Joint tenants With Right of suRvivoRship undeRstanding Cost Basis at death Calculating the step-up in basis of investments at death is usually not that difficult. All individually owned capital assets included in a deceased person’s estate receive a new cost basis, generally valued as of the date of death. However, jointly owned property can be trickier. First, let’s cover the step-up in basis of property held between husband and wife in joint tenant with right of survivorship form, which also applies to tenants by the entirety. When the only joint tenants are husband and wife, half of the fair market value at date of death is included in the decedent’s estate and the surviving spouse’s new basis will equal half the total pre-death basis and half the fair market value at date of death. The formula looks like this: New basis = (Date-of-death fair market value + Old basis) / 2 Here’s a practical example to help determine the new basis: At the time of Tom’s death, he and his wife, Nancy, owned a portfolio of common stocks as joint tenants. Tom paid $5,000, and Nancy $11,000, of the original $16,000 purchase price. When Tom died, the stock was worth $22,000, and Nancy acquired Tom’s interest by right of survivorship. Four months later she sold the stock for $29,000. Nancy will realize a long-term gain of $10,000. Nancy’s basis is $19,000, the sum of $8,000 -half the original basis- plus $11,000 comprised of Tom’s half interest included in his estate. Tom and Nancy’s portfolio Shares 100 100 100 100 100

Nancy is unable to claim a full step-up on certain assets and no step-up on other assets; each share receives a one-half step up equally. Notice that even though the spouse’s contributed different amounts to the original $16,000, they both own an equal 50% share of the property for inclusion in their estates. This is unique to husband and wife joint tenant with right of survivorship property as we will see later in the article. Those in community property states must consider an interesting twist. The new basis in community property is fair market value at the date of death for both halves of the community property, even though only half is included in the decedent spouse’s estate. This translates into a full step-up in cost basis at the first spouse’s death which is certainly simple enough to determine and very advantageous for the surviving spouse. People who own property as joint tenants with right of survivorship and are not married go by the consideration furnished rule. This rule states that the decedent’s gross estate includes that portion of the property as the decedent’s share of the consideration, or price paid for the property, bears to the total consideration. The new basis for each surviving co-owner’s interest is his or her old basis plus an increase for his or her proportional share of the amount included in the decedent’s estate. Example: Years ago, brothers Steve and Stan purchased stock for $10,000, taking title as joint tenants. Steve paid $6,000 and Stan paid $4,000 towards the purchase. At Steve’s death the stock was worth $20,000. Included in Steve’s gross estate is 60% of the stock’s value because that corresponds to his share of the consideration paid for the stock, even though property law recognized that he owned 50% of the stock immediately before death. Stan’s new basis would be $16,000, which is the amount included in Steve’s estate of $12,000 plus Stan’s $4,000 basis in his pre-death interest in the property. The mobility of the animal was uncoordinated and seemed to flop like a fish when it tried to go forward. Upon examination a large tick was discovered attached to the belly and two other small ticks under that. This particular species of ticks that were on the Pom had secreted a toxin that affected the nervous system. The owners of the Pom had responded in a timely manner and this dog made a recovery after the ticks were removed. Had the ticks not been removed when they were, the condition could have ascended up the body and affected the front limbs and even

respiration. The condition can worsen very rapidly. It should be noted that not all ticks secrete a toxin, but we have some in this part of the country that do. Last spring a calf was brought into the clinic because it had lost its ability to walk. We discovered ticks on it and applied a tick product. The calf made a full recovery after removing the ticks. With dogs it is a very good idea to apply a preventative flea and tick medication. It is easy to apply, effective for one whole month and repels flies and mosquitoes too. - DR B

Railroad Towns Celebrate 100 Years on the Hi-Line of Montana

A common denominator for many of Montana’s small towns began with the innovative ideas of a man whose name we’re all familiar with: James J. Hill. While not a Montana native, he certainly impacted those of us who are. It is because of his decision to pursue the ambitious idea of laying rails along the northern stretches of Montana that many of our great-grandparents elected to come here in the first place. Many came to farm or ranch, further west they logged, and along the way did very creative things to carve out a place for their families. As the settlements grew, schools formed, stores were built, and individuals with trades found niches for their services. Our hearty ancestors built an entirely new world before the days of Snickers bars, air conditioning or electric heat. They battled the extremes of this country without -40 degree rated muck boots, sun screen or bale beds. This determined bunch worked hard, very hard—so this summer, as many hi-line towns prepare for some summer celebrating, we take a moment to appreciate the efforts of those who came before us in settling the high prairies and river bottoms of northern Montana. 100 years of anything is a point to be celebrated and the summer of 2010 brings us to the centennial of several Hi-Line “settlements”. As you are planning your summer entertainment, consider staying close and taking in some of the local fan-fare as Rudyard, Hingham and Chester pull out all the stops to celebrate their rich histories. Each town will celebrate in its own unique way, but they have one thing in common--the folks there all know how to have a good time! Rudyard Centennial, June 25-27th: Sometime before June 25, the folks in Rudyard, Montana will be busy in preparation for the Centennial Celebration there. It’d be good to start getting into shape now, so you can be ready for the Fun Run on Saturday morning bright and early. Then, dust off the old year books and get ready to see some old familiar faces as the “all school reunion” beckons everyone and anyone who was ever part of the Rudyard school scene. Students, teachers and friends are encouraged to join the fun; there are RSVP’s to fill out and mail in so be sure to check the website at http://rudyardmuseum.com/2010celebration/plans.htm for more information and get ready for a blast from the past! Some of the weekend highlights include dancing, fireworks and the three man (or woman) toilet race, as well as a parade, quilt exhibit and an alumni football game. There is a historical presentation for those interested in learning a few things about Rudyard’s primitive beginnings, and there will be lots of fantastic food along the way! Those who register for this weekend of fun will get to choose the town’s next official “Sorehead”. Mark your calendar!

Hingham Centennial, July 9-11th: July 9th, 10th and 11th, Hingham residents will be celebrating 100 years as well. Friday begins the festivities with the all school reunion registration at Spencer’s Hi-Way Bar from 3:00-6:00 followed by a dinner at the Community Center. On Saturday, the fun kicks off at 8:00 with breakfast at the Community Center and heritage displays of Hingham families, along with a Hingham historical slide show. There is also a Fun Run/Walk for anyone interested; meet at the park, and if you pre-register you will receive a t-shirt. At 10:30 is the “Tour

Chester Centennial, July 2-4: Chester offers three days of fun July 2nd , 3rd and 4th. Friday starts off with registration and activities in the CJI School Old Gym. There is a performance of “Nunsenceâ€? which is said to be a “sin to miss!â€? In the evening, the band Roustabout will be playing live on 1st Street East and make plans to stay and dance the night away with the Clintons who will wrap up the evening. Saturday will still allow for late registration, then the Fun Run starts at 9:00. The parade makes its way downtown at 10:30 and the fun doesn’t stop there. . . between the tours, cow-pie bingo, sporting events and the pool, there’s plenty to entertain. The town begins the “Get Downâ€? festival at noon and that goes until 4:00. The evening brings a 7:00 community concert and wraps up with outdoor movies and fireworks. Annual Fort Benton Summer Celebration Takes Place Parallel to Centennial Events

June 25th, 26th and 27th marks the 34th Annual Fort Benton Summer Celebration. The whole weekend is jam packed with something for everyone. Begin Friday morning with a visit to the Missouri Breaks Interpretive Center and follow that with a browse through the used book sale and have some lemonade at the library. The Museum of the Northern Great Plains will be open all weekend, as will the Museum of the Upper Missouri. Old Fort Park is the site of the Living History Encampment and “Art on the Levee”. Check out the open houses at Historic Old Fort Benton and Fort Benton Realty. Take some time to let the kids play at the Fun Zone that boasts everything from face painting, a bouncy house, air brush tattoos, bungee jumping, a duck pond, a human gyro, and Spiderman (who will also be at the parade on Saturday!). Saturday hear the acoustic talents of guitarist Joe Ryan who will be playing at several locations in town. A mid-morning parade is a must see, the “Theme Time Trails River to Roads” along front street. The University of Montana’s mascot will be at the parade! The kids will love it; make sure to be there at 11:00 to take in the fun! The MSU women basketball players will be teaching a skills clinic for grades 2-9 in the Fort Benton High School gym. The Missouri Breaks Gang will be providing entertainment throughout the afternoon and later, there’s bull riding at the fair grounds. Live entertainment includes the talents of Daphne Denniston, Ruf Cut Grass, Colin Ross, Mig O’Hara and Kieran, not to mention Jamie and Shaun Carrier and Peter Lindskoog. Fade will be performing at 8:30 followed by the night show and street dance at the Grand Union Square accompanied by a grand fireworks show. Sunday continues with “Art on the Levee”, the cavalry will be set up in the park for a taste of history, and the museums will facilitate more tours.
