Should I Convert to a Roth IRA?

This is a perplexing question many investors are asking themselves in the wake of all the new tax laws. If the opportunity is available, should an individual take a distribution from an existing IRA and roll it over (i.e., convert it) to a Roth IRA? A good question, but not so fast. The first question should be; “Can I convert to a Roth IRA?”

Beginning in 2010 and thereafter, the $100,000 Adjusted Gross Income limit threshold on conversions has been eliminated. In addition, for those converting in 2010 only, 50% of the conversion income will be included on the 2011 income tax return and 50% of the conversion income will be included in the 2012 income tax return. If this election is made, no conversion income is included in the tax return for 2010. The taxpayer must affirmatively elect out of the two year spread of the 2010 conversion income to 2011 and 2012. The two year spread of 2010 conversion income only applies to conversions made in 2010, and not in later years. Taxpayers should attempt to project their income levels for 2011 and 2012 to determine if electing out of the two year spread makes sense for them. If the election out of the two year spread is made, then all of the conversion income will be recognized on their 2010 income tax return.

What are some of the considerations in comparing a traditional IRA to a Roth IRA? Conventional wisdom suggests that most taxpayers expect to be in a lower tax bracket when they retire. Financial planning based on this assumption would advise an individual to defer taxes to the greatest extent possible during working years, and ultimately pay the tax bill during retirement at a lower individual rate.

Using this logic, converting to the Roth IRA would appear to be a less attractive strategy with taxes paid sooner, based on the individual’s current tax bracket. These days, many people are asking the question; “Will I really be in a lower tax bracket in retirement?” Some important considerations include: What is the likelihood of higher marginal tax rates in the future? Will current deductions for dependents, business expenses and or mortgage interest offset less income in retirement? Will the individual continue to work in retirement, or will they even need the income? Is the objective of the IRA to accumulate assets for heirs? Evaluating the tax impact of the Roth IRA vs. the traditional IRA depends on the assumptions made. Another consideration is whether the account owner will be subject to the estate tax upon death. If the estate tax is an issue, then converting to Roth IRA may make sense in the long run.

Another important consideration in comparing the two alternatives is the manner in which the tax on the distribution from the existing IRA will be paid. For example, a person with a top marginal bracket of 28% is considering rolling over an existing $100,000 IRA to a Roth IRA. When the $100,000 is distributed, the tax due will be $28,000. If the comparison to the existing $100,000 IRA is made with the Roth IRA starting $72,000 ($100,000 - $28,000), the result will be much different than if the Roth IRA starts even with the traditional IRA at $100,000. In addition, if the $28,000 tax is paid from the amount being converted to a Roth IRA, then the 10% premature withdrawal penalty will apply to that amount.

The 10% penalty does not apply if the income tax liability associated with the conversion is paid from sources outside of the converted amount.

If the tax is paid from the proceeds of the IRA being converted, a true apples-to-apples comparison would start the Roth IRA at $72,000. However, if the assumption is made that the tax will be paid from some other source and the Roth IRA starts out at $100,000, the result will likely favor the Roth IRA. This is true even if a calculation is made to consider the opportunity cost of the dollars being used to pay the $28,000 tax due on the distribution from the original IRA.

There are also several other considerations. The uncertainty of tax rates in the future makes this comparison increasingly complex. In addition, the age of the individual electing to convert from a traditional IRA to a Roth IRA is important because the advantage of tax-free distributions from the Roth IRA is leveraged by the length of time the dollars have to grow. The advantage of converting to a Roth IRA generally decreases as the age of the individual increases. Another factor is that, while the individual is alive, the Required Minimum Distribution (RMD) rules have no impact on a Roth IRA.

In summary, there are many variables in the traditional vs. Roth equation that should be evaluated on a situational basis. There are no simple formulas that spell out a clear decision. An individual’s IRA strategy should be integrated with their overall financial and estate plan to achieve optimal results. For many people, the guidance of a professional financial advisor will be a critical aspect in making the decision that is right for them.

The 2011 Legislature passed SB 212 which was signed into law by Governor Schweitzer. SB 212 required an Environmental Analysis be completed including a comprehensive statewide Bison Management Plan prior to the relocation of any bison from the holding facility near Gardiner, Mt. to any area of Montana. When the Montana Fish Wildlife and Parks (FWP) began to initiate plans to move these bison to other parts of the state without a completed Management Plan, the Environmental Quality Counsel (EQC), a committee of state legislators, met to discuss this action.

During the March 17th, 2011 EQC meeting in Helena FWP Director Joe Maurier stated:” Bison once roamed Montana but that is not the case today. Ideally Bison should have free range but we are not there yet.” This statement by the current director of FWP should concern every rancher and private property owner in Montana.

After hearing testimony from FWP and the public during the March 17th meeting, the EQC voted unanimously to send a letter to FWP condemning there plan to relocate bison throughout Montana. The letter informed the FWP that this attempt to relocate bison without a Statewide Management Plan was in direct violation of SB 212.

At a subsequent meeting of the FWP Commission, the Commission ignored the letter from the EQC and authorized the FWP to proceed with their plan to relocate bison and ignore the requirements of SB 212.

The FWP, under the direction of Governor appointed Joe Maurier, are bound and determined to move forward with relocating bison in several areas of Montana. The FWP seems to believe they are above the law by attempting to violate SB 212. The heritage and culture of Eastern Montana and the entire state are at risk. Agriculture and private property rights are under siege.

The FWP has not been completely forthcoming in the impact of bison, both in the environmental and economical consequences. The September 20, 2011 Addendum to the flawed Environmental Assessment completed by the FWP for this relocation attempt does not accurately assess the cost of fencing. The amount specified of 3 dollars per foot is grossly underestimated. The cost of water facilities in this document is also well below what it will cost. The cost of property damage from bison escaping their containment pastures was never addressed.

Citizens for Balanced Use (CBU) believe the FWP has intentionally left out many possible consequences of expanding the range of bison to other parts of the state. We also believe this action to move bison without a sufficient statewide plan is in violation of SB 212. The FWP and Governor Schweitzer have a clear agenda of expanding bison throughout the state

no matter what the cost.

CBU had discussed the bison range expansion issue with the director of FWP more than 3 years ago and at that time Director Maurier assured me that bison would be relocated throughout Montana. The FWP has continued to push for expansion of bison. Even the current Governor boasted of his plan at a past legislature EQC meeting on March 17th, 2006 where he was going to take private property from ranchers west and north of Yellowstone Park. His statement at this meeting was that taking this land for bison was no different than taking land for a power line or pipeline. It would be mandatory that ranchers give up their property. Today the Park County Stockgrowers are engaged in a lawsuit with FWP and the Governor fighting the expansion of bison North of Yellowstone Park into the Paradise Valley.

There should be no doubt in anyone’s mind that both the Governor and his administrative staff at FWP have an agenda of bison range expansion no matter the cost to taxpayers and property owners. This agenda along with this administration’s lack of concern about overpopulation of wolves will ultimately be the demise of Montana’s number one economic driver, agriculture.

The Bison Relocation Environmental Assessment (EA) is incomplete, deceptive in nature and in many cases uses selective science and false cost analysis in order to sell the public on what amounts to simply a bad idea. The past public hearings that were held by FWP should have sent a strong message to FWP that the captured bison from Yellowstone Park should not be relocated to any area outside the Park. Not a single participant at these meetings was in favor of relocating captured Yellowstone Bison to other areas of Montana and yet the FWP continues to push this bad idea.

Domestic bison located in several areas of Montana including the area around Chinook have escaped their containment facility in the past and greatly affected neighboring property. These animals in many cases were hazed in an attempt to get them to return to their pastures with not total success. Some animals were killed and damage to private property was never compensated for. The current EA does not address compensation for bison impacts to private property in the event they escape.

Because legislature has the ability to fund or defund programs there is never a sure guarantee that compensation and funding for any issues regarding bison expansion in Montana would be constant and predictable. Look at the compensation funding by Defenders of Wildlife for impacts to ranchers from wolf introduction. This group no longer contributes to this compensation fund and it is now left up to the taxpayers of Montana with some coming from the Federal Government.

Keep in mind the money from the Federal Government comes with several strings attached through regulations, restrictions and requirements. All state or federal damage compensation funding provided will be coming from the taxpayers.

Defenders of Wildlife and the FWP are up to their old tricks again by selling the public on a bad plan like they did with the wolves and ultimately forcing private property owners to pay the price. It’s no secret the agenda of the Defenders of Wildlife is to remove cattle from the landscape.

The American Prairie Foundation located just South of Malta has just changed their name to the American Prairie Reserve.

The goal of this group is to intimidate and harasses landowners into selling their ranches to the reserve. Domestic bison from Canada are being brought in right now to this reserve south of Malta.

Today Montana is separated into 3 bison management zones. Zone One in the southern area around Yellowstone Park requires all female cattle to be bled and tested for brucellosis prior to shipping. This requirement is time consuming and costly to those ranchers in Zone 1. Extra handling of these cattle also has an amount of animal stress associated with it depending on the temper of that particular animal. If brucellosis is ever found in other zones in Montana, full herd testing could be required in the entire zone or possibly even the state. An important thing to also consider is if there is a detection of brucellosis in a cattle herd, it would result in the quarantine and possible complete destruction and slaughter of a rancher’s entire herd. Is bison range expansion worth the risk? You decide.

CBU, along with several property owners and organizations, has filed legal action against Director Maurier and the FWP for violation of SB212. We will be holding a fundraiser dinner and informational meeting in Chinook, Mt. on March 30, 2012.

The meeting will be held at the Meadowlark Elementary Gym. Watch for more information to come on this important meeting. CBU is a grass roots organization dedicated to the protection of private property rights while working to preserve and promote multiple use recreation, active forest management and responsible resource development on our federally managed public lands.



Here in Montana we raise the most high quality, high protein spring wheat of any where in the world and yet we are woefully lacking in the use of this highly nutritious food product in our diet.

I was introduced to the use of whole wheat berries as a young lad back in Lenora Kansas. My Grandmother would give me a quarter and a 1 peck (1/4 bushel) container and tell me to go out to the local elevator and get some wheat and bring her back the change.

It was almost a mile out to the elevator and the road crossed the Solomon River which contained toads and crawdads so the trip with my wagon and the peck of wheat took quite a while. But upon my return with the wheat and the change, Grandma would wash the wheat through several waters to remove all the chaff and then set it out in the warming oven of he wood stove to dry.

When dry she would have me run it through her hand cranked meat grinder to crack it then she would store it in an empty lard tin. Of an evening she would set several cups of the cracked grain in a pan with water to soak over night. The next morning she would cook it on the wood stove while slices of cracked wheat bread were drying and toasting in the oven.

In those day’s the fresh whole milk separated so Grandma would pour off the cream along with some of the milk for our cereal and my Sister Carolyn and I would have a breakfast of dry cracked wheat toast (that snapped when you bit into it) buttered with homemade butter my sister and I had churned, covered with choke cherry jelly (made from wild choke cherries that I had picked) and cracked whole wheat cereal with a little brown sugar and rich cream topping. A breakfast fit for the Gods. To this day it remains Carolyn’s and my favorite breakfast memory.

I have a few whole wheat recipes in my arsenal but I am certain there are dozens if not hundreds out there. If we could get them all together we would have a cook book that would be a valuable addition to a “Healthy Lifestyle”.

Cattle Guards

To 99 percent of readers, the words “cattle guard” conjures an image of a pipe grate spanning a roadway. Today’s story concerns the one percent who mistakenly pictured a blue-gloved TSA agent, twirling a lariat in a feedlot. Their error does not occur out of ignorance, but from lack of familiarity with commonplace things from a different environment. I have seen this phenomenon first hand.

When we started our cattle drive business in the mid ‘90s, we knew there were risks to placing guest cowboys in new surroundings. We planned for all possible mishaps, but in terms of accidents, we were not as good at guessing as our guests were at surprising us. The perfect example occurred one June morning while trailing the herd up the West Pass Creek Road. A cattle guard marks the Montana / Wyoming state line, so an open gate in the borrow pit allows the cattle to plod off the road, through the gate and then back up on the road. The pace trailing momma cows and calves can be unmercifully slow and on this morning a guest had fallen fast asleep on his horse. Normally this is okay because then the horse can make all the important decisions without first having to debate the issue with its rider. Unfortunately this morning, the horse was also asleep and he ambled right into the cattle guard. Luckily, the cattle guard was so full of road dirt it did not pose much of a leg-breaking threat. The clink of horse shoes on the pipe startled the pony and he froze long enough for me to swing off, grab him by the bit, and back him off the cattle guard. Crisis averted. I mentally scribbled a note to add cattle guards to our things-cowboys-should-know lecture. This same handicap of unfamiliarity also occurs when normal people engage bureaucrats in a battle of wits and this brings me to my point.

Recently, the U.S. Department of Labor (DOL) proposed regulations blocking farm and ranch kids under 16 years old from operating power equipment and those under 18 from working around livestock. Agriculture families and trade groups rightfully went ballistic, just as the DOL anticipated. Countering with points such as 6, 8, or 10-year-old ranch kids are old enough to trail cows mistakenly validates the premise the DOL belongs in the middle of the child/parent relationship in the first place. They do not! Once this initial point is conceded, all further negotiations simply tighten the noose of big government around the necks of American families. As predictable as the sun rising every morning, the DOL soon softened their stance and agreed to work with the Department of Agriculture to modify their new rules. Thinking they had scored a victory, agriculture supporters cheered, figuratively swung back into the saddle and unknowingly rode right off into a cattle guard. We are relying on one bureaucracy, the Department of Agriculture, to rein in the expansion of another, the Department of Labor. This will not occur because they are on the same team—both divisions of the executive branch established by the president to purposely grow the central government.

The street fighter guide to politics suggests three options:

First, elect congressional representation who will jerk the purse strings and jerk them hard. The federal government is $16 trillion in debt and the DOL has 17,419 employees with a budget of $12 billion per year. Pink-slipping half of the DOL employees will save $6 billion annually. The DOL has the economic power of a bake sale and it generates nothing but paperwork and regulation so halving it will scarcely be noticed. Second, replace our chief executive with someone who favors limited government as expressed in our “Declaration of Independence” rather than the massive central government described in the “Communist Manifesto”. This would be beneficial on multiple fronts. Third, establish a strong state legislature with the will to nullify unconstitutional federal overreaches of power.

A strong American family is the backbone of our republic. My children joined our family workforce in my veterinary clinic or on our ranch well before the age of ten. By their teen years they held positions of responsibility guiding guest cowboys trailing cattle up the Little Horn Trail. Their work environment could be hot, cold, wet, dark, windy, or snowy and every tough moment developed their character and work ethic. Today all three are gainfully employed and are busy raising eight little American patriots. Politicians desiring to create a nation of helpless dependents despise citizens with self-reliance, but now you understand the true motive behind the DOL decree.
