Probate v. Non-Probate: What Is the Difference? By Christian Dribush

When planning your estate it is important to understand the difference between probate and non-probate assets. Probate is the process through which a court determines how to distribute your property after you die. Some assets are distributed to heirs by the court (probate assets) and some assets bypass the court process and go directly to your beneficiaries (non-probate assets). The probate process includes filing a will and appointing an executor or administrator, collecting assets, paying bills, filing taxes, distributing property to heirs, and filing a final account. This can be a costly and time-consuming process, which is why some people try to avoid probate by having primarily non-probate assets. Probate assets are generally assets that are owned solely by the decedent. Probate assets can include the following:

Greetings! Despite the cold weather, we are thinking ahead to warmer days when we will once again be outside enjoying what our community has to offer. The Castleton-on-Hudson Main Street Association (COHMSA) has been planning some great initiatives and events for 2018 that will take advantage of being outdoors. We would like to share some updates on one of them with you. In the last edition of Our Towne, we mentioned the Main Street Mile and, although we did not get the grant we were seeking, we are pushing ahead as determined as ever. The Main Street Mile is a 1.0-mile walking loop along the sidewalks of Main Street which will take participants approximately 20 minutes to complete. The route will be marked by permanent signs and stencils along the sidewalks between Stimpson and Seaman Avenue. Check out our website (www.castletonmainstreet.org) where you can see a draft map and some additional information. The objective of the mile is to encourage healthful walking while exploring businesses and the character of Main Street. We hope to engage our community walkers and others who may not have considered walking Main Street previously. There is a lot of excitement on Main Street and you must check it out for yourself! There is no better way to see and experience what is going on than by slowing down and taking a walk. Currently we are in the planning stages of designing the loop which includes the path, sign locations, and sign images. Our next steps are finalizing the route and getting village approvals. Then we will be moving on to the design of the signs. Before we can bring this project to the street, we will be making a push to seek donations for the purchase of the signs. To launch the Main Street Mile, we are planning a Kickoff day in late April. Stay tuned for more information as we get closer to the date. Kinderhook Memorial Library The Kinderhook Memorial Library began its 90th year of service by electing officers and seating a new Board member at its organizational meeting on January 8, 2018.

For the tenth year, Gary Spielmann and Karen Vecellio were elected as Board President and Vice President, respectively. Dorothy Balko was re-elected Board Secretary, and Michael Leonard was chosen as Board Treasurer. The Board also elected Bernadette Powis as a Trustee on the 15-member body. Spielmann noted that the full Board has a combined total of 133 years of service to the Library, or nearly nine years per Trustee. In addition, two of our veteran Trustees, Jim Tuttle and Mark Wilson, have served (Tuttle) or will serve (Wilson) as President of the 66-member MidHudson Library System. “The Library is very fortunate to have a seasoned, talented, and dedicated board to guide it this year,” Spielmann said “2018 promises to be an extraordinary year as we construct and occupy our new Library addition, which will more than double the size of the existing building. Our Reading Porch, which opened a year ago, has been well received and is in great demand. Our Phase 2 addition will contain new program space, enlarged collection for children, teens, and adults, a community meeting room, and be fully handicapped accessible. It will also feature advanced multi-media technologies for learning and enjoyment.” In 2017, visit to the Library totaled 64,148, website visits were 22,961, and there were 12,363 internet sessions. Library Director AnnaLee Giraldo also reported there were 207 new patrons added to our rolls. “We are in the final stage of our Capital Campaign, which has raised over $2.2 million towards our goal of $2.3 million,” Spielmann said. “A limited number of naming opportunities are still available. Pavers in two different sizes are on sale and can be etched with donors’ names or names of loved ones. They will be displayed in the outdoor plaza outside the large community meeting room and the children’s library. “Interested parties may pick up a form at the Library, or can print one from our Campaign website: http://www.kinderhooklibrary.org/capitalcampaign/campaign-updates/purchase-a-paver/” Spielmann concluded.

February 2018 Dear Our Towne Readers, Surprise! I know you’re used to hearing from the actual publisher of Our Towne Magazine, Jennifer Felts, but this month I, Allison Felts, am the guest Editor in Chief! I know the Our Towne readers have heard about me before from my Mother’s editorials... but for those who don’t know, I am 17 old and currently a Senior at Maple Hill High School. As I start to prepare for my future in business marketing & public relations, my Mom thought it would be a good idea for me to gain some experience (also because someday she wants me to create my own Our Towne). So, as she is busy finishing ads for the magazine, I’m helping her by writing the February Edition editorial. Through the years, I have seen my mom be the cheerleader for local businesses. I have learned so much from her, and I am so proud of her and all of the success & joy she has brought to her advertisers. I have learned that owning your own business is hard, and I am impressed from every Our Towne story I hear. I had the pleasure for working for a small business this holiday season. My experience at The Gallery, at Capital Sawmill, was like no other. Teresa Eddy and Steven Daniels were fantastic to work for! There is no denying that purchasing a home is one of the biggest thrills of your life, but it can also quickly become overwhelming. While the home you choose may appear to be the perfect house, hiding underneath the dream could be serious unknown defects that can make your investment a costly one.

Enter the home inspector. A home inspector performs a physical inspection of the structure and systems of your prospective home. This means that while you may love the beauty of the living room’s wood floors, your inspector can tell if the floor will truly last.

The home inspection is an objective visual examination of the physical structure and systems of a home, from roof to foundation. The inspection will determine not only the condition of the home, but also help foresee any immediate unnecessary additional cost that may go unnoticed by the untrained eye.

Home inspections start at around $300 depending on the size of the home, its age and overall condition. Its money well spent if you are serious about that particular property. According to the American Society of Home Inspectors (ASHI.org), the standard home inspector’s report will cover the condition of the home’s heating system; central air conditioning system (temperature permitting); interior plumbing and electrical systems; the roof, attic and visible insulation; walls, ceilings, floors, windows and doors; the foundation, basement and structural components. Compare a home inspection to getting a physical from your doctor. When problems or symptoms of problems are found, the inspector may recommend further evaluation or remedies. A home inspection summarizes the condition of a property, points out the need for major repairs and identifies areas that may need attention in the near future. The inspection will show the positive and negative aspects of a home, as well as the maintenance that will be necessary to keep it in good shape. After an inspection, both parties have a much clearer understanding of the value and needs of the property. Before any sale is complete, you will need an inspection to look over the good, the bad and the ugly of what your new home really offers. Remember, even if a house needs repairs or has hidden problems, it should not always be the catalyst for getting out of a sale. No house is perfect and as long as you know ahead of time what needs to be done and can possibly change the purchase price based on the information, the home inspection will give you a great starter list of what needs to be done to really make moving in that much easier. Homebuyers are not the only people who can hire an Inspector. Home sellers also use inspectors to gain knowledge of the condition of their home before placing it on the market. Know the condition of your home and be better prepared to acknowledge or correct problems before placing a home on the market

Stephanie Daly Refried Beans ala Instant Pot Ingredients2 lbs dried pinto beans, rinsed/sorted 5 slices of bacon, cut in small pieces 1 onion, diced 5 garlic cloves, minced 2 jalapeno, seeded and minced 2 teaspoons dried oregano 2 teaspoons ground cumin 2 teaspoons chili powder 1/2 teaspoon ground black pepper 3 tablespoons butter or vegetable shortening 4 cups unsalted chicken broth, or vegetable broth 4 cups water 2 teaspoons sea salt Optional- sour cream, diced onion, shredded cheese, crispy bacon DirectionsSoak beans for half an hour. To the Instant Pot bowl, add the bacon and sauté. Add onion, garlic cloves, jalapeno, and continue to sauté. End sautéing. Then add dried oregano, ground cumin, chili powder, ground black pepper, butter/oil, chicken broth, and water. Stir. Use a colander to strain the beans and discard the soaking liquid. Rinse with fresh water. Now add the beans to the Instant Pot bowl, and stir all of the ingredients together. Place the lid on the Instant Pot and ensure the steam release valve is set to sealing. Press the “Bean/Chili” key, which will show 30 minutes of cooking time, and increase the time to 45 minutes. When the Instant Pot is done cooking, it will come down from pressure naturally, about 40 minutes. When the pressure is released, open the lid of the Instant Pot and add the sea salt to taste. I am using my immersion blender to blend the beans to the desired consistency. The beans will appear soupy, but will thicken as they cool. Add shredded cheese as you like. Enjoy! Q. Why does my eye exam take so much time? A. If your eye exam is taking more than an hour, you’re

most likely having a dilated eye exam. During your dilated eye exam, both of your eyes will be inspected for any signs of vision problems and/or eye diseases such as glaucoma, macular degeneration, diabetic eye disease and cataracts. The view to the back of the eye is limited when the pupil is not dilated, so the dilated eye exam is a very important part of preventive eye care. In order to dilate your eyes, we use special drops. The dilation eye drops may take approximately 15-30 minutes to begin working. However, if a patient has a serious eye disease, such as glaucoma, and is taking medication, their eyes may take up to an hour to dilate. Once your pupils are dilated, your eye doctor will then look in with a bright light and use special instruments to see various parts of the eye. You’ll be asked to look up, down, left and right while the exam is being performed. This allows your eye doctor to see completely inside your eye including the macula, retina, blood vessels and optic nerve. Whether you need to have a dilated eye exam depends on your age and your health. If you have diabetes, it is especially important to have an annual dilated exam. We recommend most adults have a dilated eye exam every year in order to detect and treat eye conditions that could potentially lead to vision loss.

I can so clearly remember all the way back to the first time I was pregnant. I was one of those people that really loved being pregnant and other than a little reflux, I didn't have any major complaints. The realities of swollen feet in the summer and my expanding image, made me complemplate a lot more than complain. Only at the end, with the never ending “groundhog days” of “when the heck is this going to be over?” Or the “Is the bag in the car?” or “Listen boss, I’m staying put until you have to mop up around me”, did it got a little frustrating.

It boiled down to the WAITING. I’m just not that patient. In the same way I’m not a good gift receiver. If I want it I usually just go get it, so don’t buy it for me. Parenting is SO NOT LIKE THAT. You don’t get what you want, when you want it.

So, whether you’re antsy like me or tried to really love every minute, there was that constant message from those more experienced, who’ve been there before, sharing their wisdom to “appreciate every minute”, “absorb the nuances” & BE PRESENT. Easier said than done.

Flash Forward 17 years. I’m now sitting very apprehensively on the other end of that funny spectrum of participation and being present. With Nathan about to graduate high school, everything we do falls under this crazy umbrella of “this could be the last time we do this together as a family” and find ourselves saying things like “Next year this will be different”. I admit, I’ve been very caught up in the whirlwind of his junior and senior years, with the testing, and applying and planning. I know, I know. It was my choice to participate like this. Well, consider it a parting gift. Some parents I know were like, “It’s their future, they can do it, if they really want it”. However, I found myself thinking, that if this next stage, this college experience, could potentially cost more than my house and it’s this important of a decision, then I’m definitely participating in the process, and Nate was good with that. There is no right way to help your kids grow up. What is working for us, might be vastly different from your experience. Quite frankly, I'm pretty sure what worked for my #1 will not work for my #2 (AT ALL), just to make it interesting, I suppose. So, here we are in February of his senior year and all I can really do is reflect that the applications are all in, the essays are all written, the schedules are all made, the sports are all played, the time has come to simply wait. BUT, remember? Some of us wait a whole lot worse than others. Like me. (Raise hand) I’m frustrated and antsy, sitting in anticipation of what will be…..and finding it very hard to be present. Caught in this plan for tomorrow and live for today. It’s unsettling. Kind of like expecting him to be born on his due date, yet having to wait those excruciatingly long days until to real event. Even then he waited 24 hours and they had to go in and get him. He’s in no hurry. While I may be a little intense when it comes to his future, I know that it will all ultimately lie in his hands. When I check my own ego at the door, we can stand back and look at this young man and be proud of the work we have done. Plus, surveying the general population around me, I have to admit that most folks figure it out, regardless. I suppose he will, too. So, I’ll try to be patient, and try to not hover, but I will make a big deal of every LAST thing, because you never know. PS...update: at the writing of this article, Nate has received several positive responses from his applications. He’s looked up from his Instagram feed for a brief second, and even paused the Netflix show of the moment to celebrate. I’ve jumped for joy. At least now know that the Spring will be filled with the details of decision making. WOO HOO!

Your Financial Goals for 2018 By Tom Kubiak, EA

"Those who do not remember the past are condemned to repeat it." -George Santayana There is a big problem with many peoples' financial resolutions: They don't usually last even until the end of January. But the ones I'm about to recommend to you here can, because they're incremental AND anyone can do them. Making a permanent change in our behavior requires both time and a steely resolve. But if we attack these things on a step-by step basis, I've found that we can develop financial character one action at a time. So in that vein, here are some things you can do, in a sequential order, that will make a huge difference in your financial year. If you've already got one down, check it off, and move to the next on the list. 1) EVERYONE START HERE: Resolve to become (and stay) debt free. Now, clearly I'm not Dave Ramsey, but there's a reason why he's become so popular: his approach works. So, as a start, I'd say that you can have a fixed-rate, fixed-year traditional mortgage on your house -- but shoot for nothing else. No HELOC. No car payments. Certainly no credit card debt. Because you simply have to learn to live within your means -- which, unfortunately, sometimes means going without. The millionaires among us really are frugal. You can learn to enjoy the process of chipping away at your debt, and it's truly the best and first place to start. 2) Automate your savings (i.e., Pay Yourself First). Does your company offer a 401(k)? Get the entire match. Usually this translates to saving 5% of your salary while the company contributes a 4% match, which is the fastest way to get an 80% return on your money. Most Americans forgo this match, believing they need to spend 100% of their salary. But you can learn to think like a millionaire and live well on 95% of what you make. If you don't have a 401(k) plan, act like you do, and sock away 5% automatically. Or talk to your employer about different company savings vehicles. 3) Fully fund your 2018 Roth IRA. This is $5,500 in 2018 and $6,500 if you are older than age 50. And if you can't manage the entire amount in January, it equates to a $460 monthly savings. Automating these savings plans are relatively painless -- it's the living without after the fact which seems difficult ... until it isn't. Set your savings on autopilot, and pat yourself on the back. Remember -- these steps build off one another, so if you already have done the first 3, here's your next step: 4) Save another 5% in a taxable investment account. Automating savings is great, automating investment is even greater. Key word here: automate. At this point, you're hitting a mark of saving 15-20% of your income. That's a fast-track to long-term prosperity. In terms of WHAT you invest in, there are many great options. Index funds are a great place to start, but every person's situation is slightly different here . And so, yes: These are the basic, first steps. In January, we welcomed Dr. Caley Barile to the practice as our new associate Also, we’re the new dentist for the patients of Dr. Gary Moscowitz, who retired in December after 30 years in the community. We not only welcomed Dr. Barile, but also the staff from Dr. Moscowitz’s office so when you visit you’ll see Darlene & Jess too!!! TELL US A LITTLE MORE ABOUT DR. BARILE. She’s very intelligent, having graduated from both the prestigious University of Pennsylvania Dental School & Binghamton University. She is also native to the Capital District and graduated from Guilderland High School and wanted to return to her roots after a 7 year stint in the lower Hudson Valley. She’s married to Frank and is a devoted mom to 2 young children. We both love being dentists but agree that our first job is as a parent. Having a career that allows us to do what we love and still volunteer at school, coach sports and spend time with family really makes us happy. She is also a “comprehensive” general dentist - meaning - we do all aspects of dentistry, from first visit to last. Plus, Dr. Barile is also a preferred Invisalign provider and does a lot of her own surgery and root canals making the experience simpler for patients. We spend an hour with our new patients, getting to know them a little because taking the time in the beginning sets the stage for a great doctor/patient relationship that is built on trust and confidence. WHAT ABOUT THE OFFICE? I’d like to say Lapinski Dental is not your typical dental office. Patients often comment how friendly everyone is, from the assistants to the hygienists and of course the reception staff. We all hold ourselves to high levels of customer service and I know that it shows. I’m also very committed to investing back into the office. I renovate rooms and upgrade technology regularly. This year we have a new treatment room and an improved parking lot. I’m always looking for tools that help me be a better dentist and help the patient have a better experience. Whether it’s digital impressions, eliminating the need for messy molds, or digital xrays – reducing exposure to radiation and improving our ability to diagnose dental conditions. ANYTHING ELSE? This experience is more than I ever imagined. I have the absolute best patients in the world and through their kind referrals and word of mouth, we have continued to make a positive impact in our community. Choosing to practice here, have my kids grow up here and help folks smile here was one of the best decisions I’ve ever made. I couldn’t ask for anything more. Well, other than for you to come meet us in 2018!

Southern Rensselaer County Rotary Community Recognition Awards Adults and young people from across the local spectrum were honored at the recent 2nd annual “Community Recognition Awards” dinner sponsored by the Southern Rensselaer County Rotary Club. Human foods can be bad news for pets The holiday season is over, but don’t drop your guard with food for your pets. Our dogs and cats cannot always eat the same foods as we can and feeding human foods to pets can pose a health risk. Here’s a reminder for those items that require special care or management around our furry friends. Chocolate plus – Most of us know chocolate is poisonous for dogs, but there’s an added danger when other harmful food items are paired with chocolate. Macadamia nuts can cause temporary paralysis; raisins can cause acute kidney failure; and caffeine (such as chocolate-covered espresso beans) can be fatal.

Xylitol – Xylitol is a natural sweetener and is used as a sugar substitute. For dogs, xylitol is bad news. It can cause severe low blood sugar and possibly liver failure. You can find xylitol in many food items, including toothpaste, candy, chewing gum, mints, vitamins, throat lozenges, jams and syrups, flavored drinks, protein bars, diet and sugar-free products as well as peanut and other nut butters. Before filling your dog’s Kong with peanut butter, read the ingredient list. Unbaked yeast dough - If a dog eats unbaked dough containing yeast, potential health hazards include alcohol poisoning and gastric dilatation-volvulus (the stomach dilates and twists). The dog’s internal body temperature acts like an oven, causing the yeast to expand and sugar metabolizes into carbon dioxide and alcohol. Leftovers – We love leftovers, but for pets, fatty leftovers, bacon and gravy can be too rich. Eating these foods can cause inflammation in the pancreas (pancreatitis). Signs include severe vomiting, diarrhea, general discomfort and stomach pain. Miniature Schnauzers, Yorkshire terriers and Shetland sheepdogs are especially at risk. Bones – Feeding turkey and chicken bones to dogs and cats can be risky. They can splinter and chunks can turn into a blockage in the stomach or intestine and possibly causing a rupture. Even food like corn on the cob and peach pits can cause obstructions. If you want to feed your dog a small amount of corn, slice it off the cob first. Plants – Some plants, especially true lilies, are extremely toxic for cats. Tiger, Day, Easter, Asiatic hybrid, Red, Wood, Japanese show… these are all toxic lilies for cats. These lilies are often used in florist bouquets, so give some preventative attention to those beautiful flower arrangements. Other plants, like kalanchoe, Japanese yew, foxglove and lily of the valley can also be dangerous. While not poisonous, philodendron can cause cats to foam at the mouth. Sometimes, despite our best efforts, pets get into things. If you suspect your pet has eaten something poisonous, call the ASPCA Animal Poison Control at (888) 426-4435. The hotline is open every day, 24 hours a day. Save the number, but we hope you never need it.

Our planet passed within 91,402,000 miles of the sun on January 3rd, the closest approach in 2018. Then why so cold this time of year? Remember 8th grade Earth Science - - tilt of the earth’s axis, angle of the suns’ rays? This thought crossed my mind on a wonderful sunny December day, quickly replaced by memories of playing hockey on a pond at the end of my street on a similar winter day in the late 1960s. Carrying our skates on one shoulder and our ‘professionally taped’ stick on the other as we made our way to the ice. Some of us dragging shovels along to clear any snow from the water frozen on top of siblings of the fish and frogs we caught during the summer heat. Would they survive this winter to provide us with sport next summer? Skates on. Picking sides. Boots for goals. No “lifting” since we didn’t have anything to protect our legs from the frozen black puck. Playing until too many of us were cold, or wet, or had to get to an early supper. I didn’t think of our distance to the sun back then. But it wouldn’t be long before I did. Mr. DeLisle studied Astronomy, Physics, Computer Science and Mathematics at UAlbany, graduating in 1976. After 41 years in the world of Information Technology, he is now able to spend more time sharing his love of science & math with young and old alike. Cindy, the love of his life, and dd live in Castleton, where they grew up, met and married.

Our Valatie Hannaford is taking part in a New York State pilot pharmaceutical drug take-back program, sponsored by the Department of Environmental Conservation (DEC). I spoke with Chris Curran, the pharmacy manager, today and they are expected to have the program available by April 1, 2018, but most likely before then. Hannaford promised to notify me when the program is up and running, I will make you aware. This is a free program. You can drop your pills in a provided plastic bag at the indoor pharmacy drop-slot during business hours. DEC is taking this measure to improve water quality, protect public health and reduce safety risks. DEC is funding the program for the first 2 years and then it will be the responsibility of Hannaford. This is an easy and effective measure that can be taken to combat the opioid epidemic. It is great to see them take part in this program, thank you so much Hannaford Valatie! More good news! Chris Curran also said they are working with the Columbia County Department of Health to install a syringe drop-off box outside of the Valatie store which will be available 24 hours a day/7 days a week. This is expected to be available by this February. The drop-off box will contain free containers to deposit used syringes safely. Let's see if we can get more businesses in the area to take initiative to do the same! Retail pharmacies, hospitals, and long-term care facilities can enroll online. 2018 Team Scrabble Challenge The Friends of the Nassau Free Library will sponsor a non-traditional, team Scrabble Tournament on Sunday, February 25th, from 2-4 p.m. at Grace United Methodist Church in the Village of Nassau. Teams of 2-4 players may participate, and each team must supply its own standard (not deluxe) Scrabble game. Register as a team or come as a single player and form or join a team on site. Three rounds will be played, and the team with the highest point total for all three games will be the winner. Prizes will be awarded to members of that team.
