DURABLE POWERS OF ATTORNEY Durable powers of attorney are very useful tools when planning for the possibility of physical or mental incapacity. Durable powers of attorney allow for the management of one’s financial affairs or the making of medical decisions in spite of an incapacity. In order to understand a durable power of attorney, it is necessary to first understand powers of attorney in general. A power of attorney is used to give one person the right to act on another person’s behalf. The person who grants the power of attorney is called the “principal.” The individual who is given the power is called the “attorney-in-fact.” There are two types of powers of attorney, special and general. A special power of attorney gives the attorney-in-fact the right to act for the principal in connection with a specific transaction or for some other limited purpose. For example, you could use a properly drafted special power of attorney to give, say, your Florida lawyer the right to handle a real estate closing in Florida while you remain in New York. A general power of attorney is much broader. A general power of attorney grants the attorneyin-fact the ability to do for you almost anything you could do for yourself. Effectively, a general power of attorney creates a legal clone. Because of the broad powers granted by a general power of attorney, they should be used very carefully. Traditionally, powers of attorney expired under three circumstances; when revoked by the principal, when the principal died, and when the principal became incapacitated. A durable power of attorney is durable because it does not expire if the principal becomes incapacitated. It is this durability that makes it such a useful tool. A variation of the durable power of attorney is the “durable power of attorney for health care” (sometimes called a “health care proxy” or designation of “health care surrogate”). With this type of power of attorney the principal designates another to make health care decisions in the event of the principal’s incapacity. This type of durable power of attorney is broader in scope than a living will. Generally, a living will is used to place limits on heroic medical treatment in the event of a life threatening illness. Be careful, state laws vary in this area. Durable powers of attorney are helpful estate planning tools and are appropriate for many situations. However, they should generally be viewed as a supplement to, and not a substitute for, a living trust. As always, check with your attorney for your particular situation for the best recommendations.

Labor Day was instituted as the “workingmen’s holiday� by the labor unions in 1882 for that roughly 40% of the workforce who belonged, a tribute to the contributions workers have made to the strength, prosperity, and well-being of our country . For the last four decades or so, cowboys and cowgirls across the top side of Montana have been taking that to heart by holding good old fashioned wagon trains as a way to get away on Labor Day weekend. If you’ve never joined in the fun, now’s as good a time as any; if you’re a wagon train veteran, you already know that! Here’s a rundown of some of the trains that will be rambling across the plains this Labor Day holiday.

Milk River Wagon Train The 41st Milk River Wagon Train near Malta will be hitting the trail again starting Wednesday, September 1 thru Monday, September 6. According to Trail Boss Craig Mangis, it all starts Wednesday, September 1 approximately 35 miles south of Malta, Montana at the Jim Orahood ranch. Starting in Malta, look for Open signs indicating the route to the Orahood ranch, and feel free to pick up a map at Mon - Sat. any of the local convenience stores in Malta. There will be one campsite the entire 7:30 a.m. - 6 p.m. time with day rides 10-18 miles long. Saturday night is a Landowner Appreciation Not just your Supper and musical entertainment, and everyone is invited. Games provide more Sun. 11 a.m. - 3 p.m. ordinary Hardware store! daily entertainment, and on Sunday morning is “Broncs-for-Breakfast�, with area 6 VW 6W (DVW ‡ %R[ ‡ 0DOWD 07 ‡ high school rodeo kids riding broncs. People start packing up and heading home on Labor Day Monday. Different daytime activities are planned for each day September 2nd thru the 5th. North Country Wagon Train A second train, the North Country Wagon Train, has once again selected an outstanding trail for the 2010 Labor Day Weekend. This year it all starts up north at the community known as “Chapman�. The wagon and trail bosses invite everyone to haul in and camp there the first night, Wednesday, September 1st. The best route to Chapman, providing the road is dry, is to go to Dodson, Montana, turn north and head up Black Coulee North Country Wagon Train Road. The distance to Chapman from Dodson is 42 miles. In rainy weather, an alternative route would be thru either Loring or Turner, depending on which direction you are traveling from. The wagons will travel a total of 58 miles from Chapman to Malta. The public is welcome to come by during any night stops and encouraged to bring ICE! Day 1: Thursday, Sept. 2nd. At 9:00 a.m. “Thursday morning we will follow Woody Island Coulee heading south, stopping at Osmond Olson’s cabin, then on to the old Short Place, a trip of about 13 miles in length, slightly downhill, and smooth all the way. There is water available for the livestock at many locations along the way. Day 2: Friday, Sept 3. We will leave the Short Place at 9:00am, passing the East end of Dry Coulee and Lemere Coulee, heading southeast. Noon camp will be at a beautiful place up at the end of Joiner Coulee next to a full, small reservoir. This scenic overlook offers a beautiful view of miles of Cottonwood Creek as

we take the time for our annual memorial service honoring the memories of our many wagoneers that have passed on. After noon stop, we continue on down Upper Cottonwood, ending up at our next camp at the west end of the Bill & Jeanette Murdock ranch on Cottonwood Creek in a wooded, flat area that offers a beautiful picnic-like surrounding with many good, easy to access, water holes. This day’s trek will be 16 miles long and we should make camp at 4:00 pm. Day 3: Saturday, Sept 4th. We leave the Murdock place at 9:00 a.m., again headed in a southeasterly direction down Cottonwood Creek, passing plenty of watering holes as we pass Garland Creek/Coulee. Following noon camp we continue southwest down Cottonwood Creek, then cross Highway 191 North at the Christman Place and continue on to the old Henry Smith place. We will reach this camp after traveling 15 miles at around 4:00 pm. Day 4: Sunday, September 5th. Leaving camp at 9:00 am, we will cross the Milk River just north of our campground. After lunch, we will cross the Milk River at the Doug & Rhonda Simanton place where we will be greeted by a standing 30’ X 40’ tent for afternoon shade and evening comfort at the night camp. After traveling 12 miles, we will have late afternoon and evening music for your listening pleasure. All are invited out for a wonderful evening of fun and entertainment. Day 5: Monday, Labor Day Parade, September 6. We will leave the LaFond Ranch at 10:00 am. traveling west and south thru Bill & Pat Webb’s Ranch, gathering at Westside Service Station for about 30 minutes before proceeding into Malta for the Parade at 11:00. Wagon Boss, John Hasler and Trail Bosses, Bill Murdock & Bruce Cummings encourage any and all outriders, wagons and buggies that wish to join the Wagon Train at any point during the trip to do so. You are more then welcome; please gather with us at Westside and remain with us from the time we leave Westside until we finish in Trafton Park at 1:00 pm where Franklin Smith and crew will have a free feed for Wagoneers and friends. For both of the Malta wagon trains, be sure to bring anything you and your animals need to survive out there. Culbertson Wagon Train Another wagon train takes place a little farther to the east along the Missouri River. Forty years ago, a group of old-time cowboys built an arena for a rodeo, which today is an NRA rodeo still held each 3rd week of June, and also began a wagon train in the Culbertson area that has continued every Labor Day weekend since. Plan to camp Friday night. The wagon train runs Saturday and Sunday and returns to the same camp each night. According to Ken Arneson, the contact for the Culbertson Wagon Train (phone 406-790-0600 or 798-3712), the trail is a good ride, but can be a little rough and “crunchy�, and runs about 12 miles per day. For $100 per rider (teamsters get in free, youngsters at a discounted rate), you get all three meals for both days of the wagon train and hay for your horses, plus two nights of live music and dancing. To get to the camp, Ken says just make your way to Culbertson and watch for the signs or ask any of the locals for directions. Be aware that rubber-tired wagons are not permitted, and although not required, a top on your wagon is encouraged. No pre-registration is needed, so just show up for the fun! Bear Bells In Alaska’s Tongass National Forest, a tour guide was giving a talk to a group of tourists about hiking in grizzly bear territory: “Most bear encounters occur when hikers, being extra quiet along the trails in hopes of view wildlife, accidentally stumble into bears. Ramblings of a Conservative Cow Doctor

We hope you enjoy reading this newest feature in Tricia’s Trader. You may agree, you may disagree with Dr. Kerns’ Ramblings, but you will always have something to discuss over dinner.

Quit Feeding the Dog

All too recently, clients will plop a morbidly obese dog onto my exam table with the chief complaint, “He won’t eat.” I have been dying to respond, “he’s probably full,” but I’m too chicken to state the obvious. It appears America’s obesity epidemic has crossed species lines and since I have yet to see a dog with enough talent, intelligence or dexterity to run a can opener, humans must be the causative agent of this canine healthcare crisis. (I love using that phrase; it makes me feel so progressive.) Here is how this happens. People are programmed to seek pleasure and avoid pain and when you toss a plateful of short rib bones to your ten pound Chihuahua he rewards you by slobbering and wagging his tail. His excitement stimulates the release of pleasure endorphins from your brain. He is fat and dumb, and you’re happy, so all seems well in the beginning. Over time, your ten pound Chihuahua passes through twenty on his way to a record breaking, thirty pounds. He is soon plagued with arthritis, back pain, flatulence and dental disease, but as long as you keep feeding him, he keeps wagging his tail and eating. So how do you get off the fat dog merry-go-round? Quit feeding the dog! Are you with me, because I am going to make a leap here? Pick your favorite figure. Our national debt is $13.2 trillion, our unfunded liability to Social Security and Medicare is $130 trillion, our most recent annual federal deficit is $1.3 trillion and Montana’s biennial budget is nearly $8 billion. Figuratively speaking, our government Chihuahua is bloated and morbidly obese, yet we continue to feed the dang thing. Attention taxpayers: Quit feeding the dog! Perfectly normal, well intentioned people get elected to political office, and they immediately sit down at the legislative dinner table and begin feeding the dog from the treasury. Because legislators get pleasure endorphins for the generous way they feed the dog with other people’s money, government quickly becomes so round it can barely walk to the feed dish. After two legislative sessions, I am certain of one fact: Money sent to Helena will be spent in Helena. Legislators, or the majority of them, lack the self discipline to stop feeding the dog from the table so we must fundamentally shrink the amount of food available. Consider this reduction: Property tax contributes 10 percent of the revenues into Montana’s general fund which has grown nearly 48 percent over the last three legislative sessions. Since Montanans complain the recent property tax reappraisal process is inherently inequitable, let’s eliminate Montana state property tax entirely. Had this been done six years ago and state government still would have grown an insane 38 percent. Stop and think how attractive Montana property becomes as an investment, if it is no longer burdened by property tax; the most unfair of all taxes. As it sits now, you may have been frugal your entire life and retired your 30 year mortgage, but if you senior citizens get behind on your property tax bill you will be removed from your residence down the barrel of a gun. You never freely and fully own your home because you forever pay rent to the government as property tax. This is probably just a pipe dream, because progressives derive all their power from feeding the dog.
