This edition of the Tampa REALTOR® Magazine highlights two very important topics that are must reads: Fair Housing and Technology.
Every April is recognized as Fair Housing Month as we commemorate the passage of the Fair Housing Act. It is the landmark civil rights law signed by President Lyndon B. Johnson on April 11, 1968, that made discrimination in housing transactions unlawful.
The purpose of the Fair Housing Act is to ensure that everyone has equal access to housing and that no one is unfairly denied housing or subjected to discriminatory practices. The law makes it illegal to refuse to sell, rent or lease housing to someone because of their race, color, religion, national origin, sex, disability or family status. It also prohibits discriminatory advertising and lending practices, such as redlining, which involves denying loans or insurance based on a person's race or the racial composition of a neighborhood.
In November of 2021, the National Association of REALTORS® debuted an interactive training platform called Fairhaven and is designed to help combat discrimination in U.S. real estate markets. It can easily be accessed using technology such as a computer, tablet or smartphone and it is free to real estate professionals. To learn more about this great resource, be sure to turn to page 17 and check out the great article written by our own Susanna Madden (2002 past president).
As quickly as things are changing in our real estate industry, one thing that continues to keep us on our toes is technology. Perhaps one of the most incredible advancements in technology is artificial intelligence and Chat GPT.
The rise of artificial intelligence (AI) has dramatically changed various industries, and the real estate sector is no exception. One of the most recent AI advancements is the Generative Pre-trained Transformer (GPT) language model, with GPT4 being the current state-of-the-art model by OpenAI. Boasting human-like text generation capabilities, GPT can be a powerful tool for real estate professionals looking to transform their business practices with AI.
I wanted to share with you different ways that AI can be used in real estate. But rather than writing the rest of this article from scratch, I used OpenAI’s website and entered the following instruction, “Write an article on how GPT can be used by a REALTOR®”. Below is a snippet of what I got.
1. Automating Content Generation: Creating engaging and informative content is essential for REALTORS® to establish a strong online presence and capture the attention of potential clients. GPT-powered AI can generate written content for blogs, newsletters and social media posts, saving REALTORS® precious time and resources. By inputting keywords, topics or even providing example sentences, GPT can help REALTORS® tailor their content according to current trends and their target audience's interests.
2. Revamping Property Descriptions: Listing properties with compelling and accurate descriptions is vital to attracting potential buyers. REALTORS® can employ GPT to generate creative and unique property descriptions that highlight essential features and make a property stand out in the competitive market. By automating this process, REALTORS® can focus more on providing exceptional service to clients while ensuring high-quality listings across their platforms.
3. Personalizing Email Campaigns: Automated yet personalized email campaigns are essential for maintaining communication with clients and nurturing leads. Utilizing GPT's natural language processing capabilities, REALTORS® can generate tailored and engaging content for email campaigns easier than ever. By automating and personalizing their email marketing efforts, REALTORS® can strengthen their relationship with clients, increase brand engagement and convert more leads into sales.

Case #10-1
On a Saturday morning, REALTOR® B, a salesperson affiliated with REALTOR® A, answered an e-mail from Prospect C, a recent college graduate who was moving into the city to take his first teaching job at Northwest High School. Prospect C was married, had two young children, and was a veteran.
After working with Prospect C to determine his family could afford a three-bedroom home in the $240,000 range, REALTOR ® B described available properties near Northwest High School and set up appointments to show houses to Prospect C. That afternoon, REALTOR® B showed Prospect C and his wife three houses in neighborhoods near the high school.
On Monday, at a faculty meeting, Prospect C met Prospect D, who was also moving into the city to take a teaching position at the same high school and who was also in the market for a home. Prospect D was married with two young children and was also a veteran.
Prospect C told Prospect D of REALTOR® B’s knowledge of the market and VA financing and how helpful he had been. Prospect D called REALTOR® A’s office that afternoon and asked for REALTOR® B. and asked for REALTOR® B. REALTOR® B met Prospect D and determined Prospect D could also afford a home in the $240,000 range. Prospect D told REALTOR® B that he was also a new teacher at Northwest High School and had been referred by Prospect C. Prospect D was black.
REALTOR® B showed Prospect D houses in several neighborhoods undergoing racial transition but did not show Prospect D homes in neighborhoods near the high school. Prospect D asked about houses closer to Northwest High School. REALTOR® B replied that he had no knowledge of any homes in that area for which Prospect D could qualify. The next day, Prospect D, while visiting Prospect C, related his problems in finding a home near the high school and learned that REALTOR® B had shown Prospect C several homes near the high school. Prospect D filed a complaint with the Association of REALTORS® claiming that REALTOR® B had discriminated against him and his family by not offering equal professional services.
The complaint was reviewed by the Grievance Committee. REALTOR® B was charged with an alleged violation of Article 10, and the complaint was referred to a Hearing Panel of the Association’s Professional Standards Committee for hearing. At the hearing, REALTOR® B admitted that he did not use the same efforts to show Prospect D properties in neighborhoods near the high school as he did with Prospect C because he felt Prospect D and his family would feel more comfortable living in a racially integrated neighborhood.
The Hearing Panel found REALTOR® B in violation of Article 10 of the Code of Ethics.

Q: When calculating an effective date, is it always the date that the last party signs or initials and delivers the offer or final counteroffer to the other party?
A: No. It sounds like you are describing, almost word for word, the definition of effective date found in the most current version of the Residential Contract for Sale and Purchase published by the Florida Realtors and Florida Bar. But that’s not the only way for a contract to establish an effective date.
Since this is a contract interpretation question, a party must carefully read everything contained in the contract to get an interpretation specific to the contract they signed. Some contracts, for example, simply pick a date, as in “the effective date of this contract is May 15, 2023” Other contracts may have a slightly different way to calculate the effective date, such as going by the date of the final signature, not final delivery. Parties to the contract should read their own contract carefully, especially if it’s not familiar to them, and should direct any questions they may have to an attorney.

For most, when we hear the term ‘Fair Housing’, we think in terms of housing being fair to everyone. Rightfully so because homeownership should be an equal opportunity for everyone. In today’s tech-driven world though, have you ever stopped and wondered how technology plays a role in Fair Housing?
It might not seem obvious at first, but Fair Housing and technology cross paths in several ways. Technology has the potential to promote Fair Housing by improving access to information and resources for renters and homeowners. Conversely, it can also exacerbate housing discrimination and perpetuate inequalities. As the saying goes, “technology can be your best friend or your worst enemy”. Take these examples into account on how Fair Housing and technology intersect:
1. Housing Search Platforms: Online platforms such as Zillow and Apartments.com have made it easier for people to find housing. However, these platforms may also perpetuate housing discrimination by allowing landlords to target specific demographics or use discriminatory language in their listings.
2. Algorithmic Bias: Algorithms used in the housing industry can sometimes aid bias, such as by automatically rejecting applications or pricing based on demographic factors. This can result in
discrimination against groups of people, such as people of color, people with disabilities, or families with children.
3. Data-driven Decision-making: Housing policy and planning decisions are increasingly being informed by data analysis. But if the data used is biased or incomplete, it can lead to discriminatory policies or perpetuate inequalities.
4. Online Housing Education & Resources: Technology can be used to provide information and resources to help people understand their Fair Housing rights and access affordable housing options.
All in all, technology can both promote and hinder Fair Housing, depending on how it is used. It is important to consider the potential impact of technology on Fair Housing and work to mitigate any negative effects. Be mindful of your and consumers’ available resources –due diligence is key in everything!

The purpose of our Grievance Committee is to investigate potentially unethical conduct and arbitration requests and forward cases to Professional Standards Committee for hearings. We function similar to a “grand jury.”
We work behind the scenes and are fulfilling our duties as promised. But early on, our committee of twenty members decided to step it up and we want to share with you what we are doing.
We decided, as a group, to take the Fairhaven Challenge. “What is the Fairhaven Challenge?” you ask.
Per National Association of REALTORS®, “Fairhaven is an online, immersive simulation that uses the power of storytelling that lets learners confront housing discrimination in scenarios that feel real.”
It continues to say, “Inspired by real stories, this innovative online experience has agents work against the clock to sell homes in the fictional town of Fairhaven, while confronting discrimination in the homebuying process. Learners will also walk in the shoes of a homebuyer facing discrimination.”
Fairhaven was debuted in 2021 by the National Association of REALTORS®, and it is designed to help combat discrimination in real estate markets. There is no charge to take the course, and you get there by typing Fairhaven.Realtor into your browser. If you don’t remember your NAR username or password, you can
click Forgot username or password? and reset it.
By the end of our March meeting, over 80% of our Grievance Committee had taken the course, and that number is still growing. They are all excited about it and are talking to their offices about getting their agents to do it.
Here are some takeaways:
• It takes about an hour to complete the course.
• You get a certificate of completion at the end.
• You don’t have to finish it all at once; you can spend as much or little time as you want and come back. It remembers where you were.
• You will be surprised how much you learn. It’s fun to do.
Here’s a quote from our Vice Chair Steve Medendorp: “The Fairhaven Challenge was easy and fun to participate in. As a simulation, you are thrust into different scenarios that challenge not only your knowledge but your own behaviors.”

From lead generation to automatically creating listing descriptions, Artificial Intelligence (AI) has rapidly taken over the real estate industry in recent months. AI is making automation easier for REALTORS® and allowing them to focus on the human side of business.
Artificial Intelligence has the ability to look at millions of data streams at once, unlike humans. REALTORS® can get an analysis done on future market trends for the upcoming homebuying season or possible investments in the area. Tools like this would give a REALTOR® and their brokerage a huge competitive advantage as they are noticing opportunities in the market that might otherwise get overlooked. It is important to note these AI tools don’t have access to the databases that MLS, associations or brokerages have, but it is still a great way to stay ahead.
Chat bots are a great way to engage with a machine and have them answer questions and create decisive responses the way a human would. By using tools like ChatGPT, agents can ask AI to create descriptions for their listings. All agents need to do is provide the AI with a short description of the house and they will receive a humanlike description they can use for their listing that is sure to grab a buyer’s attention.
Similarly, to chat bot’s creating copy for your listings, it can do the same for your marketing strategies. Whether you need help with blogs, email, website assistance or social media, AI can help you create effective and persuasive copy. AI software can assist you by writing content, creating content ideas, or simply expanding on content you already have.
In today’s market, the most popular way to find clients is digitally. AI makes this easy to all REALTORS® and is efficient for both parties. For clients, AI can generate what houses it thinks clients would be interested in and the agents they might want to work with based on their algorithm.
AI becoming widely popular and accepted, how will it affect the real estate industry?
Artificial intelligence tools often collect and store large amounts of personal data from you and/or potential clients. This is a good and bad thing. There is a chance that this AI could be involved in a data leak of some kind. Thankfully, these tools have high security systems in place to lower the chances of this happening. AI systems also tend to flag and alert the users of a potential security breach ahead of time, so it isn’t an issue anyone has to be constantly worried about.
There is a large concern that AI-powered tools may replace the need for human agents altogether, resulting in job loss and decreased job security. In addition to this, there is a small possibility of a court’s ruling decision that would end the 1099 exemption affecting the brokerages and individual agents, but not so much for large companies like Zillow or Redfin. These are aspects all agents and brokerages should be aware of as it affects everyone.
There is always the possibility for AI tools to make errors or misinterpret data, which could result in incorrect property valuations, inaccurate market analyses, and other issues that have the potential to spread false information to a larger audience. As easy as it is to create new and unique information using AI, one can as easily create false information regarding a listing or an identity as well. These falsified pieces of information are likely to mislead buyers or sellers. To protect yourself and clients from this make sure you are trained on how to catch fake information and be sure to use AI ethically and responsibly
Artificial intelligence is a term used for machine technologies that perform tasks that would otherwise require human intelligence. Artificial Intelligence aims to react the same ways a human would. Whether it is analyzing patterns or making judgements. Put simply, AI is the computers' ability to think and learn like us. There are many AI tools to learn about and pick from as a REALTOR®, but some ways REALTORS® are using AI in their ever day business include virtual reality for listings, automated copy for listings, lead generation and analyzing market trends/forecasting.
Creating genuine connections with your clients is one thing AI can’t do. REALTORS® help clients picture their lives in the homes they are being shown. AI can virtually show a house and give you numbers and data, but it can’t make the client feel like the house is their home. A REALTOR® can also effectively analyze and reciprocate emotions with their client. AI can’t manage the human emotion behind real estate transactions. That is what makes the professional behind the process so important. A real estate pro who uses AI in combination with their own abilities is irreplaceable.
To mitigate these risks, REALTORS® should stay informed about the latest AI developments and be cautious about relying too heavily on AI-powered tools. They should also prioritize ethical and responsible use of AI and work to ensure that AI tools are transparent, accountable and free from bias. Nonetheless, artificial intelligence is a great way to work smarter, not harder.
Whether a REALTOR® uses AI to create copy for their listings or to generate leads, it is a sure way to ease the process. Remember that when using AI, it is important, crucial even, to adhere to the NAR Code of Ethics and Standards of Practice. Being sure not to mislead clients with incorrect information and preserving confidential information are very important. REALTORS® are encouraged to take the free Code of Ethics training provided on the National Association of REALTORS® website.
Knowing about deeds when buying and selling real estate is essential. Transferring property ownership is a big deal, and as a homeowner, you want to make sure you transfer the title without any problems. There are several types of deeds, each with pros and cons. We want to address the most common questions.
1. What’s the difference between a quit claim deed and a warranty deed?
A warranty deed is a legally binding assurance given to a buyer by a seller. A warranty deed is preferred since it carries a guarantee from the seller that he/she holds clear title. With a quit claim deed, the seller does not have to guarantee anything, which is why a warranty deed is preferred in most cases.
2. Should I get a life estate deed or an enhanced life estate deed?
A life estate deed transfers the property to the beneficiaries automatically after death. A certified copy of a death certificate will need to be recorded. Getting a life estate deed will allow you to avoid the probate process and save on legal fees. There are drawbacks, including it is irrevocable, and if you decide to mortgage or sell the property, you aren’t the sole owner. With an enhanced life estate deed, you can revoke the deed as long as the grantor is alive. The grantor reserves all rights and powers to the property, including mortgaging and selling the property.
3. Why does my spouse need to sign the mortgage if he/she is not on title?
Under Florida’s Constitution, the spouse must sign the mortgage, even if he/she is not financially responsible for any payments. This is due to the vested interests a spouse might have. On the other hand, there are benefits to having the spouse on the deed, including avoiding the probate process and protection from creditors.
4. What are “Doc” stamps on the deed and the mortgage?
A doc (documentary) stamp is a tax imposed on documents that transfer or grant interests, such as deeds and mortgages. These taxes are collected by the closing agent and ultimately paid to the Florida Department of Revenue.
5. Is my homestead protected from judgment creditors?
Article X, Section 4 of the Florida Constitution protects Florida Homestead property from levy and execution by judgment creditors. Any property that is attached to the land is protected from creditors. This does not include personal property that is moveable, such as furniture.

On Thursday, February 9, GTR members made new connections and rekindled old ones over wings at our free mixer in Riverview!
Members of the Governmental Affairs Committee and RPAC major investors gathered at the Florida State Fairgrounds on Thursday, February 9 to attend the 2023 Governor's Luncheon. GTR was a table sponsor of the luncheon, which officially opens the historic Florida State Fair and features the Governor, his cabinet and some 1000 of Tampa’s top civic and business leaders.

Young Professional Network's RealMixes are back! The event had a nice turnout at the Tampa Bay Brewing Company. Aside from the food and beverage, there was networking and a fun trivia contest on Ybor City. CEO Jason Outman shared a few words and his vision for elevating broker and member engagement.
Homeownership is not only a keyway to creating generational wealth, but it also financially impacts our community in exponential ways. The real estate industry accounted for $293.8 billion (or 24%) of the gross state product in 2021, according to the National Association of REALTORS®. When homeownership becomes more accessible to more people, it benefits our state, community and industry. As we focus on fair housing this quarter, I want to highlight opportunities within Greater Tampa REALTORS® where both members and affiliate members can participate, donate and educate in the spirit of driving more homeownership opportunities in our community.
Per the GTR website, “The Real Estate for All Alliance (REFAA) is a diversity partnership between Greater Tampa REALTORS® (GTR) and the six real estate specialty groups in the Tampa Bay area. GTR formed REFAA to celebrate diversity and equal representation for homeowners from all backgrounds. This charitable organization was created to aid first-time home buyers in the form of a grant, which does not have to be repaid. Upon approval of the application, buyers are able to use those funds towards closing costs and downpayment. Additionally, this grant can be used with other down-payment assistance programs. In 2017, Tampa’s mayor began a program where city-owned vacant lots were awarded to builders and non-profits at no cost with the caveat that the land be developed and property sold at a capped sales amount to income-eligible buyers. This program has the dual benefits of developing unused land and providing homeownership opportunities to income-eligible prospective homeowners.
