The Criminalizing of Workplace Accidents In 2004, the Government of Canada passed Bill C-45 which created the first Criminal Code provisions to criminalize workplace accidents. The provisions include section 217.1, which reads, “Every one who undertakes, or has the authority, to direct how another person does work or performs a task is under a legal duty to take reasonable steps to prevent bodily harm to that person, or any other person, arising from that work or task.” Other provisions include sections 22.1 and 22.2 of the Code which make an organization a party to an offence in certain circumstances, including where their authorized representatives are deemed to be parties to an offence, and section 718.21 which deals with the factors a court must consider when sentencing an organization convicted of a criminal offence. The purposes of the new provisions, among others, are to establish duties for organizations overseeing workers, to facilitate the criminal prosecution of organizations for workplace accidents where those duties are breached, and to increase penalties for organizations found criminally liable for workplace accidents. It was drafted in response to the Westray Mine tragedy in Nova Scotia in 1992, where 26 miners were killed in an explosion after methane gas ignited. Employees, union officials and government inspectors had all raised concerns over worker safety at the mine before the explosion, but the corporation did nothing to alleviate these concerns. In the end, the explosion occurred. Compounding the tragedy was the fact that the police and prosecutors failed to obtain convictions against either the corporation or any of its officials for the explosion. Since the inception of these provisions, they have been infrequently used. This, however, appears to be changing. Of four known cases in the last several years, there have been two significant convictions. Earlier this year, in Ontario, Metron Construction pleaded guilty to criminal negligence causing death. Metron (and the contractors it hired) was responsible for the repair and maintenance of balconies for two Toronto highrises. One day, six workers were standing on a platform when it collapsed and fell fourteen floors. Four workers died and one was seriously injured. The sixth worker was the only one properly tethered to a safety line. Later investigation revealed that there were only enough safety lines for two workers. It was further revealed that three of the four deceased workers had marijuana in their systems. At the guilty plea, the Crown sought a fine of $1,000,000 and the defense sought a fine of $100,000. In the end, Justice Bigelow imposed a fine of $200,000. This was in addition to $112,500 worth of fines already imposed on Metron under the Occupational Health and Safety Act (OHSA). The only known trial judgment under section 217.1 of the Code occurred in Quebec in 2010. In R v. Scrocca, an employee was killed when a backhoe driven by his employer backed him up against a wall and killed him. Investigation later revealed that the backhoe had not received any maintenance since 1976 and had little to no brakes left. At trial, the employer tried to argue that he had received no indication that the backhoe’s braking system was faulty and thus did not have the mental intent to commit the offence of criminal negligence causing death. The Court did not buy that defense and pointed out an important distinction between negligence offences and others. In negligence cases, the prosecution does not need to prove intent. Rather, they need to prove that the accused person’s conduct represented a marked departure from the standards of a reasonable person in similar circumstances. In this case, it was clear that the employer breached the standard of care, and by not performing any regular maintenance on the backhoe in thirty years, his conduct was criminally negligent. As an individual, the employer was sentenced to a conditional sentence of two years less a day (a jail sentence served in the community) - a stark reminder that, not only are fines for corporations significant in these cases, where the offenders are individual officers, jail sentences are possible. Importantly, and as referenced in the summary of the Metron case, an organization can face charges under both the Code, as outlined in this post, and/or under the OHSA. While the two fall under two different jurisdictions (the Code being a federal statute and the OHSA a provincial one), there is nothing legally to prevent the laying and prosecution of both sets of charges. To protect against charges, employers must develop and maintain a strict health and safety plan, which is revised as required over time and enforced on employees. Furthermore, if employers are charged, either individually or as a corporation, or both, it is important to contact legal counsel as soon as possible to discuss your legal rights. Joseph C.
