About the Find Maroondah By Warren Strybosch

The Find Maroondah is a community paper that aims to support all things Maroondah. We want to provide a place where all Not-For-Profits (NFP), schools, sporting groups and other like organisations can share their news in one place. For instance, submitting up-andcoming events in the Find Maroondah for Free. We do not proclaim to be another newspaper and we will not be aiming to compete with other news outlets. You can obtain your news from other sources. We feel you get enough of this already. We will keep our news topics to a minimum and only provide what we feel is most relevant topics to you each month. We invite local council and the current council members to participate by submitting information each month so as to keep us informed of any changes that may be of relevance to us, their local constituents.

We will also try and showcase different organisations throughout the year so you, the reader, can learn more about what is on offer in your local area. To help support the paper, we invite local businesses owners to sponsor the paper and in return we will provide exclusive advertising and opportunities to submit articles about their businesses. As a community we encourage you to support these businesses/columnists. Without their support, we would not be able to provide this community paper to you. Lastly, we want to ask you, the local community, to support the fundraising initiatives that we will be developing

and rolling out over the coming years. Our aim is to help as many NFP and other like organisations to raise much needed funds to help them to keep operating. Our fundraising initiatives will never simply ask for money from you. We will also aim to provide something of worth to you before you part with your hard-earned money. The City of Maroondah is a local government area in Victoria, Australia in the eastern suburbs of Melbourne. Maroondah had a population of approximately 118,000 as at the 2019 Report which includes 9000 business and close to 46,000 households. The City of Maroondah was created through the amalgation the former Cities of Ringwood and Croydon in December 1994.

Housing Prices Drop For the past two years we have seen significant housing growth but now capital city values are starting to trend downwards, according to latest data. Sydney has posted the first decline in housing values since September 2020. Whilst the drop of 0.1 per cent is a modest decline, it is an indication of where the market is likely to head for both Sydney and Melbourne over the next 12 to 24 months. CoreLogic’s national Home Value Index recorded a 0.6 per cent gain in February, the pace of growth had slowed since April 2021 and marked the lowest monthly reading since October 2020. Stronger housing market conditions were recorded in Brisbane and Adelaide and Hobart, where housing values rose by more than 1.0 per cent in February. Regional markets remain strong Whilst capital cities are starting to trend downwards, regional Australia continues to record a substantially higher rate of growth than the capital cities. Over the past three months, housing values across the combined rest-of–state regions increased (up 5.7 per cent), compared to combined capitals that rose 1.8 per cent.

Although the rolling quarterly rate of value growth remains rapid across regional Australia, conditions have eased from its recent peak of 6.4 per cent over the December quarter and is down from a cyclical peak of 6.6 per cent recorded in April last year.

It’s that time of the month NATUROPATH By Kathryn Messenger

With International Women’s Day on Tuesday 8th March, now is a good time to talk about periods. Having a positive mindset about your cycle can help reduce some of the negative emotions around it. Know that this can be a time to deal with emotions gathered over the last month and a chance to give yourself time for nurture and rest. Whilst every woman’s cycle has it’s differences, a normal cycle is 28 days (give or take 7 days), last for 4-7 days (give or take 2 days), and loss should be 30ml-80ml (although this can be hard to measure). If your cycle is not within these parameters, or you experience the following, you should see your doctor: Cramping that lasts more than a few days, is a stabbing pain, pain with sex, or clots that are large or dark. Pain Pain can be reduced with regular exercise and improved diet in the month prior to your cycle. Increasing vegetables, fruit, and protein whilst decreasing sugar and processed white grains can make a big difference. Try to eat a wide variety

Cravings Whilst your period may seem like the perfect excuse to sit down with a gourmet tub or chocolate ice-cream, dark chocolate is more likely to satisfy. Ideally eat 85% cocoa (or more), but you can build up to this if you’re not used to it. If you crave salt, swap chips (crisps) for popcorn or healthy alternatives such as kale chips.

Typos, Spelling Mistakes and How to Avoid Them ACCREDITED EDITOR By Susan Pierotti

Typos What's wrong with the following – ‘Hope and peace are crucial after these tiems of COVID lockdown.’ The message is a good one. It's short, to the point, easy to digest. Are you going to remember it – or will you remember the typo?

Just like these floor tiles – lovely sheen, nice colours. Sadly, all you might remember is the one tile that’s out of place that ruins the whole effect.

It’s as if, when you go for a stroll through beautiful bushland, with the wattles blooming, the magpies carolling and a sunny warmth tempered by a light refreshing breeze, all you are aware of is a tiny, irritating grain of dirt in the sole of your shoe. If you leave a typo in your writing, even just one eeny-weeny one, that is all some people will remember. Don't let the odd typo or spelling error condemn your message. It pays to check everything you write before clicking ‘send’ or ‘post’. Try reading it aloud or reading it line by line backwards. It's amazing what you may be able to fix. Common fixable spelling errors English is a difficult language, partly because so many words sound the same but mean different things. This can also lead to unconscious spelling errors. Here are some common ones and their meanings that may help: • • • • • • •

This floor appears to have been tiled by a master tradesperson. But look again. It might take you a moment to notice the two tiny tiles in the middle that are slightly misaligned, but they’re there. Try this experiment: close your eyes for twenty seconds, then open them and look at the tiled floor again. What is the first thing you see? I bet it’s the small tiles out of place!

to fix. The Spellchecker tool on a computer picks up spelling mistakes and in the above sentence, there are no spelling ones. Every word is correctly spelt – yet it doesn’t still make sense. The most common typos are caused by typing the key next to the one we want. Yet, if that wrong key makes a correctly spelled word, a spellchecker won’t be able to fix that. By replacing only one letter in most of the words in the above sentence with an adjacent one (He have then, buy nor hum, a food tine), we get – She gave them, but not him, a good time. Artificial intelligence and computers are limited. They can’t ‘think’ like humans and they don’t use language as we do. Ask yourself this question: would you rely on your Spellchecker function again when you could employ a human to sort out your typos? Spellcheckers are a useful shortcut but a human will be able to adjust your text to suit required spelling styles (Australian English, American English, government requirements etc.). They can tweak the grammar, tidy up formatting and make you look professional, leaving you time for all those creative ideas. And as a bonus, a human will understand the sense and emotion that you want to convey. A computer can’t do all that! How To Fix Pollution, One Bite At A Time NATURE & CONSERVATION

At equivalent cost, the advantages of the products "grown" by Ecovative compared to synthetic hydrocarbonderived materials are significant. Where, for example, the production of a cubic meter of polystyrene consumes the equivalent of 1.5 liters of oil, Myco Foam requires very little energy.

In a circular economy where does polystyrene fit? In the environment it is a disaster, so how can this material become something in a circular economy? It can’t! Innovation, is required. So what have the worlds creative minds been doing to eliminate polystyrene?

Tons of polystyrene clogs landfills and pollutes the oceans taking hundreds of years to degrade, but Myco Foam returns to earth in the form of a nutrient once it has completed its life cycle. 100% natural, it is 100% biodegradable and breaks down in just a few weeks!

In 2006 two students Gavin McIntyre and Eben Bayer, from the Rensselaer Polytechnic Institute (State of New York, USA), had the idea of creating a new material from agricultural waste and mycelium. The mycelium is the vegetative part of the mushroom, consisting of branched filaments called hyphae – which help decompose the dead organic matter on which they feed. McIntyre and Bayer wanted to use this organism to grow a material with the same properties as plastic. After graduating, they decided to focus on developing their idea and founded their company in 2007. Ecovative launched itself in the packaging industry by presenting its product as an environmentally friendly alternative to polystyrene - the compact white foam used to pack the breakable items, such as electronic devices or furniture. Dell was one of the first manufacturers to use this type of packaging for its computers. Ikea, the Swedish furniture company have made a commitment to replace styrofoam with mycofoam going forward. The mushroom-based plastic, called Myco Foam, creation process is as follows:

A collection of agricultural waste such as straw, corn husks or lentil pods from local producers, is collected. The waste is sterilized and introduced into the mycelium ( the white fibrous growth in the photo above ) and the mixture is placed in shaping moulds in the dark. For five days, the mycelium grows, feeding on the agricultural waste. It forms a network of tiny white fibres entangled in and around the substrate, filling all the available space and forming a solid structure. The resulting material is removed from the mould and fully dried to kill any further growth. "Mycelium is an amazing material, because it's a self-assembling material. It actually takes things we would consider waste[…] and can transform them into a chitinous ( nitrogen containing polysaccharide) polymer, which you can form into almost any shape,” explained one of the co-founders of Ecovative.

Coffee is such a versatile substance. There are so many interesting flavours of beans from around the world that can be enjoyed in an almost endless variety of ways. (Think, cappuccino, tiramisu, ice cream...!) And as the gift that keeps on giving, after you’ve enjoyed your brew, the coffee grounds can be recycled as beauty products and in your garden.

Five Fun Craft Ideas Using Coffee

But there’s even more great things you can do with coffee. If you believe in recycling and love making crafts, here are five fun ways to use those useful coffee beans and grounds. 1 Aromatherapy Merely smelling the alluring aroma of coffee is enough to put many a good mood. So you will be delighted to know that it is so easy to use as aromatherapy in your home. Just fill a bowl with coffee beans and place tea lights on the top. The heat of the candles will gently heat the beans, filling your room with the fragrant aroma. And if you like making candles, coffee is a wonderful ingredient to add. All you need to do is melt 1 cup of candles remains in a metal or glass bowl on top of a saucepan filled halfway with water. Clean a paper coffee cup, making sure it’s dry. Position a candle wick in the cup and sprinkle 1 tablespoon of coffee grounds on the base. Add half the melted wax and let it harden for 20 minutes. Add another layer of coffee and wax. After 1 hour, cut away the coffee cup and there you have it – a candles that smells more natural one made with fragrant oils and one that look strikingly attractive. 2 Pincushion filler Speaking of craft, if you’re right into sewing, you know you can never have too many pincushions! So make yourself a new one – with coffee grounds as the stuffing. It will not only make your sewing box and the items in it smell fabulous, it will prevent your pins from rusting! 3 Paper and fabric dyes Add a bit of chic to paper crafts by using papers dyed with coffee. Make a soupy mix of coffee and water. Then dip paper, cloth and other stationery materials into the mix and leave them to sit for a few minutes. Dry thoroughly –

When dry, brush off the grounds and voilà – a dusky brown paper that becomes your signature papercraft item. You can do the same for fabric when you are making clothes – a shirt, for instance. However, as coffee is a natural product, it will wash out or fade over time. 4 Painting If you can use coffee as a dye, does it work as a paint? You bet! As with the dye, you mix coffee and water to make coffee paint. The intensity of the shade you want will depend on how much water you add to the coffee. Dark chocolate tones need little water; cappuccino tints need lots of water. You can create an extensive palette at your disposal to decorate items around your home, use in artwork and keep the kids entertained on rainy days. The beauty of coffee paint is that it is non-toxic and simple and quick to make. You also have no paint cans to get rid of, or brushes to clean afterwards. It's also the cheapest paint around!

5 Playdough For more coffee fun with the kids, make some coffee playdough. Heat glycerin drops (or shave a small amount of glycerin soap base) in a saucepan until heated, then let it cool. Mix 2 cups of flour, 2 tablespoons of cream of tartar, 1 cup of salt, 1 tablespoon of coffee and ½ cup of coffee grounds together. Add 1 cup of very hot water, 2 tablespoons of oil and the glycerin. Mix until the consistency is pasty. Yes, it now looks like mud, but it’s ideal territory for toy dinosaurs... There are numerous health and safety documents that companies use to protect their employees. Arguably, the most common of these for high-risk construction work is Safe Work Method Statements; however, many other tools are also commonly used. Below are listed 10 common Occupational Health and Safety documents that organisations use – no matter what industry you work in. 1.

We often hear the phrase ‘roads, rates and rubbish’ as a criticism of Local Government spending. Some critics believe that Local Government should not exist at all! To understand the phrase ‘roads, rates and rubbish’, we need to look back at our history.

From the beginning of Local Government in Victoria, there has been a power struggle between state and local government over service provision responsibilities. The political shifting of responsibilities between the two tiers of Government sometimes resulted in public policy failure. One such event was the failure of the state government to build an integrated sewerage network. Local councils did not have the money to build a centralised network and came up with localised solutions that ultimately failed. Holeproof and Staley Gardens HERITAGE & HISTORY By Russ Haines OAM

With the advent of the Costco store in Ringwood, between Bond and Seymour Streets, comes another turning of a chapter of Ringwood’s history. The development required the use of the Staley Gardens area, unfortunately making quite a mess with the plaques missing and the rotunda destroyed. Like most parts of Ringwood’s history, the story started well before it arrived at the city. Thomas Staley, son of Thomas Snr, went to Ayrshire on the west coast of Scotland in the 1780s, located just below Glasgow. He was a miner and no doubt he worked on the lead mines around Leadhills, where he married his wife, Mary. Despite being a small village, the Leadhills Miners' Library, founded in 1741 houses an extensive antiquarian book collection, local relics, mining records and minerals. The library is the oldest subscription library in Britain and is of significant historical and geological importance. Thomas and Mary later moved to Muirkirk, about 20kms away. As the name implies, the village formed around the church and was a source of iron and coal, again probably occupying Thomas’ time. They had five children, Margaret, Anne, Fortune, Jonathan and (another) Thomas. The three girls remained in the area. Young Thomas went to Orange Valley Estate in Jamaica,

the area associated sugar plantations, but died at the young age of 21. Jonathan married Mary Goldie in 1820 and had twelve children. It was this family that migrated to Victoria in 1853 on the ship Reaper to seek fortune on the goldfields. Thus establishing the Staley clan in Australia. One of the sons was David Gray Staley, later became a storekeeper at Yandoit, which is half way between Castlemaine and Daylesford. One of his six children was David John, born in 1865 in Yandoit and died in 1912 in Malvern, whose son was Andrew Gray Staley, born in 1890 in Wilby and died in 1981 in Toorak. Andrew Gray Staley started in the hosiery business with George Foletta in the company "Prestige"in 1920, leaving it in 1924 to form a rival hosiery firm, "Staley and Staley Ltd." with his uncle Dan Staley in new premises in Dods St Brunswick. This company grew from 10 employees in 1925 to over 300 by 1929, and over 1200 by 1932. Both Foletta and Staley were welfare-capitalists, with canteens, social activities and clubs for their employees. There was even company-organized community singing in Brunswick Town Hall during the Depression. "A flamboyant super salesman," in 1929, with the financial help of his equally flamboyant Uncle Dan ( youngest son of David Gray), he established "Holeproof (Australia)," which soon became a market leader with innovative strategies such as individually packaged and named nylon stockings, and eventually

a large range of other garments, including business shirts, casual wear and pyjamas. The small open area in central Ringwood (see map on page 1), later to become Staley Gardens, was at the back of a Holeproof hosiery factory, established there on Maroondah Highway in 1942. In 1968 Holeproof was bought by Dunlop, which later became Pacific Dunlop and subsequently, Pacific Brands – the current parent company. Eastern suburbs Holeproof factories were also established in Deepdene, Nunawading and Box Hill. The area of the current gardens was given to the Ringwood Council in 1969 by Staley, and is well-remembered by many as a popular location for touring circuses. Staley Gardens is a passive recreation area, a grassed oasis with some trees and paths, and surrounded by streets, shops and carparks. Major developments of landscaping, paving and the erection of covered shelters were carried out in 1982, financed jointly by the Ringwood Market, Myer, and the Ringwood Council. Controversial Council plans, in 2005, allowed part of it to be used as a skateboard park. In 2013, considerable development was in the area, with the Costco store.

Dealing in Crypto? ASIC asks you to get financial planning advice. By Warren Strybosch

Crypto, like any investment can rise and fall. In the last few months, we have seen crypto currencies fall between 40% to 90% and with a current unstable world economy, it does not look like we will see a rebound in this sector anytime soon. The most common crypto currency is Bitcoin. At its height in November 2021, it was worth close to $94,000 AUD, and currently it is worth $53,000. Even before the fall in crypto pricing, ASIC was concerned with the number of people investing in crypto. People had it in their mind that crypto would just continue to rise in price without ever falling. They, those who wanted to invest, were concerned they were missing the boat on such a lucrative opportunity. However, like with all investments that are driven mainly by fear in greed, crypto has proven to be no different to other investments we have seen in the past. It will have its amazing ups and downs and trying to ‘guess’ or ‘time’ the market can have devastating consequences for many investors whilst only a few people end up walking away as the winners. I have heard stories of investors jumping in at the high, watching crypto drop 1015%, leverage up their investment (in otherwards borrow against their current investments), to only see the bottom drop out of crypto after they have borrowed the funds. This has resulted in a margin call whereby they have had to sell down their now worthless investments to cover the borrowings because the lender was concerned, they might not have the ability to pay back the loan. This has resulted in them walking away with a few thousand dollars from the nearly $50,000 they had originally invested. Does this sound familiar? This is what happened with the GFC where investors had margin loans against their investments. Of those who had margin loans during the GFC, approximately 90% of investors had margin calls and were required to either sell down their investments or come up with additional funds to pay back the loan. Time simply repeats itself and the same lessons are being learned, albeit by the next generation. The biggest issue with crypto investing is income – it simply does not produce any. With all good investments you

should seek growth and income and not simply growth. Yes, you can stake some coins, and this can alleviate some of the issues around price drops, but given there is no income, you are subject to everyone else’s fear and greed driving pricing. This lack of income makes you heavily reliant or hopeful on growth and when it does not occur can cause all kinds of problems as the example above demonstrates. If you do happen to time it right and get some growth, you then must decide when to sell. Once you have sold you are out of the market.

“Setting up an SMSF is one of the most significant decisions you can make relating to your retirement savings,” ASIC said.

With the lack of income that crypto provides e.g., none at all, it is not the most ideal investment to place your money into. Crypto should only be used by those investors who a) don’t need their money, and b) have all the time in the world to watch the price go down. It is not for any investor who needs to rely on those funds to derive an income or may need to repay back the capital in the near future.

“As the trustee of your SMSF, you ultimately bear responsibility for the fund’s decisions and for complying with the law even if you rely on other people’s advice – licensed or otherwise.”

ASIC is so concerned about crypto and the increased market activity whereby schemers are recommending you switch from retail and industry funds to SMSFs to invest in crypto, that they have requested everyone seek financial planning advice from a licensed financial planner before making such decisions. ASIC said that individuals should not rely on social media ads or online contact promoting an “investment opportunity” or “high return” portfolio.

In summary, crypto is an investment that will go and down in value, does not produce income, and should only be considered as an asset class for those investors who have the time and resources behind them to see them through a bearish market, and importantly, to seek advice, from a licensed financial planner, before making any decisions about what to invest in, that includes crypto.

In particular, individuals should be wary of cold calling, text messaging and emails that recommend transferring super to an SMSF or investing in crypto assets via their SMSF. “Australians who decide to self-manage their super should consider the risks before using their SMSF to invest in crypto-assets,” ASIC noted.

The regulator pointed to its own website, Moneysmart and the ATO website as providing resources for information about scams, crypto investments and SMSFs.

Heating Your Home The Sustainable Way ARCHITECT By Kathy Ismail

The good news is that you can warm your home in ways that are not only cheaper than using fossil fuels but are environmentally sustainable! Passive heating Passive heating directs the heat from the sun to your house. It is best applied when designing a new home or extension, but it is possible to achieve when buying an established or off-the-plan house and can be applied to all Australian construction systems. Passive heating has five elements: 1 Letting the sun in Heating happens when the sun’s shortwave radiation passes through glass and is re-radiated as longwave radiation, where it is absorbed by building elements and furnishings. Longwave radiation cannot pass back through glass as easily as shortwave radiation, so the temperature inside the room warms up. The process is affected by window orientation, shading, frames and glazing types. Large windows can induce solar gain, but in winter they can lose up to nineteen hours of heat at night. Choose windows with low conductivity or U value (for example, double glazing) and high solar heat gain coefficients (SHGC). Window frames also conduct heat. Timber, PVC and thermally separated metal window frames will prevent heat transfer. Fixed horizontal shading, such as eaves, blocks summer sun but lets it in in winter. 2 Storing heat High thermal mass (the ability of a material to store heat) stores heat from the sun inside the home during the day (through brick walls, for example) and releases it at night. Thermal lag (the amount of time taken to absorb and release heat) is influenced by the building material’s temperature ranges; its conductivity, thickness and surface area; its colour, surface and texture of the materials (for example, dark, matt or textured surfaces absorb and re-radiate more energy than light, smooth, reflective surfaces); and its exposure to air movement. The thermal lag time on a concrete house is around

6.2 hours whereas a rammed earth house of the same thickness is 10.3. Good thermal mass storage includes masonry walls, water-filled containers and insulated or internal suspended slabs that are not earth-coupled. 3 Heat distribution Thermal mass heat is released through building materials, good air flow and convection design. Floor plans play a large part; the most important rooms (those most used through the day and evening) should face north. Up to 10 degrees north-west and 20 degrees north-east will still provide good passive solar access. If your sunlight is blocked by nearby buildings or your home is on a poorly orientated or narrow block with limited sunlight, there are alternative passive solutions to increase comfort and reduce your heating bills. Try roof-mounted solar panels as a possible solution. 4 Preventing heat loss Walls, floors, ceilings, windows and especially roofs lose heat at night as your home cools down. Design a compact building shape that minimises roof and external wall area for greater efficiency. Locate thermal mass walls between northern areas and southern areas to draw daytime solar gains into sleeping areas at night. Heat loss is further minimised with appropriate choice of windows and curtains or blinds, and well-insulated walls, ceilings and floors. Ensure the mass is far from cold draught sources (for example, entrances). Ceiling fans circulate warm air evenly in rooms and push it down from the ceiling to living areas.

5 Preventing cold air entering Air leakage accounts for up to a quarter of winter heat loss in buildings. Reduce this by installing high quality windows and doors with airtight seals, tight-fitting floorboards and insulating the underside of timber floors and draught-proofing strips between the door and frame. Make sure any downlights don’t penetrate ceiling insulation and that skylights are not permanently ventilated. Block off unused chimneys and flues, seal all air (vents except windows and doors) and gaps between the window and door frames and the wall before fitting architraves in new homes and extensions. Install airlocks (small, closed areas at the entrance to a home) that limit cold air coming from outside and warm air escaping. Always design doors to blow closed if left open and use spring closers on external doors. Passive heating maximises winter heat gain, minimises winter heat loss, and concentrates heating where it is most needed. Significant material costs lead to dwelling build approvals collapsing in 2022 By Warren Strybosch

With the collapse of housing construction companies like Probuild and building materials doubling in price, it is no wonder dwelling building approvals have collapsed over the last 12 months. The number of approved residential construction in Australia has plummeted, hitting its lowest figure in almost 18 months and the first decline since October last year. We have even heard of large home building businesses offering future homeowners up to $50,000 to break their home building contracts given the significant increases in material costs. It is apparently cheaper for them to pay a large break cost than to go ahead and build the new home. One builder stated that building materials like wood had only increased by 10 cents per metre but over the last 12 months, the price of wood has literally doubled. They stated that they would have to bear the cost of the increase if any building contracts were signed given it is illegal to pass on the increase to the

consumer once a contract has already been signed. According to the Australian Bureau of Statistics’ data on building approvals in Australia, there were a total of 12,916 total dwellings approved over the month of January, falling 27.9 per cent comparative to December and over 24 per cent compared to the same period last year. This fall was observed almost across every state, with the decline being felt most distinctively in Victoria (-35.5 per cent), South Australia (-29.2 per cent) and NSW (-25.9 per cent). The only state that reported monthly growth was Queensland, which saw a marginal increase of 0.5 per cent. Driving this distinct loss in new dwellings, which is the lowest since June 2020 (12,724), was a dearth of apartments, town houses, and units, which fell 43.6 per cent month-to-month, hitting 4,007.

The same category of dwelling was said to be behind the uptick of approvals reported in December. However, housing approvals were also reported by the ABS as suffering a sudden fall, hitting 8,712 over January and marking a monthly reduction of 17.5 per cent. This again was observed across the country, with every state reporting a diminished approval figure, with NSW reporting the smallest decline (-14 per cent) and South Australia the largest (-19.9 per cent). Compared to January 2021, this new figure for private houses reflects a downturn of 29 per cent. It is likely, given the large increase in building material costs, that many people will hold off building their new home or an extension, and we are likely to see further declines in new dwellings being built during 2022.

WHY ARE FIXED RATES INCREASING?

Over the last 2 years interest rates have been at their lowest level in our country’s history. Since the start of the pandemic in 2020 until September last year, fixed rates of less than 2% were offered by lenders for 2 and 3 year fixed periods. For anyone who decided to lock in a rate during this time, it seems you have made the right call. Since September interest rates offered on fixed rate loans have steadily increased, with some rates offered increasing by more than 1%, even though the RBA has stated that they are not planning to increase the cash rate until early 2023. So what are the factors that have caused lenders to increase fixed rates when the variable rates offered have not changed? The main cause of fixed rates increasing is inflation, not locally but from overseas.

Banks and other lenders source their money from a number of different areas, with a large proportion from overseas banks. In the US, for example, inflationary pressures that are the worst in 40 years due to the pandemic will see the Federal Reserve increase rates for the first time since 2018 from April 1st. As the cost of money from these sources has increased, the extra costs are being reflected in the rates offered by lenders here. While fixed rates are increasing the variable rates offered by some lenders have continued to fall, as the RBA’s cash rate has not changed as yet. Currently you are able to obtain variable rates lower than 2% with a number of lenders. However inflation is also an issue for us locally, so there is an expectation that the RBA will need to increase rates sooner than the stated 2023 timeline. This is of particular concern for anyone with a variable rate Home Loan, as budgets may already be stretched with the increased living costs impacting households.

Family Trusts in the ATO Firing Line ACCOUNTANT By Warren Strybosch

The ATO has released a suite of new guidance products that is set to have a major change on family trust distributions and tax arrangements. The ATO has released new draft public advice and guidance (PAG) products relating to section 100A reimbursement agreements and division 7A of the Income Tax Assessment Act 1936. The Draft Taxation Ruling TR 2022/D1 suite is open for consultation and clarifies the ATO’s position on reimbursement agreements under section 100A, and identifies arrangements that will not attract ATO compliance resources. Draft Taxation Determination TD 2022/D1 outlines when “financial accommodation” arises under division 7A whilst Taxpayer Alert TA 2022/1 highlights arrangements of concern from the ATO where taxpayers are using adult-child beneficiaries of family trusts to avoid tax on income. The draft Ruling means the ATO may charge Trusts up to 47% tax where a trust distributes funds to adult children and it is found the parents are using those funds instead of the intended beneficiaries, in this case, the adult children.

“We have included explanations of proposed transitional arrangements to support clients to adjust their tax affairs to comply with the draft guidance once it is finalised.” The products address the situation when certain trust distributions may attract the operation of section 100A or division 7A of part III of the Income Tax Assessment Act 1936 (ITAA 1936), according to the ATO. The guidance will be relevant to any trustee (or controller) of a closely trust that may have concerns about whether the trust anti-avoidance provision in section 100A may apply when trust income is distributed to relatively favourably taxed beneficiaries, but the benefits of that income are enjoyed by others. It also addresses trusts that intend to, or have in the past, made a private company beneficiary presently entitled to trust income but not paid the amount on the basis that the amount is held in a sub-trust for the benefit of the private company and the arrangement avoids the application of division 7A. “The vast majority of small businesses operating through a trust will not be affected by this public advice and guidance,” the ATO explained.

It has been common practice for family trusts to be set up and income splitting to occur between spouses and other family members e.g., adult children. The ATO is aiming to stop or at least restrict this practice by using section 100A arguing that the beneficiary never used the funds and therefore was not actually entitled to the trust money that was paid to them. If this is found to be the case, then the ATO can tax the trust at the maximum rate of 47% (45% tax + 2% Medicare levy).

If the ATO beings to enforce section 100A, all trustees of family trusts will need to review their income-splitting strategies and how they distribute funds to beneficiaries. It will be important for trustees to have written document in place which adequately explains the justifications as to why a beneficiary is entitled to the revenue generated by the trust. This is going to be paramount for business owners who run their business through a family trust where the main business owner is the key person generate the revenue flowing through the trust and for those who have set up trusts to pass on funds to adult children.

“The draft guidance sets out the ATO’s preliminary but considered views on the interpretation of the relevant law, as well as guidance on how the ATO will administer the ATO view as expressed in the draft products,” the ATO said.

The ATO's further guidance in PCG 2022/ D1 specifically calls out children-parent arrangements. It is likely these types of arrangements will be targeted resulting in future penalties applying if the ATO conducts an audit. An example might

be where a beneficiary has a significant difference between their entitlement to taxable 'net income' and their 'trust income' in specific year (not that uncommon) and the ATO thinks the gap is contrived to pay less tax. Again, it will be important to have carefully documented reasons as to how the adult children are using these funds for their own personal use e.g., pay board, petrol, etc. Another area the ATO will be looking closely at is where a trust pays money to a company in a circular way between a Trustee that holds shares in a Company and then the Company is also a beneficiary that pays dividends to the Trust. The idea being the Company becomes entitled to trust money which the Trustee is really using for its benefit (and which the Trustee should instead be accumulating and paying tax at 47%). It is advisable that these arrangements cease immediately. Family trusts have always been in the firing by the ATO and more so since Labor limited the ability of trustees to distribute funds to minors. These new developments, whilst they might add another level of complexity for trustees, does not mean trusts hold no value. They are still a good vehicle for asset protection, and when set up correctly, with the right documentation in place, can still provide a good way of distributing funds to adult-children, and used for income-splitting purposes. Remembering Gary Cooper By Elwynne Kift

Today we farewelled Gary Thomas Cooper who was a tireless community advocate over many organisations and issues. His work for the neighbourhood was admirable work at the Heatherdale Reserve with strategically placed bird/ possum boxes was referred to the Federal Member ( Phil Barresi at the time) and he convinced him that the Federal Government should spend money on local environmental issues which happened. Gary never missed a "Clean Up Australia" Day until just the other day. Gary was the only person I know who could bring a Federal politician back from his holidays to chair a public meeting which addressed the noise, dust, and visual pollution along Heatherdale Rd. This happened in 2004 , with the beginning and formation of the Heatherdale Community Action Group. A march was organised against this pollution, and DID

Gary was always ready to give intelligent and well thought out advice- someone who had an unusual account with an electricity company was chatting over a coffee ( Yes- Beraldo’s in front of Coles at Ringwood Square ) and Gary investigated & went through two previous years as well- RESULT - He received a refund credit - and an apology! Gary's ability to asses a situation, whether in the Community or an organisation was exceptional. He was a Regional Branch Bank Manager in Townsville , when Cyclone Tracy hit Darwin and the National Bank mentioned that Darwin needed a bit of help, and so who else would they send , but Gary told me it was all good experience for him. Many might have wondered about Gary's e-mail address. He told me with that wicked

After Sue and Gary moved to Ringwood , it was only a short time until he was helping with organising activities within the village and on the Social and General Operations Committee. Many of the Village residents were present at Gary's service. Gary attended quite a few VCAT hearings for the Community and also appeared on the jury twice that I know of . He told me that he took copious notes both times. I am sure he did and that the other jurors would have had to be correct in their opinions. Gary was awarded the OAM in 2009 and today I listed the 19 organisations that Gary was involved with. The Financial Sector was represented by 2 people in the congregation and I was honoured to read their tribute His membership was from 1966- 2020 and was highly respected in this Union - having been President for 6 years from 1981-1987 and National Vice President from 1985- 1987. He was awarded Life Membership in 2005, and was a VIP in October last year , where he was feted as being one of only 2 members who had 34 years of membership! Many tradespeople are qualified to work at height as part of their occupation. They may use scaffold, EWP (Elevating Work Platform), rope access equipment, or even work on a high-rise rooftop with access via stairs or a lift. Regardless of how they get there, most of them will be aware of their surroundings, and will make every effort to keep themselves and those around them safe and try not to break anything in the process. Some will not have read their Public Liability Policy Wording, and will be unaware that the policy they purchased has a height limit imposed which they exceed without knowing. If they create a bodily injury to a third party or damage to third party property, and they are working above the insured height limit when the accident occurs, the policy will not respond. In other words, they become personally financially liable without the benefit of insurance that suits the activities they undertake in their business.

Gone up in smoke - $42m worth of illicit tobacco ceased and destroyed By Warren Strybosch

The ATO via “Operation Greyhound”, they have uncovered a large source of illicit tobacco in Koraleigh, New South Wales. The amount covering 24 acres, was estimated to be over 250,000 kilograms in weight, and worth a staggering $42m on the open market. The ATO undertook significant warrant activity with assistance from officers attached to the Murray River PD Rural Crime Team and the Proactive Crime Team from NSW Police Force. The ATO said that this outcome demonstrates their commitment to detecting, disrupting, and dismantling crime syndicates that grow illicit tobacco.

Businesses Fudging The Books Are Placed On Notice By Warren Strybosch

Have you ever gone to pay for something and wondered whether the money you handed over is being recorded correctly for tax purposes? Do you sometimes think, especially when they ask if you want a receipt or not, if the funds are being recorded in a way so as to avoid paying tax? Well, your thoughts might have some validity to them. The ATO has recently released PS LA 2022/1 Administrative penalties for electronic sales suppression tools. It provides guidance to ATO staff on the application and remission of the administrative penalties for producing, supplying, possessing and incorrectly keeping records using an electronic sales suppression tool (ESST). ESSTs are hardware or software tools designed and used to manipulate sales records, understate income and assist in avoiding tax obligations. The production, supply, possession and use of ESSTs contribute to the black economy and undermine the integrity of the tax system. What is an ESST? ESSTs are designed to interfere with electronic sales records; that is, they can falsify, manipulate, hide, obfuscate, destroy or prevent the creation of electronic sales records, often without an audit trail showing the interference. They can take various forms and are constantly evolving, but some examples include: • • •

software that deletes or modifies point of sale (POS) records storage devices (such as back-up drives) containing software that deletes or modifies records POS devices with software that deletes or modifies records.

Penalties apply for producing, supplying, possessing, and incorrectly keeping records using ESSTs, as well as aiding or abetting another to do so. If you discover an entity has possession of or is using an ESST, in addition to considering if a penalty applies, you should work with the entity to ensure that the ESST is removed so the entity will no longer engage in conduct that can attract a penalty.

Deciding whether something is an ESST To be an ESST, the tool must both be capable of interfering with a record and one of its principal functions must be to interfere with sales records. A modification or additional features added to a legitimate sales system can be an ESST, even if the device or program as a whole is not. Records are information in any format that explain an entity's transactions or other actions. Precisely what they are and what form they take depends on the circumstances. They generally include tax invoices, receipts and records of sales and all business transaction information. An ESST must be capable of interfering with records. Typically, a tool can interfere with records if it can: • • •

manipulate, falsify or delete the record of transactions renumber or recharacterise transactions interfere with records without showing an audit trail of the changes.

A tool passes the capability test for an ESST if it can interfere with a record that: • •

an entity is required by a taxation law to keep or make, and has been, or could be, created by a POS system which creates or feeds data into an entity's tax records.

You do not need evidence that the tool has been used to interfere with a record, just that it is 'capable' of doing so. Criminal prosecutions An entity that produces, supplies or possesses an ESST or uses an ESST to incorrectly keep taxation records may be liable for criminal prosecution. The ATO may seek prosecution of an offence by conducting a criminal investigation and referring the matter to the Commonwealth Director of Public Prosecutions. Example 1 - not an ESST - changes are recorded

Bellissima Beans Café Ltd buys a POS system for their new café. This POS system

includes a function to reverse and void transactions. The manufacturer states that this function is for correcting mistakes and generating refunds. The POS system records all changes to transactions in its history log. It produces a receipt and marks it as a void transaction. All receipts have sequential transaction numbers so any void transactions with missing receipts can be identified. Although this function gives Bellissima Beans Café Ltd the ability to delete and reverse transactions, the POS system creates an audit trail, so a reasonable person would not conclude that one of its principal functions is interfering with records. The POS system is not an ESST. Example 2 - possession of an ESST - full remission

The ATO conducts a routine audit of a bookstore owned by Book Worms Pty Ltd (Book Worms). Bob is the director of this company and runs the bookstore. During the audit, a hidden function within the system allows sales transactions to be deleted or manipulated without leaving a record of the original transaction. As a reasonable person would conclude that one of the primary functions of this system is to interfere with sales records, it is an ESST. Bob is surprised to discover that his system has an ESST and explains that he had no idea that it was there. He had bought the bookstore from Keanu in March 2017, who had not mentioned that there was anything unusual about the business or the equipment. He explains that he had not used the ESST and contacts his POS system supplier immediately to ensure ESST capabilities are removed. At the conclusion of the audit, no evidence was found that the ESST had been used to alter any of Book Worms' business records. The audit did not result in any amendments to Book Worms' income tax returns or BASs. Book Worms has a good compliance history. Notwithstanding the above, Book Worms is liable to an administrative penalty of 30 units for possessing an ESST. It does not matter that Book Worms came into possession of the ESST before the legislation was enacted.

The Marketing of Infant Formula: a US$55 Billion Industry •

The International Code of Marketing of Breast-milk Substitutes, (the Code), is an international health policy that was developed forty years ago and published by the World Health Organization in 1981. It is an internationally agreed voluntary code of practice intended to regulate the marketing of breastmilk substitutes, and protect mothers from aggressive marketing practices. The Code was written in response to the marketing activities of the infant feeding industry which were promoting formula feeding over breastfeeding, in turn leading to dramatic increases in maternal and infant morbidity and mortality. The underlying basis for the Code is the belief that the health of babies is so important that the usual rules governing market competition and advertising should not apply to products intended for feeding babies. Therefore, all Governments should legislate to prevent commercial interests from damaging breastfeeding rates and the health of their population. The Code is intended to be an integral tool to help protect babies’ rights, enabling families to make infant feeding choices free from commercial influence and with full understanding of what is in their child’s best interest. It helps give babies the best possible chance to grow, develop and flourish in their critical foundation years. Unfortunately, the circumstances that necessitated the creation of the Code are still relevant and constantly evolving. In 2022, the WHO reported that the global infant formula market is now worth approximately US$55 billion annually. According to Dr Mary-Anne Land, of the Public Health Association of Australia, “Forty years on formula marketing still represents one of the most underappreciated risks to infants’ and children’s health. Scaling up breastfeeding could prevent upwards of an estimated 800,000 deaths of children under five and 20,000 breast cancer deaths among mothers each year. Despite the Code, formula companies continue to violate principles established by these international agreements, putting sales and shareholder interests before infant and population health.”

• A recent WHO/UNICEF report into the marketing of infant formula shows that half of parents and pregnant women (51 per cent) surveyed say they have been targeted with marketing from formula milk companies, much of which is in breach of international standards on infant feeding practices. The report – How marketing of formula milk influences our decisions on infant feeding, finds that industry marketing techniques include unregulated and invasive online targeting; sponsored advice networks and helplines; promotions and free gifts; and practices to influence training and recommendations among health workers. The messages that parents and health workers receive are often misleading, scientifically unsubstantiated, and violate the Code. What is covered by the Code? All breastmilk substitutes are covered by the Code. The definition for a breastmilk substitute is any food being marketed or otherwise presented as a partial or total replacement for breastmilk, whether or not suitable for that purpose. This may include: • • • • •

infant formula; follow on formula; infant milks marketed as food for special medical purposes (FSMP); baby foods; bottles/teats and related equipment.

The Code prohibits all promotion of milks and equipment related to bottle feeding and sets out requirements for labelling and information on infant feeding. Any activity that undermines breastfeeding also violates the aim and spirit of the Code. The Code and its subsequent resolutions are intended as a minimum requirement in all countries, and are written into the United Nations Convention on the Rights of the Child. Manufacturing companies may not: • promote their products in hospitals, shops or to the general public;

give free samples to mothers or free or subsidised supplies to hospitals or maternity wards; give gifts to health workers or mothers; promote their products to health workers: any information provided by companies must contain only scientific and factual information; promote foods or drinks for babies; give misleading information; have direct contact with mothers.

This requirement is intended to restrict the influence of commercial interests related to infant feeding and to protect breastfeeding as the healthiest option for mothers and their babies. It does not in any way prohibit the provision of factual information about bottle feeding or introducing solid food, or require that mothers who bottle feed be denied information or care. It is intended to ensure that all parents, whichever way they feed their baby, have access to accurate and effective information free from the influence of marketing campaigns designed to protect profits rather than babies. Dr Land goes in to say, “Manufacturing companies often present themselves as philanthropic partners in the fight to protect and improve maternal and infant health. In reality, like all other commercial companies, they exist to increase shareholder value by maintaining and increasing profit. For companies manufacturing formula milks or other baby foods, this means selling as much of their product as possible. To do this, they need to persuade parents to formula feed rather than breastfeed, to choose their formula milk rather than a competitor’s, and to use their brand of baby food as early and as much as possible.” In Australia, the principles of the Code are put into effect through the Marketing in Australia of Infant Formulas: Manufacturers And Importers Agreement (MAIF Agreement). It is Australia’s response to the Code but it is only a voluntary, selfregulatory code of conduct. In Australia, the Code is not legally enforceable and the MAIF Agreement contains weaknesses. Various health groups have strongly advocated that Australia needs to enforce the Code and subsequent resolutions under Australian law. Formula milk marketing, not the product itself, disrupts informed decision-making and undermines breastfeeding and child health.

All clubs at some stage or another lose members and it is important for the person leaving the club to let them know why they are leaving. We acknowledge that there are a number of reasons: • • • • • • •

family commitments health retirement from playing sport moving out of the area unhappiness – major disagreements offered more money to play at another club new challenges

It is possible that the member has decided to leave because they have had a dispute with someone at the club – a member of the board or a selector and they no longer trust how the club is being run.

Whatever the reason your club needs to know you have decided to move on. It may be a problem that the club is not aware of or a problem that has existed for some time and has gone unresolved. If you are thinking about leaving your club make sure you really want to leave and finish up regretting your decision. Find the time to talk someone at the club – the president, board member, club secretary and discuss your concerns and reasons why you are planning to leave BEFORE you let other members of the club know what you are planning to do. If the club is aware of your problem give them time to investigate and if it is resolved to your liking then you can happily put your plans to leave to rest.

On the reverse side if your complaint or concern is not resolved write a resignation letter to the secretary of the club detailing the reason or reasons why you are leaving. Membership is the backbone of every sporting club and retaining members should be a key objective because we all know how hard it can be recruiting new members. Before moving on think about it – do you really want to part company and start all over again at another club – its your decision.

Tourists arriving in Australia for the first time in two years are being reminded to “declare or beware” when it comes to their luggage.

Home Affairs Minister Karen Andrews says the operation began in November 2021 and by December it was already achieving results.

Agriculture Minister David Littleproud says officers intercepted four items that could have “significant impact” on Australian agriculture, brought in by passengers on one of the first planes to arrive at Brisbane airport after the ban on international flights was lifted. He told a media conference on Monday the pork product, honey and seeds were all declared and no fines were issued. But he says border force officers have been told to use the full force of penalties – a maximum fine of $2664 and visa cancellation – if people fail to declare items. International students can now also have their visas cancelled for breaching biosecurity laws. “Welcome to

Australia, but declare or be aware you will get picked up,” he said. Meanwhile supply chain criminals are being targeted at Australian border points as officials ramp up efforts to detect and stop illegal activity. COVID-19 $450 payments to cease. By Warren Strybosch

The Andrew’s government will cease paying the $450 payment to Victorians whilst they await their PCR test results, as rapid swabs make the system obsolete. The state government announced its test isolation payment will end with demand reducing as rapid antigen tests become more widely available. Industry Support and Recovery Minister Martin Pakula said Victoria was entering a new phase of managing the pandemic and the program was no longer necessary. "The recommended testing method has changed with rapid antigen tests providing results within minutes and eliminating the need to miss work while waiting for test results," Mr Pakula said. More than 1.2 million payments worth about $545 million have been approved since the system began in July 2020 during the state's devastating second wave of COVID-19 infections. Payments will still be available for Victorians who have to self-isolate, quarantine or need to care for someone in self-isolation or quarantine under the federal government's pandemic leave disaster payment.

2022 TA Temporary full expensing of depreciating assets The majority of businesses are eligible to claim an outright deduction for the cost and installation of new assets. To qualify for full expensing, the asset must be first held and first used or installed ready for use between 7:30pm AEDT 6 October 2020 and 30 June 2023. This final date of temporary full expensing was extended by 12 months from a 2021 Federal Budget announcement and is now law. Unlike prior rules on instant asset write-offs, no limit applies to the cost of an asset under the full expensing rules. That is, an asset of any value may be fully deducted in the appropriate income year. For a business to qualify for the outright deduction, the entity must have an aggregated turnover of less than $5 billion. Certain large entities

Downsizer contributions to superannuation Downsizer contributions have been available to members of complying superannuation funds since 1 July 2018. From this date, a person aged 65 years or older has been able to make a contribution up to $300,000 from the proceeds of selling their main residence. Gluttony takes over Croydon this April From Wednesday 6 April to Sunday 10 April 2022, Croydon Park will be transformed into a feast for the senses for lovers of the arts, food and wine, aptly named ‘Gluttony’. Gluttony at Croydon Park will be a condensed version of its Adelaide counterpart, squeezing the best acts, food and festivities into a five-day extravaganza. Cr Mike Symon, Mayor of Maroondah, is thrilled to add Gluttony to Maroondah’s diverse arts and entertainment calendar for 2022. “We are so excited to announce that Maroondah is the first Victorian Council to host Gluttony,” Cr Symon said. “Gluttony will be a fabulous opportunity to have a widely popular, national, one-of-a-kind experience in our own backyard.

Gluttony’s history Popping up annually in Adelaide’s east parklands since 2011, Gluttony has cultivated a reputation as being one of the top events of the Adelaide Fringe Festival. In addition to the 130+ fabulous Fringe acts that perform, Gluttony also hosts dining precincts that offer a diverse range of delicious cuisines, bars serving fine wines, local beer and topshelf spirits, family-friendly activities, interactive installations, and multiple areas to relax in their open-air party in the park. Gluttony is currently in full-swing in Adelaide, opening its doors and tent on Sunday 18 February. The festival will wrap on Sunday 20 March and will then pack up and truck itself over to Croydon.

“Every ticket purchased supports artists, arts workers and the arts and events industries, which are critical to the creative spirit and progress of our Council and indeed our festival state,” he said.

New Pavilion Boosts Membership Interest For User Groups

On Thursday 17 February, the new Springfield Sporting Pavilion was officially opened by Cr Mike Symon, Mayor of Maroondah and Sonja Terpstra, Member for Eastern Metropolitan Region, representing the Minister for Community Sport, the Hon. Ros Spence. Maroondah Councillors, sporting club members and members of the community were also in attendance. The redevelopment of the old Springfield Hall and change rooms was a $4 million project, with support from the Victorian Government. Beginning in October 2020, the redevelopment included female-friendly player and umpire change rooms, a firstaid room, equipment storerooms, accessible shower and toilet amenities, match-day public toilets, ground floor covered spectator viewing area, foyer and lift, a 200 m2 multipurpose space, kitchen and bar, meeting room, office and storerooms. Cr Mike Symon, Mayor of Maroondah, said one of the highlights of the new pavilion was the accessibility elements. “This brand-new building has been designed to be accessible for all. “It boasts accessible shower and toilet amenities, change rooms and large windows for game visibility no matter the weather,” Cr Symon said. The works are a welcome update for the sporting and community clubs that are based at the Springfield Pavilion. “Springfield is home to the Croydon Rangers Gridiron Club, is utilised as the training facility and function space by the Eastern Football Netball League (EFNL) Umpires Association and is also used by U3A Croydon who I’m sure will enjoy these facilities for many years to come.

The redevelopment involved demolishing the old Springfield Hall, redeveloping the carpark and creating new footpaths around the pavilion. The new structure was then built offsite in sections, craned in and erected in quick succession. This style of construction minimises the impact onsite for both users and surrounding residents, meaning that the brand-new facility was ready to use in a much quicker timeframe. Croydon Rangers Gridiron Club President, James Arthur, said the club have called Springfield home for over three decades. “We are already reaping the rewards that the new Springfield Pavilion is offering the Croydon Rangers Gridiron Club. Limericks are nonsense poems that take their name from nonsense poetry that originated in – yes, you’re right - Limerick, Ireland. And now, as a senior, you will recall how limericks revitalized those (otherwise boring) long car trips when you were a child. This competition enables you to revisit those childhood memories. Limericks are five line poems with a strict meter, and as they are easy to construct, they have been frequently written for children. Their simplicity and singalong rhythm have also made it easy for drunkards in pubs to write rhyming slang, frequently with sexual content. Which has enabled this art form to persist down through the ages. They went into literature when Edmund Lear published a collection titled “A Book

of Nonsense” in 1846. It’s never been out of print ever since. Here’s an example of his work: “A delighted incredulous bride “Said to the groom at her side “I never would have believed “Until right now dear sir “How our anatomies would so coincide.” And here’s another example of how easy limericks are to construct: “Here’s true history from the crew, “We found a mouse in the stew, “Said the waiter, don't shout, “And wave it about, “Or the rest will be wanting one, too.” There are many hobbies, past-times and

interests that are available to seniors during daylight hours (for example you would develop new friendships when you join a charity that prepares meals for the homeless). Then on weekends you could assist as a volunteer in a project where everyone else is still in the workforce – I’m thinking of an outdoors miniature railway society. The Downsizer Contribution – An Easy Way To Get Money Into Super FINANCIAL PLANNING By Warren Strybosch

If you have reached the eligible age, you may be able to contribute up to $300,000 from the proceeds of the sale (or part sale) of your home into your superannuation fund. From 1 July 2022 the eligible age is 60 years old or older. Prior to this it is 65 years old or older. According to the ATO, this downsizer contribution is not a non-concessional contribution and will not count towards contributions caps. The downsizer contribution can still be made even if the contributor has a total superannuation balance (TSB) greater than $1.7 million. Important points to note: • The home must in Australia, have been owned by you or our spouse for at least 10 years and the disposal must be exempt or partially exempt from capital gains tax (CGT) • You have not previously made a downsizer contribution to your super from the sale of another home or from the part sale of your home. • Prior to (or at the same time) as making your contribution you must provide your fund with the ‘Downsizer contributions into super form.’ • A downsizer contribution will not affect the TSB until this is recalculated to include all contributions, including downsizer contributions, on 30 June at the end of the financial year. • The downsizer contribution will count towards the transfer balance cap, currently set at $1.7 million. This cap applies when superannuation savings are moved into retirement phase. Downsizing contributions can only be made for the sale of one home and cannot be accessed again for the sale of a second home. • Downsizer contributions are not tax deductible and will be taken into account in determining eligibility for the Age Pension.

• If the contributor sells their home, is eligible and chooses to make a downsizer contribution, there is no requirement to purchase another home. Source: ATO.

Timing is key One of the key areas to note is timing when considering this strategy. You must make the downsizer contribution within 90 days of receiving the proceeds from the sale of your home to your respective super fund. Generally, this would mean 90 days from settlement. You can make multiple contributions from the sale of the primary residence, provided they do not total more than $300,000 each. Downsizer contributions form part of your tax-free component within superannuation and will be taken into account for determining eligibility for the Age Pension (whereas the value in the main residence is exempt). You do not have to have lived in the home for the entire ownership period. So long as you are claiming at least a partial exemption from capital gains tax [CGT] under the main residence exemption, your property meets the main residence criteria for a downsizer contribution.

9 tips to consider Tip 1 — Date of contract of sale Be aware of the date your client entered into the contract of sale to sell their home. A downsizer contribution is only available where the contract of sale for an eligible property was entered into on or after 1 July 2018. Tip 2 — 10-year ownership interest You must have held an ownership interest in the home being sold at all times during the 10-year period prior to the sale. Tip 3 — Age-based considerations An individual must be aged 60 years or older when they make a downsizer

contribution to superannuation. Interestingly, there is no upper age limit, so a downsizer contribution may be available to an individual well over the age of 65 who never had the opportunity to contribute to superannuation. Usually, any contribution to superannuation made on or after an individual’s 65th birthday requires the work test to have been met. However, a downsizer contribution can be made irrespective of an eligible individual’s work status. Tip 4 — Contribution amounts The amount you can contribute is limited to the lesser of $300,000, or the total capital proceeds you receive from the sale of your interest in the home. If you are a couple with joint ownership in the home, then you would be eligible to each contribute up to $300,000, resulting in a total downsizer contribution of $600,000. Tip 5 — Contribution timing Eligible individuals must make a downsizer contribution within 90 days of the change of ownership on the eligible property. In most cases, this will be 90 days from the date of settlement, unless an extension has been granted. You can make multiple contributions from the sale proceeds of the one eligible home within the 90-day eligibility period, so long as the total contributions do not exceed the lesser of $300,000, or the total capital proceeds received from the sale of your interest in the property. Tip 6 — Downsizer contribution form The contribution needs to be accompanied by the downsizer contribution into superannuation form either when making, or prior to making the contribution to superannuation. Tip 7 — Age Pension entitlements Age pensioners need to carefully consider how a downsizer contribution may impact their Age Pension entitlement. While the value of an individual’s home is means test exempt, the value of their superannuation interests, both in accumulation and

pension phase, are means tested when determining eligibility for the Age Pension. Eligible age pensioners may find a downsizer contribution indirectly impacts their Age Pension entitlement, however any additional amount they now have in superannuation as a result of the contribution could be used to further support their retirement income needs. Tip 8 — Estate planning perspective A downsizer contribution is a new type of after-tax contribution to superannuation and, therefore, will not count toward an individual’s non-concessional contribution cap. Any amount contributed will form part of the individual’s tax-free component. From an estate planning perspective, the tax-free component would not attract tax if a death benefit lump sum was paid to non-tax dependants such as independent adult children. Tip 9 — Transfer balance caps While an individual’s TSB can limit their ability to make certain additional contributions, most notably nonconcessional contributions, eligibility to make a downsizer contribution is not impacted by their TSB. However, an individual continues to be restricted to only moving a maximum of $1.7 million to retirement phase under the transfer balance cap (TBC). Should your client have already fully utilised their TBC, any additional contribution to superannuation under the downsizer measure would remain in accumulation phase. Extension of time In some circumstances, contributors might be able to request a longer period for making a downsizer contribution, for instance, when a delay has been caused by factors outside their control. However, an extension of time will not be granted to allow an individual to meet the age requirement. According to the ATO, an extension of time should be requested before the 90-day period from the date of settlement has expired. If a contributor has overlooked the 90-day timeframe, an extension of time may still be granted due to, but not limited, to: • • •

ill health death in the family moving house.

ATO example of an extension being granted Ben, aged 77, decides to sell his family home of 15 years. Settlement occurs on 1 August 2018. He purchases a new home in a retirement village, which is due to settle on 1 October 2018. The retirement village has only just been built, and Ben’s settlement is delayed until 1 December 2018 while final council approvals are obtained. Ben does not want to contribute funds from the sale to his superannuation until after the settlement of his new property to ensure he has enough money to purchase and move into the property. Upon his request, the ATO gives Ben an extension of time to contribute until 1 February 2019. This extension allows Ben enough time to settle on the new property and make a contribution of the remaining money from his sale. Ben can afford to contribute $200,000 to his superannuation fund after the sale and makes this on 25 January 2019. Source: ATO. Conclusion The benefit of the downsizer strategy is that there is no requirement to meet a work test to make this contribution. This is beneficial for clients aged between 60 and 74, but it is even more appealing for clients aged at least 75 who may still wish to contribute to their superannuation – whether they are still working or not. Not only is this a great advantage of the downsizer strategy, but so is the fact that it does not matter how much a client already has in superannuation. The total superannuation balance threshold of $1.7 million that would normally preclude an individual from being able to make further nonconcessional contributions does not apply for downsizer contributions.

Answer: Yes. A client can make a downsizer contribution as an in-specie transfer of assets, provided the value of the transfer does not exceed $300,000 or the total capital proceeds received for the property sale. The ATO have confirmed this in LCR 2018/9 and provide the following example on their website: Alisha has a portfolio of listed shares worth $150,000. She sells her home for $500,000. As Alisha meets all the other requirements, she can make a downsizer contribution of up to a maximum of $300,000 using a combination of her shares and cash. Remember, the downsizer contribution must be made within 90 days of receiving the sale proceeds and any transfer of shares from individual ownership to super will trigger a CGT event and capital gains tax implications may apply.
