Asset Protection by Planning Ahead By Christian H. Dribush Asset Protection Planning, in the context below, deals with the concerns of long term care. In long term care asset protection planning, we are answering three questions of how we are going to pay for our care: 1) Pay the costs out of our own pocket (decreasing the size of the estate our children will inherit) 2) Pay for long term care through long term care insurance (if we are insurable and it is affordable) or 3) Apply for and qualify for government benefits such as Medicaid and Veterans Benefits. We are discussing concerns that modest wealth families have for ensuring they will receive quality care while not subjecting themselves, their spouses, and their families to total financial impoverishment. When Asset Protection Planning Considered: There are two times when Asset Protection Planning is contemplated: 1) a crisis or 2) a pre-planned approach. A “crisis” timeframe is when asset protection must be implemented as quickly as possible according to strict guidelines, unique rules, and limited options. This is most frequently seen in Medicaid crisis planning or VA Benefits planning where a comprehensive asset protection plan is discussed, customized and implemented so that eligibility can be obtained in a matter of a few weeks. The second timeframe -- which by our human nature we generally neglect -- is asset protection by following a pre-planned approach. This pre-planned approach is undertaken in advance of any anticipated crisis. As with any complex area of life and law, pre-planning is key. Irrevocable trusts may play an important role in pre-planning for asset protection. Using Irrevocable Trusts: Irrevocable trusts may be written to accomplish a wide variety of objectives and purposes. One of the most important roles for an irrevocable trust is asset protection in the event of a long term care illness, such as Alzheimers, dementia, Parkinsons, stroke, etc. The goal is to place assets into a properly drafted irrevocable trust, which minimizes loss of control while maximizing future eligibility for Medicaid and Veterans benefits. In this way, you are limiting the erosion of your estate’s assets, safeguarding those assets for your or your spouse’s future needs, and ensuring an inheritance to your beneficiaries. General Guidelines on Who Should Consider an Irrevocable Trust: Irrevocable trusts for Medicaid or Veterans Benefits may be established by older adults who wish to protect their assets. Most of the control over the assets is turned over to a loved and trusted family member, who acts as trustee of the trust. The trustee is in charge of guarding the assets in the irrevocable trust, in case a future need arises. Irrevocable trusts may have the additional benefit of passing assets to beneficiaries of the older adult without requiring a probate. The irrevocable trust can also incorporate special purpose estate planning such as special needs trusts or discretionary trusts for children Because the transfer of assets to an irrevocable trust is subject to a waiting period for Medicaid eligibility of 5 years, it is anticipated that the older adult will not need nursing home care for 2 or 3 years. If the older adult is a veteran or a widow(er) of a veteran, then eligibility for the Veterans Aid and Attendance benefit is not subject to a waiting period. This provides more flexibility for a veteran or a widow(er), allowing him or her to establish an irrevocable trust with less concern over an unanticipated medical crisis.

Medicaid Asset Protection: There are several benefits to planning ahead with irrevocable trusts for Medicaid eligibility. First, you are achieving a future that has more certainty. You have a more definite time line, beyond which you have a more definite answer, meaning Medicaid eligibility. Second, future law changes which may make asset protection planning stricter might not affect you. For example, if a homestead, which is ordinarily exempt in most circumstances, becomes a countable asset after a short confinement to a skilled nursing care facility, having the homestead as a part of the irrevocable trust protects that homestead. With Medicaid, the rules regarding irrevocable trusts are less restrictive. Not only can you select your Trustee, you can remove the Trustee. You can maintain your rights to all the income earned from the irrevocable trust assets. You may keep the ability to change your mind until your death about who your beneficiaries will be. Finally, there’s flexibility even if you have a medical crisis within the Medicaid waiting period. If certainty is disrupted because of a medical emergency, and if keeping the irrevocable trust intact does not make sense, there may be mechanisms within the irrevocable trust to return the unused assets to you. Veterans Benefits Asset Protection: Many of the same benefits to Medicaid planning also apply to Veterans Benefits. Perhaps the most prominent benefit to using an irrevocable trust to hold assets to achieve Veterans Benefits eligibility is control. For Veteran benefits, current Veteran Administration rules do not impose a waiting period before you can access the benefit because you have transferred assets out of your ownership. Even though you can obtain Veterans benefits by giving away your assets to your children, you may not want to. By placing your assets in an irrevocable trust, you are not making an outright gift to your children. This means you are avoiding most of the problems with outright gifts. Your children do not have to think about the temptations of spending those assets, even though they are supposed to hold the assets in case you need them in the future. And your assets, owned by the irrevocable trust, are not subject to the child’s creditor’s claims or divorce.

Time to Get Moving By Cathy Graziano
In many of my articles, I have suggested, “your realtor can refer you….” Over the next few months, I would like to introduce you to some of the individuals & businesses I have referred customers to and have received rave reviews about them. Consider the following from Paul DeDominicis of Clark Moving & Storage. “Moving is third most stressful event in life.” (Employee Relocation Council.) Now that your offer has been accepted it is time to look for a mover. Starting now will allow you to comparatively shop, check references and eliminate the need to scramble at last minute. Do not fall into the trap of waiting until you have a closing date to look for a mover. Many movers book up a month or more in advance, particularly in the summer months. Even if you do not have a firm date for your closing, starting the process early will make the process smoother. Don’t assume you can “do it cheaper” yourself. By them time you rent a truck, line up your “willing” friends and feed them, it may not have saved you as much as you think. (Besides, what do you do when your best friend accidentally drops the box with Grandma’s antique china?) Always get multiple estimates. (Ideally three.) Be sure to have the mover send a representative to your home and show the representative everything you plan on moving. The Yellow Pages or Internet is a good starting point, but NEVER make a decision based on advertisement or a quote provided over the internet.
If possible, hold a “garage sale” or get rid of any items you really no longer need. The less you move the less it costs. Finally, keep your mover informed as soon as your closing date is firm, or if circumstances force you to change dates. Remember the key to a smooth move is planning and communication. A new home should be a fun-filled adventure and moving should be half the fun!

Home Cooking with Stephanie Daly Crock Pot Teriyaki Chicken Check out all of our recipes here ~ www.facebook.com/groups/ crockpotrecipesathome 5-6 boneless, skinless chicken breasts 1 cup sugar (or ½ cup truvia baking blend) 1 cup lite soy sauce ½ cup apple cider vinegar 2 garlic cloves, minced ½ tsp. ground ginger ¼ tsp. black pepper 2 Tbsp. cornstarch 2 Tbsp. cold water steamed rice, for serving sesame seeds, optional, for serving Directions1.Place chicken in the bottom of a slow cooker. In a bowl, combine sugar (or Truvia), soy sauce, vinegar, garlic, ginger and pepper. Pour over chicken in slow cooker and cover with lid. Cook on low 8 hours or until chicken is tender. 2.Take chicken out and set aside. Mix together cornstarch and water in a small bowl with a whisk. Pour into the sauce and stir together. Turn crock pot on high. Let thicken for about 30 minutes. 3.Shred chicken and place back in with sauce. Let heat through and then serve over rice. Sprinkle with sesame seeds & enjoy!

Volunteers from EGUMC and Masjid As-Salam, a mosque in Albany, will team up with Albany's South End Community Outreach Center for a day of clean-up of South End streets and the Outreach Center property. Volunteers will carpool to the Outreach Center, meet their co-workers and form cleanup teams and then share a lunchtime meal. This service project is intended to perform a valuable community service while building bridges between people. We are seeking 6-10 adult and senior high school volunteers. Concerts in the Kinderhook Village Continues into 6th Season Concerts in the Village (CITV) continues their 6th season at 3:00 p.m. on April 10th with major works of Mendelssohn, Brahms and Wagner. The concert will be held at Kinderhook Reformed Church. Led by David Smith, Artistic Director and Conductor, this program will be CITV’s 18th concert. Over 70 musicians will be performing, including the Broad Street Chorale, the Broad Street Orchestra, soprano Amanda Boyd, tenor Jon Morrell, and mezzo-soprano Vicki Smith. Former Metropolitan Opera singer Marjorie Elinor Dix will be CITV’s guest artist. Guest soloist for the Alto Rhapsody will be Marjorie Elinor Dix. A local resident, Ms. Dix has performed at the Metropolitan Opera and other opera houses throughout the United States and abroad. She has also appeared with major orchestras and chamber ensembles, including the Houston Symphony, the American Symphony Orchestra, the Boston Symphony Orchestra and the Metropolitan Opera Chamber Ensemble with James Levine. April 16th YOUTH MENTAL HEALTH FIRST AID Emotional or mental health crisis is far more common than heart attack, but would you know how to respond if a young person was showing signs of emotional or mental distress? Youth Mental Health First Aid is a 5 step action plan designed primarily for adults who work with young people, ages 12-18, as a mechanism for offering help and connection to resources in the event that signs of mental illness, distress, or crisis emerge. This 8-hour course is ideally suited to teachers, coaches, social workers, and leaders of youth groups, but caring citizens, parents, and all members of the public are welcome. It is being offered free of charge by the Rensselaer County Department of Mental Health and Commission of Economic Opportunity, in conjunction with the Castleton Volunteer Ambulance Service on Saturday, April 16, from 8:30am-4:30pm in the Castleton Ambulance Community Room, 1700 Brookview Rd, Castleton. She will talk about the research on the skeletal remains of 13 individuals unearthed in 2005 during a sewer line project on Broadway in Menands across from the Schuyler’s riverside estate, Schuyler Flatts, several miles north of their Albany home. May 7th Run for Hope 5K and Kids 50 Yard Dash Church Street Preschool is sponsoring the 2nd annual Run for Hope 5K Run/Walk and Kids Fun Run on Saturday, May 7th. This family friendly fundraiser honors Hope Oakes, wife and mother of two, who lost her battle with myelodysplasia in October of 2014. This year part of the proceeds will go to a scholarship fund that will include other families who suffered the loss of a parent, as well as the Oakes children. A portion of the proceeds also go to the Preschool to help with programming and operation. The event begins with the Kids Fun Run at 9:15 am, followed by the 5K at 9:30 am. Register early to receive a race T-shirt and a discount. Sign up before April 23rd is $20. From April 24th through race day, registration is $25. The Kids Fun Run is $5. Participants should meet at the Preschool/ Glynn Square on Church Street in Valatie. Registration opens at 8:00 am on race day. Music by DJ Johnny Bo will accompany the race, as well as refreshments, games for kids and face painting. The 5K will be followed by an award ceremony, where overall male and female winners will receive medals, along with top male and female age category winners and in honor of Mother’s Day, the fastest mommy with a stroller. The Preschool is looking for local businesses to act as race sponsors. With a $100 donation, the name of the sponsoring business will be printed on the shirt. For a donation of $150, the business logo will be prominently displayed on the shirt. All donations are tax deductable. Seeing is Believing By Daryl Bart Years ago, one of the things Joe & I really connected over was our love of travel. We still love to recount the funny stories from far away places. When our houses merged almost 20 years ago, remnants of those travels speckled our new place. Joe was fortunate enough to have studied abroad for a year in Japan, and traveled bohemian style thru Thailand and China. He brought back artwork and pottery and a love for the asian culture, food and traditions. I spent a summer bicycling thru western Europe. Like many teenagers let loose in countries with “less stringent drinking policies”, I brought home my memories in the form of empty pint glasses and beer steins. I’m even a little ashamed to say that me and my teenage co-horts even relieved the Vatican of a few “extra” mugs, after we were unceremoniously turned away for wearing shorts.

The next great ideas was magnets. We picked one up in every place we traveled. Joe thought the sign of a happy home was a messy fridge covered in artwork, cut out comic strips & report cards, held in place with magnets from distant places. We had one from Jamaica of a face with Rasta braids, from Florida filled with sand, from Canada that looked like a maple leaf. We have an iguana from Mexico and a turtle from Barbados. We have a picture of a volcano from Hawaii and a wine bottle from Italy. Times too many. You get the picture.
Then I decided we should buy a local alcoholic specialty from each place while we went and bring it home as a memory. Unfortunately, in most cases, they lay dusty and unopened. We have port from Portugal, rum from Puerto Rico & ice wine from Niagara. They just seem so much better when you drink them where they come from. I rarely come home on a Friday and say, “I’m in the mood for some ice wine”. We still have wine from Napa valley trip that was accidentally planned “before” I got pregnant. So instead of tasting it, I got some carry on luggage. We thought we’d wait for a special occasion to crack it open, but alas, time passed. Now, we don't want to find out that it’s just vinegar in there. So on the wine rack they sit.

What are Real-Ear-Measures and why should they be used?

So many hearing aid users have not had the experience of having a measurement of their ear canal before and after the hearing aid(s) are fit. This article will explain how this is done and the reason why it should be a standard test performed when purchasing hearing aids. Real ear measurement (REM) has been a diagnostic tool when fitting hearing aids for the past 30 years. The primary purpose of real ear measurement is to measure the performance of a hearing aid while it is in your ear and verify that sounds are audible, comfortable and tolerable across as many frequencies as possible based on your hearing needs. There are many unpredictable aspects of fitting hearing aids which may include the size of your ear canal, depth of the hearing aid when fit into the ear canal and the resilience of the eardrum. With REM, the audiologist is obtaining objective information on how the ear and hearing aids respond via a calibrated microphone (probe tube). Real-Ear-Measurements are conducted with the the hearing aid fit into the ear canal. With the use of a calibrated probe tube place into the canal along with the hearing aid, this measures whether the hearing aid is providing sufficient amplification across frequencies that are essential for speech understanding.

Both tests are done using a thin probe tube placed into the ear canal while you sit at the appropriate distance from a small loudspeaker. The speaker emits various tones, and a speech passage, and produces a graph of how the ear responds to these test stimuli. You do not need to do anything except sit quietly while the sounds are being presented. It is a very short and objective test to show that adequate amplification is being achieved. It you being fit with hearing aid(s), ask the audiologist to perform REM since this is a verification measurement that will enhance fitting accuracy and provide hearing satisfaction.

Southern Rensselaer County Rotary Club president Terry Brewer is flanked by Nancy and Jack Faddegon who presented the club with the first-ever Rotary District 7190 ShelterBox "Hero" pennant on Thursday, March 17, 2016.. The award was created to honor clubs donating at least $3,000 in one year to the ShelterBox effort, which the Faddegons coordinate in our district. Southern Rensselaer, which received a similar award from the national ShelterBox coordinators for its $10,000 contribution in 2015, just gave ShelterBox another $5,000. ShelterBox is a global Rotary partner that provides temporary shelter and recovery tools to people around the world victimized by natural and other disasters such as earthquakes, floods, tsunamis, hurricanes, and even mass migrations from areas of conflict. April 14th, 2016 Take Back the Night Take Back the Night Walk is Thursday April 14th,2016 at 7:00pm at Hampton Manor Lake, Onderdonk Park Hampton Avenue at Lakeshore Drive, East Greenbush In observance of National Crime Victims’ Rights Week April 10-16, 2016, the East Greenbush/Lower Rensselaer County communities are invited to participate in the yearly Take Back the Night walk. It will be held Thursday evening, April 14th, 2016 at Hampton Manor Lake, East Greenbush, beginning at 7:00pm. A brief ceremony will start the event at Onderdonk Park as government officials and local leaders in the Victims’ Rights community offer their thoughts and words of support. All in attendance will be invited to demonstrate their own support not only by their presence but by taking the mile-length walk around the lake. Well over 150 persons participated in the walk in 2015. East Greenbush has a particularly poignant reason for this celebration. Two members of the town who grew up in its’ neighborhoods, Liza Ellen Warner and Nikki Hart, lost their lives as victims of domestic violence. Martha Lasher-Warner, Liza’s mother, notes that “Victim empowerment is a central tenant of our work.” Warner who is a member of the National Victims’ Rights Board states that “by engaging the entire community, we are able to maximize and leverage existing resources to better serve all victims of crime and provide the necessary support through their journey to healing.” Families and friends, indeed all members of the community are most welcome and encouraged to join in this demonstration of advocacy on April 14th. One Big Racing Family By Kassidy Berger
The thrill of racing would be nothing without the work of the important group named the New York State Stock Car Association. NYSSCA is involved many different race tracks, including Lebanon Valley Speedway in West Lebanon, NY. The organization is a huge part of racing and is constantly looking to promote racing to new spectators. NYSSCA is an organization that aims to better the sport of racing through education and community support. In the 1960s, it was used as a place for drivers to have their voices heard and to place suggestions for their local speedways, as well as to discuss safety at the tracks. Another aspect is the support it lends to racers in need. NYSSCA was officially incorporated on March 22nd, 1969, yet it’s annual banquet began in 1964. This tradition still continues today, 52 years later. Yet now, it does so much more. “The purpose of NYSSCA is to benefit race car drivers,” secretary Kim Berger said. NYSSCA is known for always lending a hand to drivers in need. Through a racing perspective, going to the same track every week creates a certain kind of community that lingers even after the checkered flag flies. This type of community is what NYSSCA looks to support. A major feature of NYSSCA is the Injured Driver fund. If a member, including non-drivers, were to get injured from a racing-related incident at a track, then they are eligible for support from the fund. That person is allowed to receive $125 a week, for up to 26 weeks. It is just one way that NYSSCA works to improve the sport of racing and support it’s members. NYSSCA is a non-profit organization, and of course the money they hand out has to come from somewhere. Every year, NYSSCA holds their annual banquet and awards are handed out to racers who showed significant achievement in the previous year of racing. Other fundraisers include bowling tournaments in the winter and an annual golf tournament, which is being held on May 12th this year. The membership fee is only $25 a year, which is far less than what NYSSCA may support it’s members with over the course of a racing season. Many awards were given out this year at the annual banquet, which was held on January 23rd. However, one very special award was new on the program, called “Humanitarian Award in Memory of Chaplain Dave Miller". It was being given in honor of Chaplain Dave Miller, who passed away last year. “The purpose of the award was to recognize an individual who goes above and beyond outside racing to bring awareness to a good cause,” added Kim Berger.
This year it went to Brian Berger, the driver of the purposefully pink number 60 car at Lebanon Valley Speedway, who set out to raise $5,000 for breast cancer research, education, and awareness from the beginning of the 2015 racing season. NYSSCA was extremely generous on the night of the awards banquet and donated $100 to “Racing For A Cure”, which by the end of the night, hit home the goal with just over $5,000 raised. NYSSCA has also assisted in previous fundraisers of Berger’s, including the JC Flach Memorial Fund, in memory of JC Flach, a young driver who raced at Lebanon Valley alongside Berger for many years. The fund awards first-time drivers at Lebanon Valley Speedway a bonus check of $500, which has been given out three times since it began in early 2013. “NYSSCA has been a great supporter of racing for many, many years. I'm happy to be part of an organization that is there for racers in their time of need and promotes positive aspects of racing,” said Berger. Fundraisers are nothing without people to run them. “We have hundreds of members as well as countless numbers of volunteers throughout the year,” said secretary Kim Berger. NYSSCA has a board of directors in addition to officers, all elected by members. NYSSCA also supports the racing community through their annual scholarships for the children of members, or members themselves. Every year, NYSSCA gives out a scholarship of $250 to a high school senior. This is just another example of how dedicated NYSSCA is to improve the sport of racing. Without NYSSCA, racing would not be the same. It looks out for its members and encourages fans to continue to support racing. Of course, they are always looking for new members and for new people to support the tracks they sponsor. When asked why she is a part of NYSSCA, secretary Kim Berger said, “I like to stay involved in racing since it has been a part of our family my entire life.” So why not make it a new tradition for your family? The pipeline’s path runs through southern Rensselaer County. Houston-based Kinder Morgan claims that the pipeline would lower the price of natural gas in New England markets. Opponents of the pipeline contend that the pipeline would carry gas largely intended for export, and would bring hazard without benefit to people living along the pipeline’s route. The Federal Energy Regulatory Commission (FERC) is reviewing company documents and public comment on the proposed project, and will ultimately decide if it can proceed. The towns of Stephentown, Nassau, Sand Lake and Schodack have all passed resolutions opposing the pipeline, as has the Rensselaer County legislature. Last March, Congressmen Gibson and Tonko urged FERC to extend the public comment period. FERC agreed to accept public comments through January 2016. This March, Senators Gillibrand and Schumer called on FERC to reject Kinder Morgan’s current permit application, citing “overwhelmingly negative feedback … from the public” and “the potential for long lasting environmental and health impacts.” To view project documents and public comments filed with FERC, go to elibrary.ferc.gov and search for filings related to docket number CP16-21. www.LapinskiDentaL.com Dear Dr. Lapinski: I’m in a wedding this summer & want to whiten my teeth. I’ve tried drugstore products but I still don’t think my teeth are that white. Any suggestions? Tooth Whitening is an extremely popular cosmetic procedure. For relatively little time, money and effort you can kick up your entire appearance. The most common ways to whiten teeth include OTC products like strips, paint-ons, rinses and toothpastes. In the office we do custom take home trays, semi-custom professional take home & cosmetic rehabilitation using lab generated porcelain crowns and veneers. The first thing to know is that your enamel is whiter than the layers of tooth below it. Scrubbing your teeth really hard with a toothbrush will not whiten your teeth and can do a lot of abrasive damage. Whitening toothpaste can be very damaging to teeth if used incorrectly. They can remove superficial staining but overtime, they can actually remove your white enamel as you literally scrub off the top layer of tooth structure. Gum recession and divots in teeth are being seen more commonly than 10 years ago, which I believe is the result of toothbrush abrasion & toothpaste misuse. Whitening toothpaste should be used by adults, and should be used cautiously to prevent long term damage. The best results I’ve seen is on patients using professional whitening products. I personally prefer the trays as side effects are relatively rare. Plus, the patient is in control of how often to bleach & periodic touch-ups are very simple. Office Bleaching is done using a specialized gel/light combination. The downside to 1-hour bleaching is that it’s a one shot deal & if you’re not pleased with the result – you’ll have to repeat the procedure or get trays made. Both can work very well & are safe to the teeth, not damaging tooth structure. The most common side effects for both are tooth sensitivity & gum irritation, which are generally short in duration and minor in nature. Lastly, you can whiten teeth by replacing them with crowns, veneers or a combination of whitening and cosmetic procedures – which can dramatically change the color, shape and appearance of your – but this is a topic for a different question. Parasite Fact and Fiction
My home and yard are clean, so, my dog can’t get worms. Fiction! Dogs can get intestinal parasites a variety of ways, including ingesting eggs or spores in contaminated dirt, water, feces or food. Scooting on the floor could be a sign of parasite infection. Fact! Some dogs do not show any symptoms, but signs can include floor scooting, vomiting, diarrhea, distended abdomen, weight loss and an occasional cough. Ringworm is a worm. Fiction! Ringworm is fungus that affects the skin. It starts as a small hairless lesion and it can increase in size. Like some parasites, it can be passed from pet to humans. Worms can be passed from a mother dog to her puppies. Fact! Some intestinal parasites lie dormant in the mother and become active when she’s pregnant, passing from mother to puppy during nursing or birth, which is why parasite preventatives prescribed during puppy veterinary health checks are so important. Cats and dogs can get tapeworms from fleas. Fact! Tapeworms are usually spread through infected fleas. Even children can accidently ingest an infected flea and get tapeworms. Fleas can increase by the thousands in a day or two. Fact! After its first blood meal, a single flea can lay up to 40 to 50 eggs in one day. Stool samples can detect intestinal parasites. Fact! When your veterinarian asks you to bring in your pet’s stool, they are checking for parasites. Heartworm is not really a parasite. Fiction! Heartworms are a type of roundworm that live in the heart. Adult heartworms can live 5-7 years in a dog’s heart, causing damage on both the heart and lungs. Cats cannot get heartworms. Fiction! Cats can get heartworms but they are resistant hosts. The worms may not live to their final adult stage, but immature worms can still cause damage to a cat’s lungs and airways. While dogs are the usual host, heartworms can infect more than 30 animal species. Mosquitoes carry heartworms. Fact! An infected mosquito bites a dog and can leave heartworm larvae behind. A simple annual blood test can detect heartworms. If my dog or cat had parasites, I would see them. Fiction! In the early stages of heartworm infection, there are no obvious signs. Some intestinal parasites will pass microscopic eggs or spores in your dog’s feces that are too small to see. Roundworms and tapeworms can be an exception. Internal parasites are not serious. Fiction! Heartworms, left untreated, cause heartworm disease which can be fatal. Other internal parasites (worms) can cause vomiting, diarrhea, malnutrition and anemia. Some parasites can infect humans (especially children) through contaminated soil or sandboxes. Parasites are disgusting, but they are preventable. An annual blood and stool sample test can quickly rule out (or detect) parasites. Monthly preventatives go further keeping pets’ safe, and their owners, from these harmful freeloaders.
