The Alternative Minimum Tax (AMT)

In the past ten years there have been eight temporary legislative AMT-related “patches,” designed to forestall a sudden dramatic increase in the number of individuals who are affected by the AMT. The latest twoyear patch, included as part of the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010, is effective through December 31, 2011. That means you can expect additional AMT legislation later this year or in early 2012.

What is the AMT? The AMT is essentially a separate federal income tax system with its own tax rates, and its own set of rules governing the recognition and timing of income and expenses. If you’re subject to the AMT, you have to calculate your taxes twice--once under the regular tax system and again under the AMT system. If your income tax liability under the AMT is greater than your liability under the regular tax system, the difference is reported as an additional tax on your federal income tax return. If you’re subject to the AMT in one year, you may be entitled to a credit that can be applied against regular tax liability in future years.

How do you know if you’re subject to the AMT? Part of the problem with the AMT is that, without doing some calculations, there’s no easy way to determine whether or not you’re subject to the tax. Key AMT “triggers” include the number of personal exemptions you claim, your miscellaneous itemized deductions, and your state and local tax deductions. So, for example, if you have a large family and live in a high-tax state, there’s a good possibility you might have to contend with the AMT. IRS Form 1040 instructions include a worksheet that may help you determine whether you’re subject to the AMT (an electronic version of this worksheet is also available on the IRS website), but you might need to complete IRS Form 6251 to know for sure.

Common AMT adjustments It’s no easy task to calculate the AMT, in part because of the number and seemingly disparate nature of the adjustments that need to be made. Here are some of the more common AMT adjustments: • Standard deduction and personal exemptions: The federal standard deduction, generally available under the regular tax system if you don’t itemize deductions, is not allowed for purposes of calculating the AMT. Nor can you take a deduction for personal exemptions.

• Itemized deductions: Under the AMT calculation, no deduction is allowed for state and local taxes paid, or for certain miscellaneous itemized deductions. Your deduction for medical expenses may also be reduced, and you can only deduct qualifying residence interest (e.g., mortgage or home equity loan interest) to the extent the loan proceeds are used to purchase, construct, or improve a principal residence.

• Exercise of incentive stock options (ISOs): Under the regular tax system, tax is generally deferred until you sell the acquired stock. But for AMT purposes, when you exercise an ISO, income is generally recognized to the extent that the fair market value of the acquired shares exceeds the option price. This means that a significant ISO exercise in a year can trigger AMT liability. If ISOs are exercised and sold in the same year, however, no AMT adjustment is needed, since any income would be recognized for regular tax purposes as well.

• Depreciation: If you’re depreciating assets (for example, if you’re a sole proprietor and own an asset for business use), you’ll have to calculate depreciation twice--once under regular income tax rules and once under AMT rules.

AMT exemption amounts

While the AMT takes away personal exemptions and a number of deductions, it provides specific AMT exemptions. The amount of AMT exemption that you’re entitled to depends on your filing status.

Your exemption amount, however, begins to phase out once your taxable income exceeds a certain threshold ($150,000 for married individuals filing jointly, $112,500 for single individuals, and $75,000 for married individuals filing separately).

What happens in 2012?

AMT exemption amounts and phaseout thresholds are not adjusted for inflation--they only change through legislation. This is one of the principal reasons that more people tend to be subject to the AMT each year. The increased AMT exemption amounts included in the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010 are for the 2010 and 2011 tax years only. Unless Congress passes new legislation, 2012 AMT exemption amounts will return to pre-2001 levels. In addition, without new legislation, the AMT rules could limit your ability to claim certain nonrefundable personal tax credits in 2012, including the American Opportunity (Hope) and Lifetime Learning tax credits, the dependent care credit, and the credit for the elderly and disabled.

AMT rates

Under the AMT, the first $175,000 of your taxable income is taxed at a rate of 26%. (If your filing status is married filing separately, the 26% rate applies to your first $87,500 in taxable income.) Taxable income above this amount is taxed at a flat rate of 28%.

The lower maximum tax rates that apply to long-term capital gain and qualifying dividends apply to the AMT calculation as well. So, even under AMT rules, a maximum rate of 15% (0% for individuals in the lower two tax brackets) applies. However, long-term capital gain and qualifying dividends are included when you determine your taxable income under the AMT system. That means large capital gains and qualifying dividends can push you into the phaseout range for AMT exemptions, and can indirectly increase AMT exposure.

Technical Note: In the context of AMT exemption amounts and tax rates, taxable income really refers to your alternative minimum taxable income (AMTI). Your AMTI is your regular taxable income increased or decreased by AMT preferences and adjustments.

Summing up Owing AMT isn’t the end of the world, but it can be a very unpleasant surprise. It also turns a number of traditional tax planning strategies (e.g., accelerating deductions) on their heads, so it’s a good idea to factor in the AMT before the end of the year, while there’s still time to plan.

IODINE

Since my column on salt I have had several questions about Iodine because I had stated that I don’t use Iodized salt.

First off, let my say there is absolutely nothing wrong with using Iodized salt. I don’t use it because it does not have the true taste of pure salt. However, I supplement with liquid food grade Iodine for my nutritional needs, as Iodine is absolutely essential to maintain a healthy body.

There is controversy as to whether or not Iodized salt provides adequate amounts of Iodine to maintain healthy reserves. The controversy stems mostly from holistic practitioners who recommend limits far above the Government Recommended Daily Allowance. There is no doubt that Iodine is an essential nutrient, but before I would go on mega doses I would want the advice of a certified Nutritionist. On the other hand, I would not trust Iodized salt alone to supply adequate amounts of Iodine to achieve maximum health benefits. Our soils are depleted of Iodine and the only foods available with an appreciable amount of natural Iodine come from the ocean. So landlubber that I am, I supplement. I would recommend you do the same.

The benefits of Iodine are far too complex to cover in the space we have available here. I suggest you Google “Iodine” and spend some time reading. I Baked Salmon with Mustard-Horseradish sauce guarantee you will be impressed

Is this true, and would it help my score in any way? ~Anna Dear Anna, Your brother is wrong. It will not improve his credit score at all. As an authorized user, he is not the owner of the debt. There’s a high likelihood that it will affect your credit score in a negative way, though, because there’s a good chance he’ll do some dumb things with your card.

Look at it this way. Why would someone give him credit, or raise his credit score, just for using your credit? It doesn’t make sense. Your credit score is affected by things like whether or not you pay your bill on time. The card isn’t in his name, so really all this amounts to is him having fun with your card, and you’re the one who’s liable for the damage. The truth is that authorized users shouldn’t even show up on a credit report.

It sounds like your brother has some financial problems. While I admire the fact that he wants to fix things, this is not the answer. Don’t misunderstand what I’m saying, Anna. Chances are he’s not trying to con you. He probably just got some bad information. But the hard truth is this: If you go along with his idea, it’s not going to help him, and it’s going to hurt you. I’m an NFL season ticket holder for the Tennessee Titans. But I’ve been debt-free for years, and my family’s financial future is very secure. Whether the Titans win or lose, or whether I watch the games in person or in front of the television, has no impact on their security. However, if you’re sitting there with credit card debt, a car payment and living paycheck to paycheck, you’ve got no business buying season tickets. Get yourself out of debt, build an emergency fund, and make sure your family is taken care of first. Then you can have some fun. Live like no one else so that later you can live like no one else. And then, if that includes season tickets to your favorite football, baseball or hockey team, have a blast!

Remember, this kind of thing is entertainment. I know a lot of silly people out there act like whoever wins a football game is a matter of life and death, but it’s just a game. Your life and your financial future are not games, and they’re not things to be taken lightly. First things first, Greg.

Tailgates and Tooth Fairies

It was the early ‘90s and my new veterinary practice was growing rapidly. The harder, faster, smarter, and longer I worked, the better the cash flowed, which is completely contrary to President Obama’s recent declaration of “you didn’t build that.” (I have the scars to prove I did build it.) As I was always seeking new ways to gain market share, I purchased a 16 foot gooseneck trailer and tweaked it into a fully enclosed, large animal, surgical unit. I planned on backing the trailer up to the rotting remnant of a farmer’s corral, loading a cow with a calving problem into my surgical suite, performing a c-section, and then hosing it clean before racing down the road to the next case. It appeared brilliant on paper.

Because it is contradictory to pull something as classy as a surgical suite with a hail damaged ranch pickup, I traded my ‘84 half-ton for a brand new, Ford Supercab. The blue and silver Ford so perfectly matched the paint scheme on the trailer; I parked it in plain view of Main Street so clients driving by could marvel at my handiwork. In the parking lot, my surgical trailer was impressive, but there was one day my brilliance unraveled, prompting me to abandon the entire idea.

It was a Tuesday morning, when I raced out to my first calving call of the day. Steve and Rob’s cow was in an old barn a good half mile from their calving shed, so this was a perfect time to use my surgery trailer. I rolled to a stop in their barnyard and pointing through an old corral, I asked, “Can I pull my trailer through there, and back up to the barn door?”

Rob answered, “Yes,” so I blasted into the corral. What Rob actually said was, “Yes…but you will probably get stuck.” He was right. I buried my pickup and trailer in a 50-year-old, composting mass of straw and manure. Fixing the cow and then getting unstuck cost me an hour I did not have and feeling the pressure, I hustled to get back to the clinic.

I was nearly there, when Teresa radioed saying I had a uterine prolapse at Bill’s up in Molt, so I raced north out of town, fixed the prolapse and sped back to Laurel. I had barely rolled to a stop at the clinic, when Teresa radioed there was a ewe with lambing problems in Joliet. (Teresa never did like me.) The trailer was not needed for this call, so I dropped the tailgate, cranked the gooseneck off the ball and trotted into the clinic to fill my coffee cup. As I sprinted back to my pickup, I wondered if I should just leave my tailgate down for the 16 miles to Joliet, or stop and close it after pulling away from the trailer. Distracted by the pressure, I absent mindedly flicked the tailgate shut, jumped in the pickup, stomped the gas and zoomed ahead for about 48 inches.

The feel of a gooseneck bending a new tailgate into a “V” is indescribably painful. Exasperated, I jumped from the pickup like a raving mad man and tried to jerk the tailgate open. It was stuck. I needed to get to Joliet and with my blood pressure fully pegged, I hopped back in the driver’s seat, backed up and smacked it again. After three jerks, the tailgate was hopelessly wedged in place and the sides of the pickup were tapering inwards. Figuring the tailgate would eventually lose interest and let go, I dragged the trailer all over the parking lot, going so far as to block the trailer tires before ramming it again and again. I was wrong and I was stuck. My friend, Mark, drove up about then and spotting the veins popping out on my neck, asked if he could help. With his calming influence, we methodically and slowly disassembled the tailgate latch assembly and freed my pickup from the trailer. Had Mark not appeared, I might still be dragging that trailer around my parking lot, so I learned, when all seems lost it is best to step back and look at things from a different perspective. This brings me to my point.

Many Republicans went to bed election night with the same crazed look as I did when I smashed my new tailgate.

Desperately desiring power, party pundits are demanding the GOP modify their platform and join the Democrats in offering free goodies to America’s 50 million “tooth fairy voters”; those demanding free contraception, free abortion, free food stamps, amnesty and Obama-phones. Calm down; you are acting like a crazy veterinarian. The Democrat platform is founded on the Marxist principles of freebies and it will be impossible for the GOP to out fairy the tooth fairy. Engaging the Democrats in a give-away-war will guarantee financial collapse because we are shooting each other with the same taxpayer dollars. Instead, the GOP must shift to the right; back to our country’s founding principles. There we will find enough Libertarians and Constitutionalists to help us restore our great American republic.

Each has their segregated responsibilities.

Custom Collision Repair John does sales and measuring, Bill and Dale do installations. Besides Havre Muffler & Brake them, the company also employs Havre Ready Mix, Inc.~ five other staff members and two Baltrusch Construction, Inc. subcontractors. The two newest ~Havre Sand & Gravel, Inc. members of the gang have been with the company for six years and two Pacific Steel & Recycling years, respectively, meaning that McNair customers get the benefit of Tilleman Motor Co. What was once a lumberyard is today the headquarters of McNair Furniture, which will years of expertise and knowledge soon celebrate 30 years of working on the Hi-Line.

RUDYARD: every step of the way.

McNair Furniture Bev and Leota help John man the store. They apply their years of experience in helping their customers pick colors or make interior design decisions. In MALTA: addition to Bill and Dale, Ed, Steve and Kip do installations, and Denny and Jeff do contract ceramic installation.

Radio Shack Malta All are natives of Rudyard, Hingham or Inverness, or are family to someone from there, so saying that community is important to the folks at McNair Furniture would be redundant. School activities are central to most community events that First State Bank take place in Rudyard with its in-town population of about 350 people. Everyone who works at the company either has already Great Northern Hotel & put their kids through the school system, or are currently following the “extracurricular trail” with their kids’ sports and other Restaurant ~ Maltana Motel activities; as a result, they are big supporters of the Booster Club. They allow the students to use their facilities for float-building activities and the like, and provide use of their equipment to different community projects when needed.

Crossroads Coffee ~ The Commercial Club is a key organization in town, and Dale, especially, stays busy helping out with that. The Feigel Photo Commercial Club heads up projects like establishment of the Memorial Park, or setting up softball tournaments and Christmas Liquor Haven ~ Travel Haven Strolls. They’re currently working on building a pavilion at the baseball field.

Outside of town McNair Furniture is supportive, as well. As Havre Area Chamber of Commerce members, they Mint Bar participate in the Christmas Cash program, and they are supporters of the Northern Montana Healthcare Foundation’s Benefit Wine Gala held in November of each year, plus the Northern Alumni Scholarship Social and Auction.
