to engage in employment with an employer on the list of ineligible employers; g. Not have worked in Canada for one or more periods totalling four years after April 1, 2011, (with certain exceptions); and h. Provide any additional documents requested by the officer to establish your admissibility. If you are in Canada as a visitor (Visitor/TouristVisa), you cannot apply within Canada. You must apply for a work permit at a Canadian visa office: • responsible for the country where you live, • responsible for the country you are a citizen of, or • at a Canadian embassy or consulate in the United States of America. You may be asked to go for an inperson interview at that office. If so, make sure you have all the documents you need to enter that country. Q10: How do I check if a consultant or an Employment Agent/Agency is licensed to handle Work Permits, LMOs, Permanent Resident (PR) applications and any immigration related matters? ANS: After the Canadian law known as Bill C- 35 was implemented in June 2011, only licensed immigration consultants who are members of ICCRC, licensed lawyers and licensed Chambre des notaires du Québec can legally handle and process immigration related matters.

Harper Government Protecting Canadians from Counterfeit Goods New Legislation Introduces Strong New Protections Ottawa, - The Honourable Christian Paradis, Minister of Industry, and the Honourable Vic Toews, Minister of Public Safety, today introduced the Combating Counterfeit Products Act. This new legislation will protect Canadian consumers, Canadian manufacturers and retailers as well as the Canadian economy from the health and economic threats presented by counterfeit goods coming into Canada. "Our Government is standing up for Canadian consumers and businesses, ensuring they do not fall victim to trademark counterfeiting. In today's global marketplace, we need strong, modern rules to protect our economy and the health and safety of Canadians and their families," said Minister Paradis. "Counterfeit products hurt our economy, undermine innovation, threaten jobs and expose consumers and their families to unsafe products." The Combating Counterfeit Products Act will provide the Canada Border Services Agency (CBSA) with the authority to take action against the commercial movement of counterfeit goods at the border, and will also include new criminal offences for commercial trademark counterfeiting. It will also allow Canadian businesses to

‘Juan dela Cruz’ is most watch among TV shows
The latest TV ratings data from multinational Kantar Media shows ABS-CBN’s “Juan dela Cruz” lording it over programs aired on other Philippine TV stations.
The Kapamilya series registered 42.6% in its February 21 episode which is considered an all-time highest nationwide rating. In comparison, rival network GMA-7’s “24 Oras” and “Indio” gained nationwide ratings of 16.9% and 18.8%, respectively. “Juan dela Cruz” stars Coco Martin as Juan dela Cruz, a half “tagapagbantay” and half “aswang” who falls in love with Rosario (Erich Gonzales) an aswang-hunter. Directed by Malu Sevilla, the series premiered on ABS-CBN and worldwide on TFC on February 4, 2013. Completing the list of Top 5 most watched programs on the

Aside from Marasigan and Castillo, Sandwich boasts of some of the most creative personalities in Pinoy Rock including Myrene Academia-Marasigan, who also plays bass for Imago and Duster; Mong Alcaraz, who also plays guitar for ChicoSci; and Mike Dizon, who also hits the skins for Pedicab. Sandwich has been recognized by different awardgiving bodies and has received several nominations and awards. In 1999, they released their debut album Grip Stand Throw. This was followed by 4-Track Mind (2000); Thanks To The Moon’s Gravitational Pull (2003); Five on the Floor (2006); <S> Marks the Spot (2008); and Contra Tiempo (2010). Sandwich continues to experiment on new sounds, proof of the genuine talent of its members. In between recordings and gigs, the band continues to do other projects, including soundtracks for several shows and movies.

Peasant Cookery took part in the culinary collaboration. The Tallest Poppy served up brunch on the weekend. In a special culinary colaboration national attention amongst food last Saturday, the guests were treated to circles. RAW: almond was the an additional serving of sweet pan seared brainchild idea of chef Mandel Filipino longanisa. Hitzer, chef/owner of deer + almond and RAW: Gallery director Joe Kalturnyk. The idea was to open up a contemporary restaurant on the frozen river trail and bill itself as a culinary winter festival. In search of the next unique gastronomic experience, a five-course meal prepared by several of Winnipeg's most talented chefs at RAW: almond was an opportunity I did not want to miss. Culinary romance on the Assiniboine
here are amazing things happening in a little white tent nestled along the banks of the Assiniboine River as it meets with Red River. The trappers of the fur trade probably never had it this good as they settled into dinner at Upper Fort Garry. I'm sure their daily meals of pemmican and smoked meat were delicious. Dinner on the river brings back some of our long forgotten heritage. RAW: almond is the temporary pop up restaurant that served as the culinary hotspot for last three weeks during our cold and windy Winnipeg winters. Youth Power: Chairman John Sulit scheduled to visit BC
CEO/Chairman of the board of the Alberta Youth Congress John Sulit is scheduled to visit the Province of British Columbia. Alberta’s tough youth will be making his 2nd Provincial State Visit to the said province and to attend the 9th ...that's what Calgaryism is all about. Annual Canadian Model United Nations Summit in downtown Vancouver. Sulit is said to arrive on April 4, 2013 in Vancouver, where he will also be staying for the trips duration. The trip will last until April 8, 2013 which is rumored that Sulit personally asked for the duration to be extended to be able to meet with governmental and non-governmental leaders, as well as organizations, communities, and schools. “The main mandate of this trip is obviously to enforce a stronger relationship between the youth and their leaders” Sulit said. It is unconfirmed whether Sulit will be staying at the same hotel together with all the other delegates of the summit across the country at Sheraton Wall Centre, in downtown Vancouver. “We will be gathered there to discuss array of issues involving the youth and their concerns and try to address them with great diplomacy in practice” “I hope that whatever issue we will table on this summit does not interfere with our professionalism and diplomacy but continue to create bridges and set a tremendous example for the rest of Canada’s youth” Sulit added. Sulit is well recognized with his works and endorsements to some of the provinces most elite and powerful leaders last provincial general elections and senatorial elections. The Alberta Youth Congress (a.k.a AYC) is a registered nonprofit youth-based organization in the province of Alberta. It was founded by CEO/Chairman John Sulit, with the assistance of past Member of the Legislative Assembly of Alberta for EdmontonMill Woods Carl Benito. The organization’s mandates are; to address the issues and needs of our youth to various types of government, to represent and act on behalf of the youth in the most effective and appropriate way, and to create projects that will ensure pro-activeness, productiveness, and progressiveness in the individual communities of our youth.

Tax Time Already (RRSPs Part 2)

This column is meant to follow up the column that I wrote for the last edition. Sometimes it makes sense to withdraw monies from your RRSP. In the last few years, the Tax Free Savings Plan has been created that provides an option that may give greater flexibility than RRSPs. I will discuss this later in the column. In the meantime, you can borrow from your RRSP for two reasons without having to pay tax if you make regular repayments. These are for the Lifelong Learning Plan (LLP) or the Home Buyer’s Plan (HBP). For the LLP the withdrawals may not exceed $10,000 in a year and $20,000 over four years and the reason can be for either the taxpayer or their spouse and must be repaid in equal installments over 10 years. The withdrawal for the HBP can be as much as $25,000 and must be repaid within 15 years. Any missed repayment will be added to the income of the taxpayer in the year
missed. As the intention of RRSPs is to provide for future income and security in retirement, it is wise to repay these loans as soon as possible because until the funds are replaced you are missing out on the accrued deferred interest that assists in building an adequate retirement nest egg. I mentioned Tax Free Savings Accounts (TFSAs) earlier in my column in the previous edition. TFAs were introduced in 2009 and, like the RRSPS are cumulative and income earned in the account, is tax free. Differences include: • the original principal investment is not tax deductible • amounts may be withdrawn and replaced, but be careful as there are restrictions in timing when replacing withdrawals. The rate of contribution to TFSAs was $5,000 for 2009 through 2012, increased to $5,500 for 2013. The greater flexibility in withdrawals may be more attractive if you can anticipate needing the monies in the future before retirement i.e. for education or purchasing a home but you will not get the a tax rebate when making the purchase as you do with an RRSP. As well, if your tax rate is lower and you anticipate a higher rate on retirement, the TFSA may look more attractive. Similar penalties are assessed for over-contributions to TFSAs as for RRSPs (1% per month for the period of over contribution). A tax planning approach might be for a couple (married or common law) with different levels of income
to have the higher earner contribute to the lower earner who will then purchase a TFSA. The issues we have discussed here can become quite complex and decisions can affect not only your current taxes but your future security. This discussion is meant to introduce you to some of the considerations but I can only recommend that you consult professionals in tax planning and in investment decisions. It is also important that you become as familiar as possible and as knowledgeable as possible because it is your future that you are planning. I can remember several years where many clients invested in speculative venture funds because they “had to absolutely save taxes that year” and the fund ended up making very little, if any, money over a decade. Prime Minister Stephen Harper announces the establishment of the Office of Religious Freedom Vaughan, ONTARIO – Prime Minister Stephen Harper today announced the establishment of the Office of Religious Freedom within the Department of Foreign Affairs and International Trade, which will be dedicated to promoting freedom of religion or belief around the world. He also announced the appointment of Dr. Andrew Bennett as Ambassador to the Office. The Prime Minister was joined by Jason Kenney, Minister of Citizenship, Immigration and Multiculturalism, and Julian Fantino, Minister of International Cooperation. “Around the world, violations of religious freedom are widespread and they are increasing,” said the Prime Minister. “Dr Bennett is a man of principle and deep convictions and he will encourage the protection of religious minorities around the world so all can practice their faith without fear of violence and repression.” Under Ambassador Bennett’s leadership, the Office – which is now operational – will promote
freedom of religion or belief as a Canadian foreign policy priority. The Office will be an important vehicle through which Canada can advance fundamental Canadian values including freedom, democracy, human rights and the rule of law worldwide. “Our Government is dedicated to promoting the freedom and prosperity of the people it serves,” added the Prime Minister. We will work with other countries and all people of goodwill, to promote the principles we share.“ Specifically, the Office will focus on advocacy, analysis, policy development and programming relating to: protecting and advocating on behalf of religious minorities under threat; opposing religious hatred and intolerance; and, promoting Canadian values of pluralism and tolerance abroad. Activities will be centred on countries or situations where there is evidence of egregious violations of the right to freedom of religion, violations that could include violence, hatred and systemic discrimination.

Alberta moves to protect electricity consumers

E
lectricity rates can be a concern for Albertans, especially month-tomonth changes in rates, the cost of new transmission lines and understanding your monthly electricity bill. On January 29, the Alberta government released new actions to make sure Albertans are paying the lowest electricity rates possible in a fair and competitive market. Those who are currently on the regulated rate option (RRO) will see less fluctuation
in price. Right now, electricity companies can only buy power 45 days in advance for the RRO. The province will extend that to 120 days to bring more stability and predictability in the market. Consumers will still have a monthly rate, but the price will not spike as much from one month to another. The Alberta Government is also moving to require transmission companies to prove that new costs are reasonable. The prices and new project plans will be studied carefully by the Alberta Utilities Commission before the project is approved. The costs and projects will also be made public. Every cent will have to be justified before Albertans are asked to pay for it. Another important change includes the Utilities Consumer Advocate becoming an independent agency that will continue to promote a fair and competitive retail market. The Utilities Consumer Advocate

It looks like the directions of the Philippine economy are headed up in the scale pointing towards a stabilized and stellar growth. Things are turning around , jobs now are in abundance and Philippines is a hot market when it comes to investing, real estate, construction, manufacturing , services and trades. With all these positive surveys and reports, there is always that lingering question, would it translate to a better income for the Filipinos? To better answer my question I went to the streets of Manila and asked the sentiments of the common people. The vendors of the street seemed to have a brisk sale of their 'turon' and 'banana cue', People lined up non stop to sample those delicacies. They don't mind spending at all. On the other side of the streets in Ermita , the agencies that advertise jobs abroad, are lined up with young job seekers with brown Manila envelope. I asked one of the applicants and mentioned that he wants to still go abroad despite of having a job in Manila. His is seeking for better wages. Yes, they want better wages, to provide the necessities in life for their families. The taxi drivers are the best people to ask questions about the economy of the Philippines. They have their radio on all the time and they are updated with all aspects of Philippine news be it in economic, political and entertainment. One

The Bulletin , issued February 17, 2013 reported the 2012 Fourth Quarter Global Survey of Consumer Confidence and Spending Intentions survey by the firm Nielsen reported the Philippines as the most optimistic country in Southeast Asia; and second in global consumer confidence, India being the number one. Yes, a good sign indeed that finally positive news and surveys about the Philippines are in the open, giving the much needed morale to boost to the Philippine economy. Philippine Daily Inquirer reported that the Philippine 'has the fresh opportunity to be Asia's next tiger economy. A sleeping tiger? The Daily Inquirer reported also, in their January 31, 2013 that the economic growth of the Philippines rose to 6.6% in the fourth quarter of 2012.

taxi driver just wants to rush home after 24 hours of driving the streets of Manila with only short breaks in his shift. He could not care less about the economy . What he wants is the take home money that translate to a net profit after paying the surmounting gas bills and maintenance. We stopped at the stop light and saw his eyes close to take the much needed rest. After a couple of minutes, his eyes opened knowing that lights would turn green. One taxi driver from Pampanga is optimistic of his business as a taxi driver. He moved his family to Manila to seek better wages. His positive answer has a tone of confidence and satisfaction. He said: " In the province there no jobs for me. Their are jobs here around Manila " kaya lang huwag ka lang mamimili'. He mentioned about clients who are now give more tips and they don't mind leaving a hefty change. For me as I walk around Manila, business is brisk, people are buying, restaurants are full and I see lots of happy and smiling faces. Is this just for real or just a facade covering their real sentiments? Is Philippines headed to a boom? While I know and I believe that a rapist, a serial murderercum-rapist, a pedophile, or any sexual predator ultimately chooses any victim—beautiful or not, naked or clad—still, there are also so-called stimuli and triggers.
While a woman or even a man, for that matter, has the freedom to wear whatever s/he chooses as long as it is something legal in the particular community or place she is going, she has to consider the circumstances. In short, it's not only about freedom dressing; it should be also about smart and conscious dressing (even appropriate dressing). For example, if you are going to a party and you decide to wear very skimpy attire, then make sure that you go there by car or any personal vehicle—not by tricycle, jeepney, bus, nor even taxicab. Last 2011, The Philippine Stock Exchange (PSE) made it to the list of top performing markets against other stock exchanges worldwide as the growth rates of its broad market index, domestic market capitalization and trading turnover ranked first, third and fourth, respectively, among 51 exchanges globally. PSE was recognized for the second time as third best performer among the 50-member exchanges of the World Federation of Exchanges in 2012. Among the top performers in 2011, only the PSE made it to the list of top performing markets again in 2012 across all the same growth metrics.
Based on the 2012 Market Highlights report released by the WFE, the PSE was ranked third after it posted a 38.9 percent expansion in market capitalization last year, outpaced only by the stock exchanges in Turkey and Thailand. In the WFE report, the 25.3 percent growth in the PSE’s value turnover last year was also the third best after the Saudi Stock Exchange and the Bermuda Stock Exchange. The PSE also claimed the fourth post in terms of expansion in number of trades and registered the fifth highest increase in broad market index for 2012.

Cruising the Fiordland of New Zealand
he most unforgettable highlight of our December voyage Down Under is cruising the Fiordland National Park, the largest national park of New Zealand. One of the most majestic natural wonders of New Zealand, the Fiordland occupying the southwest corner of the South Island is dominated by the snowcapped mountains (the Southern Alps), deep lakes and ocean-filled steep valleys, crenellated coasts, and cascading waterfalls. The area is also rich in wildlife including dolphins, seals and birds. Fiordland features a number of fiords often named "sounds" of which Milford Sound is the most famous and most visited. Situated within the fiordland are Browne Falls and Sutherland Falls which rank among the tallest waterfalls in the world and three deepest lakes of New Zealand Lake Hauroko, Manapouri and Te Anau. This part of New Zealand has a very wet climate, receiving 6,300 mm of rainfall every year. Finally the Princess entered Nonie and Amy with family. Dusky Sound, one of the most complex of the many fiords. After exiting Dusky Sound the boat sailed to the south easterly course into the Tasman Sea again along the southwest coast of New Zealand enroute to Port Chalmers. Note: Fiord (or fjord) is a long, narrow deep inlet from the sea between steep slopes of a mountainous coast. Fjords usually occur where ocean flows into valleys formed near the coast by glaciers.
