St. Nicholas was a Bishop who lived in the fourth century in a place called Myra in Asia Minor (now called Turkey). He was a very rich man because his parents died when he was young and left him a lot of money. He was also a very kind man and had a reputation for helping the poor and giving secret gifts to people who needed it. There are several legends about St. Nicholas, although we don't know if any of them are true! There was a poor man who had three daughters. The man was so poor that he did not have enough money for a dowry, so his daughters couldn't get married. (A dowry is a sum of money paid to the bridegroom by the brides parents on the wedding day. This still happens in some countries, even today.) One night, Nicholas secretly dropped a bag of gold down the chimney and into the house (This meant that the oldest daughter was then able to be married.). The bag fell into a stocking that had been hung by the fire to dry! This was repeated later with the second daughter. Finally, determined to discover the person who had given him the money, the father secretly hid by the fire every evening until he caught Nicholas dropping in a bag of gold. Nicholas begged the man to not tell anyone what he had done, because he did not want to bring attention to himself. But soon the news got out and when anyone received a secret gift, it was thought that maybe it was from Nicholas. Because of his kindness Nicholas was made a Saint. St. Nicholas is not only the saint of children but also of sailors! One story tells of him helping some sailors that were caught in a dreadful storm off the coast of Turkey. The storm was raging around them and all the men were terrified that their ship would sink beneath the giant waves. They prayed to St. Nicholas to help them. Suddenly, he was standing on the deck before them. He ordered the sea to be calm, the storm died away, and they were able to sail their ship safely to port. St. Nicholas was exiled from Myra and later put in prison during the persecution by the Emperor Diocletian. No one is really knows when he died, but it was on 6th December in either 345 or 352. In 1087, his bones were stolen from Turkey by some Italian merchant sailors. The bones are now kept in the Church named after him in the Italian port of Bari. On St. Nicholas feast day (6th December), the sailors of Bari still carry his statue from the Cathedral out to sea, so Continued on page 3...

(Some scholars now believe that it was actually written by Henry Livingston, Jr., who was a distant relative of Dr Moore's wife.) The poem describes St. Nicholas with eight reindeer and gives them their names. They became really well known in the song 'Rudolph the Red nosed Reindeer', written in 1949. The UK Father Christmas and the American Santa Claus became more and more alike over the years and are now one and the same. Some people say that Santa lives at the North Pole. In Finland, they say that he lives in the north part of their country called Lapland. But everyone agrees that he travels through the sky on a sledge that is pulled by reindeer, that he comes into houses down the chimney at night and places presents for the children in socks or bags by their beds, in front of the family Christmas tree, or by the fire place. Most children receive their presents on Christmas Eve night or early Christmas morning, but in some countries they get their presents on St. Nicholas' Eve, December 5th. Who Will Own What?

There are two big pieces to the estate planning puzzle: who will run what (management succession) and who will own what (the transfer of assets). In my last ProfitTips article I called management succession the more difficult of the two because it involves judging the competency of people you love and holding them accountable to produce results. It is perceived by the incoming generation as an issue of respect. But the transfer of assets is no cake walk either. When it comes to who will own what, there are four primary issues: legacy, fairness, the viability of the units distributed to heirs, and mechanics. Most folks would probably argue that there should be a fifth, taxes. But I’ve seen too many people let tax avoidance drive their planning process. The result is almost always a catastrophic mess. When ranches fail to make the transition from one generation to the next it is rarely estate taxes that cause the problem. It is usually convoluted attempts to avoid paying taxes that are the culprit! Legacy When I was young my mother explained to my sister and me that it was unlikely that she’d leave us much of an inheritance. She intended to use whatever assets she collected in her life to make sure she would never be financially dependent on my sister or myself. True to her word, her modest estate completely funded her long-term care. My Mom’s legacy never had anything to do with a physical asset. Her legacy was in the principles and values she exemplified. It’s been my experience that the more someone’s legacy involves a physical asset, the weaker the legacy and the greater the likelihood that transitioning assets from one generation to the next will be a problem. Fairness Most of us love our children equally and because we love them equally we want to give each heir an equal share of the estate. But there are a lot of situations where equal isn’t fair. If one of our kids stayed home to help her folks while others pursued adventures of their own, it might be fair to leave more to the child who sacrificed. But fairness isn’t the only problem with equality. There is also the issue of viability. Viability There was a time when parents could leave part of the ranch to each of their kids and each heir would have a viable unit. But there was also a time when a person could earn a decent living running 200 cows. Today we need 3 or 4 times the scale to be economically viable, and splitting the ranch could just set everyone up to fail. Generally, If the viability of the ranch means anything to you and if you want to leave the ranch to multiple heirs, there is a much better way to go. It starts with separating the land from the operating business. It’s fine to leave the land to multiple heirs as long as they have undivided interests and there is a common sense buyout agreement. Heirs who want to cash out must be aware that a minority stake in a family asset is worth pennies on each dollar of appraised value. Their 25% minority interest in a $20 million ranch isn’t worth $5 million. It may only be worth $2 million! With rare exception, the operating business should NOT be left to multiple heirs. It ought to be left to, or bought by, the one or two heirs that will run it. And the operating business should pay market rate rent to the land owners. Mechanics Life insurance, off-ranch investments, trusts, buy-out agreements. There are a lot of tools that can ensure the smooth and successful transition of assets to heirs and the sustainable future of a viable ranch. Anyone who wants their ranch and their heirs to thrive for generations to come needs to hire professional help … and not just any professional. A professional with a track-record! DO NOT ask a neighbor your age who they used and how they feel about the experience. Ask the kids of someone who died how things worked out. If they are satisfied get your referral from them. The only way to measure success is AFTER the fact.

Come to God’s Table In Psalm 42:5 (AMP), the psalmist asked, “Why are you in despair, O my soul? And why have you become restless and disturbed within me?” It seems that many people often feel this way. Because of the pressures of everyday life—in our work, finances, our homes or relationships—there is some form of depression, discouragement, or discontentment in almost everyone you see. But it really doesn’t have to be that way. We do not need to live our lives in despair, restless or disturbed. We can be content, encouraged and joyful even in the midst of troubles. For many years I felt bad about myself because of the abuse I endured for most of my childhood. I felt damaged and ashamed and focused more on what I did wrong than anything else. That is until I came to an understanding of who I am in Christ. You see, what we think of ourselves has a lot to do with how we feel about ourselves. And when you give your life to Christ, you don’t have to be mad at yourself because you don’t do everything right. You can enjoy your life even while you have a problem! The question is, can you see yourself the way God sees you—the way He says you are in His Word? Will you trust the Holy Spirit to work in you until you can see it? Don’t worry…you don’t have to wait until He’s done; the work is ongoing. You just need to trust Him. Come to the Table In a book I read about shepherds and sheep, it talks about how a shepherd will go to the “table lands,” a high plateau that is difficult to reach but where there is good, healthy grass for the sheep to graze. He goes and “prepares” the land by removing any poisonous grasses and flowers that could harm the sheep. In Psalm 23:5 (NIV), David says, “You prepare a table before me in the presence of my enemies. You anoint my head with oil; my cup overflows.” And 2 Samuel, chapter 9 tells a beautiful story that conveys how welcome we are at the table of the king. After the deaths of King Saul and his son Jonathan, David began to search for someone from the bloodline of Saul, to whom he could show favor to honor his friend Jonathan (2 Samuel 9:1). He just wanted to be good to someone in Saul and Jonathan’s family on Jonathan’s behalf. David found out that Jonathan’s son, Mephibosheth, was still alive. But he was told that the young man had “issues.” His feet were lame. That was no matter to King David, who sent for Mephibosheth to be brought to him. Mephibosheth came before King David in fear and shame, bowing and asking, “What is your servant, that you should notice a dead dog like me?” (v.8 NIV). Many of us come to God that way because we do not feel good enough or that we deserve God’s love and mercy. I felt this way for a long time, so I understand what it’s like. But we don’t have to clean ourselves up to come to God, because the truth is we can’t make ourselves good enough in our own effort or strength. God wants us to come to Him just as we are, and then He will change the things about us that need to be changed as we grow in our relationship with Him. David assured Mephibosheth, saying, “Don’t be afraid, for I will surely show you kindness for the sake of your father Jonathan. I will restore to you all the land that belonged to your grandfather Saul, and you will always eat at my table” (v. 7 NIV). The last verse of that chapter says, “Mephibosheth lived in Jerusalem, because he always ate at the king’s table; he was lame in both feet” (NIV). What a beautiful account of unconditional love, acceptance and redemption! You Are Always Welcome This can be our story as well. As Psalm 23:5 says, God’s table has been prepared for us in the presence of all our enemies—all our issues and problems. The Lord welcomes us to His table and anoints our heads with oil, a symbol of the Holy Spirit, who refreshes and energizes our hearts. And He continually fills our cup to overflowing! When we live in God’s presence, our “cup”—our life—will overflow with His love, grace, mercy, and every other good thing He has for us. The Lord is a good Shepherd, and there is no reason for you to feel insecure, ashamed or fearful before Him. Dear Jamie, This is an important question. It’s not important because $350 is a big deal in the grand scheme of things, it’s important because you’re making a judgment call as to what you’re focusing on and what you value. If you’re focusing on your husband finishing school, so his income goes up and you’re trying to get out of debt, that's fine. I love it when people are willing to work their tails off to have better lives. But if that’s your focus, and at the same time you’re trying to rationalize buying something you don’t really need, that’s a bad thing. You don’t need a new cell phone for a camera, especially if the camera is the only reason you’re buying it. You can find decent digital cameras everywhere these days for $50 or less. I understand the joy that goes along with having a child. I have three kids, and we were absolutely ecstatic each and every time one was born. And, of course, we wanted good photos of them all. But right now, I think you’re trying to rationalize a phone upgrade based on the emotion of a new baby. As an exercise of your value system, that’s a tendency you need to break. This is a test, Jamie. What you’re talking about here is a luxury, not a necessity. Rationalization is one of the prime causes of overspending. Please understand, I’m not picking on you and I don’t mean to be harsh. We’ve all flunked this test at times. But this is an important moment where your judgment and values are concerned. It’s your call, but you really don’t need to blow $350 on a new phone right now. —Dave
