EMPLOYERS FINED MORE THAN $16 MILLION FOR SAFETY BREACHES IN 2024
OCCUPATIONAL HEALTH & SAFETY
By Mark Felton
As a business owner and employer, it is your responsibility to ensure the health and safety of your employees within your workplace. This includes providing your team with a safe work environment and protection from hazards. You can achieve this by understanding your obligations under the Occupational Health and Safety (OHS) laws and by complying with them.
Victorian employers are reminded they face serious legal consequences if they put workers at risk after WorkSafe completed 153 successful health and safety prosecutions last year.
The total of $16,182,957 in fines imposed by the courts in 2023 for breaches of the Occupational Health and Safety Act and the Dangerous Goods Act included three separate seven-figure penalties and a further 25 prosecutions attracting fines of at least $100,000.
Offences involving the risk of a fall from height, which is among the leading causes of workplace fatalities in Victoria, continue to be a key compliance priority and were the subject of 39 prosecutions and fines of almost $2 million.
There were 25 prosecutions for unsafe machinery including inadequate guarding, 15 relating to the risk of being crushed by or between objects, and 13 involving powered mobile plant such as forklifts.
More than half of WorkSafe's health and safety prosecutions last year were against employers in the construction (52) and manufacturing (38) industries; followed by transport, postal and warehousing (11) and wholesale trade (10).
WorkSafe Executive Director Health and Safety Narelle Beer said inspectors and investigators would continue to target workplaces where harm was most likely to occur. "The safest places to work are those where employers accept that injuries and fatalities are preventable and priority is placed on doing what they can to protect their people," Dr Beer said.
"WorkSafe will use every enforcement tool at its disposal to hold to account employers who put the health and safety of their workers or others at risk."
Tragically, 17 of WorkSafe's successful prosecutions and $6.3 million in fines imposed by the courts last year related to a workplace fatality.
Dr Beer said multiple duty holders were also prosecuted for offences involving workplace bullying and sexual harassment, including several matters involving a number of young and vulnerable workers.
"Employers must have systems and processes in place to identify, assess and respond to hazards and associated risks to both the physical and mental health of their workers," she said.
"This includes ensuring there is adequate training and supervision and that workers are encouraged to speak up or ask questions when they have concerns for their safety."
In addition to last year's court outcomes, WorkSafe also accepted seven enforceable undertakings from duty holders committing to spend a combined $1.2 million dollars to improve workplace health and safety knowledge and outcomes in their respective industries.
Major WorkSafe prosecution outcomes in 2023:
• Bradbury Industrial Services Pty Ltd convicted and fined $2.9 million in relation to an explosion and fire at a Campbellfield warehouse in 2019 and chemical stockpiles at other sites across Melbourne's north.
• Manufacturer Dennis Jones
Engineering Pty Ltd convicted and
• fined $2.1 million after an apprentice suffered life-changing head injuries at a Gippsland factory in October 2021.
• Energy Australia Yallourn Pty Ltd convicted and fined $1.5 million following the death of a worker in an arc flash incident at Yallourn Power Station in November 2018.
• Diving company Underwater Inspection Services convicted and fined $730,000 for repeatedly putting workers at risk at sites across Victoria between May and August 2018.
• Gas cylinder supplier Supagas Pty Ltd fined $550,000 after a worker was left permanently disabled in a ute explosion at Bayswater in December 2017.
As a business owner, are you confident that you do not have shortfalls in your efforts to keep your workers healthy and safe? Do you have an understanding of your responsibility to ensure the safety of your employees? Are you confident that you can provide a safe work environment and comply with OHS laws? Do you believe that you are effective in carrying out risk assessments, employee consultation and providing training? Do you regularly review these measures to ensure that they remain fit for purpose and keep you and your employees healthy and safe? Why not make a New Year’s resolution to get your house in order?
At Beaumont Advisory we assist business owners clarify what they currently have in place, as well as where there are shortfalls. We then assist in developing effective systems and documentation, working with businesses to ensure effective implementation. Checks are put in place to monitor ongoing effectiveness, to ensure that going forward, they are sound and comply with the Act, and most importantly keep you and your employees informed, and healthy and safe. IS THE REFINANCE BOOM OVER?
MORTGAGE BROKERING
By Reece Droscher
In 2023, the cashback craze was on steroids. Lenders vying for refinancing business were offering sweeteners of $5,000 or more to borrowers who switched over their home loans.
In 2024 the landscape is vastly different. Fewer and fewer lenders are offering cashbacks, and those who have reduced the amount they’re willing to hand over. The average cashback is now around $2,000.
So, has the refinance boom finished? Let’s take a look.
What happened in 2023?
Last year, we saw homeowners refinancing their home loans in record numbers. As interest rates soared, more and more borrowers decided to shop around in order to find a more competitive home loan.
The surge in refinances was no doubt driven by the amount of borrowers rolling off low fixed rate mortgages on to higher variable interest rates. Reserve Bank of Australia (RBA) data shows 880,000 borrowers came off fixed rates in 2023. Their repayments jumped significantly when this happened.
According to Australian Bureau of Statistics figures, monthly mortgage refinances peaked at $21.5 billion in July 2023. That was 21.8% higher compared to the year prior. However, as the year progressed, refinancing started to slow down. By December 2023, the value of refinances had dropped to $17.1 billion
What’s the outlook in 2024?
The number of fixed rate mortgages expiring is lower in 2024 compared to last year, which means the number of people refinancing may also slow down.
Having said that, there are still 450,000 fixed rate home loans set to expire in 2024, according to the RBA. If you fall into this category, it’s important to review your home loan early and ensure it still meets your needs
What happens if your fixed rate expires?
Usually, your home loan will revert to your bank’s standard variable rate once your fixed term is up. If that rate is higher than your fixed term rate, you may see your repayments jump significantly.
Why it pays to consider refinancing
Refinancing can help you achieve all sorts of goals, including:
• Finding a more competitive home loan
• Accessing interest-saving features like offset accounts and redraw facilities
• Using your equity to buy another property, renovate, or make another big-ticket purchase
• Consolidating your debt so that you can budget and manage your repayments more effectively.
Like to explore your options?
If you’re approaching the fixed-rate cliff, get in touch sooner rather than later to explore your options.
As your mortgage and finance broker, we can help you work out what your repayments would look like when you roll off your fixed rate on to a variable rate. We may be able to suggest other ways to prepare, like making extra repayments now as a buffer for when your fixed term ends.
In some instances, we may be able to negotiate a better rate with your current lender or suggest another bank with a more competitive home loan that better suits your needs.
We’re here to help, so get in touch.

COOL ROADS?
By Liz Sanzaro
When plastic sandals were rubbing blisters on feet, children of the 1960's will remember taking these shoes off to get relief only to find that the Asphalt footpath was scorching upwards of 70 degrees celsius, hot enough to cook an egg.
Now that climate change is really impacting us all in ways we never thought of, the clever minds and the creative people among us are starting to think about possible solutions.
What is a COOL ROAD? For starters, the darker the colour the more heat
is absorbed. A cool road is one that has had an extra layer coating it in a lighter colour sealant to help prevent melting of the bitumen as well as reflect sunlight. The United States have already begun this process, with some small reduction in the surface heat temperature of the newly coated roads, a mammoth task for countries like ours where the road network is extensive. Expensive too!
For us to have a good quality of life, we need our living environment to have at least 30% tree cover. Maroondah has been lucky with many trees planted years ago by residents. With slogans like "don't ringbark Ringwood", and Arbor days when the Croydon Conservation Society and local schools obtained tube stock and planted for the future, it looked like Maroondah would be safe.
Sadly, things have changed and people seem to be more focused on finances, housing affordability, and justifiably, finding a spot to build a home for the family. The next image says it all really. It shows how built form and paving become a heat sink, holding the heat and radiating. You really need to spot the patches of pinky purple, which is where shade is.
That future is here now, but instead of treasuring our mature trees some developers see them as obstacles to be removed and will wear the cost of fines. Here in lies the problem.
Collectively many Councils under the group called MAV, the municipal association of Victoria have written to the Minister for the environment and the Premier asking for the State fine for illegal tree removal to be re- visited.
CCS has also been lobbying the same two ministers to discuss a better method of deterrent for anyone who unlawfully
removes a tree, which in the broad view of life on Earth should be of benefit to us all. Monash University has mapped the vulnerability of areas of Melbourne by postcode. Make no Mistake; extreme heat is a serious health issue for people who are young, old, sick, have no access to air-conditioning or just forget to keep hydrated, or in the shade. We cannot afford for our municipality to lose any more of our heritage tall shady trees.
So how best to get the State Government to revisit the State Environment law to look at a revision to improving the deterrent, so that trees are not just removed because they are in the way.
CCS has already written to both the Premier Jacinta Allan and the Environment Minister, Steve Dimopolous, who is the minister for everything. Member for Oakleigh. Minister for Tourism, Sport, Major Events, Environment & Outdoor Recreation. Frustratingly we have not heard back from either as yet.
We hope to keep up the pressure to the Government, and hope people begin to understand and help protect the mature trees we live amongst. If you hear chain saws at the weekend and you are concerned Maroondah Council has 24/7 ranger bylaw officer, you can contact on 1300 88 22 33, and someone will attend to ensure it is legal, or needs to be stopped.

Super Contribution changes announced by Govt
ACCOUNTANT
By Warren Strybosch
The Federal Government has confirmed that there will be an increase in the non-concessional and concessional contribution caps.
Currently, you could place up to $27,500 per year into super as a concessional contribution. Concessional contributions included your Superannuation Guarantee Contributions (SGC), Salary Sacrifice of super, additional employer contributions and personal contributions for which you wish to claim a tax deduction and where an Intent to Claim form had to be filled out. From 1st July 2024, the concessional cap will increase to $30,000 per year.
For non-concessional contributions, the current cap was $110,000 per year and this will now increase to $120,000. This is good news for those who are getting closer to retirement and wish to place more funds into super as the
bring forward provisions, will allow nonconcessional contributions to increase from $330,000 to $360,000.
Additionally, from 1 July 2024, the Total Superannuation Balance (TSB) thresholds used to determine the maximum amount of bring-forward non-concessional contributions available to an individual will also be adjusted.
The TSB is a fairly easy concept to understand. It's usually the total amount of money you have in your super at any one time. The ATO measures your TSB each 30 June to determine which super measures you are eligible to use in the following financial year as follows:
• carry-forward concessional contributions
• non-concessional contributions cap and the bring-forward of your non-concessional contributions cap
• work test exemption
• government co-contribution
• spouse tax offset
• segregated asset method for calculating exempt current pension income.
You can view your TSB by using ATO online services . Select Super then Information then Total superannuation balance .

Scout Heritage Victoria Centre & Archives

A part of the charter of Scout Heritage Victoria is to research Scouting history. The gates and pillars were discovered at Brighton memorial park in very poor condition - the gates were removed and the pillars and granite memorials to World War 1 returned servicemen were smashed and scattered.
An in-depth search of war records by SHV provided the names an other information and a team in conjunction with the RSL, Scouts and other bodies brough the gates and pillars back to life at Joseph Harris park at Mt. Martha. A rededication ceremony was conducted in November 2003 to restore the memorial.

Elevate Your Business with Elmedia Marketing's Proven Strategies for Positive Google Reviews
DIGITAL MARKETING
By Ethan Strybosch
Enhancing Online Reputation and Driving Growth in the Digital Age
In today's digital age, online reviews wield unparalleled influence over businesses. Among the plethora of review platforms, Google Reviews stand out as a critical factor in shaping a company's online reputation. Positive Google Reviews not only enhance visibility but also build trust among potential customers.
Importance of Positive Google Reviews:
1. Visibility and Credibility:
Positive reviews on Google enhance a business's visibility in search results. Google's algorithm prioritizes businesses with higher ratings, making them more likely to appear in local search queries. Furthermore, positive reviews contribute to a company's credibility, fostering trust among prospective customers.
2. Consumer Decision-Making:
Modern consumers heavily rely on online reviews to inform their purchasing decisions. According to recent statistics, 93% of consumers rely on Google Reviews to determine the quality of a
business, and 72% won't act until they've read reviews. Positive Google Reviews serve as social proof, reassuring potential customers that they are making a sound choice by choosing your product or service.
3. Competitive Edge: In a crowded marketplace, positive Google Reviews set your business apart from competitors. A higher star rating and positive testimonials can be the differentiating factor that influences a customer to choose your business over others.
Strategies to Generate Positive Google Reviews:
1. Automated Review Requests:
Implementing automated systems to request reviews can streamline the process. After a customer completes a purchase or service, an automated email or text message can be sent, politely requesting feedback. This ensures that satisfied customers are prompted to leave a review without significant effort on their part.
2. Incentivizing Positive Reviews:
While it's important to remain ethical and compliant with review platform policies, offering small incentives can motivate customers to share their positive
experiences. Consider discounts, loyalty points, or exclusive access to promotions as tokens of appreciation for leaving a positive review.
3. Timing and Personalization: Timing is crucial when requesting reviews. Send requests when the positive experience is fresh in the customer's mind. Personalize the request by addressing the customer by name and referencing specific details of their interaction with your business, demonstrating that their feedback is valued. This can all be automated in our El.ite marketing software.
4. Engage with Existing Reviews: Actively engage with existing reviews, both positive and negative. Responding to reviews, expressing gratitude for positive feedback, and addressing concerns in a constructive manner not only demonstrate excellent customer service but also encourage others to leave reviews.

What is Fatty Liver Disease?
NATUROPATH
By Kathryn Messenger
Historically, Fatty Liver Disease (FLD) was associated with excessive alcohol consumption, but now has evolved into two distinct categories: Alcoholic Fatty Liver Disease (AFLD) and Non-Alcoholic Fatty Liver Disease (NAFLD). Next month, I’ll delve into NAFLD, but for now, here’s the breakdown of ALFD.
Alcoholic Fatty Liver Disease (AFLD)
AFLD was first seen in prolonged alcohol abuse, where the liver struggles to metabolise the excessive intake of alcohol. This led to the accumulation of fat, impairing liver function and paving the way for inflammation. This is diagnosed with a blood test, but usually if you have FLD, you will find that you don’t metabolise alcohol well and will take a longer time to recover after drinking than your friends, or than you used to. You may also have other problems such as worse sleep after drinking.
Metabolically, alcohol is a sugar
Alcohol, intriguingly, shares a metabolic pathway with sugar in our bodies. When we consume alcohol, it undergoes a process in the liver akin to the metabolism of sugars by liver enzymes. This similarity
helps explain why excessive alcohol consumption can contribute to the accumulation of fat in the liver. In both cases, whether from alcohol or sugar, the liver faces an influx of substances that can overwhelm its processing capacity, leading to fat storage and eventually conditions like AFLD.
But regardless of the state of your liver, there are dietary and lifestyle changes that can turn your liver around.
Address the stress
It’s likely that stress, anxiety or depression have led to the high intake of alcohol. But rather than just using will power to move through this (as it’s doomed to fail once again), identify your stressors and find one or two that you can remove from your life. Find other ways to reduce your stress so that alcohol is not your only way to relax.
Reduce alcohol consumption
Now that you have reduced your stressors, start to reduce your alcohol consumption. Find something to do such as a new hobby with others to replace the time that you used to spend drinking.
Dietary changes
No dietary issue is in isolation, and it is highly likely that diet, along with alcohol
has contributed to this disease. Below are some suggestions to get started, but we’ll dive into that in more detail next month.
• Prioritise Whole Foods: integrate an array of nutrient-rich fruits and vegetables into your diet, providing essential vitamins and antioxidants. These elements reduce inflammation and aid in liver repair.
• Proteins for Repair: include protein sources such as beef, lamb, kangaroo, poultry, fish, tofu, and legumes. These proteins play a crucial role in liver cell repair, bolstering its structural integrity.
• Mindful Fat Consumption: Opt for healthy fats like those found in avocados, nuts, and olive oil, steering clear of trans fats and deep fried foods. This ensures a balanced lipid profile, preventing the accumulation of unhealthy fats within the liver.
Further support
Whilst food is a powerful medicine, sometimes we need a bit more than that to help us along. Whether it’s dietary advice or natural medicines you need, Whole Naturopathy is here to help.
Natural medicines, particularly herbs, have an amazing effect on your liver as well as on your mental health, which may be what got you into trouble in the first place. I would love to help your journey to optimal health, and help you live a long life with the health and energy to do well.

GENERAL INSURANCE
By Craig Anderson
Commercial Legal Protection is designed to help SME businesses deal with unexpected legal issues not already covered by their other insurance policies. Intended to complement traditional SME policies, rather than substitute core insurance cover, the policy provides expert legal assistance when an insured really needs it and protects them from potentially crippling costs which will have to be incurred, regardless of any fault on the client’s part. The following article has been reproduced verbatim with permission from Solution Underwriting, and refers exclusively to their own product.
What does the Solution Commercial Legal Protection Policy cover?
In general terms, legal expenses insurance provides advice and cover for the legal costs of pursuing or defending certain classes of legal action.
It is not a substitute for General Liability, Professional Indemnity, Directors and Officers Liability insurance, or Management Liability insurance, but it aims to cover legal expenses not covered by those insurances.
Legal expenses insurance complements other classes of insurance as it lowers the financial burden associated with legal disputes and also provides access to legal advice and assistance which could curb the need for full-scale litigation.
Under the Solution Underwriting wording a Dispute means any civil legal proceedings or action in a Court or Tribunal either commenced by the Insured or commenced against the Insured by a third party which relates to the Insured’s core business activities and which falls within one of the policy’s Head of Cover below.
Head of Cover 1: Contractual Disputes regarding Supply of Good and/or Services
Perhaps the most valuable Head of Cover for most SMEs, this section covers the Insured’s own legal costs and any legal costs awarded against them, both when defending a claim against them by a customer or supplier; and when pursuing a customer or supplier over the breach of a term in a written commercial contract.
Examples include where a retailer Insured has had to pursue a supplier over sub-standard goods which they had
What Is Commercial Legal Protection?
bought to sell on; and where the Insured has a lawyer defend them when they have refused to pay a hire company for a faulty piece of plant or equipment leased to them.
Head of Cover 2: Tax Audit
Tax Audit is a well-established standalone product in Australia and has been included with legal expenses policies for a number of years. This cover will pay for an Insured’s accountant to respond to an audit by the Australian Taxation Office. If the audit escalates into a dispute, the policy can extend to also cover a specialist lawyer to represent the the Insured in any proceedings which may arise.
Not only does this Head of Cover include expenses associated with the Tax Audit but it also covers a claim from the ATO where additional GST is due or where additional income tax or fringe benefits tax is due.
Head of Cover 3: Statutory Licence Protection
This section will indemnify the Insured for costs incurred in seeking to protect the Insured’s rights under a statutory licence which is under threat of suspension, revocation or amendment and could have a material impact on the client’s ability to conduct their business. The policy will provide expert legal assistance to challenge any attempt to suspend, revoke or alter the terms of the licence to the Insured’s detriment.
Head of Cover 4: Landlord Disputes
Where a SME rents its business premises from a commercial landlord there is scope for dispute over the terms of the lease and alleged breaches arising from it. The policy will provide the Insured with a lawyer to pursue a claim against a landlord or defend themselves in the event that they are accused of a breach.
Heads of Cover 5: Restrictive Covenant Pursuit (protecting a client’s intellectual property)
An SME’s customer base and sensitive commercial information is its lifeblood. When an employee leaves the business, it is imperative that they are not able to
take this information to a new employer and use it to prejudice the SME’s interests. This cover ensures that where a restrictive covenant preventing them from doing so is written into their employment contract, legal assistance is on hand from a specialist in the field to enforce the relevant terms as far as the law will permit, in order to mitigate the damage caused.
Head of Cover 6: Third Party Damage to Goods or Premises
This section is triggered when a third party causes damage to an Insured’s premises or property.
Head of Cover 7: Debt Recovery
Cashflow is vital to all SME businesses. The debt recovery service provided under the policy will provide assistance for the Insured to exert pressure in recovering the sums due, and ultimately taking matters to court if this fails to bring the desired outcome.
Legal Advice Service
All clients have access to a FREE Legal Advice Service managed by one of Australia’s prominent legal firms. This dedicated service has been created for Solution Underwriting Agency clients and allows the Insured to receive targeted advice from a lawyer relating to any problem directly associated with the client’s core business activities.
The Legal Advice Service provides free, specialist advice with fast turn around and clients can obtain legal advice as many times as required throughout the policy period – no limitations.
Please request and read the policy documents for full details.

Downsizer Contributions
FINANCIAL PLANNER
By Erryn Langley
Australians aged 55 and over who sell their home are able to make a contribution of up to $300,000 into superannuation from the sale proceeds. Both members of a couple can take advantage of this rule for the same home, resulting in a total possible contribution of $600,000 per couple.
Contributions made under this legislation will not count towards other superannuation caps. Additionally, no work test or age restrictions apply, but you must have owned your home for at least 10 years, and it must have been your principal residence at some stage.
Who is eligible?
To be eligible to make a downsizer contribution, each of the following conditions must be met:
• You must be aged 55 or older at the time you make the downsizer contribution.
• The contract for the sale of the property was entered into after 30 June 2018.
• The home was owned by you and/ or your spouse for at least 10 years.
• The home is in Australia and is not a caravan, houseboat, or mobile home.
• The proceeds from the sale of the home qualify for a full or partial main residence exemption from capital gains tax.
• You provide your superannuation fund with a “Downsizer contribution into super” form no later than when the contribution was made.
• You make the contribution within 90 days of the sale proceeds being received.
• You have not made a downsizer contribution from the sale of another property in the past.
Important note:
If you are a member of a couple, however, you own 100% of the home being sold, your spouse can still make a downsizer contribution as long as you both meet the eligibility criteria.
To make a downsizer contribution, it is not necessary to purchase a new home. For example, a downsizer contribution may be made following the sale of an eligible home even if you are moving in with family, into a retirement village, residential aged care facility, or into another property you own.
Case Study:
Geoff (70) and Janine (64) have recently sold their family home for $900,000 after living there for 20 years.
Geoff was the sole owner of the home at the time of sale.
They now plan to move to the coast, where they own a holiday home.
Both Geoff and Janine are eligible to make a $300,000 downsizer contribution to super ($600,000 in total). That’s an additional $600,000 to generate tax-free pension payments to supplement their retirement income.
Although Janine did not own the home, she can make a downsizer contribution as Geoff’s spouse. Additionally, there is no requirement to purchase a new property to benefit from a downsizer contribution and boost retirement savings.
Remember, the downsizer contribution must be made within 90 days of selling the property (generally settlement date).
Risks to consider
Age Pension entitlements: You may risk losing some or all of your Age Pension if you sell your home and make a downsizer contribution. While the family
home is exempt from the Asset Test, the $300,000 you contribute to super as a result of downsizing will be an assessable asset if you have reached pension age. This may impact your pension entitlements.
ATO assess eligibility: The Australian Taxation Office (ATO) determines if you are eligible to make a downsizer contribution. If you make the contribution and the ATO subsequently determines that you were ineligible, they will notify you and your super fund to assess what options are available. There is a risk that an ineligible contribution could count towards your non-concessional contribution cap.

Whilst
Corporate Insolvency; Or, The death trap of debt and bad luck spiralling out of control!
LEGAL
By Dean Bosman
Often it can feel like the mountain of debt for the business is inescapable, and it burns through your mind day in and day out, trying to get on top of the debt, whilst still needing suppliers to give you material for your business. Often it can be one or two major clients having gone into liquidation that leaves you overextended and unable to make ends meet.
There are a lot of issues to consider of course, and there are no simple answers, however there are some options that can take the pressure off, and in some cases remove it altogether. The simplest and most effective options are Small Business Re-Structuring, Safe Harbour Protections, and Liquidation, sale and purchase through a new entity. These are great options, but with a number of caveats.
Small Business Re-structure
For smaller enterprises, the Small Business Restructuring (SBR) process provides an alternative to traditional insolvency procedures. The SBR process aims to streamline the restructuring of small businesses, making it more cost-effective and less time-consuming. Under this scheme, eligible small businesses can develop and propose a restructuring plan to creditors, allowing them to continue trading while addressing their financial challenges. The director stays in control, and the forensic accountant (a registered liquidator) provides suggestions and advice about how to manage the debt, how to streamline the business, for example outsourcing things that can be done faster and better by specialists, but mainly dealing with your creditors and making a deal with them. Many creditors will take a lesser amount on the basis that there will be ongoing trade for them.
In order to qualify for SBR, you need to have a maximum of $1M in debt, your tax returns and BAS’s up to date, and employee entitlements (read Superannuation) up to date. You will need to engage a registered liquidator.
Safe Harbour Provisions
Recognizing the challenges faced by directors in distressed companies, the
government has introduced safe harbour provisions. These provisions provide directors with a degree of protection from personal liability for insolvent trading if they take prompt and reasonable steps to develop a course of action that is likely to lead to a better outcome for the company and its creditors.
To avail yourself of safe harbour protections, directors must be able to demonstrate that they have acted in good faith and with due diligence to prevent the company from trading while insolvent. This may involve seeking professional advice, developing a restructuring plan, or taking other measures to improve the company's financial position. By doing so, directors can shield themselves from personal liability and contribute to the preservation of the company's value. Again, you will need a registered liquidator to assist.
Creation of New Corporation, Sale of Business to the new Corporation, then Liquidation of the old, indebted Corporation
First of all, this is not a Phoenix Operation. A Phoenix Operation is where the old corporation transfers its assets, accounts, funds, stock in trade etc to a new entity, and then carries on trading, avoiding the old company’s debts. It will often involve de-registering the old corporation. This is unlawful, and quite simply a foolish way to try and resolve things.
There are two ways you can go about this:
1. Engage a registered business valuer to provide a formal valuation on the business, and then purchase the business from the old corporation with a new corporation. Do not use funds from the old corporation for
14 FIND MAROONDAH |MARCH 2024 findmaroondah.com.au
the purpose, or the new corporation will be owned by the old one. The transaction must be an ‘arms length’ transaction, which means the funds must come from elsewhere – it can be a loan to the new entity, you may have savings that have accrued from drawing your salary from the old corporation, as long as you have paid PAYG tax, you can pay yourself with franked dividends (ask me about this if you’re unsure, as it’s an entire article on its own). As long as the source of the funds does not come back to the old corporation.
You will need to have a formal business sale contract to ensure everything is done legitimately, and the contract will list all the assets, stock etc that are being transferred, so there is a clear path in which the assets are transferred as part of the transaction.
You can then appoint a liquidator to the company, though the funds for the purchase must stay with the old entity. Those funds can be used to pay the liquidators fees, and any balance will be spread among the creditors of the old corporation (usually for a small percentage of the debts owed). The liquidator will review the transaction to make sure it is not an ‘uncommercial transaction’ – for instance if the valuer says the business is worth $50,000, but you only pay $30,000, the liquidator will come after the new entity for the $20,000 difference. Also be aware
Financial Adviser
hosted by Ben Nash
that if you have given personal guarantees for debts, this process will not avoid the guarantees, and the creditors with guarantees will still come after you personally.
2. Engage a liquidator for the old entity, then create a new entity and have the liquidator provide a valuation on the business of the old entity from a registered valuer, and as above, the new entity buys the business from the liquidator. As long as the transaction is an “arms length” transaction, then the transition to the new entity is genuine and without issues. Again, the liquidator uses the funds from the sale of the old business to pay out the creditors, and the old corporation is de-registered.
The good thing about this process, whichever you use, is that the former owner of the business is best placed to pay the highest value – someone who does not know the business would be taking a risk, and therefore will not pay as much for the old business.
Now the caveats.
If the director has carried on a long time with the debts, incurring new liabilities with no chance of paying them, he or she may be trading whilst insolvent, and may have exposed themselves to personal liability for the debts of the company. Accordingly, the
sooner the better to take action before any chance of insolvent trading looms.
Wrap Up
Navigating insolvency does require an understanding of the legal options available to businesses in distress. Liquidation and business sale, conducted through ‘arm's length’ transactions, can provide an avenue for companies to shed the burden of old debts and continue operations under a new corporation. Additionally, the implementation of safe harbour provisions and Small Business Restructuring, offers directors protection from personal liability, encouraging them to take the necessary steps to revive the company's financial health.
It is crucial to seek advice before taking steps, so feel free to call me to discuss. There is no fee for an initial discussion, which can include talking with an insolvency practitioner to ensure compliance with the relevant laws and regulations. We have a number of liquidators we use, and they are very good at navigating the issues with you.

Bookkeeping - Back to basics
This
month – Trial Balance and Financial reports
BOOKKEEPING
By Jodie Moore
Financial Reports
There are many reports that are useful in running your business. They can be used at tax time to complete your tax return, to keep track of how well your business is doing, and to apply for a loan, to name just a few uses. Your financial report can also be used by different people such as Creditors, the ATO, your accountant, investors, and management. It is important that the reports are accurate and there are several guidelines that must be followed when producing them so that they can be easily read by any of the users.
Over the past few editions, we have been working through the bookkeeping process from creating your Chart of Accounts to recording your transactions to now, creating your financial statements.
Trial Balance
A Trial Balance is produced to check that all your ledger accounts balance. It lists the total balances of every general ledger account at a specific point in time. The accounts are listed down the left of the report and the amounts are in two columns on the right. The Debit Accounts (Assets and Expenses) have their totals in the left column, and the Credit Accounts (Liabilities, Revenue, Equity) are on the right. Both columns are then added up, and if your books are all balanced you will find both columns equal each other. Please note however, just because your columns balance, doesn’t mean your trial balance is accurate so it is important to double check your work. A trial balance is used to create the next two reports, so it is important to take your time on this to get it right.
Where the Trial Balance includes Asset accounts, Expense accounts, Liability accounts, Revenue accounts and Owners Equity accounts, the Profit and Loss Statement shows the Revenue and Expense accounts, and the Balance Sheet shows the Assets, Liabilities and Owners Equity Accounts.
Profit and Loss Statement
Also known as an Income Statement, the Profit and Loss Statement shows whether your business is making a profit over a certain period. Usually this will be over the last 12 months but could be over a week, month or even years. Once you list out your revenue earned over that period and your expenses over the same period, the difference will tell you if you have made a profit of loss for that period. This profit or loss amount is then transferred to the Balance Sheet under the Owners Equity category.
Balance Sheet
From the Trial Balance we now transfer the Assets, Liabilities and Owners Equity (including the Profit or Loss that you determined in the P&L Statement) to the Balance Sheet. The Balance Sheet shows you how your business is doing when it comes to your company’s overall wellbeing. If your liabilities are greater than your assets for example, then you aren’t going to have anything in your owners equity which is a huge problem when it comes to the survival of your business.
These three reports really do give you the best idea of how well your business is doing. The Trial Balance allows you to check that the general ledger accounts balance, the profit and loss statement whether you are gaining profit or losing money, and the balance sheet can give an idea on the longevity of your business.
There is one more report that can be helpful in understanding your business, the Cash Flow Statement. I’ll cover this next month.

What is Ryeqo, the recently approved medicine for endometriosis?
For women diagnosed with endometriosis it is often a long sentence of chronic pain and cramping that impacts their daily life. It is a condition that is both difficult to diagnose and treat, with many women needing either surgery or regular medication.
A medicine called Ryeqo has just been approved for marketing specifically for endometriosis, although it was already available in Australia to treat a different condition.
Women who want the drug will need to consult their local doctor and, as it is not yet on the Pharmaceutical Benefits Scheme, they will need to pay the full cost of the script.
What does Ryeqo do?
Endometriosis affects 14% of women of reproductive age. While we don’t have a full understanding of the cause, the evidence suggests it’s due to body tissue that is similar to the lining of the uterus (called the endometrium) growing outside the uterus. This causes pain and inflammation, which reduces quality of life and can also affect fertility.
Ryeqo is a tablet containing three different active ingredients: relugolix, estradiol and norethisterone.
Relugolix is a drug that blocks a particular peptide from releasing other hormones. It is also used in the treatment of prostate cancer. Estradiol is a naturally occurring oestrogen hormone in women that helps regulate the menstrual cycle and is used in menopausal hormone therapy. Norethisterone is a synthetic hormone commonly used in birth control medications and to delay menstruation and help with heavy menstrual bleeding
All three components work together to regulate the levels of oestrogen
and progesterone in the body that contribute to endometriosis, alleviating its symptoms.
Relugolix reduces the overall levels of oestrogen and progesterone in the body. The estradiol compensates for the loss of oestrogen because low oestrogen levels can cause hot flushes (also called hot flashes) and bone density loss. And norethisterone blocks the effects of estradiol on the uterus (where too much tissue growth is unwanted).
Is it really new?
The maker of Ryeqo claims it is the first new drug for endometriosis in Australia in 13 years. But individually, all three active ingredients in Ryeqo have been in use since 2019 or earlier.
Ryeqo has been available in Australia since 2022, but until now was not specifically indicated for endometriosis. It was originally approved for the treatment of uterine fibroids, which share some common symptoms with endometriosis and have related causes.
In addition to Ryeqo, current medical guidance lists other drugs that are suitable for endometriosis and some reformulations of these have also only been recently approved.
The oral medicine Dienogest was approved in 2021, and there have been a number of injectable drugs for endometriosis recently approved, such as Sayana Press which was approved in a smaller dose form for self-injection in 2023.
How to take it and what not to do
Ryeqo is a once-a-day tablet. You can take it with, or without food, but it should be taken about the same time each day. It is recommended you start taking Ryeqo within the first five days after the
start of your next period. If you start at another time during your period, you may experience initial irregular or heavier bleeding.
Because it contains both synthetic and natural hormones, you can’t use the contraceptive pill and Ryeqo together. However, because Ryeqo does contain norethisterone it can be used as your contraception, although it will take at least one month of use to be effective. So, if you are on Ryeqo, you should use a non-hormonal contraceptive – such as condoms – for a month when starting the medicine.
Ryeqo may be incompatible with other medicines. It might not be suitable for you if you take medicines for epilepsy, HIV and AIDS, hepatitis C, fungal or bacterial infections, high blood pressure, irregular heartbeat, angina (chest pain), or organ rejection. You should also not take Ryeqo if you have a liver tumour or liver disease.
The possible side effects of Ryeqo are similar to those of oral contraceptives. Blood clots are a risk with any medicine that contains an oestrogen or a progestogen, which Ryeqo does. Other potential side effects include bone loss, a reduction in menstrual blood loss or loss of your period.
It’s costly for now
Ryeqo can now be prescribed in Australia, so you should discuss whether Ryeqo is right for you with the doctor you usually consult for your endometriosis.
While the maker has made a submission to the Pharmaceutical Benefits Advisory Committee, it is not yet subsidised by the Australian government. This means that rather than paying the normal PBS price of up to A$31.60, it has been reported it may cost as much as $135 for a onemonth supply. The committee will make a decision on whether to subsidise Ryeqo at its meeting next month.

R&D tax incentive claims - ATO flags questionable arrangements
The federal government has tabled draft legislation into parliament to change tax concessional treatment for individuals with very large superannuation account balances.
From 1 July 2025, superannuation balances over $3 million will have earnings on that portion of the balance taxed up to an overall 30%. The 30% tax rate will be the same as the company tax rate and the individual tax bracket of $45,000 to $200,000 in that income year.
The legislation is currently going through the parliamentary process. Individuals with large superannuation balances currently have 18 months to plan for the possibility for this new law to be enacted.

R&D tax incentive claims - ATO flags questionable arrangements
The ATO has released 2 taxpayer alerts flagging incorrect R&D tax offset claims where expenditure is incurred by associated entities or activities are conducted overseas for foreign related entities.
Taxpayer Alerts TA 2023/4 and TA 2023/5 warn taxpayers about using such arrangements and how they might be subjected to increased scrutiny and possible penalties.
The ATO is currently reviewing claims made by R&D entities under the R&D tax incentive for expenditure incurred using the arrangements specified in these taxpayer alerts.
The ATO has urged entities that have entered, or are contemplating entering, into arrangements of concern to promptly engage with them.

Changes proposed for DGR status and charitable giving rules
The Federal Government released a draft report that proposes policy reforms to incentivise philanthropy and increase outcomes for donors, charities and taxpayers.
Several reforms to the administration and oversight of organisations with deductible gift recipient (DGR) status also came into effect on 1 January 2024.
The proposed and enacted reforms aim to facilitate firm foundations for the future of philanthropy, enabling greater donor choice and ensuring that regulation continues to support trust and confidence in charities.
The areas of focus include, but are not limited to, the tax deductibility of donations, regulatory framework and public information on charities and giving.

Tax deductions to be denied for interest charged by the ATO
fter 1 July 2025, a proposed amendment to the tax law will mean that deductions will be denied for ATO interest charges, specifically the general interest charge (GIC) and shortfall interest charge (SIC). GIC is incurred when tax debts have not been paid on time and SIC is incurred when a tax liability has been incorrectly self-assessed and resulted in a shortfall of tax paid.
Both GIC and SIC are currently tax-deductible for all entities. Removing the deduction is intended to encourage entities to correctly self-assess their tax liabilities and pay on time.
The ATO also imposes a late payment interest, which is not tax-deductible and excluded for the purposes of this measure.

Electric vehicle home charging expenses – guidance finalised
The ATO has finalised the practical compliance guideline which will assist taxpayers with calculating electricity costs relating to charging electric vehicles at home. In response to the surge in use of electric vehicles in Australia, provision of electric vehicles to employees or associates was recently made exempt from FBT (conditions applied)
From 1 April 2022 and 1 July 2022 for FBT and income tax purposes respectively, a cents per kilometer rate of 4.20 cents can be used to calculate electricity costs of charging an electric vehicle at residential premises. This guideline does not apply to plug-in hybrid electric vehicles which have internal combustion engines or are not considered low-emission vehicles.
This guideline also does not apply to electric motorcycles and electric scooters.

Incentivising pensioners back into the workforce – updates
Pensioners and those on Veterans' entitlements will be enticed back into the workforce with an increase to their work bonus concession balance. This measure is being supplemented with an increase to the time limit for the suspension of pension entitlement from 12 weeks to 2 years. This means if a pensioner earns too much income over a period of time, their pension will be suspended instead of cancelled.
Effective from 1 January 2024, all pensioners over pension age and eligible Veterans now have a maximum work bonus balance limit of $11,800 up from $7,800 and all new age pension recipients have a maximum work bonus income balance of $4,000 (previously nil).
Also effective from 1 July 2024, employment income nil rate will be doubled to 24 weeks (previously 12 weeks) for income support recipients.
Guidance finalised for depreciation of composite items
The ATO has finalised guidance on whether an asset that is made up of a number of components (a composite item) is itself a depreciating asset, or whether one or more of its components are separate depreciating assets.
The Taxation Ruling TR 2024/1 provides the Commissioner’s view on identifying the relevant depreciating asset and hence its effective life and depreciation rate for the purposes of Div 40 of ITAA 1997.
Guiding principles have also been provided to help ascertain the level of “interest in the underlying asset” and apply the decline in value provisions for the purposes of s 40-35.
This Ruling does not address Div 43, which provides deductions for certain capital works expenditure.
Bills on revised tax cuts introduced in Parliament
The Labor government has announced changes to personal tax rates that will provide a tax cut for every Australian taxpayer commencing from 1 July 2024.
Changing the original course of action, as announced by the previous Coalition government, the new tax changes aim to focus on the low and middle income earners and provide cost-of-living relief.
The Medicare levy low-income thresholds for 2023-24 will also be increased, reducing or eliminating the amount of Medicare levy paid by Australians on lower incomes.
The bills amending income tax rate thresholds, tax rates for individuals and Medicare levy low-income thresholds, have been introduced in the Parlianment and await approval to become law.

Artists, arts and cultural groups and organisations are invited to apply for Council’s Arts and Cultural Grants funding program for 2024/25
The grants are part of Council’s Community Grants funding program, which supports community-driven projects, initiatives and events.
Mayor of Maroondah, Councillor Kylie Spears, said the grants can support a range of projects. “The Arts and Cultural Grants are a fantastic opportunity for artists, arts and cultural groups or organisations to apply for funding towards their project or program,” Cr Spears said.
“If you have a project that could add to Maroondah’s vibrant local arts and cultural scene or encourage more community members to get involved in the arts, I encourage you to learn more about the grants and submit an application.”
Blossoms of Life – The Eucalyptus Flower for Everyone was supported by Council’s 2022/23 Arts and Cultural Grants funding program.
Boosting community arts and culture
The collaborative art project between artist Hsin Lin and poet Lauren M Hancock was installed at Ringwood Lake Park.
“As a local artist, most of my inspiration comes from my observation of nature. Ringwood Lake Park is one of my favourite places in Maroondah to visit, where we are blessed with various native vegetation and beautiful flowers in different seasons,” Hsin Lin said.
“To celebrate and promote the beauty and strength of native flowers, I wanted to deliver a bigger, brighter artwork, cooperating with local poet Lauren M Hancock to present a permanent display in a public area that aims to bring colourful, joyful experiences to local residents.
“Having the artwork in this location - a place we love and belong, and where children grow - and seeing the flowers in full bloom reminds everyone that we are alive, vibrant, and blossoming.” U3A Croydon received a grant in 2023/24 to support its free Musical Instrument Lending Library,
which encourages members to trial, learn and perform new instruments at community facilities and events. This benefits new and experienced musicians, Secretary Peter McErlain said.
“There are three beginner classes for ukelele, guitar and piano at U3A Croydon, so beginners, who are reluctant to purchase an instrument, can borrow an instrument for a semester and have free tuition from an experienced music tutor,” Peter said.
“Members who already play an instrument can borrow a [different] instrument and try learning this to further expand their knowledge and skills.”
The library also provides a sense of connection and “shared purpose” for groups of older residents. “With a music group of quite a few people45 in several groups - there is a huge sense of support, a real shared interest in each other. Inspirational citizens honoured
Maroondah’s most remarkable community members were celebrated at an Australia Day event held at Ringwood Lake Park on Friday 26 January.
Mayor of Maroondah, Councillor Kylie Spears, announced the 2024 Citizen of the Year, Young Citizen of the Year and Community Event of the Year during a special awards ceremony, where 60 people also received their Australian citizenship. “The annual Maroondah Australia Day Awards are a wonderful opportunity to acknowledge outstanding individuals in our community who, through their dedication and passion, have made positive contributions to our community and to the lives of others,” Cr Spears said.
“Through these awards, we are able to celebrate those who generously give their time and energy to our community, yet seek no recognition for their work. I sincerely thank and congratulate all of our award recipients and nominees for their extraordinary achievements.”
Each year, our community is invited to nominate an individual or community group for the Maroondah Australia Day Awards, in recognition of their outstanding contributions to the community. This year’s recipients have been honoured for their remarkable impact on Maroondah and the wider community.
Citizen of the Year
Catherine Gordon was named 2024 Citizen of the Year. She has been a dedicated and tireless volunteer for the Maroondah Volleyball Association and wider community for many years. Catherine is a driving force in the growth of participation at all levels within Maroondah Volleyball and has also been involved in many programs, activities and fundraisers. Catherine is passionate about inclusiveness and has been instrumental in ensuring
the sport is equally accessible for all and promoting community engagement and social inclusion. She has coordinated regular sitting volleyball activities, increased cultural participation, held LGBTQIA+ events and is actively looking to develop wheelchair volleyball.
“I started our first-ever VolleyAll program, a full inclusion program for volleyball that can be played at the grassroots, everyday level for a child who has a disability, whether it’s physical or mental. That’s been a great program. I’m very passionate about getting all kids in our community involved,” Catherine said.
Young Citizen of the Year
Satria Arbai received the Young Citizen of the Year award for his passion and dedication towards advocating for disability rights. He has worked hard to raise awareness and understanding of the challenges faced by young people with a disability within the school community at Ringwood Secondary College.
Satria’s active involvement in the student-led Ringwood Activists for Disability (RAD) group and presentations delivered to students have challenged misconceptions about people with a disability and promoted the importance of inclusiveness. This advocacy has helped to improve the visibility of people with a disability within the school community and has made Ringwood Secondary College a more inclusive and supportive environment.
“At school, I had the opportunity to run a workshop on how to interact with someone with a disability and I also ran a project with the Ringwood Activists for Disability there. It made me feel really happy that I got to do something for the community,” Satria said. “I’m proud of our social media account educating people about disability and how to become a better ally for people with disability. It’s really great.”
Community Event of the Year
The Language of Friendship event was awarded Community Event of the Year. The sold out ‘Language of Friendship’ workshop was held at Eastland in February 2023 with over 700 bookings.
Presented in partnership with URSTRONG, Maroondah Positive Education Network and Communities of Wellbeing, the event showed parents how to support children to create healthy, feel-good social connections while using the ‘language of friendship’, including friendship tools such as a friend-ometer to rate friendships as healthy or unhealthy, friendship facts, friendship values and skills to talk through ‘friendship fires’ and disagreements.
URSTRONG’s whole-school friendship strategy was also recognised for improving the social climate in schools across the world by connecting over one million children, parents and teachers with the common language of friendship. Edwina Ricci accepted the award and said “The event was inspired by some research we did in 2019 … and was the extension of the ‘language of friendship’. The language of friendship is simple and easy to implement, and is a really important way for students to manage their own relationships, to be self-determined and have the language and skills to understand that friendships change and that’s okay.
“It’s four or five years down the track now and [the need] is still there, so that’s a sign of something that is sustainable and having a great impact,” Edwina said Congratulations to our deserving recipients and nominees.

Are you part of a community group or organisation with a project or program that could make a difference in Maroondah? Consider applying for Council's 2024/25 Community Grants funding program
Funding is available for not-forprofit, incorporated groups to assist with projects or programs that make a positive contribution to the Maroondah community.
The funds can be used to buy equipment or to deliver a program, project or event in Maroondah.
Groups can apply for funding under Community Development Grants, Small Equipment Grants and Emergency Food Relief Grants.
Mayor of Maroondah, Councillor Kylie Spears, said the funding can support a range of community projects, initiatives and services, so community groups and organisations should consider applying.
“Council is pleased to offer assistance to community groups and support them in developing or delivering a range of programs, projects and events that contribute to community wellbeing in Maroondah.
“If you are part of a community group or organisation in Maroondah and have a project or program that could benefit our community, I encourage you to find out more about
Supporting community groups
Council’s Community Grants funding program and if eligible, submit your application.” Big Little Buddies received a grant as part of Council’s 2023/24 Community Grants funding program. The grant helped the charity purchase new equipment and instruments for its music-based intergenerational programs, which promote shared enjoyment, learning, and positive health and wellbeing outcomes for participants young and old.
Monique Waterhouse, of Big Little Buddies, said the intergenerational programs have “benefits for everyone involved.”
“We know the significant impact of the COVID-19 pandemic on aged care residents in terms of isolation and loneliness, and we are working to combat this. We also aim to foster positive attitudes towards ageing and older people in the younger generations. Caregivers often express how the programs positively influence their children’s social skills and confidence, as well as their empathy and kindness,” Monique said.
“As a small charity organisation, we rely heavily on the generosity of donations and grants to be able to implement our programs for sustained periods, allowing them to have the greatest impact on the lives of all who attend, especially the aged care residents - or ‘big buddies’, as we like to call them.”
Council’s Community Grants have also supported various programs at Hope City Mission, including their emergency relief community food garden, their food relief delivery program and their financial literacy program.
Emergency Relief Manager, Josh, said Council’s support has been “invaluable”, particularly following an increase in need over the last 12 months.
“The Maroondah City Council Community Grants funding program has been a big part of Hope City Mission being able to improve our services and increase our services as the community’s needs have increased. Having gone from servicing approximately 70 families a week to 140 or 150 families per week, we have needed the support that Council has given us.
“We are really fortunate to help so many people each week and we have a great team of volunteers. We can also help with produce that we grow ourselves through our community garden. All of these projects and programs, including our food delivery, wouldn’t happen if it weren’t for sponsorship and partnership,” Josh said.
“We are so grateful for Council’s support. It’s been a big part of helping us support and bring hope to people in the City of Maroondah.”

Ringwood Caledonian Society – Dance Scottish
Scottish Country Dancing has been around for over 300 years and is danced around the world, and also in Ringwood!
The Ringwood Caledonian Society holds classes every week to teach Scottish Country Dancing and has been established now for almost 55 years. We also celebrate significant Scottish events such as Burn’s night (in celebration of Scotland’s famous poet Robert Burns birthday) and St Andrew’s Day (St Andrew is the patron saint of Scotland) and run an annual Barn Dance (similar to a Ceilidh).
“Scottish Country Dancing has so many benefits” according to the teacher and president Sarah Wrigley. “It’s been proven to improve people’s mental and physical health and we have a great social group as well. You don’t need a partner. There are no swords involved. You also don’t have to be Scottish!”
Scottish Country Dancing is usually described as the ballroom or social dancing of Scotland. It’s still often danced at weddings and parties, and with the popularity of the Outlander series on television, all things Scottish are increasingly sought out.
Scottish Country Dancing is suitable for men, women and children of all ages, but you need to have a reasonable level of fitness to get started.
While they welcome beginners at any time of the year, on March 27th (8 – 10pm), Ringwood Caledonian Society is running a Come and Try Night to give people a taster of the dance form. This will be followed up by a Beginner’s course running from April 3rd. ”It’s a great way of finding out whether this form of dance is for you. It’s a casual night, so you just need soft shoes (like runners or ballet flats) and a smile, a general level of fitness to dance and comfortable clothes. And for an added bonus, a cuppa and cake at the end to mingle”. The night is free.
The beginners’ program starts the following week at 7.30pm and runs for 6 - 8 weeks, from which the group is integrated more and more into the general class. “It’s not a dance form you pick up on the first night. It takes a while to work out what your feet should be doing and knowing and executing the formations well. So it takes a bit of practice and a bit of time regularly attending classes to improve”.
The bonus though is that you can travel pretty much anywhere in the world after that and join a class and be generally well looked after. There are also annual schools held in Australia, New Zealand, Canada and of course Scotland, as well as Branch classes and weekends around the world. – It’s like an extended family of friends sharing a common interest.
Classes run from February through to early – mid December from 8 – 10pm and cost just $6 per night (including tea, coffee and biscuits).
If you would like to see us in action, the Ringwood Caledonian Society will also be demonstrating Scottish Country Dancing at the Melbourne Highland Games and Celtic Festival at Eastfield Park in Croydon on Sunday March 24th. Pop by our stand and have a chat! Lots of activities for the kids too!
Ringwood Caledonian Society celebrated its 50th anniversary in 2017. We meet weekly at Central Ringwood Community hall to enjoy Scottish Country Dancing.

URGENT HOME NEEDED days in the shelter 765
We are in need of a very special and super cat-savvy person who is willing to give our big boy Bowie a chance.
Bowie was first surrendered to Blue Cross in December of 2020. Between then and now, he has been adopted and returned to us not one, but two times due to his temperamental behaviour. Had he been at any other shelter, we’re sure he wouldn’t have been given a third chance, but we held onto hope that there was someone out there who would love Bowie for who he is, attitude and all.
Since being returned the second time, Bowie has been at the shelter for well over a year, but in total, has been in a shelter for roughly 765 days of his life.
Though we do our best, shelters are not designed for animals to stay such lengthy periods of time, and we are concerned about Bowie’s quality of life the longer he is here.
This big, beautiful boy can be quite social when it’s on his terms, and quite often enjoys sitting on your knee and having some pats. Despite being a big tough boy, Bowie

is actually quite timid of unfamiliar noises and environments, which can cause him to be a bit on-edge. It’s that relatively small percentage of the time where he’s feeling a bit uncertain (or just in a bad mood) that his attitude comes out, and he can be a bit intimidating to some people.
Though he makes his displeasure known, it’s mostly just a lot of noise - warning you that he’s not in the mood - that generally doesn’t go beyond a swipe if you don’t listen to him. He really needs someone who isn’t going to be put off by his attitude, and will be able to get to know him and understand when to give him space. Ideally, he would enjoy having access to a secure outdoor area and a home where he can have his own space and come to you for company when he feels like it.
Bowie will need a home with only adults and no other pets. If you think you have the guts to give Bowie the best chance at a happy life, please give us a call on 9722 1265 to book an appointment to meet him.
Arrabri will be hosting our annual International Women's Day on Wednesday 6th March at 12pm. International Women's Day is a time to celebrate women's achievements and call for action as we work toward women's equality. The theme for International Women's Day 2024 is Inspire Inclusion. When we inspire others to understand and value women's inclusion, we forge a better world. And when women themselves are inspired to be included, there's a sense of belonging, relevance, and empowerment. Collectively, let's forge a more inclusive world for women.

RETIREMENT
By Warren Strybosch
Account based pensions first appeared in the Australian superannuation landscape from 1 July 2007 as a simplified replacement for allocated pensions. Account based pensions can only be “purchased” with superannuation money.
For an account-based pension to be effective, a minimum prescribed amount of income must be paid to the account holder (member) each year.
The minimum level of income to be drawn each financial year is based on the member’s:
a. account balance as at start of the financial year, and
b. the payment factor relevant to their age at the start of the financial year.
Where an account based pension commences to be paid on a date other than 1 July, the minimum income is based on the account balance at the date the pension commences and is pro-rated for the number of days the pension is to be paid for the year.
Likewise, if a pension is commuted (i.e. is discontinued) before the end of the financial year, the minimum income is pro-rated for the portion of the financial year the pension has been in force.
The minimum income is rounded to the nearest $10.
For example, a 68-year old with an account-based pension balance of $387,500 at 1 July 2023 would be required to draw a minimum income of $19,380. The income may be drawn as a single income payment, or at regular or irregular intervals throughout the course of the year.
Except where an account-based pension is being paid under transition to retirement (TTR) rules, there is no maximum limit on the amount of income that can be drawn in a financial year.
Where a TTR pension is being paid, income payments are limited to a maximum of 10% of the account balance. Unlike minimum pension payments is relation to an account-based pension that is paid for less than 12 months, the maximum income is not pro-rated.
In the event that income of less than the prescribed minimum is paid during the course of a financial year, an account based pension is taken to have ceased at the start of the financial year and any amounts paid are treated as lump sum superannuation benefits. They are taxed accordingly.
However, the Commissioner of Taxation may treat a pension as remaining in the pension phase even though the minimum income has not been paid where:
1. The trustees of the fund failed to pay the minimum because of:
a. an honest mistake and a small underpayment arose, or
b. matters outside of the control of the trustees
1. The underpayment is a small underpayment
2. A catch-up payment of the shortfall is made as soon as practicable in the following financial year.
3. The fund would have otherwise continued to be in the pension phase had the short payment have not occurred.
A trustee is able to self-assess where a small underpayment is made. A small underpayment is an amount less than one twelfth of the minimum annual payment.
There are several adverse consequences that may arise where the minimum pension payment is not made and the account-based pension is treated as having ceased, including:
1. The fund will not be entitled to a tax exemption on investment earnings derived from assets supporting the pension payments (exempt current pension income),
2. Where a pension is being paid under TTR rules, the treatment of income payments as lump sum benefits may result in a breach of the superannuation payment standards (i.e. lump sums cannot be paid from a TTR pension),
3. The tax components of the account-based pension account will be crystallised with other tax components a member may have in an accumulation account. This may have estate planning ramification particularly where the tax-free component was being quarantined from other tax components.

Norwood’s Senior Women’s squad has enjoyed a positive start to 2024, with both the SANFLW and Development League sides securing wins across all four Trial Matches.
The Redlegs concluded their Trial Matches in warm conditions at Coopers Stadium on Saturday, with two wins over Glenelg.
Norwood’s SANFLW side claimed a 22-point win over the Tigers, 8.8-56 to 5.4-34.
Amelia Rusden and Jade Halfpenny each kicked two goals, while Elle Lineage, Adrienne Davies, Tahlita Buethke and Kiana Lee kicked one apiece.
Earlier in the day Norwood’s Development League team had to overcome a four-goal half time deficit to fight back and win 7.4-46 to 5.3-33.
First year player Isabella Calvanese starred for the Redlegs Development League side, booting four goals while Kaitey Whittaker, Alana Lishmund, and Mykaela Walker kicked one each.
In the first Trial on February 10, Norwood’s SANFLW side claimed a 15-point win over North, 9.7-61 to 7.4-46, while the Development League won by four points, 7.5-47 to 6.7-43.
Norwood’s SANFLW Round 1 match is scheduled for Friday night, March 1 at Coopers Stadium against reigning premiers Central District.
Norwood’s Senior Men’s Trial Matches will take place on Saturday, March 9 against North at Coopers Stadium (2:10pm), and Saturday, March 16 against South Adelaide in Noarlunga (1:10pm).
We’re still taking registrations for our Auskick Program that starts on Friday 10th May from 5.30pm - 6.45pm. SPORTS MARCH 2024 EDITION
Team
Last 26 of Feb travelled to Mitcham and in what was a seesaw game until late, the team dug in deep and won by 16 shots. What an awesome effort which earns us the opportunity against Vermont next week. Unfortunately Team 2 & 3 fought hard but came up short but had outstanding seasons both making the second day of finals. Great to have so many members back at the club for our big raffle, song, members draw and reading of the cards. A fantastic atmosphere and we look forward to next Games!! Go Eagles!!
