PRESIDENT’S CORNER

It seems like just yesterday... It seems like just yesterday, when I shared with you in December 2019 the vision and commitment to the work ahead of us for 2020. I was also excited for the challenge; however, I had no idea of the challenge all of us would face with COVID-19. Our plans for 2020 spoke of collaboration both domestically and globally, embracing our community with a commitment to be boots on the ground in partnerships that would support the needs and be a part of growth for Greater Tampa Bay. We also spoke of the fact that we stood on the strong foundation our previous leaders had built, and it was our job to reach higher by adapting to the changing environment, strengthening our value proposition and unlocking new opportunities. I am humbled by the volunteers and staff of Greater Tampa REALTORS® (GTR) who have worked diligently to meet our plans and vision for 2020 AND exceeded all expectations of the vision during a global pandemic, WOW! The hard work and commitment are recognized in the achievements of the 2020 team. Early in the year, we joined forces with the Pasco REALTOR® Organization (PRO) in collaboration of our educational calendar and offered more opportunities for our members than ever before through virtual platforms. The pandemic created an environment in which none of us had ever experienced, a global shutdown. GTR put into action a plan to support our members even though our doors had to be closed due to the pandemic. A huge thank you to our CEO, Dennis MacDonald. The Global Committee hosted delegates from Spain in February at the Columbia Restaurant, they further continued to unlock opportunities in the international markets by hosting virtual inbound and outbound trade missions for our members - a job well done indeed as they were awarded the Platinum Global Achievement Award from the National Association of REALTORS® (NAR). A special thank you to Anand Patel and Marlene Cambronero. Our Community Outreach Committee has been amazing in supporting our communities, we sponsored our first Habitat for Humanity build, which was most humbling as we celebrated with a drive by parade hosting the family on move in day! The committee has continued throughout the year in many other partnerships and support including the Heart Walk, food drives, volunteering with Metropolitan Ministries Holiday Tent, participating in a Hillsborough County park restoration day with a grant from NAR and so much more; so proud of them! A special thank you to John Daux and Joey Henderson. The Events Committee was responsible for our first GTR virtual convention. What an incredible three days of educational opportunities, keynote speakers, technology and a global trade mission. The committees and staff did an amazing job working within the virtual landscape platform and engaging so many members! A special thank you to Diana Kurtz and Grace Smith. 2020 was an important election year and our Governmental Affairs Committee delivered, with due diligence in screenings of candidates during COVID-19, collaboration and commitment, we did very well with our support and our percentages to those who were elected. It was a great year of information and dedication! Thank you Andy Scaglione and Jacob Bruynell! RPAC - Another great job! Although we could not engage in our typical fundraising events such as the Chili Cookoff, this team worked creatively and met the goal for 2020! Thank you Connie Johnson and Gypsy Perry! The Future of GTR - We brought forward our first three-year strategic plan and hired a professional consultant to carry GTR into the future with new resources, partnership opportunities and so much more that will empower our members to not only survive but thrive into the future! This is an exciting time for GTR. Additionally, a few of our GTR members received Florida REALTORS® state award recognitions for their achievements this year, congratulations to all. As this year comes to a close, I want to thank each and every one of you for allowing me to be your 2020 President. It has been an honor to DARLENE DAVENPORT serve you and a year I will always remember! I am extremely grateful 2020 President for the amazing and spirited leadership of the Board of Directors, the staff and all our volunteers. You make the difference for Greater Tampa REALTORS® and its members; I am excited to see the continued efforts in 2021 and beyond. She provides assistance with ethics complaints/concerns, commission disputes, mediations and advising of NAR procedures and guidelines. National Association of REALTORS® Global has awarded Greater Tampa REALTORS® the PLATINUM Global Achievement Program Award. This is the third time GTR has received Platinum Council recognition from NAR. The start of this quarter ushered in an unexpected turn of events for us all. The impact of the COVID-19, sadly enough, has claimed many lives, brought some businesses to a crawl and forced the temporary closures of several industries. The entire social-distancing experience has set forth new paradigms to conduct real estate transactions. Showing a home, meeting with prospects, obtaining signatures and even closings have required us all to adopt electronic methods of execution.

Some of you have taken this time to participate in the Commitment to Excellence (C2EX) contest. Earning this designation ultimately builds your credibility as a professional REALTOR®. We are also excited to see many of you taking advantage of your free access the David Knox Real Estate Training Video Library. This online, on-demand video training provides access to videos, support materials and action plans specifically for real estate agents.

Rest assured your Association is here for you. Staying abreast of all the latest developments, we quickly mobilized our entire operations to enable our members can meet the new normal. To keep you informed of the latest news, our staff added a COVID-19 page to the GTR website. In addition to the site including REALTOR® business changes from our state and national associations, staff sought information related to Safer-at-Home, economic assistance and resources from our county, state and national governments. With the contributions of the executive board, senior staff and personnel, a plan of action was created to navigate our transition to providing 100% virtual support.

It was good to see members watched and asked questions of our elected officials and the presidents of NAR and FR during sponsored Zoom forums. Also, the virtual classes have been very well attended. Our educators and Affiliates continue to play a major role in helping to make these important Zoom forums and classes available for you. We truly value our REALTOR® educators and Affiliate sponsors. Our committee leadership have also done a commendable job to continue assemblies through conference calls and video meetings. The following items were acted upon at the September 2020 Meeting: ✓ Move forward with the new company for the Relocation Guide. ✓ Have Dennis MacDonald involved with the Leadership Tampa Bay program. ✓ Send the amended bylaws as amended by Executive committteee on this date to the BOD. ✓ Send the 2021 Budget to the BOD for approval (BOD ratified the budget). ✓ Provide $500 as a 10% investment to secure $5,000 total for a NAR's Placemaking Grant to support the public community garden at the Apollo Beach Recreation Center. ✓ Approve $170.40 to pay for the Spanish translation of the GTR Home Buyer Toolkit

CODE OF ETHICS Appeal of Grievance Committee Decision

R

EALTORS® A and B were partners in a building company. They both held membership in the XYZ Board of REALTORS® and were Participants in the Board’s Multiple Listing Service. After many successful years, they decided to terminate their partnership with REALTOR® A continuing the building business and REALTOR® B forming a new residential brokerage company. As part of their termination agreement, REALTOR® B agreed not to build new homes in the XYZ Board’s jurisdiction for a period of twelve months. Six months later, REALTOR® A filed a written request for arbitration with the Professional Standards Administrator of the XYZ Board of REALTORS®. In his request, REALTOR® A outlined the terms of their partnership termination agreement pointing out that REALTOR® B had continued to build new homes in violation of their agreement. REALTOR® A demanded that the Board take action to enforce the agreement and compel REALTOR® B to refrain from any further construction. The Professional Standards Administrator forwarded the arbitration request to the Grievance Committee for review. After review, the Grievance Committee found the matter not properly arbitrable. REALTOR® A was upset with the Grievance Committee’s decision and appealed to the Board of Directors. The Board of Directors noted that Article 17 of the Code of Ethics requires arbitration of disputes “ . . . between REALTORS® associated with

different firms arising out of their relationship as REALTORS®.” If REALTOR® A were requesting arbitration of a dispute arising out of a real estate transaction (such as a dispute concerning entitlement to commissions or subagency compensation), this would be a properly arbitrable matter. However, the Directors noted that the dispute in question related to the provisions of a partnership termination agreement which the Board had no authority to enforce. The Directors advised that while the Board’s arbitration facilities were available to settle disputes between members, buyers, and sellers related to real estate transactions, the Board’s authority did not extend to ordering performance of contracts since this was properly the privilege of the courts.

Q: One of my listings is about to close. The seller asked me to give him a portion of my commission at closing. I would like to do so but I’m not sure if it’s permissible under Florida’s real estate license law. Is it? A: Yes. Florida Administrative Code rule, 61J2-10.028(2) provides “[t]he sharing of brokerage compensation by a licensee with a party to the real estate transaction with full disclosure to all interested parties is not considered a violation of Chapter 475, Part I Florida Statutes.”

Q: Does the seller of a residential condominium resale have a set amount of time, as a matter of law, in which to provide "condominium docs" to the buyer? A: No. However, the buyer has three days (excluding Saturdays, Sundays, and legal holidays) from the time he or she receives the documents to rescind the contract, so it's in the best interest of the seller to provide the documents as soon as possible.

Moments of Gratitude in 2020

The last few months of the year usher in a period of reflection for many of us. Family meals, gift exchanges, donations, resolutions and volunteer opportunities have evolved into an end-of-year ritual. In 2020, our dayto-day life has adapted to tough circumstances—and for this reason the Young Professionals Network (YPN) deems it even more essential that we show our gratitude to those who deserve it! Though many of us have faced hardships this year, there is a lot to be thankful for. Here’s how our YPN’ers are reflecting on and acting with gratitude this year: I’m grateful for all the silver linings that 2020 has brought for me, my family and my business. I’ve learned to slow down and appreciate things more, spend more quality time with my family and nurture my business relationships into more personal relationships. I would have to say the highlight was finding out that I’m going to be a MiMi, which I am SOOO thankful for!

I am grateful for YPN and all of the amazing individuals I have been able to meet through it. When times get tough, I know I can pick up the phone and call one of my fellow YPNers for advice!

No one could have predicted these unprecedented times we are facing today. What kept me going was the love of my family, my health and my amazing job. In addition to that, being able to see people flourish during our Young Professionals Network meetings really motivated me to drive more business. It is a constant reminder to remain optimistic and remain grateful for every opportunity that presents itself to me.

This year has been unlike any before, forcing all of us to spend a lot more time at home. Unfortunately, it has created some unintended consequences by increasing the rate of domestic incidents. I believe the home is the place everyone should feel safe. Therefore, I have been volunteering my time at The Spring of Tampa Bay. I am grateful for the warm environment they provide everyone, including their volunteers.

In 2021, Focus on a Personal Touch by Tracy Wisneski Personal touches have always been part of real estate, but sometimes fall to the wayside with sales goals, digital marketing, increased competition and a host of other distractions in our industry. With all the challenges we’ve faced in 2020, it’s more important than ever to focus our attention on personal touches with our clients as we begin the new year.

Promote Small Businesses in Your Community.

Pick up the phone!

Partner with them! Are you hosting a buyer class or open house? Reach out directly to a local small business for catering. There are many great ways to promote local small businesses and be part of your local communities.

I know! This is most agents’ least favorite activity, but it’s an important one. A call is typically best because it allows for dialogue, but you know your clients best, so text first if that’s their preference. This personal communication is arguably the strongest tool in your toolbox. It’s more important than ever during this time of social distancing and fewer opportunities for personal interactions.

What to say?

Did they close on their house this year? Even though you probably told them about filing homestead exemption, they may have overlooked it. Reach out to see how they’re doing and ask if they’ve gotten their homestead filed yet. If they haven’t, you can resend them the links and information to help them get that done. You’d be surprised how many buyers overlook this important step and forgo big savings in the process. They’ll appreciate the guidance. Do they have school aged children? Point them to helpful resources like articles on virtual learning, remind them of timelines for school choice, let them know about community family events. Maybe they’ve begun working from home. You can suggest some articles on how to prepare their workspace and manage the challenges of working from home.

Local, small businesses are an important part of their communities and many are struggling these days. Share their posts, go by to video them for a quick interview or take a picture of yourself at their store to promote on your social media pages.

Sponsor Schools in Your Neighborhood.

Spending your marketing dollars to help your local schools is a great way to remain connected to community residents while helping a great cause. Everything from field banners to sports guides and lots in between. Better yet, volunteer some of your time. It’s an excellent way to form strong community ties. As we look to 2021, take some time to consider how you can best create and foster strong relationships for a robust and lasting business built on referrals. COMMUNITY OUTREACH

Safely Serving Others Despite A Challenging Year by Joey Henderson Before COVID-19, the members of the Greater Tampa REALTORS® (GTR) Community Outreach Committee, anxiously looked forward to advancing the Association’s mark of participating in the community and neighborhood events. The establishment of community outreach helped to further formalize the association’s effort to support the community. The committee was on its way by participating in its first event, the City of Tampa’s Community Resource Fair at Jefferson high school. With successful community exposure, a few minutes of radio airtime and engaging potential homebuyers, committee members unanimously voted to participate in the city’s quarterly event. Unfortunately, like so many events, COVID-19 canceled the three remaining quarterly resource fairs. One would think the pandemic would have ended charge for GTR‘s Community Outreach Committee. On the contrary, Community Outreach was able to pivot in the face of uncertainty to rise up to its motto of REALTORS® doing good in the community. With encouragement and support from 2020 President Darlene Davenport, Chairman John Daux and Vice Chair Kieanna Carty, the committee marched on to lead GTR in accomplishing some new outreach ventures. During the pandemic the Community Outreach Committee was the title sponsor for Hillsborough County's Habitat for Humanity’s first Real Estate Build where GTR members participated in a parade of cars celebrating the sweat equity accomplishment of the Barnes and other Habitat families. With the pandemic disrupting the good works of organizations like Metropolitan Ministries and Everyday Blessings, GTR lead the way to collect 2,000 pounds of food and supplies and collected over $7,000 in funds for both organizations. In the last quarter of 2020, with the help of our colleagues from the Real Estate for All Alliance and friends, the committee raised over $3,400 for the American Heart Association (AHA). Also to support the virtual Heart Walk, several members of team Greater Tampa REALTORS® & Family! gathered at GTR the morning of Saturday, November 14 to make a 5.2-mile round trip trek from GTR to Bayshore. Properly masked and social distanced, the team enjoyed the brisk walk, sharing stories, waving to passersby and posting photos to AHA’s Heart Walk social media.

Four days later on Wednesday November 18, with the help of the National Association of REALTOR®’s (NAR) $3,000 Community Rebuilding Grant, 25 GTR members assisted employees of Hillsborough County’s Parks and Recreation Department with the revitalization of Northlakes Park. In collaboration with members of GTR’s Board of Directors executive team, Governmental Affairs and REALTOR® Party Committees, members of Community Outreach sanitized the concession stand, laid mulch installed plants and a variety of trees for the park, which had suffered from vandalism and arson.

In addition to participating in a food and supply drive for ECHO and a gift card toy drive for Voices for Children (in partnership with GTR's Young Professionals Network), to complete this year of outreach, committee members will conclude the year by volunteering at Metropolitan Ministry’s Holiday Tent food distribution on Friday, December 11. With masks and gloves on, GTR members will place groceries in the trunks of cars of appreciative families in need.

Led by the Community Outreach Committee, GTR was able to safely serve others despite this challenging year. To summarize GTR’s call for “boots on the ground,” Chairman John Daux stated, “My favorite experience as the leader of the Community Outreach Committee is working with the committee members and GTR staff to reach our goals of giving back to our community and creating a strong presence for our association. It was such a pleasure working with a group of folks that are selfless and passionate towards the cause. With the pandemic we could have easily rolled over, but this team was innovative and found ways to make our presence felt in the community with a combination of virtual, boots on the ground and fundraising events. This is a group of true servant leaders!”

As remote work became the new normal, homes now serve as an office, school, gym and place of entertainment. These changes have increased homebuyers demand for single-family homes with more square footage. It has also transformed what buyers want and need in a home. Keep reading to learn what to expect from new developments, condos and buyers. Goodbye Open Floor Plans. Open floor plans are no longer desired. Buyers need barriers to buffer noise. You can expect new construction homes to include privacy nooks and pocket doors to close off open spaces. More Storage. Homebuyers are now in need of more space in their pantry, laundry room and garage. With COVID-19 cases surging, people are bulk shopping to cut down on trips to the grocery store. This trend is expected to continue until a vaccine is made available for the virus.

Outdoor Spaces. Homebuyers fear another shelter in place. Many are migrating to suburban areas in the South to have yearround access to outdoor amenities. Some luxury condos are beginning to offer private rentals for various items such as bikes and scooters. November has been widely recognized as REALTOR® Designation Awareness Month and I would like to share some of our exciting certification and designation classes, coming up in 2021. Did you know, a survey of REALTORS® conducted by the National Association of REALTORS® found that members with just one designation increased their income by over $27,600 (NAR Member Profile)! If you have not yet taken classes to obtain a certification or designation, now is the time to include it in your business plan. For our newest members, the Graduate REALTOR® Institute (GRI) is a seven-module designation, designed to give you an in-depth training in legal and regulatory issues, technology, professional standards and the sales process. This designation will set you apart and show you as a resource with expertise in the various areas of real estate. Did I mention, the 100 series will also complete your 45-hour post licensing requirement? GTR will offer the GRI 100 series four times in 2021 and you can complete your post licensing for $120. Members who would like to obtain the entire designation (GRI 100, 200 & 300) can do so in 2021 for only $360! For our global real estate professionals, we have plenty of opportunities for you to increase your knowledge base. GTR is offering the Certified International Property Specialist (CIPS), the Resort & Second-Home Property Specialist (RSPS) and the Global Real Estate Professional (GREP) in 2021. So long 2020, to say we are excited for 2021 is an understatement. This year has brought forward many challenges that we never thought we would face within our lifetime. However, as leaders, we use these experiences as learning lessons by reviewing where we fell short and how we can overcome the challenges. I am proud to say that we, as Affiliates, have done our best to OVERCOME! With the support of our amazing Greater Tampa REALTORS® (GTR) staff, we have been able to maintain our presence in front of our REALTOR® partners virtually and work together to help those clients needing to buy/sell a home. We have been able to host Affiliate Forums that help educate us on how to thrive in the new marketplace. We had an amazing REALTOR® Panel, which brought to life all perspectives from new to tenured REALTORS®. It goes without saying, we overcame the pandemic challenges with new strategies and mentality.

It’s harvest time in Plant City, and the smell of fresh strawberries hangs in the air thick as jam, sweet enough to taste. Just flick your tongue in the breeze and see. The plump red berries are what most people imagine when they think of Plant City, and while strawberries are indeed king in the World’s Strawberry Capital, there’s something else in the air these days: the scent of success wafting through the rural community. After years of just “being there” east of Tampa and mostly unnoticed, save for the week of the Strawberry Festival, it seems homebuyers have all suddenly taken notice of Plant City, which appears to be enjoying its moment. Seems these days, just as the plump, red berries are picked in the Plant City fields, homebuyers more and more are picking Plant City. Wayne Wiggins, owner-broker of Plant City Realty, Inc., understands. He’s generation number five in Plant City, and he’s been wondering when people would finally get it—when they would figure out there’s a lot more to Plant City than just its famous fruit. “Builders have finally discovered us,” said Wiggins, who concentrates his real estate business there. He notes that new housing is booming, more is coming and the supply of pre-owned homes is low due to high demand— something driven by more working families choosing the town ideally situated midway between Tampa and Orlando

work centers. Add the ease of commuting in either direction to value pricing, an abundance of country charm, and an old-fashioned, small-town feel, and the rush to Plant City is more than understandable, said Wiggins. “As I like to say, we’re having our 15 minutes,” he said. Wiggins’ Plant City ancestors go way back (some slung muskets in the Civil War). A town street bears his family name. It’s changed over the years, but Wiggins said despite the surge in growth, no one need worry that development will spoil Plant City. Its leagues of guardian residents and founding families are smart, the city’s leadership and planners are just as sharp, and wise enough to control growth using good ol’ “common sense.” New people coming sometimes may have a tendency to try and make their new hometown into the one they came from, Wiggins lamented, but Plant City leaders—its movers and shakers—have a “way of tempering that,” and they jealously protect Plant City’s wholesome, country character, Wiggins said. The new chapter in Plant City began when improving the city’s parks, streets and revitalization efforts downtown began to “get traction,” he said. When

the nation’s largest builders began to show up, things began to really roll. Companies like DR Horton and Pulte Homes are building in the city, and Plant City has annexed parts of Hillsborough County to accommodate some of that building. Seems the builders like Plant City as much as the families buying their new homes, something Wiggins attributes to the fact that the city works so well with developers. Plant City officials are “friendly,” is the best way Wiggins said he can put it, at least compared to Hillsborough County. By friendly he doesn’t mean easy and willing to give away the store. He means easyreasonable—easy, practical and realistic. The planning and building process is “less cumbersome; they use common sense and decisions are made based on what is a good idea,” said Wiggins. Plant City’s new homes are now known as some of the best values going. Young families can get into new 3/2 Plant City homes for around $200,000, Wiggins said. If you’ve got $300,000 to spend, count on that home being a “really nice one.” At the low end of the pre-owned market, an older family home that needs some fixing might come in below

$150,0000. A large mobile home on enough land for livestock can be had for $150,000 to $200,000. The problem is demand exceeds supply, Wiggins said. Still, prices remain stable and comparatively attractive. He does advise having financing in order, as considering a deal too long could mean watching it get scooped up by a better prepared buyer. The pre-owned market is a diverse mix of historic woodframe farmhouses and small bungalows, to large, two-story executive and manor homes on acreage that push $1 million. For those who imagine Plant City is poor farm country, think again, Wiggins said. “Plant City is not a poor town,” he said. “There’s a lot of old money and new money” and many homes are valued between $500,000 and $1 million. Be it a mobile home or a mini mansion, what one can’t put a price on is the smalltown feeling Plant City exudes, said Melissa Poage, an agent with Signature Realty who grew up there. It’s grown over the years, but retains its smalltown charm, she said, something rare these days. “It’s still America’s small town,” she said of Plant City. “It’s community-minded, family oriented; it’s just that it’s grown.” Many who grew up in Plant City leave for careers only to return years later, she said, adding it’s the kind of place with the power to call one back. home“It’s comforting, towny, yet it’s close to everything,” she noted, referring to the easy drive into neighboring Tampa. Many who live there commute to work in Tampa, St. Petersburg or Orlando, she said. It’s a safe place, kid friendly, the schools are good and it has the wide-open country spaces that are a sure cure for urban claustrophobia. People know each other, and it’s
