wo people were killed last morning when a compound wall of an open plot collapsed due to the incessant rains. The incident occurred near Ratan Tata road at Parsi colony in the Tardeo area of South Mumbai, said the police. In all, five people were injured and rushed to Nair Hospital, out of which two of them were declared dead and one is critical. The deceased have been identified as Manoj Kumar Singh (36), Rohit Kumar Singh (46) and the one who is critical has been identified as Manish Kumar Singh (22).

According to information received, the balcony-cum-passage of Kashinath Smruti building came crashing down at about 9.40 am on Sunday. Built in 1980, the 34-year-old Kashintah Smruti which housed 32 tenements had been earmarked as a dangerous structure four months back by the PWD wing of the Mira Bhayandar Municipal Corporation (MBMC). However, the building was still occupied by 7 to 8 tenements, including a few shopkeepers, who in pursuit of a repairing permission had moved the judiciary seeking stay on eviction notices issued by the MBMC. 'dangerous'Sixteen buildings in the twin-city have been tagged as dangerous and unfit for human habitation by the MBMC. In the aftermath of the Mumbra building collapse, the MBMC, under the relevant sections of the BPMC Act, had mandated residents of as many as 1,267 structures to conduct structural audits and submit the stability reports to the concerned ward offices. Onehundred-and-eleven out of the 1,267 structures are more than 30 years old. While most of the buildings have carried out or are in the process of getting their structures repaired as per the audit reports, several housing societies have expressed a question mark on the authenticity of audits carried out by the structural auditors empaneled by the MBMC.

A doctor from Nair Hospital said, “Manish Singh, who would be around 35 years old, is critical. He is on ventilator. He has suffered severe injuries on both the shoulders and has pelvic bone injuries. He has also suffered blunt head injuries. The two bodies have been sent for post mortem so that the exact cause of death can be ascertained. They were brought to the hospital by the police. Details about them are not available. They are unknown. But they both are male and might be in the age bracket of 45 to 48.” The bodies and the injured were brought to Nair Hospital between 2 am and 3 am of Sunday morning.

The building is also surrounded by shanties. Local ward office Assistant Commissioner S P Khilije said, “The BMC's work in the demolition is very limited as a co-ordinating authority. British era iron I-beams are so strong that our gas cutters are proving helpless on it.” The chief officer on the MHADA Repair Board, Dr Ramesh Surwade said, “The building was built in the 1940s. We have shifted 21 families of this building to a safer place.” Due to the demolition trains were running 20 to 25 minutes behind schedule on Sunday. 106 local services were cancelled by Sunday evening. .

ust before the Lok Sabha elections, in a hurry to launch the populist health scheme, the Central government snatched up the three-digit helpline number 108, which was earlier provided to all the civic Disaster. Management Units (DMU) across the country, and gave it to the National Rural Health Mission (NRHM). This created a mess across the states as hundreds of DMUs which have been entrusted to handle crises complained that their units were paralysed as the they were not provided with an alternative helpline number for several months. The central government created the National Disaster Management Authority (NDMA) to tackle 38 kinds of disasters including earthquakes, fire, fallen trees, collapsed buildings, etc. The common helpline number, 108, was given to local disaster units. Mumbai, Thane, Pune and other civic bodies across the Maharashtra popularised 108. Over the years,

gion. Investigations revealed that Sawant was an habitual offender who was arrested in 2007 on charges of posing as a police sub inspector in Vasai. It may be recalled that 35-year-old Hemant Patil, was a pride of Valiv village near Vasai, until his arrest in June, 2013 on charges of impersonation and cheating. Patil masqueraded as an IPS officer posted as Additional Superintendent of Police (ASP). However his luck ran out when he ran into the actual ASP of the region Sangramsingh Nishaandar.

This became evident when three days after a 'police officer' was arrested in Mira Road, another bogus police personnel landed in the custody of the Bhayandar police on Saturday. In the present case the imposter, Dinesh Brijraj Tiwari (30) moved around as a police constable extorting money from local panwallahs and traders in Mira Road, Bhayandar, Vasai and Virar threatening to implicate them in fabricated cases for selling banned guthka products. Civic body launches an extensive operation to clean all ponds, natural wells and dug wells in the twin city to mitigate water crisis

ven as the threat of water scarcity looms large, the Mira Bhayandar Municipal Corporation (MBMC) has finally decided to dig a little further to mitigate the crisis. In a belated but much needed move, MBMC’s water supply department has now turned its attention towards traditional methods aimed at keeping a tab on its own natural and dug water resources. Following standing instructions from civic chief Suresh Kakani, the water supply department has launched an extensive operation to clean all ponds, natural wells and

dug wells in the twin city. As per records there are 29 natural and 89 dug wells in the Mira Bhayandar region, however most of them are a picture of utter neglect and apathy. Besides this, the MBMC has also decided to revive existing handpumps and re-bore more of them so that availability of potable water could be enhanced. As of now there are 94 handpumps in the region, most lying unused in need of re-bores and repairs. “While the repair works have already been initiated to fix the broken handpumps, we have asked the Ground Water Survey and Development Authority, to conduct a survey to identify more water resources

across the twin city where more handpumps and dug wells could be bored for dispensing potable water...” said, Suresh Vakode, Executive Engineer (Water Supply). “Before the situation gets worse in coming days, we are taking these precautionary measures. These steps may be small but are significant and there is no harm in reviving our natural resources and tap new ones to augment existing supply,” Kakani said. ccording to the police officers, Shashikant Kadam and his fatherin-law have been on the run since the past two years after their anticipatory bail was rejected by a Sessions Court and then by the High Court. “We have been tracing the two, but have not been able to arrest them yet. We had visited Satara as well, which is the native of Kadam, but the two were not there,” said Ashok Kadam, senior police inspector of Kherwadi police station. Officers said that they had been tracking the mobile numbers of Kadam and his father-in-law Rasal, but both numbers are switched off. “The last known location of Kadam was Jogeshwari at his house a few months ago but after that the entire family has been missing from the area,” added Kadam. After the fraud came to light, the MHADA had asked the Kherwadi

police to investigate the case, after Kalyani Mahadeo Khatate (32) of Alandi village had not been able to take possession of her flat in 2009. Khatate, widow of paratrooper Mahadeo Khatate, was allotted an affordable house by MHADA in Bimbisar Nagar in Goregaon, Mumbai, in 2009, has not been able to take possession of the flat. As of November 2013, the flat has been occupied by one Shivaji Bandu Jagtap despite repeated intervention by Khatate and the army authorities. The MHADA had asked the Mumbai police to investigate a case of 13 widows of Indian Army soldiers allegedly duped off the lowcost houses they had won in a lottery in Mumbai. According to Khatate, it all started in 2008-09 when Jagtap approached her claiming she could participate in a MHADA lottery meant for widows of ex-servicemen. Her husband was killed fighting terrorists in the north

and was decorated with Sena Medal (gallantry) on August 15, 2002. Khatate had said that she had submitted all documents and even got a call from MHADA which said that “I have been allotted a flat in the scheme.” She even paid Rs 9.64 lakh towards the flat. According to the documents, MHADA allotted flat no 503 in building no 31/ B to her on July 1, 2009. She took possession of the flat on November 9, 2009. However, an irrevocable power of attorney form dated November 18, 2009, shows that Khatate made Jagtap the power of attorney. Notable is the fact that this irrevocable power of attorney was made on a stamp paper purchased on May 22, 2009, even before MHADA allotted the flat to Khatate. According to her, Jagtap, an agent, has been occupying the flat ever since it was ready to move into. Jagtap took possession of the flat by forging documents.

Three lakh devotees throng Shirdi temple

At least three lakh devotees from different parts of the country thronged Saibaba temple during the three-day long "Guru Poornima" festival which concluded on Saturday, official said yesterday. Almost fifteen months after infamous Shil-Daighar building collapse in which 74 people were killed, police has arrested the chief contractor of the structure from Latur. "With the arrest of Laxman Rathod on Saturday, the total number of arrests in the case has gone up to 25," Sanjeev Kadam, senior inspector of Thane crime branch, said yesterday. The building, mostly housing the lowermiddle class families of migrants from other states, had collapsed in April 2013 at the area located between Mumbra and Dombivli in the district.

he Central Industrial Security Force (CISF) has arrested a 54-year-old Australian national, from the domestic airport here for allegedly possessing a satellite phone. The man works as a vice-president in a Malaysian company. The accused has been identified as McDonald Bruce Andrew, who was to take flight to Goa with his wife and children and was found with Iridium company's satellite phone when he was intercepted at about 1.45 pm yesterday by personnel of the Central Industrial Security Force (CISF). He was granted bail on a personal bond of Rs.15,000 yesterday itself. India has

banned the use of sat phones and even if foreigners coming in with valid documents permitting them to carry such phones, the domestic authorities reserve the right to overrule such permissions. “McDonald was charged under relevant sections of the Indian Wireless Telegraph Act 1933, Indian Telegraph Act 1885 and subsequently arrested,” said Lahu Gautam Thate, sub-inspector at the airport police station. According to police, McDonald arrived in India with his family from Malaysia on July 11 and checked into a five star hotel in Mumbai. His wife is originally from Goa. An unconstitutional, illegal demand T

HE Congress Party is asking the ruling BJP government to recognise it as the Opposition party in the Parliament. Immediately after the government was formed, the Congress which has only 44 seats, began to plead with the ruling party to recognise it as the Opposition. After a while, the Congress became aggressive and demanded recognition as the Opposition. The Congress leaders' demand was based on the rights the Opposition has in Parliament. The BJP, which wanted to close the matter, said this was a matter which would be decided by the Speaker. The Congress has decided to wage a war regarding its right to be recognised as the Opposition. It has declared that if it was denied the right to be the Opposition party, it would refer the matter to the Supreme Court. The Congress party's argument is that the Opposition has a big role to play: For instance, in the Lokpal panel, it has a seat. Another development has taken place. There was a perception among political parties and people that the Congress would be defeated but it was a big surprise it was decimated. It got only 44 seats. As per the Constitution, a party can be in the Opposition if it has ten per cent of the strength of the House -- which is 54 seats out of 543. What the Congress is asking the BJP is to commit an unconstitutional and illegal act. The Congress position following the rout in the Lok Sabha elections is pathetic. It is most unlikely that the Supreme Court would support an illegal and unconstitutional proposal.

ET us be clear. If you are a politician your response to the budget would depend on which side of the Speaker you sit in the Lok Sabha. So even if the budget is good under the circumstances do not expect those on the Opposition benches, even if they are the ones who had brought the nation’s economy to its knees in the first place, to acknowledge a brave effort at reviving it. Therefore, leave their pro forma criticism aside. Arun Jaitley has done a good job given the mess he had inherited, the paucity of time at his disposal and the little wiggle room available to push drastic changes. There is much in the fine print and the painfully long budget speech to provide an inkling into the vision that underpins Jaitley’s maiden offering. The hundred crore earmarks for a number of schemes are no laughing matter; these constitute the blueprint for change the Modi Government seeks to bring in the country. In their anxiety to pan the budget, almost everyone outside the NDA has picked on these Rs.100-crore outlays as if these test the intelligence of the budgetmaker. Actually, critics are shown in rather poor light, mistaking initial, scheme-specific provisions for necessary spadework as if these were for the full implementation of entire projects.

Genuine complaint But if there is a genuine complaint against the maiden budget of the Modi Government it is that there is no effort at expanding the tax base. We have one of the lowest tax-to-GDP ratios, a little over ten per cent. It is no exaggeration that more millionaires are outside the tax net than inside. It should be unacceptable to the finance minister that in a country of 1.2 (one point two) billion only 43,000 declare their income to be Rs.1 crore or more. At any given time in the big cities you can find evidence of more crorepatis in crore-plus limousines than the taxman cares to notice. Jaitley himself would know at least a hundred-odd colleagues from his legal fraternity who are in the crore-plus league. Even if some of them do suppress their incomes, and one or two get nabbed, for example, Abhishek Manu Singhvi of the Congress Party, there is ample scope to enlarge the tax kitty by closely monitoring the expenditure of big-earning, big-spending professionals, be it lawyers or architects, tax consultants or software developers, etc. Of course, the business class is no-

torious for wanting not to pay its honest share towards nation-building, while crying for better roads, decent airports, clean neighborhoods, etc. The existence of a parallel economy, as large if not larger than the over-ground economy, is an undeniable fact. Jaitley could have taken a small step towards the introduction of expenditure tax to try and chip away at the stranglehold of black money. Enlisting the support of the States in dealing with this menace would, of course, be necessary, but the lead would still have to come from the

genuine taxes. Jaitley can help in his budget next February if he makes the tax laws simple. Withdraws the maze of concessions and deductions, and instead restricts the rate of taxation to three or four slabs, for the middle, upper and high income groups. Fix the rates, say, at fifteen, twenty and twenty-five percent without complicating the task of computation by incomprehensible gobbledygook. Jaitley has the mandate to make peoples’ lives better, less complicated. Let him begin by making tax laws simple and easily enforceable. And by ensuring that all earning Indians contribute their fair share to the urgent task of nation-building. When he presents his next budget, he will have no excuse not to try the bold and the beautiful. This one, we understand, did not carry his imprint for obvious reasons.

This must change if India is to compete with China. And it can change if only Indians are made to realize that there will be costs for evading

Leasing that out or selling it outright would yield at the very minimum Rs ten thousand crores with which the NDA Government can undertake to bolster further the proposed Beti Bachao, Beti Padhao programme. Is the Congress Party game to yield its grip on the tens of hectares on Rajindra Prasad Road alone which houses the Rajiv Gandhi Foundation and the Indira Gandhi Prathishtan? And strictly for the Beti Bachao, Beti Padhao programme? Put your money where your mouth is, dear Congressmen. Will you? your face, but you can see he is not looking at you. He just looks through you as if you are a glass thing, transparent; you are just in the way, he is not looking at you. And you are transparent for him: he looks beyond you. Look in the sky without looking for something, because if you look for something a cloud is bound to come: "something" means a cloud, "nothing" means the vast expanse of the blue sky. It is politically motivated with the intention of taking revenge on the Gandhis. The BJP has not been able to convince the court that Young Indian, where Sonia and Rahul are shareholders, is not a profit-oriented organisation. This made him join Mumbai University’s course for post graduation in Arts (Numismatics & Archaeology). He cleared this course in 2013 at the age of 53. Shah is actually a commerce graduate from Podar College. As if to remind youngsters, Shah says, “I wish to keep the art of letter writing alive by sending handwritten letters to celebrities. As in today’s mobile, internetand WhatsApp world, people have forgotten the place called 'Post Office', as no one posts letters, and in turn they do not even know the price of a post card.” Of late, Shah got a novel way to add to his collection in a decorative way. As wedding invitation cards are

I got his full family's autographs, including that of his grandson. I wish that the younger generation starts writing letters by which they can learn and gain knowledge.”

A commerce graduate who is into the field of advertising and photography, Shah cultivated the habit of collecting stamps, coins and autographs from celebrities early in his life. Shah has recently been awarded ‘Rashtriya Gaurav Puraskar’ in Pune by Madhusudan Ghanekar, a Limca Book record holder for whistling 120 songs at a stretch. “I have been collecting autographs since childhood days, but I got serious after I got a reply from Ronald Reagan, the then President of US, in 1985. Since then there was no looking back. My journey in collecting autographs and meeting celebrities got me a collection of 700+ autographs. I spend around Rs.100 per cover which I send to the celebrities. I send a SASE (self addressed stamped envelope) to the celebrity,” informs Shah. t is a peculiar situation at roads with signboards in Chembur, because of their low heights, these boards tend to hurt pedestrians walking on the road. While the road cleaned up and cemented at many places in Chembur, the menace of these signboards began. Their heights drastically reduced because of the concrete roads or paver blocks on footpaths. These sign boards, instead of helping the general public, are causing them physical damage. Umesh Kotian, a resident of Chembur, said, “As one can see in the picture, D K Sandhu Marg signboard at the junction has shortened because of the road work. The authorities, while doing road work, should apply their minds on these factors too. It is obvious that after road work or footpath work is complete, its height should increase. So why can’t they put sign boards at proper height right then instead

Normally we raise the heights of these boards while doing road maintenance or spreading concrete. I will do the needful or inform the concerned officer from the ward office.” When the ADC spoke to Sanjay Jadhav, assistant engineer (maintenance), M ward, he said, “I will look into the matter. The concerned signboards will be placed at proper heights so that it doesn’t hurt citizens.”

If the stock exchanges are a barometer of the economy and an indication of things to come, than one must clearly take the Union Budget and its implications with a pinch of salt. The market post the railway budget has trended sharply downwards witnessing its largest weekly fall in over two years, clearly giving both the budgets a thumbs down. By Deepak Sahijwala

he “tax revenue projections outlined in the budget are too optimistic and no action plan for reducing subsidies was laid out... there is, in fact, a high possibility of an overshoot from budgeted levels if oil prices rise due to the ongoing strife in Iraq . And on GST, one cannot forget that earlier time lines for its roll-out have not been adhered to and progress cannot be taken for granted given the need for consensus among states on this issue. We believe the fiscal deficit is likely to print higher at 4.5% of

GDP rather than the budgeted 4.1% in fiscal 2015, unless the government cuts back on expenditure� says Crisil Reasearch in a post budget analysis. Giving due credit to the fiscal arithmetic laid out in the Budget and its positives, Crisil believes that “the scope for fiscal slippage however, remains high. Among others, the budget envisages the quality of expenditure to improve with an increase in capital spend, which is critical for a sustainable recovery in growth; subsidy rollovers lower than last fiscal; and Goods and

Services Tax (GST) getting rolled out by the end of this fiscal. It bases it's argument on the fact that “the budget assumes nominal GDP growth at 13.4%, up from 12.3% in the last 2 years. Growth in gross tax revenues has been budgeted at 17.7% (direct taxes at 15.7% and indirect taxes at 20.2%). This implies a tax buoyancy (percentage increase in tax revenue for every 1% increase in GDP) of 1.3 – which is higher than the last 10 years’ average of 1.0 and too optimistic given muted

GDP growth expectations (5.4-5.9%), no increase in tax rates and cuts in excise and customs duties. In particular, growth in corporation tax is budgeted to rise to 14.6%, up from an average 9.6% in the last three years. A kick to corporate tax collection is likely to come from an introduction of long term capital gains tax on debt-oriented mutual fund schemes, and through higher collections on account of dividend distribution tax (DDT). However, the expectations on customs and excise duties are aggressive as these are budgeted to grow at over 15%, up from less than 6% growth last fiscal�. Similarly, Standard Chartered Bank in a post budget analysis is

also of the view that “Some of the budget’s assumptions around indirect tax revenue growth appear optimistic to us. This might worry markets about fiscal slippage later in the year, but we think that the divestment proceeds could surprise positively if equity markets remain buoyant. Although there is no concrete plan to reduce subsidies, the Finance Minister could cut expenditure marginally later in the year to meet the deficit target, if needed. Announcement of the direct and indirect tax reforms has been deferred, with the government still to resolve a few contentious issues with the relevant stakeholders. Markets had hoped for a more specific approach to the issue of publicsector bank recapitalisation, as this would have allayed fears of fiscal slippage� It believes “The revised FY15 fiscal deficit math has two positive messages. First, sticking to the interim fiscal deficit target at 4.1% of GDP sends a strong message on the government’s intent to adhere to a fiscal consolidation path. Second, the improved composition of expenditure leaning more towards developmental instead of non-developmental or recurrent

Finance Minister Jaitley has been able to deliver on some of these while on others there was disappointment. In our view, some of the issues where the budget did not deliver specific measures could be taken up at a later date, since the Finance Minister got only a month to prepare his first budget.” Says Kavita Chacko, Economist at CARE Ratings “Even though the finance minister has maintained the fiscal deficit target of 4.1% (for FY15) set by his predecessor, achieving the same looks challenging given that no drastic changes in the health of the economy are expected for the remainder of the year and thereby in its revenues... No major announcements were made on the reforms front. The budget only indicated that it would be bringing in reforms later on. Overall the budget can be viewed as one with a long term growth strategy and not one which can provide a quick fix for fixing the Indian economy.” As regards the markets, which reacted nervously and dropped from its all time high of July 8 to register its biggest weekly fall in over two years , there are mixed opinions. While some analyst feel this knee jerk correction is temporary others feel that there is still some downside left.

he “authorities’ intention to promote foreign direct investment in selected sectors and initial specific steps to ease rules in defence, insurance and real estate will likely improve international investors’ assessment of India’s macroeconomic policy. These measures boost the authorities’ ability to bridge any short-term current account financing shortfall with new FDI inflows. It also opens up the prospect of an improved economic performance medium-term, which may create the conditions for more Indian rupee (INR) strength further out'” says a report released by Standard Chartered Bank. According to it “In the short term, however, USD-INR dynamics remain heavily influenced by the Reserve Bank of India’s (RBI) vigorous FX policy. It is not clear that anything in the budget changes the RBI’s trade-offs in this respect. RBI Governor Rajan takes the view that USD-INR in the 60-62 range leaves the INR around “fair value” and the RBI’s calculations of the INR’s real effective exchange rate, based on consumer price inflation clearly support this view. Data on the RBI’s FX forward book suggest that FX intervention in May was substantial – around USD 20bn (Figure 2). We estimate that June intervention was around USD 7bn and total RBI intervention in recent months could easily have

exceeded USD 30bn. Given the scale of this intervention and only modest new budget measures, there is the danger of a short-term lNR liquidation dynamic which would see USD-INR rebound decisively back into the RBI’s “fair value” zone. In the near term, technical resistance based on the 20 March 2014 daily close lies at 61.33. Given this liquidation threat, we maintain a short-term Neutral recommendation for the INR, but look for opportunities to switch to Overweight on any significant USDINR correction higher (our end-Q3 USD-INR forecast is at 59.00). While this first Modi budget may have not brought decisive measures to improve India’s growth/inflation mix, these measures should materialise in coming quarters. Improved inflation news should boost the likelihood that the INR will outperform the considerable depreciation priced into the USD-INR onshore forwards. We retain a medium-term Overweight recommendation and argue that corporate clients hedging overseas FX receivables should look through short-term volatility to exploit the hedging opportunities offered by relatively steep USD-INR onshore forward curves. The USD-INR 1Y onshore forward, for example, at 64.95 is a full 8.3% above spot and 7.4% above our USDINR forecast for mid-2015.”

he mutual fund industry welcomed the budget proposal to increase the tax exemption limit under section 80C of the Income Tax Act to Rs. 1.5 lakh, but said other measures were a mixed bag. “The additional exemption under 80C will provide a limited window for tax exemption eligible mutual fund schemes,” LIC Nomura Mutual Fund’s Anutosh Bose said. However, for the MF sector, the change in long-term capital gains will impact negatively and the support available to bring in first-time investors towards equity/debt investments will get severely compromised when compared to bank deposits, he warned. “The increase in the 80C limit enhances tax incentive for potential retail investors to invest into equities mutual fund,” Kotak Mutual Fund’s Sandesh Kirkire said. “This is a budget that focuses on speed, scale and skill. On the downside where do you think the indices will find support? MARKETS tend to always over-shoot both on the up-side as well as on the downside in the short-term. The ongoing downward move is a mere correction in the long-term bull trend. Nifty has a very strong support at 7200 levels. Be Profitable Through Physical Appearances: Since customers are demanding it is essential to be hygienic. The physical appearance of the sales people is also very important, because if he/she is unkempt, the customer won’t feel like buying. Be Profitable Through Ambience: A visit to store should be a pleasant experience. The equipment as well as air conditioners in the shop should be switched on to enhance the ambience of the store.

Be Profitable Through Processes Processes should be followed to avoid errors and misunderstanding. A note of all customers’ calls should be made and the timelines should be adhered to. Ever since my college days, I, was highly influenced, intrigued and fascinated in the manner in which financial markets used to function. I used to read a lot about how the markets function, rationale behind the macro elements and financial statements of the companies listed on the bourses. I, in fact found this aspect very dynamic in nature where a judicious mix of various economic, political, regulatory, social and least to say the core earnings of companies/sectors needed to be analyzed thoroughly to arrive at a logical decision. The desire to keep on learning new elements and being passionate about it made me resolve to get associated with the financial markets.

Any final words? Any investor should try and do some basis analysis of the companies he wished to invest in. One should ideally not blindly follow or invest in stocks that have been recommended by friends, colleagues, market experts. Do some basic research about the company you wish to invest as information about companies is readily available with the advent of technology. Once you have invested be patient, focused and have a long term approach and not get swayed by short term fluctuations and movements in stock prices.

How do you pick your investments? I am highly influenced with following a bottom up and a long term approach towards investments in the financial markets. I employ fundamental analysis in picking up stocks and attempt to understand the company and the sector in great detail before conducting a thorough financial analysis of the company involved.

How would you describe your methodology? The methodology is broken down in a few processes per se. First of all I, ideally attempt to know in great detail the area in which the company operates, the listed/unlisted peers within the space, growth prospects of the industry, quality of management, sustainability of earnings and the ability of the company to carry on as a going concern through varied economic cycles. After getting a fair idea about the same I, ideally like to interact with the management to understand the critical elements of the business functionality and resolve any queries I might have. Taking a cue from all the data points collected, I, ideally like to build estimates based on key assumptions relevant to the company specifically. I would in fact like to quote Benjamin Graham : “investment operation is one which, upon thorough analysis, promises safety of principal and an adequate return. Operations not meeting these requirements are speculative”. What appeals to you about investing? My view is that investors should keep a focused, balanced and a long term approach towards the Financial markets. Historical and empirical evidence has proved that staying invested over a longer period of time within equity as an asset class yields returns which are better than any other comparable asset class. In fact I would again like to quote Benjamin Graham who says: “ The stock owner should not be too concerned with erratic fluctuations in stock prices, since in the short term, the

What differentiates you from other Investors? My strong belief is based on the assumption that investments in companies with a proven track record, strong, focused and committed management and the ability to run businesses through tough economic cycles would be able to deliver both value and returns to the investors. Again identifying the right companies is crucial and understanding of the sector is pertinent before taking a call. In my opinion valuations and an appropriate entry point is equally important as any company which is available on the market at a price which is at a discount to its intrinsic value would not necessary be attractive. So identifying companies at the right time is important for stock picking as companies are available from diverse sectors but which of these sectors will perform consistently over a longer period is important. What gives you that edge? Staying convinced about my ideations and invested over a long horizon is bound to generate adequate returns to shareholders.

Is there any applicable lesson to investing? Investing is a systematic process. Value creation takes time but once a company starts reflecting earnings stability and momentum the financial performance gets exhibited in their stock price. How much of what you do is gut feel? Gut feel is more speculative and the offshoots can be correlated with plenty of noise created over stocks/sectors. So one should ideally stay away from any noise and focus more on the core fundamentals . Do you try to anticipate market trends? I attempt not to be influenced in my decision making process by following market trends. If one is convinced about the quality of earnings the company might be able to deliver over a longer period of time backed by management of the company having a high pedigree and having a clean track record when it comes to governance and dealing with regulators, such companies shall deliver numbers consistently and the same shall be reflected in the kind of returns generated to shareholders.

When a trade goes against you? As I mentioned earlier the entire approach of a bottom up analysis and value investing is based on the fact to choose qualitative companies at reasonable valuations.

The stock markets move in cycles and in a downturn there is every probability that the prices might move downwards. The immediate and probable reaction is in such a situation is to press the panic button and wonder what to do next. Albeit, if one is convinced about the business prospects and the earnings visibility, all one needs to do is be patient and ride the down cycle. The same stocks over a longer period of time shall reflect their true value in the stock price.

Any positions you ever lost sleep over? I still continue enjoying my 8 hour sleep on a daily basis. If one stays invested in quality companies, there shall not be a cause of worry to lose sleep. What would make you wary about an Investment? If the company indulges in any activity not related to their core business, its

commitment of capital in proportions not called out and over leverages itself with inorganic acquisitions or have any red flag raised by the regulators, such situations would make me wary.

Your best investment? One of the best trades has been a company from the auto ancillary space. In the economic downturn the company was able to generate decent return ratios to its shareholders, but the stock was beaten down as a lot of anticipation was of deceleration in earnings going forward and sentiment had turned sour towards the industry in general. However the stock was available at beaten down valuations which made it a good entry point. Your success mantra ? Investing as I mentioned earlier is a time consuming affair. You need

What is your take on the current market scenario? The markets have clearly reacted to a positive election mandate and with the Union budget out of the way, the markets will now focus on earnings over the next couple of quarters and key macro data points like Inflation, IIP etc. Again the kind of moves over the next 2-3 quarters by the government with subsidy management and fiscal consolidation shall be key. RBI and its stance on inflation and interest rate movements shall be what the industry be watching out for. Globally how the euro zone functions and the kind of policy actions taken by the ECB and moves by the FED specifically in terms of timelines for a hike in interest rates over the next few months need to be monitored closely. Indian markets five years down the road ? An improvement in global growth and hence in external demand environment, GDP growth having bottomed out and hence expectation to it trending upwards, and deceleration in food inflation are some of the key positive impulses for the markets going forward. We attribute a 15.5x multiple to our Sensex EPS based on FY2016E earnings and arrive at a target of 27,300 for the Sensex over the next one year. From a 5 year perspective reforms measure initiated by the government, corporate earnings trending higher, foreign investments making their way towards India makes us bullish on India. If one goes with the basic assumptions and improvement in our fiscal situation the Sensex might reach levels in excess of 45000 over the next 5 years.

Finance Bill Creates Confusion And Chaos, Says Firoze Andhyarujina “T

he Union Budget 2014-15 has one too many favourable provisions for the common man. The Budget encompasses reforms to upgrade diverse sectors of the economy by undertaking development programmes. It has signaled growth as a top priority of the Government thereby improving the investment climate for domestic and foreign investors. However, certain provisions in the Finance Bill have overturned the judgments of the Supreme court and High court leading to far reaching confusion and chaos”, said Firoze B. Andhyarujina, Senior Counsel, Supreme Court of India during an interactive meeting on “Implications of the Budget 2014-15” jointly organised by MVIRDC World Trade Centre and All India Association of Industries. Enumerating further on the amendments in the Finance Bill Andhyarujina said that the bill makes no mention of the retrospective taxation amendment thereby litigations remaining pending with the option but reference to the high level Committee for settlement of disputes. Secondly, as per the Finance Bill a trust can claim tax deduction on the purchase of an asset. However, there remains no provision for deduction for depreciation of the purchased asset which is an unwelcome move by trusts. Another matter of concern for charitable and religious trusts is that under section

12AA, the trust registration is liable to cancellation in event of no utility to the general public or usage towards religious communities as against the only earlier provision of money not being spent under specified provisions. A matter of concern in the Finance Bill is the amendments on the capital gains taxation norms. As per the earlier Bill under section 54, reinvestment in buying home from selling of an earlier property was exempt from taxation. However, the recent bill restricts reinvestment exemption towards purchase of only single house with no such restrictions earlier. Also, as per the section 54 reinvestment in property abroad had been exempted from taxation which is now restricted to “India” only thereby unsettling earlier laws passed by the Courts. Earlier Capital gains from forfeiting failed negotiations on purchase of land, building or house were exempt from tax. However, as per the current bill forfeiting of failed negotiations is to be taxed as income from other sources violating the basic cannons of taxation. The dividend distribution tax was levied at 16.995% as per earlier provisions. However, the amended bill states gross taxation of dividend distribution tax thereby including surcharge and education cess which is likely to reduce dividend profits of shareholders.

The Companies Acts obligation of 2% investment towards Corporate Social Responsibility by companies was exempt from taxation which has been brought under taxation bracket. Lastly, as per the earlier provision interest payment for nonpayment of taxes commences since the time period when liability arose. However, the bill states interest payment since the assessing officer makes the order. The Budget has tinkered with laws leading to hardships for the common man. The need of the hour is clarity of laws besides building trust by the Government towards its law abiding citizens. The clarification of policies is likely to continue in the near term, Andhyarujina stated. Affirming the views of Andhyarujina panelist Nishith Desai, Founder, Nishith Desai Associates said the country is in need for less government interference and more governance. India needs to learn best practices from the US and UK for designing an unambiguous taxation structure. It is vital that drafts men be involved in designing legislative bills henceforth. M. S. Mani, Partner, Deloitte India elaborated on the indirect taxation code of the Government. The service taxes purview has been expanded to include commercial, economic and business activities. The Budget stipulates no definitive time frame for the

implementation of the GST. Lastly, the budget has given the much needed boost to the manufacturing sector by slashing excise duties and custom duties of key resources required for manufacturing. Jairaj Purandare, Founder Chairman, JMP Advisors Pvt. Ltd said the Union Budget 2014-15 signals reforms with provisions such as smart cities, e-visas, development of power sector, infrastructural sector, revival of the coal industry, linking of rivers, skill development programmes, incentive for housing and FDI cap changes in defense and insurance. However, proposals alone cannot make a difference to the economy. Ensuring execution of the said provisions is of paramount importance to generate sustainable growth in the next five years. Earlier, in his welcome remarks Y. R. Warerkar, Executive Director, MVIRDC World Trade Centre said the NDA government presented its maiden budget 2014-15 keeping in view the expectations of all segments of society. The Budget is pragmatic, all encompassing with intense focus on development, particularly the social sectors. The Budget offers big relief to tax payers. The sops announced in the budget are distinctly reforms –oriented aiming to lift economic growth to 7-8 percent in the next 3-4 years by promoting manufacturing and infrastructure and rationalizing subsidies.

NSE India : CNX Nifty — Daily Market Report for: Monday (July 14, 2014) By Dominic Rebello

REVIEW OF THE PREVIOUS DAY:

The Nifty fell substantially on Friday (July 11, 2014) a net 108.15 points (1.43%) and closed at the 7459 point level. The market opened up with a gap at the 7584 points level. It then rose sharply into the green and registered the day’s high at the 7625 points level at 9.28 a.m. The index then declined and turned into a range bound movement until 11.10 a.m. It then declined sharply into the red and registered the day’s low at the 7447 points level at 3.16 p.m. and then turned into a range bound movement until closing at the day. The Nifty witnessed a volatile session, moved in a range of 179 points and closed below the psychologically important 7500 points level. Sentiment was bearish and amongst the 50 Nifty stocks 37 were losers, while 13 stocks closed in the green. Substantial buying was witnessed in IT, healthcare and technology stocks, while substantial selling was witnessed in realty, capital goods, power, PSU and metal stocks. TECHNICAL ANALYSIS: Volume: Volume (Qty shares) decreased 27.97%. This change is substantial but indicates a moderate participation by investors.

Market Breadth: Overall Market Breadth on the NSE was negative. Amongst all the traded stocks, 235 were gainers, 1321 were losers and 31 remained unchanged.

Slow Stochastic Indicator: The Slow Stochastic Oscillator has declined in the neutral zone. The Slow K line in the Stochastic Oscillator is below the slow D line (negative if it continues). RSI Indicator: The RSI is above the 40 level but is now declining (negative if it continues).

MACD Indicator: The MACD is below zero and is declining (negative if it continues). It is below its 9-day Average (negative).

Overall Market Strength/Weakness: The indicators and oscillators discussed here are indicating a weak market with a negative bias. Support Levels: For short-term traders the immediate main support is at the 7538 points level was crossed below yesterday. The next support is at the 7471 points level.

Resistance Levels: The immediate main resistance is at the 7896 points level. The next resistance is at the 7954 points level. Pivot Point Analysis: For intra-day traders the support and resistance levels are calculated according to the pivot point theory and are: Pivot point = 7511 (This is the level where the trend is likely to change during intra-day). Support (1) = 7396. Support (2) = 7332. Resistance (1) = 7575. Resistance (2) = 7690.

OUTLOOK FOR TODAY: On Japanese candlestick patterns the index after having formed a doji pattern (indicating indecisiveness amongst investors) has formed a long black body candle. This indicates that the bias has shifted towards the sell side of the market. Further, the 5 days moving average has dropped below the 15 days moving average. This is negative and a sell signal. The index is below its 5, 15 and 25 days moving averages and all the three averages are declining. Moreover, the velocity parameters too indicate weakness. All these indicate a negative bias and the possibility of a further decline unfolding. Investors are advised to avoid buying at current levels.

Work with strict stop losses on all positions

ADX Indicator & DI Lines: The +DI line is above the –DI line but both lines are converging (negative if it continues). The ADX is falling while the Market Index is falling, which indicates that the present down trend is decreasing in strength. MOVING AVERAGES (TREND INDICATORS) The index: Is below its 5-day average (at 7604) Negative. Is below its 15-day average (at 7607) Negative. Is below its 25-day average (at 7600) Negative. Is above its 200-day average (at 6549) Positive.

We expect VIL to continue to generate above-average industry returns in core domestic operations on the back of aggressive dealer expansion strategy, strong focus on branding through advertisements, launch of new products and the ability to gain market share. We believe VIL is likely to increase the pace of its earnings sharper than HIL, further re-rating the stock going forward. We have valued VIL at 23x P/E FY16E EPS of Rs39.8 and 14.5x EV/EBITDA, assigning a Buy rating to the stock with a target price of Rs915. Indians suffer over Rs.13,000 crore loss due to thefts

Claim to be juvenile to escape law: Lashkar tells its cadres S

RINAGAR/NEW DELHI: Declare your age below 18 years if you are caught by security personnel--this is a new diktat from Pakistan-based Lashkar-e-Taiba terror outfit sent to its cadre in Jammu and Kashmir. Details of this LeT tactic was given by arrested Mohd Naveed Jutt alias Abu Hanzala, who was subjected to age determination test as he had claimed to the interrogators that he was 17 years old, official sources told PTI. After sustained questioning, Jutt, whose age turned out to be 22 years, said his 'masters' across the border had instructed him to give his age as 17 years. Jutt said the LeT top brass has been telling the new recruits, who are school dropouts or having criminal background, that they should behave as someone who is below 18 years so that they are tried under the Juvenile Justice Act and not normal Indian Penal Code. EW DELHI: In yet another naval mishap, a warship suffered damage while operating in the Andaman and Nicobar Islands region prompting the force to order a detailed investigation into it. INS Kuthar -- a Khukri class corvette -- suffered damage while entering the harbour of a naval base in Andamans and is undergoing repairs there, sources told PTI. It is the 15th reported mishap involving naval personnel and assets after the sinking of the Russian-origin submarine INS Sindhurakshak in August last year in which all the 18 personnel on board were killed. The latest mishap occurred at a time when the warship was returning after operating in rough weather. A Board of Inquiry (BoI)

IAF scrambles fighter jets as Turkish plane sparks alert J

ODHPUR: The Indian Air Force (IAF) on Sunday scrambled fighter planes from air base here after two commercial passenger aircraft sought to enter Indian territory from Pakistan side using similar identification codes, sparking a security alert. Two MiG-21 fighter aircraft were sent from Jodhpur air base to investigate a Turkish Airlines plane over Jaisalmer this morning when it repeated an identification code, which is unique to any aircraft, given by a commercial passenger plane that had entered Indian airspace before it. However, the Delhi-bound passenger plane

was later allowed to proceed after its credentials were verified, IAF officials told PTI. Identification codes are issued to commercial airplanes to establish their identity before they enter the territory of any particular country during international flights. The first aircraft entered the Indian territory using its identification code and doubts were raised when the second aircraft gave out the same code. Two MiG-21 Bison aircraft were sent to intercept the aircraft and it was allowed to proceed towards its destination after the fighter jets verified its credentials.

After finishing 10th class, Dasu applies for job in the police and gets into the force as a traffic cop. Then he is transferred to the crime branch because of his heroics. I was lately seen in the movie ‘Pyaar Se Dekho Zara’ alongside Hrishitaa Bhatt and I was also a part of Maneesh Sharma’s ‘Band Baaja Baaraat’ where I shared screen space with Ranveer and Anushka. I have always been praised for my outstanding performances and recently gained critical acclaim for my act in the renowned German film ‘The Girl With The Indian Emerald’ where I worked with Michael Karen. I have also been the face for various brand endorsements and have been seen on various magazine covers, music videos and international catalogues after bagging the Mr Photogenic title in Gladrags Mega Model Manhunt. I have also been a part of theatre with some reputed plays like 'Rakht Abhishekh', 'Itihaas' and 'Virasat'.

Manit Joura, who became a household name with his astounding work in many famous television shows like '24', 'Karol Bagh', 'Ram Milaayi Jodi', 'MTV Rush', 'Khamosiyan' and many more, is all set to enter Life OK’s renowned show ‘Hum Ne Li Hai Shapath’ as an undercover cop. We spoke to the hunky good-looking Manish about his new role. By Sandeep Hattangadi

What made you accept this show? The show, produced by Fireworks Production, is one of the channel drivers for Life OK and is very popular on television. I play a supersonic man with super powers. The show also has popular TV stars like Aman Verma and Payal Rohtagi. How did you prepare for this role? I took special efforts to get some training from the real life cops so I can bring justice and liveliness to my character. I will be seen

performing various stunts in a role which I have never done before. I professionally trained in martial arts, tai chi and gymnastics which is something I practice on a regular basis to keep myself fit and

healthy. I have trained in horse riding, swimming, automotive stunts, aiming, sword fighting and scuba diving.

What about your Bollywood

What are your other interests? I am fond of travelling and exploring new destinations. I prefer taking road trips. Recently I drove from Mumbai to Jim Corbett National Park. Before taking this trip, I had the finest road trip of my life from Frankfurt to Athens, Greece. I have also taken various other road trips around the country. And what next? I am in talks for a few films, but right now I am concentrating on this show.

Amitabh’s ‘Yudh’ premieres today M

egastar Amitabh Bachchan's television debut 'Yudh' will go on air today. Bachchan (71) plays the character of a real estate baron, Yudhisthir Sikarwar, in the show. The show follows the story of Sikarwar who has recently been diagnosed with a degenerative neurological disorder. 'Yudh' premieres today at 10.30 pm on Sony Entertainment Television. Anurag Kashyap is the creative director along with Shoojit Sircar, who has been roped in as a creative consultant. The series is directed by Ribhu Dasgupta. The show is co-produced by Bachchan's production company, Saraswati Creations, in collaboration with Endemol India. We spoke to a cross section of the industry's personalities to gauge their expectations of the show, and, of course, of Amitabh Bachchan.

It was raining outside and all that the actors desired was a hot cup of chai and a mix of pakodas to satisfy the customary snack that the Indians have to accompany the smell of rains. “Since we are always busy shooting, it becomes difficult to plan a trip. We are a family that shoots together and eats together”, quipped Neelu aka Bhabho.

'Zindagi', from Zee's bouquet of channels, which was launched with shows from Pakistan in the first phase, will treat audiences to new shows every month to air at 8.55 pm from July 13 onwards. Zindagi will launch two new shows – 'Maat' and 'Noorpur Ki Rani'. Starting on July 19. 'Maat' will bring to Indian Television two of Pakistan’s most talented actresses – Aminah Sheikh and Sabah Qamar. To air at 8.55 p, from July 13, 'Noorpur Ki Rani', will replace the refreshing rom-com 'Aunn Zara' and is a story of paradoxes brought out by contrasting characters of Noorie and Princess Rania.

POLICE COMEDY

Sab TV presents a special onehour episode of the most viewed police comedy this Saturday and Sunday. Watch as the FIR team tries to solves cases involving a fraud ‘thapad baba’ and the case of a missing dog. Starting next weekend, FIR will take on a new avatar with the inclusion of a live audience on the sets and interaction with them. The show will now be telecast weekly at 9 pm to entertain viewers over the weekend. Aamir Ali, who stars as Bajrang Pandey said, “The show has received incredible response from the audience.”

Muslims face issues of ‘inclusion’ in police force

Gujarat ‘includes’ most Muslims in its police force Ironically, Gujarat, a state often pegged as an anti-Muslim state ever since the 2002 Godhra riots, revealed a completely different picture. An RTI application filed in 2012 revealed that Gujarat, which faced one of the worst anti-Muslim riots in the country, had emerged as the state with the largest number of Muslims posted in police stations, higher than states with larger Muslim populations. The data, shared by the Home Ministry after an RTI application was filed, revealed that 10.6 per cent

of Gujarat’s cops posted in police stations were Muslims. This, in 2012, was higher than the proportion of Muslims in the state’s population, which was 9.1 per cent according to 2001 census. According to the details provided by the Home Ministry, the state had 5,021 cops from the community out of a total of 47,424 in its 501 police stations. Based on this data, on an average, Gujarat accounted for 10 Muslim cops per police station. Instead of ensuring a minimum number of Muslim policemen in the force across the nation, the share of the minority community has fallen to an all-time new low of 6.2 per cent in 2013. This marks a decline in the total percentage of Muslim representation in the force from the 6.5 per cent Muslim component in allIndia police in 2012, 6.52 per cent in 2011 and 6.9 per cent in 2010. The 2005 Rajinder Sachar Committee had recommended deploying at least one senior Muslim officer in each police station in Muslim-dominant areas along with few other suggestions. In definitive numeric terms, the number of Muslims in police forces across the country dropped down

This, after the UPA regime claimed its government was committed to implementing Sachar panel’s recommendation for better representation of Muslims in the police forces.

And, this only gives a skewed picture of the ground reality. Of the 1,08,602 Muslims serving in police forces all over the country in 2013, a total of 41,089 were from Jammu & Kashmir alone. So, if we exempt J&K from statistics, the share of Muslims in all-India police would be barely 4.07 per cent. As per 2001 and 2011 census figures, the share of Muslims in the country’s total population stood at 13.4 per cent and 13.43 per cent respectively. The Sahara Group has two companies – Sahara India Real Estate Corpn Ltd. (SIRECL) and Sahara Housing Investment Corpn Ltd. (SHICL) – which function outside the economic system of the country facilitating such people for whom the government could not, in the last 67 years, get even a bank account opened. These companies worked among the poor sections of the people and they were encouraged to deposit money. Almost 40 per cent of the country’s population are devoid of any banking facilities and in such a situation if these two Sahara group companies have three crore investors, then the group should be complimented for it. In Bangladesh, Mohammad Yunus founder of the Grameen Bank was felicitated with the Nobel Prize for such work, but in India, the Sahara chief Subrata Roy got jail...

AHARA’S two companies – SIRECL and SHICL – got people like rickshawpullers, vegetable vendors, roadside tea vendors and even pavements dwellers to deposit a small amount of money everyday and if, as and when they needed money, it was provided it to them. If a daughter had to be married, a house had to be constructed, a son had to be educated, some new work or venture had to be started or there was an emergency, whenever they needed money, these companies provided to their needs. No government or financial organisation or any institution in the country had even bothered to reach this segment of people in society. The depositors were local people and there was a bond of trust between the two. It would be understandable if anyone amongst these poor people were to say that Sahara’s companies do not return the money, but if the depositors in the two companies of Sahara have no problems, then what is Sahara boss is being punished for? Is SEBI having a problem with the fact that so many people have been depositing money and without any help from the government they have been getting money on time? That brings up the question once again: why is the Sahara chief Subrata Roy in jail? Did he indulge in fraudulent activities? Did he run away with the investors’ money? Or has there been a complaint from an investor? Sahara claims that in accordance with the Ministry of Cor-

porate Affairs rules, in 2006 it filed returns of 1.98 crore investors on the orders of the Registrar of Companies (ROC). In 2008-09 also Sahara raised money from investors under optionally fully convertible debentures (OFCDs). For this Sahara had taken permission from the ROC, Kanpur for SIRECL and from ROC, Maharashtra, for SHICL. Sahara claims that the books of accounts and returns of these two companies have always been filed before the ROC, which examines their accounts from time to time. In other words, the ROC was doing the work of regulator for these companies. At that time no Governmental agency or SEBI raised any questions. It is worth noting that on April 21, 2010, SEBI had written to the ROC, Regional Director that two OFCD companies, SIRECL and SHICL, are not listed with them, therefore it has no jurisdiction over the activities of these companies. Therefore, whatever action has to be taken will have to be done by the ROC. The question is whether SEBI can demand action against a company by writing a letter to the ROC? It can certainly demand that because such and such a company is not under our jurisdiction, you may take action against it. In addition, documents and court orders show that the jurisdiction over unlisted entities, including those mobilising public money, lies with the Ministry of Corporate Affairs, not SEBI. In a reply to a question in Parliament on 30 April 2010, the Minister of State for Finance,

Sahara chief Subrata Roy Namo Narayan Meena, said while the Government was aware of some instances of misuse of privately placed debentures by some companies, these debentures were regulated only by the Companies Act, 1956 and administered by the Ministry of Corporate Affairs. Moreover, in two separate orders by High Courts, one in Mumbai and another in Kerala, the court has held that SEBI does not have regulatory powers over shares and debentures issued by unlisted companies. But in 2010 itself SEBI performed an about turn. In an affidavit in the Allahabad High Court SEBI said that SIRECL and SHICL come under its area of jurisdiction. Now how can SEBI have it both ways? SEBI should

first clarify which of the two is correct. If the fist statement is correct, why did SEBI change its stand? And, if the later statement is correct, then what is the meaning of the first two statements? Why did SEBI mislead the ROC and Parliament? The question is whether any public institution or regulator can tender one reply in Parliament and a month later give a different, opposite reply in the Supreme Court? The first question stops at this: under whose jurisdiction do the two companies of Sahara fall? Sahara says that the matter falls under the jurisdiction of the ROC, but SEBI says it is the regulator of the two companies, SIRECL and SHICL. However, many of the country’s well known law experts believe that in this controversy SEBI is wrong and Sahara is right. “The Supreme Court even now should institute an SIT…” Former Additional Soliciter general Vikas Singh said the non-baliable warrant against Roy was an unprecedented event. “Sahara has a scheme where it goes to the people to get money. It is about more of trust and less record keeping,” he said. “Today no investor is complaining, the only controversy before the SEBI was if it has jurisdiction over the money taken by Sahara,” he added. In spite of all this, on SEBI’s complaint, Sahara has been punished. The SEBI plea is that if the investors are more than 50 in number, it cannot be called a private investment or enterprise. The question is

whether such a limit has been fixed by law? If with more than 50 investors it no longer remains ‘private’, then in 2006 when Sahara had filed the returns of 1.98 crore investors, why did SEBI not complain or why did no other Government agency ‘catch’ Sahara? Sahara claims that 93 per cent of the money to the investors, i.e. Rs. 23,500 crore has already been paid and all documents relating to this have been submitted to SEBI. Along with Subrata Roy, the directors of the two companies of Sahara have also been sent to jail. After sending them to jail the court put the condition that unless and until Sahara India deposits five thousand crore rupees in cash and gives a bond of five thousand crore rupees of immovable property, till then they will remain in jail. Not only this, from November 2013, all of Sahara’s bank accounts were frozen and a freeze also imposed on sale of properties. This means that you cannot sell your properties, cannot withdraw money from the bank. Then where was the money supposed to come from? Rs. 10,000 crore is not a small amount. Those working for Sahara had to suffer difficulties in getting their salaries. It was only in early June, after keeping them in jail for almost a hundred days, that the Supreme Court lifted the freeze on the group’s moveable and immovable assets so it could raise Rs. 10,000 crore for part repayment to investors. But Subrata Roy still continues to remain in jail. The question is, how justified is it to impose the kind of restrictions that were imposed and on top of that placing the condition of producing such a huge amount as bail? Subrata Roy’s passport was also confiscated. There is great difficulty in understanding why Subrata Roy and two Sahara directors are being punished in this way. One obviously needs excellent knowledge of the law to understand what their crime is.

As soon as Narendra Modi became the Prime Minister, he had asked all his ministers to give him a presentation and put down in it what all they are going to do within 100 days and which direction they are going to take. Yet it is still not clear what plan the Cabinet is making for the 100 days, what plans have been made and on which plan is work is going on. The country knows nothing about the agenda for 100 days because of which an atmosphere of doubt is forming. The doubt is forming because there are problems in the country and the country is thrashing around to get out of those problems and that is why for the first time after 1984 it has elected a government

with a clear majority. Modi had asked the country for this and the people of the country gave him full support with open hands and without any doubt. But even after such support, if prime minister does not share his direction, the work that has to be done and his plans with the public, then doubt is created. Should we now accept that a new form of democracy is about to be unleashed upon us with total stealth and secrecy? The government seems to be worried about rising prices, but inflation does not seem to be stopping anywhere. How can it be that we see rail fares increased by 14.20 per cent and accept that inflation will reduce? How can it be that the rates of petrol and diesel go up every month and we also accept the claims about inflation going down? How can we believe that we do not accept economic policies that generate employment and there will still be employment? How can we accept that the technique which the

OTTINGHAM: Test debutant Stuart Binny scored his first half-century for India to frustrate England's seamers and secure a draw for the visitors in the opening Test at the end of the fifth and final day at Trent Bridge on Sunday. India scored 391 for 9 in 123 overs as the Test ended in a draw. Binny's bowling did not do much to trouble the hosts but he excelled with the willow, hitting strokes all around the wicket in his debut match to effectively erase any hopes England had of forcing a result. If Binny was superb, bowler Bhuvneshwar Kumar showed he is no mug with the bat hitting his second successive fifty with a superb unbeaten effort of 63 as he effectively cocked a snook at the English bowling. The visitors recovered from losing three early wickets in the morning, plus Ravindra Jadeja then falling after lunch, to reach 347 for eight at tea after Binny finally went for 78, with Bhuvneshwar Kumar (31) and Ishant Sharma (5) unbeaten. India had a lead of 308 and with only 31 overs remaining, an England victory in the first of the five-match series seemed highly unlikely. Record entries for Thakkar Badminton UMBAI: A record number of M over 1000 entries have been received for the 3rd Gautam Thakkar Memorial All India Junior Badminton Tournament 2014, hosted by the GTMBA (Gautam Thakkar Memorial Badminton Association) and hosted by Bombay Gymkhana and to be played at their courts from July 14 to 20, 2014. Matches would also be played at the Cricket Club of India (CCI) courts. The prize fund is Rs. 5.0 lacs and additional incentives of Rs. 1.6 lacs will be given as bonus to top ranked shuttlers participating. The tournament is sanctioned by the Badminton Association of India (BAI) and is being jointly organised by the Maharashtra Badminton Association (MBA) and the Greater Mumbai Badminton Association (GMBA)and managed by Evolution Sport. OIMBATORE: Chittesh S Mandody had an outstanding drive as he emerged best in the third and final race in the FB02 category of the JK Racing India Series 2nd round, the feature event of the competition, which concluded at the Kari Motor Speedway, in Coimbatore on Sunday. The Kolhapur driver, starting from pole position, raced like a champion and even the presence of ace drivers Armaan Ebrahim and Aditya Patel did not put any kind of pressure on him as he took the chequered flag well in front of the rest of the field with a timing of 16:53.705. International drivers Armaan and Aditya, both participating as ‘guest drivers’, expectedly finished second and third respectively ahead of Akhil Rabindra and Krishnaraj Mahadik. Akhil was placed second in 17:08.862 and Krishnaraj was third in 17:13.559. RASILIA: Louis van Gaal is hoping he can replicate the team spirit that took the Netherlands to third place at the FIFA World Cup when he arrives at Manchester United. Van Gaal went against the Dutch tradition of playing a 4-3-3 formation and used a 3-5-2 system in Brazil, which made them so strong defensively that they conceded just one goal in their last five matches. Now he hopes his success will "open eyes" at home and make people realise that there are other ways to win matches.

Scolari leaves decision on future to federation B

RASILIA: Luiz Felipe Scolari has left a decision on his future as coach of Brazil to the country's federation after the World Cup hosts' campaign ended in more disappointment. "It is up to the president to decide. We will hand in a final report and then leave it to him to analyse what needs to be done," said Scolari after Brazil lost 3-0 to the Netherlands in the third-place play-off in Brasilia yesterday. "I'm not going to discuss (my future) with you. Winning or losing that is what we would have done." Scolari's contract with the Brazilian Football Confederation (CBF) expires with the end of Brazil's campaign but there have been suggestions that president Jose Maria Marin could persuade him to stay on until the end of the year while a long-term replacement is sought. Julio Cesar accepts Brazil career is over
