REVISED ONE-ROLLOVER-PER-YEAR LIMIT APPLIES IN 2015: IRS CLARIFIES RULES Background The Internal Revenue Code says that if you receive a distribution from an IRA, you can’t make a tax-free (60-day) rollover into another IRA if you’ve already completed a tax-free rollover within the previous one-year (12-month) period. The long-standing position of the IRS was that this rule applied separately to each IRA someone owns. Earlier this year, however, the Tax Court, in the case of Bobrow v. Commissioner, held that, regardless of how many IRAs he or she maintains, a taxpayer may make only one nontaxable 60-day rollover within each 12-month period.

The IRS response to Bobrow The IRS, in Announcement 2014-15, indicated that it would follow the Tax Court’s Bobrow decision and apply the one-rollover-per-year limit on an aggregate basis, instead of separately to each IRA you own. However, in order to give IRA trustees and custodians time to make changes in their IRA rollover procedures and disclosure documents, the IRS indicated that the revised rule would not apply to any rollover that involved an IRA distribution that occurred before January 1, 2015.

IRS further clarifies the new one-rollover-per-year limit In November, the IRS issued Announcement 2014-32, providing further guidance on how the revised one-rolloverper-year limit is to be applied. Most importantly, the IRS has now clarified that:

IRAs, are aggregated and treated as one IRA when applying the new rule. For example, if you make a 60day rollover from a Roth IRA to the same or another Roth IRA, you will be precluded from making a 60-day rollover from any other IRA--including traditional IRAs--within 12 months. The converse is also true--a 60-day rollover from a traditional IRA to the same or another traditional IRA will preclude you from making a 60-day rollover from one Roth IRA to another Roth IRA. 2. The exclusion for 2014 distributions is not absolute. While generally you can ignore rollovers of 2014 distributions when determining whether a 2015 rollover violates the new one-rollover-per-year limit, this special transition rule will NOT apply if the 2015 rollover is from the same IRA that either made, or received, the 2014 rollover.

The one-rollover-per-year limit does not apply to direct transfers between IRA trustees and custodians, rollovers from qualified plans to IRAs, or conversions of traditional IRAs to Roth IRAs. What this means to you In general, it’s best to avoid 60-day rollovers whenever possible. Use direct transfers (as opposed to 60-day rollovers) between IRAs, as these direct transfers aren’t subject to the one-rollover-per-year limit. The tax consequences of making a mistake can be significant--a failed rollover will be treated as a taxable distribution (with potential early-distribution penalties if you’re not yet 59½) and a potential excess contribution to the 1. All IRAs, including traditional, Roth, SEP, and SIMPLE receiving IRA. I’m retired, and currently I have about five percent of my retirement savings in gold and silver I’ve been acquiring over the last few years. I’ve seen gold prices decline significantly, and I’m wondering if I should hang on to it as a safety factor in the event the economy goes bad in a hurry. I want to make sure I’ll still have a safety factor, and something of value, if that happens.

What’s the safety factor here? And if everything goes downhill, why does it have value? Gold has this weird allure and mythology around it that says, “I’ve still got something that people will take when the economy crashes.” But the truth is there hasn’t been an instance when people used gold as a medium of exchange in a crashed or failed economy since the Roman Empire.

People still use gold because they believe in it. We also believe in green paper with presidents’ faces on it. So, gold really has no more intrinsic value than that green paper. The only reason we place value on it is because we, the society, place value on it. A failed society might not place value on it anymore.

In a completely failed economy, the first step is usually a takeover by a Fascist government. After that, you get a new color of money – of paper – with a new leader’s face on it. Then, the old stuff isn’t worth anything. It’s very seldom you ever see gold come to the rescue.

I don’t believe in investing in gold for that reason. Plus, the track record on gold, as far as a rate of return, is horrible over the long haul. There was a time a few years ago when everyone went crazy on it, but other than that? Ugh!

We’ve got our emergency fund in place, and we’re debt-free except for our home.

We’d like to have a child soon, but my job requires frequent travel. I don’t want to be away most of the time when there’s a baby in the house, so I’m thinking about opening my own business. That way, I can set my own hours. What do you think of this idea?

Dear Ray,

Ask yourself this question: If time and money weren’t considerations, which one would you rather do? You’d be on straight commission as an entrepreneur, so there would be no regular checks to count on as income. You’d have to wake up every single morning, go out and kill something and drag it home. If you don’t, your family won’t eat.

An entrepreneur is the only person I know who can go from sheer terror to sheer exhilaration and back every single day. You’ve got to have a strong mind and heart to make things happen, and it will be a rough ride if you don’t have both. Plus, it won’t last long if you don’t absolutely love what you’re doing.

Everybody wants to be successful in their job and make lots of money, but personal happiness is just as important. If you wake up jazzed about what you’re going to do every day, chances are you’ll be successful and happy. But if you wake up dreading the day and your job, then I can almost guarantee you won’t be successful financially or happy.

Do lots of research and planning before you make any big changes, Ray. There are great small business ideas still waiting to be had, but to make something good happen you’ve got to find the one that’s right for you!

Farmers and Ranchers for Montana (FARM), is a fledgling agricultural organization launched in December 2014, committed to fair water policies, and consisting of over 500 members state-wide, including farmers, ranchers, businesses, Indian tribes, and local leaders who are concerned with the availability of water access for all Montanans.

Currently, FARM is focused on getting the controversial Confederated Salish and Kootenai Tribes (CSKT) water compact approved in the 2015 Montana State Legislature; not an easy task for their first time out.

Depending on whom you talk to, CSKT is the salvation of Montana agriculture, or its downfall.

A look at FARM’s facebook page shows comments running the gamut from “God help us if this passes,” and “This is the largest federal water grab in history,” to “…will protect the water rights of Montanans and prevent millions of dollars in litigation.” You will find links to Senator Debby Barrett’s public letter against CSKT and Dr. Ed Berry’s rebuttal of her letter, point by point.

Because the water compact is FARM’s first issue since the organization’s formation, it is easy to lump the two together. However, by claiming to be committed to “fair water policies,” FARM has set itself up to champion all water users in the state, therefore committing itself to far more than what the CSKT water compact covers.

Agriculture, in all its forms, is the number one business in Montana, with over 28,000 farms and ranches across the state. Water makes it all possible and a lack of water will negatively impact everyone because, in a way, we are all water users either directly or indirectly.

Most of us envision farmers and ranchers as men and women presiding over vast herds of cattle and sheep roaming the prairie, or using giant machines costing hundreds of thousands of dollars to harvest thousands of acres of wheat, corn, and peas. This requires massive amounts of water to be successful; neither their crops nor herds can survive without access to a dependable water supply. The difference between irrigated farm land and dryland farming can be 60 bushels of wheat or more per acre, the price of a lease, one-hundred dollars or more per acre.

On a smaller scale, our local producers, the ones who set up at once-a-week Farmer’s Markets around the state and provide us with access to locally grown produce and fresh eggs, to the home gardeners who produce enough for their families, and perhaps a little extra to share with neighbors, to the small rancher you buy a steer from every year to butcher and put in your freezer, are directly affected by these same water policies.

Indirectly, those of us that purchase these products, whether through the grocery store, farmer’s markets, or directly from a farmer or rancher, will be similarly impacted by price, quality, and availability, according to the producer’s access to water.

FARM has more at stake here than just the CSKT. The stated purpose of this organization, “a commitment to fair water policies,” encompasses more than the availability of water. Quality, use, and ownership fall under the parameters of their commitment, especially in Montana with regard to the Bakken Oil Boom and its alleged effects on water quality, and the recent attempts of city

governments in other states to claim ownership of, and fining citizens for, collecting and using rainwater; in essence, claiming any water falling from the sky and landing anywhere in the city belongs to the city. It hasn’t happened here…yet, but that doesn’t mean it won’t.

The CSKT water compact is just the first stop for FARM, a jumping off place of sorts, and will be resolved shortly. “State law requires the tribes to file their claims by June 30th, 2015,” says Shelby DeMars, Communication Director, for FARM. “Therefore the Compact must pass the legislature during this, the 64th Legislative Session.”

Since the 64th Legislative Session in Montana started on January 5th and runs for 90 working days, including Saturdays, the decision for or against the CSKT water compact will be made known by the middle of April.

FARM is an agricultural organization to keep an eye on. Its naysayers claim the organization was formed with the intent of getting the water compact approved, meaning after this legislative session, whether they win or not, FARM will disappear. Their commitment to fair water policies, however, carries a much larger burden of responsibility.
