INHERITED IRAS AND BANKRUPTCY Background Since the enactment of the Bankruptcy Abuse Prevention and Consumer Protection Act in 2005, individual retirement accounts (IRAs) have been protected under federal law if you declare bankruptcy. The exemption was originally capped at $1 million, but has since grown to $1,245,475 (as of April 1, 2013) due to cost-of-living increases. (The million-dollar cap does not apply to amounts rolled over from a qualified employer plan like a 401(k)--these amounts are fully protected under federal law.) Over the years, federal court decisions have been divided over whether or not inherited IRAs are protected under the Act. To resolve this conflict, the United States Supreme Court agreed to hear the case of Clark v. Rameker. The Supreme Court’s decision On June 12, the Court decided the Clark case, holding that inherited IRAs are not protected “retirement funds” under federal law. The Court reached this conclusion by noting that the holder of an inherited IRA cannot invest new money in the account, can withdraw the entire balance at any time and use the funds for any reason without penalty, and must take required distributions from the account no matter how far the holder is from retirement. So what does this mean to you? If you declare

bankruptcy and hold an inherited IRA, you will not receive any protection for those assets under federal law. Whether they receive any protection from creditors at all (inside or outside of bankruptcy) will instead depend on the laws of your particular state. Note that if you inherit an IRA from your deceased spouse, and you are the sole beneficiary, you are generally entitled to treat that IRA as your own (for example, by making an affirmative election or contributing to the account). If you do so, the IRA should not be considered an inherited IRA for bankruptcy purposes. But since the Clark case dealt with an IRA inherited by the IRA owner’s daughter, and not a spouse, this was not specifically addressed by the Court. Also, you should keep this ruling in mind as you name beneficiaries for your own IRAs, particularly if you intend to name someone other than your spouse as beneficiary. If creditor protection for your heirs is important to you, one option is to consider naming a spendthrift trust as your IRA beneficiary. These trusts limit your trust beneficiary’s ability to control the trust funds, and provide protection from your beneficiary’s creditors under the laws of most states. However, be sure to consult a qualified professional, as establishing a trust as your IRA beneficiary can have significant legal and tax implications.

Montana Island Challenge What happens when you combine physical fitness and philanthropy? The answer is, a whole lot of feeling good, comraderie, and support for area youth organizations...at least when it’s part of the Montana Island Challenge. This year’s Challenge takes place August 7 and 8 in the Snowy Mountains near Lewistown, Montana. Participants have the option of biking the “Half Day at Half Moon” 12-hour circuit mountain bike ride from 7pm Friday night to 7am Saturday morning, complete with a midnight pancake party, or simply joining the challenge to hike or run Saturday morning. Those who join in Saturday are welcome to stay over, and can choose between a 7K or 9K hike, or a 7K, 9K, 15K or half marathon. Half Moon Ranch Recreational Retreat is graciously hosting the activities at 1314 Half Moon Ranch Rd, Lewistown, MT 59457, www.hmradventures.com. DEAR DAVE, I own a rental property that brings in enough to pay the taxes and insurance with a little left over. Recently, I found out that my tenant, who just signed a new two-year lease, is subleasing the property for the short term as a vacation site. This kind of thing happened once before and is prohibited in the agreement. Do you think I should approach him about the situation or let it go until it becomes problematic? ~Catherine Dear Catherine, It’s already a problem, because he’s in violation of the lease agreement. Call him today and tell him to stop the sublease immediately. Let him know that he’ll be evicted if anything like this ever happens again. This may sound harsh, but an agreement is an agreement. You may not have experienced any big problems up until now, but what happens when he pulls this again and the next people who come in are a bunch of partiers? You could end up with broken windows, holes in the walls and a bad reputation. On top of all that, what if they leave and he doesn’t have the money to fix things? It’s all on you. Why? Because you lost control of your property! As a landlord, I always try to be gentle and nice but really clear about things. But this guy needs to understand that you mean what you say in the lease agreement. Once more, and he’s gone! ~Dave DEAR DAVE, I have a relative who recently entered a rehab center to treat her drug addiction. I’ve been trying to help with things on the outside, and recently I discovered she has about $20,000 in debt. This is in addition to the rent owed on her apartment. I don’t have a lot of money, but do you think I should start trying to pay some of these bills for her? ~Jeremy Dear Jeremy, I’m really sorry to hear about your relative. Addiction is painful thing for the addict and for their family and friends. While what you’re suggesting is noble, my advice would be to leave the debt alone. I would, however, notify her landlord of what’s happened. If he won’t hold her place, then get her stuff out and turn over the keys so he or she can find another tenant. As far as the debt obligations are concerned, just let her creditors cry and whine. They’re going to do that anyway, and you’re in no position to help financially at this point. Once she’s out and healthy again, one of the first things she’ll have to do is recreate her life and income. When that’s been done, then she needs to go back and make arrangements with her creditors. But right now, she needs to concentrate on herself. And as her family, you need to pour as much love and support as you can into the healing process. You’ve got a great heart, Jeremy, but the money stuff can wait until she’s out, healthy and established again. Then, if you want and have been able to save a bit, you might gift her a little money to help her get started again.
