'll try to supply as much information in this big subject as our small page can allow. In case you need more details, I refer you to a useful book Fiqh as-Sunnah - by Sayyed Sabiq – is originally in Arabic, but you can find its English translation if you want. DIVORCE AS A LAST OPTION: Although divorce being allowed in Islam is a sign of the lenience and practical nature of the Islamic legal system, keeping the unity of the family is considered a priority for the sake of the children. For this reason, divorce is always a last choice, after exhausting all possible means of reconciliation. For example, Allah addresses men asking them to try hard to keep the marriage, even if they dislike their wives: ... live with them on a footing of kindness and equity. If ye take a dislike to them it may be that ye dislike a thing, and God brings about through it a great deal of good. - Surah 4 Verse 19 Also the following verse is addressed to women asking them the same thing: If a wife fears cruelty or desertion on her husband's part, there is no blame on them if they arrange an amicable

settlement between themselves; ... - Surah 4 Verse 128 Again, the following verse is addressed to the family or the society for the same purpose of rescuing this bond, which God did not make easy to break: If ye fear a breach between them twain, appoint (two) arbiters, one from his family, and the other from hers; if they wish for peace, God will cause their reconciliation: For God hath full knowledge, and is acquainted with all things. - Surah 4 Verse 35 But, if after exhausting all methods of reconciliation, the hatred between the husband and wife is still greater than tolerance, then divorce becomes inevitable. Here comes the genius of the Islamic law, which holds practical, rather than unrealistic approaches, towards real situations. The ultimate aims of marriage, as well as any other aspect of human life, are to achieve happiness and virtue. So, when people are denied their right to end an unhappy marriage, these two aims are seriously violated. This is, as the couple will live in suffering, which may lead them to marital infidelity. Thus divorce in this case – if weighed up to the disaster of family disintegration - will be less disastrous.


HAYATI FAITH METHODS OF DIVORCE: Men have the right to divorce. If a man dislikes keeping his marriage for any reason, he divorces his wife and compensates her financially by paying her what is termed mut'a payment. This is in addition to the regular financial sustenance for her living, in case she has the custody of their children. Divorce becomes in effect once the husband utters or writes down any of the legal formulae of divorce such as: ‘I divorce you’ or ‘you are divorced’…etc. The husband can do these either by himself or through a messenger.

n pre-Islamic times divorce was a weapon used against the woman solely in a man's hands; when he wanted to harm the wife he would seek to divorce her and then take her back as he pleased. There were no set rules and the woman had no rights in the matter. So Allah Allah (The Almighty) invalidated this injustice by revealing the verse which says:

(Divorce is two times: then one may retain with goodness (and reasonable terms), or let go with goodness (and reasonable terms).) [2:229]

The waiting period is to determine that she is free from pregnancy. In case of pregnancy, the woman has to wait until after delivery before she marries a second husband.

As a way to help preserve the marriage even when some differences occur, a Muslim man following the Sunnah (way)of the Prophet (Peace be upon Him) may only divorce his wife while she is clean from menses wherein he has not had sexual relations with her in that month. Since this requires some waiting period before the pronouncement of divorce, this allows time for any anger to subside or misunderstandings to be cleared up, and gives time to other family members or mediators to help in reconciliation. If they continue on the path towards divorce, then she must wait three menstrual periods. During this time, he may take her back honorably into marriage. HAYATI FASHION of us just magically woke up one day knowing exactly what Hijab is or how we should dress. If you did, please exit out of this screen because I do not want to waste your time. But in all seriousness, most girls can agree that dressing modestly has been a growing process. I can personally say I’ve learned so much in the past 10 years since I’ve consciously made the decision to wear the hijab. I’m not saying start with a hijab accompanied by a sleeveless shirt and a knee-length pencil skirt and tell everyone “don’t judge me, I’m growing in my hijab.” That’s ridiculous. I’m talking about the skinny jeans, cropped pants, leggings, the short blouses, the “bang-revealing” hijabis and all other aspects that could potentially label you as “dressed inappropriately.” You know what’s funny though, is that every single person I have ever talked to has defined “modesty” and “properly dressed” differently and because we, as dysfunctional and opinionated human beings, cannot agree on a definition, let’s go back to what Islam tells us. Islam has elevated the Muslim woman by ordaining her to fully cover her body in loose, nonrevealing garments avoiding the potential of outlining her body and its details. So realistically speaking and in a perfect world, the Abaya would be the best way to ensure that all of the above prerequisites are properly obeyed. Alternate to Abayas are long maxi dresses and skirts accompanied with loose tops. Many, including myself, are still in the skinny jeans phase but I tend to avoid leggings and jeggings. My shirts have gotten considerably longer (ok MUCH MUCH LONGER) and much less form fitting than when I initially began wearing the hijab (I can thank Allah and the evolving 38 HAYATI

modest fashion industry). My shirts reside about knee length and now every time I wear anything shorter, I feel uncomfortable. I usually end up driving home and changing. The point I am trying to make is that I didn’t just magically start dressing like this. I grew into it just like the majority of young women in my community and God-willing, I will continue to constantly improve on the way I dress. I was blessed to be surrounded by a supportive group of friends and family whom allowed me to make my own decisions WHILE slowly and gradually guiding me in the right direction. I do not remember a time when I was backlashed by anyone for the way I dressed but maybe that’s because I never really gave in to negative energy and always kept my head held high. I DID, however, always appreciate constructive criticism and tried to apply it to the best of my understanding. You know, the kind of criticism that makes you feel like the person in front of you REALLY cares about you and doesn’t want to just point out your flaws to feel better about themselves. Unfortunately, many other girls in my community were subjects of harsh and crude judgments, the kind of words that make you cry on the spot and when you question this person as being judgmental, you’re responded to with the ever-sofamous phrase of “I am only trying to give advice” or “This is not Islam and this is not hijab and we have to save Islam”. No, you’re not going to “save” Islam. However, THIS is what is completely and absolutely UNACCEPTABLE and THIS is exactly why we end up losing our youths to outside temptations. Whether that’s cutting themselves off from the communities, or girls taking

MUSLIMAH This month’s front cover of HAYATI is by far my favorite so far. It is so creative, colorful and a beautiful depiction of a Muslim woman, fashion, style, religion with a fiery personality. This cover is everything that represents HAYATI and it was magnificently illustrated by Momna Aakel. By Fatima Togbe At 22 years old, Momna Aakel lives in Brooklyn, NewYork (where she moved to from Pakistan with her family). She is a nursing student and aspiring doctor by day, Inshallah and an amazing illustrator by night.

HAYATI FEATURE Momna prefers working on fashion illustration but sometimes it just depends on what she is inspired by. Although her fashion sketches could lead you to picture her as an avid fashionista, constantly following the latest trends, Momna confesses that she is far from it. However, like most girls she dabbles in a little trend following here and there. Since she lives in NewYork, she has to walk a lot so being comfortable in whatever she wears is primarily what shapes her sense of style. I find it quite intriguing to know what her sense of style and her slight interest in a trend or two have no influence what so ever on her sketches. However, Islam does inspire her work. Momna explains that in the beginning, Islam did not really influence her work, but after she began to follow many hijab fashion blogs, she was inspired to try to incorporate the best of both worlds in one piece.

“I am far from a fashionista!” The response she has been getting from people across of the world has been “awesome so far Alhamdulillah” she says. Social Media has helped her to improve her art and has given her the type of exposure she could have never dreamt of. When I asked her what her goals were and where she sees her passion for art going, she replied “I’m taking it one day at a time”, which I believe is the best thing to do many times. Other than illustrating, Momna is a huge makeup and nail varnish collector even though she admits that she does not use them as much as she would like to. “I love love love applying henna on friends and family and if there is no one available I would just grab a white piece of paper and start designing on that with a henna cone”. I am really amazed by this young girl’s talent and by the front cover she sketched and designed especially for Hayati this month. I wish her all the best and may Allah swt guide her studies and her craft. 50 HAYATI

EDUCATION BEGINS IN

THE WOMB In the world, there is an estimate of three to four babies born every second! And when those eyes peep up at the mother or father, there is an undoubted instant connection between them. This baby knows you, miss mother...this baby knows you, mister father, almost better than you could have ever imagined. Your baby has been aware of his or her surroundings from within in the womb and that brings me to the point of this article, education begins in the womb. By Rumki Chowdhury

n Islam, the mother holds a very high status in the society. Paradise lies beneath her feet so the way to paradise for the child is to show an utmost respect to his or her mother. According to Muhammad (PBUH), the importance of the mother is three times above the importance of the father. The mother is also the school, she is the educator of her child or children and therefore, education begins within the home. What we often forget is that the baby’s first home

is within his or her mother’s womb and therefore, education begins within the home of the womb! Alhumdulillah, the miracle of fetus development into a fully-functioning human being contains careful steps. The first sense of the baby is touch which appears on week seven within the womb. "You especially want to lock [low cabinets] that contain household products that are dangerous because once your child starts crawling, he or she can get out cleaning fluids and drink them," Cronan says.
