August is going to be a month of “tug” within ourselves between what we think we should want and what we really do want. August is going to be a month of appreciating the fundamental way things can come together in our lives. It is a month of not trying to sensationalize our lives, or be caught up in drama, but more accepting the simplicity of how things are working. In a business deal, if you have what you need, and it is coming together, this time, when you might normally push the envelope and try and get a little bit more, let it be and just move forward with what you have. In relationships, if you are okay with how things are right now, maybe you
don’t have that ring, but you do have their love, accept that and enjoy that and what it brings to your life. In August, it is not so much the case of “let sleeping dogs lie,” but more, “a bird in hand is worth two in the bush.” And should you decide to “push it,” or to get more intense with someone rather than let it flow? From what I can see, the only loss will be your own peace of mind, and instead of having an easy, flowing month, you will be caught up in stressing the small stuff for no greater gain. COUNTRY TRUE VALUE SPRUCES UP SCHOOL 12- WITH 40-GALLON PAINT DONATION Troy-based school wins True Value Foundation’s ‘Painting a Brighter Future’ grant Troy, NY, 2010 – A fresh coat of paint brightens up any room, and this summer School 12 of the Enlarged City School District of Troy will receive 40 gallons of paint to refresh its learning environment. School 12 was selected as the winner of a paint grant through Country True Value’s partnership with True Value Foundation’s ‘Painting a Brighter Future’ program. A True Value Foundation paint grant helps renew an atmosphere that sets a positive tone for educators to teach and children to learn. Partnering with True Value Foundation, Country True Value/ Just Ask Rental notified neighborhood schools of the grant last fall and encouraged them to apply School 12 is using the 40 gallons of paint to give their classrooms a much-needed makeover. The more than 450 students next fall will enjoy playing and learning in the newly painted facility. “Through True Value Foundation’s Painting a Brighter Future’ program, we’re able to help School 12 and give back to the community we love to serve,” said Joe Gross, of Country True Value/ Just Ask Rental. “The donation will not only save the school money, but more importantly will create an environment that fosters learning, inspires creativity and builds community.” ‘Painting a Brighter Future’ is the signature program of the True Value Foundation, a philanthropic organization of True Value retailers nationwide. Serving as ambassadors for the foundation, True Value retailers introduced the ‘Painting a Brighter Future’ program to their towns, championing the cause of enhancing the educational environment in their respective communities. Who better than a hardware store owner to help convince local school officials on how 40 gallons of paint can enhance the learning environment for area students. Retailers identified elementary, junior high or high schools in their neighborhoods that met basic qualifications and encouraged the schools to apply for paint grants, which were awarded based on need. An extensive judging process evaluated several aspects of the school, including student population, involvement with the surrounding community and the reasoning behind the school’s request. Using this set of criteria, an advisory committee of True Value Company professionals identified the top applicants as grant winners, each of whom were notified by their local True Value hardware store. True Value Foundation was established in 2008 to unite True Value retailers in helping people in their communities build stronger lives through charitable programs. Through the foundation, America’s local hometown True Value hardware stores are encouraged to support youth programs, create solutions for community and social issues, and inspire adults to continue to learn through new experiences. By uniting retailers in this mission through local initiatives, the foundation brings positive change to more people in True Value communities.

Powers Park Concert Series July 10 will mark the kickoff for the wildly popular, Powers Park Concert Series. Now in it’s 7th season, the concert series will feature some of the biggest names of the local music scene. The concerts offer great music, festival foods, and a big weekly, 50/50 raffle. ery frequently potential clients come to me with their own unreasonable expectations. Clients always think their particular case is worth far more than it actually is. Or, they believe that they are right and everyone else is wrong regardless of how many times you point out all of the facts that support your analysis as opposed to theirs. There’s something about practicing law that makes people think that anyone can do what a lawyer does. I’ve always thought that it had something to do with the fact that a lawyer’s work is all cerebral. I think a lot and read a lot and analyze even more. It’s not as if, once I’m hired, that I can pick up a tool and set to work on a project and show my clients what I’ve accomplished for them each day. I have no freshly dug ditch to point to or a foundation to a house to look at or even a pile of boxes that I can show have been moved from one stack to the other. It simply doesn’t work that way. And because most of the work I do is in my head, most people don’t think I work at all. I certainly wish that was the case. I’ve recently taken up golf and I could certainly use some free time to get to the practice range to work on my short game. As it is, I feel like I have no free time whatsoever and, for the most part, that’s absolutely true. And since I have no discernable way of judging what I have or haven’t accomplished in the cases I’m working on, it seems as though I never stop working. Think about it – if I’m a carpenter, my work stops when I put down my hammer and saw. But for me, since I work with my mind, I can’t just turn off my brain. So when I’m out to dinner with friends, my mind drifts back to that contract that I’m negotiating at the moment. Or I’m mentally sorting through the evidence that I’m going to need for the custody trial I have coming up. I suspect that’s

part of what is meant when folks refer to thinking like a lawyer. But I’ve been trained to think this way. The process was beaten into me while I was studying during law school and I’ve been honing these legal analytical skills as a professional practicing law since 1992. So why do clients with no particular legal background whatsoever always second guess me? Why do they think they can pull the wool over my eyes? When I first started practicing, I was assigned a case by the partner I was working for which had been around the office for quite some time and had been ignored. I was given these marching orders: settle it or get rid of it. I was the cleanup guy. It was my job to re-connect with the client and somehow dispose of the case. So I reviewed the case (a slip and fall), determined its strength (liability was questionable which would make it very difficult if not impossible for my client to succeed) and, if we did prevail, I determined the extent of the damages or how much my client could potentially receive as compensation from the lawsuit (based on the injuries and necessary medical treatment, I concluded the case, at most, was worth anywhere from $25,000 to $50,000). There had been no less than 3 prior associates who had worked on the file and each one of them had notes in the file that, for the most part, were in agreement with my analysis of the strength and value of the litigation.

with my analysis. “The last attorney said it was the best case they’d ever seen and it was worth half a million or more in settlement value”, is what the client told me. And that is the exact point where I knew that he was lying to me. Because even as a green, novice attorney I knew that no lawyer ever turns their back on a winning case. Never. We’re all in this to make a living and I couldn’t make a living if I turned away cases that had some kind of potential dollar value regardless of how large that dollar value is. And clients always forget this: in a personal injury case, the more money I get for you, the more money I make because my fee is contingent upon the size of the settlement or verdict that I get for you. So can someone explain how it makes sense for me to undervalue your case? How do I or any other lawyer benefit from such practices? And if I over-value your case (tell you that a $1000 case has a million dollar value) that’s worse. Since I can never get you the million dollars, I’d be setting myself up for disaster. I’m the one who fails if I can’t get you the settlement that I promise which means that, in the long run, I’ll end up losing that client and any other clients they may have sent my way. Losing and isolating clients is just plain bad for business – any business. There I go thinking like a lawyer again!

So next I had to meet with the client and that’s where things got interesting. When I explained that the case was not very strong I was instantly met with resistance. “That’s not what the other attorneys told me” is what I heard. We hashed that out for a little while and then I gave him my analysis of the value. And, of course, he disagreed

Cat Pee = Human Rage “He’s peeing all over! -- He’s ruining my house!” I have about 20 suggestions for things you can try. Rule out physical. Evaluate psychological. Identify and correct problems when possible. Sometimes works/sometimes doesn’t. Now what do you do? He’s still peeing (those were really nice shoes, they looked good on you...now and forever more they will reek of cat pee--you will reek of cat pee--you will be known by others as the person who smells like cat pee...throw them away). Big problem. Lots of anger...rage actually, and property damage. I read somewhere that inappropriate elimination is the number one reason for feline euthanasia. Don’t know if it’s true but the notion breaks my heart. My story: one of my cats used to pee on something in the house every 3 weeks, faithfully. This went on for 6 years as I tried and tested everything. The day I euthanized my other cat--his best friend, was the last day he peed in the house. Something about my old diabetic/asthmatic cat seemed to stimulate him to pee in the house--every 3 weeks. Nothing else has changed. He just stopped. It’s been a year. How could I figure that one out?! Odd story--Lady says “I’m here because you saved the cat of a lady I met at Walmart--and you saved mine.” An odd but friendly opening--”Really?” I said. She continues, “I was in the pet aisle and another lady was there and we got to talking and she said her cat used to pee in the house too but stopped after you suggested she try a certain type of cat litter--then I tried the litter and mine stopped too--and my previous vet told me I’d just have to learn to live with it! I spent lots of money on tests and everything and nothing worked! What a crappy vet!” She finally took a breath. I carefully explained that I got lucky. I would have wanted to run all the same tests and tried all the same meds and that there are about 20 such odd ball things to try--each of which has a 2% chance of working, and that ultimately, the majority of people will have to just learn to live with the pee. The air was sort of sucked from the room...”You mean you’re not a great vet?” “Huh? I’m pretty good--and sometimes great--but probably not always.” “That’s disappointing,” She said,”but I like your honesty and your hospital is wonderful, so I suspect you’re my new vet.” Glad I could help.

Bottom line: most vets will want to “do everything” to try to figure out why your cat is ruining your life with pee. Often the answer is right there--sugar or bacteria or crystals--in the urine! It has to be checked--if no help, analyze environmental stressors, culture the urine and check the blood--if no help, med trials and X-rays and ultra sound--if no help, try all the odd ball stuff--if no help, euthanize your other cat...? Just kidding. If you’ve got this problem in your home, don’t beat the cat. Call your vet. There’s a fair chance they can fix the problem. Dave Stone, DVM

MORRIE, a beagle/rottie mix, is 9 years old. He must have been a beauty in his prime. Now older, he walks slowly and has a poor vision (severe cataracts in both eyes)- but the beauty has not left his soul! Morrie is outstandingly gentle and friendly. He walks slowly but his pace picks up after a few minutes. He tends to ignore other dogs but he is NOT good with cats and is focused on his caretaker. He loves to be petted and talked to. He is a funny-looking dog – we have deemed him a Beagle/Rottie (a Reagle?) – he has a Rottie rear end and stub tail, sort-of Rottie head-shape, with a coat that is white with large lemon spots. So think a small (52 lb), lemon yellow Rottie. Due to his age and vision impairment we would not place him in a home with young children. Hope everyone is having a great summer. It’s been a very hot one. Yes, I’ve spent lots of time swimming and trying to keep cool…mainly lying over the a/c vent in our hallway. I have to talk about something very important and that has been in the news a lot lately. There have been too many instances of people leaving l i their th i pets t in i their th i cars in this sweltering heat. You have to understand it only takes minutes for a pet left in a car on a warm day to die of heatstroke and suffocation. On a 78 degree day, temperatures in a car can exceed 90 degrees in the shake and 160 degrees in the sun!! Rolling down a window or parking in the shade doesn’t guarantee safety either. Temperatures can still climb to dangerous levels plus you run the risk that your pet can jump out of an open window. It’s not safe to leave your pets in the car even with the a/c running. If the a/c unit shuts down, it can blow hot air into the car. Dogs and cats cool themselves by panting and by sweating through their paws. If they have only overheated air to breath, they can suffer brain damage and die of heatstroke. To lower your pet’s temperature, give him water to drink, place a cold towel on the head, neck and chest and call your vet. All this seems like common sense but there have been too many instances where people feel they only will be a few minutes and that their pet will be ok. Please think! To keep pets safe this summer, the ASPCA’s Animal Health Services offers the following tips. Pets dehydrate quickly, so give them plenty of water when it’s hot. Also, make sure pets have a shady place to get out of the sun, and keep them indoors when it’s extremely hot. Rodenticides (mouse and rat baits), lawn and garden insecticides and some flea and tick products can harm cats and dogs if ingested, so keep them out of reach. While there are flea products that can be used safely on pets, products labeled as “dog only” containing permethrin can be deadly to cats. Be sure to read directions on these products carefully. Do not leave pets unsupervised near a pool — not all dogs swim well. Introduce pets to water gradually and make sure dogs wear flotation devices while on boats. Try not to let pets drink pool water, which contains chlorine and other chemicals that could cause stomach upset. During warmer months, the ASPCA sees an increase in injured animals as a result of high-rise syndrome, which occurs when pets fall out of windows or doors and are seriously or fatally injured. To prevent this, pet owners should keep unscreened windows or doors closed at home and secure adjustable screens. Also, lowering the blinds to about 8 inches above the window sill will keep the room cooler and let your pet watch the world go by. Be aware of heated situations. When taking your dog outdoors or in the company of other animals, always keep an eye on those around you. Book Review IPetite, blond-haired Jennifer Thompson was raped at knifepoint in her Burlington, North Carolina apartment. Eleven years later, when DNA evidence exonerated Cotton, both he and Jennifer were forced to confront reality: He faced a difficult transition from prison to freedom, and she faced the truth about that night and her part in undoing an innocent man’s life. But instead of going their separate ways, the two decided to meet and eventually began corresponding. THE COLLABORATIVE REVOLUTION: CHOOSING HOPE OVER FEAR FOR COUPLES AND FAMILIES IN CRISIS This Article is the first of a three-part series exploring the Collaborative Law Process as an option available to couples or parents who are involved in a separation, divorce, Family Court proceedings, interfamilial disputes, partnership termination or other family law matters, including the modification of current orders of support and custody. Collaborative Practice, including Collaborative Law and interdisciplinary Collaborative Divorce, is an option that combines the advocacy of traditional legal methods with the interest-based negotiations of Mediation. It is a way to resolve disputes respectfully, without going to court, while working with trained professionals, who help you reach a separation or divorce “with dignity”, and has been called “the peaceful divorce”. Collaborative Practice involves a team approach to solving problems. The Professional Team consists of Attorneys, Mental Health Facilitators, Divorce Coaches, Child Specialists and Financial Specialists, all of whom have received collaborative training under guidelines established by the International Academy of Collaborative Professionals (www.collaborativepractice.com). Create Calendar Central Each school year floats on a sea of schedules. Functions, Lunch menus, meetings and lessons. Ease the family into a school year schedule. The first day of school is no time for a drastic adjustment of household sleep schedules. Instead, ease children back into a school year routine gradually. During the last two weeks of summer, re-introduce a school year bedtime. Begin waking late sleepers earlier and earlier, closer to the hour they’ll need to rise when school begins. Don’t neglect mealtimes! Younger children, in particular, need to adapt to new meal routines before the school day demands it of them. Plan meals and snacks to accustom little ones to rituals of the school day before the school year begins.

Based on a $200,000 home: The Town’s portion is $65 per month and if water and sewer are applied add an additional $20. The Town’s Library and Fire Districts (both of which are out of the Town Boards control) are responsible for $12 and $13 per month respectively. The County cost is $92 per month.

The largest share is the School District, which is voted on by the residents, and is $260 per month. No one likes taxes, but these are the facts. Town taxes provide many services, including police/ dispatching, town parks, youth and senior programs, snow plowing, road maintenance as well as town administration costs. All this and more is provided for $65 per month. The town does not have control over fire and library services but they are an essential part of our quality of life and the combined cost is around $25. Your County taxes are $92 a month – services? I recommend a call to your County Legislature in regards to your County tax. The $260 per month school tax is billed in September and is completely separate from the town tax bill. Taxes are an integral part of our society and this administration has, and is working hard to balance services provided with your tax dollars. You will hear a lot about the “high taxes” over the upcoming election cycle and I hope you keep this eference handy.
