MARRIAGE V COHABITATION a fair fight?

T

he breakdown of a long-term relationship is often painful. But sadly the heartache can be multiplied when a married or cohabiting couple consider the division of their wealth after separation. Historically, a married person might expect to fare better than a cohabitant but recent decisions in the Scottish Courts have indicated a switch in fortunes may be happening. Scottish family law finally caught up with social change in 2006 when cohabiting couples were granted improved rights over how their assets are shared on separation. On divorce, couples are entitled to share their combined assets, whether those assets are in their joint names or held separately. On separation, cohabitants retain what they each own. However, whether married or cohabiting, individuals may seek “compensation” for advantages bestowed or disadvantages suffered, such as giving up a career to care for children. In a recent Court of Session case, a wife had sacrificed her own career and had contributed significantly to the running of her husband’s enterprise during a long marriage while bringing up their three children. She was awarded £250,000 for her supposed disadvantage. But this represented a tiny fraction of the capital value of her husband’s overall wealth, albeit that much of it had been inherited. Yet, in a 2013 decision from the same Court, a cohabitant, who had also made financial contributions and personal

sacrifices during a long cohabitation, was awarded a similar sum but, crucially, the award represented approximately one third of the overall wealth of her partner. What lessons can be derived from such decisions? Principally, this highlights that litigation is a fickle business but it also illustrates that resolving a break-up collaboratively is more likely to deliver a fair and equitable settlement. But, the way in which the Courts view how “disadvantage” is compensated in divorce does require some concerned scrutiny if “fairness” is truly to remain the touchstone for decisions on divorce.

Jennifer Reoch is a former Miss Scotland who swapped pageants from programming and is now co-presenter of STV Glasgow’s The Riverside Show. Here the lifelong Southsider steps away from the cameras to talk about one of her favourite subjects, Glasgow. What is Glasgow’s must see attraction? For me, the most beautiful building in the city is Glasgow University. The history that surrounds it is fascinating and the views from the front of the building are unrivalled. I spent four years studying here and I could still spend all day just staring at the architecture. The city’s best kept secret? The amazing rowing scene on the River Clyde. There are boathouses in Glasgow Green and boats fly up and down the river in all weather. Where in or around the city do you go for a quick escape? The top floor of Princes Square for a bit of people watching is always a good way to escape for an hour or two. Out of the city, Luss at Loch Lomond is so close yet feels a million miles away. Where’s the best place to go on a Sunday? A stroll around Pollok Park in the Southside. The park is beautiful in all seasons and the perfect way to relax and get some fresh air. The Highland cows are always fun to watch and the cafe in Pollok House is perfect to refuel.

My top tanning tip is don’t forget to bronze your ears. Beauty top tip? Don’t cherry pick when it comes to skincare products. Find something, try it and if it works expand your collection of that brand.

With hobbies including cooking, baking and travel, Jenny Barnett is perfectly suited to her role at Harvey Jones Kitchens where she gets the opportunity to travel across Scotland designing clients’ kitchens. How would you describe your ‘signature’ look for your home? Modern and light with a cosy twist using textures and colour. I am naturally organised which is reflected in the functional use of space. What makes a house a home? Memories. I have a wall covered in framed photographs of holidays and good times. My top interiors tip would be… For kitchens, really think about how you want to use the space. For example, do you plate up at the worktop or the table? It is the small details which make the space easier to use. Tell us something surprising about your home. I have a balcony where I grow over 20 varieties of vegetables, herbs and flowers. Friends always get a shock when they see the ‘garden’ and my giant tomato plants. For a good housewarming present I’d buy… Something personal. I am making a picture for a friend using coloured layered cut paper.

As Cruise’s assistant womenswear manager, Donna guides her clients through all their sartorial dilemmas at the Ingram Street store. Here she shares her own personal style statements. I’d describe my style as… rock chick. I love quirky styles and black is my colour of choice. The person whose style I most admire is… Kate Moss. My favourite designer is…Yves Saint Laurent. When it comes to fashion I’m a bit of an… investment buyer. My favourite recent find was… a fantastic western shirt from The Kooples. My best fashion bargain ever was… a Mulberry Bayswater bag, bought 10 years ago at a Cruise event. A timeless classic. If money were no object on the fashion front I’d buy… Saint Laurent leather biker jacket and handbag, probably the Sac de Jour tote. When it comes to style I think it is important to… dress in clothes you feel comfortable in and that express your personality. The most ridiculous thing I have ever had to wear… A Katharine Hamnett skater suit. It was 1990. My fashion no-no is… bad tailoring. Life’s too short for a bad suit. My fashion tip is… every woman should own a quality pair of leather trousers, teamed up with a suit or tux jacket, a pair of Valentino Rockstud shoes and a clutch. Fab.

FAR LEFT: Nevada, USA, 2008 This image of Bill was made for my Highway 50 project. I was the only non US citizen asked to create a portfolio for NBC’s Character Project. Eleven artists were eventually selected from many hundred who submitted their proposals and hopes as to how to capture the diversity of the US. I chose to drive the entire Highway 50 from West Coast to East Coast. Lebanon,1993 I was in Lebanon making a personal project when driving north of Beirut I came across a group of folk living in tents at the side of the road. I was making some portraits of two men when this young girl simply walked between them. I made a quiet simple portrait and took only two frames before she turned and left. This is still one of my most powerful images and memories.

The title comes from a letter written to the photographer’s adoptive mother and is, along with the stark image free book cover, the first indication as to how personal David views his photography. While other photographers would go for a flashy, bold or celebrity based image for a book cover, Eustace, who will be honoured as the first contemporary photographer to have his work exhibited at The Scottish Gallery in February 2015,

simply and subtley invites the viewer to delve inside and, with each page turn, revealing an intimate connection with each of his subjects. From windblown Hebridean landscapes to sun soaked vistas of America, from the knowing faces of the children of Lebanon to the serenity of child monks in Burma, along with a series of beautifully composed, intimate, celebrity portraits, from first viewing it is clear this volume of over 250 images taken over the past 25 years is far more than simply a collection of photographs. Here, exclusively for i-on, David has chosen some of his favourite images from the book and reveals the story behind them.

LEFT: Glasgow, Scotland, 2003 This was a fashion image for The Herald magazine. I’d been asked by the then editor to bring some new life to the fashion pages and approached my dear friends Kelly Cooper Barr and James Gilchrist. Kelly eventually became the fashion editor and for three years we worked together to create a new look to the magazine. In this time the magazine won UK Supplement of the Year. ABOVE: American Mid-West, 2009 This image is of my daughter, Rachael, and made during the In Search of Eustace project. I was approached by the US firm Anthropologie who had launched a new arts based web initiative with the idea to commission people who ‘inspired Anthropologie’. I was the first person asked and

again given complete freedom to come up with the project and its development. I decided to go on a road trip with Rachael, who was 16 at the time, and we covered over 2,500 miles around the American Mid-West. Starting at Chateau Marmont in Los Angeles and following a rather zig zag route, we ended up in a small town south of Dallas, Texas, called Eustace. It was very brave of Anthropologie at the time as even the clothes Rachael wore were her own and had no link to the company. It showed the confidence the company offered in their own brand. This was about artists and how they inspired the brand. I was once asked if this was my most important portfolio. I said I wasn’t sure... but I know it is my most meaningful.

I was travelling someway off the coast of Burma and came across this incredibly remote fishing village on a tiny island and a group of pilgrim monks had set up a small monastery on it. I found this child so peaceful and calming. There’s a link I knew existed as soon as I pressed the shutter’s button.

RIGHT: Glasgow, Scotland, 2011 This is John Byrne wearing a suit from another friend, Glasgow designer Deryck Walker. I regard John Byrne as Scotland’s greatest living artist and over the years have been fortunate enough to photograph him many times and get to know him as a friend. He is one of those people I find so incredibly inspiring and his outlook on art is very honest.

Despite spending his days satisfying hungry appetites in his popular cafés, Piece co-founder John Moore doesn’t feel the need to escape the kitchen after a long shift. In fact, it’s his favourite room at home too.

“I

t may seem like a busman’s holiday but our kitchen is definitely my favourite room,” says John, who lives with his wife, Jenny, and their cocker spaniel, Monty. “The original kitchen was weird so we ripped it out and stuck it downstairs to create a utility room for the dog and we’ve finally got to build our dream kitchen upstairs.” The couple moved to the Park district two years ago having felt their previous property in the hugely popular Finnieston was just too close to John’s business on Argyle Street. But despite the need to distance home and ‘office’ John has managed to bring some of his work home with him – at least in the kitchen’s semblance. “Yes, the look has definitely been inspired by commercial kitchen and restaurant design, especially with the use of steel. “We designed the kitchen and diner purely for cooking and partying - no washing machines or ironing boards in sight and, as a space, it’s incredibly effective. With just the two of us the room feels cosy but we have had 40 at a party and the room accommodates the volume fairly easily.” Apart from the impressive steel clad island and American sized fridge, the other dominant feature in the room is the stunning 10 foot kitchen table which is actually an old refectory table that the couple found at Finnieston’s Mulberry Bank Auctions – a good example of the couple’s

success at mixing contemporary buys with classic quality pieces around their home. “We have a quirky and fun thing going on and that in part is because when I was growing up in Belfast I lived in a quirky Victorian house that still had all the old servants bells, sinks, fireplaces, etc.; the type of things people ripped out and now want to replace. “I think I always wanted to live somewhere similar. Along with the furniture, the flat’s high ceilings, rattling windows and impossibility to heat offers me complete nostalgia.”

While the couple had clear ideas on what kind of home they wanted to create they did benefit from being friends with Rehab Interiors designer, Lee Sowerbutts, but not in the actual design process. “Lee was moving home and some of his furniture didn’t work in his new place so he offered it to us. His carefully bought pieces have definitely been one of the most worthwhile investments we’ve made – other than the kitchen, of course.” Having no distinct theme has also helped when it comes to dressing the rooms and that’s why the modern classics such as the black leather Barcelona chair in the kitchen and Arco floor lamp in the living area are perfect housemates to the likes of the refectory table and the couple’s medicine cabinet bureau. “I think if there’s any theme at all it is cushions – which seem to multiply on a weekly basis,” says John. The property is a work in progress and the couple say it will take years to renovate but with John’s business going from strength to strength – two new Piece locations will open in 2015 – the couple are happy to take their time. “I do have a short attention span,” confesses John, “so there will be more changes along the way but until we have the time and the cash, we’re both really happy in our quirky, unfinished but fun home.”

I

t took a bit of arm twisting for me to convince my meat loving mate Ronnie to join me for an evening of purely vegetarian food. Just like many others, he’s a man who believes a meal’s not a meal without a bit of meat. But twist I did and off we went to the West End to visit Glasgow’s only Indian vegetarian restaurant, Usha’s. On entering we were greeted not only by a friendly waitress but by three black and white photographs of Jawaharlal Nehru, Mahatma Gandhi and Muhammad Ali Jinnah which led my still reluctant dinner companion to quip, “It must be good, they’ve had some really famous visitors already.” The restaurant itself looks good - contemporary but with some traditional Indian touches. I especially liked how the mezzanine was dressed in a hanging gardens style sparing diners upstairs revealing more than they should. We were shown to a two seater booth, given our menus and the advice that the dishes were tapas style so three to four dishes per couple should be enough to satisfy us.

I thought a drop of the hard stuff might smooth the culinary waters so a bottle of merlot, £15.95, was quickly ordered. The menu was pretty comprehensive and seeing old faithfuls like Pooris, Pakoras and Tandoori Sizzlers allayed Ronnie’s fear that there would be nothing he’d like to eat and I was more than happy with the choice. There was even a ‘World’ food section which I ignored as I don’t expect to see a Vindaloo on the menu of a Mexican or Italian restaurant so seeing fajitas and pasta on the menu here baffled me. Being greedy, and unconvinced that three small dishes would be enough, we chose four to share with our picks being a Paneer Dosa with a Dansac masala at £4.95, Palak Paneer at £4.95, Tarka Dal at £3.95 and a stuffed Tandoori Mushroom Sizzler at £7.95. We also ordered a couple of Lacha Parathas at £2.25 each. Our waiter also explained we could request the level of heat to the dishes – a nice touch and good for groups with different chilli tolerances.


DINNER | 67 First up was the Dosa, presented on a board with three dips as well as the separate hot Dansac sauce. This was definitely on the generous side, impressively so. Splitting the crispy crepe in half revealed the soft melted cheese and on first bite my companion’s vegetarian scepticism quickly disappeared – much like the Dosa itself. The Tarka Dal and Palak Paneer came next accompanied by the Parathas. Served in mini casserole dishes, the puce Palak Paneer was thick and garlic laced and the top class Tarka Dal was rich and well balanced, with the lentils having just enough bite. We both agreed that any bigger and we’d have struggled to start, let alone finish, the incredible Tandoori Sizzler which quickly followed. Now this was special and definitely sized to share. Packed with a seriously spicy potato mix, these sizzling mushrooms had quite a kick. Anyone who thinks life’s too short to stuff a mushroom needs to try these. Those familiar with Usha’s location will know this site has been a bit of a white elephant of late with no restaurant lasting on this spot for long. But if our quality experience, and the speedy return of confirmed carnivore Ronnie just days later, is anything to go by, Usha’s deserves to be the restaurant that bucks that trend. There’s a good selection of daily specials and a good value Market Menu – two courses for £14. Tables can be a little tight so be prepared to get cosy. Fully licensed, there’s £5 corkage BYOB. Good for… brunch, lunch and dinner. Expect to pay… £5.95 for sea fish chowder, £14.95 for a Ramsay’s pork belly main course, £5 for clootie dumpling and custard. Anything else? The Black Sheep Bistro Good things come in small packages and that’s definitely true of this compact family run restaurant. The menu is fit to burst with dishes your granny would be proud of. The portion sizes are more than generous so visit with an empty tum to fully appreciate the experience. Good for… the homemade steak pie. The best we have tried. Expect to pay… £3.50 for lentil soup, £12.50 for aforementioned steak pie, £8 for meringue and puff candy ice-cream. Anything else? In season now is kale, one of the UK’s most nutritionally rich vegetables. An excellent source of vitamins K, A and C, Kale also contains manganese, copper and phytochemicals, which may guard against certain types of cancer. When it comes to cooking, prepare it as you would cabbage and use in warming soups and stir-fries or make healthy crisps by drizzling some kale leaves with a little oil and salt and baking in a hot oven for 10 minutes.

NOSTALGIA TRIP Food fans old enough to remember the much-loved Ed Debevic’s on Miller Street will love the news that another retro 50s restaurant group, Ed’s Easy Diner, is opening its first diner in the city in the St. Enoch Centre in November. American classics will make up the menu as ‘50s classics play on the jukebox.
