Education, engine for economic growth The proven range of education in Sotogrande and the surrounding area is boosting arrival of new families settling here and broadening the business sector. More than two thousand pupils began the 2016/17 school year in Valle del Guadiaro. Half of them did so at a private school and the presence of more than 40 different nationalities in the local school community really stands out. The presence of a proven and prestigious range of education has become one of the main assets to be taken into account when new families decide to settle in the area. The arrival of these families is an important economic driving force in the education, property and service sectors.

Una buen centro escolar, en el que la educación destaque por ser: eficiente, eficaz, intuitiva, participativa, grupal, …, supone uno de los grandes dilemas y asuntos de mayor relevancia para muchas familias a la hora de decidirse por encontrar, buscar o elegir un destino en el que establecerse con carácter indefinido. Contar con un cinturón geográfico repleto de grandes centros educativos de enorme prestigio (públicos y especialmente privados), obviamente en Sotogrande y todo el Valle del Guadiaro, reforzados por los muchos existentes tanto en el resto de la Comarca, como en el propio Gibraltar o Costa del Sol; es, sin duda, un valor diferencial y ciertamente definitivo para la puesta en valor de Sotogrande como destino. Es totalmente necesario e indispensable para la inmensa mayoría de las familias, por no

decir todas, que se plantean instalarse en la zona, sentirse plenamente respaldados en el ámbito escolar y educativo de sus hijos. Y, ciertamente, en eso Sotogrande lleva muchos años trabajando, potenciando y fomentando su imagen exterior con estrategias y pasos muy bien guiados y dignos de elogio. Es por ello que con el inicio del curso escolar, con todo lo relacionado con el desembarco de la familias nuevas en Sotogrande (léanse el Informe de la Comunidad Escolar en Sotogrande que lleva esta edición), supone también, y tiene una importante consecuencia en el ámbito económico de la zona, una nueva oportunidad de generación de riqueza con la llegada de familias de perfil alto atraídas por una eficiente y reputada formación académica en la zona. Mil veces se ha sondeado y escuchado sobre idea sobre y posibilidad de instalar en

la zona un centro de formación académica/ profesionl o escuela de negocios de alto niel. El tejido empresarial de la zona puede nutrirse y ser motivador para la segunda de estas opciones, mientras que la primera puede encontrar en profesiones tan definidas como las vinculadas a deportes del tipo golf (greenkeper, caddy master, etc.), la vela o el polo, una posición de privilegio casi única en España y Europa por el entorno de Sotogrande Todo ello supondría un enorme impulso en la economía de la zona y sin duda, una opción más de expansión y de crecimiento de vida social y de negocio en Sotogrande. Cuando se hablan del futuro de Sotogrande se oyen mil planes y estrategias de grandes negocios hoteleros, inmobiliarios, deportivos,…, y quizás la respuesta pueda estar en lo más básico, fundamental y necesario: la educación.

Having a geographic belt filled great and very prestigious schools (public, and especially private), obviously in Sotogrande and all of Valle del Guadiaro, strengthened by the many that exist in the rest of the Province, as well as in Gibraltar and the Costa del Sol; is undoubtedly a distinguishing asset and certainly contributes to Sotogrande´s value as a destination. It is completely necessary and vital for the immense majority of families, if not

to say all of them, who consider settling in the area, that they feel fully backed in the school and education sector for their children. Certainly, this is something that Sotogrande has spent many years working on, strengthening and boosting its external image through strategies and steps that are very well-guided and praiseworthy. That is why the start of the school year, and everything linked to the arrival of new families in Sotogrande (see the report on Sotogrande´s School Community in this edition) also has a signiﬁcant impact on the area´s economy. The arrival of well-todo families attracted by the area´s eﬀective and renowned academic education is a new opportunity to generate wealth. On innumerable occasions there has been talk and opinion taking about the possibility to put an academic/

professional centre or high-level business centre in the area. The business network could help to sustain and be a motivating factor the latter of these options, while the former could ﬁnd in the Sotogrande area such speciﬁc professions such as those linked to golf (green keeper, caddy master, etc.), sailing or polo, a privileged position that makes this destination almost unique in Spain and Europe. All of this would be a great boost for the area´s economy and certainly another option for expanding and growing Sotogrande´s social and business life. When talking about Sotogrande, we hear thousands of plans and strategies for big hotel, property and sports businesses… perhaps the answer is to be found in what is most basic, fundamental and necessary: education.

‘Vuelta al cole’ y a la normalidad Atrás quedó un verano único en lo que se refiere a afluencia, se puede decir que hubo un antes y un después en estos ratios de ocupación. Aunque sí cabe destacar que buscando opinión en algunas apreciaciones de los sectores empresariales, hubo mucha cautela en el gasto medio por visitante, siendo la media inferior a 1 José Luis García otros años con menos Editor/Director ocupación. Todo puede jlgarcia@grupohcp.com ser indicativo de que la gente pretende alargar su periplo en este magnífico lugar y a cambio prorratea su dinero en el bolsillo, aunque es de recibo mencionar que también son muchos los comentarios en referencia a los elevados precios que se encontraban en algunos establecimientos. Cuestión que no ha estado reñida con la calidad, ya que aquí no hacen hincapié en exceso, lo que significa que la gastronomía ha ostentado un avance cualitativo, y no tanto en la prestación de servicios que no es achacable a los establecimientos en sí, sino a la masiva presencia

demandante que bloqueaba las salas y cocinas en lo que se refiere al segmento de restauración. Por lo tanto, perfectamente se podría calificar de un verano apoteósico con la salvedad que aín no estamos preparados para un numero tan elevado de visitantes. Destacando que siempre se encuentra la excepción que confirma la regla, existiendo algunos lugares con gran capacidad de reacción. Y como indico en el titular, a la vuelta de la normalidad será necesario que cuantos hicieron el esfuerzo de ampliar plantillas y remodelar sus espacios tengan ahora la posibilidad de continuar con la mejor capacidad de prestar los mejores servicios, al mejor precio y mayor calidad, si cabe. Y la ‘vuelta al cole’, en el caso de Sotogrande y su entorno, no es cualquier cosa parecida a lo que ocurre en otros lugares donde el colorido de los uniformes y los autobuses son una de las notas relevante. Aquí empieza a ser un movimiento socio-económico muy importante, como bien reflejamos en el informe de esta edición. Hasta mas de 40 nacionalidades conviven en los centros del entorno, siendo una mayoría de ellos de nuevas familias que han decidido ubicar su residencia fija en Sotogrande. Todo esto hace indicar que no sólo es la cuota escolar lo que mueve la economía, sino las propias familias de alto poder adquisitivo que deciden instalarse en la zona con lo que conlleva ese dato en inversión, tanto en el sector inmobiliario como en la creación de nuevos puestos de trabajo. Así que la enseñanza de calidad también es un gran motor económico para nuestra área. Haciendo referencia a los motores económicos, no cabe duda

que los deportes como el polo y el golf son estelares, al que hay que sumar la náutica en sus diversas modalidades, ya que este año las aguas de Sotogrande están siendo surcadas por embarcaciones de gran nivel. Esto hace que la maquinaria que los rodea sea un atractivo más, llámese los RC44, los J80 y ahora también la prueba de GC32 Racing Tour en esta semana; todo un acierto que por fin se está viendo reflejado como una zona neurálgica en materia de náutica de recreo y deportiva. No se puede obviar que recién terminó el Torneo Internacional de Polo organizado por Santa María Polo Club, que un año mas fue la actividad estrella del verano. Y en golf, sin dejar de ser modestos, también recién terminó la temporada de pruebas regulares del IV Circuito de Golf La Revista Sotogrande, resultando un éxito de participación, donde mas de 300 jugadores se dieron cita a lo largo de las seis pruebas celebradas en los mejores campos de España, afortunadamente casi todos en nuestra zona. Ya sólo resta disputar la Gran Final en Real Club Valderrama el próximo día 18. Un evento que crecerá notablemente en la edición del 2017, en la que ya se está trabajando por parte del equipo de Grupo HCP. Llega el otoño y debe ser bien recibido por todos con entusiasmo porque al margen del tema político, a nivel nacional, estamos creciendo en todos los aspectos, y sobre todo en calidad. La maquinaria no se detiene en otoño, toma fuerza. Os recuerdo que podéis contarme cualquier tema de interés, bien de forma directa o a través de @JLGarciaSG.

“Back to School” and Normality We have reached the end of a unique summer in terms of visitor numbers, it could be said that there was a before and after in those occupancy ratings. However, it is worth highlighting that, when looking for opinions, via perspectives from business sectors, there was a lot of caution in the average spending per visitor, with the average lower than in other years with lower occupancy. Everything could indicate that people aim to extend their stay in this magnificent place, and in exchange, they make the money in their pocket go further, however it is proper to acknowledge that there are also a lot of comments in relation to the high prices found in some establishments. This matter has not been at odds with quality, as there is no emphasis on excess here, which means that gastronomy has undergone an improvement in quality, although the provision services not so much. This is not attributable to the establishments themselves, but rather the massive numbers of customers, blocking up dining rooms and kitchens of the restaurant sector. Therefore, this could perfectly be classed as an exalted summer, with the caveat that we are still not prepared for such a high number of visitors. It is worth highlighting that the exception always confirms the rule, and there are some places with a great capacity to react. And, as I indicate

in the title, it will be necessary for everyone who made the effort to enlarge their workforce and remodel their spaces now have the possibility to continue with the best capacity to provide the best services, at the best price and best quality, if possible. And the “return to school”, in the case of Sotogrande and its surrounding area, is not anything similar to what happens in other places where the colour of the uniforms and buses are one of the important notes. Here, it is beginning to be a very important socio-economic movement, as we outline in this edition´s report. Up to 40 nationalities coexist in the area´s schools, with the majority of them from new families who have decided to make Sotogrande their permanent residence. All of this indicates that it is not only the school fees that move the economy, it is also the families themselves with a large spending power who decide to settle in the area, with all that involves in terms of investment, in the property sector as well as with the creation of new jobs. Therefore, teaching quality is also a great economic engine for our area. With regard to the economic driving forces, there is no doubt that sports such as polo and golf are stellar, and it is necessary to add the different forms of sailing to that list, as

this year the waters of Sotogrande have been crossed by top level vessels. This means that the machinery around them is another asset, whether it is the RC44, the J80s or now also the GC32 Racing Tour event this week; a real success that is being reflected in an area that is a hub for recreational and competitive sailing. We cannot forget that the International Polo Tournament organised by Santa María Polo Club finished recently, once again this year it was the star activity of the summer. And in gold, without forgetting about modesty, the season of regular events of the 4th Sotogrande Magazine Golf Circuit recently concluded, it was a participation success, with more than 300 players participating in the six events held at the best courses in Spain, fortunately almost all were in our area. All that remains, is the Grand Final to be played at Real Club Valderrama on the 18th. This is an event whose 2017 edition will grow notably, and the Grupo HCP team is already at work on it. Autumn is here and it should be received by everyone with enthusiasm because aside from national politics, we are growing in every area, especially quality. Demarcación de Costas realiza los trabajos en el río Guadiaro y playa de Sotogrande ✑ Manuel Gil

Demarcación de Costas se encuentra desde el pasado lunes (29 de agosto) realizando las labores de extracción de arena en la desembocadura del río Guadiaro y depositando una cantidad total, hasta llegar a los 10.000 metros cúbicos, en la playa de Sotogrande para mantener así su regeneración. Esta acción se produce después de la intervención, el pasado jueves, del Ayuntamiento de San Roque y cumple con el anuncio de actuación del pasado miércoles, 24 de agosto. La alcaldesa accidental de San Roque, Dolores Marchena, se pronunció pidiendo al Gobierno central que no detenga las obras que ha iniciado en el desembocadura del rio Guadiaro hasta su ﬁnalización. Marchena se felicitó porque “las obras se hayan iniciado, 48 horas después de la intervención municipal, en el rio, aunque vemos que las obras no van al ritmo que nos gustaría, pues la bocana sigue cerrada”.

La edil confía en que “la administración central, en próximas ocasiones, tenga en cuenta la rapidez necesaria para actuar ante de que se convierta en un problema medioambiental importante”. Para evitarlo, “el pasado jueves, aun sin tener las competencias en ello, tuvo que abrir la bocana para garantizar la supervivencia de las especies, y vamos a continuar con esta supervisión directa para que esto no ocurra y se lleven a cabo las medidas que la Demarcación de Costas debe realizar aquí”. Marchena recordó que “es necesario mover 10 mil metros cúbicos de arena para dar solución a este problema, y en ello están trabajando un par de máquinas y camiones, quizás insuﬁciente para este volumen”. Por su parte, el concejal de Urbanismo, Juan Manuel Ordoñez, apuntó que “estamos contentos de que las autoridades competentes, el gobierno central a través de Costas, están actuando, pese a que durante 9 días

dijo que no era competente”. “Es una pena que este trabajo no se hubiera iniciado antes, ahora sería más fácil abrir la bocana, y lo que pedimos es que los trabajos ﬁnalicen lo antes posible y preservar este poaraje natural”, señaló el edil. Ordoñez apunta que “para años sucesivos, que se sabe la problemática en esta zona del litoral, que se suele cerrar cada año, en años sucesivos se actúe antes y con celeridad para que no se vuelva a cerrar esta bocana”. Ordoñez criticó que tras nueve días en los que desde el Ayuntamiento se pedía intervención en el rio y desde el PP y el Gobierno se decía que no era su competencia, ahora vengan a echarse ﬂores que lo están arreglando. El primer edil accidental aseguró que lo cierto es que han estado 9 días intentado “esquivar su responsabilidad,” y cuando “se han visto forzados a actuar, sacan pecho ante los ciudadanos, esos mismos a los que habían dado la espalda”.

Coastal Demarcation carries out work on Guadiaro River and Sotogrande Beach Since Monday 29 August, Coastal Demarcation has been carrying out work to remove sand from the mouth of the Guadiaro River, and deposit a total amount of 10,000 cubic metres on Sotogrande Beach in order to maintain its regeneration. move 10 thousand cubic metres of sand in order to resolve this problem, and a few machines and lorries are working on the issue, which is perhaps insuﬃcient for this volume”. In turn, the councilor for Tourism, Juan Manuel Ordoñez, stated that “we are happy that the relevant authorities, and the central government through the Coastal department, are acting, despite the fact that for 9 days, it said that it was not responsible”. “It is a shame that this work was not started beforehand, that would have made it easier now to open up the river mouth, and what we are asking for is that the work ends as soon as possible and to preserve this natural area”, remarked the councillor. Ordoñez pointed out that “in future years, knowing that these problems exist in this area of the coast, which usually closes over each year, action should be taken sooner and quicker so that this river mouth does not close over again”. Ordoñez criticized the fact that nine days since the Council asked for intervention on the river, and since the PP and the Government said that it was not their responsibility, they are now celebrating the fact that they are resolving the problem. La oferta de ocio de Sotogrande dará un nuevo salto de calidad con el nuevo festival que Santa María está preparando para el próximo verano (agosto de 2017). ‘Sunset Valley’ será un festival de conciertos de carácter internacional en el que participarán estrellas de la música de otras décadas. Santa María Polo Club es el lugar idóneo para llevar a cabo esta iniciativa, un entorno privilegiado para ofrecer una experiencia única al público asistente, que según la organización estima de una edad mayor de 25 años por la talla de los artistas musicales que acudirán al encuentro. Sunset Valley nace con el objetivo de completar la oferta de ocio que Santa María Polo Club ofrece, además de Food-truc-

ks, Polo Shopping durante el Torneo Internacional de Polo, este nuevo festival de conciertos rematará la lista de planes estrella para el momento más idóneo del año, el verano. La línea artística estará guiada por auténticas estrellas de la música, especialmente de otras décadas y de importante reconocimiento, el estilo predominante será el Pop/Rock, Blues y Flamenco, aunque también contaremos con la presencia de Dj’s, dado que después de los conciertos el escenario se convertirá en una de las terrazas favoritas del verano. El concepto de Sunset Valley mantiene cierta similitud con el modelo de Starlite Festival que actualmente presenta Marbella, la relación de ambos se encuentra en la talla de los

La diferencia es que Sunset Valley pretende aunar al público del Campo de Gibraltar. Sotogrande’s events calendar is blossoming with the presentation of next Summer’s ‘Sunset Valley’ Festival, scheduled to take place in August 2017. ‘Sunset Valley’ is an international concert festival that includes live performances by stars from throughout the decades. Santa Maria Polo Club is a spectacular event venue with privileged surroundings offering a unique experience for all. According to event organizers, the estimated average age of attendees is around 25 years old due to the fanbase of the major performers who are to play. Sunset Valley was born with the aim of rounding out Santa Maria Polo Club’s events calendar, and includes Food Trucks, Polo Shopping during the Intenational Polo Tournament, and this new concert festival that’s projected to be a huge hit during the best possible moment of the year: Summer. Artistic vision is guided by star performing artists, specially from other decades and funda-

mentally renown artists from different styles like Pop, Rock, Blues and Flamenco, although there will also be DJs to liven things up after concerts end when the venue turns into an open air terrace, one of the best chill out spots for Summer. The concept of Sunset Valley has certain similarities to the Starlite Festival model which is currently promoted in Marbella. Ties between both festivals could easily be drawn when comparing the magnitude of the artists involved, the venue size and the care taken to provide excellent service to attendees which is always one of the main highlights of any Santa Maria Polo Club event. rreno, estos trabajos se están realizando de modo manual y retirando todo aquel material que por su volumen pudiera obstaculizar el paso del agua. Tras estas actuaciones en los arroyos comenzará la cam-

paña de poda 2016-2017 que se prolongará hasta ﬁnales de marzo del próximo año.

Un total de 13 organizaciones en la provincia de Cádiz, de un total de 187 en Andalucía, disponen del distintivo de ‘zona cardioasegurada’ que concede la Consejería de Salud, a través de la Empresa Pública de Emergencias Sanitarias, a las instituciones que lo solicitan y cumplen una serie de requisitos. Ante una parada cardiorrespiratoria, es fundamental la rapidez con que se inicie la maniobra de reanimación cardiopulmonar básica, por parte de las personas presentes, mientras llegan los servicios de emergencia. En ese sentido, para facilitar la actuación rápida ante situaciones de este tipo, en Andalucía se han instalado desﬁbriladores externos automatizados (DEA) en organismos

públicos, espacios de ocio y grandes aglomeraciones de personas y empresas privadas, que permiten que, ante una parada cardiorrespiratoria, se puedan proporcionar unos primeros auxilios adecuados mientras acuden los servicios de emergencias. Las instituciones que han conseguido ser ‘zona cardioasegurada’ son fundamentalmente instalaciones deportivas, ediﬁcios públicos, colegios e institutos de enseñanza secundaria, estaciones de trenes, hoteles, empresas o farmacias. En el caso de la provincia de Cádiz, son 13 los centros que disponen de este distintivo, a saber, Azucarera Iberia-Fabrica Guadalete; Club Deportivo ‘Maestro Isidoro Visuara’; Club Deportivo ‘San Fran-

Todo bien, de momento Mariano Rajoy urgió a las demás fuerzas políticas a llegar a un acuerdo para evitar la celebración de nuevas elecciones, y uno de los argumentos que empleó fue que la economía española va bastante bien, “de momento”. No se refería, por supuesto, a la ignorancia acerca del futuro que exhibimos los seres humanos, y los economistas en primer lugar. En efecto, como no sabemos qué puede suceder, todo va bien, o mal, siempre “de momento”. Rajoy apuntaba en otra dirección, y sugería que si no hay Gobierno ello pone a la economía española en riesgo. Asociación de Consumidores y Usuarios de La Marina de Sotogrande ‘ACUMAR’ 1.- Qué es ACUMAR – Es la Asociación de Consumidores y Usuarios de La Marina de Sotogrande, inscrita en el Registro de Asociaciones de la Junta de Andalucía con el nº 74. Constituye un Órgano de Representación Legal Colectiva, ante cualquier entidad, de los propietarios y usuarios de La Marina que están asocia1 Remitido de dos, como consumidores que son. prensa. 2.- Qué pretende ACUMAR – Como fin principal y general de la Asociación; defender los intereses de sus asociados, frente a vulneraciones de sus derechos como propietarios de los inmuebles de La Marina. En consecuencia y como objetivo inmediato asegurar que la transición del actual régimen de conservación, conocido como el REM, hacia una Entidad Urbanística de Conservación (EUC) se realice en un tiempo razonable y de una forma ordenada, obligando al Ayuntamiento de San Roque y a Sotogrande S.A. a respetar los derechos que nos asisten como propietarios de La Marina. 3.- Cómo se pertenece a ACUMAR – Se puede pertenecer de manera colectiva vía Comunidad de Propietarios o a título individual. Actualmente, de las 28 comunidades activas que hay en La Marina, existen 18 comunidades asociadas, y tres más en estudio de adhesión. Esto supone la representación de cerca de mil propietarios. Para solicitar la incorporación como asociado, ya sea a nivel colectivo como a nivel individual, basta con enviar un email a la dirección propietarios@marinadesotogrande.com y/o llamando al teléfono 956.105.312. Todas las peticiones son informadas. 4.- Qué ofrece ACUMAR a sus asociados – Asesoramiento en defensa de los derechos individuales y colectivos como propietarios de La Marina, frente a posibles vulneraciones de Sotogrande S.A., Ayuntamiento, ARCGISA, etc. Actualmente a nivel individual los casos más claros que se dan son; la facturación indebida que Sotogrande realiza a numerosos propietarios aumentando en cerca del 30% la superficie computable de sus propiedades, en la aplicación del REM, y la facturación irregular del agua sin la existencia de contadores.

5.- Que ha hecho ACUMAR hasta la fecha – Hasta el momento ACUMAR está realizando una intensa actividad negociadora con el Ayuntamiento de San Roque, Sotogrande S.A. y ARCGISA, con objeto de poner en funcionamiento la Entidad Urbanística de Conservación, que marca el Plan General de Urbanismo de San Roque. Para esto se ha realizado lo siguiente: a.- Elaboración y presentación al Ayuntamiento de un borrador de estatutos de la futura EUC, acorde con el ordenamiento jurídico, la experiencia de 13 EUC,s de toda España y teniendo en cuenta el respeto a los derechos de los propietarios. b.- Identificación detallada, en plano con sus cálculos correspondientes, de todas las distintas superficies que constituyen La Marina, en función de su titularidad y responsabilidad de conservación, con vistas a su gestión cuando se constituyan la EUC y el Condominio, citados en la propia inscripción del REM. c.- Estudio económico detallado de los costes que podrán representar para cada propietario el paso del actual régimen REM a la EUC, teniendo en cuenta los costes externos e internos a los edificios. d.- Cálculo de las tablas de coeficientes de participación de los 2.529 inmuebles, actualmente registrados como pertenecientes a La Marina, en los gastos generales de la EUC, en función de la edificabilidad de cada edificio y su participación en la superficie total de La Marina. e.- Requerimiento al Ayuntamiento, en la figura del Alcalde, para que inste a Sotogrande S.A. a cumplir con lo que le fue requerido en Octubre de 2015 y que hasta el momento no ha cumplido f.- Requerimiento a ARCGISA, en la figura de su Director General, para que inste a la urbanizadora Sotogrande a que realice las adaptaciones necesarias, en el sistema de canalización del agua, antes de que se constituya la EUC, de forma que sea posible la facturación individualizada por medio de contadores. g.- Requerimiento a Sotogrande para que, en tanto se constituye la EUC, realice la facturación del REM de acuerdo con lo que ellos mismos inscribieron en el registro, sin interpretaciones abusivas e innecesarias. h.- Inicio de contactos con las presidencias de los fondos Cerberus y Orion para advertirles del perjuicio que podría representar para sus

intereses el aumento del nivel de impagados que constituiría un “hecho relevante” relacionado con Sotogrande S.A. que, como empresa que cotiza en bolsa, debería ser comunicado a la CNMV. Durante el año en el que la Asociación lleva funcionando se ha llevado a cabo un trabajo exhaustivo de estudio detallado de las circunstancias legales y económicas en las que se inscribió y desarrolló el REM y actualmente se encuentra en situación de afrontar la defensa de sus asociados con un solido respaldo legal. 6.- Relación entre ACUMAR y la futura EUC – No existe ni existirá NINGUNA relación de tipo organizativo ni estructural. Cuando la EUC se constituya, TODOS los propietarios elegirán libremente y de acuerdo a la Ley y sus estatutos su Consejo Rector y éste será el que rija los destinos de la Entidad, de forma soberana. ACUMAR continuará, al margen de este hecho, ejerciendo la defensa de los derechos de sus asociados independientemente de la existencia o no de la EUC, incluso frente a esta, si fuera el caso. 7.- Posicionamiento de ACUMAR ante el procedimiento penal – ACUMAR prefiere no entrar a valorar las decisiones tomadas por un grupo de propietarios que de forma individual, pretendiendo trasladarlo a sus comunidades, han acometido este camino para resolver su descontento con Sotogrande. A pesar de que el objetivo final parece ser el mismo, existen muestras que nos llevan a la desconfianza, por lo que queremos dejar constancia que actualmente no existe relación alguna de la Asociación con estos planteamientos. El hecho de que algunos de estos propietarios estén a su vez demandados por Sotogrande S.A. por cuantiosas deudas, otros muestran un gran interés por ampliar sus negocios de administración de comunidades e incluso empresas de mantenimiento, nos lleva a ser cautelosos y mantenernos al margen para preservar la independencia que, de acuerdo con los estatutos de la Asociación, debe regir nuestra gestión. Es por esto que ACUMAR no tiene vocación de hacer propaganda de posicionamiento alguno, tan solo pretende informar sobre los derechos de sus asociados y obligar a que se respeten dentro de la legalidad y en última instancia conseguir que la EUC sea una realidad ordenada en el menor tiempo posible.

Consequently, the immediate objective is to ensure that the transition from the current conservation regime, known as REM to an Urban Conservation Entity (UCE) is carried out in a reasonable time and in an orderly manner, obliging the Council of San Roque and Sotogrande S.A. to respect the rights that correspond to us as owners of La Marina. 3.- How do you belong to ACUMAR – You can belong collectively via the Community of Owners or individually. Currently, of the 28 active communities that there are in La Marina, there are 18 associated communities, and three more studying the option of joining. This means the representation of close to one thousand owner. In order to request incorporation as an associate, whether collectively or individually, you simply need to send an email to the address propietarios@marinadesotogrande.com and/or call 956.105.312. All requests are provided with information. 4.- What does ACUMAR offer its associates– Consultation in defence of individual and collective rights as owners of La Marina, against possible infringements by Sotogrande S.A., the Council, ARCGISA, etc. Currently, on an individual level, the clearest cases that take place are; undue billing that Sotogrande makes to several owners, increasing the countable areas of their properties by almost 30%, on the application of REM, and the irregular invoicing for water without the existence of meters. 5.- What has ACUMAR done up until now– Up until now, ACUMAR has been carrying out intense negotiation activity with the Council of San Roque, Sotogrande S.A. and ARCGISA, in order

For this purpose, it has carried out the following: a.- Creation and submission to the Council of a draft list of statutes of the future UCE, in accordance with the legislation, the experience of 13 UCEs, all of Spain and taking into account the rights of the owners. b.- Detailed identification, along with the corresponding calculations of the different areas that comprise La Marina, in accordance with their ownership and responsibility for conservation, with a view to management when the UCE and the Condominium are set up, as outlined in the registration for REM. c.- A detailed economic study of the costs that may be borne by each owner with the move from the current REM to the UCE, taking into account the external and internal costs of buildings. d.- Calculation of the tables of share participation of the 2,529 properties, currently registered as belonging to La Marina, in the general costs of the UCE, in accordance with the development potential of each building and its share of the total area of La Marina. e.- Request to the Council, addressed to the Mayor, in order for it to urge Sotogrande S.A. to comply with what was requested in October 2015 and that has not been fulfilled up until now f.- Request to ARCGISA, addressed to the Managing Director, so that it makes a request to the developer Sotogrande developer for them to carry out the necessary adaptation to the water channel system, before it sets up the UCE, so that individual billing is made possible through meters. g.- Request to Sotogrande so that, as soon as the UCE is set up, it carries out the invoicing of the REM in accordance to what they themselves entered in the registry, without abusive and unnecessary interpretations. h.- Initial contact with the presidents of the Cerberus y Orion funds in order to warn them about the possible harm to their interests from the increase in non-payments that would constitute a “relevant fact”

related with Sotogrande S.A that, as a company listed on the stock exchange, should be reported to the Spanish Securities & Exchange Commission (CNMV). During the year in which the Association has been functioning it has carried out exhaustive work to study the legal and economic circumstances in which the REM was registered and implemented, and it is currently in a situation where it working to defend its associates with solid legal backing. 6.- Relationship between ACUMAR and the future UCE – There is not nor will there be ANY kind of organisational or structural relationship. ACUMAR will continue, aside from this fact, to exercise the rights of its associates regardless of the existence or not of the UCE, even in opposition to it, if necessary. 7.- Positioning of ACUMAR in relation to penal procedures– ACUMAR prefers not to get into assessments of decisions taken by a group of owners that individually, with the aim of taking the issue to their communities, have undertaken this route in order to resolve their unhappiness with Sotogrande. Despite the fact that the end objective seems to be the same, there is evidence that leads us to wariness, therefore we want to put on record that there is currently no link to the Association with these approaches. The fact that some of these owners are in turn sought by Sotogrande S.A. for large debts, and others show great interest in extending their community administration businesses and even maintenance companies, leads us to be cautious and stand aside, in order to preserve the independence that, in accordance with the Association´s statutes, should govern our management. El informe turístico municipal sobre la ocupación y servicios este verano crece respecto a los datos de 2015 1 M. Gil / Redacción

El verano turístico se puede considerer como “excelente” en el término municipal de San Roque, mejorando las previsiones y superando las cifras del año anterior, ya de por sí muy bueno. Destacan los porcentajes obtenidos en ocupación hotelera, que se hna incrementado respecto a 2015 tanto en junio, julio, agosto y primera quincena de septiembre, habiéndose alcanzado en varios casos el lleno completo algunos días. La teniente de alcalde delegada de Turismo, Dolores Marchena, presentó, junto a los técnicos de su departamento el informe elaborado por los mismos. Explicó Marchena que se ha registrado un incremento en las visitas al Punto de Información Turística ubicado en el Puerto Deportivo de Sotogrande respecto al verano pasado. En total, dicho Punto

de Información y la Oficina de Turismo situada en el Palacio de los Gobernadores han registrado la visita de 1.961 personas, mientras que otras 264 han conocido el municipio en visitas guiadas. En cuanto a las nacionalidades, naturales de hasta 33 países han sido atendidos este verano tanto en la Oficina de Turismo como en el Punto de Información, destacando el turismo español seguido de británicos y franceses. A continuación figuran alemanes, belgas, irlandeses, rusos, argentinos, italianos, daneses, canadienses y estadounidenses. En cuanto a la ocupación hotelera, precisó Marchena que se ha recabado a partir de los datos ofrecidos por los mismos establecimientos del sector (se ha consultado a siete hoteles y un establecimiento de turismo rural: Hotel Almenara, Hotel

Un grupo de vecinos, de la Comunidad de Propietarios Residencial Mesana, presentó un escrito ante el Ayuntamiento de San Roque el que se denuncia y solicita una mayor actuación municipal o responsabilidad por parte de los causantes, a consecuencia de las molestias provocadas en la convivencia diaria por el exceso de ruido procedente de un bar situado en las cercanías de la urbanización. Se detalla que son muchos los propietarios que a lo largo de todo el verano expresaron su malestar por el ruido conti-

nuo generado de un bar colindante con el edificio de la Comunidad, concretamente situado en el Centro Comercial de Sotovila. Estos vecinos relatan que la terraza-bar del local abría todas las noches haciendo imposible el descanso ordinario por lo elevado de la música que incluso “hace vibrar las ventanas”. Aunque la cuestión va más allá de una mera molestia por un alto nivel de ruido. El estado en el que en muchas de las ocasiones se queda el recinto o la zonas cercanas, con una visible falta de salubridad e

Neighbours condemn excessive noise from establishment in Sotovila A group of neighbours, from the Residencial Mesana Community of Owners, has presented a written document to the Council of San Roque, to denounce and request greater municipal involvement or for the perpetrators to be held responsible, as a result of disturbances caused to daily life by excessive noise coming from a bar located in the area around the resort. It explains that throughout summer many owners have

expressed their discontent caused by the continuous noise coming from a bar adjacent to the Community´s building. Specifically, it is located in the Sotovila Shopping Centre. These residents report that the terrace-bar of the premises was open every night, making it impossible to enjoy ordinary rest due to the high level of music that even “made the windows vibrate”. However, the question goes

far beyond a mere disturbance due to a high noise level. The state that the area and nearby zones are often left in, with a visible lack of cleanliness and hygiene requires greater attention from the relevant bodies. The action being called for by residents is none other than greater respect for the area´s cleanliness and suitable behaviour, showing consideration towards harmonious living between all parties.

El día de las nuevas familias siempre es un momento emocionante, amigable y grato en el Colegio Internacional de Sotogrande, y este año no ha sido de otra manera. Con más de 200 nuevos estudiantes que se han incorporado al colegio, había mucha información que compartir y presentaciones que hacer. El día comenzó con la bienvenida que dio el director James Kearney, seguida de la oportunidad de que los nuevos padres y estudiantes conocieran a los profesores y vieran las clases, con mucho tiempo para hacer preguntas y calmar los nervios de última hora. El primer día en un nuevo colegio siempre es un poco sobrecogedor, por lo que para ayudar a calmar los nervios, se invitó a algunos de los estudiantes a ayudar en el Día de la bienvenida. Entre las tareas encargadas a los estudiantes embajadores estaban mostrar el campus a los nuevos niños y asegurarse de que todo el mundo reconociera una cara amigable el primer día de colegio. También se hizo uso de Assist, cuyo objetivo es hacer que el trasla-

La asociación de padres y profesores, y el equipo de embajadores profesores se dedicaron a ayudar a que las familias se sintieran parte de la comunidad al estar disponibles para resolver cualquier duda que los padres pudieran

Además hubo presencia de la SILA (Sotogrande International Language Academy), que ofrece cursos de español para ayudar a las nuevas familias a la hora de vivir e integrarse en una nueva comunidad y país, y también ofrece clases en inglés, francés, alemán, ruso y chino. El día finalizó con una barbacoa celebrada por Sotogrande SA en el campo de golf de La Reserva, donde las nuevas familias se relajaron y charlaron con los profesores y otros padres en un bello entorno, mientras que los estudiantes jugaban y forjaban nuevas amistades, con la emoción del curso que empieza.

New families day is always an exciting, friendly and welcoming time at Sotogrande International School and this year was no different, with over 200 new students joining the school there was a lot of information to share and introductions to make. support and advice to families relocating to the area and joining the SIS community. Through a network of trusted companies Assist is able to help with queries ranging from how to get NIE’s and find a house through to buying cars and ensuring families have health insurance. Helping families feel part of the community was a focus for the school PTA and Parent Ambassador Team who were available to answer any questions parents had. In addition to SILA – Sotogrande International Language Academy, who offer courses in Spanish to help new families on their journey living and integrating into a new community and country as well as offering classes in English, French, German, Russian and Chinese. The day ended with a BBQ hosted by Sotogrande SA at La Reserva Golf Course, where new families relaxed and chatted to teachers and parents in the beautiful setting, while the student played and forged new friendships, excited for the coming year.

Suena el primer timbre del año, se abren las puertas y arranca la ‘Vuelta al cole’. Un año calendario más, con la primera quincena del mes de septiembre (en diferentes fechas según las distintas etapas escolares), comienza el éxodo infantil desde las playas hasta las bancadas y aulas para los varios centenares de niños en todo el municipio y muy especialmente en Sotogrande y todo el Valle del Guadiaro. En este curso escolar 2016/17, hasta un total de 2.183 escolares componen la comunidad educativa del Valle del Guadiaro en todos sus ciclos. Una cifra no del todo completa (suelen quedar al margen, no contabilizadas, las plazas en guarderías privadas) pero que con los datos tangibles que a con-

tinuación se detallan supera en más de 150 a las cifras del curso anterior, sobre unos dos mil. Ciñendo un poco más la cuota que cursa los estudios en el Valle del Guadiaro (1.819), el margen de crecimiento también es algo superior respecto al cómputo registrado el pasado curso de 1.722 escolares. ternacional de Sotogrande. Recordar que hace algunos meses, también recogido por estas páginas, volvió a aparecer el centro en la prestigiosa lista de los cien mejores centros en España. Este año cursarán nada menos que 855 alumnos sus estudios en las extraordinarias instalaciones de las que dispone el SIS (como se le suele conocer de manera abreviada), en la parte alta de la Urbanización, junto a La Reserva de Sotogrande. Una cifra asombrosa y de gran relevancia si tenemos en cuenta los 720 alumnos que contabilizó a principios del pasado ejercicio (no es extraño en Sotogrande la llegada de nuevas familias a la zona en diferentes épocas del año con el curso ya en marcha). Eso se traduce, en cifras, con nada menos que 206 alumnos de nueva matriculación en el Internacional de Sotogrande este curso. Una comunidad

muy involucrada en la vida de la Urbanización y que por parte del colegio suelen darse a conocer con otras familias por diferentes eventos y actos sociales. Además, el colegio disponte de un departamento destinado a la instalación y acomodo de nuevas familias en Sotogrande.

chos de los más fundamentales valores de integración y sociabilidad cultural. En este curso, concretamente, entre el alumnado conviven escolares de 44 nacionalidades diferentes. Siendo de éstas, la predominante, la española con un 36% del total, seguido de los alumnos de Reino Unido (27%). Destacar también el tempranero inicio de curso de los más pequeños, en las diferentes guarderías públicas y privadas. En este caso, mencionar las 41 plazas de la Escuela Infantil Puente de Hierro, en Guadiaro. El gran desembarco fue el comienzo de curso, para Primaria e Infantil, en algunos de los casos, el pasado lunes 12 de septiembre en el que lo hicieron más de tres mil alumnos en todo el municipio de San Roque. Entre ellos, se encuentran los 491 alumnos con los que este año cuenta el CEIP Gloria Fuertes entre sus dos centros (Gua-

diaro y Pueblo Nuevo). Una cifra que se reparte ciertamente entre los 175 matriculados en la etapa de Infantil y los 316 registrados, hasta el momento, en el ciclo de Primaria. También, en este centro, se resalta el carácter multicultural, como en todos los del Valle del Guadiaro, reuniendo entres sus aulas a alumnos hasta de 25 nacionalidades diferentes. Todo un gran valor del que disfruta la zona con esa enorme riqueza intengradora. En el caso del CEIP Barbésula de San Enrique de Guadiaro, el número de alumnos crece respecto al pasado curso (123), alcanzando hasta 150 matriculados para este calendario 2016/17. Se reparten en 45 alumnos en la etapa de Infantil y unos 115 en los diferentes

El jueves 15 de septiembre se pusieron manos a la obra los estudiantes del IES Sierra Almenara que concentra la enseñanza secundaria pública en el Valle del Guadiaro. This helps to strengthen many of the most crucial values of integration and cultural sociability. This year specifically, there are 44 different nationalities among the school pupils. The predominant natio-

nality among them is Spanish, covering 36% of the total number, followed by pupils from the United Kingdom (27%). We should also highlight the early start to the year for the little ones, at the different public and private nurseries. In this case, it is worth mentioning the 41 places at the Puente de Hierro Nursery School, in Guadiaro. The big event came with the start of the school year, for Primary and Nursery pupils, in some cases, on Monday 12 September, with more than three thousand pupils throughout the municipality of San Roque returning to school. This includes the 491 pupils attending CEIP Gloria Fuertes, split between the two school sites (Guadiaro and Pueblo Nuevo). This figure is split between the 175 registered for Nursery and the 316 registered until now for primary school. This school also has a markedly multicultural character, like all of those in Valle del Guadiaro, bringing together 25 different nationalities in its classrooms. All of this is a great asset that the area enjoys with the enormous richness of integration. In the case of CEIP Barbésula in San Enrique de Guadiaro, the number of pupils has grown in relation to last year (123), reaching a total number of 150 registered for 2016/17. There are 45 pupils in Nursery and 115 in the different Primary School years). The last back to school, are the older pupils. On Thursday 15 September, the students at IES Sierra Almenara, which accounts for

la administración local para la remodelación y adecuación de los diferentes centros en San Roque. En esta línea, conocemos varias de las opiniones de concejales del Ayuntamiento de San Roque

Junta General de ACUMAR, celebrada este verano El pasado día 19 de Agosto, en el salón Patiño del Club de Golf La Cañada, se celebró la Junta General de Presidentes de la Asociación de Consumidores y Usuarios de La Marina de Sotogrande, ACUMAR; contando con la presencia de los presidentes de todas la comunidades que forman parte de la Asociación, así como de los administradores de las mismas. En la Junta General, tras analizar profundamente la situación, se tomó por unanimidad la decisión de exigir de manera ﬁrme, tanto al Ayuntamiento como a Sotogrande, el cumplimiento de los últimos requerimientos que permitan llevar a cabo lo establecido en el Plan General de Urbanismo de San Roque. Igualmente y hasta el momento de la puesta en marcha de la Entidad Urbanística (EUC), se requerirá el cumplimiento correcto del REM, por parte de Sotogrande, S.A.. Y de igual forma se requerirá a ARCGISA para que tome las medidas necesarias de forma que la infraestructura de las canalizaciones de agua y la ubicación de los contadores sean las apropiadas para permitir la facturación individualizada, de acuerdo con lo establecido en el Reglamento de la Concesión del Suministro de agua. Además se acordó proceder en todo momento de la manera más consecuente posible para preservar los intereses y desarrollos de La Marina y su entorno.

On 19 August, the Patiño salon at Club de Golf La Cañada hosted the General Assembly of Presidents, of the Association of Consumer and Users of Sotogrande Marina, ACUMAR; the event was attended by the presidents of all the communities that form part of the Association, as well as the administrators of the communities. At the General Assembly, after deep analysis of the situation, a unanimous decision was taken to ﬁrmly demand that the Council and Sotogrande fulﬁl the latest requests that would make it possible to carry out what is established in the San Roque General Urban Planning Plan. Likewise, and up until the launch of the Urban Conservation Entity (UCE), it will request correct compliance with the REM, by Sotogrande, S.A. Similarly, it will request that ARCGISA take the necessary measures in such a way that the infrastructure of water channels and the location of meters are suitable to allow for individual billing, in accordance with what is established in the Regulation on the Concession on Water Supply. Furthermore, it agreed to proceed in the most responsible way possible in order to preserve the interests and developments of the Marina and its surrounding area.

La Confederación de Empresarios de la provincia de Cádiz (CEC) celebró una nueva cita del ciclo “Café con…” en La Línea, que contó con la participación del alcalde de La Línea, Juan Franco, y el de San Roque, Juan Carlos Ruiz Boix, además de otras autoridades. Gibraltar y el ‘Brexi’ fueron los ejes centrales del encuentro. Con este evento, que se desarrolló en el hotel “Ohtles Campo de Gibraltar”, la CEC trató de acercar el mundo empresarial a los diferentes representantes institucionales y a personalidades relevantes del panorama económico, social y empresarial, creando así un punto de encuentro del que la Confederación de Empresarios considera que pueden extraerse importantes conclusiones. Ruiz Boix señaló que “el rumor sobre la necesidad de contar con un visado para trabajar en Gibraltar, por lo tanto hay que estar

atento a esa realidad y recordar cual es la importancia económica que algunos no quieren ver”. Destacó que “la cuestión es que a Gibraltar acuden a trabajar casi diez mil personas de la comarca, también del municipio de San Roque y que ya cuando se cerró la verja provoco un éxodo masivo de la población de la comarca que perdieron su empleo con ese cierre”. Por ello, el alcalde entiende que “hay que estar ocupado y preocupado en ofrecer respuestas y que esta situación del Brexit se vea como una fortaleza, como una oportunidad”. Por su parte, el presidente de la Confederación de Empresarios de la provincia de Cádiz (CEC), Javier Sánchez Rojas, señaló que “con este acto hemos dado la oportunidad al alcalde de La Línea de contarnos a un ámbito eminentemente empresarial cuál es la situación, cual es la coyun-

tura frente a una situación que se desencadenó el 23 de junio con el referendum británico”. Sánchez apuntó que “desde el ámbito empresarial, lo que le hemos trasladado a él y a toda la comarca es el absoluto apoyo empresarial en colaborar en todo lo que se pueda en reflexiones, estudios, análisis,

opiniones, sobre lo que pueda suponer cuando se plasme definitivamente este nuevo escenario”. El conferenciante, el alcalde de La Línea, Juan Franco, explicó que “trabajabamos para poder paliar las posibles consecuencias y sobretodo para buscar soluciones que creo que para eso estamos

Soy optimista porque creo que nos podemos encontrar con una oportunidad histórica para la ciudad de La Línea y para el Campo de Gibraltar y puede incluso servir para reforzar los lazos con Gibraltar. El portavoz del PIVG, Jesús Mayoral, criticó duramente la gestión del Consistorio sanroqueño (o la falta, en este caso), en varias zonas del Valle del Guadiaro. Enttre otras acciones destacó el aspecto “tercermundista en pleno centro de Guadiaro [en la calle Francisco Amado en la confluencia con la calle carretera], en su arteria principal, que han podido ver ver los turistas que han visitado el pueblo este verano”, en referencia al cableado aéreo en esa zona de la barriada. “Desde hace seis meses venimos denunciando a Óscar Ledesma [concejal responsable del Valle del Guadiaro], la invasión que tiene realizada ENDESA de

cuatro postes de luz de soporte del cableado aéreo puestos encima de la acera, que ya es muy estrecha, de unos ochenta centímetros que hace imposible que pasen los peatones por la misma, teniendo que invadir la calzada con el consiguiente peligro que ello conlleva”, relató y matizó que durante carios Plenos han pedido una mejora. “No es de recibo que después de seis meses transcurridos la situación sea la misma y no será por el trabajo que se desarrollan en Valle del Guadiaro. La repercusión del IBI en las compraventas El artículo 63 del Real Decreto Legislativo 2/2004 de 5 de marzo por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales establece que son sujetos pasivos del IBI, a título de contribu1 Luis Babiano yentes, las personas Abogados / Lawyers naturales y jurídicas Sotogrande que ostenten la titularidad del derecho que, en cada caso, sea constitutivo del hecho imponible de este Impuesto. Añade a este respecto el artículo 61 que constituye el hecho imponible del impuesto la titularidad del derecho de propiedad, entre otros, sobre los bienes inmuebles rústicos urbanos y sobre los inmuebles de características especiales. Finaliza el artículo 75.2 que el impuesto se devengará el primer día del período impositivo y que el período impositivo coincide con el año natural. Sin embargo el apartado dos del artículo 63 regula que todo esto será sin perjuicio de la facultad del sujeto pasivo de repercutir la carga tributaria soportada conforme a las normas de derecho común. Todo lo anterior significa que es sujeto pasivo de este impuesto la persona que sea propietaria del inmueble gravado el día 1 de enero de cada año

pero ¿qué sucede si se transmite el inmueble durante el período impositivo? Si seguimos al pie de la letra la regulación legal el vendedor está obligado al pago del impuesto aun cuando el inmueble se transfiera a lo largo del período impositivo. Y será el único responsable de su pago frente al correspondiente Ayuntamiento porque todo lo que digamos a continuación tiene efectos únicamente entre las partes del contrato y no modifica la obligación legal del vendedor de pagar íntegramente el impuesto al Ayuntamiento. Sin perjuicio de esta obligación existe la posibilidad de repercutir el impuesto conforme a las normas de derecho común. Es decir, el IBI lo paga el vendedor salvo que exista un pacto expreso de repercusión del mismo contra el comprador. De tal manera, que si no se dice nada en el contrato de compraventa el impuesto lo tiene que pagar íntegramente la parte vendedora. Esto venía siendo la práctica común en el mercado inmobiliario. Sin embargo este criterio que venía siendo generalmente aceptado ha sido modificado por una sentencia de la Sección 1ª de la Sala Civil del Tribunal Supremo de 15 de junio de 2016 que establece las siguientes reglas: Cuando el art. 63.2 del Texto Refu ndido de la Ley Reguladora de las Haciendas Locales establece que «Lo dispuesto en el apartado anterior será de aplicación sin perjuicio de la facultad del sujeto pasivo de repercutir la carga tributaria soportada conforme a las normas de derecho común», debe entenderse que el sujeto pasivo del impuesto, en este caso la vendedora, puede reper-

cutirlo, sin necesidad de pacto. El tenor del art. 63.2 del Texto Refundido de la Ley Reguladora de las Haciendas Locales advierte de la posibilidad de repercusión, sin sujetarlo a pacto que lo permita, limitándose el precepto a establecer que el reparto del importe del impuesto se hará conforme a las normas de derecho común, que no son otras, en este caso, que las de la compraventa ( art. 1445 y siguientes del C. Civil ), en virtud de las cuales la compradora debe considerarse propietaria desde el momento de la entrega del inmueble (art. 609 del C. Civil). Sin perjuicio de ello, las partes podrán pactar la imposibilidad de la repercusión. Por ello la nueva regla general establecida por el Tribunal Supremo es que, en caso de ausencia de pacto en contrario, el vendedor que abone el IBI podrá repercutirlo sobre el comprador, en proporción al tiempo en que cada una de las partes haya ostentado la titularidad dominical y por el tiempo que lo sea. Resumiendo: 1. Si no se pacta nada en el contrato de compraventa con respecto al impuesto de bienes inmuebles, el vendedor tiene derecho a repercutir al comprador proporcionalmente dicho impuesto. 2. Para que no exista repercusión debe pactarse expresamente entre las partes. Es importante que lo tengan en cuenta partir de ahora en los casos de compraventa que se vayan a realizar.

The Repercussion of Property Tax on Sales Article 63 of the Legislative Royal Decree 2/2004 of 5 March which approves the Recast Text of the Regulatory Law of Local Tax Authorities establishes that legal bodies and persons that obtain the ownership of the right that, in each case, constitutes the taxable event of this Tax, are passive subjects of Property Tax, as taxpayers. The law adds in this regard article 61 that the taxable event of the tax is constituted by the property right, among other things, on rural or urban property and on property with special characteristics. Article 75.2 concludes that the tax will be chargeable on the first day of the taxable period and that the taxable event coincides with the calendar year. However, section two of Article 63 regulates that all of this will be without prejudice to the power of the passive subject to pass on the tax burden supported in relation to the regulations of common law. All of the above makes a passive subject of this tax the person that is owner of the taxed property on 1 January of each year, but what happens if the property is transferred during the taxable period? If we follow legal regulations to the letter, the seller is obliged to pay the tax even when the property is transferred throughout the taxable period. They will be the only party responsible for payment to the corresponding Council because everything that we go

on to say only has effects between the parties of the contract and it does not modify the seller´s legal obligation to pay the tax fully to the Council. Without prejudice to this obligation, there is the possibility of passing on this tax in accordance with the regulations of common law. That is to say, the property tax is paid by the seller unless there is an express pact for the passing on of it against the buyer. In such a manner, if nothing is said in the sale contract the tax has to be paid fully by the selling party. This had been becoming common practice on the property market. However, this criteria that had been becoming generally accepted has been modified by a ruling from Section 1 of the Civil Chamber of the Supreme Court on 15 June 2016 which establishes the following rules: When Article 63.2 of the Recast Text of the Regulatory Law of Local Tax Authorities establishes that “What is provided for in the previous section will apply without prejudice to the power of the passive subject to pass on the tax burden borne in accordance with the regulations of common law”, should be understood to mean that passive subjective of the tax, in this case the selling party, can pass it on, without the need for a pact. The wording of Article 63.2 of the Recast Text of the Regulatory Law of Local Tax Authorities warns of

the possibility of transfer, without subjecting it to a pact that allows it, limiting the provision to establish that the distribution of the tax will be carried out in accordance with the regulations of common law, which are none other in this case, than those of the purchase (Article 1445 and the following ones of the Civil Code), by which the buyer should be considered as owner from the moment the property is handed over (Article 609 of the Civil Code). Without prejudice to that, the parties can agree to the impossibility of transfer. For that purpose, the new general rules established by the Supreme Court is that, in the event of an absence of a pact agreeing otherwise, the seller that pays the Property Tax can transfer it to the buyer, in proportion to the time that each of the party has held legal ownership and for the time that the ownership is. In summary: 1. If nothing is agreed otherwise in the sales contract with regard to the property tax, the seller has the right to proportionally transfer said tax to the buyer. 2. In order for there to be no transfer, it is necessary to expressly agree that between the parties. It is important that you take this into account for now onwards in any cases of purchases or sales that you are going to carry out.

Accidente de tráfico a la entrada de Torreguadiaro 1 Manuel Gil

El pasado jueves, 8 de septiembre, se produjo un accidente de tráfico pasadas las 15:00 horas en la rotonda de entrada a Torreguadiaro por la travesía Avenida Mar del Sur. Una furgoneta, procedente de la bajada de la vía A-7 (que rodea Torreguadiaro) en dirección Cádiz, no pudo detenerse tras entrar en la rotonda y acabó saliéndose

la calzada al no poder girar. El vehículo acabó desprendiéndose en la cuneta donde se encontraba alojado. Pese a lo aparatoso del incidente, el conductor del vehículo (comercial), no sufrió daños de gravedad por el impacto y se mantuvo junto al propio vehículo junto a una patrulla de la Guardia Civil, a la espera de la

llegada de una grúa o una unidad de auxilio que permitiese levantar la furgoneta y ser depositada de nuevo en la calzada.

Ya se encuentra abierto el plazo para el pago del “vado” y el IAE La delegada de Hacienda, Mónica Córdoba, informó que desde el jueves 1 de septiembre y hasta el día 16 de noviembre se abre el plazo del cobro en periodo voluntario de los recibos correspondientes a la Entrada de Vehículos (vado) y del Impuesto sobre Actividades Económicas. Los contribuyentes que se encuentren afectados por el pago de los mismos, pueden recoger los dípticos en la Oficina de Recaudación, en la Plaza de Andalucía y en las Alcaldías de Barrios de Estación, Puente Mayorga y Guadiaro, en horario de 9 a 14 horas, de lunes a viernes. La edil quiso recordar “a los contribuyentes que podrán hacer uso de las modalidades de pago y gestión de cobros por las Entidades Bancarias Colaboradoras (Domiciliaciones y Dípticos), y que se puede solicitar el fraccionamiento del pago en periodo voluntario”. Una vez transcurrido el plazo de ingreso, las deudas serán exigidas por el procedimiento de apremio y devengarán los recargos del periodo ejecutivo. Asimismo, Córdoba ha recordado que hasta el 16 de octubre se encuentra abierto, en periodo voluntario, el pago del Impuesto de Bienes Inmuebles.

Traffic accident at the entrance to Torreguadiaro On Thursday 8 September, a traffic accident took place after 3pm at the entrance roundabout to Torreguadiaro along the Avenida Mar del Sur crossing. A truck, coming from the slope of the A-7 road (which goes round Torreguadiaro) heading towards

Cádiz, was unable to stop after entering on the roundabout and ended up going out over the road as it was unable to turn. The vehicle ended up breaking free from the ditch where it was lodged. Despite the seriousness of the incident, the driver of the (com-

mercial) vehicle did not suffer serious injury from the impact and remained alongside the vehicle along with a Guardia Civil patrol, as they awaited the arrival of a crane and a help unit in order to lift the van and put it back on the road again.

Taxpayers who are affected by these payments can pick up leaflets at the Tax Office at Plaza de Andalucía, and at the Town Halls in Estación, Puente Mayorga and Guadiaro, between 9am and 2pm from Monday to Friday. The councillor reminds affected taxpayers that “You can use the payment methods and collection management processes with collaborating banks (direct debits and two-part payments), and you can apply to make the payment in instalments.” Once the payment period has elapsed, payment enforcement orders will begin and surcharges will be applicable in the enforcement period. Additionally, Córdoba stated that the voluntary period for the payment of Property Tax is open until 16 October.

El Juzgado Mixto número 2 de San Roque, según anunció ayer el propio protagonista en cuestión, dictó el sobreseimiento de la denuncia interpuesta contra el alcalde de San Roque, Juan Carlos Ruiz Boix, por el policía local M. A. V. R., por presuntamente impedir la grabación de un Pleno de la Corporación durante una agitada sesión en febrero de 2013 entre representantes del gobierno municipal y de la entidad local de seguridad. Ruix Boix aplaudió el desenlace de los hechos reprochando la mediática “campaña torticera y sin escrúpulos” llevada a cabo por parte de

la oposición durante todo el tiempo que permaneció abierta la causa. “Afortunadamente los ciudadanos no cayeron en eso y nos apoyaron con una mayoría absoluta que no se daba hace más de 20 años. Se me acusón que había cometido delitos de coacción y prevaricación y que debía dimitir y renunciar a ser candidato en las elecciones. Una campaña orquestada que se basó en una denuncia que ahora es desestimada y archivada”, espetó el regidor. “¿Harán otra compaña para limpiar mi honor y dignidad como político y persona? ¿Quién repara los daños? a los padres la oportunidad de saber más sobre las investigaciones cerebrales más recientes y su impacto en nuestro enfoque de la enseñanza en el SIS. Se exploró la estructura del cerebro y algunas características clave sobre la naturaleza de las neuronas a través de actividades divertidas e interactivas, que eran un reﬂejo de cómo se imparte clase. Al aplicar los enfoques que creemos que mejor funcionan con los estudiantes, se

creó una atmósfera que permitió que los padres hicieran preguntas, establecieran conexiones con sus conocimientos previos y consideraran las expectativas que tienen con sus hijos.

Puerto Sotograde financia una campaña de esterilización de gatos en el puerto 1 M. Gil

Miguel Ángel Diez, director de Puerto Sotogrande, aprobó un presupuesto para la castración y ayuda de los gatos callejeros, ubicados en el puerto deportivo, concretamente en el punto limpio. Otro de los acuerdos alcanzados, de la mano de la asociación Soto Cats Recue, fue la construcción de una zona de alimentación especial para los gatos de la calle, tal y como las que se han construido con anterioridad en tres puntos de la Urbanización. Cierto es que la instalación de estass zonas la construcción es-

tán logrado evitar que los gatos callejeros deambulen en busca de comida por restaurantes, centros comerciales y zonas de ocio. En este caso, un total de 21 gatos fueron esterilizados dentro de la campaña realizada del 25 al 27 de agosto. Con este hecho; queda castrada al 80% la colonia de gatos del puerto de sotogrande, puesto que los 6 restantes no tienen la edad mínima para ser castrados. Dentro del desarrollo de esta campaña se rescató un gato de 4 semanas de edad, el cual estaba en muy malas condiciones y ahora se recupera en una casa de

acogida. “Queremos destacar la amabilidad y actitud colaborativa del director del puerto de sotogrande, algo que nos llena de satisfacción y nos anima a seguir en el camino de ayudar la población callejera de gatos en sotogrande”, se aseguró desde la asociación Soto Cats Rescue, colaboradora en toda esta cuestión.

Asegúrese de que la escritura de la compraventa de un inmueble refleja quién se hace cargo del IBI del año de la compra Frente al ayuntamiento, el responsable de pagar el Impuesto sobre Bienes Inmuebles (IBI) es la persona que sea propietaria del inmueble el día 1 de enero. presamente lo contrario. De acuerdo con este nuevo criterio, en la venta de una vivienda realizada, por ejemplo, el 1 de abril de 2017 y cuyo IBI es de 900 euros, el vendedor podrá exigir al comprador el reintegro de 673 euros, salvo que hubiera renunciado a ese derecho. Por tanto, si usted actúa como adquirente, asegúrese de que en la escritura conste dicha renuncia. En definitiva, con esta sentencia en la mano, es posible que algunos vendedores que transmitieron sus inmuebles hace tiempo se

planteen reclamar al comprador la parte proporcional de IBI del año de la transmisión (siempre que no hayan transcurrido los plazos de prescripción previstos en la normativa civil). Las principales compañías hospitalarias europeas, la alemana Helios (perteneciente a Fresenius) y la española Quironsalud sellan un acuerdo de integración cuyo resultado es la creación del primer operador europeo y uno de los más importantes del mundo. El Colegio San José celebra su XXIX Torneo de Tenis La cita se convierte en nuevo éxito al contar con más de 170 participantes durante la semana de competición en el Club de Tenis Bel-Air de Estepona 1 M. Gil

Las instalaciones del Club de Tenis Bel-Air de Estepona acogieron el XXIX Torneo de Tenis Colegio San José. Los finalistas recibieron 8.000 euros en premios, siendo ganadores Daniel Monedero y Carla Pons en las categorías Absoluto Masculino y Femenino, respectivamente. La competición contó con siete días de intenso espectáculo deportivo en los que 173 jugadores dieron muestras de su gran calidad. Los coordinadores del Torneo, Manuel Morcillo y José Antonio Banderas (Colegio San José) y Sergio Gómez Barrios (Club de Tenis Bel-Air) destacaron la alta participación de esta edición y la profesionalidad de muchos de los jugadores, como Yasmine Kabbaj, campeona de Marruecos sub 12, o los malagueños Luis Gomar, campeón de

España sub 15 y Daniel Monedero, campeón de España absoluto 2010, entre otros. Tras éste, fantástico cóctel, degustación de bebidas, entrega de premios y sorteo de regalos como ya es costumbre en la gran familia que se formado alrededor del Circuito. En el plano deportivo, la Bola más cercana fue para José Manuel Sáiz, mientras que el Drive más largo se lo llevaron Dawn Milton y José Ignacio Benito, en Damas y Caballeros respectivamente. Real Club de Golf Sotogrande adds finishing touch to 4th Circuit A final in true style, a final to remember. The fourth edition of the Sotogrande Magazine Golf Magazine could not have had a more exceptional finishing touch. The historic Real Club de Golf course, an emblem of the early days of the early days of the Resort crowned the final of another memorable edition. Finca Cortesín: superado el gran reto del Circuito El impresionante recorrido de Finca Cortesín, escenario de multitud de torneos internacionales profesionales de enorme relevancia (como el Volvo Masters), acogió la quinta y penúltima cita puntuable para la clasificación de la Gran Final del IV Circuito de Golf La Revista de Sotogrande. Una prueba que contó con más de un centenar de participantes que disfrutaron del extraordinario trazado, uno de los mejores del sur de Europa. El campo en unas condiciones impresionantes y con algo de tregua por parte del levante y del calor, propició una emocionantí-

sima competición deportiva en el que los golfistas tuvieron que emplear sus mejores dotes con el swing para sortear el complejo recorrido y de tan altísimo nivel como el de Finca Cortesín. Además, para combatir los 18 hoyos, los jugadores disfrutaron de un refrescante zumo de frutas al paso entre los primeros y segundos nueve hoyos por la Casa Club. En el apartado deportivo, la Bola más Cercana (hoyo 17) fue para Sandra Hilinger, mientras que el Drive más Recto cayó en manos de José Antonio Román. Fernando Moreno fue el triunfador en

la Categoría Scratch. En Categoría Damas, Qiaru Sun fue la vencedera seguida en el podio por Annick Vander Bracht y Concha Soler. Finca Cortesín: overcomes great challenge of Circuit The impressive course at Finca Cortesín, the setting for several very important professional international tournaments (such as the Volvo Masters), held the ﬁfth and penultimate event with qualifying points up for grabs for the Grand Final of the 4th Sotogrande Magazine Golf Circuit. The event was attended by over one hundred participants who enjoyed the extraordinary course, one of the best in the south of Europe. The course in impressive conditions, and with a little respite from the eastern wind and heat,

provided an extremely exciting competition where the golfers had to user their best swing abilities to get around the complex course of Finca Cortesín which is at such a high level. Also, in order to tackle the 18 holes, the players enjoyed a refreshing fruit juice after the front and back nine holes, in the Club House. Esta entidad, creada en 2008, tiene como objetivo reunir a abogados polistas de todo el mundo a fin de compartir, una vez al año, una semana de polo, intercambio de ideas y experiencias profesionales en los más espectaculares clubes de polo del mundo. Actualmente, Lawyers Polo Association está compuesto por más de 350 abogados polistas, quienes comparten la profesión de abogado y la pasión por el polo y los caballos. El equipo de Dubai se proclamó campeón de la Copa de Oro tras vencer a Ayala Polo Team en la final por 12 a 7 y así adjudicarse el trofeo más importante del 45 Torneo Internacional de Santa María Polo Club. Dubai levantó así por segundo año consecutivo la preciada Copa de Oro tras un apasionante encuentro que logró torcer en su favor en el último chukker del partido. Destacar la presencia del Rey Emérito Juan Carlos I en Sotogrande y realizó los honores de la entrega del galardón. Fue una final muy disputada, con ambos equipos luchando por romper una paridad que se mantuvo hasta el quinto chukker. Fue en ese período cuando la formación que integran Rashid Albwardy, Santiago Stirling, Alejo Taranco y Adolfo Cambiaso consiguió una diferencia de tres goles que supo rentabilizar muy bien en los últimos 10 minutos de partido para terminar de llevarse el

triunfo. Y ello pese a que Adolfo Cambiaso, su principal figura y el mejor jugador de polo del mundo, no pudo terminar el partido tras sufrir un fuerte golpe que lo dejó fuera de la cancha en los últimos tres minutos de la final siendo reemplazado por Juan Martín Nero. En lo que se refiere a los premios especiales, Dolfina Primicia, jugada por Adolfo Cambiaso, fue el mejor ejemplar de la final y el propio Adolfo Cambiaso fue nombrado como el MVP del partido. La Copa Subsidiaria, que se disputó previo a la final de la Copa de Oro Cartier, la ganó el equipo de Lechuza Caracas tras vencer a Dos Lunas A&G Banca Privada por 10 a 8.

La de Oro arrancamos no de la mejor manera pero fuimos retomando el sistema en el siguiente partido, ese sistema que tanto le rinde al equipo y a Adolfo Cambiaso y eso nos llevó a ganar. Dubai, champions of the Sotogrande Gold Cup The Dubai team were proclaimed champions of the Gold Cup after beating the Ayala Polo Team 12-7 in the final to get their hands on the most important trophy of the Santa Maria Polo Club’s 45th International Tournament. It was the second time in a row that Dubai has lifted the prestigious Gold Cup after a passionate match in which they managed to tip the balance in their favour in the final chukka of the match. King Emeritus Juan Carlos I was at Sotogrande and he had the honour of presenting the trophy. It was a very close final, with both teams struggling to break a parity that remained until the fifth chukka. It was in that period when the team formed by Rashid Albwardy, Santiago Stirling, Alejo Taranco and Adolfo Cambiaso forged a threegoal lead that they managed to hold on to for the last ten min-

utes of the match and take the title. This was despite the fact that Adolfo Cambiaso, their star and the best polo player in the world, was unable to finish the match after an injury sidelined him for the last three minutes of the final. He was replaced by Juan Martín Nero. As for the special prizes, Dolfina Primicia, ridden by Adolfo Cambiaso, was the best playing pony in the final while Adolfo Cambiaso was named man of the match. Sotogrande mantiene su impresionante año 2016, respecto a lo que el mundo de la vela se refiere, y acogerá una nueva regata internacional durante el próximo mes de septiembre, concretamente del 22 al 25. Se trata de la cuarta prueba del Racing Tour GC32, un prestigioso circuito europeo en el compiten los catamaranes más rápidos del panorama, considerados de última generación. Los GC32 son unas embarcaciones de 10 metros de largo y 6 de ancho, considerados los yates de carreras más rápidos del mundo. Esta competición está dirigida a equipos profesionales y a particulares que quieran experimentar lo último en alto rendimiento

en regatas de vela, una oportunidad sólo disponible en equipos de la Copa América. Estos barcos, menos encorsetados a los reglamentos de la Copa América, permiten disfrutar de una experiencia única y ‘saltar’ sobre el mar a grandes velocidades. Fruto de todos estos ingredientes nace la competición Racing Tour GC32, que en su edición de 2016 visita entre otros enclaves, la Marina de Sotogrande. These vessels, less constrained by the regulations of the America´s Cup, make it possible to enjoy a unique experience and “jump” over the sea at great speeds. The GC32 Racing Tour has been set up as a result of all these ingredients, and among other places, the 2016 edition is visiting Sotogrande Marina. The current calendar began with the event in Riva del Garda (Italy). Following a stop in Malcesine (Italy), a special event at Lake

Traunsee (Austria) and Palma de Mallorca (3-6 August); the regatta will disembark in Sotogrande from 22 to 25 September, before the finishing event in Marseille, from 13 to 16 October. In total, this edition has eleven teams competing in this discipline: Argo (United States) Armin Strom (Switzerland), Gunvor Sailing (Sweden), Malizia - Yacht Club (Monaco), Mamma Aiuto! (Japan), Norauto (France), Orange Racing (Holland), Realteam (Switzerland), Spindrift Racing (France), Team Engie (France) and Team Tilt (Switzerland).

Aerolíneas Argentinas apunta a volar alto en Europa con un constante crecimiento 1 Jesús Sanz

Aerolíneas Argentinas, una de las principales compañías de vuelo del sur de América y patrocinador del Mediano handicap en el 45 Torneo Internacional de Sotogrande, apunta alto en Europa mejorando sus frecuencias, tecnologías y comodidades en vuelos transoceánicos. Según palabras de Guillermo Rudaeff, director general en Europa de Aerolíneas Argentinas, trabajan para “crecer en la oferta a Europa”. “Tenemos vuelos diarios en Madrid, y tratamos de cerrar en los próximos meses vuelos diarios también a Barcelona. Con los vuelos a Roma, trabajamos para cambiar a Airbus 330, más eficiente que el actual 340 que usamos”. España es un enclave fundamental en la actividad de Aerolíneas Argentinas en Europa. “Es clave. Es más del 50% de la producción en Europa. Por historia, lazos comerciales y culturales, la relación entre Argentina y España está latente también en los vuelos que ofrecemos a diario en el caso de Madrid, y con frecuencia de cinco por semana en Barcelona”, comenta Guillermo. El próximo 25 de septiembre se celebra el IV Triatlón San Roque. La Delegación Municipal de Deportes adelantó que en este momento se cuenta con más de 130 inscritos, cuando en 2015 se apuntaron 155 deportistas, por lo que se espera superar con creces la cifra de participantes de la pasada edición. Recordar que esta prueba atlética de resistencia, que combina las disciplinas de natación, ciclismo y carrera a pie, tendrá su prólogo en la jornada del sábado 24 con una gran fiesta en la playa de Torreguadiaro. A partir de las 17.00 horas se desarrollará un Acuatlón Infantil, en el que se prevén unos 40 participantes, al que seguirán partidos de los siguientes deportes: rugby playa, voley playa y pádel playa. En esta ocasión, igual que en los últimos dos años fuimos mostrando imágenes históricas de la Urbanización y el entorno, publicaremos imágenes de rincones, detalles o lugares muy conocidos por parte de todos los residentes de la zona pero poco reconocibles según el ángulo en el que aparezca la imagen.
