Housewarming Traditions From Around the Globe A message from your 2021 GTR President Ellie Lambert Among the things we love about where we live is our amazing cultural diversity, which includes the food, art and traditions that weave their ways into our community.

The food would be cooked in a large pot over a fire, where the chimney hook could be used to raise or lower the pot to heat or cool the food.

As the saying goes, all real estate is local, but certainly not all home buyers. According to the National Association of Realtors® 2021 Profile of International Transactions in U.S. Residential Real Estate, global buyers spent an estimated $54.4 billion on housing between April 2020–March 2021, responding to attractive prices, economic stability and welldefined property rights.

India. In India, it is generally considered lucky to move into a new house on Thursday, while Friday and Saturday are the unluckiest days to move. Many also hold Griha Pravesh, a detailed ceremony intended to bring positivity and good fortune. This ceremony also has carefully chosen dates and specific customs, including sending guests home with sweets.

This is said to ensure that the homeowners will have a happy and prosperous life. Thailand. Thai tradition dictates that visitors should bring a new homeowner three items: rice, water and a knife. The rice and water are so that food will always be plentiful and the homeowner will know prosperity, and the knife is to protect them from any evil spirits. There is also a traditional ceremony known as ‘Sen Wai Jour Teen’, during which the homeowner asks the ‘Lord of the Land’ and any restless ghosts and spirits in the vicinity for protection through an offering of food and water, flowers and incense. China. Before moving into a new home, Chinese custom is to shine a light in every corner, closet and wardrobe of the house. This is said to let any lingering spirits know that it is time to leave and how to find the way outside. France. When construction of a new home is finished, the French throw a traditional party called the “pendre la cremaillere,” literally meaning ‘to hang the chimney hook.’ The phrase comes from medieval times when it was customary to invite over everyone who took part in the building of the house and eat dinner as a gesture of thanks.

ACKNOWLEDGEMENTS Congratulations to our Director of Community Affairs Joey Henderson for becoming a Chairman of the Community Action Board (CAB). In this role, Joey will administrate the meetings for the CAB/ Community Services Block Grant Board (CSBGB) of Hillsborough County. This tripartite board includes representation from elected public officials, the low-income community and the private sector. The board oversees over $2.3 million dollars of CSBG funding with an objective to advocate on behalf of low-income citizens. The CAB also advises the Hillsborough County Social Services Department, the grantee agency, in order to ensure proper administration, planning, development, implementation and evaluation of programs designed to alleviate poverty. Additionally, the CAB promotes and supports opportunities for individuals and families to achieve self-sufficiency, as it strives to help influence improvement in the quality of life for individuals and families who live at or below the federal poverty level. GTR welcomes Lisa Brosky as the new Director of Communications and Marketing. Lisa has extensive experience in brand management, marketing and crisis communication. Most recently she was vice chancellor for External Relations at Pima Community College in Tucson, Arizona, where she led a rebranding and a highly successful marketing program. She also has experience in government relations, fund-raising and corporate communications. Lisa has a master’s degree from The Ohio State University and a bachelor’s degree from Eastern Kentucky University. Lisa said she and her husband have planned a move to Tampa Bay since their first visit in 1996 and are happy to finally make it here. She is honored to join Greater Tampa REALTORS®. Tony Green has joined GTR as the newest addition to our Member Services team. Tony is originally from New Orleans, Louisiana. He is a graduate from Southeastern Louisiana University. Ascertaining Whether a Consumer is Subject to an Exclusive Representation Agreement

R

EALTOR® A was holding an open house for their client’s home, which had been on the market for several months, so REALTOR®A was thrilled to see Buyer C approach the home after two hours with no visitors. REALTOR® A gave her a tour of the space, but Buyer C indicated she was looking for more of a “fixer upper”, as she had almost singlehandedly completed some significant renovation projects in her previous homes, and was looking for the perfect next project. REALTOR® A had another listing that she knew was perfect for Buyer C, and hadn’t been listed in the MLS yet as the client had just signed their agreement earlier that morning. REALTOR® A described the home to Buyer C, and offered to show it to her. Buyer C replied, “Oh, thank you, I am actually working with someone. I should probably ask them about it.” REALTOR® A responded, “that’s fine, but to be honest, I’m not sure if your agent will even get a chance to see it. At the price at which it’s listed, I’m confident it will sell before I can even get it in the MLS.” Somewhat reluctantly, Buyer C agreed to let REALTOR® A show her the second home. REALTOR® A drafted an offer, which was accepted, and the parties completed a quick close. Proud of a job well done for her client, REALTOR® A was shocked when she received notice of an ethics complaint filed against her by REALTOR® B, alleging a violation of Article 16 for interfering with his exclusive relationship with Buyer C. At the hearing, REALTOR® B provided the hearing panel with copies of this exclusive buyer agency agreement

with Buyer C, and Buyer C testified that she did tell REALTOR® A she was working with someone, but felt pressured to tour and submit an offer with REALTOR® A or risk losing the house. REALTOR® A defended her actions, stating, “Listen, if I had known that Buyer C had an exclusive agreement with someone, I would have backed off. But she never said that she was working with someone exclusively; just that she was working with someone. It’s not my responsibility to fill in the gaps on what she told me or hammer her with questions and drive away a potential buyer just to determine what sort of relationship she has. That doesn’t serve my client well.” The Hearing Panel decided that REALTOR® A had violated Article 16, as Standard of Practice 16-9 provides, “REALTORS®, prior to entering into a representation agreement, have an affirmative obligation to make reasonable efforts to determine whether the prospect is subject to a current, valid exclusive agreement to provide the same type of real estate service.” As REALTOR® A had made no affirmative effort to ascertain whether Buyer C’s relationship with another agent was exclusive or not, the Hearing Panel concluded she had made no reasonable efforts to determine the nature of the relationship as required by Article 16.

Q: Article 10 in the National Association of REALTORS® (NAR) Code of Ethics has long required that REALTORS® not deny professional services or discriminate based on NAR’s list of protected classes. I heard that this rule was recently expanded to apply to a REALTORS®'s personal time, in addition to time working with clients and customers. Is this true? A: Yes. When NAR voted to approve a new Standard of Practice 10-5, which became effective Nov. 13, 2020, they also expanded the code of ethics to ensure this rule applies to all of a REALTORS®'s activities, whether “on the clock” or during personal time.

Q: What specific types of speech does this new Standard of Practice 10-5 prohibit? What are NAR’s categories of protected classes? How to Market Real Estate Globally

International buyers invest billions of dollars in the U.S. housing market. They view the United States as a place offering favorable opportunities. Attracting foreign buyers has its challenges, but the benefits should not be ignored. According to the National Association of Realtors (NAR), the national dollar volume of foreign buyer residential purchases during April 2019 to March 2020 accounted for $74 Billion. With this, the top destinations for international buyers are Florida attracting 22% of foreign buyers, California with 15%, Texas 9%, New York accounted for 5% of foreign buyers and New Jersey at 4%. Other major destinations include North Carolina, Arizona, Minnesota, Georgia, Illinois and Virginia. “NAR reports that foreign buyers tend to flock to specific areas of the country. For example, many buyers from Asia purchase property in California. Mexican buyers tend to buy homes in the Southwest, while Canadians and Europeans are attracted to the East Coast.” Thus, publishing your properties internationally is a start but it is necessary to be aware of some tips for success to connect with the buyers. Know Your Buyer It is important that when you work with foreign buyers, you remain persistent. Get to know your buyer as well as their property requirements, hobbies and culture.

Then, prepare for potential questions your clients may have. Such questions include the cost of living, educational opportunities, healthcare system and possibly things to do in the area. Respect Cultural Differences Succeeding in the global real estate market entails a lot of patience and respect for cultural differences. Consumer behavior is strongly influenced by culture, where the western culture is different from the eastern culture. Thus, understanding the clients’ customs are one major skill that directs the success of acquiring an international buyer. Build Connections It is important to build a network across the globe. Partnering with other real estate agents in the country of your potential buyer is important. Establishing partnerships also increases your knowledge of your potential buyer’s culture. Having a website or a social media platform where you can showcase your listings allows you to connect with almost anyone in the world. This will surely help define your overall marketing strategy. The Dollars are in the Details What You Need to Know About Land Use Due Diligence in Florida

by Derrill McAteer One of the toughest discussions a land use lawyer can have with a prospective client is telling them they cannot use the property they closed on “as-is” for their desired use. Often, a plan can be crafted to resurrect the investor’s cash flow goals. But sometimes, too many uninformed and expensive choices have already been made. A small expenditure for land use due diligence and review during a defined period in the contract, with local government approval contingencies to closing, can help ensure successful cash flow. What should this due diligence include? 1. The Future Land Use Map and Comprehensive Plan State statute requires every local government in Florida to adopt a “Comprehensive Plan,” complete with a “Future Land Use Map” detailing what “Future Land Use Category” applies to a parcel or area. Each plan must include at least two planning periods, one that covers at least the first five-year period after the plan’s adoption and one that covers at least a 10-year period. More planning periods for specific components, elements and land use amendments to the plan are allowed as part of the planning process. For due diligence purposes, the Future Land Use Category is arguably the most important aspect of the plan. Future Land Use Categories set forth: • A list of goals and general uses • The allowed residential density • The commercial or mixed-use allowable Floor Area Ratio (FAR) FAR is the measurement of a building's floor area in relation to the size of the parcel the building is located on. It is expressed numerically and is derived by dividing the total area of the building by the total area of the parcel (building area ÷ lot area). If the Future Land Use Category allows a FAR of 1.5 on a 100,000-square-foot commercial parcel, 150,000 square feet of usable square footage may be constructed. This is subject to local parking requirements, impervious surface limitations, landscaping requirements, traffic, etc. FAR may be increased by bonus incentives set forth in the language of the Future Land Use Category or other parts of the plan that encourage improvements and community amenities in the development.

With regard to residential density, a Future Land Use Category may allow up to so many residential dwelling units per acre, whether they be single or multi-family in nature. Residential density is usually subject to many of the same limitations as commercial FAR. It may often be augmented through bonuses similar to those allowing for more dwelling units per acre. However, if a parcel is purchased with a Future Land Use Category that does not allow for the intended use, it will require several months of review by local government staff and an approval vote by the local governing body. If the parcel is larger than 10 acres, the application must be submitted to the state for review. Upon receipt of a comment letter from the State Land Planning Agency, the local governing body has 180 days to adopt, adopt with changes or decline to adopt the amendment. The adopted amendment is then submitted to the state and regional review agencies for final comments. It cannot take effect until 31 days after adoption. 2. Zoning If the parcel carries the proper Future Land Use Category, the next step is to confirm the proper zoning for its intended use. Every city and county in Florida is required by statute to have its own land development code. Thus, a category labeled “General Commercial” can mean 67 different things in the 67 counties, as well as the many hundreds of incorporated municipalities across the state. Conversely, categories labeled generically as “Light Industrial” or “Heavy Industrial” can carry similar variations across the state, and in many cases prohibit less intense uses that one might assume would be allowed. Cities and counties will often require a planned development (PD) rezoning if parcels are so codependent or complex that zoning approval depends on a replat and is governed by a heavily detailed and engineered site plan. This can be expensive to discover after a rushed closing. If a jurisdiction is going to require a PD, it’s better to know that going into a deal and structure proceedings accordingly.

another time period (often up to six months or a year) to apply for and obtain the entitlements and permit approvals needed to use the property for the buyer’s intended use. These contracts are complex. They must mesh well with the process outlined in the land development code of the jurisdiction in which the parcel is located. Form agreements such as the FAR/BAR and REALTOR® Association contracts can be utilized, but specific addendums should be included to allow for the unique land use due diligence and approval contingences required for specific properties. So, what should you keep in mind before buying property for a certain use? There are many other factors that affect the available or approvable uses of a property, like: • Property tax classifications • Water use permits • Wetland delineation • Traffic impacts and the presence of sufficient road capacity • Potential impact fees for new construction • Intense uses • The present and future availability of utilities (including water and sewer) But careful and proper due diligence review of a property’s land use, including the comprehensive plan and zoning, coupled with a purchase and sale agreement drafted for the buyer’s specific requirements, can make a big difference in the success or failure of the investment. How can contracts help you perform due diligence? The proper way to obtain land for specific development is via a contingent sale contract. This kind of contract gives a generous study period (such as 60 days) for proper due diligence. LORENZO ACEVEDO Born and raised in Brooklyn, New York, Lorenzo Acevedo Enlisted in the Army at the age of 19. After serving around the world and country, including a combat deployment to Afghanistan, Lorenzo decided to make Tampa his new home in 2008. After retiring from the Army, Lorenzo owned and operated several businesses making Real estate his primary. NICHOLAS ACOSTA Many in St. Petersburg know the name Acosta by way of Bayfront Health St. Petersburg: Dr. Anthony Acosta was the emergency room medical director there for 46 years, until his death from cancer four years ago. Now, his son Nicholas Acosta has moved home to St. Petersburg, bringing his real estate business, Downtown Expert Realty LLC, along with him. Nick hopes to honor his family’s legacy by serving the St. Petersburg community with as much integrity and commitment as his father. RICHARD DOMBROWSKI As the Broker/Owner of Bay Realty of Florida, Richard Dombrowski has built a successful team of 11 agents. The very first (partial) year of Bay Realty’s existence was a profitable one. Always innovating, Richard has managed to improve sales and closings year after year. As COO/Broker of Valencia Realty, Richard enjoyed holding the title of ‘#1 Listing Agent in Florida’ for five consecutive quarters. He held as many as 325 listings while managing an administrative staff of seven and a sales staff of 30 agents. Richard recognized the need for innovative solutions to issues like vacant listings being vandalized. Reacting to the market, Richard opened Home Caretakers International to successfully combat those very issues. After enjoying a successful on the Chicago Board of Options & Chicago Stock Exchange trading floors in Chicago, Illinois, Richard migrated to Florida. He began his career in homebuilding as a sales person with Centex Homes in 1994. With Centex, he amassed a variety of experience holding several positions within the company. His division closed 225-345 homes generating revenues of $56 million to $78 million respectively. Raising pre-tax profit from $8 million to $17 million brought the division to a ranking of #1 within the nationwide company. Richard accepted a position as Vice President of Sales and Marketing with Ryland Homes in Tampa, Florida. In his five years there he was responsible for increasing annual sales from 425 to 1,050. He opened and staffed 22 communities in six counties with a variety of product offering that he assisted in developing. During that time, Richard established the sales & marketing budgets for the division and set sales goals to meet them. Over the next seven years, Richard worked as a Vice President of Sales and Marketing, Region Vice President of Operations, and most recently as Division President for a national homebuilder. As Division President of the Tampa division, he increased sales by 48% by the end of the first half of 2007. Richard exceeded 2007 earnings by 20% over business plan, reduced average cycle time by 55 days to 97 days, improved customer satisfaction. His success in the business can be attributed to his ability to assemble award-winning and record-breaking teams wherever he has been. Richard obtained his Bachelor’s Degree in Business Management from Eckerd College where he graduated with honors in 2014 and lives in Land O’ Lakes, Florida with his wife and daughter.

In the late 90’s he served as Executive Director for the Ruskin Chamber of Commercea nd graduated from the University of Florida’s Wedgworth Leadership Program for Agriculture and Natural Resources. Later, He joined the Southwest Florida Water Management District as the Government Affairs Manager for the Central Florida and was responsible for fostering a new regional water supply authority. ROGER VERSZYLA After Roger was Honorably discharged for his 3 years’ time spend in the US Army, he then went off to college to get his degree and was offered an opportunity to spend the next 45 years working for major contractors as a business manager that cause him to locate from working in Algeria to the North slopes of Alaska and many places in-between his assignments. His responsibilities included the managing of the financial affairs of those companies, from recruiting, purchasing, OSHA compliance, contract administration, client negotiations and held accountable for every dollar spent on those projects. Approximately 20 years ago, Roger decided to get his Real Estate and Community Association licenses and has kept them active but did not work the licenses until his retirement. Since his retirement, he has been active with his involvement GTAR and various committees. His Real Estate career has primary been focus in the management of properties, rentals, and some sales. Disruption in foreign purchase of American Real Estate by Jennifer Lalji Everyone has been affected by the COVID-19 crisis in one way or another, no more so than real estate, particularly the international market in the U.S. Real estate accounts for nearly 1/5 of the U.S. economy, so when health concerns spread and state-at-home and lockdowns orders were enacted globally, the real estate industry took a collective breath. While buyers in the U.S. inexplicitly went on a buying spree, the same was not true of international buyers. The market felt the impact. Sales of U.S. homes to foreign buyers fell by 31% from April 2020 to March 2021, according to the National Association of REALTORS. At just 107,00 properties, it was the lowest unit volume and lowest dollar volume since 2011. “The big decline in foreign purchases of homes in the U.S. in the past year is no surprise, given the pandemicinduced lockdown and international travel restrictions,” NAR chief economic Lawrence Yun said in a release. Foreign buyers also responded to the uncertainty of the American real estate market, particularly early in the pandemic. For Florida, the news was not all bad. For the 13th straight year, the Sunshine State led among top destinations for international buyers with 21% of all international purchases. California ranked second (16%), followed by Texas (9%) and Arizona (5%). New Jersey and New York tied at 4%. Perhaps, in more good news, international buyers still believe the U.S. is a good investment. Home prices are comparably more affordable, especially for buyers in

places like Hong Kong and London, and opportunities to use homes for vacation rentals is strong. Others, particularly Chinese buyers, seek homes for their children taking advantage of educational opportunities in the U.S. While acceptance of vaccines and lifting of travel ban restrictions are expected to have a significant impact, technology may make the biggest difference. Just as technology has supported virtual home buying in the U.S., it has been adopted internationally, helping foreign buyers feel more comfortable in their decisions. Agents and brokers can meet face-to-face via Zoom and other platforms. From virtual video tours and 3-D model renderings as well as applications such as Google Maps and Google Duo, consumers globally have more access from their homes to U.S. markets than ever before. Juwai, a Chinese website for buyers of overseas property, says it now features more than 5,000 virtual tours. Every aspect of the home buying journey from walk-throughs, negotiations, contractual signings and closings can take place without ever setting foot on a property from nearly anywhere in the world. Florida Realtors® has embarked on a historic statewide effort to place a constitutional amendment regarding affordable housing on the 2022 General Election ballot. This amendment would guarantee that the portion of the taxes charged on documents like deeds and mortgages will only be used to make homes and apartments safer and more affordable for seniors, low-income and moderate-income Florida residents. The intended purpose of these funds is that they be used for housing programs, but for nearly two decades the legislative process has resulted in billions of these dollars being used for non-housing projects.

Voting YES for the amendment would make sure these funds only go to affordable housing projects— but first, we need to get the amendment on the ballot!

I had the honor of speaking with the March Affiliate of the Month for Greater Tampa REALTORS® (GTR) Kenneth, or has his friends and associates know him, Kenny, McLaurin. In a time when all events were canceled and networking turned exclusively to Zoom events, Kenny immersed himself and began immediately to build relationships, which led to being awarded Affiliate of the Month in March of 2021. Being an owner of his own company, our meeting was first thing in the morning. He is a Michigan native from the Ann Arbor area. Kenny ran and operated a successful home inspection company in Michigan for eight years before deciding it was time to exchange the white snow for white sand. He and his wife found themselves in the Tampa area and loved it! His company, McLaurin Inspections, does both Residential and Commercial Inspections. Here’s how the interview went:

Me: In your opinion, what is the most important thing to focus on as an affiliate member? Why?

Kenny: For one year and three months. We moved from Michigan in March of 2020. One of the first things I did immediately was join the Greater Tampa REALTORS®. Me: A lot of affiliates vie for the recognition of Affiliate of the Month. Tell me about being Affiliate of the Month in March.

Me: What advice do you have for a new affiliate member? Kenny: You have to get involved. And by involved, I mean talk to people, get to know them and let them get to know you. People will send you business when they know and trust you. It is all about relationships and partnerships. Build your core team. You will find that everyone will support each other.

Kenny: Find your balance. Get involved. This is a community where everyone is working toward a common goal. And, along the way you will find your business growing.

It’s harvest time in Plant City, and the smell of fresh strawberries hangs in the air thick as jam, sweet enough to taste. Just flick your tongue in the breeze and see. The plump red berries are what most people imagine when they think of Plant City, and while strawberries are indeed king in the World’s Strawberry Capital, there’s something else in the air these days: the scent of success wafting through the rural community. After years of just “being there” east of Tampa and mostly unnoticed, save for the week of the Strawberry Festival, it seems homebuyers have all suddenly taken notice of Plant City, which appears to be enjoying its moment. Seems these days, just as the plump, red berries are picked in the Plant City fields, homebuyers more and more are picking Plant City. Wayne Wiggins, owner-broker of Plant City Realty, Inc., understands. He’s generation number five in Plant City, and he’s been wondering when people would finally get it—when they would figure out there’s a lot more to Plant City than just its famous fruit. “Builders have finally discovered us,” said Wiggins, who concentrates his real estate business there. He notes that new housing is booming, more is coming and the supply of pre-owned homes is low due to high demand— something driven by more working families choosing the town ideally situated midway between Tampa and Orlando

work centers. Add the ease of commuting in either direction to value pricing, an abundance of country charm, and an old-fashioned, small-town feel, and the rush to Plant City is more than understandable, said Wiggins. “As I like to say, we’re having our 15 minutes,” he said. Wiggins’ Plant City ancestors go way back (some slung muskets in the Civil War). A town street bears his family name. It’s changed over the years, but Wiggins said despite the surge in growth, no one need worry that development will spoil Plant City. Its leagues of guardian residents and founding families are smart, the city’s leadership and planners are just as sharp, and wise enough to control growth using good ol’ “common sense.” New people coming sometimes may have a tendency to try and make their new hometown into the one they came from, Wiggins lamented, but Plant City leaders—its movers and shakers—have a “way of tempering that,” and they jealously protect Plant City’s wholesome, country character, Wiggins said. The new chapter in Plant City began when improving the city’s parks, streets and revitalization efforts downtown began to “get traction,” he said. When

the nation’s largest builders began to show up, things began to really roll. Companies like DR Horton and Pulte Homes are building in the city, and Plant City has annexed parts of Hillsborough County to accommodate some of that building. Seems the builders like Plant City as much as the families buying their new homes, something Wiggins attributes to the fact that the city works so well with developers. Plant City officials are “friendly,” is the best way Wiggins said he can put it, at least compared to Hillsborough County. By friendly he doesn’t mean easy and willing to give away the store. He means easyreasonable—easy, practical and realistic. The planning and building process is “less cumbersome; they use common sense and decisions are made based on what is a good idea,” said Wiggins. Plant City’s new homes are now known as some of the best values going. Young families can get into new 3/2 Plant City homes for around $200,000, Wiggins said. If you’ve got $300,000 to spend, count on that home being a “really nice one.” At the low end of the pre-owned market, an older family home that needs some fixing might come in below

$150,0000. A large mobile home on enough land for livestock can be had for $150,000 to $200,000. The problem is demand exceeds supply, Wiggins said. Still, prices remain stable and comparatively attractive. He does advise having financing in order, as considering a deal too long could mean watching it get scooped up by a better prepared buyer. The pre-owned market is a diverse mix of historic woodframe farmhouses and small bungalows, to large, two-story executive and manor homes on acreage that push $1 million. For those who imagine Plant City is poor farm country, think again, Wiggins said. “Plant City is not a poor town,” he said. “There’s a lot of old money and new money” and many homes are valued between $500,000 and $1 million. Be it a mobile home or a mini mansion, what one can’t put a price on is the smalltown feeling Plant City exudes, said Melissa Poage, an agent with Signature Realty who grew up there. It’s grown over the years, but retains its smalltown charm, she said, something rare these days. “It’s still America’s small town,” she said of Plant City. “It’s community-minded, family oriented; it’s just that it’s grown.” Many who grew up in Plant City leave for careers only to return years later, she said, adding it’s the kind of place with the power to call one back. home“It’s comforting, towny, yet it’s close to everything,” she noted, referring to the easy drive into neighboring Tampa. Many who live there commute to work in Tampa, St. Petersburg or Orlando, she said. It’s a safe place, kid friendly, the schools are good and it has the wide-open country spaces that are a sure cure for urban claustrophobia. People know each other, and it’s
