How Grandparents Can Help Grandchildren with College Costs
As the cost of a college education continues to climb, many grandparents are stepping in to help. This trend is expected to accelerate as baby boomers, many of whom went to college, become grandparents and start gifting what’s predicted to be trillions of dollars over the coming decades. Helping to pay for a grandchild’s college education can bring great personal satisfaction and is a smart way for grandparents to pass on wealth without having to pay gift and estate taxes. So what are some ways to accomplish this goal? Outright cash gifts A common way for grandparents to help grandchildren with college costs is to make an outright gift of cash or securities. But this method has a couple of drawbacks. A gift of more than the annual federal gift tax exclusion amount--$13,000 for individual gifts and $26,000 for gifts made by a married couple--might have gift tax and generation-skipping transfer (GST) tax consequences (GST tax is an additional gift tax imposed on gifts made to someone who is more than one generation below you). Another drawback is that a cash gift to a student will be considered untaxed income by the federal government’s aid application, the FAFSA, and student income is assessed at a rate of 50%, which can impact financial aid eligibility. One workaround is for the grandparent to give the cash gift to the parent instead of the grandchild, because gifts to parents do not need to be reported as income on the FAFSA. Another solution is to wait until your grandchild graduates college and then give a cash gift that can be used to pay off school loans. Yet another option is to pay the college directly. Pay tuition directly to the college Under federal law, tuition payments made directly to a college aren’t considered taxable gifts, no matter how large the payment. So grandparents don’t have to worry about the $13,000 annual federal gift tax exclusion. But payments can only be made for tuition--room and board, books, fees, equipment, and other similar expenses don’t qualify. Aside from the obvious tax advantage, paying tuition directly to the college ensures that your money will be used for the education purpose you intended, plus it removes the money from your estate. And you are still free to give your grandchild a separate tax-free gift each year up to the $13,000 limit ($26,000 for joint gifts). However, colleges will often reduce a student’s institutional financial aid by the amount of the grandparent’s payment. So before sending a check, ask the college how it will affect your grandchild’s eligibility for college-based aid. If your contribution will adversely affect your grandchild’s aid package, particularly the scholarship or grant portion, consider gifting the money to your grandchild after graduation to help him or her pay off student loans. 529 plans A 529 plan can be an excellent way for grandparents to contribute to a grandchild’s college education, while simultaneously paring down their own estate. Contributions to a 529 plan grow tax deferred, and withdrawals used for the beneficiary’s qualified education expenses are completely tax free at the federal level (and generally at the state level too). There are two types of 529 plans: college savings plans and prepaid tuition plans. College savings plans are individual investment-type accounts offered by nearly all states and managed by financial institutions. Funds can be used at any accredited college in the United States or abroad. Prepaid tuition plans allow prepayment of tuition at today’s prices for the limited group of colleges--typically instate public colleges--that participate in the plan. Grandparents can open a 529 account and name a grandchild as beneficiary (only one person can be listed as account owner, though) or they can contribute to an already existing 529 account. Grandparents can contribute a lump sum to a grandchild’s 529 account, or they can contribute smaller, regular amounts. Regarding lump-sum gifts, a big advantage of 529 plans is that under special rules unique to 529 plans, individuals can make a single lump-sum gift to a 529 plan of up to $65,000 ($130,000 for joint gifts by married couples) and avoid federal gift tax. To do so, a special election must be made to treat the gift as if it were made in equal installments over a five-year period, and no additional gifts can be made to the beneficiary during this time. Example: Mr. and Mrs. Brady make a lump-sum contribution of $130,000 to their grandchild’s 529 plan in Year 1, electing to treat the gift as if it were made over 5 years. The result is they are considered to have made annual gifts of $26,000 ($13,000 each) in Years 1 through 5 ($130,000 / 5 years). Because the amount gifted by each grandparent is within the annual gift tax exclusion, the Bradys won’t owe any gift tax (assuming they don’t make any other gifts to this grandchild during the 5-year period). In Year 6, they can make another lump-sum contribution and repeat the process. In Year 11, they can do so again. Significantly, this money is considered removed from the grandparents’ estate, even though in the case of a grandparent-owned 529 account the grandparent would still retain control over the funds. There is a caveat, however. If a grandparent were to die during the five-year period, then a prorated portion of the contribution would be “recaptured” into the estate for estate tax purposes. Example: In the previous example, if Mr. Brady were to die in Year 2, his total Year 1 and 2 contributions ($26,000) would be excluded from his estate. But the remaining portion attributed to him in Years 3, 4, and 5 ($39,000) would be included in his estate. The contributions attributed to Mrs. Brady ($13,000 per year) would not be recaptured into the estate. If grandparents want to open a 529 account for their grandchild, there are a few things to keep in mind. If you need to withdraw the money in the 529 account for something other than your grandchild’s college expenses--for example, for medical expenses or emergency purposes--there is a double consequence: the earnings portion of the withdrawal is subject to a 10% penalty and will be taxed at your ordinary income tax rate. Also, funds in a grandparent-owned 529 account may still be factored in when determining Medicaid eligibility, unless these funds are specifically exempted by state law. Regarding financial aid, grandparent-owned 529 accounts do not need to be listed as an asset on the federal government’s financial aid application, the FAFSA. However, distributions (withdrawals) from a grandparent-owned 529 plan are reported as untaxed income to the beneficiary (grandchild), and this income is assessed at 50% by the FAFSA. By contrast, parent-owned 529 accounts are reported as a parent asset on the FAFSA (and assessed at 5.6%) and distributions from parent-owned plans aren’t counted as student income. To avoid having the distribution from a grandparent-owned 529 account count as student income, one option is for the grandparent to delay taking a distribution from the 529 plan until any time after January 1 of the grandchild’s junior year of college (because there will be no more FAFSAs to fill out). Another option is for the grandparent to change the owner of the 529 account to the parent. Colleges treat 529 plans differently for purposes of distributing their own financial aid. Generally, parent-owned and grandparent-owned 529 accounts are treated equally because colleges simply require a student to list all 529 plans for which he or she is the named beneficiary. Note: Investors should consider the investment objectives, risks, charges, and expenses associated with 529 plans before investing. More information about specific 529 plans is available in each issuer’s official statement, which should be read carefully before investing. Also, before investing, consider whether your state offers a 529 plan that provides residents with favorable state tax benefits. Private elementary/secondary school If you’re interested in contributing to your grandchild’s private elementary or secondary school education, a Coverdell education savings account (ESA) is worth a look. You can contribute up to $2,000 per beneficiary each year to a Coverdell ESA. Like funds in a 529 plan, money in a Coverdell ESA grows tax deferred and is tax free at the federal and state level if used to pay the beneficiary’s qualified education expenses, which includes college along with private elementary and secondary school. However, there are income limits on who can contribute to a Coverdell ESA--married couples with a modified adjusted gross income over $220,000 ($110,000 for individuals) can’t contribute. Well, it’s that time of year when people with gardens start wondering what to do with what’s left of the garden before killing frost. I had the most trouble with carrots~mostly because I always had way too many and I liked to leave them in the ground until after a light frost as it helped to sweeten them up. One year I lost the whole carrot crop to deer. They discovered they could pull the carrots by their tops, so they cleaned up the entire crop in one night. Another year I dug a pit in the garden and buried a couple bushels of carrots. Then I covered them with a big pile of leaves so they wouldn’t freeze and I could dig them up mid winter. In late December when I went to dig them, I discovered that some burrowing animals had found them and I assume they enjoyed their winter snack. I haven’t had a garden for several years now and I mentioned to the wife a while back that I would like to do a garden again next year. The first words out of her mouth were, “Well, you don’t have to plant so darn many carrots!” Some people just don’t understand us gardeners. Carrot Slaw 5 – large carrots grated course ½ - cup raisins ½ - cup coconut flakes ½ - cup miniature marshmallows 1 – can pineapple tidbits drained (20 oz.) ½ - cup mayonnaise, 1- Tbsp. sugar, 1- tsp. mild vinegar Mix all in a salad bowl and refrigerate several hours to blend flavors before serving. This recipe keeps well, so I generally double it and have it for several days. “Leftovers always taste better.” If you happen to have too many carrots or if you have any at all, here’s a tasty way to use some of them up. OKTOBERFEST is coming! September 16 thru October 7 by Julie Warburton and Tricia Kimmel In Munich, Germany, Crown Prince Ludwig married Princess Therese of Bavaria on October 12, 1810. To celebrate the nuptials the people of Munich were invited to attend the festivities held on land in front of the city’s entrance. This field was named Theresienwiese or “Theresa’s Meadow” in honor of the Crown Princess, located very near present day’s Munich center. This celebration of a royal marriage has grown and evolved into what the world knows as Oktoberfest. The Munich Oktoberfest celebration takes place on the last two weeks of September ending on the first Sunday in October. In the 200 year history of Oktoberfest the festivities were only canceled 24 times because of cholera epidemics and war. During that time, the celebration has made its way across the pond, allowing those with and without a German heritage the opportunity to don their tracht (traditional national costume in German-speaking countries), whether it’s the men sporting lederhosen or the ladies decked out in dirndl. Montana’s largest group of European-American ancestry comes from Germany with a healthy representation of their heritage during local Oktoberfest celebrations. Those in attendance share stories from their predecessors and reminisce over their families’ histories, all the while enjoying their German or Oktoberfest beer. For those planning to contribute traditional fare to the festivities, a great place to start your search may be your local library. Though some may want to turn to the internet to find a recipe for Schweinebraten, libraries often have cookbooks put together by locals featuring many recipes from the “old country” passed down from generation to generation. Oktoberfest offers communities a chance to celebrate the diversity of those who settled this region, whether it’s in traditional garb, eating hearty German food or just enjoying a good German beer with friends. This year find a nearby Oktoberfest celebration and see what it has to offer. What’s So Great About German Beer? For centuries, beer has been a staple beverage all across society, permeating both the diets and the economies of folks across the world. So, why does Germany command such prestigious repute in the palates of beer drinkers today? Beer in Germany has been regulated by authorities for over 400 years and is still an important source of tax revenue for the country. As such, the quality of beer in Germany is legislatively regulated to ensure a healthy and “happy” drinking experience in hopes that more citizens will consume it and dish out the taxes tied to it. The first regulation appeared in Augsburg, Germany. Establishments that served “bad beer or dishonest amounts” would receive a fine and their beer would be confiscated. The most famous brewing law is the Reinheitsgebot or “Purity Law”. According to Old World, which is a unique shopping, dining, art and entertainment center located in Huntington Beach, California, the Purity Law is the oldest food regulation in the world and still exists today unchanged from the original, ordered by Duke Wilhelm IV of Bavaria in 1516. According to the law, beer should only be brewed using barley, hops and water, creating a starndard which made Bavarian beers superior to others in the industry. This type of regulation quickly caught on and spread across Germany. Yeast later entered the picture, but the usefulness of yeast was still unknown at the time of the law’s writing. Today’s version of the German beer tax law reads: “For the preparation of beer, only malt, hops, yeast and water can be used.” Strict compliance with the Reinheitsgebot ensures that German brewers provide a pure and healthy beer to consumers, carving out an elite niche for German beers in today’s beer-brewing world. Germany’s pride in its beer heritage is portrayed year to year when the Munich mayor taps the first Oktoberfest Beer Barrel in the Schottenhamel Tent.

We hope you enjoy reading this feature in Tricia’s Trader. You may agree, you may disagree with Dr. Kerns’ Ramblings, but
you will always have something to discuss over dinner.
Wrangling horses is unfamiliar to most people, so only a fool would use it to make a political analogy; something this fool is about to do. Because most American horses live on small acreages the wrangling process consists of shaking a bucket of grain and getting the heck out of the way. Like indoctrinating subjects with free stuff, the horses charge into the corral oblivious to what happens next. (I could make my analogy right here, but my big point comes later.) A dwindling number of ranches still ride one horse to gather the others and in my experience it is always an all-out horse race. The more rugged the pasture and the ranker the ponies, the more dangerous the gather, so fathers wisely advise young cowboys to never attempt wrangling horses bareback using only a halter. Unfortunately, every cowboy forgets this advice one time in their lives and my mistake came on a wintery March day in the early ‘70s. The impending ice age was the progressive hoax of the day and the hills above our Wyoming ranch were drifted with snow. Carrying a bucket of grain I figured I’d catch one horse, saddle him back at the barn and then gather the others. I spent an hour circumventing drifted brush patches in the knee deep snow before catching my mount at the very top of the highest hill nearly a mile from the barn. It was decision time. The thought of trudging back through the snow down to the barn was not appealing, so I fashioned the halter rope into a set of roping reins and hopped on bareback. “Heck,” I thought. “So I don’t have to do this twice, I’ll just chase all the ponies in as I go.” I circled behind the horses and gavea holler, triggering a horse stampede. This was the most foolish thing I had ever done…so far. (When measured on the stupid scale, recent decisions such as entering politics are far worse than wrangling horses bareback.) The next ten minutes were a continuous snow-white blur punctuated with brown chokecherry patches. We were down the hill, up the hill, over the hill and through the hill. I thought about abandoning ship, but the foothills are so boulder strewn a soft landing was in question. On the third pass, the leads took the corral; I jumped off, shut the gate and vowed I would never, ever do that again. Spoken fatherly advice is generally sound, but easily forgotten, so if our founding fathers thought a point so important they actually wrote it down, is it not in our best interest we adhere to it? Here is what I mean. In America’s birth certificate, our Declaration of Independence, Thomas Jefferson clearly states our rights came from God and government only functions to secure those rights. (Commit this concept to memory, because this defines what it means to be an American.) Two recent news events reveal this truth is being progressively and purposely replaced with a lie. Early last week, in a CNN broadcast, a Democrat activist chastised VP candidate Paul Ryan for stating our rights came from God. “Maybe the rights of rich white men,” she whined, “but for the rest of us, our rights come from government.” Later in the week, when Los Angeles Mayor Villaraigosa was chairing the Democrat National Committee platform convention, the inserted language containing the phrase “God-given potential” was booed by floor delegates. For the sake of their souls, I will assume they were expressing disagreement with the origin of rights rather than with God Himself. Progressives purposely claim government gives you your rights for the simple reason the freedom to speak, assemble, bear arms, or worship can then be either protected or prohibited depending on a simple show of hands; the truly frightening and unstable arrangement inherent in a democracy. If the 56 patriots who signed our Declaration of Indeendence were willing to risk their “lives, fortunes and sacred honor” stating God and not government as the origin of rights, is it not prudent we heed their advice? After all, it is written down. Think about it.
