“A

lot of thinking goes behind constituting the laws. Laying down laws is not an easy job and when I strongly believe in it, the hitch only occurs in implementation. The laws are implemented differently by different personnel, which is what I have been removed from the various places I have been posted. During my initial posting in Sindhudurg, there was a lot of opaqueness and no transparency. The Right to Information (RTI) Act was introduced in Maharashtra in 2002, I introduced

In the mid-90’s just like any other aspirant, Mahesh Zagade kick started his career as the CEO of the Zilla Parishad in Sindhudurg and has not looked back since then. Awarded the ‘No Tobacco Day’ award by WHO, he went on to become the Municipal Commissioner of Pune before taking over the Food and Drug Administration (FDA) as Commissioner and is now the Transport Commissioner, which means Zagade has come a long way. He introduced the concept of signal free traffic halts in Pune. Introducing major reforms in Sindhudurg, Nashik and Pune and strongly believing in the implementation of law have been key factors in Zagade’s journey. Mahesh Zagade interacts with Aroosa Ahmed and reveals his bouncy yet eventful journey. He talks about the current transport situation in Maharashtra. the RTI concept in Sindhudurg in the year 1998. A calender was introduced wherein officials had to do all the activity in the given time frame and if the task was not completed, action would be taken against them” Zagade, who is an IAS officer has also worked as the Collector of Nashik; he believes slums are created because of the failure of administration and due to illegal construction. “Revenue laws were 'on holiday' in Nashik, illegal construction, unscruplous landholders, private limited companies holding land and people capturing land in violation of law was common. I started implementing the revenue laws; it was a struggle initially but the laws were implemented in degrees and action was taken against the illegal holders.” Zagade is also known for his disaster prevention in the 2006 floods, the floods which had devastated Mumbai, did not take a single life in Nashik, “It had taken two days for the rains to reach Nashik once it hit

Mumbai. I reduced the water levels of the major dams and reservoirs, there was resistance from the irrigation department because the schedule is decided in Mantralaya. However, I convinced the department and opened the valves and allowed the water to flow into the agricultural fields. The rains in Nashik were scary and the city had not witnessed such rainfall in 60 years, but since there was little water in the dams, the water got collected in the dams and reservoirs and it did not turn out to be a big disaster.” Zagade, who served as the Municipal Commissioner of Pune before being transferred as FDA Commissioner, noted that laws were not implemented properly and in order to make Pune one of the top 100 liveable cities of the world, it required good financial inputs. However, there was lack of financial inputs and there existed leakages which were difficult to mend. He began implementing laws and the concept of signal free

city in Pune, after which he was transferred as the Food and Drug Administration (FDA) Commissioner. Soon after taking charge as the FDA Commissioner, Zagade discovered that the laws which were implemented six decades back were not being followed and the authorities were playing with the lives of ordinary citizens. “The FDA, license holder and their associations were only in the picture, the citizens were missing. The irony was from the time you get up and use toothpaste till the time you hit the bed, everything is controlled by these people, who did not include citizens. I commenced with issuing licenses to every food vendor and in a span of two years, seven lakh registrations and licenses were done in Maharashtra, which constituted 27 per cent of licenses of the country was issued in Maharashtra only.” Zagade, in his tenture as the FDA Commissioner had cancelled more than 3,000 licenses because the chemists were selling medicine

without recruiting full time pharmacists. He played a major role in implementing the ban on gutka and paan masala, wheein gutka and paan masala worth Rs.36 crore was seized. Zagade had taken action against Johnson & Johnson. “Johnson & Johnson had licence to manufacture baby powder at Mulund plant. The company was following the process of steam sterilization. During tnternal investigations in 2007, the company found that some of the batches had very high-micro flora and therefore the company decided to sterilize those batches again. However, the baby powder was packed in the containers, The company decided to sterilize with ethylene oxide for which the standard operating process was not submitted to FDA. Johnson & Johnson should have strictly followed stipulated norms.” His anti-corrupt nature and implementing the laws led to his departure from FDA after completing

three years . Zagade, who is now the Transport Commissioner has directed the officials and the Regional Transport Offices (RTO) to eradicate corruption from the RTOs. “I have directed my men and made it clear to them that we only exist for reasons like making sure that the citizens spend minimum time on road and maximum time with their loved ones and making sure the vehicles are mechanically fit so that congestion does not happen. Providing quality drivers is a responsibility of the RTO as it issues licenses. This is where corruption happens, and it will stop by the implementation of the law in 360 degrees.” When asked about the overloading of trucks and tankers and the clearance by the toll nakas he said, “Trucks and tankers are overloaded and get cleared by the toll nakas is a clear indication of corruption. The overloaded trucks is a major reason for loss of lives, I will not compromise on human safety, anything which comes in my way to ensure safe travel for the citizens will be removed. I have given the RTOs one month's time to remove the touts from the place and if this is not done in the time frame, I will take action against the territorial officer. Working along with Anti-Corruption Department, like I have done in the past will be helpful in eradicating corruption from the department.” Zagade plans to make use of technology for providing seamless travel for the commuters, “There is technology available which will be used such as bringing in Radio Frequency Identification Device (RFID) and installing GPS in the taxi and autorickshaw metres will be very helpful.” The use of RFID system will not only clarify the difference between legal and illegal auto rickshaws and taxis, it will also give access only to authorised autorickshaws and taxis to get CNG from the pumps. The after effects of not being corrupt and using laws for busting rackets has been rough. Zagade has been humiliated, targeted, abused personally, on the internet, blogs and in print media. He also has been threatened, warned of dire consequences, including encounter. Despite all this, his ideology and methodology of working does not change. “I will continue to function the way I do and will eradicate corruption from any department I'm posted in,” Zagade concluded.

The diamond story

New findings have revealed long unknown details about how carbon deep beneath the Earth’s surface is helping diamond formation in the Earth’s mantle. The new theoretical model called the 'Deep Earth Water' model allowed researchers to determine the chemical makeup of fluids in the Earth’s mantle, expelled from descending tectonic plates. "These mantle fluids with dissolved organic carbon species could be creating diamonds in a previously unknown way," experts say. The Johns Hopkins University-led team in the US found that some of the fluids at 100 miles below the Earth’s surface contained the expected carbon dioxide and methane. But others, those in equilibrium with diamonds, contained dissolved organic carbon species including a vinegar-like acetic acid. The article was published in the journal Nature Geoscience.

ohsen Makhmabal an eminent filmmaker from Iran is here in the ongoing international Film Festival of India, Goa 2014 to represent an 8-film package in the retrospective section. He was accompanied by his wife Marzieh Meshkini. Wellknown director Shaji Karun gave a brief introduction of Mohsen Makhmalbaf stating that Makhmalbaf was the best filmmaker of Iran whose film-making ideas are immense. In fact his entire body of work reflects his whole gamut of technical expertise. Mohsen Makhmalbaf’s opening statement was, “I love India and the next thing I really love about India is its colourful hoardings spread in every nook and corner and more specially its Bollywood films' hoardings which are like a constant celebration of Indian cinema.” He further feels that, “The basic human emotions of one

A 21-year-old youth has been arrested for his involvement in the crime, the police said. Hours after the girl mysteriously disappeared from the compound of her building in Nalasopara (East), the toddler was found near Virar railway station with injuries on her private parts on Thursday night. It was revealed that the girl had been sexually

abused and abandoned near the Virar railway station when passersby rushed her to the nearby Primary Health Center from where she was shifted to a Kandivli-based hospital. The accused had entered the building in search of a job of watchman, when he spotted and lured the girl away with a chocolate, the police said. On the basis of CCTV footage and mobile surveillance, the police nabbed the accused from Boisar. The accused has confessed to the crime and has been booked under section 376 of the IPC and under relevant sections of the Protection of Children from Sexual Offences Act, 2012. The MUST RUN Marathon will be a 21 km half marathon to be held in Bandra. Neenu Kewlani, activist and volunteer for Nina Foundation, Able Disable All People Together (ADAPT), and Skuriti Foundation feels that differently-abled don't get equal treatment. Speaking to the ADC she said, “There are many differently-abled who are interested in the marathon and will be taking part in it. Many have approached us for it, I'm happy that the differently-abled will be taking part in the marathon. As far as the facilities for differently-abled are concerned, it's not sufficient, almost nil, and it's necessary to raise awareness for the same. hile the Mumbai University (MU) is constructing various buildings for its various hostels and is using nano-technology at its Kalina Campus, most of the land in the campus is not being used constructively. Though the MU had established a tennis court, swimming pool, a basketball court and a sports complex, the facilities are not being used due to them being in a 'pathetic' state. This barren condition at the Kalina Campus, has forced the students to enroll in private sporting clubs side-tracking the University facilities. In 2007, former Vice-Chancellor Dr. Vijay Khole established the Sports Complex with an aim to provide students with requirements for sports and also to start teaching courses related to sports such as Bachelors of Physical Education and Masters of Physical Education. This sports complex consists of an indoor stadium with classrooms for the Physical Education courses. The swimming pool, tennis court and basket ball court are outside the sports complex, which are attached to the open playground of the complex. The ADC when visited the sports complex, experienced a shocker with the tennis court, basket ball court being barren and the swimming pool which lacked water having a plastic covering. This sports complex also has a water pond having stagnant water, which could be breeding ground for 'carriers' of infectious disease. No wonder then

T looks like both the Bharatiya Janata Party (BJP) and the Shiv Sena do not want to give up trying to come together again. The drama does not seem to have an end. Only yesterday, news spread like wild fire that the BJP is making a big bid to get Sena support. There was definite news that the BJP and the Sena will work together. The TV channels carried big headlines that negotiations between the parties have been successful and the Shiv Sena will be in the government. Chief Minister Devendra Fadnavis went to Nagpur, met BJP’s senior leader Nitin Gadkari and held talks with him. We do not know what exactly happened between the two leaders, but most probably they discussed about a Sena-BJP alliance. And then comes a bombshell from a Shiv Sena leader there is no question of any change and that his party is not joining the government but will sit in the Opposition. He said “Our party is in the Opposition. We will take on the government on various issues when the State Assembly meets next month for Winter Session in Nagpur.” Meanwhile, Sena leader Uddhav Thackeray has left Mumbai and has gone to Malegaon. The situation is as confusing as before. It is likely to be the same till the Assembly meets in December. The natural, traditional allies do not agree on many crucial issues.

T is expected that the mainline politicians would pay scant heed to the growing ambitions of the Muslim-centric rather Muslim-only parties to spread their wings far away from their traditional pocket-boroughs. But others in the business of studying developing trends in the social and political spheres ought to have taken note of the slow but certain rise of people like Asaduddin Owaisi and Badruddin Ajmal, who front two of the most potent challenges to the non-denominational politics of the country. People with long memories would not fail to be disturbed by recent reports that the Owaisi family-owned Majlis-e-Ittehadul Muslimeen and perfume king Ajmal’s All India United Democratic Front are now keen to acquire a wider electoral footprint. Both parties have set their sights on the 2016 Assembly poll in West Bengal. And have stepped up their activities in Uttar Pradesh with an eye on the Assembly poll in 2017. The reason why Owaisi has stepped out of the inner Muslim ghettos around Hyderabad’s Charminar is shrouded in mystery. But it is amply clear that he now espies percentage in hoisting the MIM flag wherever there is a concentration of his co-religionists. His major foray outside his home-base resulted in the party winning two seats in the recent Maharashtra Assembly poll. Both winners, predictably Muslims, won with huge majorities in the Muslim-dominated constituencies. For the record, Owaisi protests that the MIM had fielded even non-Muslim candidates, but such tokenism does not take a weebit from its Islam-centric character. In fact, Owaisi and his vile-tongued younger brother, Akbaruddin, hammered hard the ‘Islam-isin-danger’ theme at all their campaign rallies. Dangerously, that line of argument won them instant converts among Muslim voters. Given the sheer disgust of the Muslim voter with the so-called secular parties, there can be no denying that he is searching for a new platform. After the long but unrequited love affair with the Congress, he tried various regional outfits, be it in UP or Andhra Pradesh, Bihar or West Bengal. But all these one-leader parties too left the Muslim voter underwhelmed, consequently further fuelling the disillusion that they treated him merely as a bonded, no-choice voter at election time, to be shunned afterwards. Admittedly, the rise of the BJP on the national stage has further sharpened the sense of grievance and insecurity among a majority of Muslims. Though, so far, nothing has been done by the central or state governments run by the party to aggravate that sense of alienation, the in-your-face interventions in the public sphere by the RSS and its various offshoots have contributed to the sense of unease felt by the minorities. Maybe a dialogue between the Sangh Parivar and the leaders of the Muslim community will help address various grievances, real or imaginary, the two sides harbour against each other. At the very least, an active line of communication between the two communities will help check wild misconceptions and help bridge the trust gap. Such a détente can partially neutralize the viciousness of the Owaisi brothers and slow their onward march towards winning the Muslim voter through divisive propaganda. The rise of Owaisi’s MIM and Ajmal’s AIUDF might spell trouble for the traditional thekedars’ of the Muslim vote, such as the Congress and the Samajwadis, Trinamool Congress etc., for example, but eventually it will end up fraying the social fabric of the entire country. The initial, casual approach of the Congress leadership to the rise of the Muslim League beginning in the early decades of the 20th century should hold its own lessons for the present-day leaderships

of the national parties. Times may have changed, the context and circumstances might be entirely different, but what remains unchanged is the grip of religion on a section of the population. If anything, it has got stronger as unholy men have come to the fore as headmen of their communities. Besides, as against the early 20th century, the petro-dollar-driven Wahhabism is now a potent force dictating the actions and beliefs of the ulema as well as ordinary Muslims. In West Bengal, where Mamata Banerjee panders to the Islamic extremists in the hope of a guaranteed second term in power, the decision by the Owaisis and Ajmal to contest the next Assembly poll might in the short run aid the BJP’s growth. But, then, the real and longterm agenda of the Muslim-centric parties is not to defeat the BJP, but to carve a new and exclusive sphere for themselves where they will reign in the name of Islam. These are early signs of a potentially separatist movement which our politicians can ignore only at

Following an adverse report by the income tax authorities, the government might soon initiate the process for a presidential reference for the removal of Singh. One shudders to think of the role someone like Singh might be playing in the selection of the future rulers of India.

The heads of the Central Bureau of Investigation, the Central Intelligence Bureau and the Research and Analysis Wing are set to retire soon. All these are important posts whose holders often influence the course of Indian politics, as was evident during the ten-year UPA rule. The CBI chief, Ranjit Sinha, derisively called kala tota by some of his colleagues for his black deeds and the apex court’s description of the investigating agency as a caged

The details that have come out of the sensational arrest of Rampal leave no doubt that his empire has been built over the years for all alleged activities for which another mega-godman is being tried at present. While spiritual leaders trying to show the public how to lead a righteous life are welcome, the liberal use of the prefix 'baba' by all and sundry needs to be first curbed. For instance Christianity does not allow a person to be called a 'Saint' so easily and that is how it should be. SOME godmen and religious cult leaders often have an exaggerated sense of their own importance: they sometimes end up believing what they tell their fanatic followers. On whether the government is looking at doing away with the Public Distribution System, Jaitley said the Expenditure Management Commission would suggest ways to streamline them. Following the Budget announcement, the Finance Ministry set up the Expenditure Management Commission, headed by Bimal Jalan, to suggest ways to reduce food, fertiliser and oil subsidies and narrow the fiscal deficit. In the current fiscal, the deficit is expected to be 4.1 per cent of GDP this financial year, down from 4.5 per cent a year ago.

At least seven persons, including two women, were killed and nine injured when a private bus fell into a gorge at Haripur Dhar-Solan road in Himachal Pradesh on Sunday. EW DELHI: A reduction of the scope of subsidies currently being provided to welloff people appears to be on the anvil with Finance Minister Arun Jaitley questioning the justification of 'unquantified' subsidy amounts to 'unidentifiable' sections. However, he maintained that some element of subsidy will have to remain for a large section who are entitled to it since the country has lot of poor people who need state support. "Yesterday, I had said why should people like you and me get an LPG subsidy and look at the kind of burden it is having on the budget. We have started living with the deficit budget. We just make sure that our fiscal deficit is not beyond a particular point," he said at an interaction with PTI journalists at the agency's headquarters. Some element of subsidy, he said, would always be required because there were lot of poor people who need support. "But then you cannot have such sections enjoying the benefit who are not entitled to," he added. Under the current dispensation, the Minister said the government targets a specific number for deficit and in turn borrows from the market to fund current expenditure. "You cannot have a subsidy, an

At what point had you given a thought to making a career in the stock markets? I was always fascinated by the financial markets right from a very young age. I was barely 14 years old and in my ninth standard, when I used to learn and assist my father in filling up IPO forms. My father is an avid investor. I was raring to go, but was a minor and hence not allowed!

How do you pick your investments? Do you use technical analysis, or do you employ fundamental data? I am purely into fundamentals. I believe in the Warren buffet Style of investing. He uses a terminology called the “Economic moat�. The moat is "something that gives a company a clear advantage over others and protects it against incursions from the competition." How would you describe your methodology? I buy businesses that have a more sustainable and durable competitive advantage. By having a well-known

We strongly believe that we are in the midst of a strong structural bull run, which can last for at least another 5 years. With a conducive economic scenario, macroeconomic fundamentals bottoming out, with a stable and strong government, we will see earnings growth and PE re-ratings upwards, building a case like never before for the market to reach uncharted territories. If earnings conservatively grow at a CAGR of 15 % in the next five years, you can imagine where the indices will reach!! Instead of seeking tips and multi-bagger ideas, ask for sound investment and portfolio advice.

What is your take on the current market scenario, Indian as well as global? India is in an enviable position. Markets will be on an upward trajectory on the back of improved earnings growth, PE rerating, renewed vigor shown by the government to initiate reforms, lower crude prices, lower inflation and supportive global cues and decent earnings.

While the Nifty closed just short of the 8500 points level, the Sensex closed above the 28000 points level throughout the week. However, the market is likely to be volatile this week. The Current Account Deficit (CAD) figures for the September quarter will be announced today, while the (F&O) futures & options expiry, coupled with the September quarter GDP data, which will be announced on Friday November 28 may influence the trend. The RBI meet on December 2 will also weigh on the minds of the market players. Last week the sectors that gained the most were public sector banks, capital goods, infra, auto and FMCG stocks. Positive global cues led by comments from European Central Bank (ECB) President Mario Draghi raised expectations for aggressive quantitative easing measures from the ECB going ahead. The upcoming Winter session in which reforms bills are expected to be tabled and passed along with the merger of Kotak Mahindra and ING Vysya led the bullish sentiment. “Nifty scaled new highs and was led by banking stocks. RBI lifting FII restriction of share purchase of Yes bank, Kotak Mahindra acquisition of ING Vysya, SBI stock split and strength in Rupee together lifted Bank Nifty. Anticipation of GST bill implementation also led to positive sentiment. Globally, Asian provided positive sentiment after China’s central bank’s announcement of $8.17 infusion in its economy, Japan’s snap elections and service tax hike delay,

US jobless claims falling and inflation remaining stable,” said Kiran Kumar Kavikondala Director & CEO, WealthRays Securities said. “Markets ended the week on a high. Supportive global cues, expectations of improvement in growth rates and expectations of an early interest rate cut, kept sentiments positive. Banking stocks were the major gainers for the day. We expect markets to remain focused on the upcoming RBI meeting on December 2. Any dovish signal from the RBI will buoy sentiments within the economy and lead to further improvement at the ground level. The markets will react positively to the same, we believe,” said Dipen Shah, Head- Private Client Group Research, Kotak Securities. "The equity markets were seen rejoicing last Friday. This indicates that investors are hopeful for the announcement of new reforms in the upcoming winter session of parliament, which begins next week. However, lack of broader participation in the rally made the stock selection difficult for the traders. We believe this upward would continue but broader participation is required to regain the momentum. If you are investing Rs. 2 lakhs, instead of risking the entire amount by investing in equity fund you may invest in debt fund under STP plan in which Rs. 2 lakhs would be invested in a debt fund and you would specify the amount of Rs. 1000 or Rs. 2000 to be transferred every month on a pre-determined date into a equity fund. This will help investors with comparatively lower risk – appetite to take advantage of returns in equity fund. Either one could choose a specific amount exclusively where amount will be transferred to another fund only when total value of investment in the fund

for a bull run, then SIP would give better returns as compared to STP. If investors are ready to take risk, then STP can be used in the reverse way during a bull run, where you invest lumpsum in equity fund and profits can be chosen as STP amount that goes into debt fund. But this could be risky as retail investors will not have enough tools or resources in terms of time and knowledge to identify the end of a bull run. Systematic withdrawal plan (SWP) helps investors to redeem certain amount from mutual funds at regular intervals on a pre-determined date. Here, redeemed amount will be transferred to investor’s bank account. This acts as regular earnings on a monthly or quarterly basis especially post retirement. Choose SIP, STP and SWP as per your requirement to enjoy optimum benefit from each of these options.

fter a long time, we saw the Dollar/Rupee cross the 62.00 handle, but could not sustain as alleged central bank offers coupled with exporter and FII sell interest pushed it down towards 61.78 levels on spot. We have argued in the past that the yen carry flows and other forms of financial flows that are heading into the Indian financial markets, will make it difficult for the Rupee to depreciate in a straight line. We have heard that the demand for reserves from the central bank tends to extinguish above the 62.00 handle and could be another reason why USD/INR is unable to sustain beyond that level. India's external merchandise trade data had little to cheer about.

Imports rose 3.62% in October to USD 39.45 bn. Oil imports contracted by around 19%, not a surprise, as global crude oil prices had fallen by nearly a fifth in that month. Import of bullion metals rose by nearly 280% at USD 4.1 bn. Non-oil and non-bullion imports, an indicator of domestic consumption and investment demand, rose by nearly 6% at USD 22.98 bn. However, exports contracted by 5.04% to USD 26.09 bn in October from USD 27.48 bn a year earlier. On a month on month basis, exports contracted by over 9%. The fall in exports, was the first this financial year. The decline was primarily due to fall in exports of major export items such as engineering goods, drugs and pharmaceuticals and gems, petroleum products and jewellery. One can argue that the contraction in exports of petroleum goods was on account of plunge in petroleum prices but that argument does not explain the broad based contraction in exports of other goods. Trade deficit for October rose to USD 13.35 bn from USD 10.59 bn in October 2013. In September this year, it had widened to USD 14.25 bn. Total exports in the April-October 2014 period, at USD 189.79 bn, were 4.72% higher than in the corre-

sponding period of the previous fiscal year. The cumulative value of imports for the April-October period was USD 273.55 bn, 1.86% higher than imports in the same period last year. The trade deficit during this period was at USD 83.75 bn, lower than the deficit of USD 87.31 bn in April-October 2013. Global markets were in a jubilant mood as two major central banks offered liquidity and promise of more liquidity in the future. Chinese central bank reduced its benchmark oneyear loan rate by 0.4 percentage point to 5.6%, marking the first interest-rate cut since July 2012. The PBOC also reduced the benchmark one-year deposit rate to 2.75% from 3% but gave banks greater flexibility to raise deposit rates above that benchmark. Over the past one year as Chinese economy has been facing the twin menace of slowing growth

and mounting debt. At the producer level, prices have been in deflationary zone for the last so many months. A combination of high debt and deflation is a dangerous cocktail that can swallow any economy. For China, the leverage in the private sector as well as in the government owned enterprises are backed by assets which have become unproductive or idled in the wake of slowing global economy. Such a mix of adverse forces is now slowing growth and making the debt gradually unserviceable. Last week, global economic data releases had more hits than misses. US economic performance showed improvement. However, we would expect a slowdown in the final quarter of this year, if the winter continues to harsher than normal. economic surveys for the month of November were better than estimates but industrial production for last month contracted by 0.1% m/m. In Japan, PM Shinzo Abe announced snap elections in December and also deferred tax hike. Japanese PM also promised fiscal stimulus to boost economic growth. Japan entered into recession in third quarter as domestic demand has been hit by a one two punch of hike in sales tax and weak Yen. We had in the past argued that weak Yen policy can have adverse impact on Japanese consumers, as cost of imported goods move up. Incase Shinzo Abe is able to secure a strong mandate in the December elections, then we can expect a stimulus package to be announced in January-February of 2015, leading to a sharp boost in GDP during the first half of 2015. Over the next week, traders will keep a close eye on the Q2F15 current account data from India, where the current account deficit is expected to increase from the USD 8 bn it registered during Q1FY15. Indian Rupee is expected to trade within a range of 61.40/50 and 61.90/62.00 on spot. However, Rupee can remain a candidate for buy on dips against the Euro, Pound and Yen.

Scams, controversies, rumblings about delayed projects, agitations by consumers and debates about the over/under-regulation of the real estate sector have all provided ready cannon fodder for countless publications, internet forums and assorted activists. In fact, the real estate sector has drawn more media flak and outrage than any other industry in India. ANUJ PURI

his tempts the question – why is Indian real estate a sector that everyone loves to hate? It is a valid question, and one that many corporate heads, industrialists and big-ticket investors have asked me during my business travels abroad. The question – or variants of it is sometimes asked in an amused and otherwise unconcerned manner, but more often with real interest tinged with worry. After all, almost everyone with a healthy investor instinct has or intends to have a piece of the massive Indian growth story, and any kind of participation in it invariably involves real estate. There is no easy answer to this question, which is in any case a rather unfair one to begin with. Nevertheless, the generalized negativity about the Indian real estate sector that has been created in the public mind is a reality. I usually counter the question with another question – “What have you read or heard about it that makes you think so?” My intention is not to be evasive, but to understand whether the question comes from a real understanding of the Indian real estate industry and its complexities, or whether it just a knee-jerk reaction to yet another hyped-up media report. Very often, the questioner is genuinely informed and has been following media stories about the sector quite closely, but no longer knows what to believe. This is understandable, and I invariably ask my questioners if they have enough time for a detailed answer. After all, this confusion is the result of a war of opinion that has been waged against the Indian real estate sector for quite a while. The controversy is made even more complex by the fact that it is being actively encouraged by people who have no interest in presenting a more realistic picture of the Indian real estate industry.

WHAT LIES BENEATH

it is considered the most important manifestation of success, wealth and power. Unfortunately, the fact that real estate transmits such signals in India has made it an object of not only admiration and desire, but also of something close to fear. While fear is invariably the result of a lack of understanding, it is nonetheless a very real force on the ground. Naturally, any environment involving fear also needs villains. It is almost axiomatic that Indian real estate developers are the designated ‘bad guys’ – the greedy perpetrators of crimes against the helpless common man, wielding their wealth and political clout with impunity, with the sole intention of turning a profit and furthering their own agenda. Such a stage-setting lends itself rather well to a protracted public drama involving the tantalizing element of good battling evil; of victims versus perpetrators. The epic battle of the Mahabharata, as it were, translated into present-day brick and mortar. Such a drama is readily absorbed by Indians almost by default, but is more damaging is the fact that it is also exotically interesting to foreign palates. Market watchers in countries that India has or is seeking to have economic ties cannot but notice the bad press that Indian real estate is getting. This is how the unfair and wildly inaccurate blacks and whites of the Indian condition as depicted by ‘Slumdog Millionaire’, become superimposed on an industry which is - if fact be told - the backbone of the country’s economy. If we take a closer look at Indian real estate today, there is no escaping how important it is: The Indian real estate sector generates employment for about 7.6 million people across the country last year Real estate is the most single-important consideration for any foreign company eyeing Indian shores to launch operations and create countless more jobs Real estate’s overall contribution to India’s GDP was estimated at about 6% in 2013 Real estate constantly cross-fertilizes other industries like cement, steel, paint, chemicals, tiles, fixtures and fittings The scams that have so seriously impacted the image and credibility of Indian real estate in the past were not the result of a unified developer nexus, but the work of individual players whose crimes have now been attributed to the industry at large. Should we not also consider how some of India’s biggest real estate developers took incredible risks to open up entire new cities to add to the country’s growth? The urbanization that is the focal point of India’s economic growth hinges on the growth of its cities, and therefore on the products that real estate developers deliver. Wherever we see new cities rise from obscurity into promi-

innumerable projects and added to overall development costs by about 15%, including the fungible premium builders had to pay for the additional 35% FSI option. The fact that this resulted in a cumulative 20% hike in construction cost and led to price increases across most projects in MMR is just one aspect of the story. The other fallout was that developers had to re-work the specifications of their upcoming as well as on-going unapproved projects, which led to significant project delays. Apart from an exacerbated cash-crunch, developers also had to contend with the ire of their buyers. Likewise, while certain instances of faulty land acquisition or title disputes are endemic to fly-by-night operators, it is also true that cases such as in the Noida Extension, land acquisition issues have been legally established to be the fault of the involved authorities. But as always, the blame has been conveniently laid at the feet of a vaguelydefined builder nexus.

REAL ESTATE SECTOR IS CHANGING

nence, there are developers restructuring skylines, building homes for population and office spaces for them to work in. No Indian’s heart can help but swell with pride as they perceive a city like Mumbai, Gurgaon or Bangalore from the air as their planes prepare to land there. What gorgeous evidence of progress is displayed in the tapestry of skyscrapers jostling each other for space, road networks spreading out to connect new areas to existing ones, and office and manufacturing complexes providing the economic nerve-centres. This is the work of real estate developers, but their contributions towards weaving the very fabric of our cities is overshadowed by the specter of antipathy that has been generated against the entire real estate sector. We must try to understand the basis for this antipathy before we can explain it. At the end of the day, real estate is a business like any other, and no industry can claim to be free of flaws and anomalies. Almost every day, we hear about delayed projects, deviations from project quality and configurations, and additional payments being charged for changes in apartment areas. We read about how real estate is the first port of call for politicians looking to off-load their unaccounted funds, about developers who have launched projects on land which has not been cleared for development, and how others have been pulled up for flouting FSI and environmental norms.

Such things do occur, and the developers who practice business in such a manner must be held responsible and brought to book. However, these developers do not represent the industry as a whole – they are anomalies that must be eradicated, not symptoms of an industry-spanning pandemic of manipulation and wrongdoing.

A CLOSER LOOK AT PROJECT DELAYS

Most of the extensively-reported incidents of delayed project completion are often not the result of malpractice, but of a flawed regulatory environment. It is true that some unscrupulous smaller developers intentionally undertake a slower pace of construction if sales in the project are sluggish or a larger part of the project is unsold. However, in most of the cases being touted as evidence of a corrupt industry, delays have happened because the authorities have not granted timely approvals and the morass of bureaucratic red tape that developers have to navigate for every project. Before a project is officially launched on the market and offered to buyers, there are myriad permissions that a developer needs to obtain from the state and central agencies and ministries. This does not only lead to delays, but also cost escalations. Like in any other business, the longer raw material is held, the higher is the holding cost – which, in addition to interest costs in case of borrowed funds, causes an

increase in the overall price of the finished product. In real estate, land is the basic raw material for development, with construction materials being the variable costs. The longer a developer has to hold his land without getting any receipts through the sale of proposed apartments, the higher his project costs escalate. The time consumed in obtaining all approvals adds to the total time expended in completing and delivering the project as per the promised times. Obtaining the 57-odd permissions to begin construction of a project can take as much as two years. During this time, the cost of acquisition or even just holding the land for a project rises. Builders already have to cover external and internal development charges, license costs and often charges for change of land use from various departments, which have also risen. Cost of construction has gone up by more than 35%, as well. Again, if we consider changes in the apartment area or unexpected price increases after consumers have purchased properties from a developer, these too often occur because changes in project plans were required by the authorities before they issue an approval. There are many examples of how abrupt changes in regulations governing real estate development have worked against both developers and real estate buyers. To cite just one – a couple of years ago, there were revisions made in the DCR regulations for the Mumbai Metropolitan Region which simultaneously road-blocked

The ugly caricature of Indian real estate as an industry controlled by corrupt despots is naive, hopelessly outdated and extremely damaging to the country’s global image as a thriving economic dynamo. The fly-by-night players who were responsible for this image are still around, but their ranks are rapidly decreasing. In the meantime, it makes absolutely no sense to paint every real estate developer with the same brush. Most large listed real estate developers in India today have wholeheartedly embraced the mantra of complete transparency. They are selling their products on the basis of declared carpet area, firmly refuse any hint of black money monies as part of their sales transactions, and do everything in their power to deliver their products on time. They are also fighting hard to correct the structural deficiencies of the overall regulatory system – not only because their businesses are suffering on account of conflicting rules and regulations, but because they are being held accountable for factors which are beyond their control. They take their roles as industry stakeholders very seriously, and are among the loudest voices in the outcry for positive change at a policy and regulatory level. Common to all these players is a vision of Indian real estate as a level playing field in which the business of real estate development and consumption can be carried out in a rational, transparent and uniformly beneficial manner. This is a long and detailed counter-argument to offer to a simple question – why does everyone love to hate Indian real estate? And for this reason, I only answer it if the question comes from someone who is willing to accept a balanced response, no matter how long it takes to give.

Pre-existing diseases are excluded from these insurances. Some of the key coverages one should be looking for in a Student Insurance policy are as follows... Contents Insurance: A student today will invariably be travelling with at least his/her mobile phone and laptop. Hence, it makes sense to take insurance that provides coverage for valuables. Some policies have a property and casualty feature, which ensures that you are reimbursed even if your valuables are stolen or damaged during the course of the trip. Personal Liability Feature: When you are travelling abroad, there are bound to be cultural differences. You would not want to get into a legal bind as a result, but you can at least be prepared for such a contingency. If you

shop around a little, you might even find Travel Insurance policies for students that throw in the personal liability component free of cost. Medical Coverage: Whether you are travelling for a few weeks or a few years, there is no avoiding medical coverage. Having to go to a foreign hospital can massively dent your limited finances. So instead of wishing for great health for the duration of your travel, make sure that your travel insurance provides adequate medical coverage. Study Interruption Component: An overseas degree never comes cheap. So, it makes sense to purchase travel insurance that will provide coverage in case your studies are interrupted due to some unforeseen factor. While buying a Student Travel Insurance policy, one should ensure that the policy is accepted by the overseas university he/she is applying to. Also, students travelling abroad and their parents must know what is typically covered and what is not in the plan that they are selecting for their children.

E-Commerce Needs More Regulation

onsumer confidence to shop online will continue to rise and India will have 100 million online shoppers by 2016. This was revealed by Google last week, in its annual online shopping growth trends report, compiled by combining extensive research conducted by Forrester Consulting and Google search trends. The report revealed that India’s e-tailing market is at an inflection point and will see rapid growth to become a $15 billion or over Rs 90,000 crore market by 2016. Well, thats the good news.But if the debacle of Fliplarts one day sale on October 6, is anything to go by, than clearly our house is not in order. Considering that it is the 'biggest and best name' in the business and yet it floundered is something that raises concern for the future of the industry. That Flipkart, so we learn, has resolved every consumer grievance and was hugely apologetic also provides some relief. But that was not the end of it. Perhaps, it was the huge media and public uproar as also the intervention of Minister of State for Finance and Corporate Affairs .Nirmala Sitharaman's intervention or else it was simply Flipkart's effort to keep its credibility at stake that brought about an ammicable resolution to the issue.

But what about the johnnys'-come-lately? Today, many a companies big and small are flocking the eCommerce space. Not much regulation is required and almost anybody can use the online route to sell wares or services.No attention is being paid to the “fly by night' operators who could creep into the system, and this is where the danger lies. While e-commerce in India is also required to be conducted in a legally permissible manner and the information technology act 2000 (IT Act 2000) prescribes stringent penal and pecuniary penalties for violation of its provisions during e-commerce transactions, this is not sufficient. It focusses on fraud as a crime. It focusses on other laws that govern general businesses. But what about consumer protection? What if the transaction is legally, clean and does not amount to a crime, but a consumer is short changed through defective goods orservices or through overcharging? Then the only recourse is the Consumer Protection Act, 1986 that has to be pursued through Consumer Disputes Redressal Agencies. And that in India is a cumbersome and often dissappointing solution. The lenthy and time consuming processes results in many an unfortunate consumer giving up on his rights and writing of his loss as an act of fate. And herein lies the catch. Fraudsters know that they can play it safe within the periphery of the law. 'Short change, don't cheat and get away with it' would be their route to easy money. And this is where the government needs to pay attention. Else geniune businesses reputations as also the sector as a whole will suffer, as will the Indian consumer. Nifty Scales New Peak NSE India : CNX Nifty — Daily Market Report for: Monday (November 24, 2014) By Dominic Rebello

REVIEW OF THE PREVIOUS DAY:

The Nifty rose substantially on Friday (November 23, 2014) a net 75.45 points (0.90%) and closed at the 8477 point level. The market opened up with a gap at the 8408 points level. It then declined and registered the day’s low at the 8398 points level at 9.28 a.m. The index then rose sharply and turned into a range bound movement until 2.15 p.m. It then rose further and registered the day’s high at the 8489 points level at 2.36 p.m. and then turned into a range bound movement until closing at the day. The Nifty moved in a range of 91 points and closed above the psychologically important 8450 points level. Sentiment was bullish and amongst the 50 Nifty stocks 36 were gainers, while 14 stocks closed in the red. Substantial buying was witnessed in banking and capital goods stocks. TECHNICAL ANALYSIS: Volume: Volume (Qty shares) increased 0.30%. This change is small and indicates a moderate participation by investors.

Market Breadth: Overall Market Breadth on the NSE was negative. Amongst all the traded stocks, 629 were gainers, 873 were losers and 42 remained unchanged.

Slow Stochastic Indicator: The Slow Stochastic Oscillator is in the over-bought zone. The Slow K line in the Stochastic Oscillator is below the slow D line (neutral if it continues). RSI Indicator: The RSI is above the 60 level and is now rising (positive if it continues).

MACD Indicator: The MACD is above zero and is rising (positive if it continues). It is above its 9-day Average (positive).

Overall Market Strength/Weakness: The indicators and oscillators discussed here are indicating a strong market with a positive bias. Support Levels: For short-term traders the immediate main support is at the 8144 points level. The next support is at the 8026 points level.

Resistance Levels: The immediate main resistance is at the 8496 points level. The next resistance is at the 8538 points level. Pivot Point Analysis: For intra-day traders the support and resistance levels are calculated according to the pivot point theory and are: Pivot point = 8455 (This is the level where the trend is likely to change during intra-day). Support (1) = 8421. Support (2) = 8364. Resistance (1) = 8512. Resistance (2) = 8546.

OUTLOOK FOR TODAY: On Japanese candlestick patterns the index after having formed a Dragon fly doji (indicating indecisiveness amongst investors) has formed a white body candle on higher volumes. Further, the index has crossed above its 5 day’s moving average. The index is now above its 5, 15, 25 and 200-day’s moving average and all the four averages are rising and also positively trended. Moreover, the velocity parameters too indicate strength. All these indicate a positive bias and the possibility of a further up move unfolding. Investors are advised to hold long positions.

Work with strict stop losses on all positions

ADX Indicator & DI Lines: The +DI line is above the –DI line and both lines are diverging (positive if it continues). The ADX is flat while the Market Index is rising. No signal here.

BUY Federal Bank of India above 149, Stop Loss 144, Target 160 Federal Bank of India is displaying a positive trend and trading close to its historic highs. It is displaying a higher top higher bottomformation. It is placed above its 200-day SMA, which is its long-term moving average and is a positive sign for the stock. The RSI is placed above its average, while the KST is on the verge of moving above its average. The volume recorded is good and is placed above its 10-day SMA. It is likely to move higher and should be bought above 149 with stop loss of 144 and Target Price of 160.

BUY Havells above 313, Stop Loss 307, Target 325 Havells is displaying a positive trend and trading at its historic highs. It is displaying a higher top higher bottom formation. It is placed above its 200-day SMA. The volume recorded is good and is placed above its 10-day SMA. The KST and RSI are placed above their respective averages .It is likely to move higher and should be bought above 313 with stop loss of 307 and Target price of 325.

BUY Godrej Properties above 254, Stop Loss 249, Target 265 Godrej Properties is displaying a positive trend. It is displaying a higher top higher bottomformation. It is placed above its 200-day SMA, which is its long-term moving average and is a positive sign for the stock. The volume recorded is average and it is placed marginally below its 10-day SMA. The KST and RSI are placed above their respective averages. It is likely to move higher and it should be bought above 1137 with stop loss of 1122 and Target Price of 1170. BUY ICICI Bank above 1739, Stop Loss 1716, Target 1790 ICICI Bank is displaying a positive trend and is trading at historic highs. It is displaying a higher top higher bottom formation. It is placed above its 200-day SMA, which is its long-term moving average and is a positive sign for the stock. The volume recorded is good and it is placed above its 10-day SMA. The KST and RSI are placed above their respective averages. It is likely to move higher and it should be bought above 1739 with stop loss of 1716 and Target Price of 1790.

rom reality programmes and saasbahu soaps, prime time television has gallantly galloped into history and legendary folk-lore tales, historical period and costume dramas with historical heroes, opulent palatial sets, elaborate ornate costumes, glitzy jewellery and hi-tech action sequences into homes. "Our country continues to be religious, and mythological shows continue to have a precious place. They will always work," says Nikhil Madhok, former senior director, marketing and communications, of now defunct Imagine TV. Perhaps that's why costume dramas – whether historical, mythological or fantasy with horses, elephants etc – seem to have caught the fancy of TV producers, who are spending millions, anything between 10 and 50 per cent more than the cost of production of a regular soap, to recreate legendary stories like 'Shobhaa Somnath Ki', 'Dwarkadheesh', 'Kahani Chandrakanta Ki' and 'Jai Jai Jai Bajrangbali' which were once the toast of their channels. The recent shows include ‘Maharana Pratap’, ‘Vikram Vetal’, ‘Akbar Birbal’, ‘Jhansi Ki Rani’, ‘Har Har Mahadev’, and the only channel devoted to historical and mythological shows now recently launched as EPIC Channel premierEs with shows like ‘Dharmakshetra’, ‘Daanav’, etc. Mahabharata narrated the tale of the Kauravas and the Pandavas, their numerous personal conflicts, ethical puzzles, subplots, and dramatic twists that paved the way to the most powerful yet destructive battles (‘Kurukshetra’) of all time. But the protagonists and the antagonists have never got an opportunity to present their side of the story. All these mytho-characters have walked the thin line between just and unjust, fair and unfair, deceit and loyalty, betrayal and duty, and now must face the consequences of their actions. Several questions lie buried in the ruins of history. Of late, 'Dharmakshetra', a courtroom drama, unearths these buried questions and allows the legendary characters of Mahabharata to justify their actions for the very first

The popularity of our TV shows amazes me.

Why do you think Pakistani shows are popular in India? I think it’s because of the content, the writing, and the performances which are serious and sober and also that they are not long-winding like the Indian shows which run into hundreds of episodes. Also the culture is the same, the language is same and the tastes are same. Just as popular Hindi cinema in Pakistan has a huge following and stars like Shahrukh, Aamir and Salman are Muslim names which the Pakistani audiences can easily identify. I think the popularity began with shows like 'Ankahee' and 'Dhoop Kinare' which were very popular with Indian audiences including stars like Dilip Kumar and Amitabh Bachchan.

t is of course the special privilege of the Prime Minister – who to make a Minister and who not to make. And obviously, he will make only that person a Minister in whom he has complete trust. In the first cabinet expansion of Prime Minister Narendra Modi, some discrepancies were seen, which it is certain his associates would not have apprised him about. We want to apprise him about them because we want to see Narendra Modi become successful, and this success is not of a person named Narendra Modi, but is of the Prime Minister of the country. The Prime Minister of the country has been elected for the next 5 years and the pain or curse that the people of the country have suffered in the last 10 years – it is to be rid of it that they have trusted everything that Prime Minister Narendra Modi has said. That is why we want Narendra Modi to be successful, especially

in fulfilling those promises which he has made regarding development. Those promises which he has made regarding inflation and corruption and those promises in which he has talked about the doors opening for new hopes. Narendra Modi has given the responsibility of the most important Ministry in his Cabinet to Manohar Parikkar. Manohar Parikkar was the Chief Minister of Goa and Narendra Modi has made him Defence Minister of the country. However, in between the oath taking and the designations for the Ministries becoming known, informed sources of the Bharatiya Janata Party spread talk that Rajnath Singh may get Defence and Manohar Parikkar may get the Home Ministry. If that would have happened, then it would have been an injustice to both, because the message would have gone across that Rajnath Singh has done something really wrong because of which he was removed from the Home Ministry

and then it would have become difficult for Rajnath Singh to remain in the Cabinet, or at the very least his credibility would have ended. Rajnath Singh’s Ministry remained with him without any tinkering – this will be counted amongst the good actions of Narendra Modi. And he has given the Defense Ministry to a perfectly appropriate person, because the Defense Ministry at this time is actually going through a time of significant turmoil. I remember that the former Army Chief, General Vijay Kumar Singh, had written 11 letters to the Prime Minister of that time, Manmohan Singh, out of which three letters had been leaked by the Defence Ministry! One of those letters said that our forces don’t even have ammunition to fight a war for even three days. No mention was made in it of good weapons. The basic necessity – meaning, ammunition, that itself was not there. My information tells me that the situation is the same even today. That

is why it is necessary that the new Army Chief make plans to produce ammunition and modern weapons in the country itself. The weapons that are bought, a technology transfer deal should be done for them too and the country should be made completely self dependent in the defense sector. But why the Prime Minister changed the other Ministry – Railways, this no one could understand. He removed Sadanand Gowda from the Railways Ministry, and made him the Law Minister. But the biggest question is that a person against whose son a case of rape is going on, who is an accused, you have made him the Law Minister! This doesn’t come anywhere within the radius or frame of ethics. Similarly, why did he give the Rail Ministry to Suresh Prabhu, this also is beyond understanding, because Suresh Prabhu is quite knowledgeable about the power sector and his name itself is known in the country for doing work in the power sector.

Trouble trails Indian Forest Service (IFS) officer Sanjiv Chaturvedi wherever he goes. After his muchpublicised litany of woes in Haryana in the erstwhile Hooda sarkar, it was believed that his move to Delhi would spell the dawn of quieter times. But his stint as Chief Vigilance Officer at the All India Institute of Medical Sciences (AIIMS) was typically stormy. While the last has not been heard on his controversial transfer from AIIMS, the Union Health Ministry, which has also now, after the reshuffle, changed hands, has sunk into further trouble on the appointment of CVOs. After Vishwas Mehta’s repatriation to his home cadre, the Union Health Ministry quietly gave the charge to joint secretary Manoj Jhalani. Unfortunately, it did not inform the Chief Vigilance Commission about the move. Interestingly, it completely ignored the fact that it had removed Chaturvedi on the same ground – that his appointment (in the previous UPA Government) did not have the approval of the Vigilance Commission! Clearly, following “due process” is an arbitrary thing, depending on who the Ministry (or rather the Minister) wants to keep. Chaturvedi has clearly few well-wishers in the Ministry!

Hit by scarcity

There are gaping holes in the bureaucratic framework of Odisha, with 37 senior babus on Central deputation and as many as 50 IAS posts out of the sanctioned strength of 226 lying vacant. Little wonder that the babus who did not move out on deputation are currently struggling to cope with multiple charges. Senior IAS officer R.K. Sharma is juggling both forest and labour departments; Development Commissioner A.P. Padhi is also Additional Chief Secretary to Chief Minister Naveen Patnaik; Agriculture Secretary Rajesh Verma is overseeing the Cooperation Department, among many others. Odisha struggles with shortage of IAS officers is not new, or unique. Many other States too face this problem. Though the Patnaik Government promoted more than 50 State service officers to IAS rank in the past five years, clearly there are not enough babus to deal with the administrative challenges. Of course, someone needs to ask why the State Government is not moving fast enough on filling all those vacancies in the IAS cadre allotted to the State.

No rest for babus

The bureaucracy has faced the brunt of the changes wrought by the Narendra Modi’s sarkar. From punctuality to transparency babus across the country are beginning to discover what “achche din” truly mean. While babus in the capital have by now become accustomed to working long hours and during weekends, their compatriots in the States too may find their work life changing drastically. Apparently the Centre is mulling the idea of reintroducing the sixday work week in Government offices. The fear is real, since this is a model that already operates in Gujarat and the Modi sarkar has painstakingly introduced many processes from the State in the national capital. — Dilip Cherian

EW DELHI: Ritu Rani will lead a 18-member Indian hockey team for the fivematch Test tour of Italy to be played in Rome from December 1 to 12. The tour, seen as a preparation for the World Hockey League Round 2, was selected by Hockey India selectors Surinder Kaur, Harbinder Singh, Mamta Kharab, High Performance Director Roelant Oltmans, chief coach Neil Hawgood, and coach N S Saini, after a selection trial conducted in Bhopal on November 19 and 20. Double points finish for Force India at season-ending race

ABU DHABI: Sahara Force India ended the season on a high with Nico Hulkenberg finishing the Abu Dhabi Grand Prix in sixth position just ahead of teammate Sergio Perez. With double points on offer in the season-ending race at the majestic Yas Marina Circuit, Force India collected 28 points to finish sixth in the Constructors championship with 155 points, 26 less than fifth-placed McLaren. Last year also Force India had ended sixth but the team had scored only 77 points. In the drivers' championship, Hulkenberg finished ninth with 96 points, ahead of Perez, who scored 59 points this season. Force India has decided to retain both the drivers in the 2015 season. Last year Force India's Paul di Resta (12) and Adrian Sutil (13) had ended outside the top-10 bracket in the drivers' championship.
