PRESIDENT’S MESSAGE Rich Achor – ARENA Builders

Thrown any money away lately? Thrown any money away lately? If you have sold a home I’ll bet you have and probably did not even know it. This is true if you are a builder and sell multiple houses in a year or a homeowner who sells a few in a lifetime. Remember the line on the HUD-1 statement concerning loan payoff? Did you know that the amount on that line is typically the equivalent of 5 days interest higher than the actual amount required to pay off the loan the day of closing? Have you been told it is OK, the bank will refund to you any interest not actually “used”? Were you told that the real reason it is 5 days after the closing date is to allow the lawyer plenty of time to get the payoff to the bank? Remember the line on the HUD-1 that charged you, the seller, a fee for the lawyer to pay off the loan? Did you assume that since the lawyer will not process the closing until the lending bank wires the funds into the lawyer’s account that the lawyer’s office in turn does not conclude the process of closing the sale until they then wire the funds to pay off your loan? Well... the recognized completion of the closing is the recording of the new deed at the county courthouse. In almost 100% of the cases the seller’s loan has not been paid off and will not be paid off for sometimes days. The distribution of sales commissions, and net proceeds to the seller are disbursed (this is why most think everything is done) in most cases immediately after the recording of the deed. The payoff to your lender is then “processed’ by the attorney’s office, when they get to it. OK, what’s the big deal of a few days? On a $200,000 loan at 5% (builders how many of you are seeing 5% notes from the banks today?) the daily interest is $27.40. Ask the lawyer or your realtor why the delay… well the lawyer’s office needs time to prepare the paperwork and get it to the bank, it just takes time. Why can all the other documents be prepared before closingcan’t the payoff, why can the lawyer send someone to the courthouse to record the deed, but not the bank

- is it because sometimes it is an out of town bank? – what about wire transfers ?, that is how they GOT the money. I have been told the lawyer needs to send instructions with the payoff….doesn’t the lender for the buyer also need to send instructions to the lawyer with their wire? Does the process somehow change ?? The real answer is the person getting taken advantage of here usually does not know it, does not pick the attorney and has no recourse to right the situation. The buyer picks the attorney, usually at the “suggestion” of the buyer’s real estate agent. The key is to make it in everyone’s interest to see that your note is paid off with the same haste that the deed is recorded and the funds are distributed to the real estate companies. I suggest every person selling a home amend the possession clause in the contract to state that the possession of the property transfers when the later of the recording of the deed with the county or the receipt of the payoff to the seller’s notes on the property by the seller’s lender occurs. This will force the transaction to recognize your hidden cost of the time the attorney takes to pay off your loan. The buyers want in the house, and the agents want their commission checkssee if it is ok for it to take a few days now. Maybe this will be addressed when the next rewrite of the “standard” real estate contract is accomplished, but until then you can simply write it in. If you have said reading this column has never done anything for you, maybe when you sell your next home remembering to set possession after your note(s) are paid off will save you a few $$ and make the time you took reading this worthwhile. By the time you get next month’s newsletter we will ALL have voted, right? If you don’t vote you have no right to complain. 3


REMODELERS UPDATE Chuck Hicks, President, NAHBR, HBAWS The NAHB Remodelers September meeting featured a guest panel of appraisers who informed us of the market situation, the current appraisal process, and values associated with dollars spent on renovations. Susan King, Michael Clapp, and Milton Jessup were our panelists. Each gave their assessment of the market, and answered questions from the audience. It was so well received that we plan a followup meeting next year to further the discussion and also see how the appraisal market might have changed. I recently had an opportunity to speak at an Association of Realtors’ Lunch and Learn event. Our topic was the Renovation Repair and Paint rules regarding Lead based paint. The realtors were very interested in the topic and asking good questions. Several were concerned that this topic will become a line item on their disclosure statements in the future, asking if a certified renovator performed the remodeling work on the home. Hopefully, the RRP rules will eventually drive more business to the certified firms and help reduce work going to non-licenced contractors. Remember to volunteer to help assemble Christmas trees for Brenners Children Hospital. Rob Powell will be sending more information out in the coming weeks. Our October has been changed to October 5th to accommodate conflicts with the Fall Parade events. We hope to extend our discussion from last meeting by having a panel of loan officers talk to us about their perspective on the renovation market.Our November meeting will be held at Fergusons. More details to come.

Designing Your Dream Kitchen

Erik Anderson, DreamMaker Bath & Kitchen™ Sometimes I get asked where somebody should start if they want to renovate their kitchen. If you want to enjoy the renovation process and end up with a beautiful new kitchen, you have to have a great plan. A great plan will consist of your ideas, a person who can take those ideas and create a set of drawings and specifications for your project, and, lastly, a competent company who can build what you have created in your mind. So how should you start in creating your plan? Start with some basics: 1. Make a list of items you would like to have changed in your existing kitchen or kitchens you have used in the past 2. Talk to some of your friends about what they like in their kitchens 3. Go to some open houses to see what ideas builders are using in the new homes they are constructing 4. Start gathering pictures from the different Kitchen magazines a. Highlight the items you really like in each of the magazines 5. Start creating your list of important items for your new kitchen. Take your time doing these items. You will be living in your new kitchen for many years so spending a few months planning it is well worth the time. The list you create and the pictures you have collected are a very valuable source of information for a kitchen designer. Most of the time, we start seeing a pattern in the pictures you collect. You may not see the pattern, but the designer will. As the saying goes, a picture is worth a thousand words. As I mentioned, this is just the first step in having a successful kitchen renovation project, but it is the most important. You will enjoy your new kitchen so much more if you take the time to really think about what you desire in it. This is YOUR kitchen. Think about what YOU want in it. You can use the assistance of a Certified Kitchen Designer, but they cannot read your mind. You need to give them some ideas with which to work. Follow the 5 steps mentioned above for a great start to a great project. GOVERNMENTAL AFFAIRS REPORT Nancy Gould - Joint Governmental Affairs Director

What’s True, What’s Not

H.R. 2454 – the American Clean Energy and Security Act. Over the past few months, several members have forwarded emails to me that make some frightening claims about H.R. 2454 (H.R. 2998), sometimes called the Energy Bill or Cap and Trade Bill. To find the truth, I went to NAR and NAHB for answers. As I thought, both have been and will continue to be vigilant in working with Congress members to remove provisions that would adversely affect our industries, homeowners and homebuyers. (Thank goodness they are there helping us!) In summary, NAR did not oppose the bill; NAHB did. However, both worked together to improve the bill and were successful. Their efforts resulted in an improved bill that was approved by the House of Representatives this past June. Some of the improvements include: • Does not create a federal energy audit requirement for real property; • Exempts existing homes and buildings from any federal guidelines for new construction energy efficiency information labels. • Leaves the decision to states as to whether to require energy audits, disclosures, etc. • Provides property owners with significant financial incentives, matching grants and tools to make property improvements and reduce their energy bills; • Establishes green building incentives for HUD housing The Senate now has the bill and NAHB staff does not see them taking action in the near future. Even so, they encourage all members to read their onepage summary of the bill that can be accessed through our Governmental Affairs page at www.wsrar.com or www.hbaws.org. They point out that there are still provisions about which some Home Builders may have concerns, such as one that would require States and local governments to adopt energy codes that are 12

at least 30% above 2006 requirements, then increase that to 50% by 2014, and then incrementally increase the requirements until reaching a 75% improvement by 2029. So, even if the bill may “have died,” NAHB staff advises that it is always a good idea to let your senators know what your thoughts. In addition to the summary sheet, NAHB also recommends looking at “greenhouse gas emissions” on its website. There is also a wealth of information on the NAR website – simply click her on Information Pack. So, where is the truth in this case? Well, as is often the case, it appears to be somewhere in the middle – and you will have to decide for yourself. I hope I’ve given you the tools to do that.
