THE TKPOA BOARD OF DIRECTORS have determined that the risk of

any harmful cross-connections to the Tahoe Keys Water Company (TKWC) Distribution System is minimal with the installation of the following “Interim Irrigation Conditions”. The TKPOA Board of Directors are providing this program to allow property owners to irrigate their landscaping using one or more of the five “Interim Irrigation Conditions” listed on the attached “TKPOA Interim Irrigation Conditions” memorandum. Those property owners interested in installing a “Interim Irrigation Conditions” will be required to submit an application to the Architectural Control Committee (ACC) for approval that includes, application fee, ACC application Form 14-16 Unclassified Modification Application, and site plan. All installations will require inspection by TKWC staff prior to use. This application and approval process for interim irrigation conditions installation will be subject to all TKPOA – Rules and Regulation for Water Service and Architectural Control Committee Rules. Testosterone’s Role in Men’s Health Keys Breeze

By Brian Steixner, MD LOW TESTOSTERONE, also known as “Low T,” is a common

condition in men as they get older. Testosterone levels peak around age 30 and naturally decline with age. However, because the decline is gradual, many men do not realize the impact that a low testosterone level can have on their quality of life and overall health. Testosterone is a sex hormone that is produced primarily in a man’s testicles. During puberty, testosterone plays a key role in a man’s physical development; it makes hair grow on the face, builds muscles and causes the voice to deepen. Later in life, testosterone also plays an important role in a man’s sexual function and metabolic health. Decreasing levels of testosterone have long been considered a natural part of the aging process. The older a man gets, the lower his testosterone levels may drop. Low testosterone levels can have real and important health effects, especially on a man’s sex life. Men with low testosterone may have trouble getting and keeping an erection. The erections they do have may come less often and not as strongly as before. A man’s desire to have sex (libido) also decreases as testosterone drops. In addition, low testosterone has been associated with diabetes, high blood pressure, weight gain, depression, and decreased quality of life due to a lack of energy. Men experiencing reduced sex drives or erection issues should make an appointment with their primary care provider; a blood test can help identify low testosterone and rule out any serious causes. Testosterone levels can rise and fall during the day and more than one test may be needed, or a physician may encourage a morning blood test, which is when testosterone levels are highest. If testosterone levels are low, a testosterone replacement therapy can be prescribed in the form of a topical gel, an injection, a patch or implant. Testosterone replacement therapy can help increase sex drive and energy levels, and may decrease a man’s risk of diabetes, high blood pressure and depression. The unknowns associated with aging are daunting, but may not necessarily be something men must live with. Low testosterone levels can be supplemented, helping men take back an important part of their lives.

NOTICE: The TKWC is obligated to advise the TKPOA property owners of the understanding of the laws governing Public/Community water systems licensed by the State of California. Temporary water supply connections to existing or new landscape or household water systems are prohibited when there is a crossconnection unless they have a backflow preventer installed per Title 17 paragraph 7603, tested, and certified by a licensed backflow technician. Any water source stored (i.e., tanks, barrels, tubs) on, or adjacent to the individual properties (i.e., lagoons, waterways, Lake Tallac, Lake Tahoe) are considered “Auxiliary Water Supplies” and are subject to strict guidelines (California Code of Regulations - Title 17) to avoid the possibility of cross-contamination with the TKWC Water Distribution System.

Title 17- Division 1. State Department of Health Services and State Water Resources Control Board, Chapter 5. Sanitation (Environmental), Sub-Chapter 1. Engineering (Sanitary), Group 4. Drinking Water Supply, Article 1. General, Section: 7583. Definitions, (a) “Auxiliary Water Supply” is any water supply other than that received from a public water supply. (e) “Cross-Connection” is an unprotected actual or potential connection between a potable water system used to supply water for drinking purposes and any source or system containing unapproved water or a substance that is not or cannot be approved as safe, wholesome, and potable. By-pass arrangements, jumper connections, removable sections, swivel or changeover devices through which backflow could occur, shall be considered to be cross-connections. Section: 7603. Location of backflow preventers. (b) Double Check Valve Assembly. A double check valve assembly shall be located as close as practical to the user’s connection and shall be installed above grade, if possible, and in a manner where it is readily accessible for testing and maintenance. If you decide to have a backflow prevention device installed, TKWC requires the assembly be installed by a qualified person, be installed in compliance with Title Keys Breeze

17, Section: 7603, the TKPOA Rules and Regulations for Water Service, and the American Water Works Association (AWWA) standards. The installation shall be inspected by TKWC staff prior to the water service being turn back on. All backflow prevention devices must be tested and Certified by a licensed backflow technician, annually and the results recorded in the TKWC Backflow Program Data Base. TKPOA property owners interested in installing a “Interim Irrigation Conditions” on their property will be required to submit an application to the Architectural Control Committee (ACC) for approval that includes, application fee, ACC application Form 14-16 Unclassified Modification Application, and site plan. All installations will require inspection by TKWC staff prior to use. This application and approval process for Interim Irrigation Conditions installation will be subject to all TKPOA – Rules and Regulation for Water Service and Architectural Control Committee Rules. This application and permit allows for safety and control of all our TKWC Water Distribution System for all TKPOA property owners.

CONDITION 1 – Water Truck Irrigation via hose and/ or temporary irrigation system (No onsite storage) • Low risk of cross connection • Architectural Control Committee (ACC) Permit required and Inspect by Tahoe Keys Water Company (TKWC) staff • Periodic unannounced inspections – TKWC staff • Enforcement/penalties for non-compliance CONDITION 2 – On-site storage (tank or water trailer) with no connection to irrigation system • Low risk of cross connection • ACC Permit required and Inspection required by TKWC staff • Hose bib backflow preventers required on all external/internal spigots capable of hose connection • Periodic unannounced inspections – TKWC staff • Enforcement/penalties for non-compliance CONDITION 3 – Installed backflow preventer next to TKWC connection • Low risk of cross connection • ACC Permit required and Inspection required by TKWC staff. Truckee River Operating Agreement (TROA)

The TKPOA nor its property owners currently have water rights under the Truckee River Operating Agreement. Taking water from the lagoons, Lake Tahoe, or Lake Tallac without water rights would be a direct violation of State and Federal law. There is currently no legal right for any homeowner or the TKPOA to pump water from the Tahoe Keys lagoons for landscape irrigation or any other purpose. A process does exist under TROA with the State Water Resources Control Board (SWRCB) through which an individual property owner or the TKPOA could apply for water rights to appropriate water for such use. However, without filing an application with the State Water Resources Control Board (SWRCB) and being granted an appropriative water right, pumping water from the lagoons would not be allowed.

provides the required California Workers Compensation Insurance that provides coverage to employees who are injured during the course of employment. The TKPOA has seen a reduction in insurance premium cost, which is determined based our Experience Modification Rate that results from the amount and severity of workers compensation claims filed in a 5 to 7 year period. TKPOA has been successful in decreasing the number of claims filed through improved monthly and ongoing safety programs and communication with staff.

The TKPOA has been working with Hays Companies–Insurance Broker since 2016 and they have continual delivered on improved coverages at lower costs for our workers compensation package. Hays Companies went out to a total of eight carriers to obtain bids for the 2020–2021 TKPOA’s Workers Compensation Insurance Policy, with Benchmark Insurance remaining the most competitive. Based on working with Hays Companies they have assisted in reviewing and responding to all and any claims, and offer recommendations to improve safe work practices. Operations. The credit goes to the TKPOA staff for their ongoing commitment to safe work practices and continually creating a safe work environment. Since 2015, the TKPOA management staff implemented the “Work SAFE” monthly safety program with employee incentives for each quarterly milestone passed each year without an accident resulting in lost workdays. The Rules

The rules are straightforward. TKPOA members should observe the following provisions pursuant to Superior Court Case SV-92-0066:

No Trespassing

When entering through the LHS pedestrian gate, you are on Lot C which is a narrow lot with Pope Marsh on the left and private residences on the right. TKPOA does not own the properties to the right of Lot C. This is private property and the No Trespassing law per California Penal Code 602PC applies. The City of South Lake Tahoe Police Department will be called for trespassing on these properties. The TKPOA has clearly marked the property lines on the right of the lot. The left side of the lot has a chain link fence all the way down to the beach on the Pope Marsh side. Lot C can be used to access Pope Marsh on the left, however access to the beach on the right is prohibited as this is private property and to do so is considered trespassing (CA 602PC). Access to the right is also a dead end at the West Channel Bulkhead. During Lake Tahoe high water events there is typically no Public Trust beach access. To access Lot A at the end of the LHS roadway at the West Channel Bulkhead, you should walk down the LHS paved roadway. Pursuant to the Superior Court Case SV-92-0066 Judgment the TKPOA is responsible for the maintenance and security obligations in enforcing this judgment, and at this time the enforcement of these violations including trespassing violations on the adjacent LHS property will be pursued. Based on TKPOA Security Patrols and pedestrian gate member card reader identification system, the TKPOA has issued warning notices and in some cases, fines, to those members in violation of the LHS gate access as specified in the Superior Court Case Judgment. The TKPOA Board of Directors will continue to utilize the member discipline process in accordance with Civil Code Section 5855 and TKPOA Bylaws Article VI, Membership Rights Section 5, Article IX, Duties and Powers of the Board Section 1(r), and TKPOA Declaration of Covenants, Conditions and Restrictions (CC&R’s) Article XII, Breach or Default, Section 6 (a-f), to enforce this Superior Court Case SV-92-0066 Judgment, related governing documents, and rules. The LHS pedestrian and vehicle gates are under continuous surveillance and all TKPOA member photo ID card access is recorded so it is easy to track any violations. Once the violations are identified with the responsible property owners through the member discipline hearing process, TKPOA property owners could face their individual and property member photo ID card access privileges suspended, member photo ID cards confiscated, and potential fines. The TKPOA is requesting that all property owners please respect these rules so that we can all continue to enjoy this privilege of accessing Lot C and Lot A. Continued violations and flagrant abuse of these rules could result in legal claims against the TKPOA and potential gate closures.

launched a new and improved website: tkpoa.com Based on the recent survey results, the website was the third most popular form of communication, after email and Keys Breeze. While email is excellent for its immediacy, and Keys Breeze is great as a monthly newsletter, both of these are ephemeral. Once you’ve read the email, it’s typically forgotten, and I’m guessing not many keep an archive of Keys Breeze magazines handy. Therefore the website is the best place for homeowners to find the latest information regarding Association matters. Unfortunately, our old website was proving hard to maintain and was no longer being updated regularly. Our new website has a brand new modern look, is designed to work just as well on mobile devices as it does on a desktop computer, and the site has a host of new features for registered users to enjoy.

These features are only accessible to registered members of the site, and all user registrations are vetted to ensure only homeowners and Association staff gain access.

These new community features are designed to allow homeowners to connect online and communicate with each other and our various committees and Board of Directors. I’d like to encourage homeowners to sign in (or register if you don’t yet have an account) and update your profile. Add a selfie and make sure that your name and street are correct. Please use your real name; this is a secure site, and using real names will foster a better sense of community and trust. Looking to connect with your neighbor, go to the member directory to search by name, or filter down to members on the same street as you. Like Facebook, you can send a request to connect with someone you know and send them messages. Great if you’re looking to organize a block party of activity on your street. You’ll notice that most pages feature some of the stunning scenery we get to enjoy by owning here in the Keys. We wanted the site to feel like you were browsing a photo album. That said, I had to raid my photo album to find as many different images as I could; we’d love to showcase your stunning photos instead and switch things up through the seasons. Got a gorgeous shot? Oh, one last thing, this is an experimental part of the site, but we have moved some of the membership forms online. You can find them under the “Documents” menu.

You can now sign up for electronic delivery of notices, for example, something we highly recommend to help reduce costs. Depending on how well these online forms work out, we’ll move more online, including the various ACC applications. CONSTRUCTION SEASON IS HERE. Many of you have projects planned for 2021. If those plans involve any portion of the exterior of your home, the Architectural Control Committee (ACC) needs to be involved in the permitting and approval process. The Tahoe Keys Property Owners Association (TKPOA) Architectural Control Rules (ACR), Section 7, explains Exterior Building Materials and Finish requirements and reads as follows: 07.01 Experience has shown that many finishes and materials do not withstand the harsh Tahoe weather. Many materials are not compatible with the overall appearance the Architectural Control Committee wishes to maintain for the aesthetics of the community. 07.02 Left intentionally blank. 07.03 All exterior siding materials listed in the current California Building Code are considered. 07.04 Siding: Applications for use of any type of siding must be accompanied by a representative sample indicating surface configurations, color and dimensions (width, length, thickness). 07.05 Unprotected wood is not allowed on structures or fences. Colors must complement the environment. Earth tones are advisable and desirable. Flashy, bright, and highly reflective colors are not permitted. 07.06 Before painting or repainting, samples of paint or stain colors must be applied to the structure for review. For new construction, actual material samples on which the paint is to be applied must be provided. Only flat or satin finishes are permitted. 07.07 All exterior surfaces including trim, stairs, railing and garage/front doors must be painted or stained to complement the house and neighborhood.

Public Safety Power Shutoff

PREPARING FOR THE POSSIBILITY

LIBERTY IS WORKING YEAR-ROUND to mitigate the risk of a wildfire caused by electrical infrastructure. While we are making great strides to address the safety and reliability of our grid, extreme fire conditions may still warrant preemptive de-energization measures, also known as a Public Safety Power Shutoff (PSPS). Therefore, planning for and knowing what to expect from a PSPS will aid your wildfire protection and preparedness efforts.

What Constitutes Extreme Fire Weather?

How Will We Know if a PSPS is Activated?

A PSPS is reserved for times when fire weather conditions are at their most extreme, and de-energizing a portion of the electrical grid is the prudent decision to best protect our customers, communities, and the environment. Many of the same factors that are used by fire agencies to determine a Red Flag warning are also considered when determining if weather conditions warrant a PSPS. Liberty has deployed weather stations throughout the service area and collaborates with a fire and weather scientific consultant, the National Weather Service in Reno, Nevada, and local fire officials to monitor real-time local weather conditions to evaluate when to activate a PSPS. No single factor will drive a PSPS. A combination of factors reaching or exceeding set limits drives whether a PSPS will be initiated. Some of these factors include:

• Low Humidity Levels – Potential fuels are more

likely to ignite when there is a lower amount of water vapor in the air. • Forecast Sustained Winds and Gusts – High winds can result in several factors that may cause a fire to ignite. Sustained winds can also cause the fire to spread and even throw embers into the air and create additional fires. • Dry Fuel Conditions – Trees and other vegetation act as fuel for wildfires. Advance notification is critical in any PSPS scenario, and Liberty will alert customers, public safety partners, the community, and others at the earliest opportunity. When possible, Liberty will directly notify customers of a PSPS approximately 48 hours before power is shut off, 24 hours before power is shut off, just before power is shut off, during the PSPS, and once power has safely been restored. Direct notification is the best, most effective way to keep customers apprised of a PSPS event. We strongly encourage every customer to call Liberty at 1 (800) 782-2506 to confirm their contact information is current. If you have a friend or loved one with access and functional needs, help them update their contact information, and consider adding yourself as a secondary contact. Customers with medical equipment that relies on electricity may be eligible for the medical baseline allowance, and those enrolled may also receive priority PSPS information. Call 1 (800) 7822506 to see if you qualify. In addition to direct PSPS notifications and updates, Liberty will post outage information at libertyutilities.com, as well as on Facebook (@LibertyUtilitiesLT) and Twitter (@LibertyUtil_CA). Knowing if a PSPS event is coming, how long it will last, and whom it will affect is an important first step to being prepared for and staying safe and comfortable should a PSPS event occur. How do I Prepare?

Once you have confirmed your contact information is current, PSPS preparation is not much different from any power outage preparation. Customers should consider the following, so that their homes, businesses, and families are prepared:

Create an emergency kit, including flashlights, batteries, first aid supplies and maps of the local area. For additional emergency kit necessities, consult Ready. gov. Store non-perishable foods and water to support your family and pets for a minimum of 48 hours. Keep a full tank of gas or a fully charged battery for your vehicle, as gas and charging stations may be affected by a power outage Keep cash available, as ATMs and credit card machines may be unavailable during a power outage. Be sure phones and other critical electronic devices are charged, and consider investing in a backup battery or power source, potentially one that can recharge with solar.

Meetings and Approvals

At the May 19th, 2021 Regular Board Meeting, the TKPOA Board of Directors: Approved the March 2021 Financial Statements. They also reviewed homeowner delinquent accounts and approved one resolution to record a lien and a 2nd resolution to file a foreclosure complaint. A budget sub-committee was appointed to begin the initial work on the 2022 budget. There were four disciplinary hearings for delinquent Keys Breeze

accounts. Disciplinary hearings are generally held when a homeowner is delinquent on two quarterly assessments. At the May 25th, 2021 the Finance Committee meeting, the TKPOA Finance Committee members: Reviewed and approved the March 2021 Financial Statements, received a report and update on the Tahoe Keys Water Co. (TKWC) short-term and intermediateterm plan, reviewed an update on the Cove 3C Bulkhead project, received and update on sales of Lake Tallac individual properties reviewed legal expenses, reviewed a list of budget adjustments, reviewed and discussed the increasing trash expenses and reviewed a draft of the 2022 Budget Development Schedule. The next meeting for the Finance Committee is scheduled for Tuesday, June 22nd, 2021. As a reminder, the Budget meetings, the Board meetings, and the Finance Committee meetings, and are open to members of the TKPOA (meeting dates are subject to change).

Cove 3C & Cove 3A Bulkhead Replacement Projects Update By Kirk Wooldridge, General Manager

Cove 3C Bulkhead Replacement Project (910 Linear Feet – Reach 11 & 12)

AS OF JUNE 1ST, 2021, Anvil Builders Inc. (ABI) has informed the Tahoe Keys Property Owners Association (TKPOA) that they will not be continuing contract negotiations for the Cove 3C Bulkhead Replacement Project. ABI has indicated due to the “change in conditions” of the project constructability with current and forecasted drought condition affecting the lake levels, they are not willing to continue contract negotiations and project planning for a postponed project. ABI has recommended that the TKPOA rebid the project in the future when the conditions are favorable for the project construction and completion. On April 21st, 2021, the Cove 3C townhome property owners legally voted in favor of moving forward with this project, contracting with ABI and validating an individual Townhome Property Owner Special Assessment of $76,000 per townhome property. Now that ABI has withdrawn from the contract negotiations and withdrawn their proposal the project cannot legally move forward as voted on by the Cove 3C townhome property owners. The Cove 3C Voting Ballot for the Cove 3C Bulkhead Replacement is now no longer valid. As of June 1st, 2021, the $76,000 Special Assessment is no longer required by the Cove 3C townhome property owners since the Voting Ballot is no longer valid. For those Cove 3C townhome property owners that have already paid the $76,000 Special Assessment or a portion of it, this payment will be refunded by the TKPOA Accounting department. On May 18th, 2021, the Cove 3A townhome property owners conducted an “email vote” and it was passed by majority vote as legally required, to agree to fund the Cove 3A 23 linear feet portion of this project, which is currently estimated at $125,000 which includes the bulkhead replacement and required drainage work the Cove 3A portion of 23 linear feet (near Cove 3A Townhome Units 146–149) of the total 910 linear feet of this Cove 3C Bulkhead project. Now that ABI has withdrawn from the contract negotiations and withdrawn their proposal the project cannot legally move forward as voted on by the Cove 3A townhome property owners. Keys Breeze

On June 1st, 2021, a Town Hall Forum was held for the Cove 3C townhome property owners via a Zoom webhosted conference call. The Cove 3C townhome property owners in attendance were informed of this current development and notification by ABI. The information stated above was discussed at this Town Hall Forum. An official mailing has been sent to all Cove 3C townhome property owners providing this information.

Cove 3A Bulkhead Replacement Project (110 Linear Feet – Reach 8 & 9 near Cove 3A Units 167–156)

As of April 28th, 2021, Tahoe Marine and Excavating is unable to schedule this project for the 2021 Summer for several reasons. At this time, they are withdrawing their proposal. An official mailing has been sent to all Cove 3A Townhome Property owners providing this information.

Moving Forward

The TKPOA Board of Directors and TKPOA staff will support the Cove 3C and Cove 3A townhome property owners on working toward an improved project design as requested, revision of the construction documents/ specifications, bid sheets, contract, and Request for Proposal (RFP) process. Also, the TKPOA staff and Cove Advisor will work with Cove 3C townhome property owners on developing options for future project funding payment plans, special assessments or quarterly assessments. 2021 Boating Season

As explained above the Cove 3C Bulkhead Replacement Project will not be taking place this 2021 Summer, so no Townhome docks will be affected, or removed for Cove 3C (Units 111–145), Cove 3A (Units 146–167) and Cove 3B (Units 92–110).
