Funds support Vocational Education Programs The Charitable Contributions Committee raises charitable funds to support Vocational Education programs each year. These funds support the Jimmy Johnson Memorial Vocational Education Fund at Habitat for Humanity of Forsyth County for the Voc Ed programs. They cover the hard costs of constructing Habitat houses built by vocational education students, one house by the Career Center and one house by Forsyth Technical Community College. The fund will grow further through the efforts of the development staff of Habitat for Humanity, who is responsible for securing major gifts from the corporate community. The HBAWS was the first business partner of a secondary education program in the state of North Carolina. “Learn by doing” has always been a tried and true technique in Vocational Education. The HBAWS is excited about this opportunity and believes that the Jimmy Johnson Memorial Vocational Education Fund is a great way for the HBAWS to support the Career Center and Forsyth Technical Community College in our efforts to train and educate future professionals in their field. The Carpentry curriculum is designed to train students to construct residential structures using standard building materials and hand and power tools. Carpentry skills and a general knowledge of residential construction are also taught.

New Year, New Voice... Hello, a New Year and for the next year a new voice will be coming at you in this column. We are all a little different and thru this column a few of you may see how different I really am. Let’s start with a disclaimer; the opinions stated here are mine and mine alone. You may agree or disagree, they may excite or incite you, but let’s hope they get you thinking and that that thought promotes action. When we cease to grow, cease to change, cease to question, we mark our end. January is traditionally a time for renewal. A time to plan for the coming year, envision new directions, organize energetic new undertakings, a time to begin. This year, 2010 is unique. We have all been through things in the past few years most of us never expected to experience, we have all made multiple choices between the lesser of two less than perfect choices, some have worked out and some have not. 2010 is unique in that we again have the chance to plan for the future... to begin again. I contend our unique opportunity lies in our attitudes. We can choose to see the landscape in front of us as dotted with land mines or filled with hidden opportunities, how we answer that choice will likely decide how we view 2010 looking back come December.
actually paying their suppliers like the terms of their buy/sell arrangements say; suppliers showing up on time, actually inventorying materials; bankers lending money to those who actually need it; realtors working to get the highest price for the builders who pay them……NAH, none of that wouldn’t be any good. Think what would happen if the media actually took the real estate statistics and reported things as half full instead of half empty,….. WAIT THEY ARE!! It’s our turn… 2010 will be a good year for many of us, those who plan for the opportunities, meeting the challenges with a positive attitude and remembering...no deal is a good deal unless both sides win. Let’s have a great 2010 together!
I suggest that if we look to 2010 and follow the simplest of rules; do unto others as you would have them do unto you, 2010 will be a banner year. What the ^*(_^^* does that mean?... If you expect the best price when you buy something, give the best price when you sell something. If you expect to be paid when you perform a service, pay when you receive a service. If you expect those you work with to do what they say, do what you say. Lead by example. Think what an impact this could have…. builders 3
TAX BENEFITS INCREASED ON ENERGY-EFFICIENT HOME IMPROVEMENTS Home owners looking to save money on heating and cooling costs with energy-efficient improvements to their home can also benefit from a newly expanded federal tax credit. In the recent stimulus legislation signed by President Obama, previous energy-efficiency credits were not only renewed, but were significantly improved. Before, home owners were able to recoup 10 percent of the cost of each approved energy upgrade with the lifetime cap of $500. The new credit has tripled those amounts to 30 percent and $1,500, respectively. According to Energy Star, a joint program of the U.S. Environmental Protection Agency and the U.S. Department of Energy, a typical household spends about $2,000 a year on energy bills. By incorporating Energy Star appliances and other energy-efficient components to your home, they estimate a home owner can save about a third on his or her energy bill. The expanded tax credit money available to home owners on top of these savings is icing on the cake! “This is an excellent time for home owners to take advantage of these tax benefits to make positive changes in their home that will not only benefit them immediately, but over the long term as well,” said Eric Borsting, a California home builder and chair of the National Association of Home Builders (NAHB) green building subcommittee. What is included? Tax credits are available at 30 percent of the cost, up to $1,500, in 2009 and 2010 (for existing homes only) for: • Windows and doors • Insulation • Roofs (metal and asphalt) • HVAC (heating, ventilating and air-conditioning) • Water heaters (non-solar) • Biomass stoves
Tax credits are available at 30 percent of the cost, with no upper limit through 2016 (for existing homes & new construction) for: • Geothermal heat pumps • Solar panels • Solar water heaters • Small wind energy systems • Fuel cells

Be sure to retain records that include: • Name and address of the manufacturer • Identification of the component • Make, model or other appropriate identifiers • Statement that the component meets the 25C standards • Climate zones for which the criteria are satisfied • Additional information for storm windows, if applicable • Manufacturer’s certification — a signed statement from the manufacturer certifying that the product or component qualifies for the tax credit -------------------------------------------------------------------------------------------------------------------------------------

N.C. Builder Leads the Nation in Certified Green Homes Excerpt from Nation’s Building News
Shugart Enterprises — a North Carolina construction company targeting first-time, move-up and empty-nester home buyers — has completed more homes certified to the National Green Building Standard than any other home builder in the nation. By last week, 26 homes built by the Winston-Salem company had completed the National Green Building Certification process. Forty-five additional homes had undergone the first of two inspections required by the standard, while another 15 were just getting underway. Shugart wasn’t looking to become a green building pioneer, said Les Frye, the company’s director of special projects. But with founder Grover Shugart wanting to steer his 43-year-old business in a new — and positive — direction, the timing seemed right to make some changes. Last year, Frye and other Shugart team members met to “see if it made sense for us to jump on this green bandwagon,” he said. Frye started by attending local seminars and classes sponsored by NAHB and other green building groups. After that, “we talked it over and decided that we needed something to separate ourselves from the competition, and give buyers another reason to buy a Shugart home,” Frye said. The downturn in the housing market — which fortunately was less severe in North Carolina than in many other parts of the country — played a part, Frye said, because it gave the company some extra time on its hands. One of Shugart’s first steps in implementing green home building, Frye said, was explaining to its suppliers and trade partners how their practices would have to change. “We’ve been fortunate to have good trades and they were more than willing to work with us and buy in on it,” he said. “We’ve got to sell more houses to keep the trades busy, and they appreciated that.” Next it was time to figure out how to reengineer operations to produce green homes that were both affordable and replicable. “Our bread-and-butter product is a starter home or a home for the first-time, move-up buyer,” and Shugart did not want to lose those customers. A few years earlier, Shugart had performed a value engineering analysis of all of its house plans to determine how to construct them more efficiently. As a result, it switched to advanced framing techniques and using house wrap. “We didn’t want moisture problems to crop up two or three or four years down the road,” Frye said. By Feb. 1 of this year, every new 2nd Generation home — Shugart’s name for its new, more efficient product — was being built to Energy Star specifications. And with the approval of the National Green Building Standard just two days earlier, it was time to move Shugart up to the next level, Frye said.
“Our goal was to roll out everything by April 1 so that our new homes going forward would be certified NAHBGreen,” using the standard as the scoring tool, Frye said. “Our goal in energy efficiency was to meet Energy Star requirements with an 85 HERS rating, but now that we’re better at getting our ducts tight and our blower door tests are turning out even better than we had modeled, our actual scores are doing much better, averaging 75,” Frye said. The response from the home buying public has been positive, he said, bolstered by a new “Shugart 2nd Generation” marketing campaign. “We wanted to demonstrate that we represent the next generation in building sciences and practices. We did quite a few press releases and had the media come out for photo opportunities,” he said. Shugart has also instituted a “sweat equity” program in which buyers can complete the final painting and landscaping work in exchange for cash toward closing costs. “We try to do everything as creatively as we can. We did not want to go the discount route because we didn’t want to hurt our comps, but we did indeed pass on the minimal amount of the additional cost from certifying to Energy Star and the standard,” Frye said. It is still unclear whether the switch to green is the decisive factor in the company’s ongoing success. Green building is “still in its infancy” in Shugart’s market, said Frye. “In other parts of the country people may be more aware of Energy Star and green building, but here, we have had to educate our real estate agents and we are still trying to educate our appraiser community,” he said. “Comps are tough. The green is still intangible and appraisers are really under the gun” as they endure more scrutiny, he said. “But we have signage highlighting what’s behind the walls in the model homes and a video that walks you through the inspection process and blower door test playing on our Web site and in the design center and each of our model homes,” he said. “Is it sweat equity? From ADA to SPA Having a safe bathroom hasn’t always been glamorous and relaxing. A few years ago consumers had to choose between luxury or safety in their bathrooms, now it is possible to have both! In recent years, manufacturers have been working diligently to create products that are both aesthetically appealing and safe for homeowners. Some of the many products are walk in bath tubs, walk in showers and comfort height toilets. Walk in bath tubs have been a huge hit in remodels this past year. American Standard is one of the many companies that have a full line of walk in baths to offer. Customers can choose from a soaker tub, whirlpool system, air bath system or a combination. The combination systems are wonderful for relaxing muscles and stimulating blood circulation. The consumer can also add a neck rest or chromatherpay lighting to the bath for ultimate relaxation. Chromotherapy lighting has been proven to enhance moods. For example, red is known to boost energy levels and purple can reduce anxiety. The chair height seat on the inside of the bath makes it easy and comfortable for the bathers to soak. There are many sizes available to accommodate all bathroom configurations. These units can be installed between walls, on one wall or freestanding. Plumbers can install these tubs with wall, floor or deck mounted fixtures to match any lavatory faucet style. In addition to walk in bath tubs, walk in showers are extremely popular. There are many ways to spruce up your everyday walk in shower into a safe, luxurious spa type shower. For example, Steamist offers a teak seat with metal hinges that tilts up and mounts on the shower wall. This is great for consumers who might want to shower sitting down, but want a luxurious sturdy option. The hinges are available in a variety of different finishes such as polished nickel, brushed nickel and oil rubbed bronze to compliment other plumbing fixtures in the bathroom. Jaclo Industries offers many multi function hand held showers that mount to decorative grab bars in all finishes to make it easy and luxurious for consumers to bath while being seated. Shower door handles are available to match all the different grab bars. One of the most important elements of a walk in shower is the valve. A great option for a safe, spa 8
type bathroom is a thermostatic valve. These valves have a separate temperature control from the volume control. This enables customers to shower assured that they will not be scalded and the temperature they set will only vary 1 degree during use. Another great feature is that they can normally add up to two more outlets in addition to their main shower head, this can be in the form of a rain head, body spray, fixed head or another hand held shower. Lastly, comfort height toilets are being used in many bathrooms. Comfort height is when the toilet bowl is 16 ½” off the floor. This is a 1 ½” taller than regular toilets and is comparable to the height of a standard chair. American Standard has many different models available in this taller height with excellent flushing systems, some even featuring a 4” flush valve! They have styles lavish enough to go in powder rooms and styles simple enough to go in a utility bath. There are many colors to choose from as well as all the different rough in sizes if you have a floor joist in the way. These comfort height toilets make sitting down and standing up easier for people of all ages. The NC Division of Public Health will be discussing the new lead-based paint regulations. They will provide an educational overview of the new EPA lead-based paint renovation, repair and painting regulation and what it means to North Carolina. GOVERNMENTAL AFFAIRS REPORT Nancy Gould - Joint Governmental Affairs Director SOMETHING FOR EVERYONE - 2009 NC Planning and Zoning Legislation The information in this article is from The University of North Carolina’s School of Government's recently published Planning and Zoning Law Bulletin #17: 2009 North Carolina Planning and Development-Related Legislation. The new laws and legislation summarized below are just a tidbit of what the 29 page Bulletin #17 presents. Whether you’re a builder, real estate broker, property manager and/or small business owner, there’s something for everyone! (Bulletin #17 is available in PDF format, at the following link: http://www.sog.unc. edu/bulletins/pzl 1. Deferment of taxes levied on residences owned and constructed by builders that are unsold. This legislation is effective for 2010 and will sunset in 2013. Builders, go to page 13 of this newsletter for detailed information on how to apply. 2. Extension of development approvals. This new law was adopted to help builders and developers, also. It extends most state and local development approvals that were/are valid at any time between January 1, 2008 and December 31, 2010. In summary, this legislation will extend the expiration date of many types of development permits. 3. Energy efficiency. All cities and counties now have the authority to provide zoning incentives, such as
density bonuses and other incentives for new energyefficient development. For example, Kernersville has used this legislation to offer building permit rebates for energy efficient buildings of up to $500. Another new law limits local governments from placing restrictions on solar collectors on all types of residential properties. Also, cities and counties may now create revolving loan programs for energy improvements. Raleigh and Winston-Salem had a special bill approved with allows them to lease land for renewable energy facilities of up to 20 years without treating the transaction as a sale of land. 4. Affordable housing discrimination. Unlike many states, until now, North Carolina has had few laws to address what is known as exclusionary zoning decisions, which often result from neighborhood opposition to affordable housing developments. New legislation makes land use decisions based on the fact that a development includes affordable housing to be unlawful. Additional new legislation will allow the court system to order injunctive relief to the point that a plaintiff with limited resources could end up with the means to challenge unlawful housing discrimination. 5. Limits on land development moratoria. This bill, which was introduced in 2009, is eligible for consideration in 2010. It would prohibit local governments from establishing land development moratoria “for the purpose of developing and adopting new or amended ordinances.” 6. Winston-Salem's special eminent domain legislation. W-S and Rocky Mount now have the authority to use eminent domain to acquire substandard residential property to provide housing for person with low or moderate income. Winston-Salem has already taken the necessary steps to utilize this legislation. This list highlights very few of the new bills that the N.C. General Assembly enacted in 2009 or will be considering in 2010 that affect the real estate and building professions. In order to take advantage of new benefits some of the new legislation makes available, to avoid headaches some will create and to be knowledgeable about potential legislation you will want to support or oppose, Bulletin #17 is a must read for the new year.

BUILDER’S INVENTORY REFERRAL PROGRAM The General Assembly enacted Session Law 2009-308 which provides a deferment of taxes levied on residences owned and constructed by builders that are unsold as of January 1 of each year. The deferment may be granted based on taxes levied on improvements only – the land is fully taxable. This legislation is effective for 2010 and will sunset in 2013. Here’s how it works: 1. Application—an annual application for this deferment is required. Applications may be obtained from the Forsyth County Tax Assessor’s Office located in the Government Center, 201 North Chestnut Street in WinstonSalem, NC. Please call 336-703-2302 for more information or to request an application by mail. Completed applications should be mailed to the Forsyth County Tax Assessor, Builder’s Deferral Program, P.O. Box 757, Winston-Salem, NC 27102. Applications should be submitted during the annual listing period which starts on January 4, 2010 and ends on February 1, 2010. 2. Eligibility – the property must be owned and constructed by a builder, so a copy of a verifiable general contractor’s license must be submitted with an application for deferral. 3. Affected property – taxes will be deferred only on a residence owned and constructed by a builder. A “residence” is defined as “an improvement, other than remodeling, renovating, rehabilitating, or refinishing, by a builder to real property that is intended to be sold and used as an individual’s residence”. The residence must be unoccupied and a certificate of occupancy must have been issued prior to January 1. A copy of the certificate of occupancy must be submitted with the application for deferment. 4. Disqualifying Event – a property is disqualified at the earliest of:... a. when the builder transfers the ownership of the residence; b. when the residence is occupied by the builder or someone other than the builder with the builder’s consent; c. five years from the time the improved property was first subject to being listed by the builder. The property is considered improved once the construction of improvements begins. d. three years from the time the improved property first received this benefit. 5. Notification – the tax collector will notify the builder of the accumulated sum of deferred taxes and interest by showing said amounts on the annual tax bill. 6. Years for which taxes may be deferred--The maximum number of years taxes levied on improvements may be deferred is three years. All deferred taxes plus interest must be paid at the time of a disqualifying event. 7. Disclosure of Participation – it will be wise for the qualifying builder, realtors and closing attorneys to check carefully to make sure any deferred taxes are considered upon the sale of a qualifying residence. Past due taxes are enforceable against the owner as of the time the taxes become delinquent, which means unpaid deferred taxes under this program could be enforced against the buyer if not paid at closing.
NAHB TAX DEDUCTION INFORMATION For 2010, NAHB estimates that the non-deductible portion of national dues—the portion that is applicable to lobbying is 16%. Thus, for a member who pays their NAHB dues of $150.00 in 2010, 16% or $ 24.00 will not be eligible for deduction as a business expense. Similarly, for an affiliate member who pays their NAHB dues of $5.00 in 2010, 16% or $.80 will not be eligible for deduction as a business expense. 13
