AT THE SEPTEMBER 22ND, 2021 ,58th Annual Meeting and Special Open Board meeting the Tahoe Keys Property Owners Association (TKPOA) Board of Directors approved by board motion the Tahoe Regional Planning Agency (TRPA) Shoreline Plan Memorandum of Understanding (MOU). This approval of this MOU finally provides clarification to two decades of uncertainty for the TRPA and TKPOA. This MOU now establishes a cooperative and comprehensive approach to the implementation of the Lake Tahoe Shoreline Plan that includes the regulation and administration of moorings and lagoons structures in the Tahoe Keys lagoons. Since 2017, the TKPOA Board of Directors and TKPOA Staff have been working with the TRPA to negotiate an MOU to meet the TRPA Shoreline plan requirements. On October 24th, 2018, the TRPA Governing Board originally approved the new Shoreline Plan. This new Shoreline Plan required the TRPA and TKPOA to enter into a separate agreement (MOU) delegating the administration of moorings and lagoon structures to the TKPOA’s Architecture Control Committee (ACC). TKPOA APPROVES THE TRPA SHORELINE PLAN MOU CONTINUED FROM PAGE 3

The new TRPA Shoreline Plan programs include stronger boater education and enforcement of the 600-foot no-wake zone at Lake Tahoe, expansion of the no-wake zone to all Emerald Bay, and new nowake zone buffers around swimmers, paddlers, and shoreline structures at Tahoe to prevent unsafe boating near the shoreline where motorboats, paddlers, and swimmers interact. Other programs provide coordinated enforcement against illegal boat moorings on the lake; more projects to prevent the spread of harmful aquatic invasive species; enhanced monitoring for noise and scenic impacts from boating activity and shoreline structures; and provisions to keep boats with aftermarket exhaust systems that exceed TRPA, California, and Nevada noise limits from operating on the lake. Since this 2018 approval the TKPOA Board of Directors has appointed a Board Subcommittee to negotiate the terms of this MOU with the TRPA. The TKPOA Board Members involved in this negotiation of the MOU as part of the Subcommittee are as follows: 2017-2019: John Gonzales, Rick Wood, and Bonnie Halleran. 2020-Current: David Peterson, Joe Sherry, Bonnie Halleran, and Robert Meyers. Administrative support was provided by Kirk Wooldridge – TKPOA General Manager, Heather Blumenthal – TKPOA Operations Manager and Matt Ober - TKPOA Legal Counsel. The TRPA has been represented over the years by, Joanne S. Marchetta – Executive Director, John Marshall – General Counsel, Paul Nielsen – Special Project Manager, Tiffany Goode – Principal Planner and Permitting Program Manager, and Julie Regan – External Affairs Chief and Deputy Director. The TRPA TKPOA Shoreline Plan MOU has been on the TKPOA Regular Open Board Meeting agenda for the past year and half, and a Town Hall Forum was held on September 22nd, 2021, at the Pavilion and via Zoom.

TRPA TKPOA Shoreline Plan – Annual Mooring Registration Fee

Approximately one-fifth of the moorings serving boats that use Lake Tahoe are in the Tahoe Keys lagoons. Under the Shoreline Plan, all existing Tahoe Keys motorized boat moorings must register and pay the annual mooring registration fee to offset the identified environmental effects of motorized boating on Lake Tahoe. The Shoreline Plan requires that all new and existing moorings on Lake Tahoe be permitted and registered. Moorings include buoys, boat lifts, and boat slips. There are currently an estimated 8,731 existing moorings on Lake Tahoe. Based on the MOU approval beginning in 2021 and continuing each year thereafter the TKPOA within thirty (30) days of receipt of an invoice from TRPA shall pay an annual mooring registration fee of $61,350.00 to TRPA as payment for the yearly registration of 1,227 “Residential Access Points” to the TKPOA lagoons. The annual mooring registration fee is comprised of an annual registration fee of $50.00 for each of the 1,227 TKPOA residential properties that have access to Lake Tahoe. These “Residential Access Points” to Lake Tahoe are defined as a single family or multifamily residential property that has access to structures such as floating docks and boat slips that provide space to moor one or more motorized boats. The TKPOA property owners “Residential Access Points” are comprised of: • 892 Single-Family Home boat docks with the number of approved moorings for $50.00 • 335 Cove Townhome community boat docks with one assigned Boat Slip for $50.00 • 1,227 = (892 + 335) X $50.00 = $61,350.00 Total This Annual Mooring Registration Fee will be collected from the 1,227 TKPOA Property Owners with “Residential Access Points” to Lake Tahoe as part of the Annual Assessment. The 2022 Annual Quarterly Assessment will include this Annual Mooring Registration Fee as $12.50 per Property. ($12.50 X 4 quarters = $50.00) A TRPA application and/or permit fees are not required to be paid by TKPOA and or its property owners to register and/or annually re-register any and/or all the 1,227 Residential Access Points to Lake Tahoe. The 301 Landlocked TKPOA Properties do not have to pay this TRPA Shoreline Plan Annual Registration Fee because they do not have access to the TKPOA lagoons and Lake Tahoe. (1,227 TKPOA Properties – “Residential Access Points) + 301 Landlocked TKPOA Properties = 1,528 Total Properties).

What Counts as a Mooring or a Slip?

• Mooring structures include boat slips which is defined

as: Boat Slip: The portion of a pier or flat where a boat is berthed or moored or used for embarking. • The number of TKPOA Boat Slips are determined through the Architectural Control Committee (ACC) approval process of a properties Boat Dock and Over Water Platforms.

TRPA Shoreline Plan Benefits to the TKPOA Property Owners

• Offers a streamlined approach to implementing the

required Annual Mooring Registration program by allowing for an annual registration fee for all TKPOA Property Owner’s with Lake Tahoe access. • Current existing dock structures within the Tahoe Keys and Lake Tallac are not required to complete Form 13 and are exempt from the TRPA application and permit approval process, as long as annual mooring registration fees are paid in accordance with

the requirements described in the MOU. The intent of this provision is to recognize existing structures are not subject to retroactive permitting requirements. “Residential Access Points”, docks, or moorings within TKPOA are not development rights as defined in the TRPA Code of Ordinances and are not transferable outside of the TKPOA. There are no required TRPA Annual Mooring Registration Fees for 2019 and 2020 for TKPOA Property Owners, fee starts in 2021. The TRPA recognizes structures existing in the lagoons as legally existing structures, provided the structure has not been unserviceable beyond the time limits set forth in subsection 82.7.4 of the TRPA Code of Ordinances. Improving Running Performance + Avoiding Injuries There are many things

that keep us from enjoying the mental and physical health benefits of running; don’t let injury be one of them. Running injuries come in many forms and are typically the unfortunate result of a physically repetitive activity. Most running injuries start as aches and pains that come and go with varying levels of intensity and distance. When these aches and pains persist and start to affect your form or running gait, injuries happen. Whether you run on road, trail, track, or treadmill, proper running technique along with injury prevention and self care exercises will reduce the risk of breakdown and promote a stronger running performance. Knowing how to run and what to do before, during, and after you run can keep the minor aches and pains from becoming major issues that turn into sidelining injuries.

Before You Run

After You Run

Include dynamic stretching into your warm up routine, including swinging the legs forward, backward and side to side, and marching in place while rotating the hips outward several times. Wear properly fitted running shoes appropriate for the conditions you’ll be in (trail or road). Shoes should not rub or have pressure spots when you put them on and you should have about a thumbnail length between your longest toe and the front of the shoe. Non-cotton running socks help wick moisture and reduce the risk of blisters.

Fuel up. Eating well and staying hydrated can also reduce your risk of running injuries. Just like your car needs gas and oil to run smoothly, so does your body. Make sure you’re getting plenty of rest and recovery between runs. Ride a bike, go for a walk or do some other form of cross-training exercise between your harder runs. Medical support is often needed to support runners’ performance and help them manage and reduce the risk of running injuries by assessing individual mechanics and form. Certified physical therapists help improve performance and address pain through technology-driven assessments of musculoskeletal strength, gait, and range of motion, followed by personalized training programs. The OptoGait video analysis and biofeedback system used at the Barton Performance Lab measures

Start out slowly. The first 5 to 10 minutes running should be part of your warm-up. Stay hydrated and do not run through sharp or burning pain that changes your natural gait.

a runner’s movement through light emitting diodes (LEDs) to detect and communicate data with video cameras—synchronizing data and measuring a runner’s movement and impact at 1,000 frames per second. Factors assessed include foot strike, positioning in the runner’s midstance and power phases, abnormal motions, initial contact, contact time, flight time, step length, and cadence. Based on this evaluation, unique movements including abnormal gait patterns that may be causing pain can be identified. Then, a unique training and exercise program can be implemented to correct any issues or imbalances observed. Each Cove Advisor is responsible for handling the general affairs of the cove including unit/common area facilities; report maintenance, repair and other property owners issues to TKPOA management and follow-up in keeping those property owners up to date with current events, general affairs of projects happening within the Keys, and manage the cove’s budget. docks and accessory structures within the Tahoe Keys.

• Will not require TRPA approval for modifications

and reconstructions which otherwise would require applications, filing fees and permits from TRPA. • No required applications or permits for Boat Dock and/or Over the Water Platforms Repairs, Maintenance or Replacement (Or New Structures) with the TRPA, this is all under the TKPOA Architectural Control Department authority. • This MOU brings the TKPOA in conformance with the TRPA rules and regulations relating to permitting of shoreline structures within the lagoons and the registration of moorings, which is critical to ensuring the continued efforts of TRPA in helping to secure additional funding for the control of aquatic invasive weeds in the Tahoe Keys lagoons. The legal authority of this TRPA TKPOA Shoreline Plan MOU is provided in the following TRPA Code section 84.2.1, which states: “All projects and activities in the nearshore, foreshore, or in lagoons of Lake Tahoe shall comply with the standards and provisions set forth in this Chapter, with the exception that the standards and provisions set forth in this Chapter shall not apply to the lagoons within the Tahoe Keys Homeowners Association”. “Development Standards for the lagoon area within the Tahoe Keys Homeowners Association will be established in a Memorandum of Understanding (MOU) between TRPA and the Homeowners Association (TKPOA).” The TKPOA Covenants, Conditions and Restrictions (CC&Rs) give the Association the authority to regulate the design, construction, modification, and rebuilding of boat docks and accessory structures to be installed within the Tahoe Keys Properties and permit the same only with the written approval of the ACC in accordance with the CC&Rs and the ACC Rules. The CC&Rs also give the authority to regulate the use of lagoons within the Tahoe Keys Properties including, without limitation, the alteration or present lagoon contours, dredging, rock removal, installation of any type of retaining wall, fill, or rip-rap, all of which are prohibited without Association and TRPA approval. Bear Awareness i THE AMERICAN BLACK BEAR,

Ursus americanus, is the most common bear native to North America. The coat of a Black Bear is shaggy and usually black, but it can also be dark brown, cinnamon, yellow-brown, grey-blue, and white depending on location. The black bear is approximately 4 to 7 feet from nose to tail, and two to three feet high at the withers. It has

in the Tahoe Keys

small eyes, rounded ears, a long brown snout, a large body, and a short tail. Adult females weigh 100-200 pounds whereas adult males are larger, at 150-350 pounds, though individuals over 600 pounds have been taken by hunters in California. The first thing a bear thinks about, and their prime motivation is FOOD! These animals have a tremendous sense of smell, which guides them on their search for food. Bears are attracted to residences in the quest for an easy meal. Black Bears are smart. They learn rapidly and know where they have found food in the past. Once they have hit the “jackpot” they may damage property to get back at the food source again. Bears can pry open doors, windows, dumpsters, or other structures if they can get their claws or teeth into a crack or opening. Normally they will do this only if they smell food inside or have ‘been lucky’ before. They can easily tear through screens. CONTINUED ON PAGE 16

What you as a homeowner can do: ELIMINATE OR MASK GARBAGE AND FOOD ODORS

• Deodorize garbage cans with bleach, unscented ammonia, or unscented Pine Sol. • Separate “wet garbage” and keep it in an air and odor tight container. Use garbage disposal whenever possible. Freeze meat bones or other smelly items until pick-up day. • Deodorize soil or other porous surfaces where garbage has been stored and other areas where the bear may have spread garbage around. • Burn off BBQ grid after cooking and clean the drip can.

ELIMINATE THE SOURCE

• Utilize a ‘Bear Proof’ garbage container. • Make sure that trash cans and dumpsters are properly secure. • Put garbage out on the morning of pick-up, NOT the night before • If you cannot be there to put it out, ask a neighbor to help or take it with you for disposal elsewhere. • Do not feed pets outside and do not leave pet food outside. • Do not leave food or air-fresheners in vehicles. • Clean baby seats. Leave NO diapers, clean or soiled, in vehicles. • Remove freezers, refrigerators and ice chests stored in open porches, garages, and breezeways. • Compost piles can be a serious attractant. • Rinsing recyclables is not enough, they recognize this as garbage and will still forage through it. • Bring bird feeders and suet in at night or whenever there is no one at home. Bears will climb trees to reach an upper deck feeder. • For those homes that have fruit trees, please harvest, and remove all fallen fruit from the tree vicinity and the surrounding area. • Bears that have “learned” the likely locations of food storage will continue to make attempts to access those areas such as vehicles, dumpsters, garages, etc. • More aggressive strategies such as electric mats may need to be employed. • The TKPOA Architectural Control Committee (ACC) will consider applications for other storage facility designs on Single Family Homes (SFH) Properties if the storage structure is incorporated within the architectural design of the primary residence building. No stand-alone garbage storage structures are authorized by ACC on SFH properties. Bear boxes for a SFH can be purchased for between $800.00-$1500.00 from several different vendors around the Lake Tahoe Basin.

• All encounters and damage should be reported to California Department of Fish and Wildlife Hot Line (916) 358-2917. • If a bear or bears are in your home, garage, or on your property in a dangerous or threatening manner call 911 and the police may respond and help remove the bear or bears. • You may also contact Shelly Blair DFW Biologist for Alpine and El Dorado Counties at (916) 201-7349 email shelly.blair@wildlife.ca.gov or Nickoli Kallman at (916) 597-8267 email nickoli.kallman@wildlife.ca.gov • People who create situations where bears get food begin a cycle, which usually results in the death of a bear. Do not let this happen, follow ALL the guidelines!

GOVERNMENT POLICY FOR NUISANCE BEARS

TKPOA has bear proof dumpsters at the Pavilion parking lot that aew available to homeowners and longterm renters for disposal of up to two bags of household trash per week. Trash may also be taken to South Lake Tahoe Refuse located at 2140 Ruth Ave, South Lake Tahoe, CA 96150. Their hours of operation are Monday through Saturday 8:00 am to 5:00 pm and are closed on Sundays. In the Tahoe Keys, there have been dozens of bear sightings, break ins, damage, and encounters this year alone. Bear problems need to be addressed on a neighborhood basis. You can do all the right things but, if your neighbors do not, the bears will stay around. More information on California Black Bear Management can be found on the California Department of Fish and Wildlife website at https://wildlife.ca.gov/.

• Close and lock your windows and sliding doors at night (or when out of the room) on accessible ground floors and decks. • Do not leave food in or near a windowsill or on a counter where visible. Sights and smells will be an invitation to bears. • Securely block any access to potential hibernation/ den sites, i.e. under decks, houses or sheds before a bear decides to take up residence. • Strengthen or fortify outside doors and windows on sheds, cellars, workshops, garages, or any place where food or garbage is kept. • Install Electric door & window protection, it solves the break-in problem very quickly!

• The is NO bear relocation program in the state of California & Nevada. • When a complaint is registered about a ‘problem’ bear that involves a threat to personal safety or property damage, a depredation permit is issued. A trap is set and ANY bear who enters the trap is tagged, released, and monitored for further nuisance activity. If the bear continues to be a nuisance, the bear is euthanized. If she is a nursing mother and her cubs are trapped as well, her cubs are also tagged and monitored, and later euthanized if they become a nuisance bear as well.

Administration Department is comprised of several staff members focused on the day-to-day business operations of the Association. TKPOA’s Administration (Admin) Department includes Accounting, Front Desk, Operations, Project Management, and Administrative Office Staff. While the Administration Department has its own purpose and annual budget, several items from other Departments naturally flow into the Admin Department and are reflected in the responsibilities of Admin Staff for administrative support for all TKPOA Departments that are coded under the Administrative Department’s financial statements. For the purposes of the Admin Department Overview, we will take a look at what the Front Desk, Project Management, and Operations Staff provide for the Association.

Front Desk

TKPOA’s Front Desk is the hub of the Pavilion Office and assists in the day-to-day operation of the Association. The Front Desk serves as the main point of contact for all members, guests, tenants, and visitors to the Tahoe Keys. Front Desk Staff greet visitors to the Association’s Pavilion Office, answer phone calls on the Association’s contact line (530) 542-6444, and emails sent to the Association’s general email info@tahoekeyspoa.org and provide the following services: • • • • • • • • • • • •

Front Desk Staff is comprised of one, full time, year around Lead Attendant position and two part time, year round attendant positions. TKPOA currently has one vacant part time Front Desk Attendant position that has not been filled since April 2020. The Front Desk can be contacted at (530) 542-6444 or info@ tahoekeyspoa.org.

Administrative Clerk

The position of Administrative Clerk for a Homeowners Association (HOA) is an integral part of providing outstanding customer service and interacting effectively with owners, renters, guests, and co-workers. TKPOA’s Administrative Clerk is responsible for assisting the General Manager, Operations Manager, and Board of Directors in the day-to-day operation of the Association, maintaining Board records, correspondence, providing back-up secretarial support for all Departments, and the overall coordination and communication for TKPOA Management Staff to Board of Directors and the Association. The Administrative Clerk attends all Board Meetings and prepares the Board Packets, Agendas, and Meeting Minutes as well as attends Committee meetings for the purposes of preparing the minutes as needed and maintains the Association’s Corporate filing system and records retention per Davis Stirling Code requirements. The Administrative Clerk also cross trains at the Front Desk in an effort to maintain consistency in communications and quality service provided to members, guests, renters, and vendors. TKPOA’s Administrative Clerk position was vacant for 1 year beginning in April 2020 through April 2021 due to COVID and Board Direction for the 2021 Budget. In the first quarter of 2021, the Board of Directors restored the Administrative Clerk position due to the fundamental needs of the Board, Association Operations, and Management Staff. Project Management

TKPOA’s Project Coordinator/Property Manager Keys Breeze

is responsible for the research, coordination, analysis, presentation and implementation of annual capital improvement and maintenance projects within the Tahoe Keys Common and Townhome areas, as approved and directed by the Board of Directors. The Project Coordinator maintains the Association’s Major Component Data Base, documents project conditions and progress, prepares Requests for Proposals (RFPs), coordinates work being performed by contractors and vendors, and interacts with local regulatory agencies such as the Tahoe Regional Planning Agency (TRPA), Lahanton, and City of South Lake Tahoe (CSLT) and El Dorado County officials. The Project Coordinator works closely with the Facilities Manager and Cove Advisors on planning for Townhome projects ranging from general maintenance to capital reserve expenditures such as roof replacements, parking lot repaving, and dock repairs/ replacements. This position takes an active role in budget planning and expenditures for all Department and Townhome Reserve and Capital Improvement items. Currently, TKPOA’s new Project Coordinator has been working with the General Manager on the East Channel Bulkhead Replacement Project that is set to be completed in October 2021. Operations Manager

TKPOA’s Operations Manager is responsible for assisting the General Manager in the day to day business operations of the Association, directing the activities of the Association in accordance with policies set by the Board of Directors, and supporting TKPOA’s Community Management Staff. The Operations Manager supervises and oversees operations for the Front Desk, the Security Department, the Architectural Control Department, the Association’s Human Resources Programs, as well as backup supervision of all Departments when Department Managers and Supervisors are absent. This position also manages the Association’s Communications Plan including

General Manager

TKPOA’S General Manager is responsible for managing all of the activities and operations of the Tahoe Keys Property Owner’s Association within the parameters established by the Association’s governing documents, policies and rules as established by the Board of Directors, and applicable laws and regulations while

providing consistent and effective leadership to the Association, its members, volunteers, and staff. The General Manager works closely with the Board of Directors to develop short and long range plans for the Association, ensuring fiduciary responsibilities are met, overseeing preparation of the annual budget and annual report to members. TKPOA’s General Manager attends all Board Meetings and provides Board reports on Association business to assist the Board in making decisions for the prudent and efficient operation of the Association. AS A REMINDER TO OUR MEMBERS, their renters, and

TKPOA’s Member ID Card & Recreational Pass Policy

guests, the following are provisions of TKPOA’s Member ID Card and Recreational Pass Policy for access to the Associations amenities and facilities as revised by the Board of Directors on May 22nd, 2015:

Owners and long-term renters (LTR) must have a current valid member ID card with a valid photograph of the member and/or LTR in their possession when using any of the Association’s facilities. This includes, but is not limited to, swimming pools, spas, tennis courts, parks, playground, beaches and volleyball court.

Up to three guests per member ID card and longterm renter ID card can get access to the association facilities when accompanied by the ID cardholder.

The fee for replacing lost, stolen, or damaged ID cards will be $20. The TKPOA will take current digital photographs with the issuance of ID Cards.

Property owners or their rental management company should direct their rental guests to the TKPOA Pavilion office to purchase short-term recreational passes for use of Association amenities. Vacation renters need to provide a copy of their lease to the front desk— either hard copy or digital copy (for 2020 there is a daily per person fee of $10. Weekly passes are also available). The complete text of the member ID card and recreational pass policy can be found on the TKPOA website, www.tkpoa.com or a copy can be requested from the office. TKPOA staff is tasked with enforcing TKPOA’s operating rules for Association amenities which includes enforcement of the member ID card and recreational pass policy in order to correct violations. Please contact the front desk at (530) 542-6444 if you have questions on the member ID cards assigned to your property or on how to obtain recreational day use passes for your renters and guests. The Pavilion Office is open Monday through Sunday from 8:30 am–4:30 pm.

Property Owners Association (TKPOA) Election and Voting Rules the 58th Annual Membership Meeting was held on Wednesday, September 22nd, 2021, at 5:00 pm in the TKPOA Pavilion. Due to the Caldor Fire Mandatory Evacuation Order in South Lake Tahoe, the initial annual meeting attempt on Wednesday, September 15th, 2021, was rescheduled for Wednesday September 22nd, 2021. At the 58th Annual Meeting, reports were presented on the state of the Association, and the 2021 Board of Directors Annual Election Ballots were opened and counted by the appointed Inspector of Elections – California Notary Public – Tania Green, and TKPOA property owner volunteers Joanne Donmoyer, Sandy McGill, Liz Hansen, Renee Landau, Janet Baumann, and Cathy Cliff.

Meetings and Approvals

At the September 27th, 2021 Board of Directors meeting, the TKPOA Board of Directors: reviewed homeowner delinquent accounts. In the executive session, one counter-offer was approved for a delinquent account. There were not any disciplinary hearings for delinquent accounts. Disciplinary hearings are generally held when a homeowner is delinquent on two quarterly assessments. The Fourth Draft of the 2022 Budget was also reviewed Keys Breeze

with changes and recommendations made for the development of the 5th Draft. The July 2021 Financial Statements were also reviewed and approved. On September 28th, 2021, the Finance Committee reviewed the status of the Fourth Draft of TKPOA 2022 Budget. The Committee was updated on the approved emergency special assessment for the Water Co. shortterm and Intermediate term plans. Insurance quotes were reviewed and a separate meeting was held on October 1st, 2021 to discuss the insurance allocation methods. The July 2021 Financial Statements were reviewed and approved along with the review of the Legal Expense Analysis. The committee further approved recommending a proposal to close one of two Reserve bank accounts for Common and consolidating them together. The next meeting for the Finance Committee is scheduled for Tuesday, October 26th, 2021. As a reminder, the Budget meetings, the Board meetings, and the Finance Committee meetings, and are open to members of the TKPOA (meeting dates are subject to change).

The Water Quality Committee invites you:

Open House Events on the efforts to arrest the spread of Aquatic Invasive Species (AIS) in Lake Tahoe. These events will be held in collaboration with local regulatory agencies and community service groups. They are also open to the public. The TKPOA has invested millions of dollars to combat AIS. The collaborating agencies have mobilized their teams in support of our efforts and matched our investment. This joint effort now enters a critical period. The environmental background work is near completion, and a testing methodology for herbicides and other treatments has been defined. There will be a public comment period on the “draft permit” for the herbicide test this fall. Then, we will be looking to the key regulatory bodies—the Tahoe Regional Planning Agency (TRPA) and the Lahontan Regional Water Quality Control Board (LRWQCB)—or approval of the “Control Methods Test” in January 2022. This is a crucial milestone for the TKPOA AIS effort!
